While reflexivity is seen as a not-to-be-missed concept in professional training, references to design pedagogical devices to enhance actors’ reflective capacities on their professional situations and to foster their professional and personal development are scarce and embedded in a patchwork of theoretical and practical approaches. As designers of such devices in agricultural higher education, our practical experiences, theoretical background and discussions led us to build a model of reflexivity as five intertwined key dimensions. These dimensions deal with aspects of reflexivity (...) that it is possible to work on directly with learners by using appropriate scaffolding methods, which we describe and illustrate in this paper, referring to our teaching experiences. Cancers rely on multiple, heterogeneous processes at different scales, pertaining to many biomedical fields. Therefore, understanding cancer is necessarily an interdisciplinary task that requires placing specialised experimental and clinical research into a broader conceptual, theoretical, and methodological framework. Without such a framework, oncology will collect piecemeal results, with scant dialogue between the different scientific communities studying cancer. We argue that one important way forward in service of a more successful dialogue is through greater integration of applied sciences (experimental and clinical) (...) with conceptual and theoretical approaches, informed by philosophical methods. By way of illustration, we explore six central themes: (i) the role of mutations in cancer; (ii) the clonal evolution of cancer cells; (iii) the relationship between cancer and multicellularity; (iv) the tumour microenvironment; (v) the immune system; and (vi) stem cells. In each case, we examine open questions in the scientific literature through a philosophical methodology and show the benefit of such a synergy for the scientific and medical understanding of cancer. Background: Studies on autistic strengths are often focused on what they reveal about autistic intelligence and, in some cases, exceptional and atypical reasoning abilities. An emerging research trend has demonstrated how interests and strengths often evident in autism can be harnessed in interventions to promote the well-being, adaptive, academic and professional success of autistic people. However, abilities in certain domains may be accompanied by major limitations in others, as well as psychiatric and behavioral issues, which may challenge their inclusion in (...) support programs. Objectives: To provide an in-depth, pragmatic, real-life example of the psychological and psychiatric management of interests and strengths in an autistic adolescent. Method: An autistic teenager, C.A., with above-average calendar calculation and musical abilities, received psychiatric, neuropsychological, and language standardized and clinical assessments, combined with a measurement of his musical and calendar calculation abilities. C.A. and his parents then received psychiatric and psychological support over a 14-month period, targeting their perceptions of C.A.’s interests, strengths, and co-occurring difficulties. Results: C.A. had a verbal IQ within the intellectual disability range and a non-verbal IQ in the low mean range. Modest calendar calculation, absolute pitch, and matrix abilities coexisted with severe receptive and expressive language disorder. The discrepancy between his abilities in areas of strengths and his limitations in other domains led to anxiety, frustration, and sometimes behavioral issues. Displacing the focus from academic performance to interests, as well as promoting the use of his strengths to develop new skills independently of their short-term adaptive benefits yielded positive effects on C.A.’s self-assessment, quality of life, and behavior at follow up. Discussion: The appealing idea that abilities mostly found in autistic people, such as calendar calculation, can be directly harnessed into academic achievement and lead to paid employment may have detrimental effects, especially when such abilities are modest and associated with other limitations. These abilities should be primarily used to maximize well-being and quality of life, independently of their short-term adaptive function, which may or may not be positive. (shrink)

