In the aftermath of the accounting scandals of the early 2000s, the accounting profession experienced increased legislation and rules regulating ethical behavior of professional accountants and accounting firms. This paper considers ethics education for professional accountants (particularly Certified Public Accountants (CPAs)) and concludes that there is a need for a broader, principles-based approach to continuing professional ethics (CPE) in the United States. This conclusion is supported by the recent trend toward principles-based global ethics standards and a review of the current (...) professional standards and CPE requirements for ethics education for CPAs. We present tools, such as listing core values, creation of a personal mission statement, and the utilization of a comprehensive ethical decision-making framework, that can be incorporated into ethics CPE courses for CPAs, ethics education in academic programs, and ethical decisions in practice. We also present results from a survey about ethical dilemmas distributed to a sample of CPAs taking CPE ethics courses. Consistent with our expectations, we find that for ethical dilemmas in which professional standards more clearly apply and the facts were less ambiguous, the CPAs in the sample responded with higher average levels of ethicality and more agreement than for ethical dilemmas when professional standards were not as applicable and facts were more ambiguous. Finally, the paper demonstrates how a comprehensive ethical decision-making framework may be applied to ethical dilemmas, particularly those that cannot be satisfactorily resolved using a rulesbased approach and makes recommendations for future research. Explanations of the cause of the Challenger disaster by the Presidential Commission and by communication scholars are flawed. These explanations are characterized by a common tendency to emphasize the technical and procedural aspects of organizational life at the expense of the cognitive and ethical. Rightly construed, the Challenger disaster illustrates both the need for a revived art of rhetoric and the importance of putting in place the political and social conditions that make this art efficacious in furthering cognitive understanding and (...) ethical conduct. This book focuses on justice and its demands in the way of providing people with medical care. Building on recent insights on the nature of moral perceptions and motivations from the neurosciences, it makes a case for the traditional medical ethic and examines its financial feasibility. The book starts out by giving an account of the concept of justice and tracing it back to the practices and tenets of Hippocrates and his followers, while taking into account findings from the neurosciences. (...) Next, it considers whether the claim that it is just to limit medical care for everyone to some basic minimum is justifiable. The book then addresses finances and expenditures of the US health care system and shows that the growth of expenditures and the percentage of the gross national product spent on health care make for an unsustainable trajectory. In light of the question what should be changed, the book suggests that overdiagnosis and medicalizing normal behavior lead to harmful, costly and unnecessary interventions and are the result of unethical behavior on the part of the pharmaceutical industry and extensive ethical failures of the FDA. The book ends with suggestions about what can be done to put the U.S. health care system on the path to sustainability, better medical care, and compliance with the demands of justice. (shrink)

The Materialist who interests me is the one who identifies such things as thoughts with what he speaks of with a degree of grand unspecificity [[sic]] infuriating to the physiologist as "brain processes" or "brain-states." The casual vagueness with which he invokes the brain happens not to affect the logic of his position, and it will prove more useful than to confront him with a physiologist demanding details to face him instead with a philosophical opponent, even if we must resurrect (...) one for the purpose. Let us, then, summon an Idealist from the shadows. His view, expressed equally grosso modo, is that all brain-states are thoughts. As the "is" of either position is the one of identity, the positions sound at this stage dangerously like mere commutations of one another, so in order to forestall the ignominy of saying the same thing while meaning to sound different, the opponents make sly countermoves. The Materialist says that there are brain-states—or even more unspecifically, that there are "material objects"—which are not thoughts ; and the Idealist, that there are thoughts which are not brain-states. These detrivialize [[sic]] the contest, but they equally disguise the contest’s comical ambiguities. It will appear upon analysis of the main strategies of logical offense that these traditional antagonists have been addressing themselves to different matters all along, and are saying different but quite compatible things. My chief reason for exhuming the contest is to illuminate features of Materialism which hardly can be discerned in the context of current preoccupation with predicates and language-games. Allowing myself the privileges of gross discourse which I have accorded my contestants, I shall say: the Idealist has been speaking of the content of thought, the Materialist about thoughts themselves. The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...) treaty draft reflects these ethical considerations by including a section entitled Guiding Principles and Approaches. Most of these principles are ethical—they establish core values that undergird the treaty. Unfortunately, the treaty draft's set of principles are numerous, overlapping, and show inadequate coherence and consistency. We propose two improvements to this section of the draft pandemic treaty. First, key guiding ethical principles should be clearer and more precise than they currently are. Second, the link between ethical principles and policy implementation should be clearly established and define boundaries on acceptable interpretation, ensuring that signatories abide by these principles. First published in 1818, The World as Will and Representation contains Schopenhauer's entire philosophy, ranging through epistemology, metaphysics, philosophy of mind and action, aesthetics and philosophy of art, to ethics, the meaning of life and the philosophy of religion, in an attempt to account for the world in all its significant aspects. It gives a unique and influential account of what is and is not of value in existence, the striving and pain of the human condition and the possibility of (...) deliverance from it. This new translation of the first volume of what later became a two-volume work reflects the eloquence and power of Schopenhauer's prose and renders philosophical terms accurately and consistently. The prospect of consumable meat produced in a laboratory setting without the need to raise and slaughter animals is both realistic and exciting. Not only could such in vitro meat become popular due to potential cost savings, but it also avoids many of the ethical and environmental problems with traditional meat productions. However, as with any new technology, in vitro meat is likely to face some detractors. We examine in detail three potential objections: 1) in vitro meat is disrespectful, either (...) to nature or to animals; 2) it will reduce the number of happy animals in the world; and 3) it will open the door to cannibalism. While each objection has some attraction, we ultimately find that all can be overcome. The upshot is that in vitro meat production is generally permissible and, especially for ethical vegetarians, worth promoting. (shrink)

