The use of coercive measures in the care for the addicted has changed over the past 20 years. Laws that have adopted the “dangerousness” criterion in order to secure patients’ rights to non-intervention are increasingly subjected to critique as many authors plead for wider dangerousness criteria. One of the most salient moral issues at stake is whether addicts who are at risk of causing danger to themselves should be involuntarily admitted and/or treated. In this article, it is argued that the (...) dilemma between coercion on the one hand and abandonment on the other cannot be analysed without differentiated perspectives on the key notions that are used in these debates. The ambiguity these notions carry within care practice indicates that the conflict between the prevention of danger and respect for autonomy is not as sharp as the legal systems seem to imply. Some coercive measures need not be interpreted as an infringement of autonomy—rather, they should be interpreted as a way to provide good care. (shrink)

Analytic philosophy in the mid-twentieth century underwent a major change of direction when a prior consensus in favour of extensionalism and descriptivism made way for approaches using direct reference, the necessity of identity, and modal logic. All three were first defended, in the analytic tradition, by one woman, Ruth Barcan Marcus. But analytic philosophers now tend to credit them to Kripke, or Kripke and Carnap. I argue that seeing Barcan Marcus in her historical context – one dominated by extensionalism and (...) descriptivism – allows us to see how revolutionary she was, in her work and influence on others. I focus on her debate with Quine, who found himself retreating to softened, and more viable, versions of his anti-modal arguments as a result. I make the case that Barcan's formal logic was philosophically well-motivated, connected to her views on reference, and well-matched to her overall views on ontology. Her nominalism led her to reject posits which could not be directly observed and named, such as possibilia. She conceived of modal calculi as facilitating counterfactual discourse about actual existents. I conclude that her contributions ought to be recognized as the first of their kind. Barcan Marcus must be awarded a central place in the canon of analytic philosophy. (shrink)

In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. W.V. Quine, a champion of philosophical naturalism and pioneer of mathematical logic, was one of the most important philosophers of the 20th century. This volume provides a full picture of the development of Quine's views on structure and how it permeates and shapes his attitude to a range of philosophical questions.

An odd dissensus between confident metaphysicians and neopragmatist antimetaphysicians pervades early twenty-first century analytic philosophy. Each faction is convinced their side has won the day, but both are mistaken about the philosophical legacy of the twentieth century. More historical awareness is needed to overcome the current dissensus. Lewis and his possible-world system are lionised by metaphysicians; Quine’s pragmatist scruples about heavy-duty metaphysics inspire antimetaphysicians. But Lewis developed his system under the influence of his teacher Quine, inheriting from him his empiricism, (...) his physicalism, his metaontology, and, I will show in this paper, also his Humeanism. Using published as well as never-before-seen unpublished sources, I will make apparent that both heavy-duty metaphysicians and neopragmatist antimetaphysicians are wrong about the roles Quine and Lewis played in the development of twentieth-century philosophy. The two are much more alike than is commonly supposed, and Quine much more instrumental to the pedigree of current metaphysics. (shrink)

This article seeks to show the interaction between cultural and anatomic evolution in the birth and differentiation of cultures and languages. The diversity which characterizes our world does not preclude logical regularities due to the coherence of the human mind, which evolved slowly through the paleontological phases of its emergence over millions of years. The anatomical retroaction of the hominids is analyzed to show that, in the long run, anatomy reflected ‘cultural selection’. This paper takes as its point of departure two striking incongruities between scientiªc practice and trends in modern history and philosophy of science. (1) Many modern historians of science are so preoccupied with local scientiªc practices that they fail to recognize important non-local elements. (2) Many modern philosophers of science make a sharp distinction between explanation and evidence, whereas in scientiªc practice explanatory power is routinely used as evidence for scientiªc claims. Focal points seem to be important in helping players coordinate their strategies in coordination problems. Game theory lacks, however, a formal theory of focal points. This paper proposes a theory of focal points that is based on individual rationality considerations. The two principles upon which the theory rest are the Principle of Insufficient Reason (IR) and a Principle of Individual Team Member Rationality. The way IR is modelled combines the classic notion of description symmetry and a new notion of pay-off (...) symmetry, which yields different predictions in a variety of games. On a currently popular reading of Locke, an idea represents its cause, or what God intended to be its cause. Against Martha Bolton and my former self (among others), I argue that Locke cannot hold such a view, since it sins against his epistemology and theory of abstraction. I argue that Locke is committed to a resemblance theory of representation, with the result that ideas of secondary qualities are not representations.

