The emergent use of service robots in more and more areas of social life raises a number of legal issues which have to be addressed in order to apply and adapt the existing legal framework to this new technology. The article provides an overview of law as a means to regulate and govern technology and discusses fundamental issues of the relationship between law and technology. It then goes on to address a number of relevant problems in the field of service (...) robotics. In particular, these issues include the organization of administrative control and the legal liability regime which applies to service robots. Also, the issue of autonomy of service robots is discussed, which cannot easily be answered under the existing, human-centered legal regime. (shrink)

Service-Robotic—mainly defined as “non-industrial robotics”—is identified as the next economical success story to be expected after robots have been ubiquitously implemented into industrial production lines. Under the heading of service-robotic, we found a widespread area of applications reaching from robotics in agriculture and in the public transportation system to service robots applied in private homes. We propose for our interdisciplinary perspective of technology assessment to take the human user/worker as common focus. In some cases, the user/worker is the effective subject (...) acting by means of and in cooperation with a service robot; in other cases, the user/worker might become a pure object of the respective robotic system, for example, as a patient in a hospital. In this paper, we present a comprehensive interdisciplinary framework, which allows us to scrutinize some of the most relevant applications of service robotics; we propose to combine technical, economical, legal, philosophical/ethical, and psychological perspectives in order to design a thorough and comprehensive expert-based technology assessment. This allows us to understand the potentials as well as the limits and even the threats connected with the ongoing and the planned implementation of service robots into human lifeworld—particularly of those technical systems displaying increasing grades of autonomy. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Court cases involving sexual assault and police violence rely heavily on victim testimony. We consider what we call the “Traumatic Untrustworthiness Argument (TUA)” according to which we should be skeptical about victim testimony because people are particularly liable to misremember traumatic events. The TUA is not obviously based in mere distrust of women, people of color, disabled people, poor people, etc. Rather, it seeks to justify skepticism on epistemic and empirical grounds. We consider how the TUA might appeal to the (...) psychology and neuroscience of memory for empirical support. However, we argue that neither support the TUA. (shrink)

Thomas Reid was a philosopher who founded the Scottish school of 'common sense'. Much of Reid's work is a critique of his contemporary, David Hume, whose empiricism he rejects. In this work, written after Reid's appointment to a professorship at the university of Glasgow, and published in 1785, he turns his attention to ideas about perception, memory, conception, abstraction, judgement, reasoning and taste. He examines the work of his predecessors and contemporaries, arguing that 'when we find philosophers maintaining that (...) there is no heat in the fire, nor colour in the rainbow … we may be apt to think the whole to be only a dream of fanciful men, who have entangled themselves in cobwebs spun out of their own brain'. Thomas Aquinas produced a voluminous body of work on moral theory, and much of that work is on virtue, particularly the status and value of the virtues as principles of virtuous acts, and the way in which a moral life can be organized around them schematically. Thomas Osborne presents Aquinas's account of virtue in its historical, philosophical and theological contexts, to show the reader what Aquinas himself wished to teach about virtue. His discussion makes the complexities of Aquinas's (...) moral thought accessible to readers despite the differences between Thomas's texts themselves, and the distance between our background assumptions and his. In this article I set out a reason for believing in a form of metaethical relativism. In rough terms, the reason is this: a widely held thesis, internalism, tells us that to accept (sincerely assert, believe, etc.) a moral judgment logically requires having a motivating reason. Since the connection is logical, or conceptual, it must be explained by a theory of what it is to accept a moral claim. I argue that the internalist feature of moral expressions can best be (...) explained by my version of moral relativism, which I call "speaker relativism.". (shrink)

This is a paper about the problem of realism in meta-ethics (and, I hope, also in other areas, but that hope is so far pretty speculative). But it is not about the problem of whether realism is true. It is about the problem of what realism is. More specifically, it is about the question of what divides meta-ethical realists from irrealists. I start with a potted history of the Good Old Days.

Normative theorists like to divide normative theories into classes. One special point of focus has been to place utilitarianism into a larger class of theories which do not necessarily share its view about what is alone of impersonal intrinsic value, namely, individual human well-being, but do share another structural feature, roughly its demand that each person seek to maximize the realization of what is of impersonal intrinsic value. Many philosophers, in different areas, are tempted by what variously goes under the name of Contextualism, Speaker Relativism, Indexical Relativism. (I’ll just use Indexical Relativism in this paper.) Thinking of certain problematic expressions as deriving their content from elements of the context of use solves some problems. But it faces some problems of its own, and in this paper I’m interested in one in particular, namely, the problem of disagreement. Two alternative theories, tempting for just the same kinds of expressions (...) as Indexical Relativism is meant to handle, promise to solve the problem of disagreement. I’ll argue that they do not live up to their promise. At the end of the paper, I’ll ask what exactly disagreement amounts to, and I’ll canvass some purported solutions. (shrink)

This paper surveys some ways of distinguishing Quasi-Realism in metaethics from Non-naturalist Realism, including ‘Explanationist’ methods of distinguishing, which characterize the Real by its explanatory role, and Inferentialist methods. Rather than seeking the One True Distinction, the paper adopts an irenic and pragmatist perspective, allowing that different ways of drawing the line are best for different purposes.

