The paper offers an account of the structure of information provided by models that relevantly deviate from reality. It is argued that accounts of scientific modeling according to which a model’s epistemic and pragmatic relevance stems from the alleged fact that models give access to possibilities fail. First, it seems that there are models that do not give access to possibilities, for what they describe is impossible. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this distinction is (...) not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

The essay opens with some background information about the period in which J.S. Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as ‘blasphemous’ amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section 2 presents the (...) Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section 3 analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. Background Most jurisdictions that allow euthanasia and assisted suicide (AS) regulate it through the medical profession. However, the extent and nature of how medicine should be involved are debated. Swiss AS practice is unusual in that it is managed by lay AS organizations that rely on a law that permits AS when done for nonselfish reasons. Physicians are not mentioned in the law but are usually called upon to prescribe the lethal medications and perform capacity evaluations.Methods We analyzed in-depth interviews (...) of 23 Swiss AS experts including ethicists, lawyers, medical practitioners, and senior officials of AS organizations for their views on AS.Results Although there was agreement on some issues (e.g., need for better end-of-life care), the interviewees’ preferred model for AS, and the nature of preferred medical involvement, varied, which we categorized into five types: preference for AS practice as it occurred prior to lay AS organizations; preference for the current lay model; preference for a modified lay model to increase autonomy protections while limiting medical AS normalization; preference for various types of more medicalized models of AS; and, ambivalence about any specific model of medical involvement. The rationales given for each type of model reflected varying opinions on how medicine’s role would likely impact AS practice and demonstrated the experts’ attitudes toward those impacts.Conclusion The dynamics within the Swiss AS regime, as reflected in the varying views of Swiss AS experts, shed light on the dilemmas inherent to medical scope and involvement in AS, which may have implications for debates in other jurisdictions. The present paper argues that there is a structural difference between classical cases involving knowledge-undermining environmental luck, and cases where a subject acquires understanding in the presence of environmental luck. This difference appears to bear on arguments against the reductionist thesis that understanding is a special form of knowledge.

In recent years there has been an increase in the number of requests formercy killings by patients and their relatives. Under certain conditions,the patient may prefer death to a life devoid of quality. In contrast to thosewho uphold this quality of life approach, those who hold the sanctity oflife approach claim that life has intrinsic value and must be preservedregardless of its quality. This essay describes these two approaches,examines their flaws, and offers a golden path between the two extremepositions.We discuss (...) the halachic and the secular views, arguing for a balancebetween the sanctity of life and the quality of life. We argue that, indeed,such a balance exists in practice, and that life is important, but it is not sacred. Life can be evaluated, but quality of life is not the solecriterion. (shrink)

Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The Dutch experience has influenced the debate on euthanasia and death with dignity around the globe, especially with regard to whether physician-assisted suicide and euthanasia should be legitimized or legalized. Review of the literature reveals complex and often contradictory views about the Dutch experience. Some claim that the Netherlands offers a model for the world to follow; others believe that the Netherlands represents danger, rather than promise, and that the Dutch experience is the definitive answer regarding why we should not (...) make active euthanasia and physician-assisted suicide part of our lives.Having investigated the Dutch experience for a number of years, in the summer of 1999 I went to the Netherlands to visit the major centers of medical ethics as well as some research hospitals, and to speak with leading figures in euthanasia policy and practice. This essay commences by providing some background information on the practice of euthanasia and on the legal framework, and then reports the main answers to my first question: Why the Netherlands? To find adequate answers to a changing reality heavily influenced by advances in technology, medical professionals have developed and adopted an array of terms that have brought new concepts into the profession. “Dignity,” “vegetative state,” “futility,” “double effect,” and “brain death” have become indispensable words in the medical setting. In the following discussion, the attention is on terminology. If we believe in phenomenology, the assumption is that we should closely reflect on the words we use in all spheres of life, (...) especially in those that concern life and death. This article calls for a sincere discussion about these terms and concepts. The thesis put forward is that the language in the medical setting serves primarily the physicians, at times at the expense of the patients’ best interests. This language and the concepts it describes have generated an unhealthy atmosphere for patients, which might lead to undesirable actions at the end of patients’ lives. (shrink)