Philosophers of the modern period are often presented as having made an elementary error: that of confounding the attitude one adopts toward a proposition with its content. By examining the works of Locke and the Port-Royalians, I show that this accusation is ill-founded and that Locke, in particular, has the resources to construct a theory of propositional attitudes.

In September 2002 the President of the United States issued a new National Security Strategy. Under the impact of 9/11 the authors of this NSS argue that the United States needs to pre-emptively attack rogue states that try to develop weapons of mass destruction (WMD) and have links to terrorists who might use these WMDs against the United States or its allies. This article analyzes this so-called ?Bush doctrine? asking about its legality, justice and feasibility in the present world order. (...) Furthermore, it attempts to show which underlying tacit assumptions the authors of the NSS must make to give their argument for a right to forcible regime change plausibility. To do so the NSS is being contrasted with a realistic utopian concept of an idealized international order in which preventive defense and regime change might seem justifiable. (shrink)

Transcranial magnetic stimulation can cause measurable effects on neural activity and behavioral performance in healthy volunteers. In addition, TMS is increasingly used in clinical practice for treating various neuropsychiatric disorders. Unfortunately, TMS-induced effects show large intra- and inter-subject variability, hindering its reliability, and efficacy. One possible source of this variability may be the spontaneous fluctuations of neuronal oscillations. We present recent studies using multimodal TMS including TMS-EMG, TMS-tACS, and concurrent TMS-EEG-fMRI, to evaluate how individual oscillatory brain state affects TMS signal (...) propagation within targeted networks. We demonstrate how the spontaneous oscillatory state at the time of TMS influences both immediate and longer-lasting TMS effects. These findings indicate that at least part of the variability in TMS efficacy may be attributable to the current practice of ignoring oscillatory fluctuations during TMS. Ignoring this state-dependent spread of activity may cause great individual variability which so far is poorly understood and has proven impossible to control. We therefore also compare two technical solutions to directly account for oscillatory state during TMS, namely, to use tACS to externally control these oscillatory states and then apply TMS at the optimal brain state, or oscillatory state-triggered TMS. The described multimodal TMS approaches are paramount for establishing more robust TMS effects, and to allow enhanced control over the individual outcome of TMS interventions aimed at modulating information flow in the brain to achieve desirable changes in cognition, mood, and behavior. Hume's views on language have been widely misunderstood. Typical discussions cast Hume as either a linguistic idealist who holds that words refer to ideas or a proto-verificationist. I argue that both readings are wide of the mark and develop my own positive account. Humean signification emerges as a relation whereby a word can both indicate ideas in the mind of the speaker and cause us to have those ideas. If I am right, Hume offers a consistent view on meaning that (...) is neither linguistic idealism nor positivism but a genuine alternative to these, one that deserves to be taken seriously. (shrink)

How do people interleave attention when multitasking? One dominant account is that the completion of a subtask serves as a cue to switch tasks. But what happens if switching solely at subtask boundaries led to poor performance? We report a study in which participants manually dialed a UK-style telephone number while driving a simulated vehicle. If the driver were to exclusively return his or her attention to driving after completing a subtask (i.e., using the single break in the xxxxx-xxxxxx representational (...) structure of the number), then we would expect to see a relatively poor driving performance. In contrast, our results show that drivers choose to return attention to steering control before the natural subtask boundary. A computational modeling analysis shows that drivers had to adopt this strategy to meet the required performance objective of maintaining an acceptable lateral position in the road while dialing. Taken together these results support the idea that people can strategically control the allocation of attention in multitask settings to meet specific performance criteria. (shrink)

Biosemiotics and the analysis of biopower have not yet been explicitly brought together. This article attempts to find their connecting points from the perspective of biosemiotics. It uses the biosemiotic understanding of the different types of semiosis in order to approach the practices of biopower and biopolitics. The central concept of the paper is that of the ‘semiotic threshold’. We can speak of (1) the lower semiotic threshold, signifying the dividing line between non-semiosis and semiosis; and (2) the secondary semiotic (...) thresholds, signifying the borders between different types (iconic, indexical, symbolic) of semiosis. Speaking in terms of types of semiosis means speaking in terms of different capabilities for normativity, which is why the article uses the approaches of Michel Foucault on normalization in biopower and of Georges Canguilhem on organismic normativity. As an example on which biopolitics and biosemiotics could connect, the discourse of regenerative and anti-aging medicine is used. (shrink)

