Cosmopolitan theory suggests that we should shift our moral attention from the local to the global. Richard Vernon argues, however, that if we adopt cosmopolitan beliefs about justice we must re-examine our beliefs about political obligation. Far from undermining the demands of citizenship, cosmopolitanism implies more demanding political obligations than theories of the state have traditionally recognized. Using examples including humanitarian intervention, international criminal law, and international political economy, Vernon suggests we have a responsibility not to enhance risks facing other (...) societies and to assist them when their own risk-taking has failed. L'ŒIL, Observatoire d'Ethique Interculturelle de Lyon, a pour objectif de préserver la dimension éthique de notre société démocratique et pluraliste dans son approche de l'homme. De nouveaux savoirs et techniques, le dynamisme de la recherche scientifique, les forces du marché, le souci de juste allocation des ressources, ainsi que les demandes de la société, mettent les acteurs des systèmes de santé dans des situations confuses. Cet ouvrage est le premier témoignage des rencontres et des recherches décidées par ces auteurs venus (...) d'horizons divers, engagés dans l'ensemble du monde francophone à partir de Lyon où se sont tenues les Premières Journées internationales francophones d'Ethique interculturelle, en 2004. Pour les auteurs de cet ouvrage, l'humanité peut mieux se constituer en s'ouvrant sur le différent, sur le multiple. Par regards croisés, ils questionnent la place relative du progrès, abandonnant le mythe simpliste selon lequel seul le progrès techno-économique entraîne les progrès sociaux, politiques et moraux... Au contraire, ils adoptent les principes d'incertitude et de complexité. Ils s'interrogent sur l'éthique interculturelle résultant d'une interaction à géométrie variable entre nos appartenances à différents groupes humains - culturels, sociaux, professionnels... sur le bon usage de la vie qui peut présupposer d'avoir en tête un archétype de la vie humaine, une vie exprimée dans sa plénitude. Certaines cultures ont exalté le héros, le chevalier ou le saint, avant de mettre en avant l'homme engagé ou l'entrepreneur accompli. Ils partagent la conviction que l'univers, la vie en général et la vie humaine en particulier ne sont pas des réalités monolithiques, mais résultent de l'interaction entre des polarités apparemment opposées, mais complémentaires. En effet, chaque être humain résulte des relations tissées avec l'Autre, s'enrichissant personnellement à travers chacune d'entre elles, s'ouvrant ainsi progressivement à toute l'humanité dans sa diversité. Nous construisons notre singularité en fonction de notre ouverture sur l'universel. Many philosophers, in discussing supererogation, maintain that supererogatory actions must be done for the benefit of others. In this paper I argue that there can be instances of self-regarding supererogatory actions. That is, there are cases in which the primary (or sole) intended beneficiary of a supererogatory action is the agent herself, and she need not be acting out of a concern for morality or moral rules. Data are lacking with regard to participants' perspectives on return of genetic research results to relatives, including after the participant's death. This paper reports descriptive results from 3,630 survey respondents: 464 participants in a pancreatic cancer biobank, 1,439 family registry participants, and 1,727 healthy individuals. Our findings indicate that most participants would feel obligated to share their results with blood relatives while alive and would want results to be shared with relatives after their death.

