O objetivo do presente artigo é mostrar a relevância das reflexões de Hannah Arendt sobre a possibilidade de encontrar uma fonte de autoridade na política que não se remeta a algo que esteja acima dessa esfera. Em um primeiro momento, buscaremos definir autoridade e sua importância. Em segundo momento, será investigada a tentativa de Arendt de localizar a fonte da autoridade na esfera imanente, com os exemplos das revoluções modernas francesa e americana. Por fim, será apontado a organização política espontânea (...) dos conselhos como uma tentativa de resolução da questão da autoridade, na medida em que busca conciliá-la com a igualdade. Para esse percurso serão analisadas obras de Arendt, sobretudo Entre o Passado e o Futuro, além de comentadores específicos. (shrink)

Fueled by ever-growing amounts of (digital) data and advances in artificial intelligence, decision-making in contemporary societies is increasingly delegated to automated processes. Drawing from social science theories and from the emerging body of research about algorithmic appreciation and algorithmic perceptions, the current study explores the extent to which personal characteristics can be linked to perceptions of automated decision-making by AI, and the boundary conditions of these perceptions, namely the extent to which such perceptions differ across media, (public) health, and judicial (...) contexts. Data from a scenario-based survey experiment with a national sample (N = 958) show that people are by and large concerned about risks and have mixed opinions about fairness and usefulness of automated decision-making at a societal level, with general attitudes influenced by individual characteristics. Interestingly, decisions taken automatically by AI were often evaluated on par or even better than human experts for specific decisions. Theoretical and societal implications about these findings are discussed. (shrink)

There are two principles which bear the name Frege''sprinciple: the principle of compositionality, and the contextprinciple. The aim of this contribution is to investigate whether thisis justified: did Frege accept both principles at the same time, did hehold the one principle but not the other, or did he, at some moment,change his opinion? The conclusion is as follows. There is a developmentin Frege''s position. In the period of Grundlagen he followed to a strict form of contextuality. He repeatedcontextuality in later (...) writings, but became less strict. From 1914 on,pushed by the needs of research, he comes close to compositionality. Buthe could never make the final step toward compositionality forprincipled reasons, therefore he always would reject compositionality. (shrink)

The Knowledge-Based Bio-Economy has gained prominence as an agricultural R&D agenda of the European Union. Specific research policies are justified as necessary to create a KBBE for societal progress. Playing the role of a master narrative, the KBBE attracts rival visions; each favours a different diagnosis of unsustainable agriculture and its remedies in agro-food innovation. Each vision links a technoscientific paradigm with a quality paradigm: the dominant life sciences vision combines converging technologies with decomposability, while a marginal one combines agro-ecology (...) with integral product integrity. From these divergent visions, rival stakeholder networks contend for influence over research policies and priorities, especially within the Framework Programme 7 on Food, Agriculture, Fisheries and Biotechnology, which has aimed to promote a Knowledge-Based Bio-Economy. Although the FAFB programme has favoured a life sciences vision, agro-ecological approaches have gained a presence, thus overcoming their general lock-out from agricultural research agendas. In their own way, each rival paradigm emphasises the need for collective systems to gather information for linking producers with users, as a rationale for the public sector to fund distinctive research priorities. In this paper it is argued that Hintikka's game theoreticalsemantics for Independence Friendly logic does not formalize theintuitions about independent choices; it rather is aformalization of imperfect information. Furthermore it is shownthat the logic has several remarkable properties (e.g.,renaming of bound variables is not allowed). An alternativesemantics is proposed which formalizes intuitions aboutindependence.

