The article discusses the definition of reflection as an activity and examines the main factors that determine the kinds of reflection. According to the author of the article, reflection as an activity can be defined by the following formula: the direction of attention to EXPERIENCE for the “detection” of its FORMS and their fixation by means of certain SEMIOTIC TOOLS carried out for the sake of achieving some PURPOSE. In this formulation, the terms “experience”, “form”, “semiotic tools”, “purpose” are understood (...) as parameters, the specification of which sets the description of certain kinds of reflection. In addition, the structure of “detection” participates in the formation of reflection, which consists of the languages of description, conceptual and terminological apparatus, knowledge and other conceptual means of the reflecting subject. Variants for specifying the parameters of the definition are considered in the article on the material of various philosophical techniques (mainly domestic tradition) and a number of general cultural reflexive practices. The author correlates his understanding of reflection with a number of ideas of the Moscow Methodological Circle (MMC), in which reflection techniques were given great importance. In particular, the author schematizes his understanding as a special case of an “act of activity”, the idea of which is the development within the MMC of some of K. Marx’s ideas. In connection with the clarification of the temporal structure of reflection (which is not grasped by schematization of reflection as an act of activity), the author introduces the idea of an elementary cycle of reflection and fixes it in the form of a scheme. In conclusion, the author examines the question of the correlation of reflection and thinking and considers the possibilities of correlating his definition of reflection with the typology of reflection set by the scheme of the thinking-communication-activity-system (proposed in MMC in 1983). This study aims to help enterprises enhance their innovation capabilities in the environment of knowledge economy globalization and stand out in the fierce industry competition. Firstly, data on existing higher education theories and innovation theories are analyzed. Secondly, two companies in the sample data are selected for detailed analysis. Finally, research conclusion and corresponding talent management strategies are presented. The results show that the cumulative contribution value of employees is 87.496%. The cumulative contribution value of human capital is 70.322%. The (...) contribution value of cumulative innovation performance is 61.658%. The cumulative contribution value of R&D investment is 45.306%. The coefficient for the overall sample size is 0.509. The employee quality coefficient is 0.452. The correlation coefficient for educational attainment is 0.598. The high-tech service industry has the highest correlation coefficient at 0.504. The auto industry has the highest coefficient at 0.669. The experimental research has drawn the following conclusion: Talents positively affect enterprise innovation performance; Research and Development investment has a positive correlation with enterprise innovation performance; R&D investment has a positive correlation with talents. Through experimental research, the education level of employees is measured by academic qualifications, but the essence of academic qualification measurement is the level of knowledge and skills that employees have. In summary, the study can extend the strategic analysis of the cultivation of innovative talents and play a valuable auxiliary role in cultivating innovative talents. (shrink)

This essay contends that the debate between subjectivism and objectivism in ethics is better understood as a dispute among three alternatives: subjectivism, objectivism, and intrinsicism. Ayn Rand has identified intrinsicism – the belief that certain things are good “in, by, and of” themselves – as the doctrine that is actually operative in many defenses of moral objectivity. What intrinsicism fails to appreciate, however, is the significant role of the subject, the person to whom and for whom anything can be valuable. (...) Objective value, in Rand's view, is relational. Its existence depends on contributions of both external reality and human consciousness. Values are not reducible to psychological states, as in subjectivism, but nor are they independent of them, as in intrinsicism. Objectivity in ethics is attained neither through revelation of the intrinsic property of goodness nor through the subject's creation of goodness, but through a rational procedure of evaluation that is governed by the method of objectivity. This essay is in three parts, explaining Rand's view of exactly what intrinsicism is; elaborating on her view of the nature of moral objectivity; and highlighting certain features that make plain the differences between an intrinsicist and an objectivist account of value. Today's sweatshops violate our notions of justice, yet they continue to flourish. This is so because we have not settled on criteria that would allow us to condemn and do away with them and because the poor working conditions in certain places are preferable to the alternative of no job at all. In this paper, we examine these phenomena. We consider the definitional dilemmas posed by sweatshops by routing a standard definition of sweatshops through the precepts put forward in the (...) literature on justice and virtue ethics. We conclude that fixing on definitions is pointless and misleading and that we are better off looking at whether or not a workplace violates the basic human rights of workers and whether or not the working conditions there cohere with situations on which we have already rendered judgments. In the end, we suggest guidelines for businesses that operate in the global workplace to help them avoid charges of running sweatshops. These recommendations account for the harsh living conditions in certain developing and emerging countries as well as the norms of societies in developed countries. (shrink)

