The debate concerning abortion abounds in miraculous narratives. Judith Jarvis Thomson has contrived the most celebrated set among related ones, to wit the “violinist analogy,” the “Good Samaritan” narrative, and the “Henry Fonda” allegory, by virtue of which, she intends, on the one hand, to argue that women’s right to autonomy outweighs the alleged fetus’s right to life, and on the other, to prove that no positive moral duties can be derived towards other persons alone from the fact that a (...) moral agent is ascribed certain rights. What this short paper endeavors to prove is that Thomson’s argumentation by analogy is a weak one, since neither the number nor the relevance of similarities invoked is adequate or satisfactory, while crucial parameters concerning the morality of abortion are being totally overlooked. But I believe it well may show exactly what he denied it showed — viz., that his empiricism rests on a mistake. Hume says: Suppose... a person to have enjoyed his sight for thirty years, and (...) to have become perfectly well acquainted with colours of all kinds, excepting one particular shade of blue, for instance, which it never has been his fortune to meet with. Let all the different shades of that colour, except that single one, be plac'd before him, descending gradually from the deepest to the lightest; 'tis plain, that he will perceive a blank, where that shade is wanting, and will be sensible, that there is a greater distance in that place betwixt the contiguous colours, than in any other. Now I ask, whether 'tis possible for him, from his own imagination, to supply this deficiency, and raise up to himself the idea of that particular shade, tho' it had never been conveyed to him by his senses? I believe there are few but will be of opinion that he can.... Sometimes one is surprised by the colour which emerges when one mixes paints, powders or lights of different hues, in the sense that one is unable to imagine this resulting colour until one actually sees it. I often have analogous experiences when sightreading music on the trombone. If there is a large, unfamiliar interval between the note I am playing and the one to be played next, so I cannot 'hear' the next note inwardly, I bring the slide to the correct position, set my lips at approximately the right tension, and presto! the correct note appears, despite 110 my inability to predict what it was going to sound like. Only after I have heard it can I also 'hear' it, i.e, predict its occurrence in this melodic line. Cases like these are not puzzling philosophically, because in them, the note, colour, etc. arises primarily from the equipment used — e.g., paints, powders or lights, the trombone and tension of the lips, and so on — rather than from the mind of the person who uses these things. But in Hume's example, no extra-mental objects or events play a direct role in creating the imagined colour. In fact, this colour never appears at all outside the subject's mind, and he never sees it. Therefore here the imagined colour is produced entirely by the subject himself, without his having copied it from anything in the external world. Yet this contradicts the maxim Hume laid down at the beginning of the Treatise that all simple ideas arise from correspondingly simple (sense) impressions. Two points perhaps mitigate the seriousness of the problem set by the missing shade of blue. First, Hume saw clearly, as Locke did not, that "innate" does 2 not mean the same as "justified." He was not so much concerned with the question of where ideas come from, as with how these ideas can be shown to be legitimate. His answer to the latter question is that experience alone is competent to show this. Second, strictly speaking, no idea is itself a piece of knowledge, but only something with the help of which one constructs knowledge-claims; and it is necessary for a person to justify knowledge-claims which are composed of innate ideas, by checking them against experience, just as much as knowledge-claims composed of non-innate materials. For example, suppose I possess innately the idea (visual image) of blue and the idea (tactile image) of cool. To say that these ideas are innate means that they are merely triggered or activated in my Ill mind by experiences I happen to have, but are not created by these experiences, and are not necessarily copies of them. Nevertheless, in order for me to know something which involves these ideas, I first must put them together in a judgment, and then confirm that judgment by appeal to experience. This collection of ten essays offers the first systematic assessment of Jü rgen Habermas's "Philosophical Discourse of Modernity," a book that defended the rational potential of the modern age against the depiction of modernity as a spent epoch. The essays (of which four are newly commissioned, five were published in the journal "Praxis International," and one -- by Habermas -- first appeared in translation in "New Critique" ) are divided into two sections: "Critical Rejoinders" and "Thematic Reformulations." An opening essay (...) by d'Entrè ves sets out the main issues and orients the debate between Habermas and the postmodernists by identifying two different senses of responsibility: a responsibility to act versus a responsibility to otherness (an openness to difference, dissonance, and ambiguity). These are linked with two alternative understandings of the primary function of language: action-orienting versus world-disclosing. This is a fruitful way of looking at the issues that Habermas has raised in his attempt to resurrect and complete the project of Enlightenment. Habermas's essay discusses the main themes of his book in the context of a critical engagement with neoconservative cultural and political trends. The main body of essays offer an interesting collection of points of view, for and against Habermas's position by philosophers, social scientists, intellectual historians, and literary critics. The contents of Scala Graduum Caloris are described, supplemented by unpublished material. Both temperature measurements by his linseed oil thermometer and those based upon his law of cooling are shown to be reasonably accurate to 300°C, but above that value they are much too low. The apparent agreement and the deviation are explained by the differences between the assumptions that Newton made in deriving his law of cooling and the conditions in which he used it. Newton's attempts to link terrestrial (...) and celestial science in applications in the Principia are shown to fail from his confounding the concepts of temperature, heat and radiant intensity and his ignorance of most factors affecting the temperature rise of irradiated materials. Other comments on varied aspects of heat, mainly published in the Queries, are set out and analysed. His originality is assessed. (shrink)

A striking aspect of the so-called "Goldhagen debate" has been the bifurcated reception Hitler's Willing Executioners has received: the enthusiastic welcome of journalists and the public was as warm as the impatient dismissal of most historians was cool. This article seeks to transcend the current impasse by analyzing the underlying issues of Holocaust research at stake here. It argues that a "deep structure" necessarily characterizes the historiography of the Holocaust, comprising a tension between its positioning in "universalism" and "particularism" narratives. (...) While the former conceptualizes the Holocaust as an abstract human tragedy and explains its occurrence in terms of processes common to modern societies, the latter casts its analysis in ethnic and national categories: the Holocaust as an exclusively German and Jewish affair. These narratives possess important implications for the balance of structure and human agency in the explanation of the Holocaust: where the universalism narrative emphasizes the role of impersonal structures in mediating human action, the particularism narrative highlights the agency of human actors. Although historical accounts usually combine these narratives, recent research on the Holocaust tends in the universalist direction, and this bears on the sensitive issue of responsibility for the Holocaust by problematizing the common-sense notion of the perpetrators' intention and responsibility. Goldhagen is responding to this trend, but by retreating to the particularism narrative and employing an inadequate definition of intention, he fails to move the debate forward. It is time to rethink the concept of intention in relation to events like the Holocaust. (shrink)

Various meanings of “rational” implicitly and explicitly suggested in this issue's articles are abstracted and stated. Two accounts of rationality are shown to be able to explain most uses of “rational”: the “cool moment” account and a more objective account. The former is examined and modified, but still found inadequate. The objective account of rational is developed, taking “irrational” as the basic concept. “Irrational” is given content in terms of a list, and “rational” is subsequently defined as “not irrational”. Reasons (...) and motives are defined and distinguished. The advantages of the objective account are explored and some challenges to it are answered. (shrink)

Jaspers’s autobiography presents reflection upon the career and work of one of Germany’s leading existential philosophers. He describes briefly his early life and offers reflection upon his study and work in psychiatry. One can readily find the seeds of his later philosophical reflections evident in his General Psychopathology. Jaspers also presents illuminating discussion of his academic career, his political reflections, and comments upon the relationship of his philosophical analysis to his theological orientation. He offers extended discussion of each of his (...) major philosophical books, with insight into the origin and intentions of each volume. In addition, he presents valuable comments upon the philosophical climate of Germany against which he succeeded in reacting with