The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. The aim of this paper is to settle the controversy around Kant’s notorious discussion of maternal infanticide in the ‘Doctrine of Right’ of 1797. How should a state punish an unmarried mother who has killed her newborn infant? The text (at DoR VI 335–37) is obscure. Three readings have been defended in the literature: 1. Lenience. Maternal infanticide does not count as murder; so, capital punishment is inappropriate. On this view, the child does not enjoy the full recognition of the (...) law (this is the standard view). 2. Temporary privilege. Lenience should prevail as long as social attitudes are barbaric and treating maternal infanticide like regular cases of murder is perceived to be unjust. The regular punishment for murder will be appropriate once sexual mores have changed. The child will then enjoy the full protection of the law (Hruschka, Varden). 3. No lenience. Capital punishment, though it appears to be unjust, is actually just and ought to be applied. Any child, whether born to married parents or not, enjoys the full protection of the law (Brandt, Uleman). Based on a close examination of the passage and the context of contemporary laws and attitudes, Kant is not, it will be argued, advocating lenience but certain legislative reforms, which are needed to dispel the perception that capital punishment is unjust. Progressive legislation will change social attitudes, not vice versa. Moreover, it will be shown that Kant does not, appearances notwithstanding, endorse the thesis that a child born out of wedlock has been smuggled into the state like ‘prohibited goods’ or ‘contraband merchandise’, which would deprive the child of the protection of the state; that is the view with which Kant saddles Cesare Beccaria. In various responses to the COVID-19 pandemic, we can observe insufficient sensitivity towards the needs and circumstances of poorer citizens. Particularly in a context of high inequality, policy makers need to engage with the wider public in debates and consultations to gain better insights in the realities of the worst-off within their jurisdiction. When consultations involve members of traditionally underrepresented groups, these are not only more inclusive, which is in itself an ethical aim, but pool ideas and observations from a (...) much more diverse array of inhabitants. Inclusivity increases the odds to identify a larger range of weak spots for health security and to design health interventions that are less burdensome on those worst-off. (shrink)

Se analizan las diversas escalas de tiempo que articulan las energías del cuerpo emocional productivo, en un contexto específico del capitalismo global, el neoliberalismo desarro-llado desde la década del noventa, es decir, en la civilización neoliberal. Desde la producción de subjetividad en proto-impresiones y confi-guraciones rememoracionales y protencionales en sus variadas formas en el consumo mimético, pliegue, falla, afecto a la espera, etc., se analiza el ritmo temporal del consenso emocional producido, experimentado como padecimiento de felicidad en el terror y, (...) con ello, la forma en que se produce la regulación y autorregulación del cuerpo emocional en el capitalismo. Se piensa en este trabajo que ello, en un tiempo lineal económico que exige productividad creciente, conduce al cuerpo emocional a una proyección dependiente de uno cíclico, en el que, ante imposibilidad de elaborar comienzos propios, deviene en un sujeto que técnicamente enfrenta el riesgo, percibido como cálculo económico. Está, por ello, en un eterno retorno, desde la protoimpresión a la protención, desde el afecto a la espera al terror. Es el retorno del mito del eterno retorno, en una civilización distinta. Jens Timmermann provides a detailed philosophical, developmental and historical analysis of Immanuel Kant's 1797 essay 'On a Supposed Right to Lie from Love of Humanity', in which Kant argues that it is criminally wrong to lie to protect a friend from being murdered.

