Radial Animal Studies: Beyond Respectability Politics, Opportunism, and Cooptation is a scholar-activist book emerging out of the field of Critical Animal Studies (CAS). Radical Animal Studies (RAS) edited by Anthony J. Nocella II and Kim Socha recognizes and values the goal of total liberation and the importance of underground revolutionary direct action. RAS is a complement to, not in conflict with, CAS. Indeed, RAS is dedicated to two of the 10 CAS principles: seven (total liberation) and nine (radical politics and (...) strategies). In chapter one I firstly critique some contemporary family-resemblance approaches to the category woman, and claim that they do not take sufficient account of dis-semblance, that is, resemblances that people have in common with members of the contrast category man. Second, I analyze how the concept of woman is semantically contestable: resemblance/dissemblance structures give rise to vagueness and to borderline cases. Borderline cases can either be included in the category or excluded from it. The factors which incline parties in a (...) dispute about membership to include or exclude depend on metaphysical, ethical, or political background assumptions. In chapter two, I begin by considering the harms suffered by transgender persons through “misgendering”, the deployment of gender terms which inflict psychological harms upon transgender persons, place them in situations of injustice, or diminish their self-respect. Such deployments are morally contestable: they can be challenged on ethical grounds. Several characterisations of the term ‘woman’ proposed in the feminist literature are critiqued from this perspective. In chapter three, I elaborate a broadly liberal approach to gender pluralism. The approach involves: i) the public toleration of gender practices and beliefs which contest prevalent gender norms; and ii) state-gender neutrality. Public toleration allows gender non-conforming practices and beliefs within public space. State gender-neutrality consists mainly in the removal from law and government policy of provisions which assume compliance with prevalent conceptions of gender. (shrink)

Respecting Persons in Theory and Practice is a collection of essays of the moral and political philosophy of Jan Narveson. The essays in this collection share a consistent theme running through much of Narveson's moral and political philosophy, namely that politics and morals stem from the interests of individual people, and have no antecedent authority over us. The essays in this collection, in various ways and as applied to various aspects of the scene, argue that the ultimate and (...) true point of politics and morals is to enable us to make our lives better, according to our varied senses of what that might mean. In my recent book Liberalism with Excellence, I have expounded at length a conception of warranted self-respect. That conception, which draws heavily though far from uncritically on the scattered passages about self-respect in the writings of John Rawls, is central to my defense of a variety of liberalism that combines and transfigures certain aspects of Rawlsianism and perfectionism. However, it is also central to the positions taken in some earlier books of mine on capital punishment and torture. Although (...) my understanding of warranted self-respect was presented far more briefly or obliquely in each of those earlier books than in Liberalism with Excellence, it in fact underlies both my limited defense of the death penalty and my absolutist insistence that the use of interrogational torture is never morally permissible. The present paper will recount the gist of my conception of warranted self-respect and will then explain how that conception figures pivotally in my ruminations on the diverse matters of political morality that have been mentioned here. David Lyons is one of the pre-eminent philosophers of law active in the United States. This volume comprises essays written over a period of twenty years in which Professor Lyons outlines his fundamental views about the nature of law and its relation to morality and justice. The underlying theme of the book is that a system of law has only a tenuous connection with morality and justice. Contrary to those legal theorists who maintain that no matter how bad the law (...) of a community might be, strict conformity to existing law automatically dispenses 'formal' justice, Professor Lyons contends that the law must earn the respect that it demands. Moreover, we cannot, as some would suggest, interpret law in a value-neutral manner. Rather courts should interpret statutes, judicial precedents, and constitutional provisions in terms of values that would justify those laws. In this way officials can promote the justifiability of what they do to people in the name of law, and can help the law live up to its moral pretensions. (shrink)

This article investigates the semantics and pragmatics of the ‘hortative’ aorist and the ‘tragic’ or ‘performative’ aorist. Lloyd argued in 1999 that the tragic aorist is a more polite alternative for the corresponding present. Recently, he has extended this view to the hortative aorist, suggesting that, for example, τί οὐκ ἐκαλέσαμεν; is a polite alternative for τί οὐ καλοῦμεν; Lloyd argues that the politeness value of the aorist derives from its being a past tense, comparing the so-called ‘attitudinal’ past. The (...) present article, building on work by Colvin, Bary and Nijk, argues instead that the semantic value of the aorist is purely aspectual in these cases: the hortative and tragic aorists serve to construe the designated event as bounded, while the corresponding present forms serve to construe the designated event as unbounded. An extensive discussion of the evidence for the hortative aorist and present is presented, as well as a case study concerning the aspectual behaviour of the verb ὄμνυμι. Moreover, I argue that the proposed semantic account of the hortative and tragic aorists in terms of aspect can be unified with Lloyd's pragmatic account in terms of politeness: the difference in tone between the present and the aorist can be derived from their respective aspectual values, rather than from their temporal values. An important personality of the Swedish cultural space and of the world diplomatic space, Dag Hammarskjöld, left to posterity, besides his literary works, his economic and diplomatic contributions, the most important spiritual autobiography from the Swedish protestant space of the 20th century. Discovered shortly after his death and published by his disciples in 1963 in an English version in London, Markings presents the struggle of the author with himself, illustrated in a great diversity of styles, from haiku poems to short (...) meditations, pastels, biblical exegeses and so on. Apart from the description of his spiritual life, his relationship with God, or his conception of spiritual issues, the work also contains some interesting references to aspects of political theology. These aspects represent the subject of our research. After a short presentation of his life and activity and of the influence of his family on his education, we will try to present the way in which aspects of political theology are emphasised in the aforementioned work and which are some important elements of the author’s conception of this subject. In this respect, we will resort not only to his spiritual autobiography, but also to the most important writings about him, published by specialists in diplomacy, literature and politics. Unfortunately, it is difficult to find theologians who wrote about his spiritual autobiography. Therefore, one of the main strengths of this research will be the fact that it presents a theological approach to Dag Hammarskjöld. (shrink)

