The central part of this article deals with the morality of secession. We present the three main "pure" theories about the morality of secession and suggest the greatest justifying power of an "impure" or mixed theory. At the same time, however, we advocate the need for a proper understanding of the question of the morality of secession. More specifically, we suggest that the best way to raise it is by introducing the notion of "reasonableness" into the question itself.

One of the most complex and uncertain areas of international legal doctrine concerns how to deal with the aspiration of a people to achieve self-determination through the establishment of a new state and the related claim to a specific territory over which statehood is to be exercised. Recently, when the General Assembly of the United Nations referred to the International Court of Justice the question of the legality of the declaration of independence by Kosovar Albanians, the Court was (...) given an opportunity to clarify and develop the law on external self-determination. Instead, the Court answered extremely narrowly, confining its analysis to the legality of the act of declaration without determining any consideration of international legal norms applicable to the act of secession that was being proposed. This article intends to fill the gap left by the ICJ’s decision: first by critiquing the inadequacy and tensions visible in the existing doctrine and second by examining how recent developments in international law may allow for a more normatively coherent approach to the problem. It is commonly supposed that at least some states possess a moral right against external intervention in their domestic affairs and all human rights violations give members of the international community reasons to undertake preventive or remedial action against offending states. No state, however, currently protects or could reasonably be expected to protect its subjects’ human rights to a perfect degree. In view of this reality, many have found it difficult to explain how any existing or readily foreseeable state (...) could enjoy a moral right of nonintervention without denying the normative force of human rights. This article seeks to reconcile these apparently incompatible commitments by arguing that, in addition to acting in defense of human rights, outsiders must be appropriately responsive to individuals’ distinct and potentially countervailing interests in collective self-determination. I show that, under certain demanding but not unrealistic conditions, individuals’ interests in self-determination are of sufficient weight not simply to ground a judgment against intervention in particular cases but to generate arobust right of nonintervention on the part of some states that nevertheless fail to secure perfect protection of their subjects’ human rights. The article analyzes the phenomenon of national self-determination in terms of evolution and functioning. The authors aim to determine the general characteristics and evolution of this phenomenon in both conceptual and applied versions. In the evolution’s context of national self-determination as a theoretical concept and a political and legal principle, several stages were identified and considered. According to the authors, each stage of the phenomenon’s evolution was inevitably accompanied by its qualitative transformations, both in political and (...) legal terms. The first stage (from the end of the XVIII c. till the First World War), according to the authors, is characterized by the emergence of the idea and the formation of the socio-political concept of national self-determination, and the applied aspect of the phenomenon of national self-determination is filled with concrete content based on the ever-expanding political practice of its application. The second stage (from the First World War and the post-war reconstruction) is characterized by the transformation of self-determination from a concept into a political principle. The authors associate the third stage of the evolution of the phenomenon of national self-determination (the period after the Second World War) with the development of international relations and the formation of a global bipolar system. National self-determination turned into a principle of positive international law and laid the foundations for the future political instability of the newly independent states. Finally, the last period (the early 90s to this day) is characterized by the search and crystallization of new approaches to the principle of national self-determination and the emergence of new theories, the authors of which are trying from a political and legal point of view to substantiate the legitimacy of an expansive interpretation of this principle. The analysis allowed us to conclude that the qualitative transformations of the principle of national self-determination presented in the article did not lead to the formation of the phenomenon of national self-determination as an integral, complete, and universally recognized international political and legal norm. Why should we have a system of different states that each claim both internal and external sovereignty? How can the state gain its legitimate authority to rule? What is the problem with the ideal of the ‘global citizen’? How should states respond to different groups’ secession claims? To what extent should states have the right to control their borders? If one finds such questions intriguing, one should read Anna Stilz’s book Territorial Sovereignty: A Philosophical Exploration. Stilz argues that a (...) system of territorial states serves to protect important values – occupancy, basic justice and collective self-determination – which are key to living an autonomous life. I focus on the theory’s implication for the debates on border control. I contend that Stilz’s arguments still have difficulties grounding the state’s right to exclude would-be immigrants. That said, the book has done a great job in providing a liberal theoretical framework for us to reflect upon citizenship, immigration, succession