There seems to be a strong sentiment in pre-philosophical moral thought that actions can be morally valuable without at the same time being morally required. Yet Kant, who takes great pride in developing an ethical system firmly grounded in common moral thought, makes no provision for any such extraordinary acts of virtue. Rather, he supports a classification of actions as either obligatory, permissible or prohibited, which in the eyes of his critics makes it totally inadequate to the facts of morality. (...) The related idea of uncommonly grand and noble deeds is frequently dismissed by Kant as high-.own emotional nonsense. Such considerations give rise to the fear that actions intuitively classed as morally commendable but not required must be re-classified as commands of duty by Kant, making his ethical theory as unbearably demanding as direct utilitarianism. The paper divides into three sections: (1) an examination of the nature of moral goodness from a meta-ethical angle that introduces some passages from Kant's writings presenting strong theoretical evidence against the case for supererogatory action; (2) a critique of Thomas Hill's suggestion that within the category of wide duty we can accommodate some of the main features of actions classified as supererogatory in other ethical systems; concluding that, contra Hill, there are no actions of wide duty that can be so characterized in any significant sense; and (3) a final discussion of the problem of how demanding the requirements of Kantian ethical theory really are. Can the use of psychedelic drugs induce lasting changes in metaphysical beliefs? While it is popularly believed that they can, this question has never been formally tested. Here we exploited a large sample derived from prospective online surveying to determine whether and how beliefs concerning the nature of reality, consciousness, and free‑will, change after psychedelic use. Results revealed significant shifts away from ‘physicalist’ or ‘materialist’ views, and towards panpsychism and fatalism, post use. With the exception of fatalism, these changes endured (...) for at least 6 months, and were positively correlated with the extent of past psychedelic‑use and improved mental‑health outcomes. Path modelling suggested that the belief‑shifts were moderated by impressionability at baseline and mediated by perceived emotional synchrony with others during the psychedelic experience. The observed belief‑shifts post‑psychedelic‑use were consolidated by data from an independent controlled clinical trial. Together, these findings imply that psychedelic‑use may causally influence metaphysical beliefs—shifting them away from ‘hard materialism’. Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

Employing a social justice framework, this book examines the effects of innovation incentives and policies in agriculture. Extreme inequality of opportunity leads to a number of social tensions, inefficiencies and injustices. One issue of increasing concern is the effect inequality is having on people’s fair chances of attaining meaningful work, thus limiting opportunities to make a significant positive contribution to society and reducing the chances of living a flourishing life and developing their potential. On a global scale we can observe an increasingly uneven provision of meaningful work, raising a series of ethical concerns that need detailed examination. (...) What happens when human beings fail to do as reason bids? This book is an attempt to address this age-old question within Kant’s mature practical philosophy, i.e. the practical philosophy that emerged with the watershed discovery of autonomy in the mid-1780s. As always, Kant is good for a surprise. There is, it is argued, not one answer but two: he advocates Socratic intellectualism in the realm of prudence whilst defending an anti-intellectualist or volitional account of immoral action. This ‘hybrid’ theory (...) of practical failure is more than a philosophical curiosity. There are ramifications for Kant’s theory of practical reason as a whole. In particular, the hybrid account emphasizes the divide between pure and empirical practical rationality to the extent that the latter, while containing practically relevant propositions, no longer counts as a branch of practical reason at all. Hypothetical and categorical imperatives exemplify two entirely distinct kinds of normativity. In fact, the dichotomy between pure and empirical determining grounds of the will goes hand in hand with many other dualisms and dichotomies that, whether we like them or not, continue to define Kant’s mature ethical thought. The present article is an attempt to clarify the Kantian conception of duties to the self and to defend them against common objections. Kant’s thesis that all duty rests on duties to the self is shown to follow from the autonomy of the human will; and the allegation that they are impossible because the agent could always release himself from such a duty turns out to be question-begging. There is no attempt to prove that there are such duties, but they (...) are revealed to be an indispensable part of morality. Traditional attributes of moral commands, such as ‘categoricity’ or ‘overridingness’ make no sense in a one-sidedly other-regarding or social conception of morality. (shrink)

Time-tested commons characterize by having instituted sanctioning mechanisms that are sensitive to the circumstances and motivations of non-compliers. As a proposed Global Antimicrobial Commons cannot cost-effectively develop sanctioning mechanisms that are consistently sensitive to the circumstances of the global poor, I suggest concentrating on establishing a wider set of incentives that encourages both compliance and participation.

