Drawing upon my expertise as an artist and clinical acupuncturist with training in biomedicine, my artistic research adapts Chinese medicine practice into a strategic tool to investigate new synergies between art, medicine, technology, East, West, modernity and pre-modernity. In my performances, I use Chinese pulse diagnosis and acupuncture point location as transdisciplinary artistic technologies (qi / ) that are capable of measuring and responding to quantum entanglements between individuals and their social, natural and cosmic milieus ‐ or what can be (...) referred to as dao (). The ability of adolescents to access safe and effective new products for HIV prevention and treatment is optimised by adolescent licensure at the same time these products are approved and marketed for adults. Many adolescent product development programmes for HIV prevention or treatment products may proceed simultaneously with adult phase III development programmes. Appropriately implemented, this strategy is not expected to delay licensure as information regarding product efficacy can often be extrapolated from adults to adolescents, and pharmacokinetic properties of drugs (...) in adolescents are expected to be similar to those in adults. Finally, adolescents enrolled in therapeutic HIV prevention and treatment research can be considered adults, based on US Food and Drug Administration regulations and the appropriate application of state law. The FDA permits local jurisdictions to apply state and local HIV/sexually transmitted infection minor treatment laws so that adolescents who are HIV-positive or at risk of contracting HIV may be enrolled in therapeutic or prevention trials without obtaining parental permission. Definition of the problemThe article addresses the relationship between reproduction, time and the good life. Services offered by reproductive medicine and conceptions of the good life in time influence each other reciprocally. This interaction is characterised by implicit and explicit normative settings and expectations of appropriate temporality.ArgumentsWe first discuss the significance of time for the life course and for parenthood from a sociological and social psychological perspective. Reproductive medicine can increase the options for becoming a parent and thus for life-time (...) autonomy. However, in the context of societal imperatives for optimisation and efficiency, it can also have opposite effects and increase heteronomy. Overall, this leads to changed forms of adaptation and self-determination, new dilemmas and ambivalences in the temporal optimisation of parenthood.ConclusionsAgainst this background, we explain how the ethics of reproductive medicine could benefit from interdisciplinary research that focuses on life in its temporal course. A self-fulfilling prophecy in neuroprognostication occurs when a patient in coma is predicted to have a poor outcome, and life-sustaining treatment is withdrawn on the basis of that prediction, thus directly bringing about a poor outcome for that patient. In contrast to the predominant emphasis in the bioethics literature, we look beyond the moral issues raised by the possibility that an erroneous prediction might lead to the death of a patient who otherwise would have lived. Instead, we focus on the (...) problematic epistemic consequences of neuroprognostic SFPs in settings where research and practice intersect. When this sort of SFP occurs, the problem is that physicians and researchers are never in a position to notice whether their original prognosis was correct or incorrect, since the patient dies anyway. Thus, SFPs keep us from discerning false positives from true positives, inhibiting proper assessment of novel prognostic tests. This epistemic problem of SFPs thus impedes learning, but ethical obligations of patient care make it difficult to avoid SFPs. We then show how the impediment to catching false positive indicators of poor outcome distorts research on novel techniques for neuroprognostication, allowing biases to persist in prognostic tests. We finally highlight a particular risk that a precautionary bias towards early withdrawal of life-sustaining treatment may be amplified. We conclude with guidelines about how researchers can mitigate the epistemic problems of SFPs, to achieve more responsible innovation of neuroprognostication for patients in coma. (shrink)

Most babies born each year in the U.S. undergo mandatory newborn screening to detect serious medical conditions that can cause devastating effects if treatment is not initiated prior to the onset of symptoms. Not all of the blood collected from newborns is used during routine newborn screening, and many states retain the residual dried blood samples. DBS have a broad range of potential uses, from program evaluation to public health and biomedical research unrelated to newborn screening. State laws vary regarding (...) whether parental consent is required to use DBS for secondary research, but federal now requires parental consent for the use of DBS in federally funded research. In some practical uncertain situations decision makers are presented with described events that are out of sequence when having to make a causal attribution. A theoretical perspective concerning the causal coherence of the explanation is developed to predict the effect of this on causal attribution. Three experiments investigated the effect on causal judgement when the described order of events did not correspond to their causal order. Participants had to judge the relative probability of two possible causes of an outcome in (...) scenarios in which presentation order varied. All three experiments found that there was a preference to judge that the cause associated with events described in causal order was more responsible for the outcome when events associated with one cause were interleaved in their presentation order with those from a second cause. This occurred when there was a strong causal relationship between events. The results were consistent with the causal coherence explanation. (shrink)