In ‘Listening to Music Together’, Nick Zangwill offers three arguments which aim to establish that listening to music can never be a joint activity. If any of these arguments were sound, then our experiences of music, qua object of aesthetic attention, would be essentially private. In this paper, I argue that Zangwill’s arguments are unsound and I develop an account of shared musical experience that defends three main conclusions. First, joint listening is not merely possible but a common feature of (...) our socially situated experiences of music. Second, when listening with others our experience of the music and our sense of community with our fellow listeners often reciprocally enhance one another. Third, how deeply and intimately we share a musical experience with others depends upon such factors as our respective backgrounds, interests, and levels of expertise. (shrink)

Many philosophers of music, especially within the analytic tradition, are essentialists with respect to musical experience. That is, they view their goal as that of isolating the essential set of features constitutive of the experience of music, qua music. Toward this end, they eliminate every element that would appear to be unnecessary for one to experience music as such. In doing so, they limit their analysis to the experience of a silent, motionless individual who listens with rapt attention to (...) the sounds produced by either musicians a on stage, a stereo, or a portable device. This approach is illustrated in recent work by Nick Zangwill. Drawing on essentialist assumptions, Zangwill concludes that properly musical experience is effectively disembodied and radically private. While this seems plausible when we consider the essentialists’ paradigm case, Zangwill’s conclusion seems odd once we consider the wide variety of ways that people experience music. One’s body and social situation seem ineluctably enmeshed within the experience of, e.g., hot jazz played in a nightclub, where listeners bob their heads and dance to the music, cheer on the musicians, and socialize with their fellow concertgoers. The question this paper aims to answer is: should we consider this and similar experiences of music properly “musical”? I maintain that we should. Far from the world of pure music that Zangwill and others relegate properly musical experience, I conclude that our musical experiences are fully enmeshed within the somatic, affective, and interpersonal dimensions of human life. Democracy has been a flawed hegemony since the fall of communism. Its flexibility, its commitment to equality of representation, and its recognition of the legitimacy of opposition politics are all positive features for political institutions. But democracy has many deficiencies: it is all too easily held hostage by powerful interests; it often fails to advance social justice; and it does not cope well with a number of features of the political landscape, such as political identities, boundary disputes, (...) and environmental crises. Although democracy is valuable it fits uneasily with other political values and is in many respects less than equal to the demands it confronts. In this volume prominent political theorists and social scientists present original discussions of such central issues. Democracy's Values deals with the nature and value of democracy, particularly the tensions between it and such goods as justice, equality, efficiency, and freedom. (shrink)

The Politics of Well-Being argues that the relationship between well-being and ethical life has been overlooked. The more specific argument of the book is that ethical life requires political engagement, and the emergence of a society committed to critical thinking. It is argued that these conditions allow for our ordination and confirmation as ethical subjects. While well-being can be experienced in different ways, it is claimed that, after experience of ethical life, a more sustainable form of it is revealed (...) to us, a form which we would be drawn to preserve, a form which can be constituted as an object of hope. While the book draws on philosophical themes, its main focus is political. This is because its primary objective is to identify and to examine what needs to be done in order to realise ethical life. Its main focus in this respect is the identification and examination of the barriers which need to be overcome if ethical life is to be realised. It is acknowledged that this will not be an easy task. Indeed, it may be an impossible task. However, despite these barriers, and despite the dark days we are living through, the book is a call to hope rather than a surrender to despair. This book will be of interest to students of politics, psychology, cultural studies, philosophy and sociology, as well as anyone else interested in exploring new ideas about how the make the world a better place. Many, including Marx, Rawls, and the contemporary 'Black Lives Matter' movement, embrace the ambition to secure terms of co-existence in which the worth of people's lives becomes a lived reality rather than an empty boast. This book asks whether, as some believe, the philosophical idea of human dignity can help achieve that ambition. Offering a new fourfold typology of dignity concepts, Colin Bird argues that human dignity can perform this role only if certain traditional ways of conceiving it are abandoned. (...) Accordingly, Bird rejects the idea that human dignity refers to the inherent worth or status of individuals, and instead reinterprets it as a social relation, constituted by affects of respect and the modes of mutual attention which they generate. Immanuel Kant, in a much-maligned view, thought that we could only have indirect duties to nonhuman animals who have no inherent moral value since they lack rationality. While there are various responses to this worrisome position, no one seems to consider that animals could conceivably qualify as having rationality, even on Kantian high standards. Animals engage in various activities that could be taken as indicators of the core aspects of rationality that Kant requires for having absolute worth. While these animal (...) behaviors will not prove that animals are rational, we must remember that we also cannot prove that other humans are rational. Instead, my goal is only to provide a basis for a precautionary moral principle that requires treating animals as minimally rational, given that they might be. On this basis, we ought to accept some direct Kantian duties for the respectful treatment of animals. (shrink)

Does a political conception of human rights dictate a particular view of corporate human rights obligations? The U.N. “Protect, Respect, and Remedy” Framework and Guiding Principles on Business and Human Rights hold that corporations have only a responsibility to respect human rights. Some critics have argued that corporations should be responsible for a wider range of human rights obligations, beyond merely an obligation to respect such rights. Furthermore, it has been argued that the Framework relied on (...) a political conception of human rights, and this is what led to limiting corporate obligations to mere respect for human rights. In this paper, I explore and critically assess this general claim about political conceptions of human rights. This involves distinguishing different types of political conceptions of human rights, as well as specifying what makes a theory of human rights a “political conception.” In light of this clarificatory discussion, I argue that the general thesis is false; the mere fact that a theory offers a political conception of human rights does not necessarily entail any certain range of corporate human rights obligations. Finally, I identify some of the other aspects of a theory of human rights that do affect the range of corporate obligations it will prescribe. (shrink)