Disputes over territory are a major contributing factor to the disruption of international relations. We believe that a cumulative, integrated, and continuously updated resource providing information about such disputes in an easily accessible form would be of benefit to intelligence analysts, military strategists, political scientists, and also to historians and others concerned with international disputes. We propose an ontology-based strategy for creating such a resource. The resource will contain information about territorial disputes, arguments for and against claims pertaining to sovereignty, (...) proffered evidence for such claims, political and military motives (overt or hidden), and associated conflicts. Our approach is designed to address several issues surrounding the representation of geopolitical conflict, including the tracking and individuation of disputes and the validation of disseminated information. Si l’héroïsme médiéval s’élabore avant tout, dans sa composante guerrière, au masculin singulier, la tradition narrative française prévoit néanmoins quelques espaces à l’expression de la prouesse féminine. Du xiie au xve siècle, les romans illustrent plusieurs figures d’amazones ou de veuves viriles. Cependant, cette promotion à l’héroïsme semble difficile à concevoir dans le cas de personnages féminins assumant le rôle d’épouse ou d’amante. Pour vérifier cette constatation, l’enquête se tourne vers les romans idylliques qui ont connu un certain succès au (...) Moyen Age. La relation d’amour réciproque et relativement égalitaire pourrait nous laisser croire que les jeunes amants sont susceptibles de partager le renom de leurs aventures. L’analyse de plusieurs romans montre qu’il n’en est rien. Une exception cependant permet de distinguer le Roman de Floriant et Florete et surtout sa source directe, Erec et Enide de Chrétien de Troyes comme ferment possible d’un héroïsme de l’épouse. The feminist movement was from its start in the 19th century involved in the struggle for better health care for women. The first feminists aimed at better information on birth control and sexuality. The second feminist wave focused on the unequal division of power roles between men and women. A lot of the problems women experienced could be seen as a consequence of their subordinate role in society. At the end of the 1980s and in the 1990s, the discipline women (...) and health or women and medicine was developed. In this introduction to the theme, the developments in this discipline are described. The starting points of the new discipline followed the principles of ‘women’s health care’. These principles can be summarized as the emphasis on control and autonomy by the patient, demedicalization, the importance of the psychosocial context of complaints, empowerment of women and good information and communication. The central issue of the article is: what is the actual scientific state of the art and what important changes have been made on the subject gender and health? The article ends with ideas for future research. (shrink)

In publications in 1914 and 1918, Einstein claimed that his new theory of gravity in some sense relativizes the rotation of a body with respect to the distant stars and the acceleration of the traveler with respect to the stay-at-home in the twin paradox. What he showed was that phenomena seen as inertial effects in a space-time coordinate system in which the non-accelerating body is at rest can be seen as a combination of inertial and gravitational effects in a space-time (...) coordinate system in which the accelerating body is at rest. Two different relativity principles play a role in these accounts: the relativity of non-uniform motion, in the weak sense that the laws of physics are the same in the two space-time coordinate systems involved; what Einstein in 1920 called the relativity of the gravitational field, the notion that there is a unified inertio-gravitational field that splits differently into inertial and gravitational components in different coordinate systems. I provide a detailed reconstruction of Einstein's rather sketchy accounts of the twins and the bucket and examine the role of these two relativity principles. I argue that we can hold on to but that is either false or trivial. (shrink)

