Alcohol use and abuse play a major role in both crime and negative health outcomes in Scotland. This paper provides a description and ethical and legal analyses of a novel remote alcohol monitoring scheme for offenders which seeks to reduce alcohol-related harm to both the criminal and the public. It emerges that the prospective benefits of this scheme to health and public order vastly outweigh any potential harms.

This book constructs a deepening, interdisciplinary understanding of adult learning and imaginatively reframes its transformative aspects. The authors explore the tension at the heart of current understanding of ‘transformative’ adult learning: that while it can be framed as both easy and imperative, personal transformation is in fact rooted in the context in which we live, our stories and relationships. At its core, transformation is never easy – nor always desirable – and the authors thus draw on interdisciplinary and auto/biographical inquiry (...) to explore what it means to change our presuppositions and frames of meaning that guide our thinking. Using their linguistic, gendered, academic and cultural differences, the authors illuminate how the social, contextual, cultural, cognitive and psychological dimensions of transformation intertwine. In doing so, they emphasise the importance of transformation as a contingent struggle for meaning and recognition, social justice, fraternity, and the pursuit of truth. Although 80–90% of adults are seropositive for antibodies against the human parvovirus adeno‐associated virus (AAV), infection has not been associated with either symptoms or disease. In cell culture, AAV infection is not productive unless there is a coinfection with a helper virus, either adenovirus or any type of herpes virus; in the absence of a helper virus coinfection the viral genome is integrated into the genome, usually at a specific site on chromosome 19q13.3‐qter. The integrated genome can be activated and (...) rescued by subsequent super infection by a helper virus. The high frequency of site‐specific integration by AAV and the lack of associated disease have encouraged the use of AAV as a vector for gene therapy. This review will focus on the molecular mechanisms involved in the establishment of, and rescue from, the latent state and their relevance to use of AAV as a vector. (shrink)

This book chapter addresses two questions. First, can targeted killing by drones in non-battlefield zones be justified on basis of just war theory? Second, will the proliferation and expansion of combat drones in warfare, including the introduction of autonomous drones, be an obstacle to initiating or executing wars in a just manner in the future? The first question is answered by applying traditional jus ad bellum and jus in bello principles to the American targeted killing campaign in Pakistan; the (...) second question is answered on basis of principles of “just military preparedness” or jus ante bellum, a new category of just war thinking. It is concluded that an international ban on weaponized drones is morally imperative and, certainly, that an international treaty against autonomous lethal weapons should be adopted. (shrink)

The Russian invasion of Ukraine on February 24, 2022, has already caused large amounts of greenhouse gas (GHG) emissions and will continue to do so for many years after hostilities have ceased mainly because of the emissions linked to the rebuilding of destroyed or damaged housing, public buildings, infrastructure, factories, and the like. My aim in this paper is to discuss how in a time of climate emergency such emissions of war should impact the political morality of states initiating, (...) continuing, and ending war (through a just and enduring peace) as understood by just war theory (JWT). His work was the result of an unexpected alliance between the Wolffian Enlightenment and Pietism, after the fierce clash between these two trends which had culminated in Wolff’s banishment from Halle. In the years that followed a new cultural figure appeared, the Enlightener-Pietist, or vice versa, who was to dominate the high and late Enlightenment and of whom Zur Linden was one of the first examples. Although the Ratio takes as its starting-point the rules of logical hermeneutics, it is based in an evaluation of the themes of classical rhetoric, and conceives hermeneutics as a technique, grounded in means-end rationality, the task of which is to determine the best method for understanding texts and speech. Zur Linden’s sacred hermeneutic theory is distinguished by at least four innovative aspects: 1. The proposal of a general hermeneutics of a probabilistic type. 2. An intensive examination of the different concepts of sense and their interrelationships. 3. The critique of better understanding as the goal of exegesis. The critical points of the text should not be obliterated in favour of its consistency. 4. The possible lack of agreement between what the author intends to say and what he actually says. For Zur Linden the sense of the text takes undoubted precedence and constitutes the only possible access to the author’s sense. His author-related textual hermeneutics can still be seen today as an original and noteworthy achievement. (shrink)

