Minor-attracted persons raise multiple ethical and legal challenges. Sexual contact between adults and children is justly prohibited on child welfare grounds. Advances in technology raise the prospect of interventions for minor-attracted persons that have the potential to reduce harm to children by diverting would-be offenders to other endeavors that nonetheless may generate moral disgust This essay examines three of these potential harm reduction technologies (sex robots, haptic devices and synthetic child pornography) and raises the possibility that their use (...) can be justified and their acceptance morally obligatory if doing so reduces harm to real children. Since several landmark legal decisions in the 1970s and 1980s, substituted judgment has become widely accepted as an approach to decision‐making for incapacitated patients that incorporates their autonomy and interests. Two notable exceptions have been cases involving minors and those involving cognitively or psychiatrically impaired individuals who never previously possessed the ability to contemplate the medical decisions involved in their care. While a best interest standard may have universal merit in pediatric cases, this paper argues that substituted judgement has been (...) rejected too broadly for “never‐capacitated” patients. It then lays out a three‐condition test for using substituted judgment in these cases. For a subset of “never‐capacitated” patients who belong to distinctive religious or cultural communities with clear medical values and have an appropriate surrogate, these values may prove helpful in vindicating the interests of the never‐capacitated and should not be blanketly dismissed. In the early 1980s, a new category of crime appeared in the criminal law lexicon. In response to concerted advocacy-group lobbying, Congress and many state legislatures passed a wave of "hate crime" laws requiring the collection of statistics on, and enhancing the punishment for, crimes motivated by certain prejudices. This book places the evolution of the hate crime concept in socio-legal perspective. James B. Jacobs and Kimberly Potter adopt a skeptical if not critical stance, maintaining that legal definitions of hate (...) crime are riddled with ambiguity and subjectivity. No matter how hate crime is defined, and despite an apparent media consensus to the contrary, the authors find no evidence to support the claim that the United States is experiencing a hate crime epidemic--instead, they cast doubt on whether the number of hate crimes is even increasing. The authors further assert that, while the federal effort to establish a reliable hate crime accounting system has failed, data collected for this purpose have led to widespread misinterpretation of the state of intergroup relations in this country. The book contends that hate crime as a socio-legal category represents the elaboration of an identity politics now manifesting itself in many areas of the law. But the attempt to apply the anti-discrimination paradigm to criminal law generates problems and anomalies. For one thing, members of minority groups are frequently hate crime perpetrators. Moreover, the underlying conduct prohibited by hate crime law is already subject to criminal punishment. Jacobs and Potter question whether hate crimes are worse or more serious than similar crimes attributable to other anti-social motivations. They also argue that the effort to single out hate crime for greater punishment is, in effect, an effort to punish some offenders more seriously simply because of their beliefs, opinions, or values, thus implicating the First Amendment. Advancing a provocative argument in clear and persuasive terms, Jacobs and Potter show how the recriminalization of hate crime has little value with respect to law enforcement or criminal justice. Indeed, enforcement of such laws may exacerbate intergroup tensions rather than eradicate prejudice. (shrink)

Female genital alteration is any cutting, removal or destruction of any part of the external female genitalia. Various FGA practices are common throughout the world. While most frequent in Africa and Asia, transglobal migration has brought ritual FGA to Western nations. All forms of FGA are generally considered undesirable for medical and ethical reasons when performed on minors. One ritual FGA procedure is the vulvar nick. This is a small laceration to the vulva that does not cause morphological changes. Besides (...) being performed as a primary ritual procedure it has been proposed as a substitute for more extensive forms of FGA. Measures advocated or taken to reduce the burden of FGA can be punitive or non-punitive. Even if it is unethical to perform VN, we argue that it also is unethical to attempt to suppress it through punishment. First, punishment of VN is likely to cause more harm than good overall, even to those ostensibly being protected. Second, punishment is likely to exceed legitimate retributive ends. We do not argue in favor of performing VN. Rather, we argue that non-punitive strategies such as education and harm reduction should be employed. (shrink)

