“Splendid is the name of peace.” So begins the conciliar decree issued by five Aquitanian bishops meeting in synod at Poitiers sometime around, and quite probably in, the year 1000. The phrase had particular meaning and authority for tenth-century Aquitanian bishops, since it was borrowed from a letter by Hilary, the famed fourth-century bishop of Poitiers. The bishops went on to assert that they were meeting “for the restoration of peace and justice” in condemning, among other offenses, attacks on ecclesiastical (...) property. They cited as precedent both a council held five years earlier and one held at the abbey of Charroux. The bishops of the very same sees as those represented at Poitiers had indeed gathered in June of 989 at Charroux. They had claimed to have assembled so that “the criminal actions that, because of our long delay in calling a council, have been sprouting through evil habit in our dioceses will be rooted up and more constructive behavior implanted.” They had then threatened with anathema anyone who engaged in three very specific activities: taking ecclesiastical property by force; plundering agricultural resources from peasants; and attacking unarmed clerics. In a pioneering study Georges Duby showed how the system of justice that had prevailed in the Carolingian era ceased to function in the Mâconnais of the tenth century. His observations about the breakdown of public institutions opened up a new field of research, for they suggested the development in the tenth century of a unique set of judicial institutions and practices, different in kind from the traditional public order of the Roman and Roman-influenced Carolingian worlds. This is a bibliography of books and articles on consciousness in philosophy, cognitive science, and neuroscience over the last 30 years. There are three main sections, devoted to monographs, edited collections of papers, and articles. The first two of these sections are each divided into three subsections containing books in each of the main areas of research. The third section is divided into 12 subsections, with 10 subject headings for philosophical articles along with two additional subsections for articles in cognitive (...) science and neuroscience. Of course the division is somewhat arbitrary, but I hope that it makes the bibliography easier to use. This bibliography has first been compiled by Thomas Metzinger and David Chalmers to appear in print in two philosophical anthologies on conscious experience . From 1995 onwards it has been continuously updated by Thomas Metzinger, and now is freely available as a PDF-, RTF-, or HTML-file. This bibliography mainly attempts to cover the Anglo-Saxon and German debates, in a non-annotated, fully formatted way that makes it easy to "cut and paste" from the original file. The New Demon World Objection claims that reliabilist accounts of justification are mistaken because there are justified empirical beliefs at demon worlds—worlds at which the subjects are systematically deceived by a Cartesian demon. In this paper, I defend strongly verific (but not necessarily reliabilist) accounts of justification by claiming that there are two ways to construct a theory of justification: by analyzing our ordinary concept of justification or by taking justification to be a theoretic term defined by its role in (...) the theory of knowledge. The former route is not promising because of the splintered nature of our ordinary concept of justification—or perhaps because there is no single such concept. On the other hand, if justification is defined by the role it plays in the theory of knowledge, then there is good reason to think that justification must be strongly truth-conductive since the term was introduced by Edmund Gettier to play the primary role in converting true belief into knowledge. And if that is right, then there will be no justified empirical belief at demon worlds. The real lesson of the demon world is then turned on its head: justification does not supervene on what one shares with one’s deceived doppelganger. (shrink)

What are virtue and vice, and how do they relate to other moral properties such as goodness and rightness? This book defends a perfectionist account of virtue and vice that gives distinctive answers to these questions. The account treats the virtues as higher‐level intrinsic goods, ones that involve morally appropriate attitudes to other, independent goods and evils. Virtue by itself makes a person's life better, but in a way that depends on the goodness of other things. This account was accepted (...) by many early twentieth‐ century consequentialists, including Franz Brentano, G. E. Moore, Hastings Rashdall, and W. D. Ross. The book elaborates it further than has been done before, describing its mathematical structure, connecting it to individual virtues and vices, and applying it to specific issues such as the morality of fantasy and the proper roles of private charity and the welfare state. Much recent work on explanation in the interventionist tradition emphasizes the explanatory value of stable causal generalizations—i.e., causal generalizations that remain true in a wide range of background circumstances. We argue that two separate explanatory virtues are lumped together under the heading of `stability’. We call these two virtues breadth and guidance respectively. In our view, these two virtues are importantly distinct, but this fact is neglected or at least under-appreciated in the literature on stability. We argue that an adequate (...) theory of explanatory goodness should recognize breadth and guidance as distinct virtues, as breadth and guidance track different ideals of explanation, satisfy different cognitive and pragmatic ends, and play different theoretical roles in helping us understand the explanatory value of mechanisms. Thus keeping track of the distinction between these two forms of stability yields a more accurate and perspicuous picture of the role that stability considerations play in explanation. (shrink)