claims, cosmopolitan ideals, the colonial legacy and disputes over borders and resources. This article explores the synthesis between the theories and practice of Humanistic Management and Self-Determination Theory of Motivation (SDT). Moving from Economistic to Humanistic Management involves considering human action as uniting internal and external dimensions, having ethics as a guide for a good life, viewing society as a community of people, and being open to beauty and transcendence. The recently elucidated 50-year legacy of SDT describes it as a truly human science of motivation that takes into consideration (...) our attributes as persons, including our capacities for awareness and self-regulation. It also focuses on one’s capacity for autonomy as it applies to individual functioning, interpersonal relationships, and societal interactions. SDT posits a continuum of motivational regulation ranging from amotivation through controlled to autonomous motivation. The current empirical study of Millennials' motivation to support local and global hunger charities based on social media communication employs the complete SDT continuum. Digitalization and globalization have fundamentally changed the nature of human communication. Millennials are central to the humanistic functioning of today’s society. The study findings of the dominance of integrated personal value autonomy demonstrates the necessity of assessing the complete set of SDT motivations in various contexts and situations. Given that SDT and Humanistic Management investigations have mainly involved corporations, one must also be open to investigating the humanistic management of non-profit social and governmental organizations. The non-greenwashed triple sustainability values of corporate, social and environmental good are pertinent targets for Humanistic Management research and Practices. (shrink)

Purpose: Our aim was to determine if self-determined motivation (SDM) in elite, men’s soccer changes over time and differs as a function of age, skill-grouping, and engagement in soccer play and practice. We tested predictions from the Developmental Model of Sport Participation (DMSP) regarding relations between practice and play and SDM among both elite and non-elite samples. Methods: Elite youth soccer players in the UK (n = 31; from the Under 13/U13 yr and U15 yr age groups) completed practice (...) history and motivation questionnaires at time1 (T1) and ~2 years later (T2: now U15 yr & U17 yr). Non-elite players (n = 32; from U15 yr and U17 yr) completed the same questionnaires at T2 only. Results: For the elite groups, global SDM decreased over time for the current U17 group (from U15), but no change was seen for the current U15 group (from U13). Age group differences at T2 mirrored these data, with U17 players showing lower global SDM and higher controlled motivation than U15 elites. The non-elite players did not show age group differences, but elites scored higher for global SDM and autonomous motivation than non-elites. The recent hours accumulated in practice negatively correlated with global SDM in elite and non-elite groups, but play was unrelated to measures of motivation. Conclusions: Differences in SDM as a function of age and skill point towards the dynamic nature of these motivations over time, likely a result of proximity to external rewards related to professional status. Although high volumes of practice are related to lower global SDM in both skill groups, the absence of any relations between SDM and soccer play does not support a key prediction related to the DMSP. Push-pull theory, consumer decision-making models and rational choice theory are commonly used to explain international student mobility. Despite their merits, the individual’s motivation to study abroad is ignored. Based on two motivation theories—expectancy-value theory and self-determination theory, this study examines whether students’ intention to study abroad originates from the students themselves or compromises social pressure and how the external factors defined in push-pull theory work with these motivations to affect their decision-making. A quantitative study was conducted with (...) a sample size of 736 international students in China. The findings show that the decision to study abroad is a highly subjective and intrinsically driven behavior in which realizing one’s self-worth or fulfilling one’s purpose of life plays the most significant role. Making a decision needs a “cost-benefits calculus,” but the utility value of study abroad was positioned behind attainment value and identified motivation. The heterogeneity of international students’ motivation was also differentiated by both their gender and their parents’ educational backgrounds. (shrink)

A study of clinical medical ethicists was conducted to determine the various philosophical positions they hold with respect to ethical decision making in medicine and their various positions' relationship to the subjective-objective controversy in value theory. The study consisted of analyzing and interpreting data gathered from questionnaires from 52 clinical medical ethicists at 28 major health care centers in the United States. The study revealed that most clinical medical ethicists tend to be objectivists in value theory, i.e., believe that value (...) judgments are knowledge claims capable of being true or false and therefore expressions of moral requirements and normative imperatives emanating from an external value structure or moral order in the world. In addition, the study revealed that most clinical medical ethicists are consistent in the philosophical foundations of their ethical decision making, i.e., in decision making regarding values they tend not to hold beliefs which are incompatible with other beliefs they hold about values. In “The Blessing of Departure—Exchange of Populated Territories The Lieberman Plan as anExercise in Demographic Transformation,” Prof. Timothy Waters offers a strong endorsement of the right of ethnic majorities within a state to redefine their