Over the last few decades the study of Shīʿī Islam has witnessed a growing interest in specific aspects and perspectives of Shīʿī philosophers and theologians. The monograph authored by Sayeh Meisami focuses on the views of two of the most influential thinkers in Shīʿī, namely the eleventh century Ismāʿīlī thinker Ḥāmid al-Kirmānī and the Twelver mystic and thinker Ṣadr al-Dīn al-Shīrāzī, better known as Mullā Ṣadrā. Throughout the five chapters, the textual comparative analysis of their thought shows how multifaceted epistemological (...) and cosmological keys are transmitted from al-Kirmānī to Mullā Ṣadra, and ultimately become interwoven with their respective theories about the legitimacy of the Imām. Epistemology, cosmology, and political theory thus become, in the author’s analysis, the fil rouge that characterize the development of Shīʿī mystical and political philosophies up to the advent of Ayatollah Khomeini and the Islamic Republic of Iran. Ian Carter has recently argued in a series of articles that a certain form of respect, called ‘opacity respect’, gives a moral grounding to people’s equality. This type of respect involves abstaining from making or acting on judgements about others. Aside from arguing for its justificatory role, Carter also argues that, in this role, it has a series of implications for our thinking about liberal politics. I argue, first, that the theoretical implications of the view that opacity (...) respect grounds equality are narrower than they first appear. This is because, in order to put the view into action, one must make a certain kind of empirical claim. Second, I show that this point reveals an important structural aspect of Carter’s view, concerning the way that principles can be limited in practice. Third, I argue that the practical implications of the view are potentially much broader than they first appear, threatening absurdity. This is because the position’s repercussions naturally extend into day-to-day transactions. (shrink)

Philosophy of Science, understood as a special philosophical discipline, was born only at the beginning of the twentieth century as part of the effort for overcoming the “foundational crisis” that had affected especially mathematics and physics. Therefore, it was conceived as an investigation about the features and reliability of scientific knowledge and for a few decades was deeply marked by the philosophical approach of logical empiricism. This cognitive point of view persisted also when, after Kuhn’s work, the attention focused on (...) the scientific activity in order to understand scientific change and a sociological model replaced the view that empirical adequacy and logical consistency are the factors that determine the change of scientific theories. Ethical, social and political considerations regarding science ware considered inappropriate and potentially dangerous since they violate the alleged “neutrality of science” with respect to values. Nevertheless, the strict intertwining of science and technology in contemporary “technoscience” has produced a wide debate regarding the practical aspect of technoscientific activity that has the intrinsic features of a philosophical debate. Therefore, it is natural and advisable that the entire wealth of the philosophical disciplines be called to contribute to the specific complex discourse of the Philosophy of Science. (shrink)

This volume is an act of talking back, of talking heresy. To reclaim the term “realism,” to maintain the epistemic significance of identity, to defend any version of identity politics today is to swim upstream of strong academic currents in feminist theory, literary theory, and cultural studies. It is to risk, even to invite, a dismissal as naive, uninformed, theoretically unsophisticated. And it is a risk taken here by people already at risk in the academy, already assumed more often than (...) not to be uninformed and undereducated precisely because of their real identities. Of course, identity is today a growth industry in the academy, across the humanities and social sciences, influencing even law and communication studies. The constitutive power of gender, race, ethnicity, sexuality and other forms of identity has, finally, suddenly, been recognized as a relevant aspect of almost all projects of inquiry. However, as I shall discuss in this essay, simultaneous to this academic commodification of identity is an increasing tendency to view identity as politically and metaphysically problematic, some have even said pathological. So on the one hand the theoretical relevance of identities has become visible, while on the other hand many theorists are troubled by the implications of the claim that identity makes a difference. Increasingly, then, the attachment to identity has become suspect. If identity has become suspect, identity politics has been prosecuted, tried, and sentenced to death. To espouse identity politics in the academy today risks being viewed as a member of the Flat-Earth Society. Like “essentialism,” identity politics has become the shibboleth of cultural studies and social theory, and denouncing it has become the litmus test of academic respectability, political acceptability, and even a necessity for the very right to be heard. In contrast, there has been a noticeable thaw regarding the term essentialism. What was once perfunctorily denounced at the start of every paper in feminist theory has recently been tentatively examined by a few theorists for possible signs of validity.. (shrink)

