This open access book seeks to identify the ethical spirit of European Union law, a context in which we can observe a trend towards increasing references to the terms ‘ethics’ and ‘morality’. This aspect is all the more important because EU law is now affecting more and more areas of national law, including such sensitive ones as the patentability of human life. Especially when unethical behaviour produces legal consequences, the frequent lack of clearly defined concepts remains a challenge, particularly against (...) the background of the principle of legal certainty. This raises the question to which extent the content of these references is determined and whether it is possible to identify an ethical spirit of EU law. Answering that question, in turn, entails addressing the following questions: In references to ethics concerning EU law, can we identify references to a particular theory of practical philosophy at all; and, if so, to one or more normative ethical theories? Further, should these non-legal concepts be imported in an unaltered way, or be adapted to the legal context? This book explores the different layers of EU law, including the role of ethics in EU lawmaking and in EU case law, as well as the implementation of relevant EU directives in selected Member States. In addition to the above-mentioned normative philosophical lens, the book also analyzes the findings from the legal lens of EU integration, i.e., especially EU values, human rights and the cornerstone of human dignity. The effective collection and management of personal data of rapidly migrating populations is important for ensuring adequate healthcare and monitoring of a displaced peoples’ health status. With developments in ICT data sharing capabilities, electronic personal health records (ePHRs) are increasingly replacing less transportable paper records. ePHRs offer further advantages of improving accuracy and completeness of information and seem tailored for rapidly displaced and mobile populations. Various emerging initiatives in Europe are seeking to develop migrant‐centric ePHR responses. This paper highlights their (...) importance and benefits, but also identifies a number of significant ethical, legal and social issues (ELSI) and challenges to their design and implementation, regarding (1) the kind of information that should be stored, (2) who should have access to information, and (3) potential misuse of information. These challenges need to be urgently addressed to make possible the beneficial use of ePHRs for vulnerable migrants in Europe. (shrink)

When we cook, by meticulously following a recipe, or adding a personal twist to it, we sometimes care not only to (re-)produce a taste that we can enjoy, but also to give our food a certain aftertaste. This is not surprising, given that we ordinarily take aftertaste to be an important part of the gustatory experience as a whole, one which we seek out, and through which we evaluate what we eat and drink—at least in many cases. What is surprising (...) is that aftertastes, from a psychological point of view, seem to be analogous to afterimages, and thus have little or no epistemic import. In this paper we tackle this puzzle, and argue that we are right in treating aftertastes seriously. The moral is that both from a metaphysical and an epistemic point of view aftertastes should be categorized differently from afterimages. (shrink)

Does the A-theory have an intuitive advantage over the B-theory? Many A-theorists have claimed so, arguing that their theory has a much better explanation for the fact that we all experience the passage of time: we experience time as passing because time really does pass. In this paper I expose and reject the argument behind the A-theorist’s claim. I argue that all parties have conceded far too easily that there is an experience that needs explaining in the first place. For (...) what exactly is an experience of temporal passage? One natural thought is that we experience passage in virtue of experiencing change, or in virtue of experiencing change as ‘dynamic’. Another is that we experience passage in virtue of experiencing events as (successively) present. None of these experiences, I argue, amounts to an experience of passage. Although there might still be other ways to experience passage, A-theorists would have to provide us with a plausible candidate experience. If there is such an experience at all, it won’t be one that qualifies as what we intuitively take to be an experience of passage. The ‘intuitive advantage’, it seems, has dissolved in any case. This paper concerns anti-Humean intuitions about connections in nature. It argues for the existence of a de re link that is not necessity.Some anti-Humeans tacitly assume that metaphysical necessity can be used for all sorts of anti-Humean desires. Metaphysical necessity is thought to stick together whatever would be loose and separate in a Hume world, as if it were a kind of universal superglue.I argue that this is not feasible. Metaphysical necessity might connect synchronically co-existent properties—kinds and their essential features, (...) for example—but it is difficult to see how it could also serve as the binding force for successions of events. That is, metaphysical necessity seems not to be fit for diachronic, causal affairs in which causal laws, causation, or dispositions are involved. A different anti-Humean connection in nature has to do that job.My arguments focus mainly on a debate which has been the battleground for Humean vs. anti-Humean intuitions for many decades—namely, the analysis of dispositional predicates—yet I believe (but do not argue here) that the arguments generalise to causation and causal laws straightforwardly. Abstract- Presentism And Temporal Experience Intuitively, we all believe that we experience change and the passage of time. Presentism prides itself as the most intuitive theory of time. However, a closer look at how we would experience temporality if presentism was true reveals that this is far from obvious. For if presentism was really so intuitive, then it would do justice to these intuitions. In the course of this article I examine how presentism fares when combined with various leading theories (...) of perception and temporal perception. I focused on two Central Questions. Can presentism, given theory X, account for experiences of change and duration? And can presentism, given theory X, account for experiences of time as passing? I argue that there is no possible combination which allows for an experience of time as passing. This result alone undermines the alleged intuitive advantage of presentism and with it the motivation for the view. Presentism, it remains safe to say, is not as intuitive a theory as its adherents like to portray it. (shrink)