state's boundaries in ways consistent with the majority's right to self-determination and to opt out of a political union with minority groups, regardless of the latter's' political preferences. Applied to the Israeli context, Waters concludes that parts of the Lieberman Plan—a plan advocating the (...) redrawing of Israel borders, inter alia, in ways which exclude some areas populated by Israeli citizens belonging to the Arab-Palestinian minority —does not run afoul of international law . This short response challenges two points that are central to Waters’s analysis. First, that the right to self-determination of peoples—in particular, the right to external self-determination —is subject to temporal or contextual limitations. The right is fully applicable only in exceptional and formative moments in the life of a nation—e.g., during the formation of a new polity or the collapse of an existing political arrangement , and when states systematically fail to respect the basic interest of some of the groups that comprise its populace—i.e., in response to extraordinary situations of groups exclusion or oppression. Second, even if Waters is correct and an ongoing right to self-determination—including, a right to secede from existing states—is available to ethnic groups comprising diverse national societies, the invocation of such a right must necessarily be limited by other positive rules of international law designed to protect group and individual interests. Specifically, Waters’s concept of self-determination as a right of a preliminary nature, that overrides other human rights , is debatable. (shrink)

The aim of this study was to validate the Polish adaptation of the Treatment Self-Regulation Questionnaire, which measures the degree of self-determination in risk behaviour changes. The study comprised 219 patients, beginning to undergo treatment. The Global Motivation Scale was used to test a convergent validity. The confirmatory factor analysis did not support the theoretical four-factor model, thus an exploratory analysis was conducted to determine an optimal model across risk behaviours. The adopted two-factor model matched original TSRQ (...) subscales: autonomous motivation and external regulation. The internal consistency of factors ranging from.78 to.89. Structural equation modeling revealed the impact of global motivation on contextual motivation, limited to the equivalent type of regulation. The action aimed at supporting patient’s autonomy should consider the particular behaviour and the global motivation as a resource in disease. (shrink)

IntroductionDespite the fact that group fitness instructors serve as significant role models with potentially great impact on class participants' motivation for exercise, they are a very under-researched group. The aim of this study was therefore to examine group fitness instructors' motivational regulations for exercise, and how these motivational regulations can predict symptoms of exercise dependence and body image concerns.MethodsGroup fitness instructors from the largest fitness companies in Norway completed an online survey with reference to the Situational Motivation Scale, the Exercise (...) Dependence Scale, the Eating Disorders Inventory subscales drive for thinness and body dissatisfaction, and their weekly amount of exercise and instruction.ResultsThe instructors scored high on identified regulation and intrinsic regulation for exercise. EDS total score was positively correlated with all SIMS subscales and weekly instruction was positively correlated with Intrinsic regulation. Multiple hierarchical regression analyses found that both self-determined motivational regulations as well as external regulation positively predicted their EDS score. External regulation positively predicted EDI-DT, and EDI-BD.ConclusionGroup fitness instructors seem highly intrinsically motivated for exercise, which is hypothesized to have a positive impact on group fitness class participants. High self-determined exercise behavior does not seem to buffer against symptoms of exercise dependence within this specific population. There is a need for awareness of group fitness instructors who show high exercise dependency scores due to the link to body image concerns, amotivation and external regulated motivation. (shrink)

ObjectiveThe study aimed to enhance the learning motivation of college physical education students and improve their learning outcomes. Based on the perspective of the self-determination theory, this study explores the influence of “Small Private Online Course + flipped classroom” teaching on the learning motivation of students majoring in physical education and profoundly analyzes the influencing factors and promotion paths of learning motivation using this model.Materials and methodsA total of four classes of physical education majors in a university were (...) selected and randomly divided into an experimental group and a control group. The experimental group received “SPOC + flipped classroom” teaching, the control group received traditional teaching. Before and after the 16-week intervention, learning motivation, teacher support perception, basic psychological need satisfaction, and academic emotions of the 64 students were measured, and the data were analyzed by repeated-measures analysis of variance and partial least square regression.Results The instructional intervention reduced non-regulation, external regulation, and introjected regulation, while increased identified regulation, intrinsic regulation, and self-determination levels in the students. The levels of non-regulation, external regulation, identified regulation, and self-determination were also significantly different from those of the control group. After the intervention, the scores of support for autonomy, support for competence, support for relatedness, and need for relatedness in the experimental group were significantly higher than those in the control group. Support for autonomy, support for competence, support for relatedness, need for competence and need for relatedness