Why do agent-relative reasons have authority over us, reflective creatures? Reductive accounts base the normativity of agent-relative reasons on agent-neutral considerations like ‘having parents caring especially for their own children serves best the interests of all children’. Such accounts, however, beg the question about the source of normativity of agent-relative ways of reason-giving. In this paper, I argue for a non-reductive account of the reflective necessity of agent-relative concerns. Such an account will reveal an important structural complexity of practical reasoning (...) in general. Christine Korsgaard relates the rational binding force of practical reasons to the various identities or self-conceptions under which we value ourselves. The problem is that it is not clear why such self-conceptions would necessitate us rationally, given the fact that most of our identities are simply given. Perhaps, Harry Frankfurt is right in arguing that we are not only necessitated by reason, but also, and predominantly by what we love. I argue, however, that “the necessities of love” (in Frankfurt’s phrase) are not to be separated from, but should be seen as belonging to the necessities of reason. Our loves, concerns and related identities provide for a specific and important structure to practical reflection. They function on the background of reasoning, having a specific default role: they would lose their character as concerns, if there was a need for them to be cited on the foreground of deliberation or if there was a need to justify them. This does not mean that our deep concerns cannot be scrutinised. They can only be scrutinised in an indirect way, however, which explains their role in grounding the normativity of agent-relative reasons. It appears that this account can provide for a viable interpretation of Korsgaard’s argument about the foundational role of practical identities. (shrink)

Social Networking Sites (SNSs) not only enable users to read or create content about brands, but also to easily pass along this content using information diffusion mechanisms such as retweeting or sharing. While these capabilities can be optimal for viral marketing, little is known, however, about how reading brand messages passed along by SNS contacts influences online brand communication outcomes. Results of a survey with active SNS users indicate that (1) message evaluation, (2) the relationship with the sender, and (3) (...) the receiver’s opinion leadership and opinion-seeking levels influence not only the receiver’s intention to pass along the message further, but also his or her attitude towards the brand. The implications of these findings are discussed, including how these capabilities brought on by SNSs change the brand-consumer relationship online. (shrink)

This book presents the first accessible analysis of Spinoza's Tractatus Theologico-politicus, situating the work in the context of Spinoza’s general philosophy and its 17th-century historical background. According to Spinoza it is impossible for a being to be infinitely perfect and to have a legislative will. This idea, demonstrated in the Ethics, is presupposed and further elaborated in the Tractatus Theologico-politicus. It implies not only that on the level of truth all revealed religion is false, but also that all authority is (...) of human origin and that all obedience is rooted in a political structure. The consequences for authority as it is used in a religious context are explored: the authority of Scripture, the authority of particular interpretations of Scripture, and the authority of the Church. Verbeek also explores the work of two other philosophers of the period - Hobbes and Descartes - to highlight certain peculiarities of Spinoza's position, and to show the contrasts between their theories. The successful decoding of human genome and subsequent advances in new life sciences innovation create technological presuppositions of a new possibility of justice i.e. the just distribution of both social and natural goods. Although Rawlsians attempt to expand their theory to include this new possibility, they fail to provide plausible metrics of social justice in the genomics and post-genomics era. By contrast, Senians seem to succeed to do so through their index of basic capabilities. This paper explores what might be (...) regarded as a Senian perspective of distributive justice in new life sciences innovation. The argument is that, by comparing freedoms instead of primary goods, the capability theory allows not only for the identification of injustices linked to natural lottery but also for their elimination through the use of new genomic technologies, including gene-based diagnostics, gene therapy, somatic cell engineering and germ-line engineering. These innovative technologies seem to have the potential to reduce variability in natural goods and therefore enable individuals to convert social goods into well-being or welfare. (shrink)

