Artificial Intelligence and algorithms are increasingly able to replace human workers in cognitively sophisticated tasks, including ones related to justice. Many governments and international organizations are discussing policies related to the application of algorithmic judges in courts. In this paper, we investigate the public perceptions of algorithmic judges. Across two experiments (N = 1,822), and an internal meta-analysis (N = 3,039), our results show that even though court users acknowledge several advantages of algorithms (i.e., cost and speed), they trust human (...) judges more and have greater intentions to go to the court when a human (vs. an algorithmic) judge adjudicates. Additionally, we demonstrate that the extent that individuals trust algorithmic and human judges depends on the nature of the case: trust for algorithmic judges is especially low when legal cases involve emotional complexities (vs. technically complex or uncomplicated cases). Anglophone philosophy in the last three decades has seen a growing interest in the way participation in human society—as characterized by our doing things that count as taking up and conferring norm-governed roles within institutions like language, the law, social custom, and education—is part of what explains our existence as rational (to whatever extent we are) animals. Using the label discursive norms to refer to the standards of evaluation that attend the exercise of rational thought and agency, this development in (...) philosophy can be understood as a growing interest over the the social institution of discursive norms. The essays in this volume present a sample—by no means representative—of the sorts of issues that arise when we ask and look to answer questions about the way our social lives constrain and support our lives as rational animals. Qualitative consciousness is conscious experience marked by the presence of sensory qualities, like the experienced painfulness of having a piano dropped on your foot, or the consciousness of seeing the brilliant reds and oranges of a sunset. Over his career, philosopher David Rosenthal has defended an influential theoretical approach to explaining qualitative consciousness. This approach involves the development of two theories – the higher-order thought theory of mental state consciousness and the quality space theory of sensory quality. If the problem (...) of explaining qualitative consciousness is divided into two more manageable pieces, the door opens to a satisfying explanation of what is seen by some to be an intractable explanatory puzzle. This interdisciplinary collection develops, criticizes, and expands upon themes inspired by Rosenthal's work. Bernard Williams was one of the great philosophical figures of the second half of the 20th century and remains deeply influential. This edited volume brings together new articles from prominent scholars that focus on the innovative ideas and methods that Williams developed as part of his distinctive "outlook" in ethics. The chapters in the first section examine Williams's attempts to explore theoretical options beyond the confines of what he called the "morality system." The contributors show how, through a critical confrontation (...) with this system, Williams found new ways to think about moral obligation, morally relevant emotions such as shame, the relevance of the history of philosophy, and also how these new ways of thinking are linked to Williams's novel metaethical ideas concerning the possibility and limits of moral knowledge. In the second section, contributors explore Williams's discussions of freedom and responsibility, the role of luck in our moral lives, and the reasons that agents can be said to have. Williams's concerns about the morality system still loom large here. For example, Williams was skeptical about the prospects of putting our responsibility practices, and the conception of free will with which they are associated, on a firm footing. But as more than one contributor shows, Williams's skepticism is largely confined to conceptions of free will and responsibility that are conditioned by the morality system's uneasiness with luck. Williams has a more vindicatory story to tell about the prospects for freedom and responsibility once these concepts have been untethered from the assumptions of this system. With a cast of well known contributors, and an introduction by the editors placing Williams's work in broad context, this volume should appeal to a wide range of ethicists and moral philosophers. In each volume, a majority ofthe contributors are from Australia or New Zealand. New York: Oxford University Press, 2003, 283 pp., hardcover. Over the last few decades, there has been a remarkable output of several books and articles on the philosophy of music. Stephen Davies is one of the leading contributors to this growing literature in the Philosophy of Music. This (...) important and thought-provoking volume collects fifteen of Davies's essays on various philosophical issues pertaining to music such as ontology, performance, expression, and appreciation. With the exception of two, all of the essays have been published before. There is not enough space here to do justice to all fifteen essays, and thus I focus on those that strike me as most important and where I disagree with Davies.First a word about the book's relevance to aesthetic education and itspotential for use in aesthetic education. Davies's book strikes me as having immense potential for aesthetic education. I can easily see the various essays as being of great value in educating performers, composers, musicologists, and music lovers about various aspects of performance and appreciation especially. Here is a brief