Human biological tissue samples are an invaluable resource for biomedical research designed to find causes of diseases and their treatments. Controversy has arisen, however, when research has been conducted with laboratory specimens either without the consent of the source of the specimen or when the research conducted with the specimen has expanded beyond the scope of the original consent agreement. Moreover, disputes have arisen regarding which party, the researcher or the source of the specimen, has control over who may use (...) the specimens and for what purposes. The purposes of this article are: to summarize the most important litigation regarding the use of laboratory specimens, and to demonstrate how legal theory regarding control of laboratory specimens has evolved from arguments based upon property interests in biological samples to claims that the origins of laboratory specimens have privacy interests in their genetic information that should be protected. There may be compelling reasons to return to parents a limited subset of results from research conducted using residual newborn screening dried blood samples. This article explores the circumstances under which research results might be returned, as well as the mechanisms by which state newborn screening programs might facilitate the return of research results. The scope of any responsibility to return results of research conducted using DBS should be assessed in light of the potential impact on the primary mission of (...) state newborn screening programs. The specialist field of intellectual disability nursing has been subjected to a number of changes since the move towards deinstitutionalisation from the 1970s. Government policies sought to change the nature of the disability workforce from what was labelled as a medicalised approach, towards a more socially oriented model of support. Decades on however, many nurses who specialise in the care of people with intellectual disability are still employed. In Australia, the advent of the National Disability Insurance Scheme offers an apt (...) moment to reflect upon these decades of specialised nursing care as the context of this nursing care will continue to evolve. A review of the published literature was conducted to explore what has shaped the field in the past and how this might inform the future of this speciality area under new policy and service contexts. People with intellectual disability have specific health and support needs that require a specialised workforce. Specialist nurses continue to be needed for people with intellectual disability. This paper details the experience of planning, orchestrating, teaching, and participating in a writing-intensive, team-taught, introductory philosophy class designed to expand the diversity of voices included in philosophical study. Accordingly, this article includes the various perspectives of faculty, TAs, and students in the class. Faculty authors discuss the administrative side of the course, including its planning and goals, its texts and structure, its working definition of “philosophy,” its balance of canonical and non-canonical texts, the significant resistance met in getting the (...) course approved, the complex pedagogical difficulties that attend teaching non-canonical texts, the motivation and execution of the course’s writing-intensive dimension, and a summary of student evaluations of the course. The TA authors reflect on the high level of student engagement and interest compared to other introductory philosophy courses, the perception that students found the material highly relevant to their own lives, and the capacity of the material to bring about philosophical insight for the instructors in the class. The student author offers a favorable account of the class and remarks on how the structure of the course aided the accessibility and relevance of the texts. (shrink)

BackgroundInaccurate, false or incomplete research publications may mislead readers including researchers and decision-makers. It is therefore important that such problems are identified and rectified promptly. This usually involves collaboration between the research institutions and academic journals involved, but these interactions can be problematic.MethodsThese recommendations were developed following discussions at World Conferences on Research Integrity in 2013 and 2017, and at a specially convened 3-day workshop in 2016 involving participants from 7 countries with expertise in publication ethics and research integrity. The (...) recommendations aim to address issues surrounding cooperation and liaison between institutions and journals about possible and actual problems with the integrity of reported research arising before and after publication.ResultsThe main recommendations are that research institutions should: develop mechanisms for assessing the integrity of reported research that are distinct from processes to determine whether individual researchers have committed misconduct;release relevant sections of reports of research integrity or misconduct investigations to all journals that have published research that was investigated;take responsibility for research performed under their auspices regardless of whether the researcher still works at that institution or how long ago the work was done;work with funders to ensure essential research data is retained for at least 10 years.Journals should: respond to institutions about research integrity cases in a timely manner;have criteria for determining whether, and what type of, information and evidence relating to the integrity of research reports should be passed on to institutions;pass on research integrity concerns to institutions, regardless of whether they