This article examines how private equity returns in Asia are related to levels of legal protection and corruption. We utilize a unique data set comprising over 750 returns to private equity transactions across 20 developing and developed countries in Asia. The data indicate that legal protections are an important determinant of private equity returns in Asia, but also that private equity managers are able to mitigate the potential for corruption. The quality of legal system (including legal protections) is positively related (...) to returns. Inefficient legal protections negatively impact transaction structures and economic certainty when exiting investments. We also find that private equity managers, irrespective of the quality of legal system they are operating within, can mitigate the potential impact of corruption. Private equity returns are higher in countries with higher levels of corruption, controlling for legal systems. This finding is consistent with the view that private equity managers bring about organizational change to alleviate the costs of corruption. Our findings are robust to inclusion of controls for Hofstede cultural variables, economic conditions, and transaction specific characteristics, as well as consideration of econometric sample selection methods for unexited investments. As engineers propose constructing humanlike automata, the question arises as to whether such machines merit human rights. The issue warrants serious and rigorous examination, although it has not yet cohered into a conversation. To put it into a sure direction, this paper proposes phrasing it in terms of whether humans are morally obligated to extend to maximally humanlike automata full human rights, or those set forth in common international rights documents. This paper’s approach is to consider the ontology of humans (...) and of automata and whether ontological difference between them, that pertains to the very bases of human rights, affects the latter’s claims to full human rights. Considering common bases of human rights, can these bases tell us whether a certain ontological distinction of humans from automata—or a de facto distinction about humans tacitly acknowledged by full-rights-recognizing societies—makes a difference in whether humans are morally obligated to assign these entities full rights? Human rights to security also arise. The conclusion is that humans need not be under any moral obligation to confer full human rights on automata. The paper’s ultimate point is not to close the discussion with this ontological cap but to set a solid moral and legal groundwork for opening it up tout court. (shrink)

In recent years, two important books by Yoram Cohen and Matthew Rutz have marked significant progress in research on the archives of Late Bronze Age Emar in northwestern Syria. Both of them approach Emar by way of its scribes. Cohen undertakes a systematic review of all named scribes identified in texts associated with Emar, while Rutz narrows his object to the building that yielded by far the largest number of excavated tablets. The validity and utility of the proximate-ultimate distinction in biology have recently been under debate. Opponents of the distinction argue that it rules out individual-level organismic processes from evolutionary explanations, thereby leading to an unfounded separation between organismic causation and evolutionary causation. Proponents of the proximate-ultimate distinction, on the other hand, argue that it serves an important epistemological role in forming different kinds of explanation-seeking questions in biology. In this paper we offer an interpretation the proximate-ultimate distinction not only as (...) a means of forming explanation-seeking questions, but also as a distinction that can help highlight the way in which individual-level organismic processes can be evolutionary causes. ABSTRACT In this paper I examine some of the issues surrounding the moral status of the therapy known as ‘deprogramming’. I argue against the extreme view that all deprogrammings are morally impermissible. In certain instances deprogramming is morally justified because it is quite capable of restoring the conditions needed for the exercise of autonomy. The view of autonomy I am following is that constructed by Gerald Dworkin, wherein two conditions must be met in describing a person as autonomous—authenticity and procedural (...) independence. Autonomy of another type, described by Dworkin as authenticity plus substantive independence, may be lost by persons involved in cults but in those instances deprogramming as reconstructed in this paper is not a morally justified measure. These two recent books tend to strengthen this assessment. Rhetorical Investigations is a sustained effort to "revisit" and "rethink" grammatical (conceptual) reflections on ordinary language and literature; and in so doing provide a "reinvention" of characteristics of literary theory through an extensive and detailed consideration of the work of Robert Frost. Although sometimes overreaching in its efforts (particularly when discussing logic), it imaginatively uses rhetoric and ordinary language concerns as a means of direction and focus for new, explanatory discussions in literary—philosophical analysis. Ordinary Language Criticism (part of the general series, "Rethinking Theory," edited by Gary Saul Morson) is a diverse and uneven collection of fifteen articles concerning and using ordinary language interests, several of which (R. M. Berry, Garry L. Hagberg, Richard Eldridge, Gerald L. Bruns) valuably repay the diligence needed to discover them in 350 plus pages. The text includes an editors' introduction that voices the wish to "return criticism to its grounds in the 'ordinary' or natural language we all speak" and (unsuccessfully but lustily) pronounces and explains "ordinary language criticism" as a new yet traditional area of study. ("New" in that it takes "as its point of departure" the ordinary language philosophy of Wittgenstein, and "traditional" in that "all criticism is really ordinary language criticism.") The editors further undertake in this introduction the endeavor to sketch something of a program for the book, meant to show connected promptings among the various writings, whereas the specific authors themselves settle down quickly and separately to a critical work at hand without particular references to each other. Both of these texts, like others in this field of study before, valuably raise questions and apprehensions of what use there is in talk about ordinary language. The best of such material provides provocations for thinking that are to be found nowhere else. The worst of such books and articles is that they prejudice sensible people against the study of the ordinary.Can one conceive of something to say about these two books that the authors and the current readers haven't already heard or of which they can be profitably reminded? It certainly would not be wise to presume such a grand stand. This is a large question to which only a small answer might be given here. Setting aside the perhaps undiscussable differences of what we each see of primary importance in the primary texts and how best to read them, one issue and difference of understanding, specific and plain enough to state briefly, perhaps usefully does arise. It is a lack of a clear sense of the "ordinary," its distinctiveness, its implications; and thereby a continuation of many of the confusions that have inhabited philosophical and literary writing before and after Wittgenstein turned his attention to the matter. Critical development and food studies scholars argue that the current food security paradigm is emblematic of a ‘New Green Revolution’, characterized by agricultural intensification, increasing reliance on biotechnology, deepening global markets, and depeasantization. High-profile examples of this model are not hard to find. Less examined, however, are food-security programs that appear to work at cross-purposes with this model. Drawing on the case of Feed the Future in Guatemala, I show how USAID engages in activities that valorize ancestral crops, subsistence production, (...) and agroecological practices. Rather than the result of macro-level planning—of either the New Green Revolution or a greener reform regime—I argue that nonconforming food security projects can be traced to individual actors and their interactions on the ground. I draw on an ‘interface approach’ (Long 1990 ), focusing on the lifeworlds of development workers, their interfaces with each other, and with the to-be-developed. Doing so reveals how food security projects are significantly shaped by the relationships and interests of development actors enmeshed in particular organizational and national settings. This research contributes a fresh perspective on the food security paradigm and its role within the ‘corporate food regime’. (shrink)

