The recent financial crisis has revealed not only market failure and regulatory failure, but also failure of the narratives that inform the rules of financial law. The term ‘narrative’ is used to mean the deep structures of assumption which inform legal rules, but which are not always fully articulated in them, and which are most fully articulated in the case law. This article identifies three such narratives, namely the arm’s length, fiduciary and consumerist narratives. It finds that they are both (...) inconsistent in practice and inherently limited in their ability to deliver virtuous outcomes, and thereby to command the imaginative assent of the regulated community. A possible new narrative, relating to the netting arrangements on which the derivatives markets rely, and based on the concept of mutuality, is recommended for the future development of financial law. In recent years, a new generation of activists has reinvigorated debate over the public commemorative landscape. While this debate is in no way limited to statues, it frequently crystallizes around public representations of historical figures who expressed support for the oppression of certain groups or contributed to their past or present oppression. In this paper, I consider what should be done about such representations. A number of philosophers have articulated arguments for modifying or removing public monuments. Joanna Burch-Brown (2017) (...) grounds her argument for removal in what I call the “honorific” function of such representations—the ways in which they express and tend to cultivate admiration for their subjects. In the first two sections of the paper, I develop a novel argument for modifying these representations based on this insight. I argue that leaving such representations unmodified in the public space tends to undermine the dignity of members of oppressed groups as well as their assurance that society and government are committed to their rights and constitutional entitlements. In the paper’s third section, I develop a “balancing test” for determining whether the relevant moral and pragmatic considerations favor making a particular representation inaccessible to the public, or recontextualizing it for public consumption. Unlike some of the existing philosophical treatments of honorific representations that focus on particular monuments, this balancing test is designed for general application to any honorific representation that satisfies the presumptive case for modification. To conclude, I offer some reasons why weak forms of recontextualization that do not involve altering institutional context may often be an insufficient remedy for the problems I describe. (shrink)

In surveys, health emerges as a leading concern for New Zealanders. In Virtual Worlds, Benjamin Woolley examines the reality of virtual reality.

Most conceptions of human rights rely on metaphysical or theological assumptions that construe them as possible only as something imposed from outside existing communities. Most people, in other words, presume that human rights come from nature, God, or the United Nations. This book argues that reliance on such putative sources actually undermines human rights. Benjamin Gregg envisions an alternative; he sees human rights as locally developed, freely embraced, and indigenously valid. Human rights, he posits, can be created by the (...) average, ordinary people to whom they are addressed, and that they are valid only if embraced by those to whom they would apply. I begin with Cunningham’s argument that, for Harvey, anatomy was an experience-based science of final causes. But how could one experience final causes? Benjamin Barber is one of America's preeminent political theorists. He has been a significant voice in the continuing debate about the nature and role of democracy in the contemporary world. A Passion for Democracy collects twenty of his most important writings on American democracy. Together they refine his distinctive position in democratic theory. Barber's conception of "strong democracy" contrasts with traditional concepts of "liberal democracy," especially in its emphasis on citizen participation in central issues of public debate. These essays (...) critique the "thin representation" of liberal democracy and buttress the arguments presented in Barber's twelve books, most recently in his well-received Jihad vs. McWorld: How Globalism and Tribalism Are Re-shaping the World. Environmental ethicists often make claims about the intrinsic value of nature or parts thereof. Advances in intrinsic value theory, most notably Ben Bradley’s ‘Two Concepts of Intrinsic Value,’ successfully cleave the concept of intrinsic value into two: a Moorean and Kantian variety. This paper seeks to classify and organize different environmental theorists within a Bradley-inspired framework, helping to bring clarity and charity to the claims of older and newer environmental ethicists. These two types of intrinsic value help explain why different (...) thinkers have differing intuitions on e.g., culling cases. Throughout his long and controversial career, Martin Heidegger developed a substantial contribution to the phenomenology of religion. In Heidegger's Phenomenology of Religion, Benjamin D. Crowe examines the key concepts and developmental phases that characterized Heidegger's work. Crowe shows that Heidegger's account of the meaning and structure of religious life belongs to his larger project of exposing and criticizing the fundamental assumptions of late modern culture. He reveals Heidegger as a realist through careful readings of his views on religious attitudes (...) and activities. Crowe challenges interpretations of Heidegger's early efforts in the phenomenology of religion and later writings on religion, including discussions of Greek religion and Hölderlin's poetry. This article explores the ways in which employers’ organizational networks, as shaped by the emergence of the “contract state” and related changes in the legal environment, affect employment practices. The classic analysis of the ways in which the legal environment benefits elites has successfully been applied to large organizations. Here, from a microsociological perspective, the authors researched how within an ambivalent legal context small and medium size cleaning companies interact with members of their organizational network. Semistructured interviews with cleaning subcontractors (...) illustrate a specific type of standardization process by which the Finance Ministry’s administrative guidelines encourage cleaning companies to ignore workers’ rights and develop illegal employment practices which are then transferred from contracts with state agencies to contracts with private firms purchasing services. It is often said that clinical research and the practice of medicine are fraught with uncertainties. But what do we mean by uncertainty? Where does uncertainty come from? How do we measure uncertainty? Is there a single theory of uncertainty that applies across all scientific domains, including the science and practice of medicine? To answer these questions, we first review the existing theories of uncertainties. We then attempt to bring the enormous literature to bear from other disciplines to address the (...) issue of uncertainty in clinical research and medical practice. The generation of animals was a difficult phenomenon to explain in the seventeenth century, having long been a problem in natural philosophy, theology, and medicine. In this paper, I explore how generation, understood as epigenesis, was directly related to an idea of rational nature. I examine epigenesis—the idea that the embryo was constructed part-by-part, over time—in the work of two seemingly dissimilar English philosophers: William Harvey, an eclectic Aristotelian, and Margaret Cavendish, a radical materialist. I chart the ways that they (...) understood and explained epigenesis, given their differences in philosophy and ontology. I argue for the importance of ideas of harmony and order in structuring their accounts of generation as a rational process. I link their experiences during the English Civil war to how they see nature as a possible source for the rationality and concord sorely missing in human affairs. (shrink)

