I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. The resulting chronology is complex, and I here only indicate it in rough form in a way which [End Page 272] brings out what I take to be its major points. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. All other dialogues, including the Theaetetus, were written prior to the Parmenides with the exception of the Republic, which Thesleff proposes is in its ultimate shape a late work, representing "only and purely Plato's 'own' and personal philosophy" (115). Aristotle's account of female nature has received mostly negative treatment, emphasising what he says females cannot do. Building on recent research, this book comprehensively revises such readings, setting out the complex and positive role played by the female in Aristotle's thought with a particular focus on the longest surviving treatise on reproduction in the ancient corpus, the Generation of Animals. It provides new interpretations of the nature of Aristotle's sexism, his theory of male and female interaction in generation, and his (...) account of inherited features. It also discusses a range of more general issues which can and should be re-examined in light of Aristotle's account of female animals: his methodology, hylomorphism, teleology and psychology. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

This essay is about a special kind of transformative choice that plays a key role in debates about permissivism, the view that some bodies of evidence permit more than one rational response. A prominent objection to this view contends that its defender cannot vindicate our aversion to arbitrarily switching between belief states in the absence of any new evidence. A prominent response to that objection tries to provide the desired vindication by appealing to the idea that arbitrary switching would involve (...) a special kind of transformative choice: the choice to change one’s epistemic standards, i.e., one’s commitments regarding the relative importance of achieving true belief and avoiding false belief. My first aims here are to argue that this response is unsuccessful and propose an alternative. My secondary aim is to consider how this discussion might bear on more general debates about transformative choice. (shrink)

The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy. Scholars have often debated how these two fields are related. The current study shows that according to Aristotelian biology, women are set up for intelligence and tend to be milder-tempered than men. Thus, women are not curtailed either intellectually or morally by their biology. The biological basis for the rule of men over women is women's lack of spiritedness. (...) Aristotle's Politics must be read with its audience in mind; there is a need to convince men of the importance of avoiding insurrection both in the city and the household. I argue that T.M. Scanlon's contractualist account of morality has difficulty accommodating our intuitions about the moral relevance of the number of people affected by an action. I first consider the "Complaint Model" of reasonable rejection, which restricts the grounds for an individual's rejection of a principle to its effects upon herself. I argue that it can accommodate our intuitions about numbers only if we assume that, whenever we do not know who will be affected, each individual may appeal only (...) to the _expected effects on her. This assumption, I suggest, leads to counterintuitive results in cases where, although we do not know who will be affected, we do know that _someone will be. I then consider two proposals to supplement the complaint model with a direct appeal to aggregation. I argue that both are open to serious objections. (shrink)

What is the cash value of Richard Rorty’s philosophy and politics of religion? This paper analyzes the political promise of Rorty’s shift from atheism to anticlericalism in the last decade of his life. It seeks to deliver primarily a concise summary of this shift, and of its transformative motivation. Then a critique of this shift is followed by the suggestion of a friendly amendment: its extension towards a pragmatic pluralism. The outlined Rortyan conception of a serene, and, at the same (...) time robust, politics of religion is proposed as a promising answer to the question of how secular liberal citizens should react to the “return of the gods.”. Cette conception est loin d'être partagée par toute la planète où dans la plupart des cas, le groupe a priorité sur l'individu et, pour ce qui est du pouvoir, l'exclusivité, l'occulte, l'arbitraire, etc. l'emportent sur la pluralité et le droit. Il s'agit donc, dans cet ouvrage, de questionner les représentations du monde, les valeurs, les institutions et les pratiques sociales qui sont à l'origine du (...) modèle politique occidental et les confronter avec d'autres représentations, d'autres valeurs, d'autres modes d'organisation sociale et politique. C'est un questionnement de l'intérieur qui cherche le sens caché des actions collectives et de leurs motivations. Ce type d'interrogation est frappé d'interdit de nos jours. Le discours universaliste dominant et les politiques qui lui sont associées nient la présence des différences culturelles de fond. L'argument massue évoqué pour étayer cet interdit est l'exploitation politique de cette problématique par les courants réactionnaires et xénophobes en Occident ou les dictateurs dans les autres contrées du monde. State governments provide preprinted advance directive forms to the general public. However, many adults in the United States (US) lack the skills necessary to read and comprehend health care-related materials. In this study, we sought to determine the readability of state government-sponsored advance directive forms.

