The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...) treaty draft reflects these ethical considerations by including a section entitled Guiding Principles and Approaches. Most of these principles are ethical—they establish core values that undergird the treaty. Unfortunately, the treaty draft's set of principles are numerous, overlapping, and show inadequate coherence and consistency. We propose two improvements to this section of the draft pandemic treaty. First, key guiding ethical principles should be clearer and more precise than they currently are. Second, the link between ethical principles and policy implementation should be clearly established and define boundaries on acceptable interpretation, ensuring that signatories abide by these principles. Virtuous Bodies breaks new ground in the field of Buddhist ethics by investigating the diverse roles bodies play in ethical development. Traditionally, Buddhists assumed a close connection between body and morality. Thus Buddhist literature contains descriptions of living beings that stink with sin, are disfigured by vices, or are perfumed and adorned with virtues. Taking an influential early medieval Indian Mahayana Buddhist text-Santideva's Compendium of Training (Siksasamuccaya)-as a case study, Susanne Mrozik demonstrates that Buddhists regarded ethical development as a (...) process of physical and moral transformation. Mrozik chooses The Compendium of Training because it quotes from over one hundred Buddhist scriptures, allowing her to reveal a broader Buddhist interest in the ethical significance of bodies. The text is a training manual for bodhisattvas, especially monastic bodhisattvas. In it, bodies function as markers of, and conditions for, one's own ethical development. Most strikingly, bodies also function as instruments for the ethical development of others. When living beings come into contact with the virtuous bodies of bodhisattvas, they are transformed physically and morally for the better. Virtuous Bodies explores both the centrality of bodies to the bodhisattva ideal and the corporeal specificity of that ideal. Arguing that the bodhisattva ideal is an embodied ethical ideal, Mrozik poses an array of fascinating questions: What does virtue look like? What kinds of physical features constitute virtuous bodies? What kinds of bodies have virtuous effects on others? Drawing on a range of contemporary theorists, this book engages in a feminist hermeneutics of recovery and suspicion in order to explore the ethical resources Buddhism offers to scholars and religious practitioners interested in the embodied nature of ethical ideals. The prospect of consumable meat produced in a laboratory setting without the need to raise and slaughter animals is both realistic and exciting. Not only could such in vitro meat become popular due to potential cost savings, but it also avoids many of the ethical and environmental problems with traditional meat productions. However, as with any new technology, in vitro meat is likely to face some detractors. We examine in detail three potential objections: 1) in vitro meat is disrespectful, either (...) to nature or to animals; 2) it will reduce the number of happy animals in the world; and 3) it will open the door to cannibalism. While each objection has some attraction, we ultimately find that all can be overcome. The upshot is that in vitro meat production is generally permissible and, especially for ethical vegetarians, worth promoting. (shrink)

Counsellors find themselves in (moral) conflict between medical confidentiality (towards the patient) and a potential right or even duty to warn at-risk relatives. Legal regulations vary between countries. English literature about German law is scarce. We reviewed the literature of relevant legal cases, focussing on German law, according to the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guidelines. This article aims to familiarise counsellors with their responsibilities, compare the situation between countries and point out (...) legally unresolved areas.According to the German Genetic Diagnostics Act (Gendiagnostikgesetz) in case of an ‘avoidable or treatable’ genetic disorder, geneticists ought to confine themselves to the obligated advice to the patient. Whether a breach of the duty of confidentiality can be justified in exceptional cases by ‘necessity as justification’ for actively informing relatives at risk remains legally unclear. In case of a ‘neither avoidable nor treatable’ genetic disease, geneticists should also refrain from actively informing relatives as the justifiable state of emergency does not permit to break the duty of confidentiality. In this article, I show that Hegel’s philosophical articulation of the family is inextricably bound to his engagement with political