This article examines Grotius's use of a Roman tradition to establish his notion of a natural and international law in his early treatise "De iure praedae ". It is argued that "De iure praedae," on a methodological level, constituted an attempt to introduce a new doctrine of sources of law by making use of the method of classical rhetoric. On a substantive level, the treatise must be seen as growing out of a Ciceronian tradition of natural law arguments in favor (...) of just war, a tradition further enriched by Grotius with concepts taken from the property law of the Digest. These concepts afforded Grotius with the substantive framework to develop his doctrine of subjective natural rights as sketched in the hitherto unpublished early manuscript Theses LVI. An implication of this investigation of the Roman foundations of Grotius's theory of natural law is that it challenges widespread assumptions about the "positive" character of ancient liberty. In this issue, Greer Donley, Sara Chandros Hull, and Benjamin E. Berkman explore the implications of using whole genome sequencing in the prenatal context. They focus on how whole genome sequencing may refine pregnancy expectations, impact child‐rearing decisions, and foreclose children's desire not to know more about their future. Their paper inspired me to reimagine the predominant worldviews of genomics prediction. One worldview is characterized by woe: the world as we know it will be forever changed unless we avoid (...) the perils of genomics. I found myself thinking of this as the Eeyore phenotype. The Tigger phenotype is a worldview characterized by confidence: the world as we know it is forever changed, and we should embrace our genomic future. Donley, Hull, and Berkman adopt a new phenotype, one that perhaps resembles Christopher Robin. This worldview is characterized by its commitment to moving forward, nurturing relationships, and deliberating thoughtfully: it applies the evidentiary model to whole genome sequencing. Like Christopher Robin, who accepted that growing up was inevitable, the authors appreciate that progress is inevitable. Their response is to offer recommendations for research that might help the Eeyores and Tiggers find common ground. (shrink)

One of the popular missional consensuses in the context of migration is seeing migrants as “moving targets” for evangelism. There is an urge to respond differently realising that migrants are not merely workers for economic welfare but persons created in the image of God. To reconstruct a model of mission that is embedded in the complex reality of migration, this paper will look into the details of three narratives of Indonesian and Filipino migrants who live and attend a Charismatic church (...) in Sabah, Malaysia. It will give insights into the process of othering and discover the quality of compassion in their lives. Based on their experiences, I argue mission as a compassionate presence provides a sound theological basis for churches to respond to the continuous othering of migrants. It invites us to rethink evangelism, not solely as winning souls for Christ, but to embody Christ by being present. (shrink)