Horace's Satires 1.8 and 1.9 have long interested commentators for the enticing glimpse they provide of the changing Roman cityscape in the 30s BCE In light of the recent problematization of the strict correspondence between the poet Horace and his elaborately constructed satiric persona, locations in the Satires should be read not so much as autobiographical accounts of the poet's movement through the city but rather as functions of other themes and motifs in the Satires. This paper examines the moral (...) and aesthetic encoding of the urban landscape in Horace's Satires Book I.Satires 1.9 and 1.8 reveal that Rome's city center and the gardens of Maecenas constitute an arena for the satirist's indirect meditation about the complex relationship between his poetry and his patron Maecenas. By mapping moral and aesthetic behavior onto these urban areas, Horace comments on the viability of satiric poetry in various social situations and settings. The emerging picture presents the city center — filled as it is with human vice and folly — as a place appropriate for satiric poetry, and Maecenas' gardens — free from competition and ambition — as a place inimical to it. Thus the gardens of Maecenas present for the satirist a moral and aesthetic problem, and their specter haunts his downtown stroll in Satires 1.9 as much as does the aspirant who dogs his steps. The decorum of patronage requires that Horace show proper subordination to his benefactors. Yet the decorum of satire requires that the poet undermine status, stability, and authority. While professing that status is not an issue in Maecenas' circle, the poems reveal instead that status is always an issue, aected no less by one's physical than one's social position. (shrink)

The first four selections in this issue are devoted to the question of the future of science in Russia. A. V. Iurevich and I. P. Tsapenko outline the depressed state of Russian science today and the tendencies that, unless checked, will bring about its complete collapse. The precipitous decline in government financing of research has not been offset by support from international foundations or private business in Russia. The salaries of scientists are among the lowest in the economy—below the official (...) subsistence level. In the last ten years the ranks of scientists have been reduced by half: some researchers are unemployed, others have gone into commerce or politics, and others have emigrated. Those who remain in the research institutes are often underemployed, lack up-to-date literature and equipment, and have few opportunities to publish their results. It is not surprising that scientific productivity measured by the number of discoveries and inventions has fallen drastically. The government ignores this situation because the scientific community lacks political influence. The public at large is too preoccupied with economic and political matters to give any thought to science or feel any sympathy for the scientists. The authors predict that if the trends of the last decade continue, Russia will be reduced to a source of raw materials, a country without science, advanced technology, higher education, and intellectual leadership. The purpose of this study was to determine whether accounting students’ perception of moral intensity could be enhanced through a limited ethics intervention in an Advanced Accounting course. Ethical decisions are heavily influenced by the intensity of the moral problem: the more egregious the act, the more the people view it as unethical. This controlled experiment measures the change in perceptions of moral intensity with the pre- and post-test instruments using five accounting specific vignettes containing moral dilemmas which are progressively (...) more intense. While other studies have shown that perceived moral intensity directly influences a persons’ moral decision-making process, as far as we are aware, this is the first study that assesses and tests whether the coverage of specific ethics content integrated into an accounting class can positively influence the students’ perception of moral intensity, moral sensitivity/awareness, moral judgment, and moral intentions. Positively influencing students’ moral sensitivity/awareness, moral judgment, and moral intentions is a critical first step to ensuring that our courses and curricula provide the learning environment in which students can develop knowledge and competencies required to become the ethical leaders of tomorrow. In this article, I argue that the medical conceptualization of gender identity in the United States has entered a “new regime of truth.” Drawing from a mixed-methods analysis of medical journals, I illuminate a shift in the locus of gender identity from external genitalia and pathologization of families to genes and brain structure and individualized self-conception. The sexed body itself has also undergone a transformation: Sex no longer resides solely in genitalia but has traveled to more visible parts of the (...) body, implicating racialized aesthetic ideals in its new formulation. The re-imagining of gender identity as genetically and neurologically inscribed and the expanding locus of sex correspond to an inversion of the relationship between gender identity and the sexed body as well as shifts in medical jurisdiction. Whereas psychiatrists in the 1960s, ’70s, and ’80s understood gender as stemming from genital sex, the less popular idea that gender identity precedes the sexed body has gained traction in recent decades. If gender identity once derived from the sexed body, the sexed body must now be brought into alignment with gender identity. The increasing legitimacy of self-defined gender identity, the expanding definition of racialized sex, and the inversion of the sex–gender identity relationship elevates the role of surgeons in