This article re-conceptualises the ‘constitutive outside’ through Roberto Esposito’s theory of immunity to detach it from Laclau and Mouffe’s political antagonism. It identifies Esposito’s thought as an innovative epistemological perspective to dissolve post-ontological political theories of community from the intertwinement with a foundational self/other dialectic. Esposito shows how a community can sustain its relations through introversive immunisation against a primarily undefined outside. But it is argued that his theory of immunity slips back to a vitalist depth ontology which ultimately de-politicises (...) the construction of the communal outside. This article draws on Niklas Luhmann’s immunity theory to resituate immunisation in the political production of social connectivity. Following Luhmann, politics relies on immunisation through contradictions to reproduce its functional role as a decision-making institution, but is at the same time constantly exposed to potential rupture through the political openness immunity introduces. Through Esposito and Luhmann, this article identifies the relationship between a social inside and its outside as open-ended and secondary to an introversive process of socio-political self-differentiation. It can involve, but does epistemologically necessitate, the construction of an external other. (shrink)

The Politics of Orientation provides the first substantial exploration of a surprising theoretical kinship and its rich political implications, between Gilles Deleuze's philosophy and the sociological systems theory of Niklas Luhmann. Through their shared theories of sense, Hannah Richter draws out how the works of Luhmann and Deleuze complement each other in creating worlds where chaos is the norm and order the unlikely and yet remarkably stable exception. From the encounter between Deleuze and Luhmann, Richter develops a (...) novel take on postfoundational ontology where subjects and societies unfold in self-productive relations of sense against a background of complexity. This article examines Gilles Deleuze’s and Giorgio Agamben’s thoughts on the immanent creativity emergent from formal, impersonal life as a pathway for resistance to biopolitics. In Coldness and Cruelty, Deleuze explores masochism as the inversion of the sadistic, biopolitical use of the body which can bring forth genuinely new expressions. Agamben dismisses masochistic creativity because it leaves the dialectical ontology of biopower intact to conceptualize his form-of-life as a space of indiscernibility between ontological essence and legal-political actualization. For Agamben, the (...) form-of-life escapes biopolitical capture because it is absolutely detached from its relations. This article argues that the radicalness of this detachment calls into question the political capacity offered by the form-of-life to actively change the relations of biopower. Against this background, Deleuze’s masochistic eroticization of power offers an alternative conceptualization of relationality as external to its terms and productive of expressions which are both thoroughly immanent and genuinely creative. Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, (...) and misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. At the heart of this book is a profound ethical investigation, “Some Questions of Moral Philosophy”; in it Arendt confronts the inadequacy of traditional moral “truths” as standards to judge what we are capable of doing, and she examines anew our ability to distinguish good from evil and right from wrong. We see how Arendt comes to understand that alongside the radical evil she had addressed in earlier analyses of totalitarianism, there exists a more pernicious evil, independent of political ideology, whose execution is limitless when the perpetrator feels no remorse and can forget his acts as soon as they are committed. Responsibility and Judgment is an essential work for understanding Arendt’s conception of morality; it is also an indispensable investigation into some of the most troubling and important issues of our time. Philosophers ask just whose expression, if anyone’s, we hear in lyric poetry. Walton provides a novel possibility: it’s the reader who “uses” the poem (just as a speech giver uses a speech) who makes the language expressive. But worries arise once we consider poems in particular social or political settings, those which require a strong self-other distinction, or those with expressions that should not be disassociated from the subjects whose experience they draw from. One way to meet this challenge is (...) to consider the poem expressive of a plural subject, which frees us from looking for a particular individual whose voice we hear in the work, whether she be fictional or actual. Some lyrics give voice to a group whose experience is attended to in the work. This may be done through a posited fictional speaker, but the ontology of the speaker is shown to be less important. Attending to a group whose concerns are voiced allows us to explain how poems can manage to address our-worldly concerns even when lacking actual persons whose expressions we encounter in the poems. Gerhard Richter's groundbreaking study argues that the concept of "afterness" is a key figure in the thought and aesthetics of modernity. It pursues questions such as: What does it mean for something to "follow" something else? Does that which follows mark a clear break with what came before it, or does it in fact tacitly perpetuate its predecessor as a consequence of its inevitable indebtedness to the terms and conditions of that from which it claims to have departed? Indeed, (...) is not the very act of breaking with, and then following upon, a way of retroactively constructing and fortifying that from which the break that set the movement of following into motion had occurred? The book explores the concept and movement of afterness as a privileged yet uncanny category through close readings of writers such as Kant, Kafka, Heidegger, Bloch, Benjamin, Brecht, Adorno, Arendt, Lyotard, and Derrida. It shows how the vexed concepts of afterness, following, and coming after shed new light on a constellation of modern preoccupations, including personal and cultural memory, translation, photography, hope, and the historical and conceptual specificity of what has been termed "after Auschwitz." The study's various analyses—across a heterogeneous collection of modern writers and thinkers, diverse historical moments of articulation, and a range of media—conspire to illuminate Lyotard's apodictic statement that "after philosophy comes philosophy. But it has been altered by the 'after.'" As Richter's intricate study demonstrates, much hinges on our interpretation of the "after." Recent work on blameworthiness has prominently featured discussions of guilt. The philosophers who develop guilt-based views of blameworthiness do an excellent job of attending to the evaluative and affective features of feeling guilty. However, these philosophers have been less attentive to guilt’s characteristic action tendencies and the role admissions of guilt play in our blaming practices. This paper focuses on the nature of guilty confession and argues that it illuminates an important function of blame that has been overlooked in the (...) recent work on guilt as it relates to blameworthiness: Blame can communicate respect. Although Walter Benjamin's writings are considered to be among the most powerful theoretical enterprises of the twentieth century, his ideas are resistant to cooptation by the doctrines of various critical programs. Mental health professionals who care for asylum seekers in Western European countries increasingly encounter problems for which standard diagnostic and therapeutic protocols and institutional healthcare policies offer no ready answers. In the following case vignettes some of these problems can be identified.