Despite its enduring insights, Durkheim’s theory of suicide fails to account for a significant set of cases because of its overreliance on structural forces to the detriment of other possible factors. In this paper, we develop a new theoretical framework for thinking about the role of culture in vulnerability to suicide. We argue that by focusing on the cultural dynamics of excessive regulation, particularly at the meso level, a more robust sociological model for suicide could be offered that supplements structure-heavy (...) Durkheimian theory. In essence, we argue that the relevance of cultural regulation to suicide rests on the (1) degree to which culture is coherent in sociocultural places, (2) existence of directives related to prescribing or proscribing suicide, (3) degree to which these directives translate into internalized meanings affecting social psychological processes, and (4) degree to which the social space is bounded. We then illustrate how our new theory provides useful insights into three cases of suicide largely neglected within sociology: specifically, suicide clusters in high schools, suicide in the military, and suicides of “despair” among middle-aged white men. We conclude with implications for future sociological research on suicide and suicide prevention. (shrink)

This paper aims to establish that, for Aristotle, the state of the physical body is crucial to the human capacity for theoretical understanding. In recent years, scholars have begun to recognise the importance of Aristotle’s biological writings for understanding his psychology, after the relative neglect of these connections. The relevance in particular of the so-called Parva naturalia, small works on what is common to body and soul, and the De motu animalium, a work devoted to animal motion in broad terms, (...) has begun to fill in the picture of how the living body is involved in cognition. This paper will support this point of view by adding the De generatione animalium, a work which gives an account of the advent of soul capacities through the development of the body from the blood, under the control of the nutritive soul. An Aristotelian science of human physiology is a study of the “thinking body”, a person as a whole rather than disembodied nous. I will first set out factors that have made it difficult to integrate Aristotle’s biological treatises into our understanding of human thinking. Next, I will distinguish the thinking shared with other animals, from theoretical understanding, which is something only humans can achieve. I will then explain the aspects of the body that must facilitate and eventually bring about the capacity for thinking, before turning to Aristotle’s embryology where nutritive soul is ultimately responsible for the construction and maintenance of the thinking body. It will be concluded that only a human body leads to theoretical understanding and only a healthy human body can do so adequately. (shrink)

This paper contributes to the (re-)conceptualisation of responsible innovation by proposing an evolutionary economic approach that focuses on the role of consumers in the innovation process. After a discussion of the philosophical foundations and ethical implications of this approach, which bears an explanatory potential that has not been adequately considered in previous discussions of responsible innovation, we present a first step towards capturing the important but often neglected role of consumers in innovation processes (including responsible innovation): We propose an agent-based (...) model that incorporates a multidimensional space of characteristics in which new products or services are represented by more than the mere aspect of price and quality. Instead, innovations are denoted by a large set of characteristics, including also negative or harmful ones. The model is used to illustrate that consumers’ heterogeneity and bounded rationality – even if considered in a simple manner – indeed play a crucial role in the creation and diffusion of responsible innovation which can and should be used for further work in this field and for possible extensions of the model. Despite a certain reluctance to incorporate treatises on animals into the undergraduate curriculum, it is now inadvisable to avoid any reference to Aristotle’s biological work when discussing most aspects of his thought. The new tendency of scholarship on Aristotle’s biology employs various methodologies but, in the main, argues for the importance of Aristotle’s biological treatises on the (...) basis of the assistance they might provide for understanding some of the more intractable problems in Aristotle’s thought. It is a piece of common sense that we can be mean-spirited, cruel, and unfair in the ways that we form beliefs. That is, we can wrong others through our doxastic activity. This fact shows that, contrary to an increasingly widespread view in the ethics of belief literature, morality has a role to play in guiding doxastic deliberation, and evidence is therefore not the only ‘right kind of reason’ for belief. But the mere existence of doxastic wronging does not tell (...) us anything about how, exactly, morality enters into doxastic deliberation. The ‘psychologist’s green thumb’ refers to the argument that an experimenter needs an indeterminate set of skills to successfully replicate an effect. This argument is sometimes invoked by psychological researchers to explain away failures of independent replication attempts of their work. In this paper, I assess the psychologist’s green thumb as a candidate explanation for individual replication failure and argue that it is potentially costly for psychology as a field. I also present other, more likely reasons for these replication failures. (...) I conclude that appealing to a psychologist’s green thumb is not a convincing explanation for replication failure. This paper presents a novel position in the philosophy of logic: I argue that _validity_ is a thick concept. Hence, I propose to consider _validity_ in analogy to other thick concepts, such as _honesty_, _selfishness_ or _justice_. This proposal is motivated by the debate on the normativity of logic: while logic textbooks seem simply descriptive in their presentation of logical truths, many have argued that logic has consequences for how we ought to reason, for what we ought to believe, or (...) for what we ought to infer. How can logic be normative, if it appears to be descriptive? According to the proposal of this paper, the normativity of logic can be explained because a thick concept is in play: _validity_. Thus, I argue that the debate on how to best characterize validity and the debate on logic’s normativity are more connected than we think, because _validity_ is a thick concept. (shrink)