In his essay On Liberty, John Stuart Mill presents the famous harm principle in the following manner: “[…] the sole end for which mankind are warranted, individually or collectively, in interfering with the liberty of action of any of their number, is self-protection. […] The only part of the conduct of anyone, for which he is amenable to society, is that which concerns others. […] Over himself, over his own body and mind, the individual is sovereign.” Hence, there is a (...) distinction between self-regarding and other-regarding acts, and only the latter are subject to moral criticism. However, while all acts are in some way selfregarding, it is not clear if there are any which are exclusively so. There are two additional difficulties. First, the “individual” may not be an individual person; self-determining communities, at least when they have the ability to decide for themselves, are also “individuals” in this sense. Second, it is claimed that groups of acts (activities and practices) have a different kind of justification from single acts. So what are the limits which “others” have in order to protect themselves from what “individuals” (personal or not) do, and what are their rights to do and to protect? If, in the final analysis, protection or defense is a source of justification, what should or must be protected, and why? Where does the demarcation line between self-regarding and other-regarding acts lie? In our age, as in Mill’s, we encounter many situations where such a line is needed, yet is hard to determine or establish. Epistemologists often assume that an agent’s epistemic goal is simply to acquire as much knowledge as possible for herself. Drawing on an analogy with ethics and other practices, I argue that being situated in an epistemic community introduces a range of epistemic virtues (and goals) which fall outside of those typically recognized by both individualistic and social epistemologists. Candidate virtues include such traits as honesty, integrity (including an unwillingness to misuse one’s status as an expert), patience, and creativity. We can (...) understand such traits to be epistemic virtues insofar as they tend to produce knowledge – not for the agent alone, but for her community. Recognition of such ‘otherregarding epistemic virtues’ both broadens the area of inquiry of epistemology, and introduces new standards for the evaluation of epistemic agents. (shrink)

Is there a successful regress argument against intellectualism? In this article I defend the negative answer. I begin by defending Stanley and Williamson's (2001) critique of the contemplation regress against Noë (2005). I then identify a new argument – the employment regress – that is designed to succeed where the contemplation regress fails, and which I take to be the most basic and plausible form of a regress argument against intellectualism. Since the early 1980’s, with the clinical advent of in vitro fertilization resulting in so-called “test tube babies,” a wide array of ethical considerations and concerns regarding artificial womb technology (AWT) have been described. Recent breakthroughs in the development of extracorporeal neonatal life support by means of AWT have reinitiated ethical interest about this topic with a sense of urgency. Most of the recent ethical literature on the topic, however, pertains not to the more imminent scenario of a physiologically improved (...) method of neonatal care through AWT, but instead to the remote scenario of “complete ectogenesis” that imagines human gestation occurring entirely outside of the womb. This scoping review of the ethical literature on AWT spans from more abstract concerns about complete ectogenesis to more immediate concerns about the soon-to-be-expected clinical life support of what we term the fetal neonate or fetonate. Within an organizing framework of different stages of human gestational development, from conception to the viable premature infant, we discuss both already identified and newly emerging ethical considerations and concerns regarding AWT and the care of the fetonate. The burgeoning science of ethics has produced a trend toward pessimism. Ordinary moral thought and action, we’re told, are profoundly influenced by arbitrary factors and ultimately driven by unreasoned feelings. This book counters the current orthodoxy on its own terms by carefully engaging with the empirical literature. The resulting view, optimistic rationalism, shows the pervasive role played by reason, and ultimately defuses sweeping debunking arguments in ethics. The science does suggest that moral knowledge and virtue don’t come easily. However, despite (...) the heavy influence of automatic and unconscious processes that have been shaped by evolutionary pressures, we needn’t reject ordinary moral psychology as fundamentally flawed or in need of serious repair. Reason can be corrupted in ethics just as in other domains, but a special pessimism about morality in particular is unwarranted. Moral judgment and motivation are fundamentally rational enterprises not beholden to the passions. (shrink)

