In 2012, a new and promising gene manipulation technique, CRISPR-Cas9, was announced that seems likely to be a foundational technique in health care and agriculture. However, patents have been granted. As with other technological developments, there are concerns of social justice regarding inequalities in access. Given the technologies’ “foundational” nature and societal impact, it is vital for such concerns to be translated into workable recommendations for policymakers and legislators. Colin Farrelly has proposed a moral justification for the use of patents (...) to speed up the arrival of technology by encouraging innovation and investment. While sympathetic to his argument, this article highlights a number of problems. By examining the role of patents in CRISPR and in two previous foundational technologies, we make some recommendations for realistic and workable guidelines for patenting and licensing. (shrink)

The revolutionary potential of the CRISPR-Cas9 gene editing technique has created a resurgence in enthusiasm and concern in genetic research perhaps not seen since the mapping of the human genome at the turn of the century. Some such concerns and anxieties revolve around crossing lines between somatic and germline interventions as well as treatment and enhancement applications. Underpinning these concerns, there are familiar concepts of safety, unintended consequences and damage to genetic identity and the creation of designer children through pursuing (...) human enhancement and eugenics. In the policy realm, these morally laden distinctions and anxieties are emerging as the basis for making important and applied measures to respond to the fast-evolving scientific developments. This paper argues that the dominant normative framing for such responses is insufficient for this task. This paper illustrates this insufficiency as arising from a continued reliance on misleading genetic essentialist assumptions that generate groundless speculation and over-reactionary normative responses. This phenomenon is explicit with regard to prospective human genetic enhancements. While many normative theorists and state-of-the-art reports continue to gesture toward the influence of environmental and social influences on a person and their traits and capacities, this recognition does not extend to the substance of the arguments themselves which tend to revert to the debunked genetic determinist framework. Given the above, this paper argues that there is a pressing need for a more central role for sociological input into particular aspects of this “enhancement myth” in order to give added weight, detail and substance to these environmental influences and influence from social structures. Rawls’ principle of fair equality of opportunity has been regularly discussed and criticized for being inadequate regarding natural inequalities. In so far as this egalitarian goal is sound, the purpose of the paper is to see how the prospect of radical genetic intervention might affect this particular inadequacy. I propose that, in a post-genetic setting, an appropriate response would be to extend the same rules regulating societal inequalities to a regulation of comparable genetic inequalities. I defend this stance against recent (...) arguments from the authors of From Chance to Choice and from Colin Farrelly’s alternative of the genetic difference principle. (shrink)

Given the constraints of human partiality and the possible social benefits of widespread genetic technology, allowing for incentive-based inequalities in access in order to boost innovation and diffusion may be the only feasible option available to the post-genomics egalitarian planner. In light of the prevailing ethos that exists in the non-ideal circumstances of society, an initial post-genomics egalitarian goal for all to have equivalent access to comparable genetic interventions seems very unlikely to succeed.While I outline how the initial egalitarian goal (...) can entail either overly prohibitive or overly idealistic prescriptions, I argue that the more recent non-ideal focus has not given adequate attention to how different distributions in genetic access may not only be constrained by, but may also affect the prevailing ethos for better or worse, in turn affecting the range of feasible options into the future. I analyse Farrelly’s Lax Genetic Difference Principle , as an exemplar of a non-ideal post-genomics theorising, and evaluate it in terms of its anticipated effects on the egalitarian ethos. I argue that achieving a more just distribution of access to genetic technologies, by principles that take into account genuine non-ideal considerations, requires a greater awareness of such effects.Finally, I briefly sketch a framework for ‘ethos-proofing’ non-ideal principles, in terms of access to genetic technologies, particularly enhancements, with regard to maintaining and fostering such an egalitarian ethos. The effective collection and management of personal data of rapidly migrating populations is important for ensuring adequate healthcare and monitoring of a displaced peoples’ health status. With developments in ICT data sharing capabilities, electronic personal health records (ePHRs) are increasingly replacing less transportable paper records. ePHRs offer further advantages of improving accuracy and completeness of information and seem tailored for rapidly displaced and mobile populations. Various emerging initiatives in Europe are seeking to develop migrant‐centric ePHR responses. This paper highlights their (...) importance and benefits, but also identifies a number of significant ethical, legal and social issues (ELSI) and challenges to their design and implementation, regarding (1) the kind of information that should be stored, (2) who should have access to information, and (3) potential misuse of information. These challenges need to be urgently addressed to make possible the beneficial use of ePHRs for vulnerable migrants in Europe. (shrink)