vigor. Special attention is given to Rickert and E. Mayer. His rather detailed description of his relationship with Heidegger is especially illuminating. Although both of these thinkers played a leading role in the development and elaboration of German existentialism, there has been little direct and explicit consideration of the works of one by the other, or comments upon their "Being-With." Jaspers tells of his early and friendly relationship with Heidegger, their long working conversations, how their thought wandered down different pathways, and his reaction to Heidegger’s involvement in the rise of National Socialism. He also writes of his reaction to Heidegger’s Being and Time, of his unfulfilled intention to write seriously upon this work, and of how divorced his own thought was from Heidegger’s way, so that it did not even affect his own philosophical development. He describes the gradual cooling of the early friendship, and the eventual cessation of the long conversations and visits. All of the above offers a more intimate glimpse into the intersubjectivity of two of Europe’s leading thinkers, as seen by one of the participants, than has been readily available to the Western public to date. Whitehead, his senior collaborator in the classic work on mathematical logic which established his philosophical reputation, Bertrand Russell once provoked the exasperated remark: “Bertie, you’re an aristocrat, not a gentleman”. To-day having matured in the lived experience of eighty-five years and having spanned this century with widely-publicised books, articles and lectures, Russell remains a living paradox in whom the cool logician, the social prophet and the tantalising polemist have yet to achieve integration. Issuing from an established intellectual (...) family with a precociously questioning mind and a moral courage equal to the assertion of any truth, educating himself to a razor-keen mind and a mastery of lucid prose, he has adopted the public role of a witty sophist as well as an iconoclast angry with conservative convention in moral, social and religious conduct. Theoretically practical conduct is a realm of private feeling and not of objective truth in his philosophy, which he implements with literal freedom. Nevertheless he must be conscious that his polemic often falls short of the standard of a disciplined respect for truth, though he might explain away this defect by referring to the accepted rules of the game which he plays…hard. Yet his biographer notes that he resents criticism of his moral and social writings more than of his purely academic work. And his aim, as expressed in a letter from Brixton prison in 1918 where an embarrassed government confined his biting pacifism, is constructive: “There is a little wisdom in the world; Heraclitus, Spinoza, and a saying here and there. Architectural style is a medium for the promotion of cultural identities and cohesion. South Asian Association for Regional Cooperation nations provide a prism through which all forms of vernacular architecture can be viewed. This study is presented through the lens of the soul of the eye coupled with the power of technological probing. This synthesis affords a most appealing and lyrical exploration of the course of the development of cities within the SAARC nations. It showcases research results combining the above (...) stated synergy—starting from some of SAARC’s sophisticated historic cultures, cultures that ebbed and flowed along its shores and valleys. This paper shall touch upon unique cultural roots stretching back to the Dravidian civilization that flourished over 3500 years ago and also look at the grouping of houses within the Indus Valley Civilization in Lothal and the Sarasvati Valley Civilization in Kalibangan. The sensitivity underlying SAARC architecture and its traditions are seen in many communal settlements, profoundly so in the Indian subcontinent and in Sri Lanka. The paper shall showcase two specific, but nevertheless, distinct styles of communal functioning within unique architectural strongholds in the ancient Ratnagiri University in Odisha, India, and also touch upon a unique blend of styles of landscape architecture in Sri Lanka. The overarching emphasis of this study is that throughout SAARC’s history, architecture has been creatively adopted to the need of its users and the characteristics of its climate and location. It has always fulfilled the needs and nourished the spirit of its people, promoting cultural cohesion even today. In this context, it is interesting to explore traditional techniques of vernacular architecture in houses in Andhra, Tamil Nadu and Kerala. The common thread linking mass housing in Lothal, Kalibangan, Anuradhapura and Ratnagiri about 2 millennia ago, with present day housing patterns, is in the application of sustainable building practices using intelligent building forms, fabric and orientation. This paper explores this commonality from a modern perspective using CFD. As the SAARC countries still struggle to get a fuller