At least, this is what numerous articles and books have unequivocally stated in the decades since Richard Rorty gave up his belief in orthodox analytical epistemology and settled into his own brand of John Dewey's antifoundational epistemology. Even though Rorty's interpretation and manipulation of Dewey have been controversial, we are all the better for the revival of discourse around what pragmatism was, is, and will be. Robert Westbrook's Democratic Hope: Pragmatism and the (...) Politics of Truth (2005), a recent contribution to this revival, clearly demonstrates the value of a vibrant and robust tradition of pragmatism to American intellectual and public life. The depth of knowledge and passion for the subject matter that made Westbrook's magnum opus, John Dewey and American Democracy (1991), a landmark study are on display in this text as well. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. One of the diverse currents was the Scholasticism in Evangelical Protestantism. Within the reformed Church, academies aimed explicitly at continuing and contributing to the theological and philosophical tradition of the entire Church. Several studies have in particular suggested continuity between Thomas Aquinas and philosophers and theologians of good standing in the reformed Church. The most recent study is Christopher Cleveland’s Thomism in John Owen.The subject of this study is well chosen. John Owen (1616-83) was an influential pastor, scholar, vice-chancellor of the University of Oxford, and chaplain of Oliver Cromwell. He received a first-rate education at Oxford and maintained a wide-ranging scholarship throughout his life. His complete works comprise twenty-four volumes in the critical edition, and these are often thorough and systematic. From his tutor and friend Thomas Barlow, Owen seems to have gained a deep and lifelong appreciation of Aquinas, Alvarez, Bañez, and other Scholastics.Cleveland rightly aims at a focused investigation. His purpose is to “expand the inquiry into Reformed Thomism” (17) and “examine the role of Thomism in the theology of John Owen” (2). By “Thomism” he means “Aquinas” and sometimes “Diego Alvarez and Domingo Bañez.” In the first chapter Cleveland outlines the book and surveys some of the secondary literature. In the second chapter he contends that Owen was influenced by Aquinas’s concept of actus purus in arguing divine simplicity, divine immutability, and divine concurrence. In the third and fourth chapters he asserts that Aquinas’s understanding of infused “habits” strengthened Owen’s explanation of justification and sanctification. In the fifth chapter Cleveland proposes that Owen’s account of the hypostatic union is greatly indebted to Aquinas. Strangely the author concludes that Owen’s thought represents “a Western Trinitarian Theology” although he does not treat Owen’s doctrine of the Trinity.This book is a laudable and well-needed attempt to determine the particular influence of Aquinas on Owen. However, Cleveland’s work would benefit from a greater methodological rigor. Let us first consider Cleveland’s criteria for tracing Aquinas’s influence. He suggests that there are “four categories into which Thomistic influence falls.” These are: (1) quotations or paraphrases of “Thomas or a Thomist author,” (2) the development of a subject by means of similar theological concepts, (3) the “use of similar but not identical principles,” and (4) a coincidence of thought because of a common source. The second criterion is said to identify the most common type of influence, and the fourth the rarest (3). Now, that Owen was influenced by Aquinas is not in contest; the question is: how was Owen influenced? And there are limitations to what can be drawn from the application of these categories. The first category is not decisive, since any [End Page 161] author may be quoted or paraphrased for widely various reasons, and some influential authors may not be quoted or paraphrased. In 1984, John W. Yolton published Perceptual Acquaintance from Descartes to Reid. His most recent book builds on that seminal work and greatly extends its relevance to issues in current philosophical debate. Perception and Reality examines the theories of perception implicit in the work of seventeenth- and eighteenth-century philosophers which centered on the question: How is knowledge of the body possible? That question raises issues of mind-body relation, the way that mentality links with physicality, and the nature of the (...) known world. In contrast to commonsense realism, which suggests that the world is as it appears to be, a more complex theory developed throughout this period. Yolton traces its evolution from Descartes to Kant, via Arnauld, Malebranche, Locke, Berkeley, and Hume. Yolton explains that the new theory postulated two interactive relations between perceivers and the physical world, one physical and causal, the other cognitive. An understanding of this double relation is important for an accurate construction of the history of philosophy. This group of essays has been discussed from time to time at the Center for the Study of Democratic Institutions in Santa