The present study examines the prevalence, localization, frequency, and intensity of playing-related pain in a sample of high-performing young musicians. We also address coping behavior and communication about PRP between young musicians, teachers, parents, and other people, such as friends. The aim is to provide information on PRP among high-performing musicians in childhood and adolescence, which can serve as a basis for music education, practice, and prevention in the context of instrumental teaching and musicians’ health. The study is part of (...) a large-scale study with highly musically gifted participants at the national level of the “Jugend musiziert” contest. For data analyses, we used descriptive statistics, correlations, Chi2-tests, principal component analysis, Kruskal–WallisHtests, and multivariate regression. About three-quarters of the surveyed participants stated that they had experienced pain during or after playing their instrument. Female musicians were significantly more frequently affected than male musicians. With increasing age, the prevalence of PRP rises from 71 percent to 85 percent. Regarding localization of pain, results are in line with many other studies with musculoskeletal problems the most common. Furthermore, data show a clear relationship between the duration of practice and the prevalence of PRP. Our study found averages of 7:18 h/week, whereas mean values of the duration of practice vary considerably between different instruments. The variance in practice duration is very large within the different instruments. Thus, when researching PRP, it is necessary to consider both the differences between different groups of instruments in the average duration of practice as well as the very large inter-individual variation in the duration of practice within a given instrument group. While just over half of the young musicians felt they had been taken seriously, 32 percent felt that their complaints were not completely taken seriously, and 12 percent did not feel taken seriously at all. Therefore, it is necessary to improve communication and information about PRP to prevent PRP and counteract existing complaints. (shrink)

Weiming’s program of overcoming the enlightenment mentality and throws a critical light on his conceptions of religious or spiritual Confucianism, of a Confucian modernity, and of the multiple modernities theory in general. It defends a unitary rather than multiple concept of modernity in terms of the realization of a morally controlled principle of free subjectivity and tries to show how Confucianism, understood as a secular ethics, could contribute to this goal.

By examining the global public good nature of pandemic preparedness we can identify key social justice issues that need to be confronted to increase citizens’ voluntary compliance with prevention and mitigation measures. As people tend to cooperate on a voluntary basis only with systems they consider fair, it becomes difficult to ensure compliance with public health measures in a context of extreme inequality. Among the major inequalities that need to be addressed we can find major differences in the extensiveness and (...) intensiveness of quarantine experiences, lack of opportunities to participate in common efforts, hardship in complying with disease control recommendations, and an unfair distribution of the cooperative surplus. Having an adequate and extensively recognized resource governance system is essential for the conservation and sustainable use of crop genetic resources in a highly populated planet. Despite the widely accepted importance of agrobiodiversity for future plant breeding and thus food security, there is still pervasive disagreement at the individual level on who should own genetic resources. The aim of the article is to provide conceptual clarification on the following concepts and their relation to agrobiodiversity stewardship: open access, commons, private property, (...) state property and common heritage of humankind. After presenting each property regime, we will examine whether and how these incentivize the conservation, improvement and sharing of crop genetic resources, and conclude by defending a mixed property regime. Kant’s practical philosophy revolves around the concepts of pure reason, autonomy, law and obligation. But for them, terms such as humanity and self-mastery (Selbstherrschaft) are also of great importance. According to Kant, these terms concretize the reason and goal of our ethical and legal-political actions. In a first step, the meaning of these terms at the end of the four Kantian questions (What can I know? What should I do? What can I hope? What is man?) is explained. In a (...) second step, Martin Heidegger’s criticism of humanism (and thus also of Kant) is presented and in a third step the consequences that his view of thinking has for law and politics are discussed: Heidegger’s thinking stands with his negation of philosophy, ethics and science in the service of a politics of immaturity. This paper explores the possibility of moral conflict in Kant’s ethics. An analysis of the only explicit discussion of the topic in his published writings confirms that there is no room for genuine moral dilemmas. Conflict is limited to nonconclusive ‘grounds’ of obligation. They arise only in the sphere of ethical duty and, though defeasible, ought to be construed as the result of valid arguments an agent correctly judges to apply in the situation at hand. While it is difficult to (...) determine in theory what makes some of them stronger than others, these ‘grounds’ can account for practical residue in conflict cases and for a plausible form of agent regret. The principle that ‘ought implies can’ survives intact. (shrink)