intend to accept the work for publication;retain peer review records for at least 10 years to enable the investigation of peer review manipulation or other inappropriate behaviour by authors or reviewers.ConclusionsVarious difficulties can prevent effective cooperation between academic journals and research institutions about research integrity concerns and hinder the correction of the research record if problems are discovered. While the issues and their solutions may vary across different settings, we encourage research institutions, journals and funders to consider how they might improve future collaboration and cooperation on research integrity cases. Over 40 years of research have shown that traumatic brain injury affects brain volume. However, technical and practical limitations made it difficult to detect brain volume abnormalities in patients suffering from chronic effects of mild or moderate traumatic brain injury. This situation improved in 2006 with the FDA clearance of NeuroQuant®, a commercially available, computer-automated software program for measuring MRI brain volume in human subjects. More recent strides were made with the introduction of NeuroGage®, commercially available software that is based (...) on NeuroQuant® and extends its utility in several ways. Studies using these and similar methods have found that most patients with chronic mild or moderate traumatic brain injury have brain volume abnormalities, and several of these studies found—surprisingly—more abnormal enlargement than atrophy. More generally, 102 peer-reviewed studies have supported the reliability and validity of NeuroQuant® and NeuroGage®. Furthermore, this updated version of a previous review addresses whether NeuroQuant® and NeuroGage® meet the Daubert standard for admissibility in court. It concludes that NeuroQuant® and NeuroGage® meet the Daubert standard based on their reliability, validity, and objectivity. Due to the improvements in technology over the years, these brain volumetric techniques are practical and readily available for clinical or forensic use, and thus they are important tools for detecting signs of brain injury. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Martin Luther King Jr. said and wrote as much or more about the meaning, nature, and power of truth as any other prominent figure in the 1950s and '60s. King was not only vastly influential as an advocate for and defender of truth; he also did more than anyone in his time to organize truth into a movement for the liberation, uplift, and empowerment of humanity, efforts that ultimately resulted in the loss of his life. Drawing on (...) class='Hi'>King's published and unpublished sermons, speeches, and writings, The Arc of Truth explores King's lifelong pilgrimage in pursuit of truth. Lewis Baldwin explores King's quest for truth from his inquisitive childhood to the influence of family and church, to Morehouse College, Crozer Theological Seminary, Boston University, and other academic institutions in the Northeast. Continuing on, the book follows King's sense that he was involved in experiments of truth within the context of the struggle to liberate and empower humanity, to his understanding of the civil rights movement as unfolding truth, to his persistent challenge to America around its need to engage in a serious reckoning with truth regarding its history and heritage. Baldwin investigates King's determination to speak truth to power, and his untiring efforts to actualize what he envisioned as the truthful ends of the beloved community through the truthful means of nonviolent direct action. King believed, taught, and demonstrated by example that truth derives from a revolution in the heart, mind, and soul before it can be translated into institutions and structures that guarantee freedom, justice, human dignity, equality of opportunity, and peace. Ultimately, King's significance for humanity cannot be considered only his contributions as a preacher, pastor, civil rights leader, and world figure--he was and remains equally impactful as a theologian, philosopher, and ethicist whose life and thought evince an enduring search for and commitment to truth. While the early Confucians were largely content to maintain the rituals of ancient kings as the core of moral education in their time, it is not obvious that contemporary humans could, or should, draw from the particulars of such a tradition. Indeed, even if one takes ritual seriously as a tool for cultivation, there remains a question of how to design moral education programs incorporating ritual. This essay examines impediments faced by a ritualized approach to moral education, how they might (...) be overcome, and how a ritual method could be developed in modernity. I contend that a Confucian notion of ritual, particularly as elaborated in the Xunzi, is both compatible with modern moral education and capable of making a distinct contribution to moral education in terms of how rituals can be used to structure and inculcate a shared climate of respect and humaneness both in- and outside the classroom. Specifically, the ritual education method includes emphases on inculcating moral fluency via symbolic practices and distinctions, training and appropriately associating promoral dispositions, enhancing moral imagination, and developing awareness of other minds. The model is thus a multifaceted approach to moral education through (meta)cognitive development. (shrink)