Barbara, California. The essays provide an excellent survey of the various contexts in which the idea of natural law is functioning today: in jurisprudence, political theory, sciences, religions, and philosophies of culture. Though the emphasis is on "modem society," there is a large amount of history in this collection, going back to the ancients, and one of the most valuable features of the analysis is the evidence here offered that "natural law" has meant and still means many different things, and that this flexibility of meaning gives the idea an enduring vitality and relevance. This is the particular theme of Scott Buchanan's "Natural Law and Teleology", which chapter reviews almost the whole history of philosophy to show how the content of natural law has varied for teleological reasons. Since it is impossible to review this whole story, it seems simplest and least distorting to quote a series of passages from the essays so that the reader can estimate the range of subject-matter and the kind of observations in the volume : The natural lawyer who lacks a sense of history, a factual sense, is as seriously deficient as the one who has been victimmed by the historical setting of his own time. Social scientists are concerned with digging up and evaluating exactly the kind of factual material the conscientious natural lawyer needs (Cogley, pp. 24, 26). Westport, CT, and London: Bergin and Garvey, 1999, 165pp., $55 cloth.Concerned with the consequences of Jacques Derrida's philosophy of deconstruction for cultural and literary studies, Martin Schiralli's elegantly written book offers, first, a critique of these claims and, then, a constructive alternative analysis. He admires Derrida's brilliantly (...) innovative writing, which as he rightly notes is "serious and philosophical" even if "the most patient reader can easily become disoriented and confused" (24). But even if, as Derrida argues, Ferdinard de Saussure's theory of meaning is flawed, we need not—he urges—become deconstructionists. Looking to the work of Stephen Toulmin, John Dewey, and late Wittgenstein, Schiralli finds suggestive ways of identifying concerns with cognitive value in literary texts. It then is possible, he argues, to offer a more reasonable perspective on recent debates about culture and politics than the recent academic arguments between "postmodern revisionists... [and] often hostile and defensive traditionalists" (73).In the second part of his book Schiralli illustrates the value of this perspective by offering a great deal of productive positive discussion. He discusses how "theoretically pertinent knowledge" (95) may be found in the novels of Jane Austen, Barbara Pym, and Anita Brookner. Appealing to Michael Polanyi's conception of tacit knowledge, he argues that Austen's ability to intuit "the rules governing social meaning... represents the tacit emergence of insight, just as her ability to use those insights explicitly in her fiction marks the emergence of more focal knowledge" (123). In analyzing an emotional response, he claims, we can ask whether it is "warranted or unwarranted in a given circumstance" (31). Using E. M. Forster's Howards End as his model, he develops this claim in an analysis that is brief, clear, and convincing. Finally, in his concluding pages he looks at the studies of character provided by Henry James and Marcel Proust. A proper theory of literary intelligence, he argues, should "treat those forms of cognitive acuity involved imaginatively in miming and representing verbally the intricacies and particularities of all aspects of human sensibility" (150).This bold, far-reaching book avoids the fanaticism that, as Schiralli notes, has marred all too much recent debate in the humanities. At this time, when the influence of Derrida has faded, I think this argumentation about his philosophical position is of less value than the constructive parts of the analysis. Treating Derrida as a theorist whose arguments tell us how to analyze literature is an unpromising project, as Schiralli well shows. Once that point is acknowledged, then we are ready to look seriously at literature as a form of social knowledge. Humanists teaching literature will find much of value in this graceful volume—and along with their colleagues in philosophy, these scholars will benefit from study of this well-argued analysis. Just how is obscure. The logic of discovery is elusive; and it is harder to explain how we have come to see matters rightly than to recognize that we do, in fact, see them rightly. What counts as a theory, moreover, calls for explication as much as does a theory's emergence. (...) When we have in mind a theory that shapes our social vision, there is a progression from a central set of propositions, keyed to a range of paradigm cases and seen as a logical structure, to a " way of thinking " widely enough embraced to have political significance, at least for a given oommunity. In this essay I want to explore some fundamental questions raised by Germain Grisez's theory of natural law ethics.1 These questions are chiefly conceptual. HANINK As a point of chronology, Grisez's early study of rubortion was the