How skeptical objections play a part in transcendental foundation The grounding task of a transcendental pragmatics according to K. O. Apel My subject is the contemporary attempts, and more precisely K. O. Apel's, that aim at the refoundation (...) of rationality within a communicational framework. 1 I want to show that this task, insofar as it aims at being radical, insofar as it is "transcendental pragmatics," is the target of criticisms that a skepticism always raises against the doctrines purporting to be built upon a foundation wholly devoid of presupposition. 2 It so happens that Apel's doctrine—in a manner more systematic than that of F. Jacques or Habermas—makes explicit the conditions of its own constitution. It does so through the overthrow of skeptical objections that aim at a refutation of its radical attempt at a transcendental foundation: in Apel's eyes, the objection of the relativist or of the skeptic, because it contains an inner contradiction (a "performative self-contradiction") a contrario ensures the absolute validity of his universal pragmatic principle. If this use of skepticism constitutes the spring of the argumentation and the cornerstone of the systematic edifice Apel built, a skeptical overthrow of his overthrow will demonstrate the fragile and unsteady nature of its transcendental ambitions. It will then become impossible to associate the communicative activity with a horizon of ethical presuppositions that guarantee the success of discussion and of negotiation. It is the legitimacy of this foundationalism that we propose to contest in order to undermine transcendental theories of discourse ethics.And yet, without reverting to a sociological empiricism or having recourse to a philosophy of intersubjectivity, by showing that philosophical skepticism is not as naive as its critiques would have it, the ethical [End Page 301] orientation of communicative activity can be suspended without giving up the quest for consensus. The latter is not originary; it is not presupposed by a speech act that is ethically neutral at its structural level, but it can at best be derived as can its contrary, disagreement. Thus, against the inflation of transcendental pragmatics, I shall oppose an ethical minimalism. The grounding device of transcendental pragmatics On the one hand, how is one to undertake a founding task without anchoring it in a philosophy of consciousness? On the other hand, how is one to protect oneself from the relativistic consequences of an empirical approach of intersubjectivity? Apel's aim is to show that communicative activity presupposes an a priori that is neither a social nor a linguistic fact but factum rationis in the sense that freedom is the condition of the possibility of moral experience in Kant. Thus, according to K. O. Apel, "it appears that even purely semantic-referential discourse presupposes a pragmatic-transcendental reflection on the communicative speech-acts' claim to validity" (Apel 1994, 54). In the same book, the author relies on the model that makes language into a mere tool of communication and of representation, the Aristotelian view of language as propositional understanding: "Among the historical effects of the Aristotelian understanding there is, to some extent, the Western concept of the common sense of language as a tool for communication and representation" (54). Habermas and Apel are examples of philosophers who do not think of the dialogic as subordinate to the monologic, an approach (...) to reflexive consciousness inherited from Cartesianism; they also invest it with a constitutive dimension when they demonstrate its foundational role in knowledge and ethics. In their eyes, dialogue does not so much constitute ordinary human activity as create the conditions of its possibility. Thus with Apel this pragmatic dimension becomes transcendental, a dimension logically independent of the social or historical circumstances within which it is brought to bear, and one that is capable of playing the role of ideal regulator in the establishment of any community that is authentically human.My aim in this paper is to investigate the role that this dialogic dimension plays in philosophical discourse. If it is constitutive, and not derived, as Habermas and Apel claim, then it should be found at work in the history of philosophy. Indeed a number of philosophers and historians of philosophy have recently claimed an implicit dialogicity at the core of Descartes's Meditations, although these are actually presented in the form of a soliloquy (cf. Jacques 1979; Beyssade and Marion 1994; Bouvier 1996). But while it is true that every philosophy exhibits interdiscursive and intertextual dimensions even at the moment that it attempts to efface all traces of this interplay to present itself as a closed system, may we not question this dialogical property as constitutive of philosophical discourse as such? Philosophers who present their doctrines in the form of dialogues often use this form merely for the purposes of polemic, refutation, or instruction. There is, however, one famous exception: Plato, whose philosophy [End Page 48] is developed for the most part through a series of fictional dialogues, to which his talent gives an intrinsic "literary" quality. We thus have a case in which we can justifiably examine the philosophical value of the dialogue form. Historians of philosophy usually claim that the elements of his dialogues are no more than expressions of an underlying and constitutive dialectical dimension, though there is some dissent. 