In most discussions of the social justice implications of new genetic technologies, enhancements are considered to be highly contentious. This is particularly so when we speak of enhancements that benefit the recipient in positional terms and enhancements that are germ-line and which can be passed on to future generations. I argue that the egalitarian reluctance, as displayed by Max Mehlman (2003:2005), to permitting enhancements is overblown. Recent writings from Buchanan (2008) and Farrelly (2004) highlight a more positive, context-dependent, role for (...) permitting the socio-economically advantaged the freedom to gain access to enhancements, including enhancements of traits associated with positional or competitive advantage. I argue that this reasoning also (necessarily) applies to germ-line enhancements or, at least, to 'effective germ-line enhancements.' In other words, I argue that such enhancements should be more seriously considered in terms of this positive context-dependent role. Nevertheless, this support is not unqualified. I critically re-examine concerns regarding the notion of the genetic underclass and I raise some worries about the possible adverse consequence of such a regulatory framework on sustaining the required egalitarian ethos. Importantly, such worries (and suggestions to address them) will be focused on the adverse effects of inequalities, rather than germ-line enhancements themselves. (shrink)

Rather, potential uses should be regulated under general, existing frameworks and where applicable by reference to sufficiently equivalent technologies and techniques already subject to specific regulation. To be clear, we do not argue for the hasty introduction of gene editing as a reproductive treatment option in the immediate future. We call for caution with regard to overreaching moratoria and prohibitions that will also affect basic research. We recommend flexible regulations that allow for further responsible research into the potential development of the technology. We call for an open and inclusive debate and argue that scientific communication should claim a more prominent role to counter the danger of widespread misinformation. A high level of transparency and accuracy should guide scientific communication while simultaneously global‐scale responsibility and governance should be fostered by promoting cross‐disciplinary thinking and multi‐level stakeholder involvement in legal and regulatory processes. Four experiments investigated how people judge the plausibility of category-based arguments, focusing on the diversity effect, in which arguments with diverse premise categories are considered particularly strong. In Experiment 1 we show that priming people as to the nature of the blank property determines whether sensitivity to diversity is observed. In Experiment 2 we find that people's hypotheses about the nature of the blank property predict judgements of argument strength. In Experiment 3 we examine the effect of our priming methodology (...) on people's tendency to bring knowledge about causality or similarity to bear when evaluating arguments, and in Experiment 4 we show that whether people's hypotheses about the nature of the blank property were causal predicted ratings of argument strength. Together these results suggest that diversity effects occur because diverse premises lead people to bring general features of the premise categories to mind. Although our findings are broadly consistent with Bayesian and Relevance-based approaches to category-based inductive reasoning, neither approach captures all of our findings. (shrink)

Three experiments investigated the effect of rarity on people's selection and interpretation of data in a variant of the pseudodiagnosticity task. For familiar (Experiment 1) but not for arbitrary (Experiment 3) materials, participants were more likely to select evidence so as to complete a likelihood ratio when the initial evidence they received was a single likelihood concerning a rare feature. This rarity effect with familiar materials was replicated in Experiment 2 where it was shown that participants were relatively insensitive to (...) explicit manipulations of the likely diagnosticity of rare evidence. In contrast to the effects for data selection, there was an effect of rarity on confidence ratings after receipt of a single likelihood for arbitrary but not for familiar materials. It is suggested that selecting diagnostic evidence necessitates explicit consideration of the alternative hypothesis and that consideration of the possible consequences of the evidence for the alternative weakens the rarity effect in confidence ratings. Paradoxically, although rarity effects in evidence selection and confidence ratings are in the spirit of Bayesian reasoning, the effect on confidence ratings appears to rely on participants thinking less about the alternative hypothesis. Substantivalists believe that spacetime and its parts are fundamental constituents of reality. Relationalists deny this, claiming that spacetime enjoys only a derivative existence. I begin by describing how the Galilean symmetries of Newtonian physics tell against both Newton's brand of substantivalism and the most obvious relationalist alternative. I then review the obvious substantivalist response to the problem, which is to ditch substantival space for substantival spacetime. The resulting position has many affinities with what are arguably the most natural interpretations of (...) special and general relativity. I move on to consider and reject two recent antisubstantivalist lines of thought. The interim conclusion is that the best argument for relationalism is an appeal to Ockham's razor. However, for this to be successful there must be genuine relationalist theories that share the theoretical virtues of their substantivalist rivals but without the additional ontological commitment. The bulk of the paper is therefore an investigation of various concrete relationalist proposals. I distinguish three options for the relationalist in the face of the success of Galilean invariant physics and trace how these generalise to relativistic physics. One of the options is particularly promising but, since its basic objects end up being spacetime points, this does not help the prospects of relationalism as traditionally conceived. I end with some reflections on the fate of substantivalism in the aftermath of the Hole Argument, concluding that we have as yet to be given good reasons to abandon the natural, substantivalist interpretation of current physics. English has plural terms as well as singular terms. But our standard formal languages, e.g., the predicate calculus, feature only singular terms. How can the plural idiom be formalized?‘Changing the subject’ is by far the most common plurals strategy among both philosophers and linguists: a plural term is replaced by a singular term standing for some complex object that ‘contains’ the individuals to which the plural term alludes. For example, one might simply replace ‘A, B imply C’ with ‘{A, B} (...) implies [singular] C’. We uncover a surprising variety of ways to change the subject, of ever‐increasing complexity and ingenuity. Our question is whether any can made to work. (shrink)