Faculty members in science, technology, engineering, and mathematics disciplines are typically expected to pursue grant funding and publish to support their research or teaching agendas. Providing effective professional development programs on grant preparation and management and on research publications is crucial. This study shares the design and implementation of such a program for Native STEM faculty from two tribal colleges and one public, non-tribal, Ph.D. granting institution during a 3-year period. The overall development and implementation of the program (...) is centered on the six R’s Indigenous framework – Respect, Relationship, Representation, Relevance, Responsibility, and Reciprocity. The role of NAF-STEM and their interactions with the program, as members of the community formed by their participation, impacted the program. Their practices and the program co-emerged over time, each providing structure and meaning for the other. Through such reciprocity, NAF-STEM and the program research team continually refined the program through their mutual engagement. They took on the shared responsibility of the program while they participated in and shaped its practices. The process and results of formative and summative assessment and the impact of COVID-19 on the program are reported. Results of the program offer lessons on the implementation of six R’s framework in professional development at institutions of higher education. (shrink)

When there have been substantial failures by institutional leadership in their oversight responsibility to protect research integrity, the public should demand that these be recognized and addressed by the institution itself, or the funding bodies. This commentary discusses a case of research failures in developing genomic predictors for cancer risk assessment and treatment at a leading university. In its review of this case, the Office of Research Integrity, an agency within the US Department of Health and Human Services, focused their (...) report entirely on one individual faculty member and made no comment on the institution’s responsibility and its failure to provide adequate oversight and investigation. These actions missed an important opportunity to emphasize the institution’s critical responsibilities in oversight of research integrity and the importance of institutional transparency and accountability. The executive hypothesis of self-regulation places cognitive information processing at the center of self-regulatory success/failure. While the hypothesis is well supported by cross-sectional studies, no study has tested its primary prediction, that temporary lapses in executive control underlie moments of self-regulatory failure. Here, we conducted a naturalistic experiment investigating whether short-term variation in executive control is associated with momentary self-regulatory outcomes, indicated by negative affect reactivity to everyday stressors. We assessed working memory capacity (WMC) through ultra-brief, ambulatory assessments on smart (...) phones five times per day in a 7-day ecological momentary assessment (EMA) study involving college-aged adults. We found that participants exhibited more negative affect reactivity to stressor exposures during moments when they exhibited lower than usual WMC. Contrary to previous findings, we found no between-person association between WMC and average stress reactivity. We interpret these findings as reflecting the role of executive control in determining one’s effective capacity to self-regulate. (shrink)