positively predicted the self-determination level, and intrinsic regulation and identified regulation negatively predicted non-regulation, external regulation, and introjected regulation.Conclusion“SPOC + flipped classroom” teaching has a positive impact on students’ learning motivation of basketball skills and promotes students’ motivation autonomy. The improvement of support for autonomy, support for competence, support for relatedness, need for competence, and need for relatedness may be related to the improvement of learning motivation of college students majoring in Physical Education. “SPOC + flipped classroom” teaching enables students to obtain more demand satisfaction by giving them more demand support, while demand support and demand satisfaction can promote the internalization of learning motivation so that students can maintain high autonomy motivation. OBJECTIVES: The subject of patient self-determination in health care has gained broad interest because of the increasing number of incompetent patients. In an attempt to solve the problems related to doctors' decision making in such circumstances, advance directives have been developed. The purpose of this study was to examine relationships between public attitudes towards patient autonomy and advance directives. SUBJECTS AND MAIN OUTCOME MEASURES: A stratified random sample of 600 adults in northern Sweden was surveyed by a questionnaire (...) with a response rate of 78.2%. The subjects were asked about their wish for control of their health care, their concerns about health care, their treatment preferences in a life-threatening situation (both reversible and irreversible), and their attitudes towards the application of advance directives. RESULTS: Numerous relationships between various aspects of self-determination in health care (desire for control, fears of over-treatment, and choice of treatment level) in general and advance directives, in particular, were found. Those who wanted to have a say in their health care (about 94%) also mainly supported the use of an advance directive. CONCLUSIONS: The fact that almost 30% of the respondents were undecided concerning their personal use of advance directives points to a lack of knowledge and to the necessity of education of the public on these issues. The self- vs. external-regulation behavior theory, SR-ER Theory model has postulated the Self-Regulation /Non or De-Regulation/Dys-regulation continuum in the person and in their context. The model also generates a behavioral heuristic that allows us to predict and explain the variability of other dependent behavioral variables in a range of scenarios. Consequently, the objective of this study was to validate the different scales prepared on the basis of the theory presented. A total of 469 students voluntarily completed at (...) different times the five questionnaires presented, to give a total of 1,385 completed questionnaires. Using an ex post facto design, descriptive, correlational, confirmatory factorial analysis, reliability, and concurrent validity analyses were carried out. The scales were analyzed individually and as a whole. The results showed the acceptable structure of scale and consistent levels of reliability. The five levels generated by the SR-NR-DR combinatory heuristic that arises from the theoretical model determined significant differences in the levels of the variables analyzed for each psychological context. We discuss the theoretical implications and the implications for the assessment and improvement of the behaviors analyzed in function of the personal and contextual regulation levels evaluated. The SRL vs. ERL theory has shown that the combination of levels of student self-regulation and regulation from the teaching context produces linear effects on achievement emotions and coping strategies. However, a similar effect on stress factors and symptoms of university students has not yet been demonstrated. The aim of this study was to test this prediction. It was hypothesized that the level of student self-regulation (low/medium/high), in interaction with the level of external regulation from teaching (low/medium/high), (...) would also produce a linear effect on stress factors and symptoms of university students. A total of 527 undergraduate students completed validated questionnaires about self-regulation, regulatory teaching, stress factors and symptoms. Using an ex post facto design by selection, ANOVAs and MANOVAs (3 x 3; 5 x 1; 5 x 2) were carried out. The results confirmed that the level of self-regulation and the level of regulatory teaching jointly determined the level of stress factors and symptoms of university students. Once again, a five-level heuristic of possible combinations was configured to jointly determined university students’ level of academic stress. We concluded that the combination of different levels of student regulation levels and regulation from teaching process jointly determines university students’ level of academic stress. The implications for university students’ emotional health, stress prevention and well-being are established. (shrink)

The aim of this research was to determine the degree to which undergraduate students’ learning approach, academic achievement and satisfaction were determined by the combination of an intrapersonal factor (self-regulation) and a interpersonal factor (contextual or regulatory teaching). The hypothesis proposed that greater combined regulation (internal and external) would be accompanied by more of a deep approach to learning, more satisfaction and higher achievement, while a lower level of combined regulation would determine a surface approach, less satisfaction and (...) lower achievement. Within an ex post facto design by selection, 1036 university students completed validated questionnaires using an online tool. Several multivariate analyses were conducted. Results showed that the combination of self-regulation and external regulation can be ordered as levels along a five-point scale or heuristic. These levels linearly determine type of learning approach, academic achievement and satisfaction. Implications are established for quality and improvement of the teaching and learning process at university. (shrink)