2 But I shall show that all of the elements of the dialogues, even the prologues and the settings, play a role that is intrinsically philosophical. Studying these elements will enable us to reveal the philosophical status of the dialogical dimension.I shall consider three hypotheses: (1) Though Plato's dialogues are literary rather than actual, their form cannot be reduced to the empty shell for an otherwise purely monological thought; there is an effective dialogism at work in both the early and the later Dialogues. This statement can be more easily accepted if it is recalled that philosophical activity for Plato consists of dialegsthai (Dixsaut 1985). 3 (2) In Plato, in effect, dialogue constitutes philosophical speech itself. The link between dialogue as a way of embodying doctrine and dialectics as an expression of the process of thought is intrinsic and necessary. Parmi les philosophies qui tentent de faire face à la crise de la rationalité, certaines, plus radicales que d’autres, en proposent une fondation reposant sur des principes qui se veulent exempts de toute présupposition. Ainsi K. O. Apel entend opérer une refondation de la rationalité éthique et cognitive en considérant les activités communicationnelles et argumentatives. Il s’agit d’élaborer une «pragmatique transcendantale» dont le processus d’étayage auto-réflexif s’appuie sur la «contradiction pragmatique» dans laquelle tombent ses éventuels contradicteurs. Une telle prétention n’est-elle (...) pas exorbitante ? Les sceptiques grecs ont élaboré une approche pragmatique du sens qui leur permet d’éviter la disqualification de leur énonciation, ce qui permet, en transposant leurs conceptions à la lumière des théories contemporaines du langage, d’échapper à la critique de Apel. On the one hand, it investigates the struggles for wages for housework in order to highlight the critique of the processes of female subjectification that take place within the house walls. Haeusermann et al. (Citation2023) draw three overall conclusions from their study on closed loop neuromodulation and self-perception in clinical treatment of refractory epilepsy. The first is that closed-loop neuromodulation devices did not substantially change epileptic patient’s personalities or self-perception postoperatively. The second is that some patients and caregivers attributed observed changes in personality and self-perception to the epilepsy itself and not to the DBS treatments. The third is that the devices provided participants with novel ways to make sense of their (...) illness. These findings further demonstrate a misalignment between some neuroethicists’ concerns about putative postoperative changes to personality, and the empirical evidence for such changes. Haeusermann et al. nonetheless concede that “neurotechnology directed at persisting rather than episodic clinical phenomena could have greater implications for personality or self-perception, either because they operate more continuously or are directed at clinical phenomena that are more stably integrated into patients’ self-concepts” (41). We acknowledge that the hypothesis that participants did not report changes because they were only episodically and not continually stimulated offers an interesting line for future investigation. Nonetheless, we would like to propose that potential postoperative personality changes might be correlated with the pathophysiology itself, rather than the stimulation effects of the technology. Generally, we advance the view that unintended effects solely induced by the technology cannot be excluded per se. Regardless, this comment aims to highlight that ethicists’ starting premise should be that patients suffering from diverse pathophysiology, or patients who are treated with stimulation in different brain regions and with differing parameters, would likely not react in the same way to treatment. We argue that a fashionable interpretation of the theory of natural selection as a claim exclusively about populations is mistaken. The interpretation rests on adopting an analysis of fitness as a probabilistic propensity which cannot be substantiated, draws parallels with thermodynamics which are without foundations, and fails to do justice to the fundamental distinction between drift and selection. This distinction requires a notion of fitness as a pairwise comparison between individuals taken two at a time, and so vitiates the interpretation (...) of the theory as one about populations exclusively. The idea that deep brain stimulation (DBS) induces changes to personality, identity, agency, authenticity, autonomy and self (PIAAAS) is so deeply entrenched within neuroethics discourses that it has become an unchallenged narrative. In this article, we critically assess evidence about putative effects of DBS on PIAAAS. We conducted a literature review of more than 1535 articles to investigate the prevalence of scientific evidence regarding these potential DBS-induced changes. While we observed an increase in the number of publications in theoretical neuroethics (...) that mention putative DBS-induced changes to patients’ postoperative PIAAAS, we found a critical lack of primary empirical studies corroborating these claims. Our findings strongly suggest that the theoretical neuroethics debate on putative effects of DBS relies on very limited empirical evidence and is, instead, reliant on unsubstantiated speculative assumptions probablyin lieuof robust evidence. As such, this may reflect the likelihood of a speculative neuroethics bubble that may need to be deflated. Nevertheless, despite the low number of first-hand primary studies and large number of marginal and single case reports, potential postoperative DBS changes experienced by patients remain a critical ethical concern. We recommend further empirical research in order to enhance theoretical neuroethics work in the area. In particular, we call for the development of better instruments capable of capturing potential postoperative variations of PIAAAS. (shrink)