Background Protecting the privacy of research participants is widely recognized as one of the standard ethical requirements for clinical research. It is unknown, however, how research professionals regard concepts of privacy as well as the situations in the research setting that require privacy protections. The aim of this study was to explore the views of research professionals from Arab countries regarding concepts and scope of privacy that occur in clinical research. Methods We adopted an exploratory qualitative approach by the (...) use of focus group discussions. We recruited individuals involved in research from Egypt and Morocco. We analyzed focus group data via a constant comparison approach, which consisted of close reading of the transcribed interviews followed by coding and then determining themes and subthemes. Results Between August 2016 and July 2018, we conducted nine focus group discussions. Respondents discussed several privacy issues that occurred before the research began ; during research, and after the research. Respondents revealed their perspectives of patients towards privacy in the clinical and research settings and mentioned that patients are more likely to permit access to their privacy in the clinical setting compared with research setting due to the existence of benefits and trust in clinical care. Respondents also recommended training regarding data protections for individuals involved in research. Conclusions Our study shows that research professionals discussed a range of privacy issues that are present during the different stages of research. We recommend 1) development of standards regarding privacy protections during recruitment efforts; 2) additional training for individuals involved in research regarding best practices with data security in secondary research; 3) a quantitative study involving investigators and REC members to determine their knowledge, attitudes and practices regarding privacy issues that occur in research; and 4) a quantitative study involving patients to elicit their views regarding their privacy concerns in research. Se examina la relación, ampliamente discutida, entre ética y derecho en el marco de la filosofía práctica kantiana. Para esclarecer algunas observaciones de La metafísica de las costumbres, se analiza el concepto de derecho y la distinción entre legislación ética y jurídica. Con la consideración de la libertad como derecho innato se reconstruyen diversas interpretaciones sobre la relación entre ética y derecho, para mostrar que, pese a la relación inescindible ente ambos, su especificidad no permite considerar la filosofía jurídica como (...) mera derivación de la filosofía moral. The article examines the -widely argued- relationship between ethics and right within the frame of Kant's practical philosophy. In order to clear up some observations made on The Metaphysics of Morals, the article analyzes the distinction between legal and ethical legislation. Taking into consideration freedom as an innate right, the article reconstructs various different interpretations regarding the relationship between ethics and right. This tries to show that, although the relationship in question is inseparable, its specificity does not allow to consider philosophy of law as a mere derivation of moral philosophy. (shrink)

[…] On je odgovoran društvu samo za ono svoje ponašanje koje se tiče ostalih. […] Pojedinac je neograničeni gospodar nad samim sobom, nad svojim tijelom i dušom.” Dakle, postoji razlika između postupaka koji se tiču nas samih i postupaka koji se tiču (...) ostalih, te moralnoj kritici podliježu samo postupci koji se tiču ostalih. Međutim, iako se svi postupci na neki način tiču nas samih, nije jasno postoje li bilo koji postupci koji su isključivo takvi. Postoje i dvije dodatne poteškoće. Kao prvo, ‘pojedinac’ može i ne biti pojedinačna osoba; samo-određujuće zajednice, barem kada su sposobne samostalno odlučivati, također su ‘pojedinci’ u ovome smislu. Kao drugo, tvrdi se da se klase postupaka, djelatnosti i načina postupanja opravdavaju drukčije nego pojedinačni postupci. Koje su, dakle, granice koje ‘drugi’ imaju kako bi se ‘zaštititili’ od kojih ‘pojedinaca’ te koja prava na postupanje i zaštitu oni imaju? Ako je izvor opravdanja, u konačnoj raščlambi, zaštita ili obrana, što se – i zašto – treba ili mora zaštititi? A recent discussion on cognitive enhancers has caused some controversy in the ethics and neuroscience fields by coming out in favour of making neuropharmaceuticals with enhancing properties available for general consumption. We highlight in this brief commentary why concerns regarding efficacy and safety, demands on resources, and public health are substantive enough to warrant serious reconsideration before pharmaceutical performance enhancement can be widely supported.

Numerous researchers have investigated accounting students’ levels of moral reasoning, ethical choice and judgment employing the Defining Issues Test and using its P score as an indicator of moral reasoning. Not surprisingly, a number of DIT studies report conflicting results. Moreover, despite widespread use of the DIT, there is concern that it may not adequately measure all facets of ethical judgment :1–26, 2010). Thus, we endeavor to provide insight not only into the contradictory results but also about the applicability of (...) the DIT for studying accounting students. To do so, we collect published and unpublished DIT studies employing accounting students as subjects and use meta-analysis to aggregate findings across these studies to quantify their results, examining commonly employed variables. We show significant relationships between P scores and some variables but not others. Further, our findings demonstrate that the DIT provides added insights when exploring questions of ethical choice, and ethics instruction, particularly when the instruction is embedded in an accounting course. Finally, we find that the level of DIT P scores reported in the studies relates to whether the study was published. We discuss the implications of our findings for future research. (shrink)