Peptidylprolyl‐isomerases (PPIases) comprise of the protein families of FK506 binding proteins (FKBPs), cyclophilins, and parvulins. Their common feature is their ability to expedite the transition of peptidylprolyl bonds between the cis and the trans conformation. Thus, it seemed highly plausible that PPIase enzymatic activity is crucial for protein folding. However, this has been difficult to prove over the decades since their discovery. In parallel, more and more studies have discovered scaffolding functions of PPIases. This essay discusses the hypothesis that PPIase (...) enzymatic activity might be the consequence of binding to peptidylprolyl protein motifs. The main focus of this paper is the large immunophilins FKBP51 and FKBP52, but other PPIases such as cyclophilin A and Pin1 are also described. From the hypothesis, it follows that the PPIase activity of these proteins might be less relevant, if at all, than the organization of protein complexes through versatile protein binding. Theo Verbeek provides the first book-length examination of the initial reception of Descartes’s written works. Drawing on his research of primary materials written in Dutch and Latin and found in libraries all over Europe, even including the Soviet Union, Theo Verbeek opens a period of Descartes’s life and of the development of Cartesian philosophy that has been virtually closed since Descartes’s death. Verbeek’s aim is to provide as complete a picture as possible of the discussions that accompanied the (...) introduction of Descartes’s philosophy into Dutch universities, especially those in Utrecht and Leiden, and to analyze some of the major problems that philosophy raised in the eyes of Aristotelian philosophers and orthodox theologians. The period covered extends from 1637, the year in which Descartes published his _Discours de la Méthode, _until his death in 1650. Verbeek demonstrates how Cartesian philosophy moved successfully into the schools and universities of Holland and how this resulted in a real evolution of Descartes’s thought beyond the somewhat dogmatic position of Descartes himself. Verbeek further argues that this progression was an essential step in the universal propagation of Cartesian philosophy throughout Europe during the second half of the seventeenth century. As he details the disputes between Cartesians and anti-Cartesians in Holland, Verbeek shows how the questions raised were related on the one hand to religious conflicts between the Remonstrants and the Orthodox Calvinists and on the other hand to political conflicts between more liberal factions fighting for the union of church and state to enhance religious control of society in general. Contending that Descartes and Cartesian philosophy were central to the development of the modern Dutch state, Verbeek illuminates the role they played in Dutch political, religious, and intellectual life. Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...) literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta-theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Second, does RJ theory need a philosophy, and why? Finally, how can restorative practices be morally justified? (shrink)

This collection of 21 essays explores the creative interaction among the cognitive neurosciences, philosophy, and theology. It is the result of an international research conference co-sponsored by the Vatican Observatory, Rome, and the Center for Theology and the Natural Sciences, Berkeley.

The present book takes the discovery that quantum-like behaviour is not solely reserved to atomic particles one step further. If electrons are modelled as vibrating droplets instead of the usually assumed point objects, and if the classical laws of nature are applied, then exactly the same behaviour as in quantum theory is found, quantitatively correct! The world of atoms is strange and quantum mechanics, the theory of this world, is almost magic. Or is it? Tiny droplets of oil bouncing round (...) on a fluid surface can also mimic the world of quantum mechanics. For the layman - for whom the main part of this book is written - this is good news. If the everyday laws of nature can conspire to show up quantum-like phenomena, there is hope to form mental pictures how the atomic world works. The book is almost formula-free, and explains everything by using many sketches and diagrams. The mathematical derivations underlying the main text are kept separate in a -peer reviewed - appendix. The author, a retired professor of Flight Mechanics and Propulsion at the Delft University of Technology, chose to publish his findings in this mixed popular and scientific form, because he found that interested laymen more often than professional physicists feel the need to form visualisations of quantum phenomena. Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...) practical development of restorative justice. These tensions also encourage a power-interest battle between different stakeholders within the restorative movement including practitioners, theoreticians, researchers and policy makers. To approach these controversies, there needs to be an acknowledgment of the multidimensional nature of the conceptual problem of restorative justice and the impact it has on its application. The article attempts to get to grips with this problem, and provide a common ground for the future development of restorative justice. (shrink)

