The problem of 'no fault' compensation for patients who suffer adverse effects as a result of their participation in clinical trials is discussed in the light of the guidelines issued by the Association of the British Pharmaceutical Industry (ABPI) and our recent experiences in reviewing protocols submitted to the local ethics of surgical research sub-committee. We have found a variety of qualifications being applied by pharmaceutical firms which are not in the spirit of the guidelines, let alone the interests of (...) the patient, and we suggest a means whereby the patients can be assured of fair treatment in the event of 'no fault' injury. Over 200 lawsuits were filed against the Hertz rental car company by former customers who were arrested as a result of the company’s poor inventory control system and its implementation of two business practices which led to the filing of unsubstantiated stolen car reports with police. According to a whistleblower, these practices essentially meant Hertz was using police “as a repo company and the court system as a collection company” (News Nation 2022, 4:24). Consequences to the individuals who were falsely (...) charged with theft included financial hardship, job loss, reputational damage, child custody problems, the trauma of arrest sometimes at gunpoint, and the traumatic experience of being jailed. This case study calls for students to analyze the company’s actions from the perspectives of ethical theories and decision making, as well as corporate social responsibility. (shrink)

This essay explores the contemporary experiences of women who live with pain, given the complex responses they encounter within Western medical systems, including pervasive stigma, bias, clinician disbelief, and poor health outcomes. In response to these realities, as highlighted within recent literature and exemplified in a first-person account provided by the paper’s author, this essay explores the Christian practice of the Stations of the Cross as a faithful response to women living with pain. The Stations provide a distinctive Christian practice (...) that invites women living with pain, as well as their clinicians and loved ones, into faithful care marked by prayer, solidarity, and hospitable listening. Practicing the Stations provides one faithful response that Christian clinicians and those who live with pain might engage in the clinic and beyond. (shrink)

A number of articles and empirical studies over the past decade, most by Paul Robinson and co-authors, have suggested a relationship between the extent of the criminal law's reputation for being just in its distribution of criminal liability and punishment in the eyes of the community – its "moral credibility" – and its ability to gain that community's deference and compliance through a variety of mechanisms that enhance its crime-control effectiveness. This has led to proposals to have criminal liability and (...) punishment rules reflect lay intuitions of justice – "empirical desert" – as a means of enhancing the system's moral credibility. In a recent article, Christopher Slobogin and Lauren Brinkley-Rubinstein (SBR) report seven sets of studies that they argue undermine these claims of empirical desert and moral credibility and instead support SBR's proposed distributive principle of "individual prevention," a view that focuses on an offender's future dangerousness rather than on his perceived desert. -/- The idea that there is a relationship between the criminal law's reputation for justness and its crime-control effectiveness did not originate with Robinson and his co-authors. Rather, it has been a common theme among a wide range of punishment theory scholars for many decades. A particularly important conclusion of recent Robinson studies, however, is their confirmation that this relationship is a continuous one: even small nudges in moral credibility can produce corresponding changes in the community's deference to the criminal law. This is important because it shows that even piecemeal changes or changes at the margin – as in reforming even one unjust doctrine or procedure – can have real implications for crime-control. SBR's studies, rather than contradicting the crime-control power of empirical desert, in fact confirm it. Further, SBR's studies do not provide support for their proposed "individual prevention" distributive principle, contrary to what they claim. -/- While SBR try to associate their principle with the popular "limiting retributivism" adopted by the American Law Institute in its 2007 amendment of the Model Penal Code, in fact it is, in many respects, just the reverse of that principle. With limiting retributivism, the Model Code's new provision sets desert as dominant, never allowing punishment to conflict with it. SBR would have "punishment" essentially always set according to future dangerousness; it is to be constrained by desert only when the extent of the resulting injustices or failures of justice is so egregious as to significantly delegitimize the government and its law. This ignores the fact that even minor departures from justice may have an important cumulative effect on the system as a whole. What SBR propose – essentially substituting preventive detention for criminal justice – promotes the worst of the failed policies of the 1960s, where detention decisions were made at the back-end by "experts," and conflicts with the trend of the past several decades of encouraging more community involvement in criminal punishment, not less. Let's suppose you think that there are no uncountable sets. Have you adopted a restrictive position? It is certainly tempting to say yes---you've prohibited the existence of certain kinds of large set. This paper argues that this intuition can be challenged. Instead, I argue that there are some considerations based on a formal notion of restrictiveness which suggest that it is restrictive to hold that there are uncountable sets.