understanding of their unique ecology and the complexity of their diverse cultures, revisiting the architectural legacy of their indigenous societies might prove insightful. The need for this revisit becomes even more relevant in the wake of the Paris Agreement and more recently the Kigali Agreement. The discourse on providing indoor thermal comfort to the SAARC people cannot be decoupled from the climate change story—heating, ventilation and cooling consume a large amount of energy and have a deep underlying link with the targets set at Paris and Kigali. The onus will be on a large number of stakeholders to meet these targets—engineers, architects, manufacturers, policy-makers, researchers and consumers. This paper aims at reminding the stakeholders of the richness and the usefulness of their vernacular architecture in upholding the ideal of sustainability. (shrink)

Ground-coupled heating-cooling systems (GCHCSs) exchange heat between the built environment and the subsurface using pipework buried in trenches or boreholes. If heat pumps in GCHCSs are powered by “green electricity,” they offer genuine carbon-free heating-cooling; for this reason, there has been a surge in the technology in recent years. Interference between adjoining installations is being reported, raising issues of sustainability in terms of performance, equitable sharing of natural resources, and localized ecological impacts. Using an analytical model for heat transport in (...) porous media, sensitivity analyses have been obtained for open-loop systems in typical hydro-geological settings for urban GSHCSs in the United Kingdom, revealing that breakthrough of injected water will likely lead to significant declines in system performance in less than 25 years for well spacings less than 300 m, unless injection rates are kept below 250 m3/d. Only by cooperatively planning will adjoining landowners in urban areas achieve large-scale sustainable system designs. (shrink)

This paper puts Jane Bennett’s vital materialism into dialogue with Luce Irigaray’s ontology of sexuate difference. Together these thinkers challenge the image of dead or intrinsically inanimate matter that is bound up with both the instrumentalization of the earth and the disavowal of sexual difference and the maternal. In its place they seek to affirm a vital, generative materiality: an ‘active matter’ whose differential becomings no longer oppose activity to passivity, subject to object, or one body, self or entity to (...) its ‘other’. For both thinkers, displacing the hylomorphic conceptual structures that have tended to dominate western metaphysical thought is inseparable from critiquing the model of the individual subject as bounded, autonomous and self-identical. Such individualism is countered by the relational ontologies figured in Bennett’s ‘distributed agencies’ and Irigaray’s ‘placental economy’, and by a shared attentiveness to the capacities of the human body to bear others within. Nonetheless, this paper argues that each thinker renders this ‘other within’ in very different ways. On the one hand, Bennett’s approach complements and expands Irigaray’s notion of the elemental by affording a greater attentiveness to inorganic and non-sexuate matters. On the other, Irigaray’s conception of generative relationality and the ontological priority of the in-between allows us to think such material entanglements in ways that more fully displace the twinned logics of individualism and instrumentalization. Her project thereby affirms the relational and irreducible differences on which the ‘vitality’ of a vital materiality depends. If there is no more “earth” to press down/repress, to work, to represent, but also and always to desire, no opaque matter which in theory does not know herself, then what pedestal remains for the ex-sistence of the “subject”? If the earth turned and more especially turned upon herself, the erection of the subject might thereby be disconcerted and risk losing its elevation and penetration. For what would there be to rise up from and exercise his power over? And in? Irigaray, Speculum of the Other Woman Jane Bennett has recently argued that “the image of dead or thoroughly instrumentalized matter feeds human hubris and our earth-destroying fantasies of conquest and consumption”, continuing that: “The figure of an intrinsically inanimate matter may be one of the impediments to the emergence of more ecological and more materially sustainable modes of production and consumption”.11J. Her sustained analysis of western thought and culture shows how its constitutive disavowal of sexual difference and the maternal is inextricably bound up with an equally deep-rooted disavowal of matter and corporeality. View all notes Irigaray seeks to expose woman's reduction to an object for a subject and a maternal-material resource for man's speculations; but in disentangling woman from her symbolic identification with the earth, she also seeks to release the earth from its identification with a passive and manipulable