Research that is initiated, designed or funded by sponsor agencies based in countries with relatively high social and economic development, and conducted in countries that are relatively less developed, gives rise to many important ethical challenges. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. This paper summarises the major outcomes of the UNAIDS consultative process. (shrink)

The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. Accordingly, works of architecture that are artworks will play a decisive role in my argument. (shrink)

Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. The concept of an operator is used in a variety of practical and theoretical areas. Operators, as both conceptual and physical entities, are found throughout the world as subsystems in nature, the human mind, and the manmade world. Operators, and what they operate, i.e., their substrates, targets, or operands, have a wide variety of forms, functions, and properties. Operators have explicit philosophical significance. On the one hand, they represent important ontological issues of reality. On the other hand, epistemological operators form (...) the basic mechanism of cognition. At the same time, there is no unified theory of the nature and functions of operators. In this work, we elaborate a detailed analysis of operators, which range from the most abstract formal structures and symbols in mathematics and logic to real entities, human and machine, and are responsible for effecting changes at both the individual and collective human levels. Our goal is to find what is common in physical objects called operators and abstract mathematical structures, with the name operator providing foundations for building a unified but flexible theory of operators. The paper concludes with some reflections on functionalism and other philosophical aspects of the ‘operation’ of operators. (shrink)

In “The logic of deep disagreements” (Informal Logic, 1985), Robert Fogelin claimed that there is a kind of disagreement – deep disagreement – which is, by its very nature, impervious to rational resolution. He further claimed that these two views are attributable to Wittgenstein. Following an exposition and discussion of that claim, we review and draw some lessons from existing responses in the literature to Fogelin’s claims. In the final two sections (6 and 7) we explore the role reason can, (...) and sometimes does, play in the resolution of deep disagreements. In doing this we discuss a series of cases, mainly drawn from Wittgenstein, which we take to illustrate the resolution of deep disagreements through the use of what we call “rational persuasion.” We conclude that, while the role of argumentation in “normal” versus “deep” disagreements is characteristically different, it plays a crucial role in the resolution of both. Despite an intractable judiciary, there is widespread consensus within the legal academy that jury nullification is compatible with the rule of law. This proposition is most strongly tested by where a jury nullifies simply because it disagrees with the law itself. While some substantive nullifications can comport with the rule of law, most commentatorsjustice,vely undifferentiated view of a morality (even though jurisdictional and vicinage morality can diverge). In doing so, a healthy vision of antityrannical nullifications is presented, but this leaves (...) out many problematic cases. Once these errors are rectified, a more nuanced picture emerges, and it becomes apparent that localism will often disrupt the congruence feature of the rule of law. (shrink)

