People tend to contribute more—and think they have stronger obligations to contribute more—to rescuing an identified victim rather than a statistical one. Indeed, they are often disposed to contribute more to rescuing a single identified victim than a greater number of statistical ones. By an “identified victim,” I mean Terry Q., lying injured in the passenger seat of the wrecked automobile on the corner of Main Street and Broadway, or Jessica McClure, the child who fell into the Texas well (...) in 1987 and whose family was sent $700,000 in donations for her. We need not know their names, however, and we can accept a very minimal form of identification. By a “statistical victim,” I mean the person who, extrapolating from traffic records, will be in a similar, serious car accident tomorrow (and may then be identified), or the children who will fall into wells next year if we do not cap them better than we did the well that trapped Jessica. Does this disposition (or perceived obligation) have any normative force? I initially thought there could be no such normative force, but consequentialist and nonconsequentialist arguments, pro and con, have convinced me that reasonable people can disagree with each other. This disagreement poses a problem for political philosophy: how should policy choices take such disagreement into account? (shrink)

A common response to Richard Dawkins' assault on religious belief has been that he is attacking a straw man. The beliefs of religious believers, so the protest goes, are not as crude and simplistic as the ones which he attributes to them. Here is Terry Eagleton's comment to that effect: Imagine someone holding forth on biology whose only knowledge of the subject is the Book of British Birds , and you have a rough idea of what it feels like (...) to read Richard Dawkins on theology. This Essay examines debates surrounding Qu Tongzu's ‘Confucianization of law’ theory. Qu's theory claims that Chinese law underwent a process of ‘Confucianization’ starting in the Han dynasty (202 BC–220 AD) and ending and culminating in the Tang dynasty (618–907), where the Confucian concept of li and other Confucian moral teachings were introduced and incorporated into the written law. I argue that Qu's theory should be properly characterised as a theory of descriptive jurisprudence and also a form of the mirror thesis. (...) In light of this characterisation, this Essay then lays out the possible counterarguments that could be raised against Qu's theory and then situates existing scholarship in the debate in these categories. I then test Qu's theory using a case study about kinship concealment in traditional Chinese law The Essay then concludes by urging that the debate should include more jurisprudential approaches. In his 1958 seminal paper “Saints and Heroes”, J. O. Urmson argued that the then dominant tripartite deontic scheme of classifying actions as being exclusively either obligatory, or optional in the sense of being morally indifferent, or wrong, ought to be expanded to include the category of the supererogatory. Colloquially, this category includes actions that are “beyond the call of duty” (beyond what is obligatory) and hence actions that one has no duty or obligation to perform. But it is a (...) controversial category. Some have argued that the concept of supererogation is paradoxical because on one hand, supererogatory actions are (by definition) supposed to be morally good, indeed morally best, actions. But then if they are morally best, why aren't they morally required, contrary to the assumption that they are morally optional? In short: how can an action that is morally best to perform fail to be what one is morally required to do? The source of this alleged paradox has been dubbed the ‘good-ought tie-up’. In our article, we address this alleged paradox by first making a phenomenological case for the reality of instances of genuine supererogatory actions, and then, by reflecting on the relevant phenomenology, explaining why there is no genuine paradox. Our explanation appeals to the idea that moral reasons can play what we call amerit conferring role. The basic idea is that moral reasons that favor supererogatory actions function to confer merit on the actions they favor—they play a merit conferring role—and can do without also requiring the actions in question. Hence, supererogatory actions can be both good and morally meritorious to perform yet still be morally optional. Recognition of a merit conferring role unties the good-ought tie up, and (as we further argue) there are good reasons, independent of helping to resolve the alleged paradox, for recognizing this sort of role that moral reasons may play. Applied a theory of information integration to decision making with probabilistic events. 10 undergraduates judged the subjective worth of duplex bets that included independent gain and lose components. The worth of each component was assumed to be the product of a subjective weight that reflected the probability of winning or losing, and the subjective worth of the money to be won or lost. The total worth of the bet was the sum of the worths of the 2 components. Thus, each (...) judgment required multiplying and adding operations. The multiplying model worked quite well in 4 experimental conditions. The adding model showed more serious discrepancies, though these were small in magnitude. The theory of functional measurement was applied to scale the subjective values of the probability and money stimuli. Subjective and objective values were nonlinearly related both for probability and for money. (shrink)

So far, interpreters have not made the import of this last clause clear. F. J. Church translates the last phrase ‘they act at random’. Burnet says of Adam that he seems to have been the first to point out that the meaning cannot be ‘they act at random’. Instead, ‘the phrase expresses indifference’. Adam′s idea, which Burnet here commends, is that the many are thoughtless in their treatment of the individual; and Adam compares 48C below: the many would lightly put (...) someone to death and just as lightly bring him back to life again. The Burnet-Adam point is evidently that the many have a policy of acting indifferently, or just as it occurs to them—by contrast with the ‘at random’ in Church′s translation, which suggests that they act without policy at all. Moral judgments are typically experienced as being categorically authoritative – i.e. as having a prescriptive force that is motivationally gripping independently of both conventional norms and one's pre-existing desires, and justificationally trumps both conventional norms and one's pre-existing desires. We argue that this key feature is best accommodated by the meta-ethical position we call ‘cognitivist expressivism’, which construes moral judgments as sui generis psychological states whose distinctive phenomenological character includes categorical authoritativeness. Traditional versions of expressivism cannot easily accommodate the justificationally (...) trumping aspect of categorical authoritativeness, because they construe moral judgments as fundamentally desire-like. Moral realism cannot easily accommodate the aspect of inherent motivational grip, because realism construes moral judgments as a species of factual belief. (shrink)

Nardin examines the moral principles underlying the idea of humanitarian intervention from the perspective of international law and from that of the natural law tradition.