This chapter talks about a picture of Crockett Johnson's book, Harold and the Purple Crayon, where Harold, a young toddler, standing with his body facing to our left but with his head turned slightly to the right. When we see Harold making a drawing with his purple crayon in an illustration by Crocker Johnson, we are witnessing the workings of Harold's imagination. Because of the peculiar metaphysics of his world, objects solve his problems when they morph from drawings into (...) real things. Harold and the Purple Crayon is a testament to the power of children's imaginations, their ability to give reality to things we adults can only dream about. The book gives us an introduction to the metaphysical distinction between real and merely imaginary things, and even criticizes one attempt to develop an account of that distinction. (shrink)

Epistemic accounts of scientific collaboration usually assume that, one way or another, two heads really are more than twice better than one. We show that this hypothesis is unduly strong. We present a deliberately crude model with unfavorable hypotheses. We show that, even then, when the priority rule is applied, large differences in successfulness can emerge from small differences in efficiency, with sometimes increasing marginal returns. We emphasize that success is sensitive to the structure of competing communities. Our results suggest (...) that purely epistemic explanations of the efficiency of collaborations are less plausible but have much more powerful socioepistemic versions. (shrink)

During the past ten years Integrative Social Contracts Theory (ISCT) has become part of the repertoire of specialized decision-oriented theories in the business ethics literature. The intention here is to (1)␣provide a brief overview of the structure and strengths of ISCT; (2) identify recurring themes in the extensive commentary on the theory including brief mention of how ISCT has been applied outside the business ethics literature; (3) describe where research appears to be headed; and (4) specify challenges faced by those (...) who seek to reform ISCT. Key themes in the critiquing literature relate to (a) the identification process for hypernorms; (b) justification of the recognition of hypernorms; (c) proposals for considering meso or meta norms; (d)␣clarification of the relationship between stakeholder concepts and ISCT; (e) problems with potentially unoccupied moral free space; (f) sources of ethical obligation within the ISCT framework; and (g) the potential role for concepts of stakeholder dialogue and engagement. For obvious reasons, however, it has had little effect on the interpretation of Wittgenstein's contemporaries. Do the terms “logical positivism” and “logical empiricism” mark a philosophically real and significant distinction? There is, of course, no doubt that the first term designates the group of philosophers known as the Vienna Circle, headed by Moritz Schlick and including Rudolf Carnap, Herbert Feigl, Philipp Frank, Hans Hahn, Otto Neurath, Friedrich Waismann and others. This paper uses the bankruptcy proceedings for Enron to discuss the role of financial institutions in business transactions. Using recent work by Dixit a business transaction is portrayed as a prisoners' dilemma problem between competing firms. The financial institution's role in this world is to provide information and enforce contracts so that the parties to the business deal act cooperatively. This role is recognized in the law under the heading of Fiduciary Responsibility. In the Enron case the bankruptcy examiner has (...) argued that the Tier 1 financial institutions for Enron failed to carry out their fiduciary responsibility. In this survey article we will first discuss what different philosophical projects are carried out under the headings of "logic" and "ontology" and then we will look at several areas where logic and ontology overlap.

According to conventional wisdom, Antonio Gramsci is a political philosopher lacking in, and who avoids, a serious interest in political economy. That is a serious misrepresentation of Gramsci’s works and thought. Equally wrong is the widespread view that anything Gramsci had to say about political economy is to be found in his scattered notes on ‘Americanism and Fordism’. On the contrary, a careful rereading of Gramsci’s Prison Notebooks shows that Marx’s great and unfinished project of the critique of political economy (...) plays a crucial rôle for Gramsci’s efforts to come to grips with the basics of a critical social science that could live up to the aspirations of a ‘scientific socialism’. As Gramsci was fully aware of the everyday battles of ideas in capitalist societies to be fought about the notions and tenets of popular or vulgar political economy, he did the best he could in order to understand and clarify the bases of a ‘critical’ and ‘scientific’ political economy. A political economy that was and still is urgently needed in order to fight the strongest of the strongholds of bourgeois hegemony - the ideas of vulgar economics in everybody’s heads. (shrink)

In the first part of my studies on Sulpicius Victor’s „Institutiones oratoriae“ I discuss its date and medieval transmission. Among other things I propose possible new evidence for its reception in 12th-century Western Germany. Finally I try to show that probably all of the transmitted chapter headings are later additions.