It is common to note that social environment and cultural formation shape mental disorders. The details of this claim are, however, not well understood. The paper takes a look at the claim that culture has an impact on psychiatry from the perspective of metaphysics and the philosophy of science. Its aim is to offer, in a general fashion, partial explications of some significant versions of the thesis that culture and social environment shape mental disorders and to highlight some of the (...) consequences social constructionism about psychiatry has for psychiatric explanation. In particular, it will be argued that the alleged dependence of facts about particular mental disorders and about the second order property of being a mental disorder on social facts amounts to a robust form of constructivism, whereas the view that clinician–patient interaction is influenced by cultural facts is perfectly compatible with an anti-constructivist stance. The article deals with the Dawson College Massacre, focusing on the story of Kimveer Gill, a 25-year-old man from Laval, Montreal who wished to murder young students in Dawson College. It is argued that the international community should continue working together to devise rules for monitoring specific Internet sites, as human lives are at stake. Preemptive measures could prevent the translation of murderous thoughts into murderous actions. Designated monitoring mechanisms of certain websites that promote violence and seek legitimacy as well (...) as adherents to the actualization of murderous thoughts and hateful messages have a potential of preventing such unfortunate events. Our intention is to draw the attention of the multifaceted international community to the shared interest and need in developing monitoring schemes for certain websites, in order to prevent hideous crimes. In this paper, a cognate of the problem of divine foreknowledge is introduced: the problem of the prophet’s foreknowledge. The latter cannot be solved referring to Ockhamism—the doctrine that divine foreknowledge could, at least in principle, be compatible with human freedom because God’s beliefs about future actions are merely soft facts, rather than hard facts about the past. Under the assumption that if Ockhamism can solve the problem of divine foreknowledge then it should also yield a solution to the problem (...) of the prophet’s foreknowledge, it is concluded that Ockhamism fails. In this article I analyze some of the troubling issues in Canadian media ethics, based on in-depth interviews with more than 50 experts on Canadian media. I begin by reflecting on the cultural considerations involved in the Canadian media's proximity to the United States. Subsequently, I discuss the problems of excessive ownership of the media by a few organizations, arguing that the right to exercise free expression does not include the right to own as many media organizations as money can (...) buy. In this context are considered the work of two Royal Commissions: the 1970 Davey Commission and the 1980 Kent Commission. Finally, I am concerned with excessive intrusion of individual privacy. When news becomes entertainment and private stories become public spectacle, individual lives can be mercilessly exposed to the glaring spotlight of unwanted publicity. In delineating the boundaries of intrusion, there is a need to distinguish between public figures and ordinary citizens, and between those who choose to live in the spotlight and ordinary citizens who stumble into the public eye. Among philosophers of mind, it is common to assume that at least some mental properties are functional in nature, and that functional properties are second-order properties. In the functionalist literature, the notion of being a second-order property is cashed out in three different ways: (i) in terms of semantic features of characterizations or definitions of properties, (ii) in terms of syntactic features of second-order quantification, and (iii) in terms of a metaphysical criterion, according to which properties are second order if (...) they are properties of first-order properties. It is shown that in the context of functionalism reference to these interpretations is misguided, and it is suggested that the notion of an ordering of properties in this context is best understood as being tied to dependence-relations. In this paper I argue that an important notion of reduction depends on a four-place relation holding between expressions, concepts, properties, and events or states of affairs. I define this notion and argue against alternative accounts that are based on syntactic features of theories. Whilst these latter attempts fail to deliver a satisfactory explanation of why a certain theory or a certain expression reduces to another, the former can give a complete explanation of why, say, ‛human pain’ reduces to ‛C-fiber (...) stimulation’ or why the mind reduces to the physical. I briefly sketch the difference between the semantic approach that I favor, which is based on a particular notion of hyper-intensions, and classical model-theoretic versions of reduction. (shrink)