Gegen das Streben der Moderne nach Widerspruchsfreiheit, Ordnung und Einheit aktiviert die Postmoderne die Begriffe Differenz, Widerstreit und Ambivalenz. Dieser Wandel lat auch die Bildungsphilosophie nicht unberuhrt. In diesem Buch wird untersucht, welche Auswirkungen postmoderne Ideen auf Bildungsphilosophie und -praxis haben konnen. Im Zentrum der Auseinandersetzung steht die Kritik an der modernen Identitats- und Subjektkategorie und der Versuch, diese aus postmoderner Sicht neu zu bestimmen und gewinnbringend auf die Erwachsenenbildung zu beziehen.

The present volume brings Arendt's notes for these lectures together with other of her texts on the topic of judging and provides important clues to the likely direction of Arendt's thinking in this area.

Rule-following is a normative doing and therefore needs to be reconsidered in a metaethical framework. Rule-following will be discussed in the light of cognitivism and non-cognitivism. It will be shown that neither cognitivism nor non-cognitivism are sufficiently good accounts for conceptualizing rule-following, because they are held captive by a quasi-mechanistical picture of rule-following. This idea stems from Stanley Cavell´s and John McDowell´s approach to rule-following. McDowell appeals to the idea that we participate in “shared forms of life” and therefore are (...) able to follow rules correctly. I believe that his quietist view can be amplified by conceptualizing different modes of following a rule. We can also follow a rule e.g. ironically and still grasp the conceptual content of the rule adequately. (shrink)

Theodor W. Adorno's multifaceted work has exerted a profound impact on far-ranging discourses and critical practices in late modernity. His analysis of the fate of art following its alleged end, of ethical imperatives "after Auschwitz," of the negative dialectic of myth and freedom from superstition, of the manipulation of consciousness by the unequal siblings of fascism and the culture industry, and of the narrowly-conceived concept of reason that has given rise to an unprecedented exploitation of nature and needless human suffering, (...) all speak to central concerns of our time. The essays collected here analyze the full range of implications emanating from Adorno's demand that the task of critical thinking be to imagine a mode of being in the world that occurs in and through a language that has liberated itself from the spell of an alleged historical and political inevitability, what he once tellingly called a "language without soil." Adorno' s finely chiseled sentences perform a ceaseless gesture of thoughtful vigilance, a vigilance understood not in the sense of moralizing or ethical normativity but of a rigorous attention to the presuppositions of thinking itself. The volume's fresh readings conspire to yield a refractory and unorthodox Adorno, a suggestive and at times infuriating thinker of the first order, whose intellectual gestures sponsor politically conscious modes of theoretical speculation in a late modernity that may still have a future because its language and aspirations are without soil. I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