The phenomenological effects of deep brain stimulation (DBS) on the self of the patient remains poorly understood and under described in the literature, despite growing evidence that a significant number of patients experience postoperative neuropsychiatric changes. To address this lack of phenomenological evidence, we conducted in-depth, semistructured interviews with 17 patients with Parkinson's disease who had undergone DBS. Exploring the subjective character specific to patients' experience of being implanted gives empirical and conceptual understanding of the potential phenomenon of DBS-induced self-estrangement. (...) Our study concluded that (1) the more patients preoperatively felt alienated by their illness, the more they experienced postoperative self-estrangement, and (2) the notion of self-estrangement seems to exist in association with certain common qualitative characters, namely, loss of control, which reflects a deteriorative estrangement, and distorted perception of capacities, which reveals a restorative estrangement. These findings indicate that subjective self-reports help us to understand some aspects of the potential phenomenon of DBS-induced self-estrangement. (shrink)

One important concern regarding implantable Brain Computer Interfaces is the fear that the intervention will negatively change a patient’s sense of identity or agency. In particular, there is concern that the user will be psychologically worse-off following treatment despite postoperative functional improvements. Clinical observations from similar implantable brain technologies, such as deep brain stimulation, show a small but significant proportion of patients report feelings of strangeness or difficulty adjusting to a new concept of themselves characterized by a maladaptive je ne (...) sais quoi despite clear motor improvement. Despite the growing number of cases in the DBS literature, there is currently no accepted or standardized tool in neuroethics specifically designed to capture the phenomenological postoperative experience of patients implanted with DBS or BCI devices. Given potential risks of postoperative maladaptation, it is important for the field of neuroethics to develop a qualitative instrument that can serve as a shared method for capturing postoperative variations in patient experience of identity and agency. The goal of this article is to introduce an instrument we have developed for this purpose and call for further neuroethical efforts to assess the phenomenology of implantable brain device use. Building upon a non-standard understanding of evolutionary process focusing on variation and persistence, I will argue that communities and ecosystems can evolve by natural selection as emergent individuals. Evolutionary biology has relied ever increasingly on the modeling of population dynamics. Most have taken for granted that we all agree on what is a population. Recent work has reexamined this perceived consensus. I will argue that there are good reasons to restrict the term “population” to collections of monophyletically related replicators and (...) interactors, which explains why many existing models in population biology exclude by definition many genuine evolving biological individuals such as communities and ecosystems. By studying a case of community evolution, we will see that it is variation that is important to evolutionary processes, not populations. Variation within a population is only one of many types of variation that can lead to evolution by natural selection. The upshot of focusing on variation is that cases of community and ecosystem adaptive change become tractable in evolutionary terms. I will show that complex emergent individuals such as communities and ecosystems cannot be fully accommodated by conventional population/reproduction models but can be accommodated by variation/persistence models. Ecological fitness has been suggested to provide a unifying definition of fitness. However, a metric for this notion of fitness was in most cases unavailable except by proxy with differential reproductive success. In this article, I show how differential persistence of lineages can be used as a way to assess ecological fitness. This view is inspired by a better understanding of the evolution of some clonal plants, colonial organisms, and ecosystems. Differential persistence shows the limitation of an ensemblist noncausal understanding (...) of evolution. Following Wallace’s suggestion, Darwin framed his theory using Spencer’s expression “survival of the fittest”. Since then, fitness occupies a significant place in the conventional understanding of Darwinism, even though the explicit meaning of the term ‘fitness’ is rarely stated. In this paper I examine some of the different roles that fitness has played in the development of the theory. Whereas the meaning of fitness was originally understood in ecological terms, it took a statistical turn in terms of reproductive success throughout (...) the 20th Century. This has lead to the ever-increasing importance of sexually reproducing organisms and the populations they compose in evolutionary explanations. I will argue that, moving forward, evolutionary theory should look back at its ecological roots in order to be more inclusive in the type of systems it examines. Many biological systems can only be satisfactorily accounted for by offering a non-reproductive account of fitness. This argument will be made by examining biological systems with very small or transient population structures. I argue this has significant consequences for how we define Darwinism, increasing the significance of survival over that of reproduction. (shrink)