list of questions pertinent to aesthetic education that Davies's work raises and addresses: Why is performance on authentic instruments important? What is involved in understanding musical works? Is technical training necessary to appreciate musical works fully? To what degree can the performer create her own interpretation of a work, and how much does the score constrain her?Now on to the essays themselves. The first part of Davies's volume concerns ontology, and the first essay "John Cage's 4'33": Is it Music?" addresses this very famous musical work. Davies argues that 4'33" is not music but rather a theatrical piece about music because it does not exclude anysounds as being ambient noise, as Davies thinks musical works should do. Davies does not deny, however, that this work is an artwork. He thinks instead that the work is not organized sound, as all music must be, for it does not exclude any sonic events during performance as ambient; even sounds made by the performer of this work, claims Davies, are mistakes and not ambient. Thus neither Cage nor the performer organize (select, appropriate) sounds. Davies also suggests that while Cage wants us to have an aesthetic interest in the sonic properties of 4'33," he failed in his intention for we hear the work instead in musico-historical terms.Contrary to Davies's view, one mustwonder if 4'33" just is a theatrical piece about music, not a musical work as such. Unlike theater and theatrical works which are meant to be both seen and heard, Cage's work is only meant to be heard. Davies's view would seem to neglect this important auditory aspect in claiming that the work is just theater not music. Besides, why must all musical works exclude some soundsas ambient, and why might Cage's [End Page 108] work not be an exception to this? Why couldn't 4'33" be a limiting case of music, at one extreme of a range of musical works? As for Davies's claim that any sounds made by the performer who is supposed to be silent are mistakes not ambient noise, one must wonder if Cage intended instead that sounds made by the performer (such as musical tones or coughs) be bracketed by listeners as not part of the work while sounds made by the audience are part of the work, thus undermining the audience-performer distinction. Moreover, against Davies's claim that Cage intended us to have an aesthetic interest in sonic properties, I submit that Cage was Zen-influenced and not committed to such dualisticaesthetic concepts (such as beautiful vs. ugly) or any concepts for that matter, whether musico-historical or not. Instead, Cage intended us to simplylisten, with an open mind and openears, without adhering rigidly to concepts or hearing 4'33" in musico-historical terms, difficult as that may be. It has become typical to read Kant and Merleau-Ponty as offering competing approaches to perceptual experience. Kant is interpreted as an ‘intellectualist’ who regards perception as conceptual ‘all the way out’, while Merleau-Ponty is seen as Kant’s challenger, who argues that perception involves non-conceptual, embodied ‘coping’. In this paper, however, I argue that a closer examination of their views of perception, especially with respect to the notion of ‘schematism’, reveals a great deal of historical and philosophical continuity between them. By (...) analyzing Kant’s theory of schematism, the interpretation of it by the Neo-Kantian Pierre Lachièze-Rey, and Merleau-Ponty’s theory of the body schema, we find that aspects of Merleau-Ponty’s theory of perception are better understood as a development of Kant’s theory of perception. This paper investigates Neoplatonist literary criticism by framing the special interest in the target of each dialogue within the context of cosmo-literary theory. The starting hypothesis is that the themes of Plato's dialogues do not fully meet the expectations of a new didactics based on isagogical schemes as an image of Neoplatonic metaphysics. Among these schemes is the target of each dialogue, whose relation to the theme can be explained, in a fruitful and innovative way, through a cosmic analogy. (...) Thus after examining the more or less explicit criticism of literary criteria of analysis by Plato's ancient exegetes, this article will focus on how Neoplatonists load the Greek term skopos (target) with metaphysical content and, accordingly, on how we should translate it in accordance with the commentators’ intentions. It will show that the target is the literary counterpart to the One, but that it should not be confused with the theme because the latter must be seen as the literary counterpart to the Intellect. In this dissertation, I develop and defend some of W. D. Ross’s moral views. Ross’s views, I argue, are often highly plausible, though it is also often the case that variations on (or modifications to) his views are needed in order to remain philosophically tenable. In my dissertation, I explain why these variations are necessary and what they should look like. In chapter 1, I discuss Ross’s theory of moral rightness in his most important work, The Right and the Good. (...) In chapters 2 and 3, I correct various misunderstandings about Ross’s position: I argue that he is no more a particularist about absolute duty than a utilitarian or a Kantian is, and on many definitions of “pluralism” present in the literature, he is not in fact a pluralist, as he is typically assumed to be. In chapter 4, I discuss several objections that Ross later comes to make to his own theory of rightness; I argue, however, that none of them are any good. In chapter 5, I argue against Ned Markosian’s recent claim that “Rossian Minimalism” is the best theory of rightness that makes use of the concept of a prima