The western utopia has both classical and Judaeo-Christian roots. From the Greeks came the form of the ideal city, based on reason, from Jews and Christians the idea of deliverance through a messiah and the culmination of history in the millennium. The Greek conception placed utopia in an ideal space, the Christian conception in an ideal time. The modern utopia, dating from Thomas More's Utopia (1516), drew upon both these traditions but added something distinctive of its own. Following More, the (...) modern utopia has developed as a literary form whose closest relative is the novel. This, I argue, is its great strength. Unlike the abstract utopias of social and political philosophy, such as Marxism or anarchism, the `concrete utopia' of writers such as Edward Bellamy, William Morris and H. G. Wells paints `pleasing pictures of daily life' which both impel us to desire the good society and give us the tools by which to assess it. It is in this respect that utopia - and its mirror-image, the anti-utopia - developed as a distinct literary genre, separating it from other forms of picturing the ideal society in both east and west. The case for an eco-emancipatory politics to release the Earth from human domination and free us all from lives that are both exploitative and exploited Human domination of nature shapes every aspect of our lives today, even as it remains virtually invisible to us. Because human beings are a part of nature, the human domination of nature circles back to confine and exploit people as well—and not only the poor and marginalized but also the privileged and affluent, even in the (...) world’s most prosperous societies. Although modern democracy establishes constraints intended to protect people from domination as the arbitrary exercise of power, it offers few such protections for nonhuman parts of nature. The result is that, wherever we fall in human hierarchies, we inevitably find ourselves both complicit in and entrapped by a system that makes sustainable living all but impossible. It confines and exploits not only nature but people too, albeit in different ways. In Eco-Emancipation, Sharon Krause argues that we can find our way to a better, freer life by constraining the use of human power in relation to nature and promoting nature’s well-being alongside our own, thereby releasing the Earth from human domination and freeing us from a way of life that is both exploitative and exploited, complicit and entrapped. Eco-emancipation calls for new, more-than-human political communities that incorporate nonhuman parts of nature through institutions of representation and regimes of rights, combining these new institutional arrangements with political activism, a public ethos of respect for nature, and a culture of eco-responsibility. In times like these, a new ethico-political ideal is required to contest the adequacy of dominant understandings of social interaction as matters of choice and rational decision-making and in contesting these understandings encourage us to imagine social alternatives. We wish to make a contribution to this project of expanding the universe of political discourse as a means to invigorating ethico-political debate. A range of existing vocabularies — the languages of trust (and relatedly respect), care and associated (...) concepts, including corporeal generosity — are currently put forward as the means to contest the dominance of neo-liberal premises about `atomistic individualism'. While many of these accounts focus on nation-states, others attend to an emerging global community. Nevertheless, we have some reservations about these languages and their premises. In our view they tend frequently to locate the `problem' in the character of citizens. We also make the case that such languages and their associated political agendas reinstate aspects of social hierarchy that mimic neo-liberal conceptions of autonomous individualism. Central to our critique is the claim that the problematic aspects of these existing languages of (inter)connection are due to an attenuated understanding of embodiment and an inadequate dialogue between the socio-political and embodiment. It is this inadequate dialogue we wish to redress. In this paper we offer a new ethical ideal called `social flesh' to ground an alternative politics for reconfiguring exploitative social relations. As an ethico-political starting point, `social flesh' highlights human embodied interdependence and in the process configures a new, more transformative political vision. It draws attention to shared embodied reliance, mutual reliance, of people across the globe on social space, infrastructure and resources. Insistence upon this shared reliance underpins a profoundly levelling perspective, a radical politics. (shrink)

Using the work of Robert A. Kagan's intellectual contribution on the intensification of law, leading authorities in the study of the politics of regulation and litigation examine the consequences of the expansion and intensification of law, both in the United States and the rest of the world. Part One considers bureaucratic legalism, a terrain in which popular and political discourse often conceives as a pitched battle between business and government, and in which claims about quantity—"too much" and "too little"—take (...) center stage. Here, the contributors examine the many ways in which regulators and the regulated cooperate, and the extent to which regulated entities internalize norms and practices associated with bureaucratic. Part Two considers adversarial legalism, a term that even among academics is often reduced to "litigiousness." The chapters in this section show that adversarial legalism is a much more complex, contingent, and multi-sided phenomenon than the popular debate over litigiousness suggests. Part III examines Kagan's core concepts in a comparative framework. Although some sometimes treat adversarial legalism as an American disease, scholars are increasingly finding it proliferating elsewhere, and debating whether it can take a prominent role in nations quite different in tradition and political structure from the United States. Across the globe, law and legalism in all its forms, bureaucratic and adversarial, is becoming more intense, and thus more central to politics, public policy and everyday life. The consequences are profound. Yet commentary is often stuck on old questions. Does the intensification of law reflect the withering of other social institutions? Is it a sign of moral decay? Or is it, on another account, signaling a new era of respect for universal human rights? The Politics of Legalism takes us instead in directions relatively unexplored by both scholars and popular commentators on law. Like Kagan's scholarship, it moves beyond stale debates about litigiousness and overregulation, and invites us to think more imaginatively about how the rise of law and legalism will shape politics and social life in the 21st Century. Conversation analysis is now what Kuhn once called a normal science. It has a discernible body of concepts, methods, and recognizable objects of analysis. More importantly, its considerable archive of accumulated findings has a very high degree of redundancy-in the positive sense that researchers have continually replicated the findings of their colleagues. It ought, then, in every respect, to be the envy of the social sciences generally and not easily dismissed as an abstruse and recondite branch of language studies (...) or "discourse analysis" concerned with merely trivial fragments of recorded talk as such. To help CA be respecified in this way, the present paper unearths a relatively unknown part of its history in the partial book manuscript of Harvey Sacks's "Aspects of the Sequential Organization of Conversation," circulated in mimeo to colleagues in 1970. There we find innumerable appeals to the now well-recognized fact that the practical actions of everyday talk have significant, culturewide, formal structures that are the proper objects of the discipline. Or, in Sacks's own terms, seemingly insignificant mundane events are generated by a powerful social "machinery." The purpose of this paper is, then, to extract a sample of these aspects of Sacks's "Aspects" in order to illustrate, sketch, or give a preliminary sense of just that point. (shrink)