La présente étude entend tracer et analyser le déploiement de « la Vérité de l’Etre » afin de montrer en quoi celui-ci est indissociable, pour Heidegger, de ce qu’il appelle, dans un passage tardif des Cahiers Noirs, l’« auto-annihilation ( Selbstvernichtung ) » du judaïsme. Nous montrerons en quoi et pourquoi, chez Heidegger, l’« Histoire » de la « Vérité de l’Etre », en se déployant elle-même, produit aussi un antijudaïsme, indissociable d’un antisémitisme, sans précédent dans l’histoire de la philosophie (...) occidentale. En effet, le judaïsme, pour Heidegger, se voit brutalement exproprié de toute possibilité d’être, et, par conséquent, demeure résolument forclos de l’« Histoire » gréco-allemande de la « Vérité de l’Etre » pour ne séjourner que dans l’« inessentielle » machination et exploitation « indéterminée » du monde. Il nous appartiendra de souligner, depuis le « dispositif » heideggérien de la « Vérité de l’Etre » – un dispositif, contrairement à ce qu’en dit Heidegger, dès plus technique – en quoi le judaïsme se voit condamné à son « auto-annihilation ». C’est ainsi que l’antijudaïsme de Heidegger, inséparable d’un antisémitisme catégorique, est à comprendre depuis sa pensée philosophique elle-même. Ce qui exige de nous une relecture dès plus vigilante, dès plus intransigeante et un questionnement critique circonstancié de cette œuvre et du rapport qu’elle détermine entre l’« Histoire » de la « Vérité de l’Etre » et l’« auto-annihilation » du judaïsme. Ainsi, à aucun moment ne s’agira-t-il, pour nous, de rejeter purement et simplement la pensée philosophique de Heidegger. Car, c’est aussi par une relecture critique de cette même pensée, par une confrontation incessante envers ce qui s’y cache dans ses plis les plus obscurs et douteux, que peuvent aussi se révéler d’inédites possibilités de repenser notre tradition philosophique tout entière en l’ouvrant vers une tout autre histoire de la philosophie – tout autre que celle qui se sera consacrée et déterminée dans et par le « dispositif » heideggérien. The aims of this essay are (A) to examine the extent to which Marx, Engels and Lenin believed in revolution by peaceful means and what was their attitude towards the phenomenon of war, and (B) to reflect on the different interpretations of their writings, discerning between three schools of thought. It is argued that Marx and Engels considered violence only as an instrument of secondary importance and desirable insofar as there is no other alternative to change the system. It is (...) further contended that while they, in the course of years, adopted a more moderate position regarding the use of violence, Lenin's viewpoint radicalized as the possibility of a revolution in Russia became real. As years went by Lenin affirmed not only the use of violence but also the resort to terrorist activities. Unlike Marx and Engels he became an ardent supporter of all types of terror. (shrink)

John Stuart Mill's concept of ethics was closely related to his firm belief in freedom. He was strictly a believer in each person bringing the greatest degree of happiness or good to the greatest number. This would be an individual act and in no way a forced action. One is free to act without coercion as long as no harm is brought to another person. Consequences must be considered carefully before acting and the act chosen must be the best of (...) possible choices designed to bring about the most good. Mill is definitely a prime example of teleological ethics - an ethics of considering consequences, one which is notably different from Kant 's concept of following a priori maxims or principles, regardless of consequences. This discussion is about the neglected concepts of trust and social responsibility on the Internet. I will discuss and explain the concepts and their implications to people and society. I then address the issue of moral and social responsibilities of ISPs and web-hosting companies. I argue that ISPs and web-hosting companies should aspire to take responsibility for content and that they should respect and abide by their own terms of conduct.

Early in 2008 I published Hate in the Classroom: Free Expression, Holocaust Denial, and Liberal Education. A rejoinder was published, and this is my reply to the rejoinder. It is about education and the role of the teacher in the classroom. I argue that teachers should keep their hateful views to themselves and not pronounce them publicly if they wish to serve as educators. Students should not be subjected to teachers who are unable to appreciate difference and pluralism, who interpret (...) liberty as a tool for hate, who abhor violence, and who exemplify the opposite of humanistic education. One cannot be a hate monger and an educator. When one opts to be the former, one should stay out of the classroom. (shrink)

This paper examines two models of thinking relating to the issue of the right to die in dignity: one takes into consideration the rights and interests of the individual; the other supposes that human life is inherently valuable. I contend that preference should be given to the first model, and further assert that the second model may be justified in moral terms only as long as it does not resort to paternalism. The view that holds that certain patients are not (...) able to comprehend their own interests in a fully rational manner, and therefore ‘we’ know what is good for these patients better than ‘they’ do, is morally unjustifiable. I proceed by refuting the ‘quality of life’ argument, asserting that each person is entitled to decide for herself when it is worth living and when it is not. In this connection, a caveat will be made regarding the role of the family. (shrink)

This is an extensive critical review of Euthanasia in International and Comparative Perspective. My Review is divided into five parts. First, I outline the book's strengths. I proceed by speaking of the need for clear and cohesive terminology. I then discuss end-of-life decision-making in some of the countries: Belgium, The Netherlands, and the State of Oregon in the United States, all allow PAS. Belgium and The Netherlands also allow euthanasia. I also discuss Israel's Dying Patient Law,13 enacted by the Knesset (...) on December 5, 2005. Finally, I make some suggestions for improvement, including a detailed proposal for PAS which I conceive to be the best policy when balancing one against the other the autonomy of the patient, on the one hand, and the safeguards against abuse when life might be considered too lightly, on the other. Indeed, the main difference between euthanasia and PAS is that in euthanasia, it is the physician who makes the final act of taking patient's life, whereas in PAS it is the patient who takes his or her life. In euthanasia, the physician has control over the process. In PAS, the physician controls the procedure up until the last act. The patient has control over the very act of suicide. (shrink)