While democracy is derided for a variety of reasons in Plato’s thought, his most damning critique of that regime type does not involve an observation about democracy qua democracy, but of the transition that it so easily engenders: the decline to tyranny. Regimes are composed of individuals and groups, though, and Plato is anxious to ascribe culpability for the degradation. Two actors are the primary focus of his analysis — the political leaders and the demos. At times he emphasizes the (...) puissance of the demos, but in other passages he suggests it is the leaders who are most authoritative. This paper discusses these apparently contradictory passages, and works towards a reconciliation. It argues that neither is assigned sole culpability, as both work in complex synrgy, and that the underlying cause of the decline—and the motivator behind both actors — is not simply freedom, but greed for material wealth. In spite of the importance of point mutations for evolution and human diseases, their natural spectrum of incidence in different species is not known. Here I propose to determine these spectra by comparing consecutive sequence periods in stretches of repetitive DNA. The article presents the analysis of more than 51,000 such point mutations identified by this approach in the genomes of human, chimpanzee, rat, mouse, pufferfish, zebrafish, and sea squirt. I propose to explain the observed spectra by auto‐mutagenic mechanisms of (...) genome variation involving the inter‐conversions of nucleotides, single base‐pair inversions and their combinations. Fichte's System of Ethics, published in 1798, is at once the most accessible presentation of its author's comprehensive philosophical project, The Science of Knowledge or Wissenschaftslehre, and the most important work in moral philosophy written between Kant and Hegel. Fichte's ethics integrates the discussion of our moral duties into the systematic framework of a transcendental theory of the human subject. Many say that ontological disputes are defective because they are unimportant or without substance. In this paper, we defend ontological disputes from the charge, with a special focus on disputes over the existence of composite objects. Disputes over the existence of composite objects, we argue, have a number of substantive implications across a variety of topics in metaphysics, science, philosophical theology, philosophy of mind, and ethics. This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast. Metaphysicians frequently appeal to the idea that theoretical simplicity is truth conducive in metaphysics, in the sense that, all other things being equal, simpler metaphysical theories are more likely to be true. In this paper I defend the notion that theoretical simplicity is truth conducive in metaphysics, against several recent objections. I do not give any direct arguments for the thesis that simplicity is truth conducive in metaphysics, since I am aware of no such arguments. I do argue, however, that (...) there is no special problem with the notion that simplicity is truth conducive in metaphysics. More specifically, I argue that if you accept the idea that simplicity is truth conducive in science, then it would be objectionably arbitrary to reject the idea that simplicity is truth conducive in metaphysics. We argue that one can explain why the influence of illusions decreases during a movement without assuming that different visual representations are used for planning and control. The basis for this is that movements are guided by a combination of correctly perceived information about certain attributes (such as a target's position) and illusory information about other attributes (such as the direction of motion). We explain how this can automatically lead to a decreasing effect of illusions when hitting discs that move (...) in an illusory direction, and when grasping objects of which the apparent size or orientation has been changed by an illusion. Quelle conception de la science proposer aujourd'hui? Les grandes doctrines du XXe siècle se sont heurtées successivement à des difficultés, que ce soit le positivisme du Cercle de Vienne ou le rationalisme critique de Popper. Même la perspective historique inspirée par Bachelard et par Kuhn a donné lieu à des versions disparates. Pourtant, toutes ces tentatives partent d'un même constat : l'échec de la vision classique de la science et la nécessité d'un nouveau discours. On peut en retracer l'histoire. Face (...) à la pluralité des hypothèses possibles au sujet de l'espace, du temps et de la matière, Poincaré pose l'existence de conventions, ou mieux de libres décisions, au cœur de la science. Ainsi, dès la fin du XIXe siècle, il coupe court aux projets traditionnels de fondation : ni le synthétique a priori de Kant, ni les faits généraux de Comte ne sauraient expliquer la nature de l'activité scientifique. Mereological nihilism (henceforth just "nihilism") is the thesis that composition never occurs. Nihilism has often been defended on the basis of its theoretical simplicity, including its ontological simplicity and its ideological simplicity (roughly, nihilism's ability to do without primitive mereological predicates). In this paper I defend nihilism on the basis of the theoretical unification conferred by nihilism, which is, roughly, nihilism's capacity to allow us to take fewer phenomena as brute and inexplicable. This represents a respect in which nihilism enjoys (...) greater theoretical simplicity than its rivals which has not yet been explored, and which is immune to many of the objections which have been leveled against previous arguments for nihilism from nihilism's theoretical simplicity. Composition as identity might be thought to confer a similar degree of theoretical unification as nihilism. I end the paper by arguing that this is not the case. (shrink)

The following is an essay review of Paul Needham's translation of Pierre Duhem's Lemixte et la combinaison chimique and a numberof other essays. In this review we describe theintent and general features of Le mixte and try to place it in the larger context of Duhem'sprogram for energetics. The long essay (Essay3) opposing Marcellin Berthelot'sthermochemistry is singled out for detailedcommentary, since it gives Duhem's reasons forendorsing Josiah Willard Gibbs's chemicalstatics. We argue that a chemical mechanics ofa Gibbsian sort, defended in (...) Le mixte and otheressays in this volume, was the inspiration for,and basis of, Duhem's energetics. Needham'swelcome translations help an English-languageaudience to better understand the basiccontours of Duhem's important, if ultimatelymisguided, project. Mereological nihilism is the thesis that composite objects—objects with proper parts—do not exist. Nihilists generally paraphrase talk of composite objects F into talk of there being “xs arranged F-wise” . Recently several philosophers have argued that nihilism is defective insofar as nihilists are either unable to say what they mean by such phrases as “there are xs arranged F-wise,” or that nihilists are unable to employ such phrases without incurring significant costs, perhaps even undermining one of the chief motivations for (...) nihilism. In this paper I defend nihilism against these objections. A key theme of the paper is this: if nihilists need to employ such phrases as “there are xs arranged F-wise,” non-nihilists will need to do so as well. Accordingly, any costs incurred by the nihilist when she employs such phrases will be shared by everyone else. What’s more, such phrases are intelligible when employed by the nihilist, as well as when they are employed by the non-nihilist, insofar as analyses of such phrases will not essentially involve mereological concepts incompatible with nihilism.