matter. Her work thus bears directly on the revaluation required to transform human beings' relations to materiality: both their own, and that of the earth they inhabit. At the centre of this revaluation is Irigaray's work to displace the image of dead or intrinsically inanimate matter that Bennett also critiques, and to affirm instead a sexuate materiality that is both living and generative. Her consistent troubling of hylomorphism is as unsettling for the subject as her question: “But what if the ‘object’ started to speak?” This question is echoed in Bennett's concern with “the moment when the object becomes the Other, when the sardine can looks back, when the mute idol speaks”.33 VM, 2, citing W.J.T. View all notes As this passage indicates, Bennett's own project is more concerned with the agency of non-human materialities – including their role in the constitution of the human – than with specifically sexed bodies or a materiality inflected by sexual difference. It is these crucial differences in emphasis, I will suggest, that allow the work of these two thinkers to be brought together in productive dialogue. On the one hand, Bennett's approach affords a greater attentiveness to inorganic and non-sexuate matter; on the other, Irigaray's twinned ontology of sexual difference and maternal relation is better able to affirm the relational differences on which the “vitality” of a vital materiality depends. The paper begins by outlining several key elements of Irigaray's philosophy of sexual difference to show how it leads necessarily to a rethinking of matter. This rethinking is especially helpful for shifting away from the hylomorphism that has been a dominant strand in western thought, informing an understanding of the earth as a fundamentally inert and ever-ready resource. As I will show, the figures through which Irigaray re-articulates female specificity also allow her to refigure the earth as active matter that “turns upon herself ” in generative flux. In the second section, I will situate Irigaray's re-thinking of matter in relation to Bennett's “vital materiality”.44Bennett can be aligned with a number of thinkers who have come to be grouped under the heading “new materialisms”. By attending to “our own constitution as vital materiality”, as well as the ways our “own” bodies are never “fully or exclusively human”, Bennett adjusts the status of human actants while re-evaluating non-human bodies “as actants rather than as objects”. As I will show, her approach provides a constructive critical perspective on Irigaray's work by drawing attention to the specifically non-sexuate nature of the elemental. Equally, however, Irigaray's insistence on sexuate difference problematises any appeal to a generic notion of “the human”. This is especially helpful, I will suggest, in relation to contemporary descriptions of climate change as “anthropogenic”. By homogenising human beings, such descriptions make it more difficult to address the ways in which current ecological problems are inseparable from global patterns of social, political and economic inequity. For both thinkers, challenging hylomorphism needs to be matched with a critique of the dominant modern model of the subject as bounded, autonomous and self-identical. And for both, this model is displaced and undone by the capacity of the human body to bear others within, in ways that engender and sustain human life. Yet as I will discuss in the final two sections, each thinker renders this “other within” in very different ways, with significant implications for the ethics and politics of a “vital materiality”. In the end it is Irigaray's rendering of a distinctively female capacity to bear an other within, explored via the generative relationality of a placental economy, that more fully escapes the individualism of the One and the Same. Together, Irigaray and Bennett show that to take seriously the ecological crises that currently confront us means overcoming the disavowal of both human beings' own fundamental materiality and our dependency on the sustaining materialities of the earth. In contrast, a dominant strand in contemporary responses to these crises is an environmental politics of “enlightened self-interest”55I borrow this phrase from H. Kopnina's critical discussion in “Forsaking Nature? Contesting ‘Biodiversity’ Through Competing Discourses of Sustainability”, Journal of Education for Sustainable Development 7, no. 1 : 51–63. that precludes any serious re-evaluation of human beings' relations to matter and the earth. If human beings can be persuaded that current levels of environmental degradation are damaging to them, threatening perhaps their very survival, they are more likely to take decisive steps to alter their behaviour. Insofar as such approaches demand action only for the sake of human interests and ends, they are both anthropocentric and spring from the same instrumentalising rationality that has engendered the ecological crises we currently face. They may well be successful in prompting