The Groundwork of the Metaphysics of Morals is Kant's central contribution to moral philosophy, and has inspired controversy ever since it was first published in 1785. Kant champions the insights of 'common human understanding' against what he sees as the dangerous perversions of ethical theory. Morality is revealed to be a matter of human autonomy: Kant locates the source of the 'categorical imperative' within each and every human will. However, he also portrays everyday morality in a way that many readers (...) find difficult to accept. The Groundwork is a short book, but its argument is dense, intricate and at times treacherous. Even the most sympathetic readers of Kant's moral philosophy usually disagree with him about some aspect of his theory, or some particular moral judgement. His unqualified condemnation of lying in the essay ‘On a supposed right to lie from philanthropy’ is a classical case in question, as is his strong endorsement of retributive justice and the death penalty. A third prominent source of discontent are Kant's repeated verdicts on the moral status of non-human animals, or rather the lack thereof. For, (...) despite the fact that his practical recommendations in this field are sensible and even progressive, he repeatedly insists that there are no direct duties to animals, that the well-being of animals is morally indifferent, in particular that we ought to treat animals decently solely for the sake of humanity. As a result, the foundations of his advice seem morally inadequate, even offensive. (shrink)

Taking people’s longevity as a measure of good life, humankind can proudly say that the average person is living a much longer life than ever before. The AIDS epidemic has however for the first time in decades stalled and in some cases even reverted this trend in a number of countries. Climate change is increasingly becoming a major challenge for food security and we can anticipate that hunger caused by crop damages will become much more common. -/- Since many of (...) the challenges humanity faced in the past were overcome by inventive solutions coming from the life sciences, we are compelled to reconsider how we incentivize science and technology development so that those in need can benefit more broadly from scientific research. There is a huge portion of the world population that is in urgent need for medicines to combat diseases that are currently neglected by the scientific community and could immensely benefit from agricultural research that specifically targets their environmental conditions. At the same time efforts have to be made to make the fruits of current and future research more widely accessible. These changes would have to be backed by a range of moral arguments to attract people with diverging notions of global justice. This article explores the main ethical theories used to demand a greater share in the benefits from scientific progress for the poor. Since life sciences bring about a number of special concerns, a short list of conflictive issues is also offered. (shrink)

The intellectual property regimes we have currently in place are heavily under attack. One of the points of criticism is the interaction between two elements of article 27 of the Universal Declaration of Human Rights, the widely discussed issue of being able to benefit from scientific progress and the less argued for position of having a right to take part in scientific enterprises. To shine light on the question if we should balance the two elements or prioritize one of them, (...) an exploration will be offered on how benefiting from scientific progress and the ability to participate in the advancement of science relate to securing human capabilities. A different perspective to the question will be gained by identifying the problem as an issue of misrecognition, especially the failure to recognize many willing collaboration partners in scientific research as peers. Lastly, I will argue that cooperative justice requires that if we have an innovation incentive system that disproportionally benefits one particular group, a certain duty to counterbalance this advantage exists when we are relying on mutual cooperation for the recognition of intellectual property rights. In 1993, Richard Hare argued that, contrary to received opinion, Kant could have been a utilitarian. In this article, I argue that Hare was wrong. Kant's theory would not have been utilitarian or consequentialist even if his practical recommendations coincided with utilitarian commands: Kant's theory of value is essentially anti-utilitarian; there is no place for rational contradiction as the source of moral imperatives in utilitarianism; Kant would reject the move to separate levels of moral thinking: first-order moral judgement makes use (...) of the principle of morality; and, relatedly, he would resist the common utilitarian distinction between actions and their motives because any correct description of an action must refer to motivation. The article concludes with the thought that any consequentialist theory based on pre-given ends (teleology) lacks the philosophical resources to distinguish between willing something as a means and as an end, leaving means only, and destroying transparency. In this paper, I explore two closely related ethical principles, ‘Ought implies Can’ and the Kantian ‘Du kannst, denn du sollst’ . The former principle is mainly used to diffuse moral dilemmas and other problem cases. Possibility is a necessary condition of obligation. Recent criticism notwithstanding, the principle is shown to be defensible and useful in the case of genuine, action-guiding oughts. The latter principle makes use of the former, but it in addition presupposes the validity of a moral command (...) and on that basis concludes that the agent must be able to act accordingly. ‘Du kannst, denn du sollst’ has its roots in Kantian ethics: the firm consciousness of moral necessity serves as the ratio cognoscendi of human freedom. The principle is mainly directed against metaphysical scepticism turning on the validity of natural determinism. It is doubtful whether many non-Kantians would be willing to support it in its original metaphysical incarnation. (shrink)