To be Black means to have ancestors whose humanity has been de-nied by slavery, colonialism, neo-colonialism, and segregation, as well as by many theories elaborated in order to justify and intensify these modes of domination. To be Black also means having to face the enduring legacies of these systems and theories, which predomi-nantly manifest through overexposure to violence and death. Today, premature death and habituation to loss remain constitutive fea-tures of Black experience. Dignity, often de????ined as the inherent value of (...) every single human being, has been a core concept in ethics since Kant, at least. But in both philosophy and modern politics, the claim of respect for the dignity of people has coexisted with deep antiblack-ness. However, apart from the Western understanding of dignity stands another tradition. The concept of dignity is pervasive in Black radicalism, Caribbean philosophy, and African thought since the 18th century. This article draws inspiration from the legacy of these thinkers to elaborate an ethics centred on the speci????icities of racial-ized life. (shrink)

Morphological content is information that is implicitly embodied in the standing structure of a cognitive system and is automatically accommodated during cognitive processing without first becoming explicit in consciousness. We maintain that much belief-formation in human cognition is essentially morphological : i.e., it draws heavily on large amounts of morphological content, and must do so in order to tractably accommodate the holistic evidential relevance of background information possessed by the cognitive agent. We also advocate a form of experiential evidentialism concerning (...) epistemic justification—roughly, the view that the justification-status of an agent’s beliefs is fully determined by the character of the agent’s conscious experience. We have previously defended both the thesis that much belief-formation is essentially morphological, and also a version of evidentialism. Here we explain how experiential evidentialism can be smoothly and plausibly combined with the thesis that much of the cognitive processing that generates justified beliefs is essentially morphological. The leading idea is this: even though epistemically relevant morphological content does not become explicit in consciousness during the process of belief-generation, nevertheless such content does affect the overall character of conscious experience in an epistemically significant way: it is implicit in conscious experience, and is implicitly appreciated by the experiencing agent. Is conceptual relativity a genuine phenomenon? If so, how is it properly understood? And if it does occur, does it undermine metaphysical realism? These are the questions we propose to address. We will argue that conceptual relativity is indeed a genuine phenomenon, albeit an extremely puzzling one. We will offer an account of it. And we will argue that it is entirely compatible with metaphysical realism. Metaphysical realism is the view that there is a world of objects and properties that (...) is independent of our thought and discourse (including our schemes of concepts) about such a world. Hilary Putnam, a former proponent of metaphysical realism, later gave it up largely because of the alleged phenomenon that he himself has given the label ‘conceptual relativity’. One of the key ideas of conceptual relativity is that certain concepts—including such fundamental concepts as object, entity, and existence—have a multiplicity of different and incompatible uses (Putnam 1987, p. 19; 1988, pp. 110 14). According to Putnam, once we recognize the phenomenon of conceptual relativity we must reject metaphysical realism: The suggestion . . . is that what is (by commonsense standards) the same situation can be described in many different ways, depending on how we use the words. The situation does not itself legislate how words like “object,” “entity,” and “exist” must be used. What is wrong with the notion of objects existing “independently” of conceptual schemes is that there are no standards for the use of even the logical notions apart from conceptual choices.” (Putnam 1988, p. 114) Putnam’s intriguing reasoning in this passage is difficult to evaluate directly, because conceptual [1] relativity is philosophically perplexing and in general is not well understood. In this paper we propose a construal of conceptual relativity that clarifies it considerably and explains how it is possible despite its initial air of paradox. We then draw upon this construal to explain why, contrary to Putnam and others, conceptual relativity does not conflict with metaphysical realism, but in fact comports well with it.. (shrink)

C. I. Lewis’s version of pragmatism, which he called “conceptualistic pragmatism,” has been little studied and is nowadays overlooked, eclipsed by the more famous pragmatisms of Dewey and James. However, it was Lewis’s version that came to dominate the formation of post-1945 pragmatism in the United States. It provided the framework in which Quine (his former student), Sellars, Davidson, Rorty and Brandom operated. Roughly, that structure involved a passive, sensory ineffable given and an ordering and classification of the given by (...) a priori categories. Comprehending those categories was a matter of apprehending a priori truths, but those categories were also changeable. Rational change involved giving some up and substituting others to meet certain basic human interests. We thus have the picture of mind and world that culminates in a certain sense in Brandom’s philosophy: External causal inputs linked to an internal normative inferential network which then results in causal outputs of linguistic shape. This is very different from the classical German idealist conception of mind and world, which takes the distinguishability-but-inseparability of concept and sensory intuition as its core. (shrink)

Vers 1918 Hermann Weyl abandonnait le logicisme et donc la tentative de réduire les mathématiques à la logique et la théorie des ensembles. Au niveau philosophique, ses points de référence furent ensuite Husserl et Fichte. Dans les années 1920 il distingua leurs positions, entre une direction intuitionniste-phénoménologique d’un côté, et formaliste-constructiviste de l’autre. Peu après Weyl, Oskar Becker adopta une distinction similaire. Mais à la différence du phénoménologue Becker, Weyl considérait l’approche active du constructivisme de Fichte comme supérieure à la (...) vision d’essences passive de Husserl. Dans cet essai, je montre ce développement dans la pensée de Weyl. Bien que certains points dans sa réception de Husserl et Fichte ne soient pas soutenables, je vais argumenter en faveur de la distinction fondamentale mentionnée ci-dessus. (shrink)