The introductory chapter places creativity in a historical context. It shows how objectivist and subjectivist research philosophies have emerged and how they relate to technical, practical and emancipatory knowledge interests which inform the study of organizational creativity. Based on a sensitizing concept of organizational creativity the chapter then suggests context, process and practice as the conceptual framing for the subsequent arguments of the book.

The prominence of judgment data in contemporary linguistics is crucially tied to Chomsky's mentalist reconception of the field. Judgment data are meta‐linguistic judgments – judgments about specific linguistic items, construed broadly to include language‐like items (e.g. ungrammatical strings). A judgment of unacceptability provides stronger evidence of ungrammaticality – insofar as reasonable alternative explanations can be ruled out (pragmatic oddity, processing difficulties, memory constraints, lexical awkwardness, etc.). The use of judgment data has never been without critics. The objections have taken various (...) forms. Earlier objections tended to deem judgments problematic as evidence per se, not just in linguistics but more generally. Later objections contend that the use of judgment data is problematic more specifically in the linguistic domain, in some cases on account of how they are in fact typically gathered or because of an over‐reliance on them over other sources of evidence. Judgment data, no matter how collected, have a definite future in linguistics. (shrink)

Emotion regulation has the odd distinction of being a wildly popular construct whose scientific existence is in considerable doubt. In this article, we discuss the confusion about whether emotion generation and emotion regulation can and should be distinguished from one another. We describe a continuum of perspectives on emotion, and highlight how different (often mutually incompatible) perspectives on emotion lead to different views about whether emotion generation and emotion regulation can be usefully distinguished. We argue that making differences in perspective (...) explicit serves the function of allowing researchers with different theoretical commitments to collaborate productively despite seemingly insurmountable differences in terminology and methods. Linguistic intuitions are a central source of evidence across a variety of linguistic domains. They have also long been a source of controversy. This chapter aims to illuminate the etiology and evidential status of at least some linguistic intuitions by relating them to error signals of the sort posited by accounts of on-line monitoring of speech production and comprehension. The suggestion is framed as a novel reply to Michael Devitt’s claim that linguistic intuitions are theory-laden “central systems” responses, rather than (...) endorsed outputs of a modularized language faculty (the “Voice of Competence”). Along the way, it is argued that linguistic intuitions may not constitute a natural kind with a common etiology; and that, for a range of cases, the process by which intuitions used in linguistics are generated amounts to little more than comprehension. This article explores Franz Brentano's opposition to papal infallibility, and sets this in the context of his development as a Catholic scholar. An active participant in the Catholic revival of the nineteenth century, Brentano contributed to the emergence of neoscholasticism through his philosophical rehabilitation of Aristotle. Brentano ultimately left the Church however as the result of intensive scrutiny of his faith occasioned by his analysis of infallibility. This article explores this crisis of faith by analyzing, for the first time, Brentano's (...) position on papal infallibility, and suggesting ways that it informed his philosophical development. This chapter highlights the impact of the work of French phenomenologist Michel Henry and Austrian psychoanalyst Otto Rank on psychoanalysis. I contend that Henry and Rank clarify the nature and role of mindfulness and creativity in psychoanalysis. To begin, I draw out the implications of Henry’s critique of Freudian psychoanalysis. In my view, Henry’s work reveals and untangles basic inconsistencies in Freud’s views on the unconscious, affective layer of the subject’s life, and establishes that the creativity of life’s immanent movement (...) is essential to the development of the subject’s personality and to the acquisition and alleviation of neuroses. At the same time, I maintain that, while Henry’s work acknowledges a potential role for mindfulness in the development of life’s creativity, his account is problematic. At the end of the day, Henry’s conception of life as an immanent, self-enclosed reality fails to adequately account for the relation between life (creativity) and intentionality (mindfulness). As a result, it fails to sufficiently account for the intersubjective character of creativity and mindfulness. To address these issues, I bring Henry’s insights into these matters into dialogue with Rank’s psychology of difference, which similarly regards affectivity and creativity as central to human life and to psychoanalysis. By doing so, what comes forward is that mindfulness and creativity are relationships that can strengthen and weaken one another, and which always involve self-enclosure and openness towards others and the cosmos. Bearing this in mind, I maintain that mindfulness and creativity can play an important role in allowing psychoanalysis to realize its aim of improving the well-being of human beings. (shrink)