Inspired by Confucianism, Daoism, and Buddhism, many East Asian ethical leaders have aspired to emulate seemingly unattainable sages and buddhas throughout history. This aspiration challenges the common psychological view that significant gaps between role models and actual selves might hinder emulation motivation. It also differs from Western findings, which suggest that ethical leadership often emerges from emulating attainable exemplars like immediate supervisors or mentors. To decipher this intriguing emulation behavior in East Asia, this study employed a multiple-case approach involving 25 (...) ethical leaders from Taiwan. Results indicate that these ethical leaders formulate three approaches to sustain emulation motivation for seemingly unattainable exemplars. First, they draw on East Asian philosophies to address demotivating factors such as ego threats and goal unattainability. Second, they embrace the cultural values of the Sinosphere, amplifying motivators like self-betterment, altruism, and life purpose. Lastly, they capitalize on the collective tendency of their culture to assimilate positive environmental influences, including societal norms and social support. These findings elucidate how and why many East Asian ethical leaders sustain buddha/sage emulation: The cultural resources of the Sinosphere nurture effective psychological strategies, underpinned by universal psychological mechanisms that suggest wider applicability across various societies. This book defends an original and pluralist theory of when and why discrimination wrongs people, in particular, through unfair subordination, through the violation of their right to a particular deliberative freedom, or through the denial to them of access to a basic good.

In a work entitled On the Generation of Animals, Aristotle remarks that “intellect (nous) alone enters from outside (thurathen)”. Interpretations of this passage as dualistic dominate the history of ideas and allow for a joining together of Platonic and Aristotelian doctrine on the soul. This, however, pulls against the well-known Aristotelian position that soul and body are intertwined and interdependent. The most influential interpretations thereby misrepresent Aristotle’s view on soul and lack any real engagement with his embryology. This paper seeks (...) to extract the account of intellect (nous) in Aristotelian embryology from this interpretative background and place it within the context of his mature biological thought. A clear account of the actual import of this statement in its relevant context is given before explaining how it has been misunderstood by various interpretative traditions. The paper finishes by touching on how early commentary by Christian writers, freed as it was from the imperative to synthesise Greek philosophy, differed from those that came after. While realising that Aristotle’s position would not aid them in their explanations of the soul’s survival after death, their engagement with Aristotle’s science allowed for other aspects of theology concerning the fittingness of soul to body. Recent scholarship emphasizes the scaffolding role of language for cognition. Language, it is claimed, is a cognition-enhancing niche (Clark, 2006), a programming tool for cognition (Lupyan and Bergen, 2016), even a neuroenhancement (Dove, 2019), and augments cognitive functions such as memory, categorization, cognitive control as well as meta-cognitive abilities (‘thinking about thinking’). Yet the notion that language enhances or augments cognition does not fit in with embodied approaches to language processing, or so we will argue. Accounts aiming to explain how (...) language enhances various cognitive functions often employ a notion of abstract representation. Yet embodied approaches to language processing have it that language processing crucially, according to some accounts even exclusively, involves embodied, modality-specific, i.e. non-abstract representations. In coming to understand a particular phrase or sentence, a prior experience has to be simulated or reenacted. The representation thus activated is embodied (modality-specific) as sensorimotor regions of the brain are thereby recruited. In the paper, we will first discuss the notion of representation, clarify what it takes for a representation to be embodied or abstract respectively, and distinguish between conceptual and (other) linguistic representations. We will then put forward a characterization of cognitive control and examine its representational infrastructure. The remainder of the paper will be devoted to arguing that language augments cognitive control. To that end, we will draw on two lines of research, which investigate how language augments cognitive control: i. research on the availability of linguistic labels, and ii. research on the active usage of a linguistic code, specifically in inner speech. Eventually, we will argue that the cognition-enhancing capacity of language can be explained once we assume that it provides us with a. abstract, non-embodied representations, and with b. abstract, sparse linguistic representations that may serve as easy-to-manipulate placeholders for fully embodied or otherwise more detailed representations.