In the Pastoral Constitution on the Church in the Modern World, Vatican II devoted a chapter to “Fostering the Nobility of Marriage and the Family” . We read in the text, as it was brought to a vote in the general session of 16 November 1965 and approved by the overwhelming majority of the council fathers, that spouses must determine the moral character of their activity according to “objective criteria based upon the dignity of the human person” . Among the (...) changes suggested by a number of fathers along with the voting for this text were several concerning the formulation of this personalist standard. According to the rules of the council, no changes could be allowed which would alter the essence of the teaching already ratified by a more than sufficient majority. However, individual formulations in the text could be clarified or nuanced.In the formulation of the “objective criteria” some fathers proposed to say that these are based on the nature and the dignity of the human person and the nature of the acts of the person . Hence the definitive formulation, “objective criteria based on the nature of the human person and his acts”. To explain how the nature of the person's acts is morally relevant, the official commentary on the expression that was used states: “By these terms it is asserted that also the acts must be judged not according to their merely biological aspect, but insofar as they pertain to the human person integrally and adequately considered.” Others asked to mention that these standards apply to the procreative capacities of human nature . The answer was that such an addition would be superfluous, since it is a question of a general principle, one which is applicable not only to marriage and sexuality but also to the entire domain of human activity.To consider the human person in an integral and adequate way, account must be taken of the person's fundamental aspects or dimensions. Efforts to include women in the canon have long been beset by reactionary gatekeeping, typified by the charge “That's not philosophy.” That charge doesn't apply to early and mid‐analytic female philosophers—Welby, Ladd‐Franklin, Bryant, Jones, de Laguna, Stebbing, Ambrose, MacDonald—with job titles like lecturer in logic and professor of philosophy and publications in Mind, the Journal of Philosophy, and Proceedings of the Aristotelian Society. It's hopeless to dismiss their work as “not philosophy.” But comparable reactionary gatekeeping affects them, this paper argues, (...) typified by the labels “bad philosophy” and “derivative philosophy.” Virtue and vice epistemology help explain why these women have been neglected and why their own approaches are epistemically virtuous. Their contemporaries and historians are deficient in scholarly virtues in labelling these women's work “bad” or derived from male mentors with no or specious justification. Their disparaged qualities—intellectual humility, modesty, critical self‐reflection, disclosing biases—are often epistemic virtues. (shrink)

I argue that Aristotle endorses what I call the ‘strong link thesis’: the claim that virtuous and vicious acts are voluntary just in case the character states from which they flow are voluntary. Pace much of the literature, I argue that Aristotle does not defend some kind of limited or qualified responsibility for character: rightly or wrongly, he believes, and must believe, that character states are voluntary, full stop.

Ce volume offre l'édition critique de la traduction latine médiévale (partielle) de la troisième partie de la Physique du Shif?' d'Avicenne. Pour l'édition de la peine première partie traduite à Tolède, qui couvre le prologue et le début du premier chapitre, les mêmes principes ont été maintenus que pour l'édition du second traité. Quant à l'édition de la majeure partie, qui fut traduite à Burgos quasiment un siècle après la tolédane et qui n'a été conservée que dans un seul témoin, (...) les cas où la traduction latine ne correspond pas à la lecture du texte arabe sont analysés de façon particulière et, autant que possible, expliqués sur la base de considérations philologiques et/ou doctrinales. En outre, dans la mesure du possible, les sources historiques des doctrines évoquées par Avicenne dans l'ensemble de ces chapitres ont été précisés. (shrink)

Like their contemporary counterparts, early modern philosophers find themselves in a predicament. On one hand, there are strong reasons to deny that sensations are representations. For there seems to be nothing in the world for them to represent. On the other hand, some sensory representations seem to be required for us to experience bodies. How else could one perceive the boundaries of a body, except by means of different shadings of color? I argue that Nicolas Malebranche offers an extreme -- (...) and ultimately unworkable -- attempt to solve this riddle. Most commentators claim that Malebranche defends an adverbial theory of sensation, according to which a sensation is merely a way in which an act of sensing happens. The adverbial reading is wrong, or so I argue. Once we arrive at a more accurate reading, we shall see that his position is much more strange than is currently thought. Nevertheless, Malebranche’s view is similar to the adverbial theory in one respect, albeit it at a very high level of generality. His view thus inherits two of the main problems that afflict adverbial theories. Although Malebranche fails to solve them, his ingenious attempts to do so are instructive. (shrink)

I trace the strong link thesis to Plato’s Laws, among other texts, and show how it functions in key arguments of both philosophers.

Semiotic mechanisms involving sacred natural sites – or areas of land or water with special spiritual significance – that have been focal points in agrarian vernacular religion have been transformed in modern Estonian culture. Some sites have accrued new significance as national monuments or tourist attractions and the dominant way of conceptualizing these sites has changed.Sacred natural sites should not be presumed to represent pristine nature. Rather, they are products of complex culture-nature interactions as they have been formed in the (...) course of traditional land management as well as different semiotic practices, including ritual and conservationist ones. The existence of sites encompassed by the term defies and blurs the rigid distinction between nature and culture.Individual sacred natural sites and categories of such sites can act as signifiers for a variety of different signifieds concurrently, acting as confluences of different sign systems and thus exemplifying the creolization of these systems as well as bringing about the hybridization of different landscape traditions in certain loci.Estonian literary culture has adopted motifs and narratives that define sacred natural sites more readily from other literary traditions than from the Estonian vernacular tradition; in turn, the vernacular tradition has also adopted and assimilated literary Romantic motifs.