The internet provides us with a multitude of ways of interacting with one another. In discussions about how technological innovations impact and shape our interpersonal interactions, there is a tendency to assume that encountering people online is essentially different to encountering people offline. Yet, individuals report feeling a sense of togetherness with one another online that echoes offline descriptions. I consider how we can understand people’s experiences of being together with others online, at least in certain instances, as arising out (...) of their feeling together as a we. Using Walther’s phenomenological framework of communality, I explore whether the following might take place online: habitual communal experiences and actual we-experiences. While neither of these sketches amount to a full account of how we find ourselves with others online, I suggest that they reveal how insights from the phenomenology of sociality can be used to deepen our understanding of online communality. What is more, I suggest that the strength of this approach is that in some cases it allows us to circumvent tricky questions about embodiment online and, in others, prompts us to ask to what extent a fully-embodied interaction is really required for we-experiences. Lucy Allais presents an original interpretation of Kant's transcendental idealism. She argues that his distinction between things in themselves and things as they appear to us has both epistemological and metaphysical components. Kant is committed to a genuine idealism about things as they appear to us, but this is not a phenomenalist idealism. He is committed to the claim that there is an aspect of reality that grounds mind-dependent spatio-temporal objects, and which we cannot cognize, but he does not assert (...) the existence of distinct non-spatio-temporal objects. On Allais's account, we cannot understand Kant's idealism without a clear account of his notion of intuition and of the role of intuition in cognition: she understands Kantian intuitions as representations that give us acquaintance with the objects of thought. This enables us to make sense of Kant's central argument for his idealism in the Transcendental Aesthetic, and to see why he takes the complete idealist position to be established there. (shrink)

When I started reading Sara Protasi’s book, The Philosophy of Envy, I was excited to learn more about an emotion I thought I rarely experienced. In the opening pages, I found myself nodding along as Protasi quotes her mother saying: “I never feel envy, but I often feel jealousy!” (6). But envy, it turns out, is sneaky, often masking itself in the guise of other emotions, hiding just below the surface. What this meticulously argued book unveils is both a nuanced (...) taxonomy of different kinds of envy and the intimate relationship that envy has to all manner of other emotions, including jealousy, shame, resentment, despair, and love. I now recognize that not only am I more familiar with envy than I supposed, but I experience envy rather often. This got me thinking about other instances of envy that I experience which I have previously overlooked or perhaps mislabeled. Prompted by Protasi’s insightful handling of envy in its varied forms, one question kept coming back to me: can you envy yourself? (shrink)