I investigate whether tobacco health warnings’ interference with autonomy is ethically justifiable in order to deter people from smoking. I dissociate first the informational role and the persuasive role of tobacco health warnings and show that both roles enable typical addicted smokers to better rule themselves, fostering their autonomy. The fact that some messages address people’s non-deliberative faculties is therefore compensated by a larger positive influence on their autonomy. However, misleading messages are not ethically justified and should be avoided. Tobacco (...) health warnings’ effect on autonomy highlights an important difference between libertarian paternalism and classical paternalism. (shrink)

I argue that Plato's purpose in the discussion of false belief in the "Theaetetus" is to entertain and then to reject the idea that thinking is a kind of mental grasping. The interpretation allows us to make good sense of Plato's discussion of 'other-judging' (189c-190e), of his remarks about mathematical error (195d-196c), and most importantly, of the initial statement of the puzzle about falsity (188a-c). That puzzle shows that if we insist on conceiving of the relation between thought and its (...) objects on the model of holding or grasping something in our hands, we will be unable to account for the possibility of false identity judgments: For no one who is literally grasping two things in his hands would seriously entertain the idea that one of the things is numerically identical with the other. He proposes a semantic principle-based conception consisting of, first, his Principles of Possibility which pro­vide necessary and sufficient conditions for a new concept 'admissibility', and second, characterizations of possibility and of necessity in terms of that new con­cept. I focus on one structural feature; viz. the recursive application involved in the specification of 'admissibility'. After sketching Peacocke’s proposal, I intro­duce a fictional (...) protagonist, Cautious Peacocke, whose coherence I claim shows that Peacocke s proposal cannot be made good. I conclude with the conjecture that similar failure will attend any such semantic-based attempts to ground the epistemology of metaphysical necessity. -/- Dans son livre intitulé Being Known, C. It is standard in set theory to assume that Cantor's Theorem establishes that the continuum is an uncountable set. A challenge for this position comes from the observation that through forcing one can collapse any cardinal to the countable and that the continuum can be made arbitrarily large. In this paper, we present a different take on the relationship between Cantor's Theorem and extensions of universes, arguing that they can be seen as showing that every set is countable and that (...) the continuum is a proper class. We examine several principles based on maximality considerations in this framework, and show how some (namely Ordinal Inner Model Hypotheses) enable us to incorporate standard set theories (including ZFC with large cardinals added). The feminist sex wars have been characterized by debates between radical feminists and sex radical feminists about women's experiences of empowerment versus oppression in the sex industry. Based on a qualitative study of the experiences of exotic dancers, this article introduces a new theoretical paradigm to the feminist sex wars that values the contributions of both sex radicals and radical feminists. It articulates a twofold temporal dimension of sex workers' experiences: how women's feelings of pleasure and empowerment gradually decline over (...) time and how good and bad experiences rapidly transform into their opposites over the course of a single evening, making the strip bar a volatile and unsettling space for performers. I extend Jones & Love's (J&L's) critique of Bayesian models and evaluate the conceptual foundations on which they are built. I argue that: (1) the part of Bayesian models is scientifically trivial; (2) theory is a fiction that arises from an inappropriate programming metaphor; and (3) the real scientific problems lie outside Bayesian theorizing.