This paper engages in a critical examination of Michel Henry’s (1922-2002) phenomenological study of the erotic relation. I argue that while Henry’s analysis sheds light on the nature of eros and how it might be renewed from the obscene objectivism to which it has largely been reduced in Western society today, his analysis of eros undermines his account of the phenomenological life of the subject as a radically immanent mode of appearing and calls for revision. I contend that it is (...) by acknowledging life as a movement of transcendence toward the world that we can resolve this issue and further refine Henry’s insights into the nature of eros and how it might once again be renewed in contemporary Western civilization. I begin by laying out Henry’s account of how the forgetting of life results in a reduction of the erotic (i.e., inter-subjective) relation to a merely sexual (i.e., inter-objective) one, and how this lays the groundwork for what he regards as the destructive sadomasochistic practices of voyeurism and pornography. Following this, I outline Henry’s account of the nature and limits of the erotic relation, and I demonstrate how Henry’s work harbours the latent suggestion that the failure of eros can serve as a step toward a higher union with others in a love of God. In the closing section, I show how Henry’s analysis of the erotic relation calls for a re-conception of life as a movement of transcendence. I outline how this re-conception better accounts for the complex exchanges between the non-objectifying drives of life and the objectifying acts of consciousness, and I show how this allows us to retain some of Henry’s insights into eros and its renewal while forcing us to modify others. In fact, while the American College of Obstetricians and Gynecologists supports the right of every birthing person to make a medically informed decision about their delivery, they do not recommend home birth owing to data indicating greater neonatal morbidity and mortality. In this article, we examine the evidence surrounding home birth in the United States and its current limitations, as well as the ethical considerations around birth setting.

If rhetoric is the art of speaking, who is listening? In Being-Moved, Daniel M. Gross provides an answer, showing when and where the art of speaking parted ways with the art of listening-and what happens when they intersect once again. Much in the history of rhetoric must be rethought along the way. And much of this rethinking pivots around Martin Heidegger's early lectures on Aristotle's Rhetoric, where his famous topic, Being, gives way to being-moved. The results, Gross goes (...) on to show, are profound. Listening to the gods, listening to the world around us, and even listening to one another in the classroom-all of these experiences become different when rhetoric is reoriented from the voice to the ear. For people to contribute to discourse, they must do more than utter the right sentence at the right time. The basic requirement is that they add to their common ground in an orderly way. To do this, we argue, they try to establish for each utterance the mutual belief that the addressees have understood what the speaker meant well enough for current purposes. This is accomplished by the collective actions of the current contributor and his or her partners, and these (...) result in units of conversation called contributions. We present a model of contributions and show how it accounts for a variety of features of everyday conversations. (shrink)

Zenon Pylyshyn argues that cognitively driven attentional effects do not amount to cognitive penetration of early vision because such effects occur either before or after early vision. Critics object that in fact such effects occur at all levels of perceptual processing. We argue that Pylyshyn’s claim is correct—but not for the reason he emphasizes. Even if his critics are correct that attentional effects are not external to early vision, these effects do not satisfy Pylyshyn’s requirements that the effects be direct (...) and exhibit semantic coherence. In addition, we distinguish our defense from those found in recent work by Raftopoulos and by Firestone and Scholl, argue that attention should not be assimilated to expectation, and discuss alternative characterizations of cognitive penetrability, advocating a kind of pluralism.