The study discusses the wooing of Agariste which was proclaimed at Olympia by Kleisthenes, the tyrant of Sicyon, inviting everybody who thought himself worthy to be his son-in-law. At the final banquet his favorite, Hippokleides, danced away his marriage by acting out a bizarre dance. However, his reaction was: „It does not matter to Hippocleides!“ (Hdt. 6,129,4). It will be proposed that Kleisthenes tried to dominate the competition and to establish an enduring hierarchy between himself and the suitors by taking (...) advantage of his position as Olympic champion, giver of the women, tyrant, and host. Thus, Hippokleides’ behavior could be understood as a self-confident rejection of Kleisthenes’ way of constituting individual status, a way which actually suspended the competition. (shrink)

The correspondence between Hannah Arendt and Karl Jaspers begins in 1926, when the twenty-year-old Arendt studied philosophy with Jaspers in Heidelberg. It is interrupted by Arendt's emigration and Jasper's 'inner emigration' and resumes in the fall of 1945. From then until Jaspers's death in 1969, the initial teacher-student relationship develops into a close friendship. Three countries figure prominently in the correspondence: Germany, Israel, and the United States. Among the topics are Fascism, the atom bomb and the threat of global (...) destruction, German guilt for the Holocaust, Jewishness, the State of Israel, American politics and American universities, the Eichmann trial in Jerusalem. Arendt and Jaspers discuss people both famous and obscure. They gossip, joke complain, and argue. They commiserate with each other over the illnesses and infirmities of old age. And they converse about the world's great philosophers: Spinoza, Kant, Marx, Max Weber, Heidegger. Twenty years ago, the biopsychosocial model was proposed by George Engel to be the new paradigm for medicine and psychiatry. The model assumed a hierarchical structure of the biological, psychological and social system and simple interactions between the participating systems. This article holds the thesis that the original biopsychosocial model cannot depict psychiatry's reality and problems. The clinical validity of the biopsychosocial model has to be questioned. It is argued that psychiatric interventions can only stimulate but not determine their target (...) systems, because intervention and outcome are only loosely coupled. Thus, psychiatric interventions have in principle limited ranges which differ according to the type of intervention and according to the system to be stimulated. Psychosocial interventions face far more obstacles to be overcome than psychopharmacogical therapy. (shrink)

During the last fifteen years or so there has been much debate, among philosophers interested in perception, on the question of whether the representational content of perceptual experience is conceptual or nonconceptual. Recently, however, a number of philosophers have challenged the terms of this debate, arguing that one of its most basic assumptions is mistaken. Experience, they claim, does not have representational content at all. On the kind of approach they suggest, having a perceptual experience is not to be understood (...) on the model of thought or belief, as a matter of the subject's taking things in the world to be this or that way, or of having this or that feature. Nor is it to be understood on the model of receiving testimony about how things are in the world, as a matter of its being represented to us that things are this or that way. Rather, it is simply a matter of our being presented with things. Having a perceptual experience of an object is a matter of our standing in a certain kind of relation to it which makes it available to us to be represented in thought or belief, but which does not itself involve our representing it, or its being represented to us.1 Much of the motivation for rejecting the view that experience has representational content springs from a concern to do justice to what is distinctive about perceptual experience in contrast to thought and belief. In particular, perceptual experience seems to be more "primitive" than thought, in that it seems natural to appeal to the character of perceptual experience to explain the possibility of thought about objects rather than the other way around. Over the past decade, clinical ethics has received growing attention in Germany as in most European countries. In the mid-1990s, most European countries made efforts to establish healthcare ethics committees and clinical ethics consultation services. The development of clinical ethics discourse and activities in Germany, however, was delayed and, consequently, is still in its natal phase. Until the end of the 1990s, the only institutionalized bodies of ethical reflection were the research ethics committees at university medical centers and at the (...) State Physician Chambers. In March 1997, the Catholic and Protestant hospital association in Germany recommended the implementation of HECs, modeled after the American HECs. Consequently, the establishment of clinical ethics consultation in the form of HECs started in Germany in denominational hospitals, followed by a small but increasing number of community hospitals. In this article an attempt is made to localize epistemological violence and to unravel and unmask power structures, including points of friction between the migrating individual and the local community. In addition, a new type of subject is presented, which, on the one hand, reveals the power structures inherent in the individual and in the society containing it, and on the other hand, through the extended model of existence, offers opportunities for a coexistence, which would be marked by solidarity and (...) fairness and would occur by way of interpersonal connections. Using examples of power structures in language courses, in universities, and in the loss of cultural values through migration, epistemic violence is tracked and presented not only theoretically, but also factually. Reinhart Koselleck is among the most original German theorists of history and historiography. His international reputation is due in part to his contributions as theorist and editor of the remarkable lexicon Geschichtliche Grundbegriffe (GG). The GG is an exceptional reference work that goes far towards realizing Koselleck's program and distinctive version of Begriffsgeschichte (the history of concepts, conceptual history). What is presented here is a translation in full of Koselleck's own entry on Krise (crisis). Few articles in the GG demonstrate (...) more successfully Koselleck's theoretical concerns, his method, and innovative use of sources. (shrink)