In this chapter, I consider three ‘promises’ of bringing phenomenology into dialogue with networked learning. First, a ‘conceptual promise’, which draws attention to conceptual resources in phenomenology that can inspire and inform how we understand, conceive of, and uncover experiences of participants in networked learning activities and environments. Second, a ‘methodological promise’, which outlines a variety of ways that phenomenological methodologies and concepts can be put to use in empirical research in networked learning. And third, a ‘critical promise’, which suggests (...) how work done in the realm of critical phenomenology is complementary to and useful for exploring the social justice and emancipatory aims of networked learning researchers. Through this framework, I reflect upon multiple ways in which phenomenology has and might continue to fruitfully inform and shape networked learning research. In doing so, I emphasise that deploying phenomenology in the context of networked learning not only enriches our understanding of networked learning but that phenomenology itself is enriched through testing, finetuning, and expanding its methods, concepts, and understanding, as well as unveiling its own limitations and constraints. The Swiss philosopher Anton Marty (Schwyz, 1847 - Prague, 1914) belongs, with Carl Stumpf, to the first circle of Brentano’s pupils. Within Brentano’s school (and, to some extent, in the secondary literature), Marty has often been considered (in particular by Meinong) a kind of would-be epigone of his master (Fisette & Fréchette 2007: 61-2). There is no doubt that Brentano’s doctrine often provides Marty with his philosophical starting points. But Marty often arrives at original conclusions which are diametrically opposed to (...) Brentano’s views. This is true of his views about space and time and about judgment, emotions and intentionality. In the latter case, for example, Marty develops Brentano’s view and its implications in great detail (Mulligan 1989; Rollinger 2004), but uses them to formulate a very unBrentanian account of intentionality as a relation of ideal assimilation (Chrudzimski 1999; Cesalli & Taieb 2013). Marty’s philosophy of language, on the other hand, is one of the first philosophies worthy of the name. In what follows, we contrast briefly their accounts of (i) judgment and states of affairs and of (ii) emotings and value (two topics of foremost significance, for Brentano and Marty’s theoretical and practical philosophies respectively) (§1), and their philosophies of language (§2). Brentano’s view of language is based on his philosophy of mind. Marty takes over the latter and turns a couple of claims by Brentano about language into a sophisticated philosophy of language of a kind made familiar much later by Grice. Marty’s philosophy of states of affairs and value and of the mind’s relations to these also takes off from views sketched by the early Brentano, views forcefully rejected by the later Brentano. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit (...) and The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. On interprète assez souvent le succès actuel des médecines parallèles comme une réaction à une double insatisfaction que la médecine scientifique laisse au patient dans nos sociétés occidentales. D'une part, la difficulté d'être entendu comme sujet dans sa maladie, comme une personne globale affectée dans la totalité de son être, dans le sens qu'elle donne à sa vie, à ses relations, etc. Et d'autre part, la difficulté d'être appréhendé d'une manière unitaire par le médecin, corps et esprit réunis. Les différents (...) auteurs de cet ouvrage, qu'ils soient théologiens, philosophes, médecins ou historiens de la médecine, ont tous pris au sérieux ces appels à dépasser ce que l'on peut appeler les impasses de la biomédecine en proposant, selon différentes inspirations, une anthropologie renouvelée du corps humain. En particulier, s'il s'agit de faire droit aux convictions du patient et du professionnel de santé, à quelles conditions - épistémologiques mais aussi politiques - un dialogue entre l'Eglise et la science peut-il s'avérer légitime et fécond? Que peuvent nous apprendre les écrits hippocratiques et les textes bibliques pour construire une autre représentation du corps humain et de la maladie? Le modèle des soins palliatifs ne pourrait-il pas fournir à la biomédecine un nouveau paradigme de prise en charge du patient où celui-ci reste un sujet, capable de relation, une personne jusqu'au bout? Despite its long history of investigating sociality, phenomenology has, to date, said little about online sociality. The phenomenological tradition typically claims that empathy is the fundamental way in which we experience others and their experiences. While empathy is discussed almost exclusively in the context of face-to-face interaction, I claim that we can empathetically perceive others and their experiences in certain online situations. Drawing upon the phenomenological distinction between the physical, objective body and the expressive, lived body, I: (i) highlight that (...) empathy involves perceiving the other’s expressive, lived body, (ii) show that the lived body is not tied to the physical body and that empathy can take place outside of face-to-face interactions, and (iii) argue that the lived body can enter online space and is empathetically available to others there. I explore two ways in which the other’s lived body enters online space and can be empathetically perceived: first, in cases where our face-to-face encounter is technologically-mediated over video link and, second, by showing how the other’s texts, as speech, can form part of the other’s lived body. Investigating empathy online not only furthers our understanding of online encounters but also leads to a refined conception of empathy more generally. (shrink)

Since the advent of the internet, researchers have been interested in the intersubjective possibilities and constraints that digital environments offer users. In the literature, we find some who argue that seemingly disembodied digitally mediated interactions are severely limited when compared to their embodied face-to-face counterparts and others who are more optimistic about the possibilities that such technologies afford. Yet, both camps tend towards offering what we see as static accounts of online intersubjectivity – accounts that attempt to determine the very (...) possibilities and constraints of digital platforms based upon their design. What we think these approaches fail to take into account is how users’ intersubjective capabilities on digital platforms can evolve and change over time. Developmental psychology emphasises the way in which intersubjective capabilities build upon and are interrelated to one another, allowing for more sophisticated styles of intersubjectivity to emerge only once earlier stages are already in place. We find this suggestive for analysing intersubjectivity online as it provides a framework for thinking about how various an individual’s intersubjective capabilities might develop. We argue that in some cases this can happen through gradual adjustments of our basic intersubjective capabilities to digital spaces, especially those that strive to mimic established forms of offline interaction (e.g., Zoom). In other cases, this can involve more substantial processes of learning to walk and talk again online. Consequently, determining the possibilities and limits of online intersubjectivity is, at least in part, relative to a user’s skill, history, and familiarity with the technology in question. This chapter provides a brief overview of the increasing importance of experimentation in the life sciences from the seventeenth century to the present day. In the wake of the Scientific Revolution initiated in physics, numerous scientists have regularly attempted to introduce experimentation and the quantification of phenomena into the life sciences. These attempts have been difficult and have systematically come up against the fact that living organisms are individuals, i.e. both totalities that are difficult to decompose and transient results of (...) an evolutionary process that gives them specific characteristics. Experimentation has thus only been possible in biology thanks to the adaptation of a mechanistic perspective to such particularities of living bodies. (shrink)