This study argues for three main theses: (1) Immanuel Kant’s ethics is a social ethics; (2) the basic premises of his social ethics point to a socialist ethics; and (3) this socialist ethics constitutes a suitable platform for criticizing and improving Karl Marx’s view of morality. -/- Some crucial aspects of Kant’s social ethics are that we must promote the “realm of ends” as a moral society of co-legislators who assist each other in the pursuit of their individual ends, which (...) requires in turn that we seek the realization of the republican state and peace between the nations. Thus, hope for progress, as supported by the enthusiasm engendered among the spectators of the French Revolution, becomes pivotal to Kant’s ethics as well as other moral feelings such as moral indignation and solidarity with the victims of oppression. -/- Kant views the moral society in the final instance as an “inner” unification of good wills. In a decisive elaboration of Kant, the neo-Kantian Hermann Cohen argues that all our social institutions, and notably economic enterprises, must instantiate the “realm of ends,” leading him to support cooperative socialism in Wilhelmine Germany. In his own words, Kant “is the true and real originator of German socialism” (1896). -/- There are important evaluative similarities between Kantian socialist ethics and Marx, such as a condemnation of capitalism as a system of servitude and an understanding of the ideal society as a cooperative society, but only Marx contends that the ideal society does not set a moral task and that there is a dialectic operative in human history that inevitably leads to communist society. This dogmatic Hegelian understanding of history must be replaced by Kantian regulative understanding of progress in support of revolutionary praxis as moral praxis. -/- We need a “Kantianization” of Marx, as Cohen and other neo-Kantian socialists also proclaimed in the three decades leading up to World War I. This study concludes with “A Historical Note on Kantian Ethical Socialism,” addressing, among others, Cohen, Karl Vorländer, Eduard Bernstein, and Kurt Eisner and the Munich Revolution of 1918. In line with recent proposals for experimental philosophy and philosophy of science in practice, we propose that the philosophy of medicine could benefit from incorporating empirical research, just as bioethics has. In this paper, we therefore take first steps towards the development of an empirical philosophy of medicine, that includes investigating practical and moral dimensions. This qualitative study gives insight into the views and experiences of a group of various medical professionals and patient representatives regarding the conceptualization of health and (...) disease concepts in practice and the possible problems that surround them. This includes clinical, epistemological, and ethical issues. We have conducted qualitative interviews with a broad range of participants (n = 17), working in various health-related disciplines, fields and organizations. From the interviews, we highlight several different practical functions of definitions of health and disease. Furthermore, we discuss 5 types of problematic situations that emerged from the interviews and analyze the underlying conceptual issues. By providing theoretical frameworks and conceptual tools, and by suggesting conceptual changes or adaptations, philosophers might be able to help solve some of these problems. This empirical-philosophical study contributes to a more pragmatic way of understanding the relevance of conceptualizing health and disease by connecting the participants’ views and experiences to the theoretical debate. Going back and forth between theory and practice will likely result in a more complex but hopefully also better and more fruitful understanding of health and disease concepts. (shrink)

Just War Theorists have neglected that a lack of “just military preparedness” on the side of a country seriously undermines its capability to resort justly to military force. In this paper, I put forth five principles of “just military preparedness” and show that since the new Obama administration will seek to maintain the United States’ dominant military position in the world, it will violate each of the principles. My main aim in this paper is to arrive at a defensible form of Marxian or socialist political universalism through a critical examination of Marx's own political universalism. In the next section, I will outline several moral errors that Walzer ascribes to political universalism, including Marx's, and show that Walzer largely misdirects his criticisms because what primarily accounts for Marx committing the errors is his Hegelian metaphysical conception of history, not his political universalism as such.

President Barack Obama has clearly placed himself in the just war tradition, and so we may ask how successful has President Obama in fact been as just war theorist? His justification of the recent NATO intervention in Libya shows that the record is at best mixed. More broadly, Obama’s failure as just war theorist is at least partly a failure of the theory itself: as long as this theory does not address issues of “just military preparedness,” it will fail (...) to place real constraints on American resort to military force. Justice requires that high consumption in affluent societies be slowed down for the sake of eradicating extreme poverty in the developing world and improving the condition of its very moderate consumers. A slowdown of high consumption for the sake of ending worldwide poverty can be realized through a social regulation of the global economy. This social regulation should include labor standards, environmental measures, rules for global capital investments, and a distributive schema that shifts some of the wealth obtained from globalization (...) from the rich countries to the developing world. To avoid that the social regulation of the global economy would have a regressive impact on lower-income groups in the affluent societies, a progressive consumption tax should be adopted with a standard deduction large enough so that these groups would not have to pay any tax at all. Attempts to slow down high consumption through a social regulation of the global economy will meet two institutional limits, the sovereign state and capitalism. In the final instance, justice and joyful simplicity for all humans may require cosmopolitan democracy and socialism. (shrink)

My main aim here is to examine what the significance is of the communitarian critique of liberalism for Hermann Cohen's political philosophy. I will conclude that Cohen's socialist Kantianism can successfully meet this critique. Also, I will argue that his political philosophy can better deal with some of the problems that communitarians detect in our Western democracies than can communitarianism itself. One crucial reason for this is that Cohen completes the original Kantian liberal project by making all agents (...) fully autonomous in the economic sphere. (shrink)