Self-determination theory considers motivation as a multidimensional phenomenon, with different levels of intensity, purposes, intentions, wills and autonomies. It distinguishes between intrinsic motivation, extrinsic motivation and amotivation. In this paper, we are going to focus on extrinsic motivation, which is related to those tasks that the subject performs without having a purpose in themselves, and which is composed of identified regulation, introjected regulation and external regulation. The aim of this research is to analyse the relationship between them (...) and emotional intelligence in 165 students with university degrees related to Physical Activity and Sport Sciences. The main findings of this work lie mainly in the demonstration of the fact that emotional intelligence is a predictor of identified regulation, introjected regulation and external regulation. Some of the authors who adopt the value-based approach to measuring freedom think of freedom as the absence not only of constraints that are external to the agent but also of constraints that are internal to the agent. Most prominent among these authors is Charles Taylor. On Taylor’s view, freedom coincides with self-mastery or self-determination or “positive freedom”. As well as leading to illiberal judgements of degrees of freedom, the tendency to roll together internal and (...) class='Hi'>external freedom into a single quantitative attribute can be shown to be logically inseparable from the value-based approach to measuring freedom. Let me in the following address a few of them. Kimura Bin's point of departure is the idea that schizophrenia is basically to be understood as a disorder of self and self-experience. Thus, (...) fundamental alterations in the sense of possession and control of one's own thoughts, actions, sensations, or emotions figure among the most prominent symptoms in its advanced stages. But even in the absence of overt symptoms, the schizophrenic may feel uncertain about her selfhood, and it is often in an attempt to restore or at least sustain her precarious self-identity that the patient engages in characteristic obsessive self-reflections that frequently simply exacerbate the problem.1. One way to illustrate what is peculiar about the self-disorder in schizophrenia is by contrasting it with the symptoms found in senile dementia. Whereas the demented patient might lack any knowledge about the features that characterize him from a third-person perspective, i.e., age, nationality, profession, location, etc., he is usually in possession of an intact first-person perspective: He is still aware of the I-Here-Now. This distinction can be cashed out as a distinction between two different ways of being aware of oneself, one external, the other internal. On the one hand, I can think of myself from a third-person perspective, that is, I can refer to an object by way of a proper name, a demonstrative, or a definite description, and occasionally this object happens to be myself. When I refer to myself in this way, I am referring to myself in exactly the same way that I can refer to Others, and Others can refer to me (the only difference being that I am the one doing it, thus making the reference into a kind of self-reference). Apart from being external and contingent, this kind of self-reference is also non-thematic, since it can occur without my knowledge of it, that is, I can refer to myself from the third-person perspective without realizing that I myself am the referent. In contrast, the self-reference available from the first-person perspective—the one expressed in the subject-use of "I"—is of an internal kind. Not only is it impossible to refer to anybody and anything apart from oneself in the first-person way, but it also belongs to the proper use of "I" that one knows that one is referring to oneself. That is, apart from being internal and necessary, the self-reference in question is also of a thematic nature. As a complex system far from equilibrium state, the dreaming brain may form a new pattern by the interaction between components within this system. At REM sleep stage, signals from neuronal clusters self-organize and form image fragments, then the image fragments interact and produce images, and finally these materials are associated into a relatively continuous narrative (i.e., dreams). The temporal unity of the self cannot be accounted for by the continuity of causal, factual, or contiguous relations between independently definable mental events, as proposed by Locke and Parfit. The identity of the self over time is normative: it depends on the institutional context of social rules external to the self that determine the relationship between past commitments and current responsibilities. From the foundation of self-determination theory and existing literature on forms of power, we empirically explored relationships between followers’ perceptions of their leader’s use of various forms of power, followers’ self-reported motivational outlooks, and followers’ favorable work intentions. Using survey data collected from two studies of working professionals, we apply path analysis and hierarchical multiple regression to analyze variance among constructs of interest. We found that followers’ perceptions of hard power use by their leaders (i.e., reward, coercive, (...) and legitimate power) was often related to higher levels of sub-optimal motivation in followers (i.e., amotivation, external regulation, and introjected regulation). However, followers who perceived their leaders used soft power (i.e., expert, referent, and informational power) often experienced higher levels of optimal motivation (i.e., identified regulation and intrinsic motivation), but further investigation of soft power use is warranted. The quality of followers’ motivational outlooks was also related to intentions to perform favorably for their organizations. (shrink)

