Polskie przepisy prawne formułujące warunki dopuszczalności eksperymentu medycznego, a więc ipso facto wyznaczające jego granice, można różnorako interpretować, zwłaszcza w tym zakresie, w jakim określają wymagany dla przeprowadzenia eksperymentu bilans związanych z nim możliwych korzyści i szkód. W artykułach prawniczych komentujących te przepisy w zasadzie jednak brak prób systematycznego i (na tyle, na ile pozwala na to sam przedmiot analizy) ścisłego wyróżnienia tych interpretacji w języku tzw. teorii racjonalnego wyboru (rational choice theory), teorii szczególnie przydatnej w tym kontekście z uwagi (...) na jej rozbudowany aparat pojęciowy pozwalający badać różnorakie konfiguracje relacji między costs i benefits. Artykuł próbuje wypełnić tę lukę: wyróżnione w nim zostały różne interpretacje przepisów prawnych określających warunki dopuszczalności eksperymentu medycznego; interpretacje te zostały również poddane ocenie. The article is dedicated to the problems of European political identity and European identity as a whole conception and as a foundation for European integration. Before 24 February 2022, European political identity had been in crisis. The contradictions between the EU member states seemed to be hardly resolvable. The Russian aggression against Ukraine gave a strong impetus to the formation of European identity. However, it is still a negative incentive for unity and solidarity rather than cohesion around positive values, as (...) well as from the outset the European integration was caused by devastating World War II as a negative experience, which should never be repeated. : President Clinton's charge to the Advisory Committee on Human Radiation Experiments included the identification of ethical and legal standards for evaluating government-sponsored radiation experiments conducted during the Cold War. In this paper, we review the traditional account of the history of American research ethics, and then highlight and explain the significance of a number of the Committee's historical findings as they relate to this account. These findings include both the national defense establishment's struggles with legal and insurance issues concerning (...) human experiments, and the medical profession's perspective on human experimentation in the years following the Nuremberg Medical Trials. We conclude that the Committee's work both enriches the traditional view of the history of research ethics and opens important new areas for study. (shrink)

Marx admirait grandement Aristote. En aurait-il pour autant accepté l'étrange réactualisation de l'ontologie, cette proto-science de "l'être en tant qu'être"? Toute son oeuvre atteste au contraire qu'elle relevait à ses yeux de "l'ancienne philosophie", conçue à une époque où se confondaient encore toutes les branches du savoir et dont il fallait "sortir d'un bond". L'élaboration par lui et ses continuateurs de cette logique supérieure qu'est la dialectique matérialiste offrait désormais la clé d'une connaissance positive d'un monde s'expliquant par lui-même, sans (...) adjonction d'aucune sorte. On peut s'étonner qu'au soir de sa vie, Georges Lukacs (1885-1971), une des figures les plus marquantes du marxisme contemporain, se soit lancé dans l'impossible tentative de réanimer cette antiquité philosophique. Riche en développements sur le travail et l'aliénation, sa monumentale Ontologie de l'être social n'en révèle pas moins un significatif écartèlement entre le penseur marxiste et l'homme de la Mitteleuropa qu'il ne dépouilla sans doute jamais complètement en lui. During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

Traditional martial arts continue to be interesting and inspiring to many people around the globe. Some of their contemporary adaptations attract enthusiasts for whom they are especially important. In this article, the author bases his observations on his own long-term participation. The analysis takes into account the influence of the perspectives of Jigoro Kano and several other creators of modern varieties of Japanese budo. It can be concluded that regular, even daily, practice—cultivating martial arts and internalizing its values—co-creates the lifestyle (...) of instructors and advanced students. (shrink)

We propose a non-standard interpretation of Alternating-time Temporal Logic with imperfect information, for which no commonly accepted semantics has been proposed yet. Rather than changing the semantic structures, we generalize the usual interpretation of formulae in single states to sets of states. We also propose a new epistemic operator for ?practical? or ?constructive? knowledge, and we show that the new logic (which we call Constructive Strategic Logic) is strictly more expressive than most existing solutions, while it retains the same model (...) checking complexity. This paper contains a discussion of striking similarities between influential philosophical concepts of the past and the approaches currently employed in selected areas of computer science. In particular, works of the Pythagoreans, Plato, Abelard, Ash’arites, Malebranche and Berkeley are presented and contrasted with such computer science ideas as digital computers, object-oriented programming, the modelling of an object’s actions and causality in virtual environments, and 3D graphics rendering. The intention of this paper is to provoke the computer science community to go (...) off the beaten path in order to find inspiration for the development of new approaches in software engineering. When engaging in a philosophical analysis of body and corporeality in a political context, it is essential to ask to what extent, under what circumstances, and in accordance with what moral norms the state performs actions that have the bodies and lives of citizens as their object. This issue was already discussed in ancient philosophy, examples of which can be found in the writings of Plato and Aristotle, but also in ancient jurisprudence, especially in the law and the legal doctrine (...) of ancient Rome. Aware of such a previous history of studies on this topic, this analysis will discuss the three main ways in which state power over the life and health of citizens is manifested. Namely: (i) capital punishment (ii) policing and (iii) warfare. In addition, it will be indicated, based on Thomistic philosophy, what moral norms govern these state actions. The fundamental differences between the three main state powers — judicial, police, and military — will also be shown in the context of lethal actions undertaken on their basis. (shrink)