A critical analysis of theories of commercial impossibility and frustration of purpose is best undertaken in conjunction with a theoretical analysis of contract in general. Contracts function as a means of transferring social benefit, which can be subcategorised into subjective and objective benefit. Contracts also regulate the transfer or risk, which is inherent in property and hence any contractual relationship. In the light of the transfer of subjective and objective benefit and risk, contracts can be shown to be by definition (...) ex ante Pareto superior for both parties. Frustration of purpose or commercial impossibility is pleaded where the ex post overall benefit differs greatly from the ex ante expected value. This difference results from the manifestation of a risk which one party bears under the terms of the original contractual risk/benefit equilibrium. Considering the various subjective and objective risks and benefits involved in the contract, it is possible to classify frustrating eventualities under eight heads. In at least six cases the importance of the principle of security of exchange clearly precludes the operation of frustration. One of the remaining cases corresponds with the controversial Krell v Henry; there appears to be a temptation to regard frustration as the most socially utilitarian solution. Given however the dynamics of contractual risk and benefit, allowing frustration there would be unworkable because it would entail placing a subjective risk burden on the party which is in a worse position to evaluate it. There should be no place in the law for a doctrine of frustration of contract on the grounds of commercial impossibility orchanged circumstances. (shrink)

This is the introductory installment in a projected series of articles in which I shall be advancing the positive case for the "intrinsic" kind of explanatory account of "consciousness4." "Consciousness4" has reference to a property of individual mental-occurrence instances wherein there takes place an immediate awareness of them either upon their occurrence or as part of their very occurrence. The immediacy or directness of such inner awareness amounts to the absence of mental mediation by any other occurrent awareness. An account (...) of consciousness4 that properly comes under the heading of "intrinsic theory" is distinguished by the thesis that a mental-occurrence instance’s being conscious4 is an intrinsic property, rather than an external-relational property of that mental-occurrence instance. My hope for the present series of articles is that, by the end, the case for intrinsic theory will he so evidently strong, or at least so vivid, that all psychologists of consciousness will have to address intrinsic theory and its explanandum of consciousness4. In this article, I set the stage by rendering some of the relevant meanings explicit, spelling out my purpose and approach to making the case for intrinsic theory, providing some context for the discussions to follow, and mentioning important objections to intrinsic theory that have been voiced in the literature. I was therefore not shocked at first when my telephone rang at four o’clock in the morning, but I soon understood the severity of the tragic news. The next half hour was (...) a blur of frantic phone calls and devastating decisions leading to surgery to remove a subdural hematoma from my nephew’s head, even though he was only two brain stem reflexes away from brain death.I thought that my experience as a neurosurgeon would somehow help me. However, when my sister–in–law asked me if this was just like the other tragic closed head injuries that I had seen in 26 years of practice, my answer was very simple: this was the only severe closed head injury I had ever seen—in my family. At this point, I was no longer a neurosurgeon. I was an uncle. My nephew’s closed head injury overwhelmed both his brain’s capacity to survive and my entire family’s ability to think rationally or objectively while grieving so intensely.It is in this context that we were asked to consider organ donation. The appeal for organ donation is one of altruism. My nephew’s parents agreed that organ donation would be an important way to honor their son’s life, allow him to make one final contribution to save the lives of several patients, and help to bring peace to the family.I will never forget, however, my niece’s distraught response. She is altruistic by nature, but was tremendously conflicted by the choice to donate her own brother’s organs. At this point, all discussions about organ donation stopped until we could understand the source of her conflict. Since she did not have legal authority regarding the final decision, some family members wondered if organ donation should be allowed if she could not come to terms with the choice. She felt isolated, because she was the only person in the room who was experiencing conflict. As a neurosurgeon, I have always advised other families in this situation that they may have more peace if they can make such decisions unanimously, regardless of who has the ultimate legal authority for decision–making. This helps bring healing to the family, eliminates disruption of family values and unity, and reduces possible feelings of guilt.I asked my niece what she was feeling. She stated something that I had never heard before as a neurosurgeon. She had listened to the words that her brother was brain dead, but she felt that he was somehow still alive, since he was breathing on a ventilator and his heart was beating. She felt powerless due to her inability to do anything more for [End Page 9] him. She also wanted to be there when her brother “died,” which she would recognize by the cessation of his