The relation between transcendental idealism and philosophical naturalism awaits more careful determination, i. e. whether the issue of their compatibility hinges on their ontological view on the relation between physical and mental phenomena (i. e. whether it is supervenience or emergence) or on their epistemological view on our access to mental content. The aim of this paper is to identify a tension between transcendental idealism and philosophical naturalism, which lies not in their ontological view on the nature of substances, (...) but in their epistemological view on the relation between self-awareness and the first-personal access to mental content. I will first trace the (mis)understanding of transcendental idealism as Berkeleyan idealism to a misinterpretation of the self-knowledge premise in transcendental arguments. I will argue that transcendental idealism is not so much concerned with grounding reality of the external world as with establishing the agential nature of the first-personal perspective of experience, and it has an important implication on the meaning and function of self-awareness in transcendental idealism. The paper investigates philosophical conceptions of the living that were articulated in Kantian and Hegelian philosophy. The paper argues that in Kant and post-Kantian philosophy the conception of the living serves as a hinge or joint in order to mediate between conceptions of the realm of nature and conceptions of the realm of freedom. In opposition to the Cartesian tradition that had tried to grasp living beings in terms of organized machines, Kant characterizes living beings not only as organized, but (...) as self-organizing beings. Living beings thus do not depend on a conception of their whole external to them (a conception present in the mind of a putative creator). They rather determine themselves. If one understands freedom as being under self-given laws as Kant and his successors did, then living beings as self-organizing entities seem structurally akin to the form of autonomy. The paper argues that it is this kinship that explains the interest that Kant and his successors have taken in the subject matter of the living. In conceiving of living entities in terms of self-organizing beings, some elements of nature seem to be graspable in terms of an inner purposiveness that makes intelligible how freedom might be actualized in nature. Although Kant has not fully developed and deployed the analogy of living self-organization and practical self-determination, it had a crucial impact on post-Kantian philosophy. The paper tries to delineate this impact by turning to Hegel who has deepened the analogy without annihilating the difference between living self-organization and practical self-determination. Background Following passage of the Patient Self Determination Act in 1990, health care institutions that receive Medicare and Medicaid funding are required to inform patients of their right to make their health care preferences known through execution of a living will and/or to appoint a surrogate-decision maker. We evaluated the impact of external factors and perceived patient preferences on physicians’ decisions to honor or forgo previously established advance directives (ADs). In addition, physician views regarding legal risk, patients’ (...) ability to comprehend complexities involved with their care, and impact of medical costs related to end-of-life care decisions were explored. Methods Attendees of two Mayo Clinic continuing medical education courses were surveyed. Three scenarios based in part on previously court-litigated matters assessed impact of external factors and perceived patient preferences on physician compliance with patient-articulated wishes regarding resuscitation. General questions measured respondents’ perception of legal risk, concerns over patient knowledge of idiosyncrasies involved with their care, and impact medical costs may have on compliance with patient preferences. Responses indicating strength of agreement or disagreement with statements were treated as ordinal data and analyzed using the Cochran Armitage trend test. Results Three hundred eighty-eight of 951 surveys were completed (41% response rate). Eighty percent reported they were likely to honor a patient’s AD despite its 5 year age. Fewer than half (41%) would honor the AD of a patient in ventricular fibrillation who had expressed a desire to “pass away in peace.” Few (17%) would forgo an AD following a family’s request for continued resuscitative treatment. A majority (52%) considered risk of liability to be lower when maintaining someone alive against their wishes than mistakenly failing to provide resuscitative efforts. A large percentage (74%) disagreed that patients could not appreciate complexities surrounding their care while 69% agreed that costs should never impact a physician’s decision as to whether to comply with a patient’s AD. Conclusions Our findings highlight the impact, albeit small, external factors have on physician AD compliance. Most respondents based their decision on the clinical situation at hand and interpretation of the patient’s initial wishes and preferences expressed by the AD. (shrink)