facie duty: Ross’s own theory (or, at least, a “world” version of it) is, I maintain, superior to Rossian Minimalism. In chapter 6, I address some objections to Ross’s theory suggested by Michael Stocker and Michael Slote and demonstrate that the best way of responding to them is by transforming Ross’s theory into a “dual-ranking” one. In chapter 7, I discuss Ross’s theory of the subjective sense of “right” (chapters 1-6 are primarily concerned with Ross’s theory of the objective sense of the term). I show that Ross’s theory is problematic, and I offer a better theory in its place. In chapter 8, I turn to Ross’s theory of moral goodness. I argue that his theory is more plausible than other theories suggested in the literature, but it suffers from the “nepotism problem.” I show that Ross’s solution to this problem is unsatisfactory and suggest a better way forward. In this rich and extensive essay Goodman argues that Spinoza's radical rationalism makes him pursue syntheses between traditionally opposed poles. Lee Rice's article, "Love of God in Spinoza," carefully analyzes Spinoza's concept of love and suggests the existence of three kinds of love parallel to the three kinds of knowledge. Warren Montag addresses the unresolved issue of Spinoza's relation to the Kabbalah. Montag sides with Deleuze against the association of Spinozism with the Neo-Platonic theory of emanation, arguing that unlike the Neo-Platonists and Kabbalists, Spinoza's view of God rules out any hierarchy, and does not assume a descent from primal simplicity into complexity. Edwin Curley contributes a beautiful reading of the story of Job and of Maimonides' interpretation of the story. Curley follows Maimonides' discussion of the various positions regarding the question of divine providence and his attempt to identify the speeches of the characters of the book of Job with each of these positions. Following a sensitive consideration of various attempts to [End Page 417] recover Maimonides' own rather concealed view about providence, Curley concludes that "[W]hatever you think Maimonides' final word on Job is, our examination of him certainly supports [Spinoza's] claim that [Maimonides] reads Scripture in terms of Platonic or Aristotelian speculations" (170).Warren Zev Harvey's essay addresses Spinoza's most neglected work, the Compendium of the Grammar of the Hebrew Language. Apart from providing an outline of Spinoza's work as a Hebrew grammarian ("a noun-intoxicated grammarian") and pointing out some of Spinoza's more eccentric views about the nature of the Hebrew language, Harvey makes a compelling case for the importance of the book for the study of Spinoza's metaphysics. He points out a fascinating analogy which Spinoza draws between the parts of speech: (proper) noun, adjectives, and participles, and Spinoza's key metaphysical terms: substance, attributes, and modes. (Think about the weighty implications of this analogy for Curley's interpretation of the substance-mode relation.) According to Harvey, Spinoza's claim that all Hebrew words are derived from nouns is a linguistic parallel to Spinoza's pivotal metaphysical doctrine which makes all things be in the substance (or God). Kenneth Seeskin's article discusses the views of Maimonides and Spinoza on the question of creation and God's relation to the world. Seeskin reconstructs an interesting critical dialogue between these two philosophers. According to Seeskin, both philosophers held that an effect must be similar to its cause. Maimonides' commitment to Negative Theology and to the denial of any common measure between God and finite things forced him to deny causal or explanatory relation between God and the world. What Maimonides can suggest instead is rather to prove that the emergence of the world ex nihilo and according to the divine will, is possible, and even likely given certain astronomical facts of medieval science. Thus, Maimonides would hold that "although we have grounds for believing that creation occurred, we will never be in a position to say how" (120). For Spinoza, such a view constitutes nothing but a "sanctuary of ignorance." Thus, according to Seeskin, Spinoza affirms a clear causal relation between God and the world of finite things insofar as God is said to explain the world. While I tend to agree with most aspects of this analysis, it is important to note that Spinoza also claims that "between the finite and infinite there is no relation" (Letter 54). This... (shrink)

This monographic chapter explains how expected utility (EU) theory arose in von Neumann and Morgenstern, how it was called into question by Allais and others, and how it gave way to non-EU theories, at least among the specialized quarters of decion theory. I organize the narrative around the idea that the successive theoretical moves amounted to resolving Duhem-Quine underdetermination problems, so they can be assessed in terms of the philosophical recommendations made to overcome these problems. I actually follow Duhem's recommendation, (...) which was essentially to rely on the passing of time to make many experiments and arguments available, and evebntually strike a balance between competing theories on the basis of this improved knowledge. Although Duhem's solution seems disappointingly vague, relying as it does on "bon sens" to bring an end to the temporal process, I do not think there is any better one in the philosophical literature, and I apply it here for what it is worth. In this perspective, EU theorists were justified in resisting the first attempts at refuting their theory, including Allais's in the 50s, but they would have lacked "bon sens" in not acknowledging their defeat in the 80s, after the long process of pros and