This paper explores whether it is possible to reformulate or re-interpret Lewis’s theory of fundamental laws of nature—his “best system analysis”—in such a way that it becomes a useful theory for special science laws. One major step in this enterprise is to make plausible how law candidates within best system competitions can tolerate exceptions—this is crucial because we expect special science laws to be so called “ceteris paribus laws ”. I attempt to show how this is possible and also how (...) we can thereby make the first step towards a solution for the infamous difficulties surrounding the troublesome ceteris paribus clause. Is it the case that, in order to have a perceptual experience as of change, duration, or any other temporally extended occurrence at all, the duration of the experience itself must come apart from the apparent duration of what is experienced? I shall argue that such a view is at least coherent. The largest part of the paper will be concerned with an objection from Ian Phillips . The objection is interesting in so far as it is an argument from (...) introspection. If it worked, it would give us a priori, non-empirical grounds for thinking that a cluster of views about temporal perception are wrong, or worse, impossible. I will argue, however, that the objection fails. Towards the end, I briefly explore the view that we have no introspective access at all to the duration of our experiences. I suggest that such a view may well be supported by some considerations about the phenomenal continuity of consciousness. (shrink)

We investigate peer influence on managerial honesty under varying levels of transparency. In a laboratory experiment, managers report their costs to a superior to request budget. We manipulate whether the managers learn each other’s report and cost or the report but not the cost. The results show, first, that managers are susceptible to peer influence, as they join peers in reporting honestly and dishonestly both under full and partial transparency. Second, however, the effect of peer influence is asymmetric. While managers’ (...) dishonesty increases much when peers’ reports are higher than they have expected, the opposite is not true. Third, partial transparency reinforces this asymmetry in peer influence. Unlike full transparency, it allows managers to substitute self-serving assumptions for missing information and to thus justify their own dishonesty more easily. The contribution of this study is twofold: It provides evidence for the interaction between transparency and peer influence and it highlights the role of expectations in fueling dishonesty. Our findings warn firms that especially partial transparency may spread dishonesty more than honesty. Transparency may also hurt firms that push honesty norms but fail to enforce compliance, thus raising and disappointing managers’ expectations. (shrink)

Text-generative AI-systems have become important semantic agents with ChatGPT. We conducted a series of experiments to learn what teachers’ conceptions of text-generative AI are in relation to philosophical texts. In our main experiment, using mixed methods, we had twenty-four high school students write philosophical essays, which we then randomized to essays with the same command from ChatGPT. We had ten prospective teachers assess these essays. They were able to tell whether it was an AI or student essay with 78.7 percent (...) accuracy, which is better than the Open AI Classifier. Interestingly, however, they used criteria like argumentative and logical flawlessness and neutrality. We concluded from this that they are using an inverted Turing test and are no longer looking for rationality in machines but for irrationality in humans. (shrink)

The project of my dissertation was to advance the metaphysical debate about temporal passage, by relating it to debates about the perceptual experience of time and change. It seems true that we experience temporal passage, even if there is disagreement whether time actually passes, or what temporal passage consists in. This appears to give the defender of dynamic time an advantage in accounting for our experience. I challenge this by arguing that no major account of temporal perception can accommodate experiences (...) of temporal passage such that we could infer passage from them. This shows that static theories of time are at no disadvantage in accounting for the phenomenology of temporality. The conclusion has far reaching consequences: for instance, an important motivation for holding an A-theory of time is precisely the psychological intuition that we experience temporal passage. By undermining that intuition, I undermine the motivation for holding an A-theory. (shrink)