economy by focusing on three central aspects of his theory of the family. Firstly, I analyze how Hegel construes the family as a historically distinct social dispositif and constitutive element of the modern order of property. I argue that Hegel’s construction of the family and its place in the modern order of property is not only gendered but also racialized. Secondly, (...) I focus on Hegel’s articulation of the nexus between the family and civil society and his critical diagnosis of the structural problems that result from it. Thirdly, I discuss Hegel’s concept of labor and the political-epistemic limitations of his problematization of civil society, which are bound to it. I draw attention to three aspects, namely the confinement of the concept of labor to civil society, Hegel’s rearticulation of the gendered matter/form distinction, and the relation between Hegel’s economic notion and speculative usage of “labor.” Finally, I consider briefly how a critical reading of Hegel’s articulation of the political economy of the family can provide productive insights for a multidimensional theory of the family today. We live in the Information Age. Advances over the past 50 years in computing technology have enabled ever-expanding capacity to generate, store, transfer, process and analyse information about people, societies, products, services, the environment—nearly every aspect of the world. In parallel, concerns over how such data is being used have emerged, focusing especially on issues of privacy and confidentiality. Yet as technological capabilities continue to expand, the debate over ethical uses of data inevitably has evolved as well. Whereas we used (...) to just talk about data, now there is great concern over Big Data. This chapter explores what, exactly, Big Data is; the ethical ramifications of its emergence, particularly for consent and anonymization; and what sorts of policy solutions are being proposed to address these emerging challenges. We will not defend one particular approach, but hope this chapter can be a useful reference for those who are contemplating difficult questions surrounding responsible management of Big Data. This article explores Franz Brentano's opposition to papal infallibility, and sets this in the context of his development as a Catholic scholar. An active participant in the Catholic revival of the nineteenth century, Brentano contributed to the emergence of neoscholasticism through his philosophical rehabilitation of Aristotle. Brentano ultimately left the Church however as the result of intensive scrutiny of his faith occasioned by his analysis of infallibility. This article explores this crisis of faith by analyzing, for the first time, Brentano's (...) position on papal infallibility, and suggesting ways that it informed his philosophical development. This paper sets out from the hypothesis that the embodied competences and expertise which characterise dance and sports activities have the potential to constructively challenge and inform phenomenological thinking. While pathological cases present experiences connected to tangible bodily deviations, the specialised movement practices of dancers and athletes present experiences which put our everyday experiences of being a moving body into perspective in a slightly different sense. These specialised experiences present factual variations of how moving, sensing and interacting can be like (...) for us as body-subjects. To use of these sources inevitably demands that qualitative research methodologies – especially short-term ethnographical fieldwork – form part of the research strategy and qualify the way the researcher involves a second-person perspective when interviewing dancers and athletes about their experiences. In the subsequent phases analysing the data generated, I argue that researchers first strive to achieve internal consistency of empirical themes identified in the case of movement practices in question thus keeping to a contextualised and lived perspective, also denoted as an emic perspective. In subsequent phases phenomenological insights are then actively engaged in the exploration and discussion of the possible transcendental structures making the described subjective experiences possible. The specialised and context-defined experiences of ‘what a moving body can be like’ are accordingly involved as factual variations to constructively add to and potentially challenge phenomenological descriptions. Lastly, I exemplify how actual research strategies have been enacted in a variety of projects involving professional dancers’, golfers’ and sports dancers’ practices and experiences, respectively. Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health and (...) Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. In this article, we inquire into Maxine Sheets-Johnstone and Michele Merritt’s descriptions and use of dance improvisation as it relates to “thinking in movement.” We agree with them scholars that improvisational practices present interesting cases for investigating how movement, thinking, and agency intertwine. However, we also find that their descriptions of improvisation overemphasize the dimension of spontaneity as an intuitive “letting happen” of movements. To recalibrate their descriptions of improvisational practices, we couple Ezequiel Di Paolo, Thomas Buhrmann, and Xabier E. (...) Barandiaran’s enactive account of the constitution of agency with case studies of two expert performers of improvisation: a dancer and a musician. Our analyses hereof show that their improvisations unfold as a sophisticated oscillation of agency between specialized forms of mental and bodily control and, indeed, a more spontaneous “letting things happen.” In all, this article’s conclusions frame thinking in movement concerning improvisational practices as contextually embedded, purposively trained, and inherently relational. On March 11, 2020 the World Health Organization classified COVID‐19, caused by Sars‐CoV‐2, as a pandemic. Although not much was known about the new virus, the first outbreaks in China and Italy showed that potentially a large number of people worldwide could fall critically ill in a short period of time. A shortage of ventilators and intensive care resources was expected in many countries, leading to concerns about restrictions of medical care and preventable deaths. In order to be prepared for (...) this challenging situation, national triage guidance has been developed or adapted from former influenza pandemic guidelines in an increasing number of countries over the past few months. In this article, we provide a comparative analysis of triage recommendations from selected national and international professional societies, including Australia/New Zealand, Belgium, Canada, Germany, Great Britain, Italy, Pakistan, South Africa, Switzerland, the United States, and the International Society of Critical Care Medicine. We describe areas of consensus, including the importance of prognosis, patient will, transparency of the decision‐making process, and psychosocial support for staff, as well as the role of justice and benefit maximization as core principles. We then probe areas of disagreement, such as the role of survival versus outcome, long‐term versus short‐term prognosis, the use of age and comorbidities as triage criteria, priority groups and potential tiebreakers such as ‘lottery’ or ‘first come, first served’. Having explored a number of tensions in current guidance, we conclude with a suggestion for framework conditions that are clear, consistent and implementable. This analysis is intended to advance the ongoing debate regarding the fair allocation of limited resources and may be relevant for future policy‐making. (shrink)

This book offers a new account of what it is to act for a normative reason. The first part of the book examines the problems of causal accounts of acting for reasons and suggests to solve them by a dispositional approach. The author argues for a dispositional account which unites epistemic, volitional, and executional dispositions in a complex normative competence. This ‘Normative Competence Account’ allows for more and less reflective ways of acting for normative reasons. The second part of the (...) book clarifies the relation between the normative reason that an agent acts for and his or her motivating reasons. It refutes the widely held ‘identity view’ that acting for a normative reason requires the normative reason to be identical with a motivating reason. The author describes how normative reasons are related to motivating reasons by a relation of correspondence, and proposes a new understanding of how normative reasons explain those actions that are performed for them. Determined by Reasons engages with current debates from a wide range of different philosophical areas, including action theory, metaethics, moral psychology, epistemology, and ontology, to develop a new account of acting for normative reasons. To do this, we argue, they try to establish for each utterance the mutual belief that the addressees have understood what the speaker meant well enough for current purposes. Although artificial intelligence has been given an unprecedented amount of attention in both the public and academic domains in the last few years, its convergence with other transformative technologies like cloud computing, robotics, and augmented/virtual reality is predicted to exacerbate its impacts on society. The adoption and integration of these technologies within industry and manufacturing spaces is a fundamental part of what is called Industry 4.0, or the Fourth Industrial Revolution. The impacts of this paradigm shift on the human operators (...) who continue to work alongside and symbiotically with these technologies in the industry bring with it novel ethical issues. Therefore, how to design these technologies for human values becomes the critical area of intervention. This paper takes up the case study of robotic AI-based assistance systems to explore the potential value implications that emerge due to current design practices and use. The design methodology known as Value Sensitive Design (VSD) is proposed as a sufficient starting point for designing these technologies for human values to address these issues. (shrink)