This book offers a collection of contemporary essays that explore philosophical themes at work in chess. This collection includes essays on the nature of a game, the appropriateness of chess as a metaphor for life, and even deigns to query whether Garry Kasparov might—just might—be a cyborg. In twelve unique essays, contributed by philosophers with a broad range of expertise in chess, this book poses both serious and playful questions about this centuries-old pastime. -/- Perhaps more interestingly, philosophers have often (...) used chess in discussions of their work. Walter Benjamin compares the marching of history to an automaton playing chess. John Dewey and Charles Sanders Peirce utilize chess to explain their pragmatism. There are approximately 181 uses of the word chess or one of its cognates in the published works of Ludwig Wittgenstein. John Rawls explains that one might want to make a distinction between constitutive and regulative rules, which can best be understood by examining a game of chess. John Searle, deeply convinced of this distinction, explains further: "The rules of football or chess are given as an example of constitutive rules because they 'create the very possibility of playing such games.'" Hubert Dreyfus and Daniel Dennett have had extensive public discussions about the issue of artificial intelligence and chess. Dreyfus, utilizing chess examples, has written extensively on what computers still cannot do. Meanwhile, in spite of his protestations, chess-playing computers continue to fascinate those who work in the area of artificial intelligence. -/- The game of chess has endured since at least the sixth century. Its earliest variant, the Indian game of Chaturanga, was from the beginning a game for thinkers. Since its inception, scholars, statesmen, strategists, and warriors have been fascinated by the game and its variants. German philosopher Emmanuel Lasker and famed French artist Marcel Duchamp were both Grandmasters at chess. Karl Marx played chess avidly, as did Sir Bertrand Russell, Jean-Paul Sartre, and the logical positivist Max Black. Jean-Jacques Rousseau mentions in his Confessions that, at the time, he "had another expedient, not less solid, in the game of chess, to which I regularly dedicated, at Maugis's, the evenings on which I did not go to the theater. I became acquainted with M. de Legal, M. Husson, Philidor, and all the great chess players of the day, without making the least improvement in the game." A brief foray into a moral thicket, exploring why we should protect nature despite tsunamis, malaria, bird flu, cancer, killer asteroids, and tofu. Most of us think that in order to be environmentalists, we have to love nature. Essentially, we should be tree huggers—embracing majestic redwoods, mighty oaks, graceful birches, etc. We ought to eat granola, drive hybrids, cook tofu, and write our appointments in Sierra Club calendars. Nature's splendor, in other words, justifies our protection of it. But, asks (...) class='Hi'>Benjamin Hale in this provocative book, what about tsunamis, earthquakes, cancer, bird flu, killer asteroids? They are nature, too. For years, environmentalists have insisted that nature is fundamentally good. In The Wild and the Wicked, Benjamin Hale adopts the opposite position—that much of the time nature can be bad—in order to show that even if nature is cruel, we still need to be environmentally conscientious. Hale argues that environmentalists needn't feel compelled to defend the value of nature, or even to adopt the attitudes of tree-hugging nature lovers. We can acknowledge nature's indifference and periodic hostility. Deftly weaving anecdote and philosophy, he shows that we don't need to love nature to be green. What really ought to be driving our environmentalism is our humanity, not nature's value. Hale argues that our unique burden as human beings is that we can act for reasons, good or bad. He claims that we should be environmentalists because environmentalism is right, because we humans have the capacity to be better than nature. As humans, we fail to live up to our moral potential if we act as brutally as nature. Arbitration is the dispute resolution method of choice in international commerce, but it rests on a complex legal foundation. In many international commercial contracts, the parties will choose the law governing any future disputes. However, where the parties do not choose a governing law, the prevailing approach in arbitration is to afford arbitrators broad and largely unfettered discretion to choose the law considered most appropriate or most applicable. The uncertainty resulting from this discretion potentially affects the parties' rights and obligations, (...) the performance of their contract, the presentation of their cases, and negotiations undertaken to settle their disputes.In this text, Dr Benjamin Hayward critically reviews the prevailing approach to the conflict of laws in international commercial arbitration. The text adopts a focused and detail-oriented analysis - being based on a study of more than 130 sets of arbitral laws and rules from around the world, and drawing heavily on arbitral case law. Nevertheless, it remains both practical and accessible, taking as its focus the needs and expectations of commercial parties, who are the ultimate users of international commercial arbitration.This text identifies the difficulties that result from resolving conflicts of laws through broad and unconstrained arbitral discretions. It establishes that a bright-line test would be a preferable way to resolve arbitral conflicts of laws. El tema sobre el que se debatía era la existencia de un deber incondicionado de decir siempre y en cualquier situación la verdad. Frente a las tesis del imperativo universal moral de la verdad del filósofo de Koënisberg, Constant opone los ejemplos concretos de situaciones en las que decir la verdad puede equivaler a hacer el mal. Gabriel (...) Albiac no explica en el Estudio introductorio que precede a la edición de los textos completos de la querella, cuanto anticipan las tesis que aquí se debaten, los problemas que generará el totalitarismo y el terror en el mundo de las ideologías holistas. Pero más allá de las consecuencias que pueden deparar las reflexiones en este libro relativas al derecho a decir y exigir la verdad - que es un de los postulados de la sacralización de la teología operada a partir del Renacimiento y de la Ilustración-, la polémica Constant/ Kant oculta otro segundo debate sobre el valor de los principios, la forma de construirlos y su eficacia para regir y explicar la realidad que se demuestra de excepcional interés en un siglo como el XXI, desbordado por su incapacidad de comprender los hechos que todos los días ofrece un mundo empírico en continua efervescencia, debido a la carencia de un sistema de categorías de principio generalmente aceptados que pueda servir de referente para unificar la multiplicidad de lo singular. In his novel “Dolina Radości” [“Valley of Joy”] Stefan Chwin tackles the subject of metamorphoses. In this article I will talk about the issue of transformations in “Dolina radości”. The hero of the novel is a makeup­-artist and that is why metamorphoses are at the center of the action. Noteworthy are also transformations connected with the most important political events and the most important places in Europe in the 20th century for example in the Polish city of Gdańsk which Chwin (...) writes about. The events of December 1970 are described in an episode of the novel but are a very important element of the whole book. This article first presents references to German literary works which are the part of the literature of German­-Polish dialogue. (shrink)