It is widely believed that at least two developments in the last third of the 20th century have given dispositionalism—the view that powers, capacities, potencies, etc. are irreducible real properties—new credibility: (i) the many counterexamples launched against reductive analyses of dispositional predicates in terms of counterfactual conditionals and (ii) a new anti-Humean faith in necessary connections in nature which, it is said, owes a lot to Kripke’s arguments surrounding metaphysical necessity. I aim to show in this paper that necessity is, (...) in fact, of little help for the dispositionalists. My argument makes use of one of the above mentioned counterexamples against Humean reduction: antidotes. Turning the tables, I ask how the dispositionalists themselves can deal with antidotes. The result will be to show that if the dispositionalists are to demystify antidote cases, they must make plausible a conceptualisation of dispositions that does not invoke any kind of necessity. I will cautiously suggest that the anti-Humean link dispositions bring to the world has to be thought of in terms of (Newtonian) forces. (shrink)

This article introduces an “ordonomic” approach to corporate citizenship. We believe that ordonomics offers a conceptual framework for analyzing both the social structure and the semantics of moral commitments. We claim that such an analysis can provide theoretical guidance for the changing role of business in society, especially in regard to the expectation and trend that businesses take a political role and act as corporate citizens. The systematicraison d'êtreof corporate citizenship is that business firms can and—judged by the criterion of (...) prudent self-interest—“should” take on an active role in rule-finding discourses and rule-setting processes with the intent of realizing a win-win outcome of the economic game. We identify—and illustrate—four ways that corporate citizens can employ moral commitments as a factor of production to enhance their processes of economic value creation. (shrink)

We develop a theory about the metaphysics of time and modality that combines the conceptual resources devised in recent sympathetic work on ontological pluralism (the thesis that there are fundamentally distinct kinds of being) with the thought that what is past, future, and merely possible is less real than what is present and actual (albeit real enough to serve as truthmakers for statements about the past, future, and merely possible). However, we also show that despite being a coherent, distinctive, and (...) prima facie appealing position, the theory succumbs to what we call the “problem of mixed ontological status”. We conclude that the proponents of the theory can only evade these problems by developing ontological pluralism in a radically different way than it has been by its recent sympathizers. (shrink)

Recent research shows – somewhat astonishingly – that people are willing to ascribe moral blame to AI-driven systems when they cause harm [1]–[4]. In this paper, we explore the moral- psychological underpinnings of these findings. Our hypothesis was that the reason why people ascribe moral blame to AI systems is that they consider them capable of entertaining inculpating mental states (what is called mens rea in the law). To explore this hypothesis, we created a scenario in which an AI system (...) runs a risk of poisoning people by using a novel type of fertilizer. Manipulating the computational (or quasi-cognitive) abilities of the AI system in a between-subjects design, we tested whether people’s willingness to ascribe knowledge of a substantial risk of harm (i.e., recklessness) and blame to the AI system. Furthermore, we investigated whether the ascription of recklessness and blame to the AI system would influence the perceived blameworthiness of the system’s user (or owner). In an experiment with 347 participants, we found (i) that people are willing to ascribe blame to AI systems in contexts of recklessness, (ii) that blame ascriptions depend strongly on the willingness to attribute recklessness and (iii) that the latter, in turn, depends on the perceived “cognitive” capacities of the system. Furthermore, our results suggest (iv) that the higher the computational sophistication of the AI system, the more blame is shifted from the human user to the AI system. (shrink)

According to the standard view in philosophy, intentionality is the mark of genuine action. In psychology, human cognition and agency are now widely explained in terms of the workings of two distinct systems (or types of processes), and intentionality is not a central notion in this dual-system theory. Further, it is often claimed, in psychology, that most human actions are automatic, rather than consciously controlled. This raises pressing questions. Does the dual-system theory preserve the philosophical account of intentional action? How (...) much of our behavior is intentional according to this view? And what is the role of consciousness? I will propose here a revised account of intentional action within the dual-system framework, and we will see that most of our behavior can qualify as intentional, even if most of it is automatic. An important lesson will be that philosophical accounts of intentional action need to pay more attention to the role of consciousness in action. (shrink)