Today’s fast-moving, media lifeworld embodies many of the metaphors of its analog predecessors – including those of warfare and conflict. The metaphor of warfare is used to describe everything from corporate marketing strategies to political campaigns, often with harmful consequences. In one way of exploring the front lines of the resulting war on truth, we describe some lessons learned from the experience of military veterans who have actually endured the liminality of combat, and who emerge with what is increasingly termed (...) moral injuries. We use their experience as an analogy for competing narratives in cyberspace, where objective standards of truth and facticity are apparent casualties, and where fake news is emerging as victorious. We then apply models of social construction, specifically the practical theory of the Coordinated Management of Meaning, and the metaphor of jazz improvisation in the context of Schutz’s lifeworld phenomenology as possibly useful, helpful, and hopeful ways of acting into the complexity of truth together. Cimino's The Deer Hunter is a mass culture product that sells. It is a conventional, manipulative Hollywood movie that moves large U.S. audiences. In trying to identify the ideological function of this film, Leibowitz has compared The Deer Hunter to Nazi ideology or German Romantic nationalist aesthetics. This comparison, however, says little about the film itself. To invoke this German tradition is to do little more than to invoke the roots of the modern culture industry in general. This book explores the importance of compassion and empathy within educational contexts. While compassion and empathy are widely recognised as key to living a happy and healthy life, there is little written about how these qualities can be taught to children and young people, or how teachers can model these traits in their own practice. This book shares several models of compassion and empathy that can be implemented in schooling contexts, also examining how these qualities are presented in children’s picture (...) books, films and games. The editors and contributors share personal insights and practical approaches to improve both awareness and use of compassionate and empathetic approaches to others. Initiated almost 200 years ago, the accusation that G.W.F. Hegel’s philosophy qualifies as Gnostic has stood the test of time. Beginning with Ferdinand Christian Baur’s 1835 Die christliche Gnosis, thinkers have attempted to inextricably bind Hegel’s philosophical endeavors to the ancient form(s) of religious knowledge production known as ‘Gnosticism’. Two additional figures have surfaced more recently who also champion the Gnostic accusation, namely Eric Voegelin and James Lindsay. Voegelin’s 1968 Science, Politics, and Gnosticism as well as his 1972 ‘On Hegel: (...) A Study in Sorcery’ seek to justify and legitimize the Gnostic accusation in unequivocal terms. Lindsay’s 2022 best-seller, Race Marxism, further perpetuates the charge of Gnosticism against Hegel. I aim to deal with each of these figures and their respective accusations in reverse chronological order, demonstrating how each of them must artificially construct Hegel as a Gnostic in order to successfully defend their accusations. This book documents Szilard's energetic attempts to influence public policy on arms control and disarmament issues, both through open political processes and statements and through behindthe-scenes contacts with Washington power sources and a remarkable exercise in personal diplomacy with Nikita Khrushchev. Leo Szilard conceived of the possibility of nuclear fission sustained by a chain reaction years before it was achieved in the laboratory. He was also one of the initiators of the atomic bomb project in the United States. Yet he (...) dedicated his final years to the causes of understanding and sustaining life. The eminent physicist became a biologist and a vital force calling, for the control of nuclear and other weapons. This book documents Szilard's energetic attempts to influence public policy on arms control and disarmament issues, both through open political processes and statements and through behindthe-scenes contacts with Washington power sources and a remarkable exercise in personal diplomacy with Nikita Khrushchev. Many of the issues Szilard deals with in this valuable record of the years 1947-1963 are still crucial today. His opposition to antiballistic missile systems, his proposal for a Washington-Moscow "hot line," his work on the Pugwash conferences that brought together scientists from the East and the West, his pivotal role in the creation of the Council for a Livable World, his advocacy of a nuclear policy of no-first-use and restricted retaliation, and his support of "minimum deterrence" in place of an overwhelming counterforce capability - all these matters are as important in the 1980s as they were in the 1950s and 1960s. The abuse of prisoners by U.S. soldiers at Abu Ghraib had far-reaching consequences, leading many people around the world to question the legitimacy of U.S. goals and activities in Iraq. Drawing on extensive unclassified reports from multiple investigations that followed Abu Ghraib, this article considers both psychological and social-situational factors that contributed to ethical failures there. This analysis suggests that leaders need to be more attuned to the developmental stage of subordinates and take appropriate steps to reinforce ethical behaviors. From (...) a psychological standpoint, young adults especially are strongly inclined to behave in accord with social conventions and pressures around them. Particularly in ambiguous circumstances, it is important that standards of behavior be clear and explicit throughout all phases of an operation and that leaders at all levels represent and reinforce those standards. In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us to solve (...) all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. The theory is illustrated on ontological issues on the nature of structural universals and informational entities. (shrink)