The predominant view is that a study using health data is observational research and should require individual consent unless it can be shown that gaining consent is impractical. But recent arguments have been made that citizens have an ethical obligation to share their health information for research purposes. In our view, this obligation is sufficient ground to expand the circumstances where secondary use research with identifiable health information is permitted without explicit subject consent. As such, for some studies the Institutional (...) Review Board/Research Ethics Committee review process should not assess the practicality of gaining consent for data use. Instead the review process should focus on assessing the public good of the research, public engagement and transparency. (shrink)

There is a trade-off between specificity and accuracy in existing models of belief. Descriptions of agents in the tripartite model, which recognizes only three doxastic attitudes—belief, disbelief, and suspension of judgment—are typically accurate, but not sufficiently specific. The orthodox Bayesian model, which requires real-valued credences, is perfectly specific, but often inaccurate: we often lack precise credences. I argue, first, that a popular attempt to fix the Bayesian model by using sets of functions is also inaccurate, since it requires us to (...) have interval-valued credences with perfectly precise endpoints. We can see this problem as analogous to the problem of higher order vagueness. Ultimately, I argue, the only way to avoid these problems is to endorse Insurmountable Unclassifiability. This principle has some surprising and radical consequences. For example, it entails that the trade-off between accuracy and specificity is in-principle unavoidable: sometimes it is simply impossible to characterize an agent’s doxastic state in a way that is both fully accurate and maximally specific. What we can do, however, is improve on both the tripartite and existing Bayesian models. I construct a new model of belief—the minimal model—that allows us to characterize agents with much greater specificity than the tripartite model, and yet which remains, unlike existing Bayesian models, perfectly accurate. This article aims to explore the relation between body and space – specifically how the relation between the embodied awareness of movement and the sense of one’s body-space can be modified and changed deliberately in different kinds of dance practices. Using a multi-sited design, the ethnographical fieldwork, which formed the empirical ground for the study, was from the outset focused on acknowledging the diversity of the dancers’ practices. Each in their own way, the 13 professional dancers involved in the study (...) relate to and experience bodied potentialities, body-space and the spatiality of movement differently. Through their practice, they indicate that the body image is shaped through a multisensorial process of reification, and that seeing is to be related to a broader perceptual engagement. Furthermore, they exemplify how seeing can be deliberately used to expand the sense of their body-space and thereby to affect the spatiality of the fields of their embodied interaction. (shrink)

The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

A strength of liberal political institutions is their ability to accommodate pluralism, both allowing divergent comprehensive doctrines as well as constructing the common ground necessary for diverse people to live together. A pressing question is how far such pluralism extends. Which comprehensive doctrines are simply beyond the pale and need not be accommodated by a political consensus? Rawls attempted to keep the boundaries of reasonable disagreement quite broad by infamously denying that political liberalism need make reference to the concept of (...) truth, a claim that has been criticized by Joseph Raz, Joshua Cohen, and David Estlund. In this paper, we argue that these criticisms fail due to the fact that political liberalism can remain non-committal on the nature of truth, leaving the concept of truth in