cons had sufficiently matured. This primary Duhemian theme is actually combined with a secondary theme - normativity. I suggest that EU theory was normative at its very beginning and has remained so all along, and I express dissatisfaction with the orthodox view that it could be treated as a straightforward descriptive theory for purposes of prediction and scientific test. This view is usually accompanied with a faulty historical reconstruction, according to which EU theorists initially formulated the VNM axioms descriptively and retreated to a normative construal once they fell threatened by empirical refutation. From my historical study, things did not evolve in this way, and the theory was both proposed and rebutted on the basis of normative arguments already in the 1950s. The ensuing, major problem was to make choice experiments compatible with this inherently normative feature of theory. Compability was obtained in some experiments, but implicitly and somewhat confusingly, for instance by excluding overtly incoherent subjects or by creating strong incentives for the subjects to reflect on the questions and provide answers they would be able to defend. I also claim that Allais had an intuition of how to combine testability and normativity, unlike most later experimenters, and that it would have been more fruitful to work from his intuition than to make choice experiments of the naively empirical style that flourished after him. In sum, it can be said that the underdetermination process accompanying EUT was resolved in a Duhemian way, but this was not without major inefficiencies. To embody explicit rationality considerations into experimental schemes right from the beginning would have limited the scope of empirical research, avoided wasting resources to get only minor findings, and speeded up the Duhemian process of groping towards a choice among competing theories. In "Contractualism and Justification," Scanlon identifies some difficulties in his theory and explores possible ways to deal with them. In "Improving Scanlon’s Contractualism," D. Parfit recommends revisions and extensions of Scanlon’s theory, while R. Forst suggests in "Justification Fundamentalism" that Scanlon may want to replace reason with justification as his foundational concept. (...) T. Nagel raises fundamental questions concerning "Moral Reality and Moral Progress," and S. Mantel offers in "On How to Explain Rational Motivation" a critical discussion of Scanlon’s cognitivist theory of motivation. Z. In the process of interpreting works of pictorial art, it is easier to understand not the "style", but the "theme", that is, not how to write, but what to write. In the history of modern art, which attaches more importance to "style", the problem of "theme" is not fundamental and is among the primitive issues worthy of the attention of amateurs who do not understand art. However, sometimes it is in simplicity that the essence lies. The simplest questions (...) that interest almost everyone are the link between works of art and society. When analyzing the "topic", the subject under study is not confined to one work of art, since an integrated approach to the consideration of the problem should be used. The author's main contribution to the study of the history of the development of Chinese painting is a new perspective – the analysis of works based on the "theme". The results of the study revealed the main themes of Chinese pictorial art, identified the main reasons for referring to them, and also established their symbolic meaning, connection with philosophical and literary traditions. The important role of literary scientists in determining the directions of thematic development of Chinese landscape painting is revealed, the significance of the images of the fisherman and the traveler as carriers of the spiritual content of the landscape is determined. The conclusion is made about the prominence of certain themes in the pictorial art, depending on the processes of social development of China. (shrink)

Fully embracing previous achievements in the research of Taoist philosophy, this paper attempts to create a sound analysis and investigation of the value concern of Taoism and reconstruct a new set of Taoist philosophy conforming to the requirement of modern science from the perspective of modern philosophy. The author sincerely wishes that the preliminary understanding of the Taoist philosophy presented in this paper would contribute to the construction of the Taoist philosophy.

The main theme of Nietzsche’s first published work, The Birth of Tragedy, is that the affirmation of life requires ‘illusion’ which allows us to cope with the ‘insight into the horrible truth’ of our condition. This article argues that Nietzsche held the same position in his later works: that illusion is a necessary to affirm life. The discussion is organized as follows. Section 1 sets out the core thesis of BT vis-à-vis the relationship between affirmation and illusion. Section 2 (...) examines the role of illusion in one of Nietzsche’s litmus tests of affirmation found in The Gay Science of 1882, ‘amor fati’—that is, the ability ‘to see as beautiful what is necessary in things’. Sections 3, 4, and 5 consider Nietzsche’s understanding of ‘self-creation’ and how, through the employment of ‘distance’ and ‘pretence’, it engenders an affirmation of existence. Four themes in the Book of the Twelve (the Day of YHWH, fertility of the land, the fate of God's people, and theodicy) have surfaced in the discussion of editorial activity, literary development, and theological perspectives. These themes deserve exploration for the role they play as a lens for reading the Book of the Twelve as a composite unity.