The first step in planning a lexicon of European political and legal concepts is to decide upon how it is to be organised. Among the principal alternatives are the formats of three German reference works on the history of concepts (Begriffsgeschichte) and the methods associated with John Pocock and Quentin Skinner. Although these German and Anglophone styles are often regarded as incompatible, on closer inspection, they turn out to be in many respects complementary, as Skinner has recently acknowledged. What would (...) such a format look like? Is it possible to overcome the difficulties inherent in attempting a lexicon combining continental and Anglophone political and legal concepts? (shrink)

As Christian List (2021) has recently argued, the increasing arrival of powerful AI systems that operate autonomously in high-stakes contexts creates a need for “future-proofing” our regulatory frameworks, i.e., for reassessing them in the face of these developments. One core part of our regulatory frameworks that dominates our everyday moral interactions is blame. Therefore, “future-proofing” our extant regulatory frameworks in the face of the increasing arrival of powerful AI systems requires, among others things, that we ask whether it makes sense (...) to extend our blaming practices to these systems. In the paper, we argue for the admittedly surprising thesis that this question should be answered in the affirmative: contrary to what one might initially think, it can make a lot of sense to blame AI systems, since, as we furthermore argue, many of the important functions that are fulfilled by blaming humans can also be served by blaming AI systems. The paper concludes that this result gives us a good pro tanto reason to extend our blame practices to AI systems. (shrink)

Elizabeth Anscombe's paper ‘Modern Moral Philosophy’ 1 seems clearly to have failed in its task. Kurt Baier describes the paper as ‘widely discussed and much admired’ 2 and Peter Winch has called one of its three theses ‘enormously influential’ 3 within moral philosophy.

To examine the ethical issues involved in governmental decisions with potential health risks, we review the history of the decision to raise the interurban speed limit in Israel in light of its impact on road death and injury. In 1993, the Israeli Ministry of Transportation initiated an “experiment” to raise the interurban speed limit from 90 to 100 kph. The “experiment” did not include a protocol and did not specify cut-off points for early termination in the case of adverse results. (...) After the raise in the speed limit, the death toll on interurban roads rose as a result of a sudden increase in speeds and case fatality rates. The committee's decision is a case study in unfettered human experimentation and public health risks when the setting is non-medical and lacks a defined ethical framework. The case study states the case for extending Helsinki type safeguards to experimentation in non-medical settings. (shrink)

ABSTRACT:Organizations constitute morally-complex environments, requiring organization members to possess levels of moral courage sufficient to promote their ethical action, while refraining from unethical actions when faced with temptations or pressures. Using a sample drawn from a military context, we explored the antecedents and consequences of moral courage. Results from this four-month field study demonstrated that authentic leadership was positively related to followers’ displays of moral courage. Further, followers’ moral courage fully mediated the effects of authentic leadership on followers’ ethical and (...) pro-social behaviors. Theoretical and practical implications for further integrating the work on moral courage, authentic leadership and ethics are discussed. (shrink)

Tobacco companies have started to position themselves as good corporate citizens. The effort towards CSR engagement in the tobacco industry is not only heavily criticized by anti-tobacco NGOs. Some opponents such as the the World Health Organization have even categorically questioned the possibility of social responsibility in the tobacco industry. The paper will demonstrate that the deep distrust towards tobacco companies is linked to the lethal character of their products and the dubious behavior of their representatives in recent decades. As (...) a result, tobacco companies are not in the CSR business in the strict sense. Key aspects of mainstream CSR theory and practice such as corporate philanthropy, stakeholder collaboration, CSR reporting and self-regulation, are demonstrated to be ineffective or even counterproductive in the tobacco industry. Building upon the terminology used in the leadership literature, the paper proposes to differentiate between transactional and transformational CSR arguing that tobacco companies can only operate on a transactional level. As a consequence, corporate responsibility in the tobacco industry is based upon a much thinner approach to CSR and has to be conceptualized with a focus on transactional integrity across the tobacco supply chain.