Asia Minor witnessed a resurgence of construction and renovation activities in the Theodosian age, and in particular in the last twenty years of the 4th and the first twenty years of the 5th century AD. In fact, the typical Late Antique city, with its imposing fortification walls, heterogeneous street colonnades and agora porticoes, and monumental churches replacing earlier temples, came into being in these decades. A confrontation of the material remains with contemporaneous historical, political, social and religious events and (...) changes, would suggest that these urbanistic interventions were the result of unrelated factors arising in just a few decades’ time. Despite the absence of a deliberate Theodosian policy of urban renewal, the care for and energy invested in the cityscape does testify to continuance of aesthetic principles and representational concerns, not only at Constantinople, but also in the provincial capitals and even in the smaller cities of the region. This paper employs theory of normal organizational wrongdoing and investigates the joint effects of management tone and the slippery slope on financial reporting misbehavior. In Study 1, we investigate assumptions about the effects of sliding down the slippery slope and tone at the top on financial executives’ decisions to misreport earnings. Results of Study 1 indicate that executives are willing to engage in misreporting behavior when there is a positive tone set by the Chief Financial Officer, regardless of the presence (...) or absence of a slippery slope. A negative tone set by the CFO does not facilitate the transition from minor indiscretions to financial misreporting. In Study 2, we find that auditors evaluating executives’ decisions under the same conditions as those in Study 1 do not react to the slippery slope condition, but auditors assess higher risks of fraud when the CFO sets a negative tone. Overall, our results indicate that many assumptions about the slippery slope and tone at the top should be questioned. We provide evidence that pro-organizational behaviors and incrementalism yield new insights into the causes of ethical failures, financial misreporting behavior, and failures of corporate governance mechanisms. In this essay, I reply to the above four critics of In Defense of Kant’s Religion (IDKR). In reply to George di Giovanni, I highlight the interpretive differencesthat divide the authors of IDKR and di Giovanni, and argue that di Giovanni’s atheist reading of Kant does not follow, even granting his premises. In reply to Pamela Sue Anderson, I show that if her reading of Kant is accurate, Kant’s own talk of God becomes empty and contemptible by his own lights, (...) and I then show how her empirical bias prompts a significant misreading of IDKR. In reply to Stephen Palmquist, I expose four fallacious maneuvers in his paper, which comprise the bulk of his essay. And in reply to Michalson, I address a series of minor concerns raised in his essay, and then set the record straight on the motives behind IDKR in general and my own take on Kant’s compatibility (or lack thereof) with Christianity in specific. Despite changes in their representation and visibility, there are still serious concerns about the inclusion and day-to-day workplace challenges various groups face (e.g., women, ethnic and cultural minorities, LGBTQ+, people as they age, and those dealing with physical or mental disabilities). Men are also underrepresented in specific work fields, in particular those in HEED (Health care, Elementary Education and the Domestic sphere). Previous literature has shown that group stereotypes play an important role in maintaining these inequalities. We outline how insights (...) from research on stigma, social-identity, and self-regulation together increase our understanding of how targets are affected by and regulate negative stereotypes in the workplace. This approach starts from the basis that members of negatively-stereotyped groups are not just passive recipients of negative attitudes, stereotypes, and behaviors, but are active individuals pursuing multiple goals, such as goals for belonging and achievement. We argue that it is only by understanding stigma from the target’s perspective (e.g., how targets are affected and respond) that we can successfully address workplace inequality. Key in this understanding is that stereotypes, prejudice and discrimination have taken on much more subtle forms, with consequences for the way members of stigmatized-groups cope. These insights lead us to propose an approach to understanding barriers to workplace equality that highlights four key aspects: a) the different (often subtle) potential triggers of identity-threat in the workplace for members of stigmatized-groups, b) the ways in which members of stigmatized-groups cope with these threats, c) the role of supportive factors that mitigate potential threats and affect self-regulation, and d) potential hidden costs for the self or others of what appears at first to be effective self-regulation. The focus on threats, coping, support, and potential hidden costs helps us understand why current diversity efforts are not always successful in increasing and maintaining members of stigmatized-groups in organizations, and provides insight into how we can aid efforts to effectively lower barriers to workplace equality. This paper compares two alternative explanations of pragmatic encroachment on knowledge (i.e., the claim that whether an agent knows that p can depend on pragmatic factors). After reviewing the evidence for such pragmatic encroachment, we ask how it is best explained, assuming it obtains. Several authors have recently argued that the best explanation is provided by a particular account of belief, which we call pragmatic credal reductivism. On this view, what it is for an agent to believe a proposition is (...) for her credence in this proposition to be above a certain threshold, a threshold that varies depending on pragmatic factors. We show that while this account of belief can provide an elegant explanation of pragmatic encroachment on knowledge, it is not alone in doing so, for an alternative account of belief, which we call the reasoning disposition account, can do so as well. And the latter account, we argue, is far more plausible than pragmatic credal reductivism, since it accords far better with a number of claims about belief that are very hard to deny. (shrink)