action. But by foregrounding the survival of “the human species” per se, such approaches foreclose discussion of whose interests are served if survival is all that is allowed to be at stake, and whose lives are thereby consigned to ongoing exploitation. Moreover, as I will argue below, the instrumental rationality that serves survival is at odds with an affirmation of life, as a becoming that depends on difference. With this in mind, I will problematise Bennett's proposed politics of “expanded self-interest”, while seeking to retain many of the insights her approach brings. To more fully displace the “rational” self-interest that has encouraged human exploitation of the earth, we might take up Bennett's “vital materiality” in ways informed by Irigaray's conception of generative difference and the relational space-time of the in-between. Nineteenth-Century Scholasticism was first published under,the title Catholic Theology in the Nineteenth Century by The Seabury Press in 1977, but it has been re-issued hy Fordham University to ruocompany the appearance of his second volume. In this earlier work McCool ohal'ts in detail the growth and 301 30~ ROBERT E. LAUDER d.wection of scholasticism, especially in relation to two influential Chmich documents: the Apostolic Consititu.tion on Faith Dei Filius, solemnly app:rovced in 1870 by the fathers of the First Vatican Council, and Leo XIII's 1879 encyclical Aeterni Patris. The,earlier,document defined and darified the Church's teaching on the supernatural and free charac1te:r of faith and on the relation between supe:matural faith and natural reason; the encydical was a disciplinary document concerning the method of philosophicaJ instruction for priests. McCool \Stresses that the linking of the two documents in the minds of Roman authorities and theologians gave the documents enormous weight and influence during the nineteenth and well into the twentieth century, but now, more than a hundred years fater, their influence is being and r'easses:sed. Though the present situation in Catholic philosophical and theological circles is not a case history reversing itself, it is an extra011dina :ry example of history leruding to the l'eopening of questions ithat,seemed definitivdy dosed. McCool suggests that there are at ~east two factors affecting contemporary Catholic theology which indicate that ·current historical research into nineteenth-century Catholic theology may point to a genuine option between a deveJoped Thomism and a restored pre-Thomistic nineteenth century system: The first of these is the freedom given to Catholic theologians by the Second Vatican Council to experiment with non-Thomistic theological systems. Aetelf'ni Patris no longer enjoys the status of an irrevocable theological option, based on immutable dogmatic and metaphysical principles. Its theological signification has been relativized. Aeterni Patris must now be considered an historical moment in the dialectical progress of theological development. The second distinctive characteristic of contemporary theology is the current ferment over theological method. This means that the nineteenth-century debate, which the official option of Aetelf'ni Patris seemed to have closed definitively, has been reopened. The disciples of SL Thomas and the partisans of the ' new ' theologies are free once more to submit their diverse theological methods to the judgment of their fellow theologians. The present article was partly inspired by G. Pollack’s book, and also Dadoloff, Saxena & Jensen (2010). As a senior physicist colleague and our friend, Robert N. Boyd, wrote in a journal (JCFA, Vol. 1, No. 2, 2022), for example, things and Beings can travel between Universes, intentionally or unintentionally [4]. In this short remark, we revisit and offer short remark to Neil Boyd’s ideas and trying to connect them with geometry of musical chords as presented by D. Tymoczko and (...) others, then to Escherian staircase and then to Jacob’s ladder which seems to pointto possibility to interpret Jacob’s vision as described in the ancient book of Genesis as interdimensional staircase, e.g. an interdimensional bridge between heaven and earth (cf. classic book: Hofstadter, Godel, Escher, Bach). Jacob’s vision of angels going down to earth from that staircase has been depicted for instance in William Blake art etc. In our communication with others via physics literature and discussions etc, we came to several conclusions as follows: Firstly, possibility of wormhole effect to mirror particle universe, which sometimes it is termed non-orientable wormhole. While such mirror particles effect have been more than 50 years predicted with the so-called parity violation (cf. Lee & Yang, 1950s), and that is called symmetry breaking. Secondly, a series of extended experiments on laser irradiated cold water may suggest possible transition from a phase of water to be at least partially fourth phase of water, which may be composed of crystalline water (see e.g. Gerald Pollack, and also Harold Aspden on