the domain of comprehensive doctrines while still avoiding the issues raised by Raz, Cohen, and Estlund. Further substantiating this point is the fact that Rawls would, and should, include parties in the overlapping consensus whose views on truth may be incoherent. Once it is seen that political liberalism allows such incoherence to reasonable parties, it is clear that the inclusion of truth and the requirement of coherence urged by Raz, Cohen, and Estlund requires more of reasonable people than is necessary for a political consensus. This paper offers an analytic perspective on epistemic dependence that is grounded in theoretical discussion and field observation at the same time. When in the course of knowledge creation epistemic labor is divided, collaborating scientists come to depend upon one another epistemically. Since instances of epistemic dependence are multifarious in scientific practice, I propose to distinguish between two different forms of epistemic dependence, opaque and translucent epistemic dependence. A scientist is opaquely dependent upon a colleague if she does not possess (...) the expertise necessary to independently carry out, and to profoundly assess, the piece of scientific labor which her colleague is contributing. If the scientist does possess the necessary expertise, I argue, her dependence is translucent. However, the distinction between opaque and translucent epistemic dependence does not exhaust dependence relations in scientific practice, because many dependence relations are neither entirely opaque nor translucent. I will discuss why this is the case, and show how we can make sense of the gray zone between opaque and translucent epistemic dependence. (shrink)

High degrees of uncertainty and a lack of effective therapeutic treatments have characterized the COVID-19 pandemic and the provision of drug products outside research settings has been controversial. International guidelines for providing patients with experimental interventions to treat infectious diseases outside of clinical trials exist but it is unclear if or how they should apply in settings where clinical trials and research are strongly regulated. We propose the Professional Oversight of Emergency-Use Interventions and Monitoring System as an alternative pathway based (...) on guidance developed for the ethical provision of experimental interventions to treat COVID-19 in Singapore. We support our proposal with justifications that establish moral duties for physicians to record outcomes data and for institutions to establish monitoring systems for reporting information on safety and effectiveness to the relevant authorities. Institutions also have a duty to support generation of evidence for what constitutes good clinical practice and so should ensure the unproven intervention is made the subject of research studies that can contribute to generalizable knowledge as soon as practical and that physicians remain committed to supporting learning health systems. We outline key differences between POEIMS and other pathways for the provision of experimental interventions in public health emergencies. (shrink)

Mit Eckharts Leitvers «die Gerechten werden leben ewiglich bei Gott» wird im thetischen Begriff «die Gerechten» epistemologisch, ontologisch und theologisch Eckharts univok-deduktives Denken, im antithetischen «werden leben» der Werk-Begriff unter analog-induktiver Perspektive gezeigt, der synthetische «ewiglich bei Gott» etabliert grundlegend den «underscheit» von Gerechtigkeit und Gerechtem als (...) un-aufhebbare Dialektik. Zwischen den Schriften "Was ist Metaphysik?", " Vom Wesen des Grundes", "Kant und das Problem der Metaphysik", 1929, und "Platons Lehre von der Wahrheit", 1942, hat Heidegger nichts publiziert außer zwei kurzen Hölderlin-Vorträgen und seiner Rektoratsrede von 1933. In diesen dreizehn Jahren hat sowohl Heideggers Denkansatz als auch seine Denkhaltung eine Veränderung erfahren; es ist die in der Heidegger-Forschung so genannte "Kehre". Seit der 1976 aus dem Nachlaß begonnenen Herausgabe von Heideggers Vorlesungen fällt von Mal zu Mal mehr Licht auf (...) seinen Denkweg in besagter Zeitspanne. Zu Recht wurde die Vorlesung als die "Heideggers philosophisches Schaffen zentral prägende Darstellungsform" bezeichnet. Studiert man die Vorlesungen, so wird klar, wie es dazu kommt, daß Heideggers Denkwege in dieser Zeit oft "jäh im Unbegangenen aufhören"; so das Motto des Buches "Holzwege", das, 1950 erschienen, Vorträge und Aufsätze aus der Zeit von 1935 bis 1946 enthält.Die These der Autorin lautet: Der Grund für Heideggers gewandeltes Denken am Ende der genannten Zeitspanne besteht in Erfahrungen, die er im Gespräch mit Hölderlin seit der Vorlesung von 1934/35 gemacht hat. Was sich zwischen 1934/35 und der Heraklit-Vorlesung von 