In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. This article seeks to show the interaction between cultural and anatomic evolution in the birth and differentiation of cultures and languages. The diversity which characterizes our world does not preclude logical regularities due to the coherence of the human mind, which evolved slowly through the paleontological phases of its emergence over millions of years. The anatomical retroaction of the hominids is analyzed to show that, in the long run, anatomy reflected ‘cultural selection’. Biosemiotics and the analysis of biopower have not yet been explicitly brought together. This article attempts to find their connecting points from the perspective of biosemiotics. It uses the biosemiotic understanding of the different types of semiosis in order to approach the practices of biopower and biopolitics. The central concept of the paper is that of the ‘semiotic threshold’. We can speak of (1) the lower semiotic threshold, signifying the dividing line between non-semiosis and semiosis; and (2) the secondary semiotic (...) thresholds, signifying the borders between different types (iconic, indexical, symbolic) of semiosis. Speaking in terms of types of semiosis means speaking in terms of different capabilities for normativity, which is why the article uses the approaches of Michel Foucault on normalization in biopower and of Georges Canguilhem on organismic normativity. As an example on which biopolitics and biosemiotics could connect, the discourse of regenerative and anti-aging medicine is used. (shrink)

Although the last decade has seen a proliferation of ontological approaches to arguments, many of them employ ad hoc solutions to representing arguments, lack interoperability with other ontologies, or cover arguments only as part of a broader approach to evidence. To provide a better ontological representation of arguments, we present the Arguments Ontology (ArgO), a small ontology for arguments that is designed to be imported and easily extended by researchers who work in different upper-level ontology frameworks, different logics, and different (...) approaches to argument evaluation. Unlike most ontological approaches to arguments, ArgO utilizes Basic Formal Ontology (BFO) as an upper-level ontology, and may be used alongside other commonly used ontologies in the BFO framework, including boththe Information Artifact Ontology (IAO), and the Information Entity Ontology (INFO). Critically, our proposal is principled, based on rigorous definitions and formal axioms out of which characterizations of arguments naturally fall. It is our hope that ArgO may assist researchers in many projects, including: integrating heterogeneous sources of evidence, structuring the content of semantic wikis, and enhancing semantic reasoning. Semiotic mechanisms involving sacred natural sites – or areas of land or water with special spiritual significance – that have been focal points in agrarian vernacular religion have been transformed in modern Estonian culture. Some sites have accrued new significance as national monuments or tourist attractions and the dominant way of conceptualizing these sites has changed.Sacred natural sites should not be presumed to represent pristine nature. Rather, they are products of complex culture-nature interactions as they have been formed in the (...) course of traditional land management as well as different semiotic practices, including ritual and conservationist ones. The existence of sites encompassed by the term defies and blurs the rigid distinction between nature and culture.Individual sacred natural sites and categories of such sites can act as signifiers for a variety of different signifieds concurrently, acting as confluences of different sign systems and thus exemplifying the creolization of these systems as well as bringing about the hybridization of different landscape traditions in certain loci.Estonian literary culture has adopted motifs and narratives that define sacred natural sites more readily from other literary traditions than from the Estonian vernacular tradition; in turn, the vernacular tradition has also adopted and assimilated literary Romantic motifs. BackgroundThe proper and ethical inclusion of PWLHIV and their young children in research is paramount to ensure valid evidence is generated to optimize treatment and care. Little empirical data exists to inform ethical considerations deemed most critical to these populations. Our study aimed to systematically review the empiric literature regarding ethical considerations for research participation of PWLHIV and their young children.MethodsWe conducted this systematic review in partnership with a medical librarian. A search strategy was designed and performed within the following (...) electronic databases: Ovid MEDLINE, Embase and CINAHL. We screened titles and abstracts using the following inclusion criteria: (1) a study population of PWLHIV or children under 5 years of age; and (2) collection of qualitative or quantitative data regarding ethics of research participation. Excluded were reviews, commentaries, policy statements, clinical care-related ethics concerns, abstracts, case studies, or studies unrelated to HIV research. Studies were appraised for quality, data were extracted, and studies were qualitatively analyzed using a principle-based ethical framework within the Belmont Report.ResultsOf the 7470 titles identified, 538 full-text articles were reviewed for eligibility and only three articles met full criteria for inclusion within this review. While we allowed for inclusion of studies involving young children born to mothers with HIV, only articles focused on PWLHIV were identified. Within the results of these studies, four themes emerged: (1) adequacy of informed consent; (2) consideration of paternal involvement; (3) balancing risks; and (4) access to research and treatment. A strength of this review is that it included perspectives of international research investigators, community leaders, and male partners. However, only two studies collected empiric data from PWLHIV regarding their experiences participating in researchConclusionResearchers and funding agencies should be aware of these considerations and appreciate the value of and critical need for formative research to ensure clinical trials involving PWLHIV promote ethical, well-informed research participation and, ultimately, improve care outcomes. In a recent article Ian Hacking argues that there can be cases where no probabilities may correctly be ascribed to individual members of a population, while probabilities are correctly ascribable to the population as a whole. In this paper a simple artificial coin-flipping model for such probabilities, not 'grounded from below' is constructed. The inferences licensed by this model and a consequence of the model for the theory of statistical tests is explored.