Many philosophers have objected to Kant’s account of duties regarding non-human nature, arguing that it does not ground adequate moral concern for non-human natural entities. However, the traditional interpretation of Kant on this issue is mistaken, because it takes him to be arguing merely that humans should abstain from animal cruelty and wanton destruction of flora solely because such actions could make one more likely to violate one’s duties to human beings. Instead, I argue, Kant’s account of duties regarding nature (...) grounds much stronger limitations on how humans may treat non-human animals and flora, since such duties are rooted in the imperfect duty to increase one’s own moral perfection. This duty proscribes actions affecting non-human nature that decrease one’s moral perfection, such as those that cause organisms unnecessary harm. Moreover, the duty to moral perfection prescribes (but does not strictly require) actions affecting non-human nature that increase one’s moral perfection, such as those that benefit organisms. Given this interpretation, I show that, contrary to a widely held view, Kant’s moral philosophy can ground a coherent and robust approach to environmental ethics. (shrink)

I borrow part of the title of my paper from Susan Sontag. In 2003, a year before her death, Susan Sontag published an essay entitled Regarding the Pain of Others. There she takes up the subject of the moral significance of presenting the views of war, violent human death exposed to the lenses of cameras. Her approach to the contemporary issue of mediatisation through the image of the sight of human suffering provokes a question: Do we need teleethics today, the (...) ethics of remote moral relations? Using the method of comparative analysis in the area of cultural determinants of ethics, I draw attention to the contemporary challenges that the culture of late modernity imposes on the morality of everyday life. My thesis is this: The images of human suffering provided by the media reveal the imperfection of our morality. As moral subjects, we are not prepared to respond to the suffering of human beings absent from face-to-face relationships. So, we need teleethics. The paper is devoted to this issue. (shrink)

This article analyses jurisdiction regarding administrative proceedings (lawsuits) in Jordan and France. Moreover, it also discusses the fact that jurisdiction regulates two matters of the utmost importance: the distribution of jurisdiction between ordinary and administrative jurisdictions and the distribution of jurisdiction between administrative jurisdictions themselves in States whose jurisdiction in administrative proceedings is distributed to more than one administrative organ. Moving on, this research was conducted using several research approaches such as, the comparative and analytical approach. The research concluded with (...) a number of conclusions and recommendations, the most important of which was the establishment of an Administrative Proceedings Management Service (APMS), as did the French Administrative Judicial Code, in which attendance was compulsory. To add on, the office of the Administrative Proceedings Administration must have a judge of its own, which corresponds to the post of the judge in the French Administrative Court. The judge will handle the completion of the data regarding both lawsuit parties, and request the documents needed for the case at hand. With that being said, the Jordanian Constitutional Court must reverse its interpretative decision, stating that the administrative justice is part of the ordinary judiciary—in referral to The Constitutional Court’s interpretation of the provisions of the Constitution, which considered the administrative judiciary as an integral part of the ordinary judiciary. Lastly, the research concluded that The French Administrative Judiciary must be taken into consideration regarding the establishment of an administrative judiciary independent from all aspects of the ordinary judiciary, and the explicit introduction of the dual judicial system. This essay introduces the second of three installments of an “elegiac symposium” in Common Knowledge on figures and concepts devalued in what Thomas Kuhn refers to as “paradigm shifts.” The essay suggests that Kuhn’s idea is provincial, in three specified senses, and then goes on to show how differently Japanese culture regards and manages major change. The author of this introduction, who is also the journal’s editor, begins by evaluating a triptych of 1895 by Toshikata as a response to the (...) seemingly revolutionary changes brought by the Meiji Restoration a generation before. He then goes on to discuss, as exemplary of Japanese attitudes toward change, the Shinto ritual during which the sacred shrines of Ise Jingū are torn down and rebuilt every twenty years. The essay concludes by explaining how the impetus for this ritual is also involved in less-exalted aspects of Japanese culture; for example, in the peculiarities of the market for ukiyo-e woodblock prints. Overall, this essay shows that Japanese ways of regarding concepts such as “old” and “new,” “continuity” and “change,” differ so radically from those presupposed in the West that the latter should be regarded as provincial rather than as universally valid. In this book, Toby Svoboda develops and defends a Kantian environmental virtue ethic, challenging the widely-held view that Kant's moral philosophy takes an instrumental view toward nature and animals and has little to offer environmental ethics. On the contrary, Svoboda posits that there is good moral reason to care about non-human organisms in their own right and to value their flourishing independently of human interests, since doing so is constitutive of certain virtues. Svoboda argues that Kant’s account of indirect duties (...) regarding nature can ground a compelling environmental ethic: the Kantian duty to develop morally virtuous dispositions strictly proscribes unnecessarily harming organisms, and Svoboda argues that this duty compels us to act in ways that benefit non-human organisms, given that doing so can enhance one’s virtues. Svoboda’s argument engages the recent literature on environmental virtue and provides an original argument for an environmental virtue ethic firmly rooted in Kant’s moral philosophy. (shrink)