producing racialized and sexed bodies. This paper explores the relationship between tolerance, forgiveness, and justice. Contrary to prevailing wisdom, it argues that tolerance and forgiveness are not independent virtues vying with justice for our allegiance, but that they fall under justice’s imperative to judge other people objectively and treat them as they deserve. Misguided extensions of tolerance and forgiveness imperil the very values that ethics is designed to promote. Thus tolerance and forgiveness are neither virtues nor vices; they are appropriate only when authorised by justice. (...) Health equity is a global concern. Although health equity extends far beyond the equitable distribution of healthcare, equitable access to healthcare is essential to the achievement of health equity. In Canada, Indigenous Peoples experience inequities in health and healthcare access. Cultural safety and trauma‐ and violence‐informed care have been proposed as models of care to improve healthcare access, yet practitioners lack guidance on how to implement these models. In this paper, we build upon an existing framework of equity‐oriented care for (...) primary healthcare settings by proposing strategies to guide nurses in operationalizing cultural safety and trauma‐ and violence‐informed care into nursing practice at the individual level. This component is one strategy to redress inequitable access to care among Indigenous Peoples in Canada. We conceptualize barriers to accessing healthcare as intrapersonal, interpersonal, and structural. We then define three domains for nursing action: practicing reflexivity, prioritizing relationships, and considering the context. We have applied this expanded framework within the context of Indigenous Peoples in Canada as a way of illustrating specific concepts and focusing our argument; however, this framework is relevant to other groups experiencing marginalizing conditions and inequitable access to healthcare, and thus is applicable to many areas of nursing practice. This paper examines a particular type of argument often employed to defend welfare rights. This argument contends that welfare rights are a necessary supplement to liberty rights because rights to freedom become hollow when their bearers are not able to take advantage of their freedom. Rights to be provided with certain goods are thus a natural outgrowth of a genuine concern to protect freedom.I argue that this reasoning suffers from two fatal flaws. First, it rests on an erroneous notion of (...) what it is to have a right, neglecting the fact that the exact source of a person's inability to exercise a right is crucial to determining whether that right is being respected. Second, the argument equivocates as to the freedom that rights are intended to protect, sometimes confusing freedom with ability, sometimes confusing not being free with not having other desired things, and sometimes confusing what a person is able to do with what a person is entitled to do. Inequities in access to oncology care among Indigenous peoples in Canada are well documented. Access to oncology care is mediated by a range of factors; however, emerging evidence suggests that healthcare providers, including nurses, play a significant role in shaping healthcare access. The purpose of this study was to critically examine access to oncology care among Indigenous peoples in Canada from the perspective of oncology nurses. Guided by postcolonial theoretical perspectives, interpretive descriptive and critical discourse analysis methodologies informed study design (...) and data analysis. Oncology nurses were recruited from across Canada to complete an online survey (n = 78). Nurses identified a range of barriers experienced by Indigenous peoples when accessing oncology care, yet located these barriers primarily at the individual and systems levels. Nurses perceived themselves as mediators of access to oncology care; however, their efforts to facilitate access to care were constrained by the dominance of biomedicine within healthcare. Nurses' constructions of access to oncology care highlight the embedded narrative of individualism within nursing practice and the relative invisibility of racism as a determinant of equitable access to care among Indigenous peoples. This suggests a need for oncology nurses to better understand and incorporate structural determinants of health perspectives. (shrink)

As nursing professionals, we believe access to healthcare is fundamental to health and that it is a determinant of health. Therefore, evidence suggesting access to healthcare is problematic for many Indigenous peoples is concerning. While biomedical perspectives underlie our current understanding of access, considering alternate perspectives could expand our awareness of and ability to address this issue. In this paper, we critique how access to healthcare is understood through a biomedical lens, how a postcolonial theoretical lens can extend that understanding, (...) and the subsequent implications this alternative view raises for the nursing profession. Drawing on peer‐reviewed published and gray literature concerning healthcare access and Indigenous peoples to inform this critique, we focus on the underlying theoretical lens shaping our current understanding of access. A postcolonial analysis provides a way of understanding healthcare as a social space and social relationship, presenting a unique perspective on access to healthcare. The novelty of this finding is of particular importance for the profession of nursing, as we are well situated to influence these social aspects, improving access to healthcare services broadly, and among Indigenous peoples specifically. This paper wishes to clarify the definitions of the central terms relating to assessment. It argues that all assessment begins with summative assessment (which is a judgement) and that formative assessment is in fact summative assessment plus feedback which is used by the learner.