Until recently, struggles for justice proceeded against the background of a taken-for-granted frame: the bounded territorial state. With that "Westphalian" picture of political space assumed by default, the scope of justice was rarely subject to open dispute. Today, however, human-rights activists and international feminists join critics of structural adjustment and the World Trade Organization in challenging the view that justice can only be a domestic relation among fellow citizens. Targeting injustices that cut across borders, they are making the scale (...) of justice an object of explicit struggle. Inspired by these efforts, Nancy Fraser asks: What is the proper frame for theorizing justice? Faced with a plurality of competing scales, how do we know which one is truly just? In exploring these questions, Fraser revises her widely discussed theory of redistribution and recognition. She introduces a third, "political" dimension of justice—representation—and elaborates a new, reflexive type of critical theory that foregrounds injustices of "misframing." Engaging with thinkers such as Jürgen Habermas, John Rawls, Michel Foucault, and Hannah Arendt, she envisions a "postwestphalian" mapping of political space that accommodates transnational solidarity, transborder publicity, and democratic frame-setting, as well as emancipatory projects that cross borders. The result is a sustained reflection on who should count with respect to what in a globalizing world. (shrink)

Reinhart Koselleck never gave spatial aspects centre stage in his work, but is nevertheless referred to as a pioneer of the ‘spatial turn’. This article explores this paradox by examining Koselleck's understanding of and approach to spatial aspects, the role they played in his work, and the reception of his work on spatial matters by other scholars. The aim is to achieve a better grasp of Koselleck's work and to clarify in what sense we can label him a pioneer of (...) the ‘spatial turn’. The article presents three arguments: (1) Spatial aspects represent a somewhat marginal and sketchy rather than integral part of Koselleck's thinking, and they stand in the shadow of his much stronger interest in historical time. (2) Koselleck's work nevertheless contains spatial analytical features, which embody, respectively, anthropological and social, geographical and geopolitical, and phenomenological and linguistic dimensions. (3) The reception of the spatial aspects of Koselleck’ work is disparate and unconnected, and those finding inspiration in Koselleck do not regard him as a spatial thinker. These caveats, the article concludes, should be kept in mind in discussions of whether Koselleck ought to be understood as a pioneer of the ‘spatial turn’. (shrink)

Analysis of conservative political participation in local food initiatives tends to be critical and dismissive, positing this participation as self-serving, individualistic, exclusionary, nativist, or reactionary. While there are nefarious aspects to certain forms of conservative local food politics, my research at three farmers’ markets in the Upper Midwest reveals that self-identified conservatives can and do hold more nuanced positions. Those with whom I met recognize the need for both local and broader change, are concerned about marginalized and struggling people, (...) are troubled by the impacts of conventional agriculture on the health of farmers, consumers, and other species, and are humble and willing to listen to other perspectives. Most analyses of food systems miss these nuanced perspectives because they approach American political ideology through a rigid left–right binary. Using more fluid approaches to understanding political ideology can create room for recognizing the complexity and diversity of views pigeon-holed under the label of “conservatism.” Along with these different approaches, a politics of empathy and mutual respect across ideological difference can help reveal common values, concerns, and aspirations for changing the food system. Recognizing these commonalities can help build a broader base of support for food system transformation. (shrink)

