Social health disparities are increasing in most countries around the world. During the past two decades, a large amount of evidence has emerged about the health consequences of social inequalities. Despite such evidence, the concept of medical fairness, as traditionally defined by the World Medical Association, has remained unchallenged and even reinforced by some scholars who emphasize that doctors should remain neutral to the socioeconomic status of their patients when providing clinical care. The inconsistency between public health and clinical care (...) perspectives raises tension between a narrow interpretation of the ethics of justice, which stresses the importance of equality and impartiality, and the ethics of care, which highlights the importance of particularity and individuality in clinical practice. This article analyzes the concept of medical fairness using the emerging evidence that demonstrates the impact of social health disparities on clinical care. It proposes a new approach of medical fairness based on equity rather than on equality and provides a consistent ethical framework based on Paul Ricoeur’s three levels of medical judgments. This integrative framework provides a better balance between public health and clinical care in medical practice. (shrink)

Societies change; and sociology has, since its inception, described and evaluated these changes. This article proposes a revised theory of collective learning processes, a conceptual framework which addresses ways in which people make sense of and cope with change. Drawing on Habermas’ classic proposal, but shifting the focus from argumentation towards storytelling, it explains how certain articulations allow for collective learning processes (imagining more inclusive orders), while others block learning processes (imagining more exclusive orders). More specifically, the article points to (...) narrative genres (romance, tragedy, comedy and irony) which organize feelings and shape the social bond, proposing that ironic and tragic stories have the potential to trigger collective learning processes, while romantic and comic stories tend to block them. Advance directives are critically important for capable individuals who wish to avoid the burdens of life-prolonging interventions in the advanced stages of dementia. However, this paper will argue that advance directives should have less application to questions about feeding patients during the clinical course of dementia than often has been presumed. The argument will be framed within the debate between Ronald Dworkin and Rebecca Dresser regarding the moral authority of precedent autonomy to determine an individual’s future end-of-life care plan. We (...) will use a brief analysis of the positions taken in two important papers that come out of the Dworkin/Dresser debate and a hypothetical patient, John, who will be followed from diagnosis of dementia to death, to show how advance directives should apply to key points in the progression of his disease, particularly in relation to food and nutrition. Clinical ethics consultants (CECs) often face some of the most difficult communication and interpersonal challenges that occur in hospitals, involving stressed stakeholders who express, with strong emotions, their preferences and concerns in situations of personal crisis and loss. In this article we will give examples of how much of the important work that ethics consultants perform in addressing clinical ethics conflicts is incompletely conceived and explained in the American Society of Bioethics and Humanities Core Competencies for Healthcare Ethics Consultation and (...) the clinical ethics literature. The work to which we refer is best conceptualized as a specialized type of interviewing, in which the emotional barriers of patients and their families or surrogates can be identified and addressed in light of relevant ethical obligations and values within the context of ethics facilitation. We highlight the need to focus on the underlying determinants and production mechanisms to fully understand the nature of facial expression of emotion and to settle the theoretical debate about the meaning of motor expression. Although emotion theorists have generally remained rather vague about the details of the process, this has been a central concern of componential appraisal theories. We describe the fundamental assumptions and predictions of this approach regarding the patterning of facial expressions for different emotions. We also review (...) recent evidence for the assumption that specific facial muscle movements may be reliable symptoms of certain appraisal outcomes and that facial expressions unfold over time on the basis of a sequence of appraisal check results. Appraisal theories of emotion have had a strong impact on the development of theory and experimental research in the domain of the affective sciences. While there is generally a high degree of convergence between theorists in this tradition, some central issues are open to debate. In this contribution three issues have been chosen for discussion: (a) varieties of relevance detection, (b) varieties of valence appraisal, and (c) sequential-cumulative effects of appraisal results. In addressing these issues, new theoretical ideas are suggested (...) and an update of recent research on the sequence of appraisal processes is provided. Comparatively little scholarly attention has been given to the question of futility in chronic psychiatric disorders, with the exception of a small body of work on so-called end-stage anorexia nervosa. A review of this literature provides the background for a critical examination of whether the concept of futility has any clinically meaningful, ethically justifiable, and legally defensible application to AN. In this article, the arguments for and against futility judgments in AN are analyzed with special emphasis on determinations of capacity (...) in this serious mental illness. Parallels between the futility disputes in medical and psychiatric disorders, where applicable, will be drawn to further illuminate whether or not the concept that continued psychiatric treatment for AN is ever truly futile. I show that in his De motu animalium Aristoteles proposes a teleology of the practical on the most general zoological level, i.e. on the level common to humans and self-moving animals. A teleology of the practical is a teleological account of the highest practical goals of animal and human self-motion. I argue that Aristotle conceives of such highest practical goals as goals that are contingently related to their realizations. When patients are admitted to the hospital, they are generally expected to remain in or within close proximity to their assigned rooms in order to promote their safety and appropriate medical care. Although there are circumstances when patients may safely leave their hospital room or floor, guidance within the medical literature for the management of patient movement within the hospital are lacking. Excessive restrictions on patient movement may be seen as overly paternalistic, while lax requirements may interfere with high quality (...) care, patient safety and efficient hospital practice. As a result, guidance in the form of institutional policy is warranted. Such policy development should take into consideration the potential clinical, legal, and ethical concerns in balancing the competing values of patients’ preferences and respect for autonomy, while ensuring high quality, safe, and efficacious medical care. This paper will provide a framework for hospitals to create institution-specific patient movement policies that are fair, systematic, and transparent. (shrink)