During the Covid-19 pandemic we increasingly turned to technology to stay in touch with our family, friends, and colleagues. Even as lockdowns and restrictions ease many are encouraging us to embrace the replacement of face-to-face encounters with technologically mediated ones. Yet, as philosophers of technology have highlighted, technology can transform the situations we find ourselves in. Drawing insights from the phenomenology of sociality, we consider how digitally-enabled forms of communication and sociality impact our experience of one another. In particular, we (...) draw attention to the way in which our embodied experience of one another is altered when we meet in digital spaces, taking as our focus the themes of perceptual access, intercorporeality, shared space, transitional spaces, and self-presentation. In light of the way in which technological mediation alters various dimensions of our social encounters, we argue that digital encounters constitute their own forms of sociality requiring their own phenomenological analysis. We conclude our paper by raising some broader concerns about the very framework of thinking about digitally and non-digitally mediated social encounters simply in terms of replacement. (shrink)

Anorexia Nervosa (AN) is a complex disorder characterised by self-starvation, an act of self-destruction. It is often described as a disorder marked by paradoxes and, despite extensive research attention, is still not well understood. Much AN research focuses upon the distorted body image that individuals with AN supposedly experience. However, based upon reports from individuals describing their own experience of AN, I argue that their bodily experience is much more complex than this focus might lead us to believe. Such research (...) often presents an overly cognitive understanding of bodily experience in AN, underplaying the affective, felt experience of individuals with AN, as well as descriptions of empowerment, strength and control reported in the early stages of AN. This paper seeks to enrich our understanding of bodily experience in AN as it progresses throughout the various stages of the disorder. I show how the classical phenomenological distinction between the body-as-subject and the body-as-object, as well as Leder’s conception of the visceral body, can inform our understanding of bodily experience in AN. I suggest that the project of self-starvation is an attempt to overcome the noisy demands of the visceral body, which are experienced as threatening the body-as-subject, through a process of objectifying the body-as-object. By cashing out AN as a project of radical bodily control that, tragically, comes to control the individual, we can capture important aspects of the bodily experience of AN and the temporal progression of the disorder. -/- . In this paper, we introduce the Japanese philosopher Tetsurō Watsuji’s phenomenology of aidagara (“betweenness”) and use his analysis in the contemporary context of online space. We argue that Watsuji develops a prescient analysis anticipating modern technologically-mediated forms of expression and engagement. More precisely, we show that instead of adopting a traditional phenomenological focus on face-to-face interaction, Watsuji argues that communication technologies — which now include Internet-enabled technologies and spaces — are expressive vehicles enabling new forms of emotional expression, shared experiences, (...) and modes of betweenness that would be otherwise inaccessible. Using Watsuji’s phenomenological analysis, we argue that the Internet is not simply a sophisticated form of communication technology that expresses our subjective spatiality (although it is), but that it actually gives rise to new forms of subjective spatiality itself. We conclude with an exploration of how certain aspects of our online interconnections are hidden from lay users in ways that have significant political and ethical implications. (shrink)

L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Ce livre propose alors une réflexion épistémologique sur l'un des grands enjeux de l'historiographie juridique contemporaine : peut-on penser l'ordre juridique médiéval et moderne à partir des catégories juridiques contemporaines? Anscombe thought that practical knowledge – a person’s knowledge of what she is intentionally doing – displays formal differences to ordinary empirical, or ‘speculative’, knowledge. I suggest these differences rest on the fact that practical knowledge involves intention analogously to how speculative knowledge involves belief. But this claim conflicts with the standard conception of knowledge, according to which knowledge is an inherently belief-involving phenomenon. Building on John Hyman’s account of knowledge as the ability to use a fact as a reason, (...) I develop an alternative, two-tier, epistemology which allows that knowledge might really come in a belief-involving and an intention-involving form. (shrink)