Measures of student ethical sensitivity and their increases help to answer questions such as whether accounting ethics should be taught at all. We investigate different sensitivity measures and alternatives to the well-established Defining Issues Test (DIT-2, Rest, J. R. et al. [1999, Postconventional Moral Thinking: A Neo-Kohlbergian Approach (Lawrence Erlbaum Associates, Mahwah, NJ]), frequently used to measure the effects of undergraduate accounting ethics education. Because the DIT measures cognitive development, which increases with age, the DIT scores for younger accounting students (...) are typically lower, have limited range, and are not likely to vary sufficiently with corresponding choices in ethical dilemmas. Since the DIT measures only the moral judgment component of ethical decision-making, we consider the multidimensional ethical scale (MES) to allow respondents to provide explanations for their moral and other judgments. The MES has been used to measure attitudes related to justice, utility, contractualism, egoism, and relativism. Unfortunately, the MES is not comparable in one-dimension to the DIT, and unlike the DIT, the MES has no theoretical or objective base. Therefore, we construct a comparable one-dimensional relative measure, a Composite MES Score, obtained from previous research on practicing accountants. We compare the reliability of this measure to the DIT in explaining the ethical choices of 54 specially chosen, somewhat homogeneous students, whose ages range from 18 to 19, and who are taking a second semester freshman accounting course at a private, religion-affiliated university. These particular students are relatively untrained in the formal use of questionable accounting choices. These students are less likely to recognize the dilemmas of the MES and are also less likely to demonstrate sufficient variation in their DIT scores, traditionally low for freshmen students. As freshmen, they are recent graduates of high school and more likely guided by other ethical influences including friends, family, or contractual obligations (some of the MES constructs) rather than higher cognitive development. This study confirms suspicions. We find the DIT scores do not vary sufficiently to explain the moral reasoning of freshmen. For eight dilemmas and 24 choices we find the DIT score correlates with only three choices, whereas the MES regression models have at least one significant construct for 23 out of 24 ethical choices. The Composite MES Score (a relative measure) also explains 23 out of 24 choices and is statistically related to the DIT in only one of the choices. Unlike the DIT, the Composite MES permits pretest and retesting with different dilemmas to evaluate changes in ethical sensitivity. These results argue for relative rather than absolute measures of sensitivity and guides beyond cognitive development (the DIT-score) to explain undergraduate student sensitivity. (shrink)

Hype over novel quantum technologies has prompted discussion on the likely societal impacts of the sector. Calls to ensure the responsible development of quantum technologies are complicated by a lack of concrete case studies or real-world examples of irresponsible quantum. At this stage, responsible quantum faces a situation reminiscent of the Collingridge dilemma. In this dilemma, the moment in which discussion on societal risks and benefits can be most impactful is also the time when the least information is available. The (...) flipside of this challenge is an opportunity to build processes for examining the public good of quantum before the trajectory (and potential problems) of the sector become “locked in”. Recent work in this space has argued that quantum researchers and innovators must work with society to address uncertainties and concerns. By engaging quantum stakeholders and understanding their perspectives on responsibility, this paper seeks to support this