A platitude that took hold with Kuhn is that there can be several equally good ways of balancing theoretical virtues for theory choice. Okasha recently modelled theory choice using technical apparatus from the domain of social choice: famously, Arrow showed that no method of social choice can jointly satisfy four desiderata, and each of the desiderata in social choice has an analogue in theory choice. Okasha suggested that one can avoid the Arrow analogue for theory choice by employing a strategy (...) used by Sen in social choice, namely, to enhance the information made available to the choice algorithms. I argue here that, despite Okasha’s claims to the contrary, the information-enhancing strategy is not compelling in the domain of theory choice. (shrink)

This paper develops and explores a new framework for theorizing about the measurement and aggregation of well-being. It is a qualitative variation on the framework of social welfare functionals developed by Amartya Sen. In Sen’s framework, a social or overall betterness ordering is assigned to each profile of real-valued utility functions. In the qualitative framework developed here, numerical utilities are replaced by the properties they are supposed to represent. This makes it possible to characterize the measurability and interpersonal comparability of (...) well-being directly, without the use of invariance conditions, and to distinguish between real changes in well-being and merely representational changes in the unit of measurement. The qualitative framework is shown to have important implications for a range of issues in axiology and social choice theory, including the characterization of welfarism, axiomatic derivations of utilitarianism, the meaningfulness of prioritarianism, the informational requirements of variable-population ethics, the impossibility theorems of Arrow and others, and the metaphysics of value. Objective interpretations of probability are usually discussed in two varieties: frequency and propensity accounts. But there is a third, neglected possibility, namely, probabilities as deriving from ranges in suitably structured initial state spaces. Roughly, the probability of an event is the proportion of initial states that lead to this event in the space of all possible initial states, provided that this proportion is approximately the same in any not too small interval of the initial state space. This idea can also (...) be expressed by saying that in the types of situations that give rise to probabilistic phenomena we may expect to find an initial state space such that any "reasonable" density function over this space leads to the same probabilities for the possible outcomes. This "method of arbitrary functions" was introduced by Poincaré, studied and extended by Hopf and more recently by Eduardo Engel, Jan von Plato and Michael Strevens. The natural-range, or method-of-arbitrary-functions approach to probabilities is usually treated as an explanation for the occurrence of probabilistic patterns, whereas I examine its prospects for an objective interpretation of probability, in the sense of providing truth conditions for probability statements that do not depend on our state of mind or information. The main objection to such a proposal is that it is circular, i.e. presupposes the concept of probability, because a measure on the initial state has to be introduced, and density functions over the space are considered. The history of the Frankfurt School cannot be fully told without examining the relationships of Critical Theorists to their Jewish family backgrounds. Jewish matters had significant effects on key figures in the Frankfurt School, including Max Horkheimer, Theodor W. Adorno, Erich Fromm, Leo Lowenthal and Herbert Marcuse. At some points, their Jewish family backgrounds clarify their life paths; at others, these backgrounds help to explain why the leaders of the School stressed the significance of antisemitism. In the post-Second World War (...) era, the differing relationships of Critical Theorists to their Jewish origins illuminate their distinctive stances toward Israel. This book investigates how the Jewish backgrounds of major Critical Theorists, and the ways in which they related to their origins, impacted upon their work, the history of the Frankfurt School, and differences that emerged among them over time. Medicalisation is a social phenomenon in which conditions that were once under legal, religious, personal or other jurisdictions are brought into the domain of medical authority. Low sexual desire in females has been medicalised, pathologised as a disease, and intervened upon with a range of pharmaceuticals. There are two polarised positions on the medicalisation of low female sexual desire: I call these the mainstream view and the critical view. I assess the central arguments for both positions. Dividing the two positions (...) are opposing models of the aetiology of low female sexual desire. I conclude by suggesting that the balance of arguments supports a modest defence of the critical view regarding the medicalisation of low female sexual desire. (shrink)