For both Spinoza and Zhuang-zi, the goal of life is attaining freedom, namely, human freedom. What do they mean by “human freedom”? What are the necessary conditions for humans to attain freedom? Seeking for answers to these questions, I’ve noted that Spinoza and Zhuang-zi suggest remarkably similar answers to these questions. First, both Spinoza and Zhuang-zi understand human freedom as a form of complete independence from externals: self-determination in Spinoza and union with the Dao in Zhuang-zi. Second, both (...) Georg Lukács wrote that "there is autonomy and 'autonomy.' The one is a moment of life itself, the elevation of its richness and contradictory unity; the other is a rigidification, a barren self-seclusion, a self-imposed banishment from the dynamic overall connection." Though Lukács' concern was with the conditions for the possibility of art, his distinction also serves as an apt description of the way that Hegel and Hegelians have contrasted their own interpretations of self-determination with that (...) of Kant. But it has always been difficult to see how elevation is possible without seclusion, or how rigidification can be avoided without making the boundaries of the self so malleable that its autonomy looks like a mere cover for the power of external forces. Yeomans explores Hegel's own attempts to grapple with this problem against the background of Kant's attempts, in his theory of virtue, to understand the way that morally autonomous agents can be robust individuals with qualitatively different projects, personal relations, and commitments that are nonetheless infused with a value that demands respect. A pervasive misunderstanding of Confucian philosophy’s concepts considers them to be directives that call for deference and subordination, principally associated with the concept Lǐ 禮 which is understood as rites, rituals, manners, or generally “propriety”. Imposing Lǐ 禮 is considered a path to social and personal harmony. However, an analysis of the conditions and implications of Lǐ 禮 in early Confucian thinking shows that authentic respect, not obedience, is considered the essential condition for good governance and an ordered society. Significantly, (...) authentic respect can only originate from within the self, it cannot be commanded. Based upon self-cultivation, participation in ritual and exemplary conduct establishes a commitment to respect, and the purposeful distinctions expressed through Lǐ 禮 make social order intelligible. Considering the essence of respect in depth, and comparing it to the ethics conceived by Immanuel Kant, neither Confucian nor Kantian ethics are truly deontological in the sense of a “duty that is owed to an external instance”, rather they both rest on the autonomy of the self. A synthesis of both implies that extending authentic respect to an other in an encounter within the context of Lǐ 禮 gives rise to “Existential Reciprocity”: a virtuous cycle which mutually affirms both the self and the other, while rejecting a dichotomous opposition between self-esteem and morality. This is not contingent on external factors, but accessible from a self-determined, autonomous engagement with self-affirming conduct and productive encounters. The purpose of this paper is to clarify Prajñākaragupta’s view of mental perception ( mānasapratyakṣa ), with special emphasis on the relationship between mental perception and self-awareness. Dignāga, in his PS 1.6ab, says: “mental [perception] ( mānasa ) is [of two kinds:] a cognition of an [external] object and awareness of one’s own mental states such as passion.” According to his commentator Jinendrabuddhi, a cognition of an external object and awareness of an internal object such as passion (...) are here equally called ‘mental perception’ in that neither depends on any of the five external sense organs. Dharmakīrti, on the other hand, considers mental perception to be a cognition which arises after sensory perception, and does not call self-awareness ‘mental perception’. According to Prajñākaragupta, mental perception is the cognition which determines an object as ‘this’ ( idam iti jñānam ). Unlike Dharmakīrti, he holds that the mental perception follows not only after the sensory perception of an external object, but also after the awareness of an internal object. The self-awareness which Dignāga calls ‘mental perception’ is for Prajñākaragupta the cognition which determines as ‘this’ an internal object, or an object which consists in a cognition; it is to be differentiated from the cognition which cognizes cognition itself, that is, self-awareness in its original sense. Within a physicalist-mechanistic worldview, in which we cannot be more than intelligent, self-reproducing biomachines or biobots, fundamentals of a new approach to the science of human self-explanation are outlined. Some a priori logical necessities, or determinants, of any biobot’s control system design are recognized. Evolution had to satisfy them, but neuroscience and cognitive science so far do not clearly see these basics. It is concluded that the old part of the brain still contains the genetically fixed drives, responses, (...) and the physiological control. Here is the seat of an ancient somatic self that is not intelligent but is still the active center of our life. The neocortex has evolved to serve the somatic self with intelligence by individually building a virtual model of the external material and social world. This model is used by the somatic self to “pre-play” intended actions and responses to see whether they would satisfy its needs. This schema of global brain function provides the neurological foundation for the ego-id dichotomy in analytic psychology, as well as some critique of it. Following the groundbreaking experiments by Benjamin Libet and John-Dylan Haynes et al. , consciousness is taken as a “theater” that presents what the neural networks already have worked out, and freedom of the will is limited. The explosive growth of culture and civilization began when neocortical power exceeded a certain threshold. This can be taken as a quasi-mutation that projected us into a supra-biological space of existence that is new to natural history. It is not clear whether this event will lead to a positive future for humanity or to doom. Functional religion is seen as a neurosystemic attempt to bring back the earlier natural state. Nationally Determined Contributions (NDCs) are critical climate policy documents formulated by the Party countries, under the UNFCCC Paris Agreement, to communicate their goals and commitments to reduce national emissions and adapt to the impacts of climate change. As an emerging discourse genre, it has attracted increasing attention from discourse analysts. However, few studies have specifically focused on the NDCs of African countries as a whole, leading into the situation in which their positions and voices are largely underrepresented in the