proposition and enable further dialogue on responsible development and use of quantum technologies. BernsteinMy name is Tara Mastrelli. I am a graduate student at the New School for Social Research.1 Dick Bernstein was my teacher and my friend. I was also the TA for his final seminar on American Pragmatism this past spring, an experience that I want to share with you today.In the months leading up to this seminar, (...) Dick said something shifted for him in the way he understood pragmatism—a sort of awakening on his part. He redesigned his syllabus into two parts—the first, working through the classical pragmatists, namely, Peirce, James, and Dewey, as he had done for sixty-eight years. And then the second half would—in Dewey's words—turn toward "the problems of men" (though Dick would always say human beings), engaging with themes and texts from Black and feminist thinkers. To be clear, for Dick, this was not an expansion of the canon or an exercise in who should or should not count as a pragmatist. Rather his aim was something different altogether—to see if we could begin to understand pragmatism not as a canon at all, but rather as a living, evolving movement.Now the point is not that this was the perfect syllabus—it wasn't. The point is what redesigning his syllabus can tell us about the type of person and teacher that Dick was. At almost 90 years old, teaching a subject he had taught for almost seventy years, he did not sit back and say that he knew everything. He wanted to learn more—from his colleagues, his students, the world around him—to experience more, to challenge his assumptions, to understand more. [End Page 103]Beyond the syllabus, another factor that made this seminar unique was Dick's health. His illness started at the beginning of the semester. He taught our first class from an emergency room in New York City during the Omicron wave of COVID-19. He was wearing a mask and breathing tubes. Machines were beeping all around him. Nurses came in from time to time to check on him. Nonetheless … his enthusiasm was not remotely diminished. Laying out his aims and ambitions for the course, he referred to it as "an exciting adventure"—for him and for us.The syllabus was not perfect, and Dick's health ebbed and flowed throughout, and yet—as the course itself progressed—it evolved into the very thing he was hoping for, which was pragmatism as a living, evolving movement. He read and added new work from a colleague examining Black feminist pragmatism and its relationship to the Movement for Black Lives, adding a full session dedicated to it. On certain days, when his breath was weak, he asked me to lead our discussions, which took on more of an almost jazz-like character—my classmates and I riffing off each other as we tried to wrestle with concepts such as DuBois's color line against the backdrop of gentrification in our own neighborhoods. When I decided to run a progressive stack for our discussions on feminism, Dick replied, "Good for you!" and enthusiastically used the hand-raising function, patiently waiting his turn.At the end of the semester, he seemed to be feeling better—his voice was strong and his eyes were bright during our final session. He conveyed his sense that, despite his recurring lament that we did not have more time (he had always envisioned the course as two semesters, or sometimes two full years), the seminar had achieved what he had wanted to achieve: "Philosophy has come alive." The aim of this study was to investigate the ethical dilemma of prioritising financial resources to expensive biological therapies. For this purpose, the four principles of biomedical ethics formulated by ethicists Tom Beauchamp and James Childress were used as a theoretical framework. Based on arguments of justice, Beauchamp and Childress advocate for a health care system organised in line with the Danish system. Notably, our study was carried out in a Danish setting.