D. M. Armstrong famously claims that deterministic laws of nature are contingent relations between universals and that his account can also be straightforwardly extended to irreducibly probabilistic laws of nature. For the most part, philosophers have neglected to scrutinize Armstrong’s account of probabilistic laws. This is surprising precisely because his own claims about probabilistic laws make it unclear just what he takes them to be. We offer three interpretations of what Armstrong-style probabilistic laws are, and argue that all three interpretations (...) are incompatible either with some feature of Armstrong’s broader metaphysics or with essential features of his account of laws (or both). Medical scientists employ ‘quality assessment tools’ (QATs) to measure the quality of evidence from clinical studies, especially randomized controlled trials (RCTs). These tools are designed to take into account various methodological details of clinical studies, including randomization, blinding, and other features of studies deemed relevant to minimizing bias and error. There are now dozens available. The various QATs on offer differ widely from each other, and second-order empirical studies show that QATs have low inter-rater reliability and low inter-tool reliability. This (...) is an instance of a more general problem I call the underdetermination of evidential significance. Disagreements about the strength of a particular piece of evidence can be due to different—but in principle equally good—weightings of the fine-grained methodological features which constitute QATs. In 1655 La Peyrère was the first to substantially argue for and popularize polygenism—the view that God created multiple original human mating pairs in separate acts of creation with numerous created before Adam. Positing or rejecting polygenism has been central to modern theorizing about human types and origins. Prominent recent interpreters have maintained that La Peyrère’s polygenism does not imply a hierarchy of human types. This paper reconstructs La Peyrère’s account and, in opposition to the dominant view, argues that his (...) polygenism produces a human species hierarchy. The Adamite species is superior to the Pre-Adamite species in virtue of its material composition, mode of creation, and form. The upshot is that La Peyrère’s theological system posits a proto-racialist conception of human types. (shrink)

Much has been made of the science to service problem (...) in counseling (Murray, 2009), with the consensus being that there is a gap between the academics writing the books and papers and the clinicians actually doing the work. This text is an effort to meet the needs of both by providing an overview of case examples that are relatable and accessible; and responses to these cases that meet the careful scrutiny required by the ACA. In Republic V Socrates offer three successive waves of paradox, the first being that amongst the rulers men and women will be assigned to fulfill the same social functions and the second being that amongst the rulers the traditional private family will be abolished. In her article “Philosopher Queens and Private Wives: Plato on Women and the Family” (Philosophy and Public Affairs (1977)) Susan Moller Okin argued that Plato’s argument is that the second wave of paradox implies the first. In (...) this note I rebut Okin’s arguments and show, in part based on evidence adduced by Okin herself, that for Plato it is the first wave of paradox that implies the second. (shrink)

Gay marriage is an issue that almost everyone has an opinion about. As with most controversial topics, South Park has also had its say. This chapter centers around one particular episode of South Park, “Follow That Egg!” Recent events show that although the episode may be getting old, the issue and the themes raised in it are as topical as ever. There are many arguments for and against gay marriage. The author looks at the most familiar arguments on both sides (...) and demonstrates that they usually miss the point, are entirely irrelevant, or are just bad arguments. In so doing, the author hopes to map out the landscape of the gay marriage debate and show how barren it is. In 1997 and 1998, the American secular philosopher Richard Rorty published a set of predictions about the twenty-first century ranging from the years 2014-95. He predicted, for instance, the election of a "strong man" in the 2016 presidential race and the proliferation of gun violence starting in 2014. He labels the years from 2014-44 the darkest years of American history, politics, and society. From 2045-95, Rorty thinks his own vision for "social hope" will be implemented within American society--a vision that (...) includes charity (in the Pauline sense), solidarity, and sympathy. Rorty considers himself a leftist, liberal, and a philosopher of hope. So why would a philosopher of hope predict such darkness and despair? In The Dark Years? Philosophy, Politics, and the Problem of Predictions philosopher and political theorist Jacob L. Goodson explains the fullness of Rorty's predictions, the problem of making predictions within the social sciences, and the reasons why even Rorty's vision for life after the "dark years" fails us on the standards of hope. Since its inception in 1994, scriptural reasoning has been practiced by academics and religious laypeople on an international scale. Scriptural reasoning is an activity or practice where Jews, Christians, and Muslims read and study together short passages from their traditionally sacred texts. In this book, Jacob L. Goodson describes this activity by giving a tour through modern philosophy and showing how certain arguments, ideas, and theories from modern philosophers help make sense of this inter-religious practice. According to Goodson, one (...) of the most interesting aspects of the practice of scriptural reasoning concerns how its driven by a tension between pragmatism and semiotics—what he calls purposefulness (pragmatism) vs. playfulness (semiotics) throughout the book. Can inter-religious practices only be playful, in terms of an academic “leisure activity”? Or do inter-religious practices need to strive toward a greater end or even a higher purpose, such as peace-making among the Abrahamic faiths or inter-religious friendships? In each individual chapter, Goodson explores this tension within the practice of scriptural reasoning. Utilizing Immanuel Kant’s deontology, Goodson concludes by demonstrating how the practice of scriptural reasoning might work if only two rules are in place while participating in it. (shrink)