Geron recently announced that it had begun enrolling patients in the world's first-in-human clinical trial involving cells derived from human embryonic stem cells (hESCs). This trial raises important questions regarding the future of hESC-based therapies, especially in spinal cord injury (SCI) patients. We address some safety and efficacy concerns with this research, as well as the ethics of fair subject selection. We consider other populations that might be better for this research: chronic complete SCI patients for a safety trial, subacute (...) incomplete SCI patients for an efficacy trial, and perhaps primary progressive multiple sclerosis (MS) patients for a combined safety and efficacy trial. E. O. Wilson (1974: 54) describes the problem that social organisms pose: “On what bases do we distinguish the extremely modified members of an invertebrate colony from the organs of a metazoan animal?” This framing of the issue has inspired many to look more closely at how groups of organisms form and behave as emergent individuals. The possible existence of “superorganisms” test our best intuitions about what can count and act as genuine biological individuals and how we should study them. (...) As we will discuss, colonies of certain organisms display many of the properties that we usually reserve only to individual organisms. Although there is good reason to believe that many social insects form genuine emergent biological individuals, the conclusion offered here is of a slightly different sort. I will argue that to understand some social insects' interactions and the emergent traits they give rise to, it may be helpful to shift our understanding from a community-level approach to an ecosystem-level approach. I will argue that viewing certain insect colonies (termites) as parts of ecosystems allows us to better understand some of the adaptations that have emerged from their evolution. (shrink)

Why and how do norms emerge? Which norms emerge and why these ones in particular? Such questions belong to the ‘problem of the emergence of norms’, which consists of an inquiry into the production of norms in social collectives. I address this question through the ethnographic study of the emergence of ‘norms against violence’ in the political collective Occupy Geneva. I do this, first, empirically, with the analysis of my field observations; and, second, theoretically, by discussing my findings. In consequence (...) of two episodes categorized as sexual assaults that occurred in their camp, the members of Occupy Geneva decided to tackle those issues in a general assembly. Their goal was to amend their first charter of good conduct in order to reform its norms and complete it with norms aiming to regulate ‘facts’ of ‘unjustified violence’. During a collective deliberation, new norms were devised, debated and consensually adopted. The writing of the new charter took place in a second general assembly during which the wording of the written norms was collectively decided. I show that indignation over the sexual assaults was the main motive that led to the collective deliberation, and that the entire process of the making of these norms was characterized by different collective emotions. Indeed, indignation, contempt and fear played major roles in the emergence of norms prohibiting violence, allowing punishment and exclusion of wrongdoers, and prescribing collective intervention against an aggressor to neutralize the threat represented. These findings prompt me to hypothesize that social norms emerge from emotions thanks to the latters’ internal structure; and that emotions provide causal and grounding explanations for this emergence. Thus, emotions allow us to answer the questions: ‘Why do norms emerge?’ and ‘Why do they have their specific forms?’ In short, I argue that social norms have emotional foundations. (shrink)

Cet article s’intéresse au problème de la maintenance, c’est-à-dire au moment où les membres d’un collectif social tentent d’assurer dans le temps l’existence de leur collectif en instituant des règles pour réguler leurs comportements. Ce problème se pose avec acuité lorsque certains membres ne respectent pas ces règles communes. Pour maintenir la coopération sociale, les membres peuvent décider d’instituer des règles secondaires visant à sanctionner les transgressions des règles primaires déjà établies. La maintenance d’un collectif peut ainsi reposer sur l’émergence (...) de pouvoirs déontiques qui donnent aux membres l’autorité de légitimement punir et expulser les transgresseurs. Mais d’où viennent ces règles ? On peut penser qu’elles émergent des émotions éprouvées par les membres envers les transgresseurs. Je le démontre à l’aide d’une étude de cas qui établit que, dans le collectif Occupy Geneva, l’institutionnalisation de normes pour punir, exclure et réintégrer les déviants s’ancraient respectivement dans l’indignation, le mépris et le pardon. -/- This article focuses on the problem of maintenance; that is the moment when the members of a social collective attempt to ensure the existence of their collective over time by instituting rules to regulate their behavior. This problem becomes critical when certain members do not respect the common rules. To maintain social cooperation, members can decide to institute secondary rules aimed at sanctioning the transgressions of the already established primary rules. The maintenance of a collective can thus rely on the emergence of deontic powers that give members the authority to legitimately punish and expel transgressors. But where do these rules come from? The hypothesis is that they emerge from the emotions felt by the members towards the transgressors. I show this with the help of a case study, which establishes that the institutionalization of norms allowing the punishment, the exclusion, and the reintegration of deviants within the “Occupy Geneva” collective, was grounded in indignation, contempt, and forgiveness respectively.