Service-Robotic—mainly defined as “non-industrial robotics”—is identified as the next economical success story to be expected after robots have been ubiquitously implemented into industrial production lines. Under the heading of service-robotic, we found a widespread area of applications reaching from robotics in agriculture and in the public transportation system to service robots applied in private homes. We propose for our interdisciplinary perspective of technology assessment to take the human user/worker as common focus. In some cases, the user/worker is the effective subject (...) acting by means of and in cooperation with a service robot; in other cases, the user/worker might become a pure object of the respective robotic system, for example, as a patient in a hospital. In this paper, we present a comprehensive interdisciplinary framework, which allows us to scrutinize some of the most relevant applications of service robotics; we propose to combine technical, economical, legal, philosophical/ethical, and psychological perspectives in order to design a thorough and comprehensive expert-based technology assessment. This allows us to understand the potentials as well as the limits and even the threats connected with the ongoing and the planned implementation of service robots into human lifeworld—particularly of those technical systems displaying increasing grades of autonomy. In recent years there has been a number of promising technical and institutional developments regarding use of ontologies in industry. At the same time, however, most industrial ontology development work remains within the realm of academic research and is without significant uptake in commercial applications. In biomedicine, by contrast, ontologies have made significant inroads as valuable tools for achieving interoperability between data systems whose contents derive from widely heterogeneous sources. In this position paper, we present a set of principles learned (...) from the successful Open Biomedical Ontologies (OBO) Foundry initiative to guide the design and development of the Industrial Ontologies Foundry (IOF), which is a counterpart to the OBO Foundry initiative for the manufacturing industry. Technology assessment (TA) is – for several reasons – not detachable from ethical questions. The development of institutions and concepts for TA, especially in the USA and Western Europe, has been marked by an increasing tendency to focus evaluative and normative questions. In the following paper, we point out, in as far as the common notions of TA are implicitly normative, why reflection upon conceptual options of TA inevitably leads to ethical questions, and that the key question of participation necessarily (...) comes up in the context of societal decisions made under conditions of risk or uncertainty. Arrangements of participatory and discoursive TA are referred to as possible applications of discourse ethics, but there are consequences to consider, which result from discourses in TA not being ideal discourses. Concepts and performance of TA arrangements on biotechnology and gene technology in different European countries are compared, analysing what similarities and differences can be found with respect to ethical clarification. Crucial questions of how to conceptualise participatory TA (pTA) and current topics in ethics of technology are shown to coincide. A proposal is presented of how these – theoretical normative and empirical descriptive – considerations can be used in a comprehensive conception for participatory and discoursive TA. (shrink)

In our essay we trace the evolution of the critical theory of religion, or comparative dialectical religiology, out of the critical theory of society of the Institute for Social Research or the Frankfurt School. For us, the history of religions reflects the history of humanity’s intellectual and spiritual evolution. As we developed our critical theory of religion, we have tried to supersede concretely the great accomplishments of three generations of critical theorists, particularly in the field of religion. One main theme (...) of our critical theory of religion is the dialectic of two modes of existence: having and being; egoism and altruism. As we determinately negated the critical theory of society into our comparative dialectical religiology, we also penetrated deeper into its roots in the works of Kant and Hegel, Marx and Freud, Judaism and Christianity, particularly into the mystical theology of the great dialectician Meister Eckhart and of his many modern followers. This paper discerns two types of mathematization, a foundational and an explorative one. The foundational perspective is well-established, but we argue that the explorative type is essential when approaching the problem of applicability and how it influences our conception of mathematics. The first part of the paper argues that a philosophical transformation made explorative mathematization possible. This transformation took place in early modernity when sense acquired partial independence from reference. The second part of the paper discusses a series of examples (...) from the history of mathematics that highlight the complementary nature of the foundational and exploratory types of mathematization. Most research on risk aversion in behavioral science with human subjects has focused on a component of risk aversion that does not adapt itself to context. More recently, studies have explored risk aversion adaptation to changing circumstances in sequential decision-making