Although euthanasia is seen as the problem of the individual will and as one’s right to privacy, to a better quality of life or to a dignified death, it has major institutional implications. They are closely related to the juridical system, to the way of understanding state involvement in protecting the individuals and respecting their freedoms, to the institutional system of health care, to the government rules that establish social, political or professional practices. The public debate around the topics (...) related to the human condition, like euthanasia, grants a special force to public communication, to organizational communication, to communication in professional environments, to physician-patient communication and, more generally, to interpersonal communication. In this text we emphasize the importance of public debate on euthanasia from the perspective of organizational ethics, of medical deontology, of patients’ rights, but especially of elaborating public policies and national programs, and we underline the importance of the need to establish protocols for health care, as well as to build a framework of democratic communication. In this essay, we revisit the concept of “political spirituality” that we developed in our book The Spirit of Revolution: Beyond the Dead Ends of Man (2016) in light of the profound political upheavals that have happened since its publication. We begin with theories about the breakdown of neoliberalism and the “return of politics” with the rise of so-called populist movements. We argue that notions of the “demos” and the “people” miss the dimension of transindividuality central to our (...) thinking of political spirituality. The second aspect of political spirituality missing from current critical theory is transcendence, or the desire to go beyond the limits of who and what we are. We capture both these dimensions through a notion of “relational finitude,” demonstrating both the poverty of European philosophy in this respect, and celebrating the contribution of feminism, decolonial theory, and African philosophy toward a new praxis of being human. The paper examines three aspects of the debate over the introduction of victim impact statements (VIS) in criminal cases. The first is the challenge VIS presents to the wholly public conception of criminal justice, in which the offender is prosecuted, tried and punished in the name of the state and not the individual victim. The second is the claim by supporters of VIS that the enhancement of victim input contributes to repairing an imbalance between offender and victim, created by the (...) crime itself and exacerbated by existing criminal justice processes. The third is the claim that victim impact evidence is necessary to ensure that punishment is properly calibrated to the blameworthiness of the offender. In respect of each question, a key role is played in supporting VIS by two presuppositions: that criminal justice should be thought of as a field of conflict among individuals seeking their due, and that the courts suffer an institutional deficiency of human understanding that requires a special remedy. The paper argues that the case for VIS is seriously weakened if these presuppositions are not accepted, and draws attention to their derivation from a wider political culture characterised by the dominance of neo-liberalism or market individualism. Feminist literature on care has extensively addressed inequalities that cut across the social categories of gender, class and ethnicity in relation to care work. One category that has received less attention in theories of caregiving so far is age. Built on the feminist literature of care and taking young (female) carers as its subject matter, this article tackles age as a third social category of intersectional inequalities along with class and gender. Firstly, through dealing with Nancy Fraser’s justice framework of (...) participatory parity, it is argued that addressing the intersectional inequalities that young (female) carers face necessitates a justice framework that contemplates both the distributional and recognitional aspects of care. In this respect a dual conceptualisation of care is presented – both as a social good and a social process. Secondly, a critical analysis will be presented of the elements of the justice framework of Fraser, where the notion of subordinated status will be related to the identities of young carers. Lastly, the normative framework participatory parity will be discussed in relation to the politics of need, as care practices define the needs of young carers that are contextualised in the care processes, but also in a childhood space. This paper responds to an invitation to historians of political thought to enter the debate on new materialism. It combines Simondon’s philosophy of individuation with some aspects of post-humanist and new materialist thought, without abandoning a more classically ‘historical’ characterization of materialism. Two keywords drawn from Barad and Simondon respectively – ‘ontoepistemology’ and ‘axiontology’ – represent the red thread of a narrative that connects the early modern invention of civil science to Wiener’s cybernetic theory of society. The political (...) stakes common to these forms of mechanical materialism were attacked ontologically, epistemologically and politically by Simondon. His approach, I will argue, opens the path for a genuine materialist critique of the political anthropology implicit in modern political thought, and shifts political thinking from politics conceived as a problem to be solved to politics as an arena of strategic experimentation. By looking at rhetoric and politics, this book offers a novel account of Juan Luis Vives' intellectual oeuvre. It argues that Vives adjusted rhetorical theory to a monarchical context in which direct speech was not a possibility, demonstrated how Erasmian languages of ethical self-government and political peace were actualized rhetorically and critically in a princely environment and, finally, rethought the cognitive and emotional foundations of humanist rhetoric in his late and famous De anima et vita (1538). Ultimately, towards the (...) end of his life, Vives epitomized a distinctively cognitive view of politics; he maintained that political concord was not a direct outcome of institutional or legal reform or of the spiritual transformation of the Christian world (an optimistic Erasmian interpretation), but that concord could only be upheld once the dynamics of emotions that motivated political action were understood and controlled through responsible rhetoric that respected decorum and civility. This article contends that Axel Honneth’s critical social theory provides a compelling general framework with which to map out the political sociology of social equality in a way that takes due account of class-based inequalities, social identity differences, and ecological challenges of contemporary globalized societies. Honneth joins an emphasis on equal respect for all—a core aspect of equality in modern democratic societies—with an account of social esteem recognition—which establishes evaluative distinctions among people—in a way that illuminates the interplay (...) of equality and difference. This is so, I argue, even though Honneth himself has focused on struggles for recognition and social freedom rather than equality, and despite some notable limitations of his political sociology. ABSTRACT Jeffrey Friedman’s Power Without Knowledge builds a critical epistemology of technocracy, rather than a democratic argument against it. For its democratic critics, technocracy is illegitimate because it amounts to the rule of cognitive elites, violating principles of mutual respect and collective self-determination. For its proponents, technocracy’s legitimacy depends on its ability to use reliable knowledge to solve social and economic problems. But Friedman demonstrates that to meet the proponents' “internal,” epistemic standard of legitimacy, technocrats would have to reckon (...) with the heterogeneity of people’s ideas, which he presents as one of two aspects of a political anthropology of ideational beings. The other aspect is ideational determinism: the shaping of our conscious actions by our interpretations, and of our interpretations by “ideational exposures”. For the most part, our symposiasts agree with this anthropology or leave it uncontested, but they fall back on democratic theory to point toward alternatives to technocracy. This raises the question, which Friedman does not ask, of whether his political anthropology undermines a certain brand of democratic theory: the liberal brand that attaches respect to people’s opinions as products of “free reflection,” i.e., as underdetermined. I discuss why one critical aspect of the process of political reconciliation involves the restoration of mutual respect for the rule of law and suggest that psychological research on post-traumatic stress disorder (PTSD) provides valuable resources for understanding how successfully to restore such mutual respect.

Hans Kelsen and Max Weber are conventionally understood as the original proponents of two distinct and opposed processes of concept formation generating two separate and contrasting theoretical frameworks for the study of law. _The Reconstruction of the Juridico-Political: Affinity and Divergence in Hans Kelsen and Max Weber__ _contests the conventional understanding of the theoretical relationship between Kelsen’s legal positivism and Weber’s sociology of law. Utilising the conceptual frame of the juridico-political, the contributors to this interdisciplinary volume analyse central (...) points of affinity and divergence in the work of these two influential figures. Thus, the chapters collected in _The Reconstruction of the Juridico-Political _offer a comprehensive reconsideration of these affinities and divergences, through a comparison of their respective reconstruction of the notions of democracy, the State, legal rights and the character of law. From this reconsideration a more complex understanding of their theoretical relationship emerges combined with a renewed emphasis upon the continued contemporary relevance of the work of Kelsen and Weber. This paper offers a systematic analysis of Hobbes’s practical political thought. Hobbes’s abstract philosophy is rightly celebrated, but he also gave much practical advice on how to avoid disorder. Yet he is typically interpreted too narrowly in this respect, especially by those who only read him economistically. Other scholars supplement this economistic focus with sociological or political interpretations, but to my knowledge, no one stresses all three aspects of his thought. This paper thus examines each of Hobbes’s (...) practical proposals for avoiding corruption and a state of nature. Hobbes clearly uses economistic, sociological and political approaches, which involve shaping incentives, desires/preferences, and opportunities, respectively. This intentionally anachronistic framework helps us see further, highlighting Hobbes’s rich and wide-ranging practical proposals for avoiding disorder – a crucial part of his theory. (shrink)