Recent work in environmental ethics has seen a pragmatic turn that emphasises the importance of developing positive relationships with nature through practices involved in, for example, ecological restoration and community gardens. This article explores whether environmental and land art-making encourages positive aesthetic-moral relationships between nature and humans. It critically examines a particular type of aesthetic objection to these kinds of artworks and defends the work of Robert Smithson and Andy Goldsworthy, among others, against this charge. It is argued that rather (...) than constituting an 'aesthetic affront' to nature, some forms of environmental and land art show 'aesthetic regard' for nature. (shrink)

The category “other-regarding preferences” is a catch-all phrase based on a self/other dichotomy. While the self/other might be useful when the motive is self-interest or altruism, it fails when the motive involves bonding. This article identifies three motives that involve bonding: i) the preferences regarding friendship and community; ii) the preferences that amalgamate communal bonding with self-interest; and iii) the preferences for distinction and status. These three types of preferences unify the self and other—usually aided by ceremonies of gift exchange (...) and celebratory prizes. This article offers a more complete taxonomy of preferences and, corollary, structures of exchange. (shrink)

A better appreciation of Kant’s commitments in a variety of disciplines reveals Kant had a deeper understanding of human and non-human animals than generally recognized, and this sheds new light on Kant’s claims about the nature and scope of moral status and helps to address, at least from Kant’s perspective, many of the familiar objections to his notorious account of “duties regarding animals.” Kant’s core principles about the nature of moral obligation structure his thoughts about the moral status of human (...) beings and non-human animals. Kant’s commitments in biology, psychology, anthropology and physical geography support his account of the nature of and distinction between humans and non-human animals. This account supports Kant’s judgment that we have duties to every human being and significant duties regarding non-human animals, duties which involve direct concern for animals because of their nature. A comparison of Kant’s account with some recently proposed Kantian alternatives provides additional perspective on some of the distinctive features, and strengths and weaknesses, of Kant’s approach. This essay is concerned with the complex relationships between falsafa and kalām. As regards the history of the latter, it has been generally agreed that al-Juwaynī played a decisive role at a moment when Avicennism became intrusive. It is mainly in his al-ʿAqīda al-niẓāmiyya that al-Juwaynī initiated a doctrinal and methodic evolution of Ashʿarism. One necessarily invokes here Ibn Rushd, who, by exposing the dogmas in their literal manifestation in his al-Kashf ʿan manāhij al-adilla fī ʿaqāʾid al-milla, actually sought to (...) operate a systematic refutation of the Ashʿarites' theses. It should be noted, however, that, despite his critical distance, Ibn Rushd nonetheless remained attentive to al-Juwaynī's evolutionary study. In this contribution, some aspects of the major issues in kalām will be examined: the existence of God and the argument of takhṣīṣ, His unicity and the argument of mumānaʿa, as well as human agency with the acknowledgement of man's capacity and its role. Albeit limited in scope, the essay attempts to make a more profound evaluation of al-Juwaynī's role at a crucial moment of the history of kalām in its specific development during which the Great Masters have not always been faithful to the classical tenets of their school, but also in its relations with falsafa and its influence on al-Juwaynī, and then and mainly on his disciple al-Ghazālī's theological thought.Le présent travail concerne les rapports complexes qui ont existé entre la falsafa et le kalām. Pour l'histoire propre de ce dernier, l'on s'accorde sur le rôle de premier ordre joué par al-Juwaynī à un moment décisif où l'avicennisme