tasks. It is an open question whether one can identify evidence, at the single subject level, for such risk aversion adaptation. We conducted a behavioral experiment on human subjects, using a sequential decision making task. We developed a model-based approach for (...) estimating the adaptation of risk-taking behavior with single-trial resolution by modelling a subject’s goals and internal representation of task contingencies. Using this model-based approach, we estimated the subject-specific adaptation of risk aversion depending on the current task context. We found striking inter-subject variations in the adaptation of risk-taking behavior. We show that these differences can be explained by differences in subjects’ internal representations of task contingencies and goals. We discuss that the proposed approach can be adapted to a wide range of experimental paradigms and be used to analyze behavioral measures other than risk aversion. (shrink)

Edited by John C. Higgins-Biddle. The Clarendon Edition of the Works of John Locke. Oxford: Oxford University Press, The Clarendon Press, 1999. Pp. cxxxix + 261. Cloth, $95.00. John C. Higgins-Biddle's new edition of the work Locke published anonymously in 1695 is another fine entry in the Clarendon series. It (...) is the first critical edition and the only one to include the revisions Locke made in a personal copy. Higgins-Biddle provides a set of Locke's manuscripts related to the text (including manuscript indices), a table of Biblical references, and a bibliography. In his meticulously researched introduction, Higgins-Biddle sets out the background and main themes of The Reasonableness by considering the controversies that surrounded it, particularly the accusations of Deism, Socinianism, and Hobbism.Locke's title is apt to mislead contemporary readers by encouraging them to expect a rationalistic defense of religious belief. What we have instead is a treatise largely devoted to discovering the basic beliefs one must hold in order to be a Christian. Christianity is 'reasonable' according to Locke because its fundamental doctrines are perspicuous and accessible to all, not because it is in every respect rationally demonstrable. Locke argues that belief in two propositions, viz., that God exists and that Jesus Christ is the Messiah, is sufficient to make one a Christian. Early critics, as Higgins-Biddle shows, mistakenly took this to mean that other doctrines, especially that of the Trinity, formed no part of Locke's brand of Christianity. Instead, Locke suggests that although belief in the fundamental doctrines is sufficient to make one a Christian, one is subsequently obligated to receive "all the parts of Divine Revelation, with a docility and disposition prepared to imbrace" (169). Locke grants, however, that a Christian may be ignorant of or even disbelieve a large portion of scriptural truths. His failure to specify which particular 'truths' he had in mind seems to have led to the charge of Socinianism, which persists to the present day.It is not clear what this charge amounts to, and Higgins-Biddle does a fine job of sorting through the religious controversies of Locke's age. One core plank of Socinianism or Unitarianism seems to have been the denial of the Trinity. Nowhere in The Reasonableness does Locke so much as mention that doctrine; however, his position does make it a secondary one, since assent to it is not required of all Christians. What is most important here is the continuity between Locke's project in this work and his thoughts on toleration. The chief aim of those who, like Locke, advocated the 'way of fundamentals' was to achieve toleration for non-conformist religious sects and to make possible a more harmonious and unified Church of England.Locke is often regarded as a founding father of English Deism, a view Locke understood as entailing the denial of all religious claims except those supported by natural theology. But Locke himself saw The Reasonableness as partly directed against the temptation to reject the claims of revelation. Such claims can be objects of faith, accepted by virtue of Biblical authority. Opposition to Deism is particularly evident in Chapter XIV, where Locke argues for the necessity of Christ as saviour. Locke admits that we cannot know what 'transactions' there were between God and Christ, but claims [End Page 296] that it would be presumptuous to reject a doctrine simply because we cannot fully comprehend it.It is not for its role in these controversies alone that The Reasonableness is to be valued. Locke also has much to say that is relevant to his moral philosophy. BackgroundStreet-connected children and youth in low- and middle-income countries have multiple vulnerabilities in relation to participation in research. These require additional considerations that are responsive to their needs and the social, cultural, and economic context, while upholding core ethical principles of respect for persons, beneficence, and justice. The objective of this paper is to describe processes and outcomes of adapting ethical guidelines for SCCY’s specific vulnerabilities in LMIC.MethodsAs part of three interrelated research projects in western Kenya, we created procedures to (...) address SCCY’s vulnerabilities related to research participation within the local context. These consisted of identifying ethical considerations and solutions in relation to community engagement, equitable recruitment, informed consent, vulnerability to coercion, and responsibility to