My contribution to the first round of a tetralog with Bill Brewer, Anil Gupta, and John McDowell. Each of us has written a response to the writings of the other three philosophers on the topic "Empirical Reason". My initial contribution focuses on what we know a priori about perception. In the second round, we will each respond to the each writer's first-round contributions.

This article addresses the tensions between the struggle for gender equality and the struggle for cultural rights in the particular form championed by traditionalists within the ANC after 1994. While both sets of rights are recognized in the 1996 Constitution, the right to equality takes precedence. Nevertheless, a ‘turn to tradition’ within the ANC has seen the consolidation of patriarchal traditional institutions in the communal areas. These developments reflect the predominance of very thin understandings of both gender equality and culture (...) within the organization. They have, however, been challenged by activists, with the principle of gender equality proving to be a significant impediment to the traditionalist agenda. The manner in which these dynamics have unfolded places gender at the centre of struggles over the meaning and practice of equality and democracy in post-apartheid South Africa. (shrink)

The predominant view of moral virtue can be traced back to Aristotle. He believed that moral virtue must involve intellectual excellence. To have moral virtue one must have practical wisdom - the ability to deliberate well and to see what is morally relevant in a given context. Julia Driver challenges this classical theory of virtue, arguing that it fails to take into account virtues which do seem to involve ignorance or epistemic defect. Some 'virtues of ignorance' are counterexamples to accounts (...) of virtue which hold that moral virtue must involve practical wisdom. Modesty, for example, is generally considered to be a virtue even though the modest person may be making an inaccurate assessment of his or her accomplishments. Driver argues that we should abandon the highly intellectualist view of virtue and instead adopt a consequentialist perspective which holds that virtue is simply a character trait which systematically produces good consequences. Mitter's study argues that until the late Qing, concepts of international order and justice were alien to China's imperial rulers. Subsequently, however, in the nineteenth and early twentieth centuries, China perceived itself to be the victim in an unjust world of aggressive, powerful, Western states. Contemporary Chinese perceptions of a just international order have been shaped by such past experiences and encompass a strong element of restitution. Chapter 20 of book II of John Locke’s An Essay Concerning Human Understanding, titled ‘Of Modes of Pleasure and Pain’ is the most extensive discussion of emotions available in Locke’s corpus. Likewise, Nouveaux essais sur l’entedement humain, II, xx, together with the following chapter xxi remains the chief source of Leibniz’s views of emotions. They offer a very interesting and captivating discussion of moral philosophy and good life. The chapter provides also a great platform to study Leibniz’s argumentative techniques and (...) the differences between the philosophers in general. Locke strives to explain the emotions with a single, unifying notion of uneasiness while Leibniz’s view of the mind is much more complex and he finds more unique ways of explaining different emotions. My paper focuses on Leibniz’s critique of Lockean uneasiness as an explanans for emotions. He views uneasiness as a unavoidable part of all our mental states and therefore it is not sufficient to explain passions or moral wrong-doing of men. I will discuss such passions as love, joy, sorrow, hope, fear, despair, anger, envy and shame and consider Locke’s possible response to Leibniz’s critique. (shrink)