The goal of this paper is to propose a unified approach to the split scope readings of negative indefinites, comparative quantifiers, and numerals. There are two main observations that justify this approach. First, split scope shows the same kinds of restrictions across these different quantifiers. Second, split scope always involves low existential force. In our approach, following Sauerland, natural language determiner quantifiers are quantifiers over choice functions, of type <<,t>,t>. In split readings, the quantifier over choice functions scopes above other (...) operators (such as intensional verbs like must or can). Determiner quantifiers leave a choice-function trace when they move and this trace combines with the noun restriction, which is interpreted low. That split scope always involves low existential force is derived, without stipulation, from Kratzer’s idea that low existential force can be achieved via binding (into the noun restriction). This paper discusses Aristotle's notion of the practical syllogism. It is argued that the notion of ‘practical’ reasoning in the sense of reasoning which implies motion in one sense or the other is alien to Aristotle's philosophy of nature. All (at least in type) the relevant passages will be discussed. The outcome is that there are three different contexts in which it would be justified to speak of practical syllogisms: (i) human deliberation, (ii) the illustration of the triggering cause of (...) animal motion, and (iii) the teleological ex post explanationof human action. (i) is genuine, but non-deductive reasoning which does not immediately result in action/motion, whereas (ii) is not genuine reasoning, but an analogy with deductive reasoning. Finally, the relation between (i) and (ii) in Aristotle's theory of animal motion will be discussed. (shrink)

The aim of this chapter is to explain Aristotle’s definition of the vegetative part of the soul in the De anima from a methodological point of view. I discuss Aristotle’s conception of the soul and his conception of “parts of the soul” before I turn to his definition of the vegetative part of the soul in De anima II 4. I argue that the definition of the vegetative capacity is deliberately abstract so as to cover its various activities under one (...) common heading. I also argue that the De anima deliberately avoids a positive and determinate description of the activity of the soul that is properly responsible for the vegetative functions, and that Aristotle offers such a positive and determinate description in his works dedicated to the actions and affections “common to body and soul”. Grundzug der Herkunft ist die Selbstunterscheidung des biblischen Glaubens an den einen Wüstengott, der sich jeder lebensweltlichen Anschauung entzieht, (...) von dem in dieser Hinsicht eingängigeren Polytheismus. Als mögliche Zukunft zeichnet sich eine Tragödie ab: Der antipolytheistische Glaube treibt in seiner christlichen Spielart sich selbst gerade dadurch in den Untergang, dass er im Zeitalter der globalisierten Erfahrung der einen Welt in seine reine Gestalt gelangt und so einer radikalen Vergessenheit der Lebenswelt anheimfällt.