One of the most lasting contributions of Marr's posthumous book is his articulation of the different “levels of analysis” that are needed to understand vision. Although a variety of work has examined how these different levels are related, there is comparatively little examination of the assumptions on which his proposed levels rest, or the plausibility of the approach Marr articulated given those assumptions. Marr placed particular significance on computational level theory, which specifies the “goal” of a computation, its appropriateness for (...) solving a particular problem, and the logic by which it can be carried out. The structure of computational level theory is inherently teleological: What the brain does is described in terms of its purpose. I argue that computational level theory, and the reverse-engineering approach it inspires, requires understanding the historical trajectory that gave rise to functional capacities that can be meaningfully attributed with some sense of purpose or goal, that is, a reconstruction of the fitness function on which natural selection acted in shaping our visual abilities. I argue that this reconstruction is required to distinguish abilities shaped by natural selection—“natural tasks” —from evolutionary “by-products”, rather than merely demonstrating that computational goals can be embedded in a Bayesian model that renders a particular behavior or process rational. Edward Harold Fulcher Swain (1883?1970) developed a unique idea about the importance of forests, advocating the creation of a new society based upon forests, and he pursued policies to implement his unique vision of forestry when he served as the Director of Queensland's Forestry Board from 1918 to 1924 and the Forestry Commissioner for New South Wales from 1935 to 1948. Swain's beliefs developed out of a combination of his Australian experiences and connections with foresters in the British Empire and (...) America. When he could not convince Australian elites about the need to create a forest-based society, he asked foresters at the 1947 Empire Forestry Conference in London to assert the primacy of forestry in land management in the British Empire. Many foresters positively received parts of Swain's argument, but his ideas could never be fully implemented in the British Empire because of the dominance of agrarian doctrines of development in post-Second World War colonial planning and the rapid process of decolonization. Swain's life sheds light onto current debates among historians about the origin and legacy of forestry in Australia and the British Empire. His ideas, many that parallel the basic tenets of modern environmentalism, require historians to rethink the relationship between Empire forestry and environmentalism. (shrink)

This paper offers a comparative analysis of the uses and formulations of speech-act theory in Derrida's and Deleuze/guattari's work. It begins by juxtaposing Derrida's concept/nonconcept of ‘iterability’ to Deleuze and Guattari's conception of the ‘order-word’ and then examines these theories of the speech act in terms of their implications and consequences for a politics of resistance. Whereas Deleuze and Guattari generate a detailed material stratum — an order-word plateau — for exploring the performative in socio-political contexts, Derrida attends to the (...) singular, wholly unique acts that occur when a repeatable formula such as a political declaration is uttered or otherwise takes place. The paper then concludes by drawing a tentative link between iterability and Deleuze and Guattari's notion of ‘deterritorialisation’ via the order-word plateau. (shrink)

The Psalms are a heterogeneous collection of texts that may come from many different periods, yet a reasonably consistent picture emerges of the sins they mention. These are mostly to do with social interactions, though there is some attention to sins of thought and intent. Because so many Psalms are concerned with supplications by those oppressed by others, the emphasis tends to fall on malice rather than on more ‘obvious’ sins such as murder or adultery, which are little mentioned. There (...) is not much reflection on the nature of sin as such, though Psalm 51 suggests that it goes back even as far as one’s conception. (shrink)

As one of the least common, yet predictable astronomical occurrences, the transits of Venus were to become among the most keenly anticipated events for early modern cosmologists. Basing himself on Johannes Kepler’s Tabulae Rudolphinae (1627), former Cambridge student Jeremiah Horrocks (1616–1641) made the first recorded observation of a transit from Much Hoole, Lancashire in 1639. Alongside the description of his observations, Horrocks’ Venus in sole visa contains four poems alongside the work’s prose descriptions, figures, and tables. His verses call on (...) the long tradition of Latin scientific poetry employed for the predictable purposes of eulogy and homage, but they also serve to justify and clarify the author’s position on scientific issues of his time. Despite the long-recognized importance of Horrocks’ observations, his hexameter compositions have been largely ignored in later scholarship. In the latest translation of the Venus in sole visa (2012), one poem—the longest and arguably the best—is omitted altogether. This paper offers a study of Horrocks’ Latin poetry, his models and engagement with its subject matter. It reveals Horrocks’ efforts to promote his predecessors’ achievements, his position on questions central to the debates of his time, and the claims for authority he made for the work of others, as well as for his own. The present article also includes a new, modern translation of Horrocks’ longest, and recently forgotten poem as an appendix. (shrink)

The minutiae of F.W.J. Schelling’s Naturphilosophie have been perennially dismissed due to its allegedly infeasible and indefensible assertions about Nature, such as his designation of Nature as “universal organism.” In the realm of post-Kantian German Idealism, such a dismissive attitude toward Schelling’s so-called objective idealism, more often than not, develops itself along the lines of Hegel’s critique of Schelling’s conception of the Absolute. In turn, I aim to accomplish two tasks in the following investigation. First, I intend to clarify Schelling’s (...) characterization of Nature as universal organism through a practical or teleological, instead of a theoretical or metaphysical, approach. Second, I seek to undermine the Hegelian-influenced criticisms of Schelling’s “Absolute” by demonstrating the ways in which the practico-teleological characterization of Schelling’s formulation of Nature extends into his later philosophical works. Through these clarifications, I hope to emphasize the uniqueness and richness of Schelling’s configuration of Nature. (shrink)