ABSTRACT This article argues for a unique role of imagination and mental images in the moral education of students. Imagination is rendered here as a capacity oriented toward realizable and salient goals; mental images are understood as particular future-oriented self-representations (FOSRs) devised by and held in imagination. FOSRs have four moral attributes: they are 1) expressive of us as moral agents, 2) shape our moral identity, 3) serve as moral pointers, and 4) help devise mitigating strategies. FOSRs can be created (...) and utilized in educational settings to further the goals of moral education by i) fostering sensitivity to moral situations among students, ii) motivating learners to act morally, iii) facilitating environments supportive of moral practice and moral habituation, and iv) helping strengthen cross-situational consistency of moral action. The four moral attributes of future-oriented self-representations (FOSRs) (1–4) that are to be engaged in moral education to further its goals (i–iv) are correlated with four elements of moral education, namely: a) moral awareness; b) moral competency; c) moral motivation; and d) moral capacity. To argue for the special role of imagination and mental images in moral education this paper integrates philosophical research and conceptual and empirical studies in psychology and education on the morality of imagination and mental images. This book challenges the widespread view of Kierkegaard’s idiosyncratic and predominantly religious position on mimesis. -/- Taking mimesis as a crucial conceptual point of reference in reading Kierkegaard, this book offers a nuanced understanding of the relation between aesthetics and religion in his thought. In this paper, I present a new account of Richard Rorty’s interpretation of Michel Foucault, which demonstrates that in the course of his career, Rorty presented several diverse (often mutually exclusive) criticisms of Foucault’s political thought. These give different interpretations of what he took to be the flaws of that thought, but also provide different explanations as to the sources of these flaws. I argue that Rorty’s specific criticisms can be divided into two overall groups. Sometimes he saw Foucault’s rejection (...) of bourgeois democracies and bourgeois utopias as a specific case of his general critique regarding the structures of social life as inherently oppressive. At other times he seemed to attribute to Foucault a view that—while not all forms of social life are inherently oppressive—bourgeois democracies certainly are, in a very specific and radical way. In conclusion I show that Rorty’s interpretation of Foucault should be understood in the context of his approach toward the ‘American Cultural Left.’. (shrink)

This essay considers the issue of informed consent as it arose in the context of 1960s living kidney donors. In one of the earliest empirical inquiries into informed consent, psychiatrists Carl H. Fellner and John R. Marshall interviewed donors about their decision‐making process and their experience and reflections on donorship. In their much‐cited 1970 paper, the physicians reported that living donors, rather than reaching a reasoned, intellectual, and unemotional decision about donating a kidney (as stipulated in the Ethical Guidelines for (...) Organ Transplantation issued by the American Medical Association's Judicial Council), instead made instantaneous and “irrational” decisions about participation. Fellner and Marshall's studies contributed to the public debate and professional discussion about the moral and ethical dimensions of donorship, even as they challenged the developing consensus on informed consent. Bodily pain and distress come in many forms. They can well up from within at times of serious illness, but the body can also be subjected to harsh treatment from outside. The medical system is often cold and depersonalized, and much worse are conditions experienced by prisoners in our age of mass incarceration, and by animals trapped in our factory farms. In this pioneering book, Drew Leder offers bold new ways to rethink how we create and treat distress, clearing (...) the way for more humane social practices. Leder draws on literary examples, clinical and philosophical sources, his medical training, and his own struggle with chronic pain. He levies a challenge to the capitalist and Cartesian models that rule modern medicine. Similarly, he looks at the root paradigms of our penitentiary and factory farm systems and the way these produce distressed bodies, asking how such institutions can be reformed. Writing with coauthors ranging from a prominent cardiologist to long-term inmates, he explores alternative environments that can better humanize—even spiritualize—the way we treat one another, offering a very different vision of medical, criminal justice, and food systems. The aim of the study was to verify the hypothesis that positive affective tone of narratives is connected to the experience of posttraumatic growth among transplant patients. Kidney transplant patients and liver transplant patients participated in the study. In the first stage, about 10 weeks after transplant, the participants told two stories about important, freely chosen events from their lives. During the second meeting 10-12 months later we measured posttraumatic growth. Results indicated that the affective tone of narratives about past (...) events was associated with the level of post-traumatic growth measured 10-12 months later. This proves that the affective tone of narratives about life, understood as a relatively constant individual characteristic, promote posttraumatic growth. (shrink)