liquid crystalline). If we can imagine laser cooling effect can be done in protracted time, then we can achieve a physical representation of Aspden‘s liquid crystalline. Therefore, in this article we outline a series of simple experiments of laser irradiated iced-water along with beryl and selenite crystals in order to see possibility of such a quantum tunneling via quantum liquid crystalline Universe hypothesis, which may likely be modeled with iced-water. It is interesting to remark here that certain experiments by Stockholm University scientists have shown that X-ray triggered water can exhibit properties just like liquid crystal (cf. PRL, 2020). That is why we consider it possible that there can be quantum phase transition where liquid water (comprised of iced cubes and water) can exhibit effects such as tunneling in quantum liquid crystalline Universe. Last but not least, we admit that what we outlined here is just aninitial phase; and if you wish, perhaps we can call such experiments as “wormhole-at-lab” experiments (abbreviated: WHALE). (shrink)

Screening programmes are becoming increasingly popular since prevention is considered 'better than cure'. While earlier diagnosis may result in more effective treatment for some, there will be consequent harm for others due to anxiety, stigma, side-effects etc. A screening test cannot guarantee the detection of all 'abnormal' cases, therefore there will be false reassurance for some. A proper consideration of the potential benefit and harm arising from screening may lead to the conclusion that the programme should not be offered. A (...) modified utilitarian approach may be used for allocation of scarce resources in health care. Ethics has an important role in this evaluation. (shrink)

McCarthy (bio)The requirements for prior, legally authorized informed consent constitute a necessary condition for recruiting subjects into biomedical or behavioral research. However, informed consent requirements pose a serious problem for most research conducted in emergency care settings. For this reason, the Food and Drug Administration's (FDA) regulations governing investigational devices and the Department of Health and Human (...) Services' (HHS) regulations for the protection of human subjects allow narrow exceptions to the general requirements of informed consent. In a joint effort to clarify the applicability of the current FDA regulations and to better understand the intent of the HHS regulations as they apply to emergency research, the FDA and the National Institutes of Health (NIH) cosponsored a public forum on the ethical conduct of emergency research in January 1995.Although the forum was not designed as a consensus conference and participants vigorously disagreed on some of the details, a broad consensus emerged on several major points: (1) both HHS and FDA regulations should, in the immediate future, be interpreted to allow for randomized clinical trials in emergency situations so long as the subjects are carefully protected; and (2) consideration should be given to producing new, closely harmonized regulations from both agencies that will provide greater clarity concerning what kinds of emergency research may be allowed without obtaining prior informed consent.The FDA-NIH forum in January was occasioned primarily by controversy about the hypothermia research protocol described below, but it is obvious that many other kinds of emergency research also await the outcome of deliberations concerning waiver of informed consent in emergency situations. These include research into the care and treatment of: occlusive stroke; subarachnoid hemorrhage due to intracranial aneurysm; metabolic coma; status epilepticus; cardiac arrest; myocardial infarction; cardiac arrhythmia; hemorrhagic shock; pulmonary embolism; acute asthmatic attack; and poisoning. The protocol, which involves the use of cooling blankets to induce hypothermia in patients suffering from severe head injuries, is designed to test the hypothesis that: "Early lowering of the body temperature of patients suffering from severe head trauma to approximately 91 degrees Fahrenheit will slow patients' metabolism and will/will not, as a consequence, reduce the rates of both morbidity and mortality in these patients." The protocol was approved by seven Institutional Review Boards (IRBs), each of which waived the requirement to obtain informed consent from research subjects in accordance with Sec. 46. 