heartbeat. She would not abandon her brother.I searched for a way to respect my niece’s wishes and her legitimate request, while preserving the ability to proceed with organ donation. Solving this conundrum proved to be a pivotal part of the beginning of both her mourning process and acceptance of his death.As an uncle, I experienced the clear dissociation that modern medicine creates between medical care and the natural human process of recognizing and accepting death. My family observed the subtle difference between a deep coma and brain death. They noticed that my nephew’s color had changed when his temperature dropped to 94o F before the heating blanket was placed. They perceived the decrease in muscle tone when he stopped breathing faster than the ventilator rate. The Philosophy for Children in Schools Project is an ongoing research project to explore the impact of philosophy for children on classroom practice. This paper reports on the responses of head teachers, teachers and local educational authority officers in South Wales, UK, to the initial training programme in Philosophy for Children carried out by the University School of Education. Achieving change in schools through the embedding of new practices is an important challenge for head teachers. Interviews and qualitative (...) questionnaires were used to explore perceptions of and attitudes towards the dialogic practice of P4C and the related challenges for school leaders. The results provide an insight into how head teachers planned to embed the new practice of P4C in their schools. Results from the interviews and questionnaires have been subject to iterative analysis and categories derived under which to discuss the findings. There are many similarities in the ways in which different head teachers go about planning change n their schools as well as differences. The results provide insight into the role of initial continuing professional development in school development and the processes by which individual heads plan to embed change in practice across the whole school. Photography – a novel medium of scientific representation in the XIXth century array of arts and sciences. To delve into various nineteenth century academic disciplines under the heading ‘photography in the arts and sciences’ as did last year's annual conference of the History of Science Society – the interest in such a topic only partly stems from the ‘iconic turn’ that has generally enlarged the scope of the social sciences in recent years. A more poignant feature in any such present (...) day study will probably be a basic scepticism facing the fact that in public use photographs have been manipulated in many respects.Yet, while shying away from any simple success story, a historically minded approach to changing ‘visual paradigms’ has begun to emerge. In this context, it has proved of considerable heuristic value to reconsider the role of early photography in an array of science, arts and technology: Since the reliance on the traditional ways of sketching reality persisted, in many an instance where photography was introduced, the thoughts the pioneer photographers had about their new, seemingly automated business, call for close attention. Thus scholarship sets up a parallel ‘discussion room’; the lively debate on the benefit of academic drawings as opposed to photographic portraits is a case in point.Some fairly specialised reports on photographically based analyses, such as electron microscopy, point to a borderline where the very idea of representation as a correspondence of reality and imagination gets blurred. Even though any ‘visual culture’ will have to shoulder the ‘burden of representation’, it is equally likely that it will offer a deeper sensibility for the intricacies entailed in the variegated ways of illustrating or mapping chosen subjects of scientific interest. Scholarship may thus somewhat control the disillusionment that by now has become the epitome of writing on photographic history. Provided with a renewed methodological awareness for the perception process and its photographic transition, historians may strike a better balance between the ever present tendencies of a realistic and an aesthetic way of picturing the world we live in. But recently these two clusters of values have seemed increasingly to conflict – as, for example, with the feminist claim that the legal toleration of pornography, long a goal sought by civil libertarians, actually violates civil rights as a form of sex discrimination.Here I propose an interpretation of the conflict of civil rights and civil liberties in its latest manifestation: the (...) controversy over how to treat discriminatory verbal harassment on American campuses. I was involved with the controversy in a practical way at Stanford, where I helped draft a harassment regulation that was recently adopted by the university.Like the pornography issue, the harassment problem illustrates the element of paradox in the conflict of civil-liberties and civil-rights perspectives or mentalities. This problem does not simply trigger familiar disagreements between liberals of a classical or libertarian orientation as against those of a welfare state or social democratic one – though it does sometimes do that. In my experience, the issue also has the power to appear to a single person in different shapes and suggest different solutions as it oscillates between being framed in civil-liberties and in civil-rights terms. At the same time, however, it remains recognizably the same problem. It is thus a very practical and political example of the kind of tension noted by Wittgenstein in the aphorism that heads this essay – a puzzle of interpretive framing, of “seeing-as.”. (shrink)

