Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. Research that is initiated, designed or funded by sponsor agencies based in countries with relatively high social and economic development, and conducted in countries that are relatively less developed, gives rise to many important ethical challenges. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." In spite of the importance of point mutations for evolution and human diseases, their natural spectrum of incidence in different species is not known. Here I propose to determine these spectra by comparing consecutive sequence periods in stretches of repetitive DNA. The article presents the analysis of more than 51,000 such point mutations identified by this approach in the genomes of human, chimpanzee, rat, mouse, pufferfish, zebrafish, and sea squirt. I propose to explain the observed spectra by auto‐mutagenic mechanisms of (...) genome variation involving the inter‐conversions of nucleotides, single base‐pair inversions and their combinations. Fichte's System of Ethics, published in 1798, is at once the most accessible presentation of its author's comprehensive philosophical project, The Science of Knowledge or Wissenschaftslehre, and the most important work in moral philosophy written between Kant and Hegel. Fichte's ethics integrates the discussion of our moral duties into the systematic framework of a transcendental theory of the human subject. This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast. This study investigated what information about brain death was available from Google searches for five major religions. A substantial body of supporting research examining online behaviors shows that information seekers use Google as their preferred search engine and usually limit their search to entries on the first page. For each of the five religions in this study, Google listings reveal ethical controversy about organ donation in the context of brain death. These results suggest that family members who go online to (...) find information about organ donation in the context of brain death would find information about ethical controversy in the first page of Google listings. Organ procurement agencies claim that all major world religions approve of organ donation and do not address the ethical controversy about organ donation in the context of brain death that is readily available online. This article presents a structured and systematic approach for identifying and modelling compliance risks. The sophistication with which modern business is carried out and the unprecedented access to a global market means that businesses are exposed to increasing and diverse regulatory requirements in and across jurisdictions. Compliance with such requirements is practically challenging, partly due to the complexity of regulatory environments. One possibility in this regard is a risk-based approach to compliance, where resources are allocated to those compliance issues that (...) are most risky. Despite the need for risk-based compliance, few specific methods and techniques for identifying and modelling compliance risks have been developed. Due to the lack of methodological and tool support, compliance risk identification often involves unstructured brainstorming, with uncertain outcomes. The proposed approach consists of a five-step process for the structured identification and assessment of compliance risks. This process aims at facilitating the identification of compliance risks and their documentation in a consistent and reusable fashion. As part of the process, the article provides a systematic approach for a graphical modelling of compliance risks, which aims at facilitating communication among experts from different backgrounds. The creation of graphical models can be partly automated based on natural language patterns for regulatory requirements. Furthermore, the structuring of the compliance requirement in a template aims at simplifying the modelling of compliance risks and facilitating a potential future automated model. (shrink)

The programme of bringing together Literary Studies and Intellectual History (›Geistesgeschichte‹) has its foundation in the notion of context. At first sight, literary text and historical context look as if they could be separated from each other with ease. However, each text carries with it contextual elements just as much as each context is always already imbued with textuality. What seems to be at stake is their relation. This is above all taken into account by functionalist approaches less interested in (...) the attribution of functions to seemingly pre-existent structures than seeing structure as following function. It clearly undermines the commonsensical assumption that structure precedes function – just as much as it destabilizes the hermeneutical relation between question and answer and the epistemological precedence of the real over the imaginary: obviously, the contextual ›seat in life‹ seems to have the same impact on text-making as textual meaning has in relation to its context; wherever the construction of a ›reality‹ looks like a plausible imaginary answer to the question of what the world is, imagination in literature and art seems to be the site of turning the answers back into questions. In the premodern period, seen as the epoch of a shift from a predominantly analogical world-view, characterized by a cosmological closure guaranteed by God, to the open concept of reality as the result of a temporal and causal, man/woman-made individual realization, this seems to be one of the decisive driving forces affecting the modification of the social imaginary, both in its framing and in its truth-finding methods, with regard to the process of ›epochal‹ change. One of the leading figures of Logical Positivism, Moritz Schlick, wrote a well-known article “On the Foundations of Knowledge”, edited in English by Sir Alfred Ayer in 1959, in which he proposes Konstantierungen, also known as affirmations or confirmations in English, to play the part of the much sought-after indubitable and incorrigible foundation of personal belief. In the present article I will oppose this view via the perspective of confirmations in their linguistic nature, a trait that renders Konstatierungen untenable both (...) as sentences in Language of Thought – where it is thought that is linguistic, and natural language is but a means for expressing it-, and as occurring in natural languages due to the obligatory phenomenon of grammatical evidentiality in many world languages. Given that the world as we perceive it appears to be predominantly classical, how can we stabilize quantum effects? Given the fundamental description of our world is quantum mechanical, how do classical phenomena emerge? Answers can be found from the analysis of the scaling properties of modular quantum systems with respect to a given level of description. It is argued that, depending on design, such partitioned quantum systems may support various functions. Despite their local appearance these functions are emergent properties (...) of the system as a whole. With respect to the separation of subject and object such functions of interest are control, simulation, and observation. They are interpreted in close analogy with more basic physical behavior.