Interest in Corporate Social Responsibility (CSR) has proliferated in academic and business circles alike. In the context of CSR, the spotlight has traditionally focused on the role of the private sector particularly in view of its wealth and global reach. Other actors have recently begun to assume more visible roles in the context of CSR, including Non-governmental organizations (NGOs) which have acquired increasing prominence on the socio-economic landscape. This article examines five partnerships between businesses and NGOs in a developing country (...) context that fall in the realm of CSR. The article starts with a literature review, delineating foundational underpinnings that have to be carefully designed and crafted to promote the success of collaborative ventures. An empirical study of five selected partnerships between businesses and NGOs in Lebanon is then presented, allowing to derive interesting insights into types of existing alliances, their relational characteristics as well as salient factors considered most determinant of success or failure in this regard. The article considers the relation between Chinese philosophy as an academic discipline and Western philosophy. In the academy there are three ways Chinese philosophy can relate to Western philosophy: Chinese philosophy may see itself as the other of Western philosophy, Chinese philosophy may seek recognition from Western philosophy, and Chinese philosophy may refuse to see Western philosophy as the measure for what is philosophy. I consider scholars from each of these three positions as well as the debate between them. Through (...) this review it becomes clear that the relation between Chinese and Western philosophy is an uneasy one. In conclusion I suggest that the relation between Chinese and Western philosophy is not a relation between two separate entities; the rise of Chinese philosophy is rather a symptom of the decline of Western learning. The basic question I want to ask is: can the exercise of private property rights abridge fundamental norms of democratic decision-making? And, under what conditions can it do so? To the extent that we view democratic decision making as required by justice, the issue is whether there is a deep tension between certain ways of exercising the rights of private property and that part of social justice that is characterized by democracy. To the extent that this tension holds, I will (...) argue that commitment to democratic norms implies that private capitalist firms must cooperate with a democratic assembly and government in the pursuit of the aims of a democratic assembly even when this implies some diminution of the profits of the firms. The cooperation I have in mind goes beyond the norm of faithful compliance with the law. To be sure, there are limits to this requirement as we will see in the later part of the paper. To the extent that private capitalist firms fail to do this and partially undermine the pursuit of the aims of a democratic assembly, they act in a way that is incompatible with fundamental norms of democratic governance. A critical notice of Terence Cuneo's The Normative Web and Hallvard Lillehammer's Companions in Guilt: Arguments for Ethical Objectivity.

In recent years an uneasy peace has descended in U.S. academe between those who feel research universities have done too little to advance the representation of minority groups and women and those who feel that the administrative policies developed to improve representation can and sometimes do come into conflict with core intellectual commitments of universities. Using quantitative and qualitative evidence from interviews with 47 natural sciences, engineering, and mathematics faculty members at a U.S. research university, the paper examines the background (...) characteristics of three sets of protagonists - academic progressives, academic traditionalists, and those whose views bridge the divide - and the way respondents discussed and justified their viewpoints. The paper draws on the theory of strategic action fields to illuminate the structure and dynamics of the conflict and suggests modifications to the theory that would improve its explanatory power for this case. The paper notes the tendency and temptation for scholars and critics to find a justification in the novel for silencing or categorising Locke, and for lampooning or reducing to absurdity the project and the arguments of the Essay. It argues that such approaches can miss what is most interesting in the novel’s indebtedness to the Essay, and offers a reading of a famous sequence where Walter, Toby, and Tristram mention, quote, present, rearrange and redistribute one of Locke’s key doctrines, the (...) succession of ideas. It then takes a closer look at the Essay and asks how the focus on uneasiness in Book II might qualify both the argument against innateness in Book I and the treatment of the doctrine of the succession of ideas. It re-interprets that doctrine, with Locke’s conditional support as a “succession of uneasinesses”, and makes one final visit to Shandy Hall to consider the critical role of conscience. (shrink)

This essay deals with property rights in body parts that can be exchanged in a market. The inquiry arises in the following context. With some exceptions, the laws of many countries permit only the donation, not the sale, of body parts. Yet for some years there has existed a shortage of body parts for transplantation and other medical uses. It might then appear that if more sales were legally permitted, the supply of body parts would increase, because people would have (...) more incentive to sell than they currently have to donate. To allow sales is to recognize property rights in body parts. To allow sales, however, makes body parts into “commodities”—that is, things that can be bought and sold in a market. And some view it as morally objectionable to treat body parts as commodities. (shrink)

Adam Smith said that ‘the propensity to truck, barter and exchange one thing for another is common to all men, and to be found in no other race of animals.’ Smith addressed the mark of the man economical, and there is no denying that this is the peculiar way he acts: clearly, to truck, barter and exchange is to act in a certain way. Austrian economics adopts this way of looking at the realm of economics. It prides itself as a (...) theory of human action. This claim seems ill-founded as long as so important a contribution as Ludwig von Mises’s praxeology remains insufficiently understood. In this paper, I address Barry Smith’s charge that in praxeology ‘other core notions, in addition to the concept of action, have been smuggled into and the theory is therefore not purely analytic’. I offer logical proofs of two cornerstone theorems of praxeology, the uneasiness theorem and the scarcity theorem, and thus provide vindication. Also, the findings support Mises’s controversial claim that economics is a priori founded in action theory. Thus, Carl Menger’s dream to lay foundations to economics and the other social sciences may have come true in the guise of praxeology. (shrink)