devenait envahissant. The aim of this essay is to demonstrate three main points: that many of the widespread appeals made to conscience in the time of COVID display little understanding of conscience’s fundamental nature; that they assume for conscience a sacrosanct status it does not possess; and that because of the first two points, conversation regarding conscience and COVID has generated considerable confusion. In support of these points, this paper shows what conscience is, employs St. John of the Cross’s examination of attachments (...) to suggest that possession of a well-formed conscience is frequently a most difficult achievement, and examines various expressions associated with the COVID debate to illustrate how much of the conversation has stemmed from or resulted in little real understanding. Recent instances of corporate misconduct and examples of blatant leader self-serving behavior have rekindled interest in leader personality traits as antecedents of negative leader behavior. The current research builds upon that work, and examines the relationship between leader psychopathy and leader self-serving behavior. Moreover, we investigate whether follower self-esteem affects the occurrence of self-serving behavior in leaders with psychopathic tendencies. We predict that self-serving behaviors by psychopathic leaders are more likely to occur in the interaction with followers low in self-esteem. (...) We first conducted an experimental study (N = 156), in which we manipulated follower self-esteem, measured leader psychopathy, and assessed their combined effect on leader self-serving behavior using an ultimatum game. We then conducted a multi-source field study (N = 124 leader-follower dyads) using questionnaires to assess leader psychopathy, follower self-esteem, and perceived leader self-serving behavior. Across both studies, we found that leader psychopathy was positively related to their self-serving behavior, but only when followers had low rather than high self-esteem. As expected, our studies showed that the degree to which (perceived) psychopathic traits of leaders are reflected in their behavior depends on the characteristics of their followers. Apparently, the behavioral expression of negative leader traits is not only a matter of the trait strength, but instead is the result of the interplay between leader and follower in a certain context. Background: Despite the expansion of ethics consultation services, questions remain about the aims of clinical ethics consultation, its methods and the expertise of those who provide such services.Objective: To describe physicians’ expectations regarding the training and skills necessary for ethics consultants to contribute effectively to the care of patients in intensive care unit .Design: Mailed survey.Participants: Physicians responsible for the care of at least 10 patients in ICU over a 6-month period at a 921-bed private teaching hospital with an established (...) ethics consultation service. 69 of 92 eligible physicians responded.Measurements: Importance of specialised knowledge and skills for ethics consultants contributing to the care of patients in ICU; need for advanced disciplinary training; expectations regarding formal-training programmes for ethics consultants.Results: Expertise in ethics was described most often as important for ethics consultants taking part in the care of patients in ICU, compared with expertise in law , religious traditions , medicine and conflict-mediation techniques . When asked about the formal training consultants should possess, however, physicians involved in the care of patients in ICU most often identified advanced medical training as important.Conclusions: Although many physicians caring for patients in ICU believe ethics consultants must possess non-medical expertise in ethics and law if they are to contribute effectively to patient care, these physicians place a very high value on medical training as well, suggesting a “medicine plus one” view of the training of an ideal ethics consultant. As ethics consultation services expand, clear expectations regarding the training of ethics consultants should be established. (shrink)