Making public policy choices based on available scientific evidence is an ideal condition for any policy making. However, the mechanisms governing these scenarios are complex, non-linear, and, alongside the medical-health and epidemiological issues, involve socio-economic, political, communicative, informational, ethical and epistemological aspects. In this article we analyze the role of scientific evidence when implementing political decisions that strictly depend on it, as in the case of the COVID-19 pandemic. In carrying out this analysis, we will focus above all (...) on the Italian case. This, on the one hand, precisely because Italy led the way regarding the containment policies of the pandemic. Secondly, the government's action was immediately criticized in various respects. Some were calling into question not only the cumbersome political mechanisms, but also suggesting a scarce ability to take scientific evidence into account. On other fronts, there are those who have criticized Italy for its blind and uncritical faith in science and for the paternalism of its decisions. This debate therefore offers the possibility of dealing with some aspects concerning scientific results and their implementation at the political level from the point of view of a political philosophy of science, roughly in the spirit suggested by John Dupré. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of (...) political coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

This paper argues that climate migration-in case of climate refugees in a strict sense-differs from other forms of migration not only by its finality but also by the fact that entire communities are forced to resettle elsewhere. For such communities to migrate with dignity-that is in a way that protects the social bases of their self-respect-their host countries are required to ensure the necessary institutional arrangements enabling these people to become full and equal members within a reasonably short time. Ensuring that their equal participation rights are not merely formal but have ‘fair value’ requires taking cultural differences into account to ensure that they do not pose substantial disadvantages for participation in the political and social sphere. Focusing on the shared sense of victimization and disadvantage-ness by both patients and doctors/medical workers in cases of medical conflicts, this paper aims to examine the current patient-doctor tensions in the larger context of moral transformation in Chinese society since the 1980s. Although the decline of public trust in certain aspects is closely associated with the impact of commodification and commercialization of medical sector during the past two decades, other factors play important role as well. In the case of patient-doctor (...) tension, mutual disrespect and mistrust also result from the ongoing process of individualization and the remaking of moral self, in which the individual demand for respect, dignity, and trust seem to have unexpectedly and ironically contributed to the rise of tensions and conflicts between patients and doctors as well as other medical workers. This paper aims to show that modeling complex systems inevitably involves non-propositional knowledge and thus the uncertainties associated with the corresponding model predictions cannot be fully quantified. This is exemplified by means of the climate system and climate modeling. The climate system is considered as a paradigm for a complex system, whereby the notion of complexity adopted in this paper is epistemic in nature and does not equate with the technical definition of a complex system as for example used within (...) physics or complexity theory. The epistemic notion of complexity allows to view the climate system as complex with respect to some features, while simple with respect to others. This distinction is of practical significance for political decision making as it allows to treat some climate predictions as (fairly) certain, while acknowledging high uncertainties with others. This volume was initially conceived as a thematic issue of the Sfera Politicii journal and some of its chapters (written by Gabriela Tănăsescu, Henrieta A. Şerban, Lorena Stuparu and Cristian-Ion Popa) were published as such in the 9 (163), September 2011 issue under the title „Theory and Political Ideology”. To enlarge the discussion on the theme, new papers have been added to the previous ones for inclusion in this book. By choosing to title it „Political theories versus ideologies?” (...) we wanted to suggest from the beginning the difficulty of a consensus on such a disputable topic. As it has multiple facets, there are several possible ways to deal with it. Each contribution in this collection is an attempt to clarify a different aspect of the issue. So, a category of texts seeks to explore the nature of political theory, the value neutrality thesis concerning the social sciences, and the distinctions between theory and ideology. One of them is devoted to a trans-theoretical analysis of the naturalist and the interpretivist models of political theory; another one, by scrutinizing the original meaning of „philosophy”, aims at showing that, when philosophy neglects the ancient harmony between philo and sophia, by focusing only on the last one, it runs the risk of failing into ideology; the first efforts of some modern thinkers, (fascinating by mathesis universalis) to apply mathematics to politics, or Michael Oakeshott ‘s concept of ideology are also dealt with in other texts. By broadening the discussion on the neutrality thesis, one of the articles brings to light the philosophical prejudices underlying both „the constitutional” and „the welfare” models, i.e., a „rule ethics” and, respectively, a utilitarian one. Several papers investigate the status of the theories of international relations. Some of them address the peculiar question whether the so called theories of European integration satisfy the criteria of what political scientists mean by an empirical study of phenomena. To put it differently: Can we refer to such theories as a scientifically approaching to the unification European process, i.e., as being able to explaining and making predictions? A subsidiary question would be: are they ideologically neutral? The problem is explicitly put in another article, whose author, by suspecting such theories’ claim to neutrality, is asking if it is possible not a scientific approach to the European integration, but a normative one, namely, a philosophy of European unification „without ideology”. Some articles, pointing out the weakness and vulnerabilities of the traditional theories of international relations when confronted with new political realities, endorse a constructivist interpretation that is likely to offer a better account for actions such as humanitarian interventions. In a similar line of thinking, constructivism is seen by another contributor as a perspective in terms of which some traditional political concepts should be revised. An example is „the national interest”, a concept that can be explained in all its aspects neither by the realist nor by liberal theories. Subjects such as „the end of ideology”, or the ideological left-wing deviations of today liberalism for electoral reasons, or that of a likely „international solidarity” ideology are discussed in this volume too. If it is to draw a conclusion from most contributions, we would say that, irrespective of its versions, normative, or empirical (scientific), or analytical, political theory conceived of itself as being not only different from, but also opposed to ideology. And it still pretends to be so. Lots of the facets of the topic have remained, obviously, unexplored. Among them, the contemporary efforts to reconcile the normative and the empirical dimensions of political theory would have been worth of addressing – maybe, in a future enterprise. Engaging in the difficult endeavor of assembling and integrating individual texts into a coherent account, we hope to be successful in stimulating further debate on the theme, a debate in which the present volume is only a modest contribution. Decency remains one of the most prevalent yet least understood terms in today's political discourse. In evoking respect, kindness, courage, integrity, reason, and tolerance, it has long expressed an unquestioned duty and belief in promoting and protecting the dignity of all persons. Today this unquestioned belief is in crisis. Tribalism and identity politics have both hindered and threatened its moral stability and efficacy. Still, many continue to undertheorize its political character by isolating it from the effects of (...) identity politics. Decency and Difference argues that decency is a primary source of the political tension that has long shaped the struggles for power, identity, and justice in the global arena. It distinguishes among basic, conservative, and liberal strands of decency to critically examine the many conflicting and competing applications of decency in global politics. Together these different stands reflect a long and uneven evolution from the British and American Empire to a global network of justice. By engaging the contradictions of the progressive and retrogressive qualities of decency and the role played by emotion and affect in driving these contradictions, the book exposes the propriety gaps of decency and the disparate ways that it is practiced in global politics. The book thus addresses the global challenge of reconciling different political proprieties and configuring a diverse political ethic of decency. (shrink)