1944 abspielt und als "Kehre" angesprochen wird, bereitet Heideggers Denken vor, wie es in "Vorträge und Aufsätze", "Unterwegs zur Sprache" und in allen späteren Schriften zum Ausdruck kommt.Die Vorlesungen ab 1934/35 zeigen drei Schwerpunkte: die Auseinandersetzung mit Hölderlin, mit Nietzsche und mit den griechischen Denkern am Anfang der abendländischen Geschichte. Während die Philosophie Nietzsches in Heideggers Augen die Vollendung des mit Platon beginnenden Zeitalters der Metaphysik artikuliert, kündigt sich in der Dichtung Hölderlins der Anfang einer anderen Geschichte an. Diesen anderen Geschichtsanfang sieht Heidegger in einem Spannungsverhältnis zu dem, was die griechischen anfänglichen Denker gesagt haben. Ihre Gedanken legt er als ein Sprechen aus dem Erfahrungsbereich der Ἀλήθεια aus. Hölderlin und die Ἀλήθεια stehen also, in je verschiedener, jedoch aufeinander bezogener Weise, für den Anfang von Geschichte. Es ist Heideggers Überzeugung, daß sich Geschichte aus ihrem Anfang bleibend bestimmt. In der Untersuchung wird die Herkunft dieser Überzeugung aufgespürt, was auch irn Hinblick auf die unveröffentlichte Abhandlung von 1941 "Über den Anfang" von Bedeutung ist.Die Verfasserin legt den Boden frei, aus dem das Denken von Heideggers Spätschriften erwächst. Dazu analysiert sie die Freiburger Vorlesungen zwischen 1934/35 und 1944. Es geht ihr darum, die zentralen Gedanken Heideggers in statu nascendi und in ihrer Entfaltung, in ihrer Kontinuität und Veränderung zu verfolgen. Eine solche Verfahrensweise ist um so mehr geboten, als in vielen bisherigen Forschungsarbeiten der Wegcharakter von Heideggers Denken nicht ernst genommen wird und frühere Positionen mit späteren unachtsam vermischt werden. Beachtet man dagegen das Weghafte dieses Denkens, so kann eine Reihe gängiger Forschungsmeinungen korrigiert werden. Zum Beispiel tritt die Zeit-Thematik in Heideggers Spätphilosophie keineswegs "deutlich in den Hintergrund", sie hält sich vielmehr unter gewandelten Namen bis ans Ende seines Denkweges durch. This volume brings together philosophical and interdisciplinary perspectives on improvisation. The contributions connect the theoretical dimensions of improvisation with different viewpoints on its practice in the arts and the classroom. The chapters address the phenomenon of improvisation in two related ways. On the one hand, they attend to the lived practices of improvisation both within and without the arts in order to explain the phenomenon. They also extend the scope of improvisational practices to include the role of improvisation in habit (...) and in planned action, at both individual and collective levels. Drawing on recent work done in the philosophy of mind, they also address questions such as whether improvisation is a single unified phenomenon, or whether it entails different senses that can be discerned theoretically and practically. Finally, they ask after the special kind of improvisational expertise which characterizes musicians, dancers, and other practitioners, an expertise marked by the artist's ability to participate competently in complex situations while deliberately relinquishing control. Philosophy of Improvisation will appeal to researchers working in philosophy, aesthetics, and pedagogy and the arts as well as practitioners involved in different kinds of music, dance, and theater performances. Based on an empirical study of a research team in natural science, the author argues that collaborating scientists do not trust each other completely. Due to the inherent incompleteness of trust, epistemic trust among scientists is not sufficient to manage epistemic dependency in research teams. To mitigate the limitations of epistemic trust, scientists resort to specific strategies of indirect assessment such as dialoguing practices and the probing of explanatory responsiveness. Furthermore, they rely upon impersonal trust and deploy practices of hierarchical (...) authorship. (shrink)

I argue for the view that there are important similarities between knowledge and acting for a normative reason. I interpret acting for a normative reason in terms of Sosa’s notion of an apt performance. Actions that are done for a normative reason are normatively apt actions. They are in accordance with a normative reason because of a competence to act in accordance with normative reasons. I argue that, if Sosa’s account of knowledge as apt belief is correct, this means that (...) acting for a normative reason is in many respects similar to knowledge. In order to strengthen Sosa’s account of knowledge, I propose to supplement it with an appeal to sub-competences. This clarifies how this account can deal with certain Gettier cases, and it helps to understand how exactly acting for a normative reason is similar to apt belief. (shrink)