In the literature, revelation is often thought of as intuitive but in tension with physicalism. While mentions of revelation are frequent, there is room for further discussion of how precisely to formulate the thesis of revelation and what it exactly amounts to. In this paper, we defend a traditional approach to semantics, that holds that the outputs of compositional semantics are propositional, i.e. truth conditions. Though traditional, this view has been challenged on a number of fronts over the years. Since classic work of Lewis, arguments have been offered which purport to show that semantic composition requires values that are relativized, e.g. to times, or other parameters that render them no longer propositional. Focusing in recent variants of these arguments involving quantification (...) and binding, we argue that a correct understanding of how composition works gives no reason to relativize semantic values, and that propositional semantic values are in fact the preferred option. We take our argument to be mainly empirical, but along the way, we defend some more general theses. Simple propositional semantic values are viable in composition, we maintain, because composition is itself a complex phenomenon, involving multiple modes of composition. Furthermore, some composition principles make adjustments to the meanings of constituents in the course of composition. These adjustments are by triggered syntactic environments. We argue such small contributions of meaning from syntactic structure are acceptable. (shrink)

Whenever sovereignty is defined as a supreme, absolute, unfettered and unlimited power, there is an obvious contradiction between two ideas: that states are sovereign and that they can or should be limited. Nevertheless, while many legal texts proclaim sovereignty, there are several signs that states are indeed limited by constitutional or international law. In light of this situation, some authors claim that those texts are mere proclamations and that sovereignty is an obsolete concept, while others argue that states are still (...) sovereign and that there are no real limits, but others still try to conceive of sovereignty as limited by morality or natural law. Professor Benvenisti’s remarkable theory of sovereigns as trustees of humanity is part of a very old tradition going back to the sixteenth century where sovereignty was defined as an absolute power, which is unlimited by positive law, yet based on and limited by natural law. This Article tries to show that this concept of sovereignty has emerged because of the necessity to provide a final point of imputation to the hierarchy of norms, and that the limitation by natural law was part of the original definition. Sovereignty so defined can usefully justify not only the power of kings and lawmakers but also that of courts trying to control kings and lawmakers. (shrink)

This paper provides an overview of the history of the notion of essence in 20th century analytic philosophy, focusing on views held by influential analytic philosophers who discussed, or relied on essence or cognate notions in their works. It in particular covers Russell and Moore’s different approaches to essence before and after breaking with British idealism, the (pre- and post-)logical positivists’ critique of metaphysics and rejection of essence (Wittgenstein, Carnap, Schlick, Stebbing), the tendency to loosen the notion of logical necessity (...) to accommodate certain metaphysical truths in Wittgenstein and others, Quine’s logical rehabilitation of metaphysics and criticism of de re modality, the modal view of essence promoted by the development of quantified modal logic (C. I. Lewis, Barcan Marcus, Kripke) and direct reference theory (Barcan Marcus, Kripke, Putnam), and the emergence of the notion of metaphysical necessity (Kneale, Kripke), and finally Fine’s re-establishment of a Neo-Aristotelian, hyperintensional notion of essence in contemporary metaphysics. Reductionist realist accounts of certain entities, such as the natural numbers and propositions, have been taken to be fatally undermined by what we may call the problem of arbitrary identification. The problem is that there are multiple and equally adequate reductions of the natural numbers to sets (see Benacerraf, 1965), as well as of propositions to unstructured or structured entities (see, e.g., Bealer, 1998; King, Soames, & Speaks, 2014; Melia, 1992). This paper sets out to solve the problem by (...) canvassing what we may call the arbitrary reference strategy. The main claims of such strategy are 2. First, we do not know which objects are the referents of proposition and numerical terms since their reference is fixed arbitrarily. Second, our ignorance of which object is picked out as the referent does not entail that no object is referred to by the relevant expression. In the 1950’s Quine rejected the analytic/synthetic distinction insisting, instead,on language conceived of as a tool created by mankind for practical purposes, and this move allowed him to overcome the strictures of a purely analytic conception of language by resorting, instead, to the pragmatist tradition represented by thinkers like James, Peirce and Dewey and C.I. Lewis. In the subsequent phases of his philosophical development, however, his commitment to pragmatism became looser, maybe because Dewey and the other main fi gures (...) of American classical pragmatism always stress the practical side of the scientifi c enterprise, thus not giving too much importance to the construction of artificial languages. What kind of metaphysics, if any, cana pragmatically oriented philosopher consistently endorse? All we have to do is to envision a more modest concept of metaphysics. A pragmatist metaphysics can indeed be construed, provided we recall that metaphysics – just like science – evolves with the passing of time. An author like Rescher follows this path. Nowhere he presents his own system as giving the “final” answer to all metaphysical, epistemic or ethical interrogatives. After all, if science is no longer held to give the ultimate answers, why should such a burden be put on the philosopher’s shoulders? (shrink)

This book contains remarkable photographs taken on the ‘lost’ fifth floor of Lewis’s by photographer Stephen King. They capture the remarkable history and former glory.