Kant argues that it is the duty of humanity to strive for an enduring peace between the nations. For Kant, political progress within each nation is essential to realizing lasting peace, and so one would expect him to view political intervention- defined as coercive interference by one nation, or some of its citizens, with the affairs of another nation in order to bring about political improvements in that nation-as justified in some cases.! Kant, however, explicitly rejects all intervention by force, (...) and some aspects of his work support an unqualified prohibition of political intervention. In this paper I will examine on which grounds, stated or inferred, Kant's practical philosophy upholds the absolute prohibition of political intervention, and conclude that, although these grounds are inadequate, they have the merit of pointing to important restrictions on justified political intervention. This detailed study examines the close cooperation between the two main figures of the Marburg School, Hermann Cohen and Paul Natorp, primarily from the time that Natorp came to the University of Marburg in 1880 to write his Habilitationsschrift under Cohen until Cohen’s resignation from Marburg in 1912. It is a common view that during this period Cohen and Natorp were of one philosophical mind: Cohen developed the basic premises of Marburg Kantianism, first in his explications of Kant’s three Critiques, (...) and later in his own philosophical system [Logic of Pure Cognition, Ethics of the Pure Will, and Aesthetics of Pure Feeling ], while Natorp used these premises in his historical studies and in the construction of his social pedagogy. On this account, it was not until Cohen’s departure from Marburg, or even not until the latter’s death, that Natorp’s philosophy began to differentiate clearly from Cohen’s, taking an increasingly metaphysical-mystical turn. Holzhey successfully undermines this view. He shows that during Cohen’s Marburg period Natorp was actually critical of some basic aspects of Cohen’s epistemic logic, ethics, and philosophy of religion, but that Natorp underplayed his disagreements and largely kept them from becoming public. This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

A study is reported which focused on the problem-solving strategies employed by expert electronics engineers pursuing a real-world task: integrated-circuit design. Verbal protocol data were analysed so as to reveal aspects of the organisation and sequencing of ongoing design activity. These analyses indicated that the designers were implementing a highly systematic solution-development strategy which deviated only a small degree from a normatively optimal top-down and breadth-first method. Although some of the observed deviation could be described as opportunistic in nature, much (...) of it reflected the rapid depth-first exploration of tentative solution ideas. We argue that switches from a predominantly breadth-first mode of problem solving to depth-first or opportunistic modes may be an important aspect of the expert's strategic knowledge about how to conduct the design process effectively when faced with difficulties, uncertainties, and design impasses. Wason's standard 2-4-6 task requires discovery of a single rule and leads to around 20% solutions, whereas the dual goal (DG) version requires discovery of two rules and elevates solutions to over 60%. We report an experiment that aimed to discriminate between competing accounts of DG facilitation by manipulating the degree of complementarity between the to-be-discovered rules. Results indicated that perfect rule complementarity is not essential for task success, thereby undermining a key tenet of the goal complementarity account of DG (...) facilitation. The triple heterogeneity account received a good degree of support since more varied triple exploration was associated with facilitatory DG conditions, in line with this account's prediction that task success is associated with the creative search of the problem space. The contrast class account (an extension of Oaksford & Chater's, 1994, iterative counterfactual model) was also corroborated in that the generation of descending triples was demonstrated to be the dominant predictor of DG success. We focus our discussion on conceptual ideas relating to the way in which iterative counterfactual testing and contrast class identification may work together to provide a powerful basis for effective hypothesis testing. We report an experiment investigating the “special-process” theory of insight problem solving, which claims that insight arises from non-conscious, non-reportable processes that enable problem re-structuring. We predicted that reducing opportunities for speech-based processing during insight problem solving should permit special processes to function more effectively and gain conscious awareness, thereby facilitating insight. We distracted speech-based processing by using either articulatory suppression or irrelevant speech, with findings for these conditions supporting the predicted insight facilitation effect relative to silent working or thinking (...) aloud. The latter condition was included to investigate the currently contested effect of “verbal overshadowing” on insight, whereby thinking aloud is claimed to hinder the operation of special, non-reportable processes. Whilst verbal overshadowing was not evident in final solution rates, there was nevertheless support for verbal overshadowing up to and beyond.. (shrink)