Postcolonial discourse is incredibly diverse and postcolonial art in Australia has numerous critical modes. This paper describes an approach in Contemporary Indigenous art that attempts a critique of the law from within the law rather than outside of it. It takes a radical form of over-proximity, rather than avant-garde distance, and finds the gap and failure in law’s attempt at creating legal subjects of us all. In the work of Gordon Bennett, Danie Mellor and the duo Adam Geczy and Adam (...) Hill, there is a working through the political and legal ramifications of the Indigenous subject in contemporary Australia. The focus on processes of initiation and subjectivization, or what Althusser called “interpellation” and show the effects of this interpellation in the Indigenous subject and offer modes of resistance. The artists are informed by Lacanian notions of subjectivization and utilise this approach to semiotics and power as the starting point for their critique. (shrink)

ABSTRACT The use of broad consent for genomics research raises important ethical questions for the conduct of genomics research, including relating to its acceptability to research participants and comprehension of difficult scientific concepts. To explore these and other challenges, we conducted a study using qualitative methods with participants enrolled in an H3Africa Rheumatic Heart Disease genomics study (the RHDGen network) in Zambia to explore their views on broad consent, sample and data sharing and secondary use. In-depth interviews were conducted with (...) RHDGen participants (n = 18), study staff (n = 5) and with individuals who refused to participate (n = 3). In general, broad consent was seen to be reasonable if reasons for storing the samples for future research use were disclosed. Some felt that broad consent should be restricted by specifying planned future studies and that secondary research should ideally relate to original disease for which samples were collected. A few participants felt that broad consent would delay the return of research results to participants. This study echoes findings in other similar studies in other parts of the continent that suggested that broad consent could be an acceptable consent model in Africa if careful thought is given to restrictions on re-use. Immanuel Kant is often considered to be the source of the contemporary idea of human dignity, but his conception of human dignity and its relation to human value and to the requirement to respect others have not been widely understood. Kant on Human Dignity offers the first in-depth study in English of this subject. Based on a comprehensive analysis of all the passages in which Kant uses the term ;dignity, as well as an analysis of the most prominent arguments for (...) a value of human beings in the Kant literature, the book carefully examines different ways of construing the relationship between dignity, value and respect for others. It takes seriously Kant s Copernican Revolution in moral philosophy: Kant argues that moral imperatives cannot be based on any values without yielding heteronomy. Instead it is imperatives of reason that determine what is valuable. The requirement to respect all human beings is one such imperative. Respect for human beings does not follow from human dignity for this would violate autonomy but is an unconditional command of reason. Following this train of thought yields a unified account of Kant s moral philosophy. (shrink)

This paper reviews the hole argument as an argument against spacetime substantivalism. After a careful presentation of the argument itself, I critically review possible responses.