Anorexia Nervosa (AN) is an eating disorder characterised by self-starvation. Accounts of AN typically frame the disorder in individualistic terms: e.g., genetic predisposition, perceptual disturbances of body size and shape, experiential bodily disturbances. Without disputing the role these factors may play in developing AN, we instead draw attention to the way disordered eating practices in AN are actively supported by others. Specifically, we consider how Pro-Anorexia (ProAna) websites—which provide support and solidarity, tips, motivational content, a sense of community, and understanding (...) to individuals with AN—help drive and maintain AN practices. We use C. Thi Nguyen’s work on epistemic “echo chambers”, along with Maria Lugones’ work on “worlds” and “ease”, to explore the dynamics of these processes. Adopting this broader temporal and intersubjective perspective, we argue, not only helps to further illuminate the experiential character of AN but also has important clinical and therapeutic significance. Bruno Latour and Steve Woolgar made use of Gaston Bachelard’s concept of phenomenotechnique in Laboratory Life. Stating that this use of a Bachelardian concept contrasts with the sharp criticism Latour made of Bachelard in his later work, I consider whether it belongs to an early Bachelardian stage of Latour’s study of science or whether Latour and Woolgar made, from the beginning, an original and anti-Bachelardian use of the concept of phenomenotechnique. I address this question by offering two symmetrical readings of (...) Laboratory Life: one reading adopts a Bachelardian perspective, in which Latour and Woolgar’s ethnological and sociological investigation appears as an empirical corroboration of Bachelard’s epistemological theses, whereas the other reading insists on the way in which Latour and Woolgar depart from Bachelard, as the sociological study of the way in which power relations shape scientific practice challenges the latter’s rationalist convictions. Although I contrast Bachelard’s epistemological use of the concept of phenomenotechnique with Latour and Woolgar’s sociological one, I wonder in the conclusion whether these approaches to science may be regarded as complements rather than antagonists and find in Pierre Bourdieu’s theses on the specificity of the scientific field resources to combine them. This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Craig Callender claims that ‘time is the great informer’, meaning that the directions in which our ‘best’ physical theories inform are temporal. This is intended to be a metaphysical claim, and as such expresses a relationship between the physical world and information-gathering systems such as ourselves. This article gives two counterexamples to this claim, illustrating the fact that time and informative strength doubly dissociate, so the claim cannot be about physical theories in general. The first is a case where physical (...) theories inform in directions that we have no reason to regard as temporal. The second is a case where our best physical theories fail to inform in directions that we have independent (pre-theoretic) reasons to regard as temporal. Taking these two cases into account suggests that the connection Callender makes between time and informativeness is perspectival. The second case demonstrates that although scientists often seek information in temporal directions, the behaviour of the physical world can present serious difficulties for finding it. In response, this article proposes a perspectival reading of Callender’s claim, according to which the connection between time and informative strength has more to do with the aims and objectives of science than the workings of the physical world. Qu'est-ce qu'être Vivant? - S'agit-il de " se conserver " et de " croître "? de " sélectionner " des " mutations utiles "? Si Vivre implique la recherche et l'obtention de conditions favorables, n'y a-t-il de vie qu'à distance de la mort? Cependant et non sans suivre certains philosophes tels Nietzsche ou Bataille, la biologie cellulaire ne nous enseigne-t-elle pas que Vivre implique de ne précisément pas cesser de " correspondre " avec la Mort? Le " dialogue " entre (...) la tendance de toute cellule à se laisser disparaître & la suspension de cette tendance chez toute cellule qui reste en Vie ne réfute-t-il pas l'antique suprématie - de Platon au néodarwinisme - de la vie sur la mort? Les recherches contemporaines sur l'auto-effacement cellulaire - sur l'" apoptose " et la Mort cellulaire " programmée " - permettent d'aborder ces questions en détail. Elles supposent, avec l'équivocité des phénomènes Vitaux, une dialectique Vie-Mort dont l'issue n'est nullement acquise d'avance. Elles nous invitent à repenser le sens même de la conservation, incorporant y compris en ses forces les plus Vives quelque chose comme l'a-Mort. En définitive, les concepts issus de la recherche en biologie cellulaire et l'interprétation épistémologique et philosophique qu'il est possible d'en donner ne concernent pas exclusivement des processus et des entités cellulaires. Notre Vie déployée dans la connaissance, dans l'art ou dans l'amour de la Vie jusque dans la Mort, répond, elle aussi, d'une telle équivocité. (shrink)