An experiment is reported examining dual-process models of belief bias in syllogistic reasoning using a problem complexity manipulation and an inspection-time method to monitor processing latencies for premises and conclusions. Endorsement rates indicated increased belief bias on complex problems, a finding that runs counter to the “belief-first” selective scrutiny model, but which is consistent with other theories, including “reasoning-first” and “parallel-process” models. Inspection-time data revealed a number of effects that, again, arbitrated against the selective scrutiny model. The most striking inspection-time (...) result was an interaction between logic and belief on premise-processing times, whereby belief - logic conflict problems promoted increased latencies relative to non-conflict problems. This finding challenges belief-first and reasoning-first models, but is directly predicted by parallel-process models, which assume that the outputs of simultaneous heuristic and analytic processing streams lead to an awareness of belief - logic conflicts than then require time-consuming resolution. This essay discusses the instructional value of mathematical proofs using different interpretations of the analysis cum synthesis method in Apollonius’ Conics as a case study. My argument is informed by Descartes’ complaint about ancient geometers and William Thurston’s discussion on how mathematical understanding is communicated. Three historical frameworks of the analysis/synthesis distinction are used to understand the instructive function of the analysis cum synthesis method: the directional interpretation, the structuralist interpretation, and the phenomenological interpretation. I apply these interpretations to the (...) analysis cum synthesis method in order reveal how the same underlying mathematical activity occurs at different levels of scale: at the level of an individual proof, at the level of a collection of proofs, and at the level of a single line within a proof. On the basis of this investigation, I argue that the instructive value of mathematical proof lies in engendering in the reader the same mathematical activity experienced by the author themselves. In this comprehensive collection of essays, most of which appear for the first time, eminent scholars from many disciplines—philosophy, economics, sociology, political science, demography, theology, history, and social psychology—examine the causes, nature, and consequences of present-day consumption patterns in the United States and throughout the world.

Current challenges in medical practice, research, and administration demand physicians who are familiar with bioethics, health law, and health economics. Curriculum directors at American Association of Medical Colleges-affiliated medical schools were sent confidential surveys requesting the number of required hours of the above subjects and the years in which they were taught, as well as instructor names. The number of relevant publications since 1990 for each named instructor was assessed by a PubMed search.In sum, teaching in all three subjects combined (...) comprises less than two percent of the total hours in the American medical curriculum, and most instructors have not recently published articles in the fields they teach. This suggests that medical schools should reevaluate their curricula and instructors in bioethics, health law, and health economics. (shrink)

Research on self-agency emphasizes the importance of a comparing mechanism, which scans for a match between anticipated and actual outcomes, in the subjective experience of doing.This study explored the “feeling of doing” in individuals with checking symptoms by examining the mechanism involved in the experienced agency for outcomes that matched expectations. This mechanism was explored using a task in which the subliminal priming of potential action-effects generally enhances people’s feeling of causing these effects when they occur, due to the unconscious (...) perception of a match between primed and observed outcomes. The main result revealed a negative relationship between checking and self-agency for observed outcomes that were primed prior to actions. This suggests that checking individuals fail to grasp the correspondence between actual outcomes of their actions and expected ones. We discuss the possible role of undermined self-agency in checking phenomena and its relationship with cognitive dysfunction. (shrink)

Stanovich & West's dual-system represents a major development in an understanding of reasoning and rationality. Their notion of System 1 functioning as a computational escape hatch during the processing of complex tasks may deserve a more central role in explanations of reasoning performance. We describe examples of apparent escape-hatch processing from the reasoning and judgement literature.

In recent years there has been an upsurge of research aimed at removing the mystery from insight and creative problem solving. The present special issue reflects this expanding field. Overall the papers gathered here converge on a nuanced view of insight and creative thinking as arising from multiple processes that can yield surprising solutions through a mixture of “special” Type 1 processes and “routine” Type 2 processes.

The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. This study examined cognitive representations of routine action, through the assessment of level of agency, in individuals with sub-clinical checking. The level of agency stems from Action Identification Theory [Vallacher, R. R., Wegner, D. M. . Levels of personal agency: Individual variation in action identification. Journal of Personality and Social Psychology 57, 660–671], which states that how actions are usually identified reflects the predominant accessibility of internal representation . Furthermore, this framework proposed that altered action regulation is related to low-level (...) of agency . In the current study, the main result indicated that checking symptoms were related to a low-level of agency, that is, individuals with sub-clinical checking identified habitual actions on the basis of instrumental aspects. This seems to indicate that checkers may act with a lack of goal representations. The results are discussed in terms of the role of low-level of agency in checking phenomena and related cognitive dysfunction. (shrink)

The Greenberger-Horne-Zeilinger state is the most famous example of a state with multiparticle entanglement. In this article we describe a group theoretic framework we have been developing for understanding the entanglement in general states of two or more quantum particles. As far as entanglement is concerned, two states of n spin-1/2 particles are equivalent if they are on the same orbit of the group of local rotations (U(2)n). We consider both pure and mixed states and calculate the number of independent (...) parameters needed to describe such states up to this equivalence. We describe how the entanglement of states in a given equivalence class may be characterized by the stability group of the action of the group of local rotations on any of the states in the class. We also show how to calculate invariants under the group of local actions for both pure and mixed states. In the case of mixed states we are able to explicitly exhibit sets of invariants which allow one to determine whether two generic mixed states are equivalent up to local unitary transformations.