Recently, an increasing body of work from sociology, social psychology, and social ontology has been devoted to collective emotions. Rather curiously, however, pressing epistemological and especially normative issues have received almost no attention. In particular, there has been a strange silence on whether one can share emotions with individuals or groups who are not aware of such sharing, or how one may identify this, and eventually identify specific norms of emotional sharing. In this paper, I shall address this set of (...) issues head-on. I will do so by drawing on one of the most elaborate, but rather neglected phenomenological accounts of sociality, namely Edith Stein’s work on communal experiences and her theory of empathy. I wish to show that a suitably amended Steinian account affords us with an intriguing alternative to both phenomenalist and normativist construals of collective emotions. Moreover, I shall argue that it provides a more fine-grained account of the different types of emotional sharing than standard accounts, ranging from face-to-face, or shared, to more robust but less direct, or collective, emotions. Finally, I will propose a tentative answer to the above questions by pointing to non-dyadic or collective forms of empathy. (shrink)

Nietzsche was famously an atheist, despite coming from a strongly Protestant family. This heritage influenced much of his thought, but was it in fact the very thing that led him to his atheism? This work provides a radical re-assessment of Protestantism by documenting and extrapolating Nietzsche's view that Christianity dies from the head down. That is, through Protestantism's inherent anarchy. In this book, Nietzsche is put into conversation with the initiatives of several powerful thinking writers; Luther, Boehme, Leibniz, and (...) Lessing. Using Nietzsche as a critical guide to the evolution of Protestant thinking, each is shown to violate, warp, or ignore gospel injunctions, and otherwise pose hazards to the primacy of Christian ethics. Demonstrating that a responsible understanding of Protestantism as a historical movement needs to engage with its inherent flaws, this is a text that will engage scholars of philosophy, theology, and religious studies alike. Every cartilage and bone in the vertebrate skeleton has a precise shape and position. The head skeleton develops in the embryo from the neural crest, which emigrates from the neural ectoderm and forms the skull and pharyngeal arches. Recent genetic data from mice and zebrafish suggest that cells in the pharyngeal segments are specified by positional information in at least two dimensions, Hox genes along the anterior‐posterior axis and other homeobox genes along the dorsal‐ventral axis within a segment. Many (...) zebrafish and human mutant phenotypes indicate that additional genes are required for the development of groups of adjacent pharyngeal arches and for patterning along the mediolateral axis of the skull. The complementary genetic approaches in humans, mice and fish reveal networks of genes that specify the complex morphology of the head skeleton along a relatively simple set of coordinates. (shrink)