This paper looks at the possibilities of using biographical research in social work focusing on the elderly. Social work with the elderly uses or should use biographical data to create individual plans for clients or for the purpose of sensory activation. Narrative interviews are a form of interaction between a senior client and a social worker. The social worker supports the senior’s narrative so they can view their life for themselves and explain its meaning from their own perspective. The use (...) of sensory activation in social work is only possible when the individual’s identity is supported by a sufficient amount of environmental stimuli, which can be achieved only by acquiring and analyzing data on the life events of the individual. The paper contains examples of the use of biographical data in social work with the elderly, which is essential for further structuring their lives. (shrink)

L'homme ne se rapporte droitement a lui-meme qu'en se rapportant a la totalite du monde qui l'entoure. Ce monde qui est unique selon Platon, sans qu'il soit double par le monde intelligible dont parlera le neoplatonisme, est rendu possible par la rencontre de l'intelligible et du sensible. Ainsi, le logos, par quoi l'homme a acces aux Formes, est ce qui permet d'operer la deliaison proprement philosophique du corps et de l'ame, selon les termes du Phedon, sans qu'il faille poser un (...) dualisme cosmique qui se retrouverait dans l'homme. De meme que le sensible s'intelligibilise par la Participation et ainsi se maintient comme phenomene stable, de meme l'homme peut avoir un usage harmonieux de son corps et de ses sensations. Deliaison n'est pas rupture. L'enfance, la sexuation, le sommeil, les reves, la mort et la parole, ici interroges, montrent que l'anthropologie de Platon ne condamne ni le plaisir, ni le corps. La vie de la pensee ne s'absente pas des mouvements corporels qu'elle accompagne. C'est pourquoi le corps est le signe de l'ame. (shrink)

Retrace l'histoire du néant en Occident en étudiant ses étapes décisives et ses principales désignations.

Toutes les democraties egalitaires, detribalisees et secularisees d'Occident sont confrontees aux memes defis du communautarisme et de la reislamisation d'une partie de l'immigration - accrus par un continuel afflux de clandestins : le probleme de l'integration se pose donc moins en termes franco-francais de Republique que plus globalement de societe ouverte. Dans la perspective de Karl Popper et en usant de la liberte d'esprit et de parole chere a Jean-Francois Revel, il s'agit ici, a partir des faits, de montrer que (...) cette situation critique resulte d'abord de la forfaiture morale et parfois juridique de politiques qui n'ont pas voulu faire respecter ledroit commun democratique. Mais, surtout et en amont, de l'emprise d'une ideologie pretendument antiraciste, sans-frontieriste et acquise au relativisme multiculturel qui a perverti les valeurs de tolerance et d'ouverture: en elle se retrouvent les veritables et paradoxaux nouveaux ennemis de la societe ouverte. Faisant grand cas de l'emergence d'une resistance intellectuelle de tradition anti-totalitaire a cette bien-pensance et du combat emancipateur des musulmans libres, cette reflexion pointe le pathos masochiste qui fait oeuvrer les societes ouvertes contre elles-memes. Sans oublier d'explorer les conditions d'une ouverture raisonnee a l'alterite. (shrink)