This chapter sheds light on a response to experimental philosophy that has not yet received enough attention: the reflection defense. According to proponents of this defense, judgments about philosophical cases are relevant only when they are the product of careful, nuanced, and conceptually rigorous reflection. The chapter argues that the reflection defense is misguided: Five studies (N>1800) are presented, showing that people make the same judgments when they are primed to engage in careful reflection as they do in the conditions (...) standardly used by experimental philosophers. Intellectual humility is an interesting but underexplored disposition. The claim “I am (intellectually) humble” seems paradoxical in that someone who has the disposition in question would not typically volunteer it. There is an explanatory gap between the meaning of the sentence and the meaning the speaker expresses by uttering it. We therefore suggest analyzing intellectual humility semantically, using a psycholexical approach that focuses on both synonyms and antonyms of ‘intellectual humility’. We present a thesaurus-based method to map the semantic space (...) of intellectual humility as a heuristic to support philosophical and psychological analysis of this disposition. We find three semantic clusters that compose intellectual humility: the sensible self, the discreet self, and the inquisitive self; likewise, we find three clusters that compose its contraries: the overrated self, the underrated other, and the underrated self. Like all causal theories in philosophy, the causal theory of action is plagued by the problem of deviant causal chains. I have proposed a solution on the basis of the assumption that mental states and events are causally efficacious in virtue of their contents. This solution has been questioned by Torbjörn Tännsjö (2009). First, I will reply to the objection, and then I will discuss Tännsjö’s alternative.

This paper presents a series of studies (total N=579) which demonstrate that folk judgments concerning the reasonableness of decisions and actions depend strongly on whether they engender positive or negative consequences. A particular decision is deemed more reasonable in retrospect when it produces beneficial consequences than when it produces harmful consequences, even if the situation in which the decision was taken and the epistemic circumstances of the agent are held fixed across conditions. This finding is worrisome for the law, where (...) the reasonable person standard plays a prominent role. The legal concept of reasonableness is outcome-insensitive: whether the defendant acted in a reasonable fashion or not depends exclusively on her context of action, no matter how things play out. Folk judgments of reasonableness are thus inconsistent with the legal concept of reasonableness. Problematically, in common law jurisdictions, the decision whether a defendant’s behavior was reasonable or not is frequently (though not necessarily) delegated to a lay jury. (shrink)

Are our beliefs justified only relatively to a specific culture or society? Is it possible to give reasons for the superiority of our scientific, epistemic methods? Markus Seidel sets out to answer these questions in his critique of epistemic relativism. Focusing on the work of the most prominent, explicitly relativist position in the sociology of scientific knowledge – so-called 'Edinburgh relativism' or the 'Strong Programme' –, he scrutinizes the key arguments for epistemic relativism from a philosophical perspective: underdetermination and (...) norm-circularity. His main negative result is that these arguments fall short of establishing epistemic relativism. -/- Despite arguing for epistemic absolutism, Seidel aims to provide an account of non-relative justification that nevertheless integrates the basic, correct intuition of the epistemic relativist. His main positive result is that the epistemic absolutist can very well accept the idea that people using different standards of justification can be equally justified in holding their beliefs: Rational disagreement, he maintains, is perfectly possible. -/- The book provides a detailed critique of relativism in the sociology of scientific knowledge and beyond. With its constructive part it aims at making conciliatory steps in a highly embittered discussion between sociology and philosophy of science. (shrink)

Previous research in Explainable Artificial Intelligence (XAI) suggests that a main aim of explainability approaches is to satisfy specific interests, goals, expectations, needs, and demands regarding artificial systems (we call these “stakeholders' desiderata”) in a variety of contexts. However, the literature on XAI is vast, spreads out across multiple largely disconnected disciplines, and it often remains unclear how explainability approaches are supposed to achieve the goal of satisfying stakeholders' desiderata. This paper discusses the main classes of stakeholders calling for explainability (...) of artificial systems and reviews their desiderata. We provide a model that explicitly spells out the main concepts and relations necessary to consider and investigate when evaluating, adjusting, choosing, and developing explainability approaches that aim to satisfy stakeholders' desiderata. This model can serve researchers from the variety of different disciplines involved in XAI as a common ground. It emphasizes where there is interdisciplinary potential in the evaluation and the development of explainability approaches. (shrink)