Is the objective passage of time compatible with relativistic physics? There are two easy routes to an affirmative answer: (1) provide a deflationary analysis of passage compatible with the block universe, or (2) argue that a privileged global present is compatible with relativity. (1) does not take passage seriously. (2) does not take relativity seriously. This paper is concerned with the viability of views that seek to take both passage and relativity seriously. The investigation proceeds by considering how traditional A-theoretic (...) conceptions of passage might be generalized to relativistic space-times without incorporating a privileged global present. I argue that the most promising position marries the idea that open possibilities for the future are settled as time passes with a ‘non-standard’ interpretation of the relevant formal models. In his paper ``What is Structural Realism?'' James Ladyman drew a distinction between epistemological structural realism and metaphysical (or ontic) structural realism. He also drew a suggestive analogy between the perennial debate between substantivalist and relationalist interpretations of spacetime on the one hand, and the debate about whether quantum mechanics treats identical particles as individuals or as `non-individuals' on the other. In both cases, Ladyman's suggestion is that an ontic structural realist interpretation of the physics might be just what is (...) needed to overcome the stalemate. The main thesis of this paper is that, whatever the interpretative difficulties of generally covariant spacetime physics are, they do not support or suggest structural realism. In particular, I hope to show that there is in fact no analogy that supports a similar interpretation of the metaphysics of spacetime points and of quantum particles. (shrink)

What is morality? How many moral values are there? And what are they? According to the theory of morality-as-cooperation, morality is a collection of biological and cultural solutions to the problems of cooperation recurrent in human social life. This theory predicts that there will be as many different types of morality as there are different types of cooperation. Previous research, drawing on evolutionary game theory, has identified at least seven different types of cooperation, and used them to explain seven different (...) types of morality: family values, group loyalty, reciprocity, heroism, deference, fairness and property rights. Here we explore the conjecture that these simple moral ‘elements’ combine to form a much larger number of more complex moral ‘molecules’, and that as such morality is a combinatorial system. For each combination of two elements, we hypothesise a candidate moral molecule, and successfully locate an example of it in the professional and popular literature. These molecules include: fraternity, blood revenge, family pride, filial piety, gavelkind, primogeniture, friendship, patriotism, tribute, diplomacy, common ownership, honour, confession, turn taking, restitution, modesty, mercy, munificence, arbitration, mendicancy, and queuing. These findings indicate that morality – like many other physical, biological, psychological and cultural systems – is indeed a combinatorial system. Thus morality-as-cooperation provides a principled and powerful theory, that explains why there are many moral values, and successfully predicts what they will be; and it generates a systematic framework that has the potential to explain all moral ideas, possible and actual. Pursuing the many implications of this theory will help to place the study of morality on a more secure scientific footing. (shrink)

Whether Kant’s late legal theory and his theory of race are contradictory in their account of colonialism has been a much-debated question that is also of highest importance for the evaluation of the Enlightenment’s contribution to Europe’s colonial expansion and the dispossession and enslavement of native and black peoples. This article discusses the problem by introducing the discourse on barbarism. This neglected discourse is the original and traditional European colonial vocabulary and served the justification of colonialism from ancient Greece throughout (...) the Renaissance to the eighteenth century. Kant’s explicit rejection of this discourse and its prejudices reveals his early critical stance toward colonial judgements of native peoples even before he developed his legal theory. This development of his critical position can be traced in his writings on race: although he makes racist statements in these texts, his theory of race is not meant to ground moral judgements on ‘races’ or a racial hierarchy but to defend the unity of mankind under the given empirical reality of colonial hierarchies. Explainable artificial intelligence (XAI) seeks to produce explanations for those machine learning methods which are deemed opaque. However, there is considerable disagreement about what this means and how to achieve it. Authors disagree on what should be explained (topic), to whom something should be explained (stakeholder), how something should be explained (instrument), and why something should be explained (goal). In this paper, I employ insights from means-end epistemology to structure the field. According to means-end epistemology, different means ought to be (...) rationally adopted to achieve different epistemic ends. Applied to XAI, different topics, stakeholders, and goals thus require different instruments. I call this the means-end account of XAI. The means-end account has a descriptive and a normative component: on the one hand, I show how the specific means-end relations give rise to a taxonomy of existing contributions to the field of XAI; on the other hand, I argue that the suitability of XAI methods can be assessed by analyzing whether they are prescribed by a given topic, stakeholder, and goal. We are neither as pessimistic nor as optimistic as Elqayam & Evans (E&E). The consequences of normativism have not been uniformly disastrous, even among the examples they consider. However, normativism won't be going away any time soon and in the literature on causal Bayes nets new debates about normativism are emerging. Finally, we suggest that to concentrate on expert reasoners as an antidote to normativism may limit the contribution of research on thinking to basic psychological science.