This paper outlines an Husserlian, phenomenological account of the first stages of the acquisition of empirical knowledge in light of some aspects of Wilfrid Sellars’ critique of the myth of the given. The account offered accords with Sellars’ in the view that epistemic status is attributed to empirical episodes holistically and within a broader normative context, but disagrees that such holism and normativity are accomplished only within the linguistic and conceptual confines of the space of reasons, and rejects the limitation (...) of the relevant normativity to the cognitive domain. Attention to the phenomenological notion of motivations in our mapping of the structure and acquisition of empirical knowledge reveals a form of weak categoriality given in experience, one outside exclusive mediation by language and concepts but also not merely causal. Section 1 outlines some basic aspects of Sellars’ account of empirical knowledge in Empiricism and the Philosophy of Mind, including a regress objection that arises due to his claim that empirical knowledge presupposes knowledge of general facts about perception. Section 2 examines Sellars’ later revisiting of the objection, via his critique of Roderick Firth, in “The Lever of Archimedes,” focusing on his analysis of the “Myth of the Categorial Given” and his use of the notion of ur-concepts. Section 3 looks at Sellars’ psychological nominalism and his rejection of the explanatory primacy of experience in light of the strict dichotomy between the space of causes and the space of reasons, and shows how Firth’s account aligns with phenomenology in its advocating for an irreducible and non-inferential role for experience. It also raises an important objection to Sellars’ account concerning the categorial givenness of causality. Section 4 turns to Husserl, arguing that his conception of motivation in the Logical Investigations and Ideas II reveals a third explanatory or logical space “between” that of causes and that of reasons. Section 5 further develops this account with regard to the explanatory role of lived experience. Section 6 revisits the regress objection to Sellars from the phenomenological standpoint developed earlier in the paper, and argues that an Husserlian account of empirical knowledge offers a viable alternative to Sellars’ that overcomes the regress objection and gives proper explanatory weight to the evidence of lived experience vis-à-vis scientific presuppositions about causality. Key to this transformation are technological advancements, including digital health, which presents novel opportunities for improvement. Emerging digital health technologies, such as virtual consultations, complex imaging procedures, and electronic medical records, are fundamental to modern healthcare (...) infrastructures. However, significant gaps remain in the evaluation and understanding of these innovations, especially for nascent technological areas. This thesis addresses this subject, aiming to delineate how individuals and institutions can bolster their evaluative capabilities, strategic decision-making, and planning for the deployment of emerging digital healthcare technologies. The research methodology amalgamates theoretical exploration, literature scrutiny, and empirical examinations, presenting an integrated perspective that intersects the disciplines of Management & Decision Science, Technology & Innovation, and Health Economics & Outcomes Research. From an applied perspective, this research focuses on developing evidence within the context of pediatric healthcare in Canada — a context notably underrepresented in healthcare management research, despite its disproportionate per capita expenditure. Technologically, the predominant focus is on applications in virtual reality (VR) and three-dimensional (3D) printing and virtualization, though with the aspiration of ensuring the generalizability of results. The current thesis is structured to parallel the progression of the research itself, as three distinct phases; this begins with a comprehensive Background that contextualizes the initial intent, exploring the relationship between technology, innovation, and health outcomes. In this phase, each academic discipline is analyzed to identify base theoretical underpinnings for the research. The second phase of this work includes five empirical studies, each preceded by context-specific literature reviews for the respective technological domain, providing insight into the current state of evidence related to value-based assessment and economic evaluation in that area. Empirical studies included a randomized controlled trial and a cost consequences assessment of VR for pre-procedural preparation for medical imaging. Additionally, novel applications of 3D printing and virtualization are critically analyzed, accompanied by a multi-case study on the implementation of 3D printing in pediatrics, a cost-consequences study of applications for thoracoabdominal surgeries, and an outcomes study on the use of 3D virtualization in medical education during the COVID-19 pandemic. The final phase of this research includes the critical analysis and synthesis of findings into a proposal for a novel value-based assessment and decision-making framework specific to emerging health innovations; this framework integrates insights and resources for clinicians, administrators, and policymakers. The outcomes of this research are skewed toward Knowledge Users, but also aims to advance the theoretical basis for health technology assessment (HTA). (shrink)