This paper challenges the general approach to Kierkegaard ’ s engagement with imitation, which privileges a strictly religious reading. Heretofore imitation has been apprehended as a coherent concept shaped within the context of imitatio Christi in the devotio moderna. I locate Kierkegaard ’ s writings in the broader context of mimesis. Analysing particular mimetic structures woven into the text, I show that a plurality of imitative models that are different fromChrist occurs therein. Addressing the distinction between the religious and the (...) aesthetic in Kierkegaard, I inquire into the status of these imitative models. Referring to the term “ Mellembestemmelserne ” and “ ekphrasis ”— the rhetorical de- vice of aesthetics — I show that the other models of imitation exhibit supportive roles to the highest type of prototype (Christ) and therefore question the solely religious rendering of mimesis and the aesthetic confines of Kierkegaard ’ s concept of aesthetics. With the meaning of trust, good faith and respect for promises made, protection, or assistance, fides in the non-exclusively religious sense of the word comes from the demand for ethical perfection: as such, it is omnipresent in human relations and in the dynamic of societies in the Middle Ages.

Helium and neon, the two lightest noble gases, have been traditionally positioned by IUPAC in the Group 18 of the Periodic Table of Elements, together with argon, and other unreactive or moderately reactive gaseous elements (krypton, xenon, radon), and oganesson. In this account we revive the old discussion on the possible placement of helium in the Group 2, while preserving the position of neon in Group 18. We provide quantum-chemical arguments for such scenario—as well as other qualitative and quantitative arguments—and (...) we describe previous suggestions in the literature which support it or put it into question. Self-esteem and emotional reactivity may be important personality determinants of human functioning in situations of social exposure. In this study, we compared the levels of these personality variables in a group of professional theater actors and a group of professional illusionists with a control group of participants who were neither actors nor illusionists and had no artistic education. We also examined the correlations between emotional reactivity and self-esteem in the three groups. For emotional reactivity, we found (1) very strong evidence (...) that the level is less for magicians than for controls, (2) substantial evidence that the level is less for magicians than for actors, (3) anecdotal evidence that the level is less for actors than for controls, and (4) decisive evidence that the average score is less for males than for females. For self-esteem, we found (1) anecdotal evidence that the level is higher for magicians than for controls, (2) substantial evidence that there is no difference between actors and magicians, (3) anecdotal evidence against a difference between actors and controls, and (4) anecdotal evidence against a difference between males and females. Based on the entire sample we found a moderate correlation between self-esteem and emotional reactivity (r = -.30, p < 0.001). Our results are compatible with the notion that emotional reactivity – as part of the temperament concept – is a factor influencing the choice of an artistic profession. (shrink)

By spelling out the affective dimension of admiration, this paper challenges the view of admiration as a trustworthy means of detecting morally desirable qualities in exemplars. Such a view of admiration, foundational for the current debate on exemplars in moral education, holds that admiration is a self-motivating emotion essentially oriented toward the good and the excellent. I demonstrate that this view ignores the affective aspects of admiration explored widely in the history of philosophy on which the debate on moral exemplars (...) substantially draws. Focusing on Spinoza, Smith, Kierkegaard, and Nietzsche, I bring to light their largely skeptical views of the moral value of admiration. These thinkers indicate that admiration can be influenced by, and is often conflated with, other emotions, and can arise in us through behavioral mimicry; moreover, admiration is often oriented toward the mediocre and corrupt, is contagious, self-referential, collective, and has limited motivational power. Their remarks on the affective dimension of admiration call into question admiration’s applicability and usefulness in moral exemplarity. (shrink)

Through an analysis of Kierkegaard’s and Dostoevsky’s approaches to the theme of the death of Christ – one of the major leitmotifs in the debate of their contemporaries conveyed through theological and philosophical considerations, but also expressed in novels and in art – I show how the thinkers comprehended and articulated in their works the religious challenges awaiting the modern man.

The doctrine of the Intelligent Design offers an intuitive explanation of why the ordering in the Universe is authored by an intentional agency. Due to its appeal to common-sense perception, this doctrine is endorsed even by scientifically literate circles despite of its obvious contradiction with the discoveries of science. In this article, an attempt to apply the tools of the cognitive science of religion to the appraisal of the methodological and epistemic status of the ID doctrine is presented. It is (...) concluded that the ID doctrine may serve as means of the real-time metaphorical reassurance of the creative power of God while it cannot give grounds to any literal inferences on the nature of the Divine action. The phenomenon of luck poses a problem for ethics for two reasons. First, it makes it difficult to formulate homogeneous moral judgments for two or more actions which seem to be similar to each other in every morally relevant aspect except of some successful or unfortunate events that take place in one case and not in the other. The occurrence of these events wasn’t under control of any of the agents but for external observers it tends to be the basis (...) for more rigorous or more tolerant moral judgment in one case and not in the other. Second, luck can affect our sense of life through success or failure of ours existentially important life projects. This fact suggests necessity of conditions for morally permissible relying on luck in formulating and pursuing one’s life project. In this paper I present possibilities of applying main views on luck to resolve the above problems. (shrink)