We examine an article of Paul Ricoeur on autonomy and vulnerability. Ricoeur presents the two notions in the field of justice as intricately woven into each other. He analyzes their interdependence on three levels of human agency. Ricoeur’s exposition has a focus on judicial judgment. After presenting Ricoeur’s argument and an analysis of his main points, the author argues that Ricoeur’s reflection lines up with some essential intentions of care ethics. Physicalism ? or roughly the view that the stuff that physics talks about is all the stuff there is ? has had a popular press in philosophical circles during the twentieth century. And yet, at the same time, it has become quite fashionable lately to believe that the mind matters in this world after all and that psychology is an autonomous science irreducible to physics. However, if (true, downward) mental causation implies non-reducibility and Physicalism implies the converse, it is hard (...) to see how these two views could be compatible. This paper reviews some classical arguments purportedly showing how the autonomy of the special sciences can be upheld without violating the laws of physics or the principle that physics constitutes a complete and closed system. These arguments are presented in order of increasing strength, indicating how the more popular arguments in fact fall short of establishing anti-reductionism of the intended kind. New arguments are added which claim to demonstrate quite effectively how downward causation is possible compatibly with the reign of physics. The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. The extant literature sees restorative justice either as alternative punishment or an alternative to punishment. This chapter puts forward the notion of restorative punishment by deconstructing the concept of pain, and by reconstructing a new vision through the notion of catharsis. In European thought a fairly general tradition has existed as to the necessary and even sacred character of any legitimate authority. Though excesses were condemned as contrary to justice, and though theories about the right of revoluion existed, in practice the concept of authority was considered as having its justification in itself. The Platonic version of this belief is that justice in the ruler consists in his conformity to preestablished and divine laws. This conviction was for the first time seriously (...) challenged in our century, as a consequence of the fact that large-scale crimes had become possible because millions of people had delegated the responsibility for their actions to authorities in command. It was Karl Popper who identified this Western tradition as an heritage from Plato. His views went contrary to the standard interpretation of Plato by the majority of classical scholars, who took great pains to refute Popper's work, though with little succes. The originality of Popper's work is twofold. Plato's theories about justice in the state were historically interpreted as representing the mentality of the closed society in opposition to that of a more developed and open type of society. Moreover, Popper was the first to give an analysis of the philosopher's unconscious motives by interpreting, on psycho-analytical principles, a wide range of significant passages in Plato's work. This paper takes as its starting point the particular place of woman in the legal norms since Antiquity, including in sacred texts, especially in the legislation on marriage and adultery. We then present, from De Cive, the Hobbes’ theistic jusnaturalism as an original attempt to found in God and in reason the laws to which women are subjected. But at the moment of his exegesis of verses 5,31-32 of the Gospel of Matthew on repudiation, it seems that his conceptual arsenal (...) wavers : between temporal reign and divine authority, the figure of Jesus threatens the Hobbesian edifice with collapse. We conclude with the idea that it is still positive legislation around women that crystallizes the crucial problems of the anthropology of law and, more generally, of the relationship between the human and the divine. This review portraits FK506 binding protein (FKBP) 51 as “reactivity protein” and collates recent publications to develop the concept of FKBP51 as contributor to different levels of adaptation. Adaptation is a fundamental process that enables unicellular and multicellular organisms to adjust their molecular circuits and structural conditions in reaction to environmental changes threatening their homeostasis. FKBP51 is known as chaperone and co‐chaperone of heat shock protein (HSP) 90, thus involved in processes ensuring correct protein folding in response to proteotoxic stress. (...) In mammals, FKBP51 both shapes the stress response and is calibrated by the stress levels through an ultrashort molecular feedback loop. More recently, it has been linked to several intracellular pathways related to the reactivity to drug exposure and stress. Through its role in autophagy and DNA methylation in particular it influences adaptive pathways, possibly also in a transgenerational fashion.Also see the video abstract here. (shrink)

The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...) in the domestic legal orders of the 46 member states of the Council of Europe. This account shows how an interplay currently taking place between judicial, policy, and statutory powers is marking the end of the adversarial-inquisitorial era. Finally, the conclusion identifies the three most important impediments that are likely to hamper this harmonization process. (shrink)

Since the establishment of the Human Genome Project and the identification of genes in human DNA that play a role in human diseases and disorders, a long, moral and political, battle has began over the extension of IPRs to information contained in human genetic material. According to the Nuffield Council on Bioethics, over the past 20 years, large numbers of human genes have been the subject of thousands of patent applications. This paper examines whether human gene patents can be justified (...) in terms of liberal theories of morality such as natural law, personality development, just reward and social utility. It is argued that human gene patents are in conflict with fundamental principles of liberal morality and justice because they result in "genetic information feudalism". (shrink)