116(d) of the HHS Regulations for the Protection of Human Subjects.1However, NIH's Office for Protection from Research Risks (OPRR), which is responsible for assuring compliance with the HHS regulations, has taken a controversial regulatory position by requiring informed consent from a legally authorized representative of each subject to be entered in the hypothermia trial. Because the obtaining of surrogate consent has proved to be very difficult, OPRR's position has slowed the research to a point where it may have to be terminated.At issue in the controversy is a fundamental question of ethics and public policy. Is it ever permissible to involve incompetent subjects in research without either their consent, or the consent of their legally authorized representatives? Pertinent HHS regulations for the protection of human subjects seem to answer the question affirmatively by allowing local IRBs to waive some or all of the elements of informed consent under carefully limited circumstances (45 CFR 46 116(d)). But first I should like to examine some of the standard criticisms of this theory and some alternative views that are currently in favour. Both in the Treatise and the Enguiry Hume maintains that reason alone never motivates action but always requires the cooperation of some separate, and separately identifiable desire-factor in order (...) to bring about action. What are Hume's grounds for this view? In the Treatise. Hume writes: 'Tis obvious, that when we have the prospect of pain or pleasure from any object, we feel a consequent emotion of aversion or propensity, and are carry 'd to avoid or embrace what will give us this uneasiness or satisfaction.... 'Tis from the prospect of pleasure or pain that the aversion or propensity arises towards any object.... This passage suggests that the way we (and Hume) know about the presence of the separate desire factor which he claims is always needed to motivate our every purposive action is by being directly aware of some desire-feeling, by introspection, each and every time we act. There is however a familiar objection to this argument: no doubt we sometimes are aware of a feeling of desire when we act, e.g., in cases where we are motivated by strong emotions. But much of the time when we act calmly or casually, after having deliberated 'in a cool hour', or when performing routine and trivial acts, we are not directly aware of any desire-feeling at the time of action. 164 Hume is not unaware of this objection -- in reply to it he invokes his notorious doctrine of the calm passions. He writes: 'Tis natural for one, that does not examine objects with a strict philosophic eye, to imagine, that those actions of the mind are entirely the same, which produce not a different sensation, and are not immediately distinguishable to the feeling and perception. Reason, for instance, exerts itself without producing any sensible emotion; and except in the more sublime disquisitions of philosophy, or in the frivolous subtilities of the schools, scarce ever conveys any pleasure or uneasiness. Hence it proceeds, that every action of the mind, which operates with the same calmness and tranquillity, is confounded with reason by all those, who judge of things from the first view and appearance. Now 'tis certain, there are certain calm desires and tendencies, which, tho' they be real passions, produce little emotion in the mind, and are more known by their effects than by the immediate feeling or sensation. These desires are of two kinds; either certain instincts originally implanted in our natures, such as benevolence and resentment, the love of life, and kindness to children; or the general appetite to good, and aversion to evil, consider 'd merely as such. When any of these passions are calm, and cause no disorder in the soul, they are very readily taken for the determination of reason, and are suppos'd to proceed from the same faculty, with that, which judges of truth and falshood. Their nature and principles have been suppos'd the same, because their sensations are not evidently different. (T 417) The most obvious application of this argument would be to cases of cool, seemingly passionless 165 deliberation: e.g., in the course of planning the family budget I set aside funds for the children's education. A cursory inspection (or recollection) of the contents of my conscious mind at the time of acting would reveal to me some purely rational considerations that I had in mind at the time. I had some thoughts at the time whose contents are (roughly) expressible in such words as "If I don't put aside so much per month over so many years we will never be able to see them all through university." But cursory introspection or recollection would not detect any separately identifiable desire-factor present to my conscious mind at the time. Considered philosophical examination, Hume assures us, will reveal one, a 'calm' one -- in this case calm 'kindness to children'. After discussing de Sousa's view of emotion in akrasia, I suggest that emotions be viewed as nonconceptual perceptions of value (see Tappolet 2000). It follows that they can render intelligible actions which are contrary to one's better judgment. An emotion can make one's action intelligible even when that action is opposed by one's all-things-considered judgment. Moreover, an akratic action prompted by an emotion may be more rational than following one's better judgement, for it may be the judgement and not the (...) perception which is in error. By contrast, "cool" akrasia is genuinely puzzling; it is not clear whether it exists. (shrink)