current (...) climate negotiation. Using a combined method of positioning theory and critical discourse analysis, this paper aims to explore the African countries’ positioning in the climate change agenda by examining the discursive narratives around three prominent thematic categories in their NDCs, i.e. responsibility, vulnerability and conditionality. It is found that the African countries intend to position themselves as non-villains, victims, and demi-heroes by strategically highlighting their insignificant historical responsibility, exceptional vulnerability, and conditionality of implementation on the external support from the international community. Furthermore, it is argued that the commonality of their self-positioning is conducive to forming a collective identity to resist the hegemonic discourses of inequality and struggle for equity in the current climate negotiation. Hegel presents two very different accounts of the initial categorization of essence in his Science of Logic and his later Encyclopedia Logic, thereby raising the question of whether this discrepancy undermines the univocal necessity of systematic logic. A close examination of these arguments reveals that the Science of Logic account captures a necessary ordering that is incompletely presented in the Encyclopedia. The details are provided for comprehending why the logic of essence must begin with a contrast of the essential and (...) the unessential, how this reverts to illusory being, and why identity depends upon the transformation of refl ection from being positing to being external to being determining in character. Significantly, the self-developing nature of these logical developments calls into question the foundationalism entailed by any privileging of the categories of essence. (shrink)

Persons must deliberate, decide, plan, and schedule their actions. Openness with respect to ends confronts them, and they must structure and direct their lives by determining what sort of career to trace out, even if it proves to be a career of routine or unambitious undertakings. Circumstances can constrain and compel, and the openness persons confront (...) can be closed off by external factors. But it is intrinsic to the nature of persons that the exercise of capacities for thought and action may be directed this way or that. There are perhaps nonpersons whose activity is to be explained with reference to beliefs and desires. In several places of his work, Kant distinguishes between two senses of self-consciousness: a pure one and an empirical one. The aim of this work is to analyze these two senses of consciousness and show that, for Kant, self-consciousness does not occur unrestrictedly: a relation with something other than consciousness is needed for it to become conscious of itself. I carry out these objectives throughout six sections. In the first one I lay out the Kantian principle of pure (...) apperception. In the second one, I present the limits of pure apperception through Kant’s critique of rational psychology. Then, in the third section, I set the basis to understand the relationship that Kant establishes between the I think and the I exist. In the fourth one I show that pure apperception, despite being pure, is not possible without the opportunity of perception. Next, in the fifth one, I introduce the notion of empirical apperception, establish its relationship with pure apperception, and elucidate its meaning. The generation of complex organ structures such as the eye requires the intricate orchestration of multiple cellular interactions. In this paper, early retinal development is discussed with respect to the structure formation of the optic cup. Although recent studies have elucidated molecular mechanisms of retinal differentiation, little is known about how the unique shape of the optic cup is determined. A recent report has demonstrated that optic‐cup morphogenesis spontaneously occurs in three‐dimensional stem‐cell culture without external forces, indicating a latent (...) intrinsic order to generate the structure. Based on this self‐organizing phenomenon, we introduce the “relaxation‐expansion” model to mechanically interpret the tissue dynamics that enable the spontaneous invagination of the neural retina. This model involves three consecutive local rules (relaxation, apical constriction, and expansion), and its computer simulation recapitulates the optic‐cup morphogenesis in silico. (shrink)

She raises two important questions: How should we understand what is going on in these accounts? and What are the implications of these reports for our understanding of what it is to have a 'sense of self' or a 'sense of agency'—of 'subjectivity' generally—which might have, both, clinical and nonclinical implications?What does it mean to have a self or a sense of having one, agency or a sense of having it? One might think these are the possession or experience of something 'inner' such as feelings of confidence or assurance, perhaps having a kind of inner structure or a set of deeply held ideas which give us coherence, motivate us and justify our actions, and which we can know by 'looking inward,' in an introspective act which provides direct, privileged acquaintance.Yet Wittgenstein called this a dangerously misleading 'picture' which 'held us captive,' and needed always to be 'gotten rid of' (Wittgenstein, 1958). Moran's position is that we find or possess ourselves when we find or hold beliefs about the world which we do not merely believe but endorse or avow, where to endorse or avow a belief about the world is to find and endorse reasons in the world, which support that belief. Thus, I can avow that it's raining if I can look outside and see that it is raining. This Moran calls the transparency condition. Endorsing or avowing both a belief and the external reasons for it gives the self what Moran refers to as authenticity and which also might be said to provide cohesion, consistency and intelligibility—plausibly, a 'sense of self.'The transparency condition also applies to beliefs that justify actions.