This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada et cetera), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of (...) practices on "real legal life." It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems - the idea being not to replace statutory law, but to complement it with customary observations. At the beginning of the COVID-19 pandemic, high hopes were placed on digital contact tracing. Digital contact tracing apps can now be downloaded in many countries, but as further waves of COVID-19 tear through much of the northern hemisphere, these apps are playing a less important role in interrupting chains of infection than anticipated. We argue that one of the reasons for this is that most countries have opted for decentralised apps, which cannot provide a means of rapidly informing users (...) of likely infections while avoiding too many false positive reports. Centralised apps, in contrast, have the potential to do this. But policy making was influenced by public debates about the right app configuration, which have tended to focus heavily on privacy, and are driven by the assumption that decentralised apps are “privacy preserving by design”. We show that both types of apps are in fact vulnerable to privacy breaches, and, drawing on principles from safety engineering and risk analysis, compare the risks of centralised and decentralised systems along two dimensions, namely the probability of possible breaches and their severity. We conclude that a centralised app may in fact minimise overall ethical risk, and contend that we must reassess our approach to digital contact tracing, and should, more generally, be cautious about a myopic focus on privacy when conducting ethical assessments of data technologies. After a long period of comparative neglect, in the last few decades growing numbers of philosophers have been paying attention to the startling contrast presented between Kant’s universal moral theory, with its inspiring enlightenment ideas of human autonomy, equality and dignity and Kant’s racism. Against Charles Mills, who argues that the way to make Kant consistent is by attributing to him a threshold notion of moral personhood, according to which some races do not qualify for consideration under the categorical imperative, (...) I argue that Kant cannot be made consistent on race, and that rather than trying to make him so, we should use the example of Kant’s racism to tell us something about the nature of racism. I argue that Kant’s own moral philosophy and moral psychology in fact give some materials for thinking about his racism, and about racism. (shrink)

On a souvent résumé la présence importante des avocats dans la vie politique française sous la III e République à travers l’expression de « République des avocats. » De manière plus complexe, il s’agit de montrer comment les avocats sont au cœur, dans les premières décennies de la République, de la construction d’un champ politique marquée par la codification des règles électorales et une certaine démocratisation du personnel politique. Dans les décennies qui suivent, on note une diversification des formes d’investissement (...) du barreau en politique, moins marqué par l’investissement dans le champ politique proprement dit que par l’engagement à travers la défense judiciaire de causes. Seen as contributing to human enhancement, implanted technologies have recently been receiving a lot of attention. However, reflections on these technologies have taken the shape of rather speculative ethical judgments on “hyped” technological devices. On the other hand, while science and technology studies and philosophy of technology have a long tradition of analyzing how technological artifacts and tools transform and configure our lives, they tend to focus on use configurations rather than the intimate relations brought about by implanted technologies. Even (...) the cyborg has lost some of its hermeneutic power as it has been detached from its material grounds, becoming a discursive entity. In this article, I reclaim the importance of materiality and explore how people live with spinal cord stimulation, which is a type of neuromodulation technology. Implanted in bodies and seemingly out of sight, this technology does not cease to matter. Embodiment and incorporation are crucial for people to live well with SCS. Embodying the neuromodulation technology entails groping processes in which gestures are central and an increased intimacy with one’s bodily materiality. Incorporating it is highly relational and entangled with the bodies of loved and distant ones, humans and nonhumans. (shrink)

Uptake is typically understood as the hearer’s recognition of the speaker’s communicative intention. According to one theory of uptake, the hearer’s role is merely as a ratifier. The speaker, by expressing a particular communicative intention, predetermines what kind of illocutionary act she might perform. Her hearer can then render this act a success or a failure. Thus the hearer has no power over which act could be performed, but she does have some power over whether it is performed. Call this (...) the ratification theory of uptake. Several philosophers have recently endorsed an alternative theory of uptake, according to which the hearer can determine the nature of the act the speaker performs. According to this theory, if the hearer regards an utterance as illocutionary act y, then it is act y, even if the speaker intended to perform act x. Call this the constitution theory of uptake. The purported advantage of this theory is that it identifies a common but underanalysed way in which speakers can be silenced. I argue that despite its initial intuitive pull, the constitution theory of uptake should be rejected. It is incompatible with ordinary intuitions about speech, it entails a conceptual impossibility, and it has unsavoury political implications, entailing that marginalised speakers barely qualify as agents.