This article focuses on the account of disrespect found in Honneth’s theory of recognition. In it, I am particularly interested in the form of misrecognition or disrespect which is the negation of respect , and which is clearly represented by statelessness. Respect, for Honneth, is closely connected to legal recognition. Guided by Honneth’s view of critical theory as ‘not entirely without a foundation in social reality’, the article puts together an analysis of the political dynamics of his (...) model of disrespect. This analysis is used to challenge certain aspects of Honneth’s political theory and in particular the implications of his conception of the state. The article argues that the way in which the state is used has the effect of obscuring significant political obstacles to recognition, and in particular, the way in which the state limits respect. This essay examines prominent New Confucian Mou Zongsan’s account of Confucian democracy by focusing on his key notion of “self-restriction.” According to Mou, true sage-kings would willingly respect ordinary people’s individual endeavors in the political realm and endorse democracy as a form of government. This move of self-restriction then aligns Confucianism with democracy in a way that fundamentally restructures traditional Confucian rulership. I make contributions on two fronts. First, I offer a reading of Mou’s self-restriction different from existing (...) ones that can help to disambiguate many aspects of Mou’s political thought. Second, what is often left out of existing discussion on Mou is the narrative of political myth and distinctive personality types associated with it. For Mou, political leadership’s impetus for transcending rule-based order and the people’s aspirations for the “superman” run deep and lie in the lasting appeal of political myth. Invoking Nietzsche, I discuss the sense in which transforming traditional rulership is not only a question of ought—why Confucians ought to adopt self-restriction—but a question of how it is possible for self-restriction to fulfill its mission. Commentators on his thought have so far largely glossed over this second aspect of Mou’s thought, thereby selling short the complexity of the idea of self-restriction. My key argument is that Mou’s self-restriction shows an effort to revamp the superman’s politics of the extraordinary into a politics of the ordinary. (shrink)

This article presents a new perspective on the intersection of technology, biology, and politics in modern Germany by examining the history of biotechnics, a nonanthropocentric concept of technology that was developed in German-speaking Europe from the 1870s to the 1930s. Biotechnics challenged the traditional view of technology as exclusively a human creation, arguing that nature itself could also be a source of technical innovations. Our study focuses on the contributions of Ernst Kapp, Raoul Heinrich Francé, and Alf Giessler, highlighting the (...) gradual shift in political perspectives that influenced the merging of nature and technology in their respective visions of biotechnics. From Kapp’s liberal radicalism to Francé’s social organicism and ultimately to Giessler’s totalitarian fascism, their writings increasingly vitalized technology by portraying it as a natural force independent from human influence. The history of biotechnics sheds light on previously unexplored aspects of debates surrounding the sciences and philosophy of technology in Germany, while also foreshadowing contemporary discussions on technocultural hybridity. As a genealogy of the idea of nonhuman technology, the article raises perturbing questions about the political implications of conflating nature and culture. (shrink)

Among anti-war activists there has been much discontent with respect to the conduct of the defense. Many had expected a far-reaching indictment of the government for its criminal behavior in Vietnam. Those who had been hoping for a "confrontation with illegal and immoral authority" are naturally disappointed, since no such confrontation took place. In fact, the defendants themselves did make strong statements about the illegality and barbarism of the American war in Vietnam. With the exception of Michael Ferber, a (...) resister himself, the defendants took their stand, without qualifications, on the "Call to Resist Illegitimate Authority", which announced the intention of the signers to support resistance to the Vietnam war, and which insisted that actions taken in support of resistance "are as legal as is the war resistance of the young men themselves." However, this aspect of the trial was barely reported in the press. Within the framework defined by the government, adopted by the Court, and accepted by the press, the issue of the legality of the war was not pertinent, nor was the question of the right, or even the duty, of resistance to American aggression. There is an emergency to inform people about the biotechnological revolution and its multidirectional consequences in every day's life. Bioethical issues should be methodically analysed, since the definition of the term depends upon the educational background and the speciality of each scientist involved.An increasing international awareness is gradually expressed by the various bodies, (political authorities, educational Institutions etc), materialized through a series of declarations and legislative regulations or by establishing various assemblies responsible for bioethical issues. However the economic dimension (...) interfering in the field causes a strong pressure for acceleration of the relevant research and its applications. Thus, the role of the assemblies is deteriorated mainly to consultative recommendations hardly efficient for the acceptance of protective for the consumers countermeasures. The mean citizen is unprotected against the consequences concerning him and his environment. Therefore there is a demand for stregthening the educational initiatives addresed either to the students of particular disciplines or to the wide public which will hopefully increase the level of the respective knowledge.