The rise of non-fungible tokens (NFTs) has been astonishing, in particular for the arts and creative industries. The dominant discourse both in mainstream media and in academia today focuses predominantly on what this new technology can do for the art market rather than art itself. However, framing NFTs in art in the context of money and markets draws attention away from the more subtle and creative role of NFTs. Consequently, this article asks: What is the role of NFTs in art, (...) beyond the market? This research complements existing empirical work, by conducting a case study and interviews with members of DADA, a historic NFT art project which is particularly critical towards the role of the art market. The findings foregrounded five roles that NFTs play in art: as (1) a tool for systemic change, (2) a new way to community, (3) a ritual artefact, (4) a means for preservation and (5) a new medium. The Danish healthcare system must meet the need for easy and equal access to healthcare for every citizen. However, investigations have shown unfair prioritization of cancer patients and unfair prioritization of resources for expensive medicines over care. What is needed are principles for proper prioritization. This article investigates whether American ethicists Tom Beauchamp and James Childress’s principle of justice may be helpful as a conceptual framework for reflections on prioritization of expensive biological therapies in the Danish healthcare system. We present (...) an empirical study exploring the principles for prioritizing new expensive biological therapies. This study includes qualitative interviews with key Danish stakeholders experienced in antibody therapy and prioritizing resources for expensive medicines. Beauchamp and Childress’s model only covers government-funded primary and acute healthcare. Based on the interviews, this study indicates that to be helpful in a Danish context this model should include equal access for citizens to government-funded primary and acute healthcare, costly medicine, and other scarce treatments. We conclude that slightly modified, Beauchamp and Childress’s principle of justice might be useful as a conceptual framework for reflections on the prioritization of expensive biological therapies in the Danish healthcare system. Background Doctors sometimes encounter parents who object to prescribed treatment for their children, and request suboptimal substitutes be administered instead. Previous studies have focused on parental refusal of treatment and when this should be permitted, but the ethics of requests for suboptimal treatment has not been explored. Methods The paper consists of two parts: an empirical analysis and an ethical analysis. We performed an online survey with a sample of the general public to assess respondents’ thresholds for acceptable harm and (...) expense resulting from parental choice, and the role that religion played in their judgement. We also identified and applied existing ethical frameworks to the case described in the survey to compare theoretical and empirical results. Results Two hundred and forty-two Mechanical Turk workers took our survey and there were 178 valid responses. Respondents’ agreement to provide treatment decreased as the risk or cost of the requested substitute increased. More than 50% of participants were prepared to provide treatment that would involve a small absolute increased risk of death for the child and a cost increase of US$<500, respectively. Religiously motivated requests were significantly more likely to be allowed. Existing ethical frameworks largely yielded ambiguous results for the case. There were clear inconsistencies between the theoretical and empirical results. Conclusion Drawing on both survey results and ethical analysis, we propose a potential model and thresholds for deciding about the permissibility of suboptimal treatment requests. (shrink)

The article explores the phenomenon of symphonism in the written and other intellectual heritage of Hryhorii Skovoroda. The study reveals that the conclusion about systemic symphonismbeing a property of the thinker’s reflections can only be hypothetical at this stage. This is due tothe fact that the source base of the present study includes a significant number of diverse works by the philosopher that have not yet received a proper archaeographic description. The matter of archaeographic description of sources in the history (...) of philosophy research in Ukraine has not yet been positively resolved and is still in its formation. This article briefly presents the problematic range of source studies of Hryhorii Skovoroda’s works. It is, however, not limited to the suggested list and tends to expand. With this circumstance in mind, the boundaries of the research were limited to a selection of Hryhorii Skovoroda’s letters to various persons, which is contained in the most representative academic printed edition of his writings available today. The distinctive features of understanding the source heritage of the philosopher include its genre character and the way it was disseminated. All the major philosopher’s works were personally handwritten or replicated by other copyists in lists. This circumstance causes considerable difficulties in verifying the accuracy of the content of the original manuscript source in print. The presentation of the material is intentionally not systematic, but illustrative. The selection of extractsfrom the philosopher’s works contains the most distinctive examples of symphonicity, which illustrate the panorama of the growth of symphonic complexes from simpler to quantitatively more complex. The inherent polemical core of the study is to establish the correspondence between systemic symphonicity and dialogicity of the philosopher’s style of thinking. The conclusions about this could be drawn on the basis of historical and philosophical explication from certain sources. The author suggests that the development of dialogicity is preceded by a thorough justification of the principle of proper thinking by Hryhorii Skovoroda, which has a complex symphonic structure. From this perspective, dialogism does not contradict the fundamental symphonicity, but is rather one of its manifestations. (shrink)