context for one of the first formulations of his natural law ethics.2 But why should this have been so? And why should abortion so engage Catholic thinkers, some of whom had felt a distance from explicitly Catholic positions, that Grisez's work should become pivotal? Answers to such questions must be tentative, but they include the following considerations. In a brief period, no more than a decade, legal abortion in the West became entrenched social policy.8 It was a policy, too, supported by dominant intellectual forces. But the new policy, defended in terms of individual freedom and a right to privacy, struck many Catholicsand non-Catholics-as vicious and tragic. It was vicious in that it made expendable the weakest and most vulnerable human beings. Human rights somehow became restricted to the strong and self-sufficient. The policy was tragic in its denial of human community. We are not, however much radical individualism supposes, merely a collection of separate egos. l/Ve are, rather, a community tied to a past and pledged to a future, so pledged, in part, by the children we bear and nurture.4 For in hearing and nurturing children we carry on the love of parents who have done as much for us; and we carry ourselves into a future where we hope our own love will be thus extended. But abortion, and surely unrestricted abortion, betrays this community of trust. Still, a policy so vicious and tragic can make us look for a fresh moral vision. Herbert Blumer was a key figure in what came to be identified as the Chicago School of Sociology. He invented the term ‘symbolic interactionism’ as a label for a theoretical approach that derived primarily from the work of John Dewey, George Herbert Mead and Charles Cooley. But his most influential work was methodological in character, and he is generally viewed today as a prominent critic of positivism, and of the growing dominance of quantitative method within US sociology. While (...) this picture is broadly accurate, it neglects an important strand in his methodological thinking. He was committed to the goal of a science of social life, while at the same time he was uncertain whether such a science is possible. In his Appraisal of Thomas and Znaniecki’s The Polish Peasant, he identified a serious dilemma facing this project: the problem of how a scientific approach can be made compatible with the distinctive nature of human social life. In the first chapter of his most influential book, Symbolic Interactionism, he advocates a naturalistic approach to case study, and seems to treat this as avoiding the dilemma. However, there is evidence to suggest that, even towards the end of his life, he regarded the problem as still unresolved. In this article, I examine both sides of Blumer’s dilemma, and whether his attitude towards it changed. However, my interest here is not only historiographical. I evaluate Blumer’s arguments and show that his intellectual struggle with this issue remains relevant today, despite the shifts that have taken place in social science methodology and the philosophy of science since his death. He concludes by offering his own proposal for a 'realism of appearances', which incorporates elements of both Humean and Kantian thinking. Practical wisdom and judgment, rather than seen as ‘things’ hidden inside the mind, are best talked of, we suggest, as emerging developmentally within an unceasing flow of activities, in which practitioners are inextricably immersed. Following a performative line of thinking, we argue that when practitioners (namely, individuals immersed in a practice, experiencing their tasks through the emotions, standards of excellence and moral values the practice engenders or enacts) face a bewildering situation in which they do not know, initially at least, (...) how to proceed, the judgment they exercise emerges out of seeking to establish a new orientation to their puzzling surroundings. They do so through actively trying to be in touch with their felt emotions and moral sensibilities, while attempting to articulate linguistically the feelings experienced in order to get a clearer view of relevant aspects of the situation at hand. Coming to a judgment involves moving around within a landscape of possibilities, and in so doing, being spontaneously responsive to the consequences of each move, and assessing which one (or combination of moves) seems best in resolving the initial tension aroused in one’s initial confusion. This volume attempts to give a short account of Herbert Spencer's life, an appreciation of his characteristics, and a statement of some of the services he rendered to science. Prominence has been given to his Autobiography, to his Principles of Biology, and to his position as a cosmic evolutionist; but little has been said of his psychology and sociology, which require another volume, or of his ethics and politics, or of his agnosticism-the whetstone of so many critics. Spencer's services is therefore partial, but it may not for that reason fail in its chief aim, that of illustrating the working of one of the most scientific minds that ever lived, -whose excess of science was almost unscientific.-.