In his 1988 review of On the Plurality of Worlds (Lycan [1988]), William Lycan argued that what he called Lewis's 'mad-dog modal realism' (also 'rape-and-loot modal realism' and 'nuclear-holocaust modal realism' - I suspect that some reference to the supposed extremity of Lewis's position is intended) rested upon an unanalysed modal notion. Lycan accepted that actualists all seemed to be stuck with such unanalysed notions (adding that his own was the notion of compatibility as applied to pairs of (...) properties), but argued that Lewis's notion of worlds was also a modal primitive: 'World' for him has to mean 'possible world', since the very flesh-and-bloodiness [which relieves him of the sort of abstraction indulged in by actualists] prevents him from admitting impossibilia. (Lycan [1988], p.46) Lycan's main concerns in this review go back to his earlier paper 'The Trouble with Possible Worlds' (Lycan [1979]), and are taken up again in his PAS paper: The ruling out of impossible worlds is a serious liability [...] For semantics needs impossible worlds. Though standard modal logics may trade just in possible states of affairs, the semantics of conditionals must deal with inconsistent beliefs. (Lycan [1991], p.224) He goes on to claim that the actualist has no problem with impossible worlds. An impossible world is just - e.g. - a set of propositions (one of which happens to be inconsistent). (loc.cit.) Whatever the truth of this in principle, most actualists have either explicitly or implicitly excluded possible worlds from their theories.* It is true, nevertheless, that Lewis has a clear problem with the very idea of worlds at which logically incompatible propositions are true. The guides "Care after research" are mainly directed to members of the 79 NHS committees of research ethics (RECs) and to those who submit their research to these committees. This is a very advanced draft document, worked in several meetings, for more than three years, that has been discussed with study participants and community members, members and chairs of RECs in the UK, international specialists in research ethics, industry representatives and other stakeholders. The drafting of the guidelines is the result of the collaboration of Neema Sofaer and Penney Lewis, both researchers at King's College London, at the Centre of Medical Law and Ethics of Dickson Poon School of Law, and Hugh Davies, Research Ethics Advisor of the Health Research Authority (HRA) of the NHS. The translator of this document, Ignacio Mastroleo, attended the workshop at the Brocher Foundation (Geneva, Switzerland, December 2011) where draft version 7.0 was revised and contributed in the revision of draft version 8.0 during 2012. Michel de Montaigne (1533–1592), author of the Essays (published in successive, revised and expanded editions from 1580 until after his death), deserves to be recognized as the first) philosophic architect of modern liberalism, that is, a doctrine that advocates the advancement of individual liberty (under law), and consequently a reduction in the scope and purpose of government to securing what are represented by Montaigne’s successors (Hobbes, Locke, Montesquieu, and the American Founders) as people’s inherent rights to their life, liberty, property, (...) and the “pursuit of happiness” as they conceive it. His outward, periodic professions of extreme conservatism and of homage to the Catholic Church are merely a rhetorical cover designed to protect the author from being persecuted (and his book from being banned). As a practitioner of what he describes as esoteric rhetoric (attributing it to the ancient political philosophers), Montaigne invites careful readers to see through his rhetorical concealment by noting how his conservative professions are undermined by the overall train of his reasoning and argument. Although Montaigne’s argument for liberal individualism may have gone too far in its influence over the long run (that is, the 21st century), we citizens of modern liberal regimes owe him a debt of gratitude for helping to liberate us from the reign of arbitrary monarchs, oppressive aristocrats, and clerical oppressors. Divers (2014) argues that a Lewisian theory of modality which includes both counterpart theory and modal realism cannot account for the truth of certain intuitively true modal sentences involving cross-world comparatives. The main purpose of this paper is to defend the Lewisian theory against Divers’s challenge by developing a response strategy based on a degree-theoretic treatment of comparatives and by showing that this treatment is compatible with the theory.