In an important and widely discussed series of studies, Jonathan Phillips and colleagues have suggested that the ordinary concept of happiness has a substantial moral component. For in- stance, two persons who enjoy the same extent of positive emotions and are equally satisfied with their lives are judged as happy to different degrees if one is less moral than the other. Considering that the relation between morality and happiness or self-interest has been one of the central questions of moral philosophy (...) since at least Plato, such a result would be of considerable philosophical interest. On closer examination of the original research and new studies, we suggest that the data point to a different conclusion: in the dominant folk understanding of happiness, morality has no fundamental role. Findings seeming to indicate a moralized concept are better explained, we suggest, by folk theories on which extreme moral turpitude indicates that an individual suffers from psychological dysfunction. The argument from inductive risk is considered to be one of the strongest challenges for value-free science. A great part of its appeal lies in the idea that even an ideal epistemic agent—the “perfect scientist” or “scientist qua scientist”—cannot escape inductive risk. In this paper, I scrutinize this ambition by stipulating an idealized Bayesian decision setting. I argue that inductive risk does not show that the “perfect scientist” must, descriptively speaking, make non-epistemic value-judgements, at least not in a way that (...) undermines the value-free ideal. However, the argument is more successful in showing that there are cases where the “perfect scientist” should, normatively speaking, use non-epistemic values. I also show that this is possible without creating problems of illegitimate prescription and wishful thinking. Thus, while inductive risk does not refute value-freedom completely, it still represents a powerful critique of value-free science. (shrink)

How are we aware of time? How do we perceive change and duration? What is it like to experience temporality as opposed to spatiality? Does the way we experience time tell us anything about the nature of time? This chapter focusses on some of the most pertinent questions in the philosophy of time—on the relation between subjective and objective time, on the metaphysical and psychological priority of the present, on the phenomenal difference between our experiences of space and our experiences (...) of time, and on how to reconcile relativistic time concepts with our common-sense ideas. It gives us an interesting in sight into leading debates on the topic, largely within the phenomenological and hermeneutic philosophical traditions. We propose a multi-step evaluation schema designed to help procurement agencies and others to examine the ethical dimensions of autonomous systems to be applied in the security sector, including autonomous weapons systems.

Mental state reasoning or theory-of-mind has been the subject of a rich body of imaging research. Although such investigations routinely tap a common set of regions, the precise function of each area remains a contentious matter. With the help of functional magnetic resonance imaging (fMRI), we sought to determine which areas are involved when processing mental state or intentional metarepresentations by focusing on the relational aspect of such representations. Using non-intentional relational representations such as spatial relations between persons and between (...) objects as a contrast, the results ascertained the involvement of the precuneus, the temporal poles, and the medial prefrontal cortex in the processing of intentional representations. In contrast, the anterior superior temporal sulcus and the left temporo-parietal junction were implicated when processing representations that refer to the presence of persons in relational contexts in general. The right temporo-parietal junction, however, was specifically activated for persons entering spatial relations. The level of representational complexity, a previously unexplored factor, was also found to modulate the neural response in some brain regions, such as the medial prefrontal cortex and the right temporo-parietal junction. These findings highlight the need to take into account the critical roles played by an extensive network of neural regions during mental state reasoning. (shrink)

Fogelin’s neo-Pyrrhonism is skepticism about epistemology and philosophy more generally. Philosophical reflection on ordinary epistemic practices leads us to deny the possibility of knowledge and justified belief. However, instead of accepting the dogma that knowledge and justified beliefs are impossible, a neo-Pyrrhonist rejects the philosophical premises that lead to this conclusion. Fogelin argues in particular that contemporary theories of justification cannot avoid dogmatic skepticism, because they are committed to the premises of the skeptical argument deriving from the modes of Agrippa. (...) It is argued against Fogelin that those theories can and typically do deny one or another of the premises and thus can avoid the skeptical conclusion. Neo-Pyrrhonism should rather be defended by arguing that the premises of the Agrippan argument are intuitively plausible and that neo-Pyrrhonism provides the best resolution of the resulting paradox. Only neo-Pyrrhonism both explains the intuitive plausibility of the premises and avoids dogmatic skepticism. (shrink)