Over the past few decades, a body of research has developed examining the academic dishonesty of university and college students. While research has explored academic dishonesty amongst American criminal justice and policing students, no research has specifically focused on investigating the dynamics and correlates of academic dishonesty amongst Australian criminology students. This study drew upon data obtained from a survey of 79 undergraduate criminal justice and policing students studying at an Australian university. Overall, the results suggest that male gender, viewing (...) academic dishonesty as less serious and holding justifications for engaging in this type of behaviour were significant predictors of self-reported academic dishonesty. The findings suggest that more proactive strategies need to be implemented by universities to prevent student involvement in academic dishonesty. (shrink)

Small but significant gender differences in emotion expressions have been reported for adults, with women showing greater emotional expressivity, especially for positive emotions and internalizing negative emotions such as sadness. But when, developmentally, do these gender differences emerge? And what developmental and contextual factors influence their emergence? This article describes a developmental bio-psycho-social model of gender differences in emotion expression in childhood. Prior empirical research supporting the model, at least with mostly White middle-class U.S. samples of youth, is presented. Educational analysts need new ways to engage with policy processes in a networked world of complex transnational connections. In this discussion, Tara Fenwick and Richard Edwards argue for a greater focus on materiality in educational policy as a way to trace the heterogeneous interactions and precarious linkages that enact policy as complex manifestations. In particular, Fenwick and Edwards point to the methodologies of actor-network theory (ANT), at least in its most recent permutations, as a useful approach to materiality in policy (...) analysis. Published examples of educational policy studies drawing from these methodologies are beginning to appear. In reviewing these, we argue that ANT sensibilities help to make visible the sociomaterial assemblages—the “messy objects”—that enact policy, the micro-negotiations that mobilize and stabilize (and destabilize) these assemblages, and the multiple ontologies that often coexist in policy environments. Fenwick and Edwards conclude with a discussion of methodological issues for working with concepts of ontological variance and messy objects in educational policy. (shrink)

In recent decades, we have seen a remarkable proliferation of the kinds of moral rights that people are thought to have. While many of these new rights have gained sizable support, the theoretical underpinnings of all rights have remained uncertain. The danger in the growth of rights claims is that we may weaken rights. As more and more desirable goods are demanded as people's "rights," the actual protection which rights afford is diminished. Abundant rights will bump up against one another, (...) preventing many rights from being fully satisfied. The long-term effect of this rights inflation will be the erosion of the value of rights, rather than the intended aim of enhanced security for people. ;The dissertation examines in two stages what the status of rights should be. First, it explores the history of the notion of rights, the exact meaning of what it is to have a right, and the obligations which rights place on other persons. It also presents an argument defending the view that all people have certain moral rights "naturally," independently of social creation or recognition. ;The second stage of the discussion focusses more directly on certain aspects of the recent expansion of rights claims. It delineates the logical and practical implications of rights "conflicts" which the boom in rights precipitates. Finally, it considers one particular type of rights which has been enjoying increasing acceptance: rights to be provided with concrete goods . ;The major conclusions reached are first, that the notion of "natural" moral rights is a credible and valuable component within an adequate moral theory; second, that individuals do have extensive rights to freedom of action; third, that "natural" moral rights cannot directly conflict with one another; and fourth, that welfare rights are spurious. ;As a whole, this work is intended largely as a caution to tame the recent enthusiasm for rights. Restraint is needed in order to preserve rights, and to allow rights to exert their protective powers to individuals more effectively. (shrink)

In the debate over proper judicial interpretation of the law, the doctrine of Originalism has been subjected to numerous, seemingly fatal criticisms. Despite the exposure of flaws that would normally bury a theory, however, Originalism continues to attract tremendous support, seeming to many to be the most sensible theory on offer. This paper examines its resilient appeal (with a particular focus on Scalia's Textualism).By surveying and identifying the fundamental weaknesses of three of the leading alternatives to Originalism (Popular Will theory, (...) Dworkin's value theory, and Minimalism), the paper demonstrates that the heart of Originalism's appeal rests in its promise of objectivity. The paper also establishes, however, that Originalism suffers from a misguided conception of what objectivity is. All camps in this debate, in fact, suffer from serious misunderstandings of the nature of objectivity. (shrink)