There has been an explosion of interest in the metaphysics of fundamentality in recent decades. The consensus view, called metaphysical foundationalism, maintains that there is something absolutely fundamental in reality upon which everything else depends. However, a number of thinkers have chal- lenged the arguments in favor of foundationalism and have proposed competing non-foundationalist ontologies. This paper provides a systematic and critical introduction to metaphysical foundationalism in the current literature and argues that its relation to ontological dependence and substance should (...) be qualified in important ways. Internalism says that if an agent judges that it is right for her to φ, then she is motivated to φ. The disagreement between Internalists and Externalists runs deep, and it lingers even in the face of clever intuition pumps. An argument in Michael Smith’s The Moral Problem seeks some leverage against Externalism from a point within normative theory. Smith argues by dilemma: Externalists either fail to explain why motivation tracks moral judgment in a good moral agent or they attribute (...) a kind of fetishism to good moral agents. I argue that there are alternative models of moral motivation available to Externalists, in particular a model according to which a good moral agent is one who is effectively regulated by a second order desire to desire to do what is right. In a recent paper Weinberg (2007) claims that there is an essential mark of trustworthiness which typical sources of evidence as perception or memory have, but philosophical intuitions lack, namely that we are able to detect and correct errors produced by these “hopeful” sources. In my paper I will argue that being a hopeful source isn't necessary for providing us with evidence. I then will show that, given some plausible background assumptions, intuitions at least come close to being hopeful, if (...) they are reliable. If this is true, Weinberg's new challenge comes down to the claim that philosophical intuitions are not reliable since they are significantly unstable. In the second part of my paper I will argue that and why the experimentally established instability of folk intuitions about philosophical cases does not show that philosopher's expert intuitions about these cases are instable. The paper describes the problem for robust moral realism of explaining the supervenience of the moral on the non-moral, and examines five objections to the argument: The moral does not supervene on the descriptive, because we may owe different obligations to duplicates. If the supervenience thesis is repaired to block, it becomes trivial and easy to explain. Supervenience is a moral doctrine and should get an explanation from within normative ethics rather than metaethics. Supervenience is a conceptual truth and should (...) be explained by the nature of our concepts rather than by a metaphysical theory. The moral does not supervene on the descriptive, because moral principles are not metaphysically necessary. It concludes that none of these objections is successful, so Robust Realists do have an explanatory debt to worry about. (shrink)

This paper is about Truth Minimalism, Norm Expressivism, and the relation between them. In particular, it is about whether Truth Minimalism can help to solve a problem thought to plague Norm Expressivism. To start with, let me explain what I mean by 'Truth Minimalism' and 'Norm Expressivism.'.

In general, the technical apparatus of decision theory is well developed. It has loads of theorems, and they can be proved from axioms. Many of the theorems are interesting, and useful both from a philosophical and a practical perspective. But decision theory does not have a well agreed upon interpretation. Its technical terms, in particular, ‘utility’ and ‘preference’ do not have a single clear and uncontroversial meaning. How to interpret these terms depends, of course, on what purposes in pursuit of (...) which one wants to put decision theory to use. One might want to use it as a model of economic decision-making, in order to predict the behavior of corporations or of the stock market. In that case, it might be useful to interpret the technical term ‘utility’ as meaning money profit. Decision theory would then be an empirical theory. I want to look into the question of what ‘utility’ could mean, if we want decision theory to function as a theory of practical rationality. I want to know whether it makes good sense to think of practical rationality as fully or even partly accounted for by decision theory. I shall lay my cards on the table: I hope it does make good sense to think of it that way. For, I think, if Humeans are right about practical rationality, then decision theory must play a very large part in their account. And I think Humeanism has very strong attractions. (shrink)

Looking back on it, it seems almost incredible that so many equally educated, equally sincere compatriots and contemporaries, all drawing from the same limited stock of evidence, should have reached so many totally different conclusions---and always with complete certainty.

In 1971, Simon Blackburn worked out an argument against moral realism appealing to the supervenience of the moral realm on the natural realm.1 He has since revised the argument, in part to take account of objections,2 but the basic structure remains intact. While commentators3 seem to agree that the argument is not successful, they have not agreed upon what goes wrong. I believe this is because no attempt has been made to see what happens when Blackburn's argument is addressed to (...) particular varieties of moral realism. As I see it, we must look to these various brands if we want to understand just where the concept of supervenience can be usefully employed. (shrink)

In chapter five of Wise Choices, Apt Feelings Allan Gibbard develops what he calls a ‘normative logic’ intended to solve some problems that face an expressivist theory of norms like his. The first is “the problem of embedding: The analysis applies to simple contexts, in which it is simply asserted or denied that such-and-such is rational. It says nothing about more complex normative assertions.”1 That is the problem with which I will be concerned. Though he doesn’t list it as one (...) of the problems to be solved, Gibbard’s devices also explain what it means to say that a certain normative argument is ‘valid’, that one normative statement follows from some others. Both of these questions arise because of the ways we ordinarily think and speak, ways which on a simplistic version of expressivism appear not to make any sense. An expressivist committed to making sense of the way we ordinarily think and speak in normative language owes some account of embeddings and of logic. Gibbard’s device seems to me the clearest and most systematic of any expressivist attempt to meet these challenges. (shrink)

The metaethics and metametaethics of Scanlon's "Reasons Fundamentalism".

I critically examine some deflationary theories of properties, according to which properties are ‘shadows of predicates’ and quantification over them serves a mere quasi-logical function. I start by considering Hofweber’s internalist theory, and pose a problem for his account of inexpressible properties. I then introduce a theory of properties that closely resembles Horwich’s minimalist theory of truth. This theory overcomes the problem of inexpressible properties, but its formulation presupposes the existence of various kinds of abstract objects. I discuss some ways (...) to reduce these existence assumptions, but ultimately suggest that deflationists can hardly avoid quantification over abstract objects of one sort or another. I conclude that property deflationism is perhaps not as deflationary as some philosophers want it to be, but that it’s still apt to call the position ‘deflationary’. (shrink)