In this collection of essays, which covers the years from 1934 to1939, we see Eric Voegelin in the role of both scholar and public intellectual in Vienna until he was forced to flee the Nazi terror that descended on Austria in 1938. Revealing the broad spectrum of thinking and scientific study of this relatively young scholar, Voegelin's essays range from Austrian politics, Austrian constitutional history, and European racism to questions of the formation and expression of public opinion, theories of administrative (...) law, and the role of political science in public university education. Several essays serve as useful commentaries on, elaborations of, or synopses of arguments Voegelin made in the five books he had published between 1928 and 1938. Within these topical headings, there are multiple thematic threads that wind their way through these essays and that remain of interest to contemporary readers. Thirteen of the pieces contained in this collection are short items that Voegelin published in trade journals and newspapers, of which nine appeared in the _Wiener Zeitung_ in 1934 and the _Neue Freie Presse_ in 1937. In these we see two brief periods in which Voegelin played the role of public intellectual not only as a lecturer but also in print. These essays will be of interest to a wide range of scholars, including constitutional historians, historians of political science, political theorists, and students of Voegelin's later work. Mental imagery (varieties of which are sometimes colloquially refered to as “visualizing,” “seeing in the mind's eye,” “hearing in the head,” “imagining the feel of,” etc.) is quasi-perceptual experience; it resembles perceptual experience, but occurs in the absence of the appropriate external stimuli. It is also generally understood to bear intentionality (i.e., mental images are always images of something or other), and thereby to function as a form of mental representation. Most management researchers pause at the threshold of objective right and wrong. Their hesitation is understandable. Values imply a “subjective,” personal dimension, one that can invite religious and moral interference in research. The dominant epistemological camps of positivism and subjectivism in management stumble over the notion of moral objectivity. Empirical research can study values in human behavior, but hard-headed scientists should not assume that one value can be objectively better than another. In this article, we invite management researchers to rethink (...) this presumption. We show how accepting at least a limited form of moral objectivity, namely, an epistemic orientation that seeks objective moral reasons, can benefit management research by 1. guiding research practice; 2. using patterns of moral objectivity as clues for formulating empirical hypotheses for psychological explanations; and 3. adding prescriptive power to empirical theories. In my commentary I will try to illustrate the fruitfulness of his approach by pointing to some connections with the phenomenology of the body as well as with recent memory and infant research.As Blankenburg himself indicates, the (...) notion of common sense developed by a shift of meaning from the classical sensus communis and thus has its original basis in the sensual-bodily experience. By the koinè aísthesis, Aristoteles meant a central sense organ integrating all single modalities of sensation (which he localized in the heart). In German physiology and psychiatry of the nineteenth century, the sensus communis was still translated as "Gemeingefühl" ("common feeling") or "cenesthesia" (Fuchs 1995). This term denoted the inner, proprioceptive bodily sensations, but also an original unity of the senses, which has been rediscovered by recent infant research as intermodal sensory perception. The affection of the body was thus regarded as the common basis of all sensation.Looking on this track for a bodily basis of the common sense, we find it in the habitual structure of the lived-body as analysed by Merleau-Ponty (1945). The body is the primary "matter-of-course," namely, the tacitly functioning medium of our everyday being-in-the-world prior to any subject-object split. The body schema, in Merleau-Ponty's view, is not only a system of familiar units of movement or "kinetic melodies," it also incorporates the surrounding things, tools, and spaces that are familiar to us and that we "inhabit." Thus, the musician "does not only manipulate the instrument like a separate object, but lives in it like a limb and inhabits the expressive musical space it opens" (Behnke 1997). But for Merleau-Ponty, the body schema is also the basis of "intercorporeity," i.e., a prepersonal sphere of reciprocal comportment and understanding prior to any explicit consensus and symbolic communication. In this sphere of elementary contact, the "atmospheric" senses play a major role: The sense of smell (as shown, e.g., by the expression "to scent treason" or in German, "jemand nicht riechen können" [not be able to "smell" or stand someone]) as well as the sense of taste whose ambiguous meaning, mentioned by Blankenburg, points to the bodily basis of the feeling for what is suitable, decent, or aesthetically pleasing. Even the designation of homo sapiens that we give to ourselves is derived from the latin sapere (to taste/to know), and thus shows that the knowledge characteristic for man is not an explicit one, but an intuitive, implicit knowing or "feel" for his surroundings, or as Kant says, an "aesthetic rather than intellectual judgment" (cited by Blankenburg).Polanyi (1967) has analysed this knowledge at the roots of common sense as "tacit knowledge." It is based on processes of Gestalt formation that enable us to grasp unified wholes through their constituting elements without still being aware of the latter. Thus, we understand the facial expression of others immediately but cannot tell from which details. Or we know how [End Page 323] to waltz without knowing the single movements or being able to explain it. Tacit knowledge implies all the taken-for-granted that we have forgotten once it has become our second nature and part of our bodily habits. It is mainly based on the neuronal coupling of single sensori-motor units by repeated perception or action. This unconscious knowing has only recently come to be explored by psychology under the heading of "implicit" or "procedural memory" (Schacter 1987, 1996). It contains familiar styles or "melodies" of moving, perceiving, and being-with-others in which our whole bodily and emotional experience is engaged. There is an atmospheric, "felt" quality about them that cannot be analysed into single elements. Implicit knowledge may, therefore, never be wholly expressed by words—it is only realized in the concrete situation.