Many research fields concerned with the processing of information contained in human faces would benefit from face stimulus sets in which specific facial characteristics are systematically varied while other important picture characteristics are kept constant. Specifically, a face database in which displayed expressions, gaze direction, and head orientation are parametrically varied in a complete factorial design would be highly useful in many research domains. Furthermore, these stimuli should be standardised in several important, technical aspects. The present article presents the freely (...) available Radboud Faces Database offering such a stimulus set, containing both Caucasian adult and children images. This face database is described both procedurally and in terms of content, and a validation study concerning its most important characteristics is presented. In the validation study, all frontal images were rated with respect to the shown facial expression, intensity of expression, clarity of expression, genuineness of expression, attractiveness, and valence. The results show very high recognition of the intended facial expressions. (shrink)

In this article, I offer a detailed examination of Margaret Macdonald's response to the Cartesian sceptical argument from dreaming. I show that Macdonald's views were not well understood by her contemporaries, and I suggest that this misunderstanding has led to her omission from subsequent discussions of this subject. I end with a brief demonstration of the fact that Macdonald's central claims have re-emerged in contemporary epistemology.

There are strong indications that many consumers are switching towards more socially and environmentally responsible products and services, reflecting a shift in consumer values indicated in several countries. However, little is known about the motives that drive some toward, or deter others from, higher levels of ethical concern and action in their purchasing decisions. Following a qualitative investigation using ZMET and focus group discussions, a questionnaire was developed and administered to a representative sample of consumers; nearly 1,000 usable questionnaires were (...) collected. The degree of awareness, concern and action regarding 16 ethical issues was quantified, using a measure developed from the Stages of Change concept within the Transtheoretical model. Motivations for ethical behaviour, in relation to each individual’s most salient ethical issue, were investigated using initially 22 motive statements within the framework of the Decisional Balance Scale (DBS). The findings suggest that the DBS and Stages model have an explanatory value within the ethical decision-making context, and that the motives identified do reflect the Decisional Balance Constructs. Indeed the study suggests that respondents’ motivational attitudes are a function of their stage of ethical awareness, concern and action. Therefore, the Decisional Balance Scale may well prove useful for designing appropriate interventions and communications to facilitate movement towards more ethical decision-making. These findings yield strategic insight for communicating messages to ethical consumers and for better understanding their purchasing decisions. (shrink)

Without inductive reasoning, we couldn't generalize from one instance to another, derive scientific hypotheses, or predict that the sun will rise again tomorrow morning. Despite the widespread nature of inductive reasoning, books on this topic are rare. Indeed, this is the first book on the psychology of inductive reasoning in twenty years. The chapters survey recent advances in the study of inductive reasoning and address questions about how it develops, the role of knowledge in induction, how best to model people's (...) reasoning, and how induction relates to other forms of thinking. Written by experts in philosophy, developmental science, cognitive psychology, and computational modeling, the contributions here will be of interest to a general cognitive science audience as well as to those with a more specialized interest in the study of thinking. Generative AI has gained a lot of attention in society, business, and science. This trend has increased since 2018, and the big breakthrough came in 2022. In particular, AI-based text and image generators are now widely used. This raises a variety of ethical issues. The present paper first gives an introduction to generative AI and then to applied ethics in this context. Three specific image generators are presented: DALL-E 2, Stable Diffusion, and Midjourney. Diffeomorphism invariance is sometimes taken to be a criterion of background independence. This claim is commonly accompanied by a second, that the genuine physical magnitudes (the ``observables'') of background-independent theories and those of background-dependent (non-diffeomorphism-invariant) theories are essentially different in nature. I argue against both claims. Background-dependent theories can be formulated in a diffeomorphism-invariant manner. This suggests that the nature of the physical magnitudes of relevantly analogous theories (one background free, the other background dependent) is essentially the same. The temptation (...) to think otherwise stems from a misunderstanding of the meaning of spacetime coordinates in background-dependent theories. (shrink)

This paper uses a schema for infinite regress arguments to provide a solution to the problem of the infinite regress of justification. The solution turns on the falsity of two claims: that a belief is justified only if some belief is a reason for it, and that the reason relation is transitive.