report.ResultsSubstantial community engagement provided input on SCCY’s participation in research, recruitment, and consent processes. We designed an assent process to support SCCY to make an informed decision regarding their participation in the research that respected their autonomy and their right to dissent, while safeguarding them in situations where their capacity to make an informed decision was diminished. To address issues related to coercion and access to care, we worked to reduce the unequal power dynamic through street outreach, and provided access to care regardless of research participation.ConclusionsAlthough a vulnerable population, the specific vulnerabilities of SCCY can to some extent be managed using innovative procedures. Engaging SCCY in ethical research is a matter of justice and will assist in reducing inequities and advancing their health and human dignity. (shrink)

Basic Formal Ontology (BFO) is a top-level ontology consisting of thirty-six classes, designed to support information integration, retrieval, and analysis across all domains of scientific investigation, presently employed in over 350 ontology projects around the world. BFO is a genuine top-level ontology, containing no terms particular to material domains, such as physics, medicine, or psychology. In this paper, we demonstrate how a series of cases illustrating common types of change may be represented by universals, defined classes, and relations employing the (...) BFO framework. We provide discussion of these cases to provide a template for other ontologists using BFO, as well as to facilitate comparison with the strategies proposed by ontologists using different top-level ontologies. In policy-making the consumption of specially labelled products, and its role in improving the welfare of livestock, has attracted considerable attention. There is in many countries a diverse market for animal welfare-friendly products which is potentially confusing and may lack transparency. We ask whether special quality labels that involve medium levels of animal welfare, as compared with labels promoting premium levels of animal welfare, have a role to play in promoting improvements in animal welfare. The Danish pork market is our (...) reference case, but we also widen the context by comparing the markets for pork in three other European countries. Our findings suggest that in order to improve animal welfare through demand for welfare-friendly products it is important to maintain separate the market for products with strong animal welfare profiles from markets for products with medium levels of animal welfare where, often, animal welfare is bundled together with other food quality attributes. We conclude that such quality labels may indeed play an important role in promoting higher animal welfare standards provided that they offer real improvements in animal welfare as compared with standard products. They will be attractive to consumers with a positive, but not especially strong interest in animal welfare as an individual food attribute who would otherwise be inclined to purchase standard products. Throughout his mature writings, Berkeley speaks of minds as substances that underlie or support ideas. After initially flirting with a Humean account, according to which minds are nothing but ‘congeries of Perceptions’, Berkeley went on to claim that a mind is a ‘perceiving, active being … entirely distinct’ from its ideas. Despite his immaterialism, Berkeley retains the traditional category of substance and gives it pride of place in his ontology. Ideas, by contrast, are ‘fleeting and dependent beings’ that must be (...) supported by a mental substance. There is no doubt that Berkeley's conception of the relationship between minds and ideas is non-traditional, but that fact does not undercut his commitment to the traditional conception of substance. Since uncertainty is a major challenge in medicine and bears the risk of causing incorrect diagnoses and harmful treatment, there are many efforts to tackle it. For some time, AI technologies have been increasingly implemented in medicine and used to reduce medical uncertainties. What initially seems desirable, however, poses challenges. We use a multimethod approach that combines philosophical inquiry, conceptual analysis, and ethical considerations to identify key challenges that arise when AI is used for medical certainty purposes. We identify several (...) challenges. Where AI is used to reduce medical uncertainties, it is likely to result in (a) patients being stripped down to their measurable data points, and being made disambiguous. Additionally, the widespread use of AI technologies in health care bears the risk of (b) human physicians being pushed out of the medical decision-making process, and patient participation being more and more limited. Further, the successful use of AI requires extensive and invasive monitoring of patients, which raises (c) questions about surveillance as well as privacy and security issues. We outline these several challenges and show that they are immediate consequences of AI-driven security efforts. If not addressed, they could entail unfavorable consequences. We contend that diminishing medical uncertainties through AI involves a tradeoff. The advantages, including enhanced precision, personalization, and overall improvement in medicine, are accompanied by several novel challenges. This paper addresses them and gives suggestions about how to use AI for certainty purposes without causing harm to patients. (shrink)