The traditional view of tax holds that consumption taxes fail tax the yield to capital, whereas income taxes do, leading to John Stuart Mill's criticism of the income tax as a "double tax" on wealth that is saved. A better analytic understanding illustrates that there are two types of consumption taxes. A prepaid consumption or (equivalently) wage tax indeed ignores the yield to capital. But a consistent progressive postpaid consumption tax gets at such yield, at the individual level, when but (...) only when the returns to capital are used to elevate lifestyles in material terms. Such a tax allows "ordinary" savings that move around labor earnings, in constant dollar terms, to different periods of an individual's life, such as times of retirement or heightened medical or educational needs. Because a progressive postpaid consumption tax falls on the yield to capital at the right time-when its use at the individual level becomes manifest-all other taxes on capital, such as capital gains, gift and estate, and corporate income taxes, can and should be repealed, in the name of fairness. This paper consists of critical interrogations and speculative reflections on the ethical bearings of Emmanuel Levinas’ resourceful and intricate views on death, otherness, and time, while illustrating the nature of the philosophical challenges confronting the interpreters of his prolific writings, and investigating their intellectual, moral and political prolongations. This line of inquiry probes the multiple aspects of ethical responsibility that are entailed by the “face-to-face” relation with the other, and their potential theoretical extensions in meditations on the notion of “visage”, (...) particularly in the context of concrete practices and everyday demands. Moreover, this study offers selective analytic parallels with Martin Heidegger’s thoughts on mortality, along with associated pointers by Jean-Paul Sartre, in view of further elucidating the ethical implications of Levinas’ thinking, and exploring their tacit entanglements with politics. It has been asserted that preaching in the first half of the twenty-first century is in crisis by the authors of Engaging Preaching. This crisis has arisen, so say the authors, due in part to those who have been entrusted to preach the ‘oracles of God’ (1 Peter 4:11), having failed to faithfully proclaim the Word of the Lord. No longer do the words of ‘Thus saith the Lord’, regularly fill the halls of the sanctuary. Instead of a sure word (...) from the Bible, those in attendance are just as likely to give tips on self-fulfillment or achieving one’s dreams. By this practice, it seems there are a significant number of pulpit practitioners who neither trust in the authority or the sufficiency of the Word of God. The situation seems bleak, but there is a remedy to be applied to this situation. Carl F. H. Henry has left us a wealth of theological writings that speak to this very problem. This paper will argue as Henry has masterfully argued for the authority of Scripture, the preacher finds a sure footing for a pulpit practice that displays the authority and the sufficiency of the Bible. It will be argued that expositional preaching is the most natural response to a robust view of the authority and sufficiency of the Word of God. (shrink)

This article offers an unprecedented close reading of the poetic texts created by the Martinican author René Ménil, whose poetry has been almost entirely neglected by scholars to date and who is better known for his philosophical and political writings than for his verse. I pay particular attention to Ménil’s treatment of geographical and cultural spaces in his published poetry from 1932 to 1950, and place that verse in dialogue with a text by another Martinican author at work around this (...) period: Edouard Glissant, and his first poetry collection, Un champ d’îles. Despite their otherwise dissimilar literary approaches, I show how both Ménil and Glissant created verse in these years where landscapes shift unpredictably, where human subjects are often overwhelmed, and where bewildering, vertiginous contact between Europe and the Caribbean is emphasized. This stands in contrast to more descriptive or directly political depictions of local nature created by other Afro-Caribbean poets during the period, and, I argue, underscores the complexities of the unsettling encounters between places and peoples occurring with increasing frequency in these years of rapid change around the Second World War. Critical examination of the concept of property in the body, with particular relevance to Stephen Munzer's work on umbilical cord blood.

When harm is caused by multiple injurers, damages are allocated among the responsible injurers in proportion to their relative responsibility for harm. This Article shows that a proportional allocation of liability between strictly-liable injurers distorts incentives to take precautions. The effects of this distortion depend on the nature of the injurers’ precautions. If precautions are complements, injurers compete for lower liability shares, which results in excessive care-taking. If precautions are substitutes, injurers are afflicted by moral hazard, which gives rise to (...) insufficient care-taking. By illuminating injurers’ strategic incentives, this Article highlights a tension between equity and efficiency under a proportional allocation of liability. (shrink)

The present revival of metaphysics seems to be characterized primarily by the fact that it is now once again respectable to turn one's attention to perennial problems and to speak of them openly as metaphysical problems. Amid the resulting discussions, a certain amount of uncertainty and caution pervades the air, and there is still a great deal of doubt about how far one may or should go with respect to metaphysical speculation. Discussion seems to be centering primarily on the meaning (...) and function of metaphysics itself and on the approaches one may legitimately take in dealing with questions concerning the existence of God and of a soul or self. Less emphasis is placed on solving specific problems, and Aristotle's notion of "being as such" or Heidegger's concern with the ground of being seem to provoke little interest this side of the Channel. In general, there is little concern with trying to tie the philosophical loose ends which characterize the present state of philosophy by producing either a bold synthesis or a new Weltanschauung. Can the law benefit from an evolutionary perspective? This little book shows how the idea of survival of the fittest can help explain legal development and the rise and fall of legal institutions. The reader is invited to join in on a journey of discovery in which the world of Darwin is connected to the topics of legal change, convergence of law, legal complexity, law in hip-hop music and the adoption of the price-payment rule. Exploring these five themes from an (...) evolutionary angle indisputably upsets our traditional view of the law, but it does fit the author's view of academia as a place for cross-disciplinary research steered by curiosity. This article provides a brief introduction to the interplay between law and religion in the health care context. First, I address the extent to which the commitments of a faith tradition may be written into laws that bind all citizens, including those who do not share those commitments. Second, I discuss the law’s accommodation of the faith commitments of individual health care providers—hardly a static inquiry, as the degree of accommodation is increasingly contested. Third, I expand the discussion to include (...) institutional health care providers, arguing that the legal system’s resistance to accommodating the morally distinct identities of institutional providers reflects a short-sighted view of the liberty of conscience. Finally, I offer some tentative thoughts about why these dynamics become even more complicated in the context of Islamic health care providers. (shrink)

Abstract:The closing section of James's "Philosophical Conceptions and Practical Results" contains a surprisingly abrupt dismissal of Kant's philosophy. This paper suggests that James's real target is his host, George Holmes Howison, whose Philosophical Union had invited James to speak at Berkeley. James and Howison shared a common commitment to pluralism in opposition to the Absolute monism such as Josiah Royce was developing. Howison relies on Kant's account of the a priori as well as his moral ideal of a Kingdom of (...) Ends in order to fashion a pluralistic form of |idealism that would avoid the errors he found in Absolute monism while also countering the influential evolutionary philosophy of Herbert Spencer. While James shared Howison's opposition to monism, as well as his critical view of Spencer, he did not share his aversion to evolutionary ideas. Ultimately, the pragmatism that he announced at Berkeley would reply to Howison's Kantian approach by retaining a pluralism while building on the modern psychology growing out of evolution. James's position would test the alliance that they had forged against monism. In time, it would prove too fragile to withstand their growing differences until a final break came in the year before James's death. (shrink)

How we think national standard languages came to dominate the world depends on how we conceptualize the way languages are linked to the people that use them. Weberian theory posits the arbitrariness and constructedness of a community based on language. People who speak the same language do not necessarily think of themselves as a community, and so such a community is an intentional, political, and inclusive production. Bourdieusian theory treats language as a form of unequally distributed cultural capital, thus highlighting (...) language’s classed nature. The rise of standard languages thus reflects a change in the class structure of a nationalizing society. In contrast, I move beyond the familiar Western cases on which these theories are based to reveal the shortcomings of both these theoretical approaches. China, with an exceptionally artificial national standard language that was promulgated by the state in an extremely top-down process, highlights the importance of intentionality in both the design of the language and the social function it was supposed to play. Building on Weber and Bourdieu, I argue that even egalitarian language standardization projects, such as the Chinese case, can result in unintended new hierarchies of privilege and power, outrunning the best intentions of their designers.