Background The fourth section of the 1967 Abortion Act states that individuals (including health care practitioners) do not have to participate in an abortion if they have a conscientious objection. A conscientious objection is a refusal to participate in abortion on the grounds of conscience. This may be informed by religious, moral, philosophical, ethical, or personal beliefs. Currently, there is very little investigation into the impact of conscientious objection on service users in Britain. The perspectives of service users are imperative (...) in understanding the real-world consequences and potential impact of conscientious objection and should be considered when creating and reviewing policies and guidelines. This research provided a platform for women and those who can become pregnant to share their experiences and opinions at a time when these voices are largely excluded in the great tradition of Western political philosophy and law-making processes. Method Five service users were interviewed using a narrative interview approach to uncover their abortion journeys and experiences of conscientious objection. Findings The findings were presented as found poems and uncovered that doctors are not always: informing service users that they have a conscientious objection to abortion, giving service users enough information to access abortion (indirect referral), treating them non-judgmentally, and providing medically correct information. Service users did not experience burdens such as long waiting times and were still able to access legal abortion. However, service users did experience negative emotional effects, as they were often left feeling scared, angry, and hopeless when they were not referred and/or were mistreated. Conclusions Findings indicate that conscientious objection could work in practice. However, it is currently failing some individuals on an emotional level, as not all doctors are adhering to guidelines. Conscientious objection in Britain needs to be addressed, to ensure service users receive fair, impartial, non-judgmental care. (shrink)

Our understanding of the universe has grown rapidly in recent decades. We’ve discovered evidence of water in nearby planets, discovered planets outside our solar system, mapped the genomes of thousands of organisms, and probed the very origins and limits of life. The scientific perspective of life-as-it-could-be has expanded in part by research in astrobiology, synthetic biology, and artificial life. In the face of such scientific developments, we argue there is an ever-growing need for universal biology, life-as-it-must-be, the multidisciplinary study of (...) non-contingent aspects of life as guided by biological theory and constrained by the universe. We present three distinct but connected ways of universalizing biology—with respect to characterizing aspects of life everywhere, with respect to the explanatory scope of biological theory, and with respect to extending biological insights to the structure of nonbiological entities. For each of these, we sketch the theoretical goals and challenges, as well as give examples of current research that might be labeled universal biology. (shrink)

The usefulness of ‘realism’ in explaining Russia’s decision to invade Ukraine has become a keenly contested debate not only in International Relations but in wider public intellectual discourse since the onset of the war in February 2022. At the centre of this debate is the punditry of John J. Mearsheimer, a prominent offensive realist who is a Professor of International Relations at the University of Chicago. This article argues that although Mearsheimer is indeed a realist, his offensive realism is but (...) one of many different realist theories that can forward an explanation of the Ukraine War. Beyond the apparent hegemony of structural realism (the branch of realism to which Mearsheimer’s offensive realism belongs), it is argued that classical and neoclassical realist frameworks can provide more nuanced and, ultimately, convincing arguments as to why Russian President Vladimir Putin decided to invade Ukraine. This is because both classical and neoclassical realism can incorporate insights from non-realist studies—such as the concepts of civilization and ontological security—and combine them into an overarching power politics framework. Although neither classical nor neoclassical realism is flawless in their explanations, they demonstrate that realism does not just have to be about international power structures but can offer multivariate accounts of why a state, like Russia, decided to act, such as invading Ukraine. Since the late 1970s, theologians have been attempting to integrate mimetic theory into different fields of theology, yet a distrust of mimetic theory persists in some theological camps. In" Rene Girard, Unlikely Apologist: Mimetic Theory and Fundamental Theology," Grant Kaplan brings mimetic theory into conversation with theology both to elucidate the relevance of mimetic theory for the discipline of fundamental theology and to understand the work of Rene Girard within a theological framework. Rather than focus on Christology or atonement (...) theory as the locus of interaction between Girard and theology, Kaplan centers his discussion on the apologetic quality of mimetic theory and the impact of mimetic theory on fundamental theology, the subdiscipline that grew to replace apologetics. His book explores the relation between Girard and fundamental theology in several keys. In one, it understands mimetic theory as a heuristic device that allows theological narratives and positions to become more intelligible and, by so doing, makes theology more persuasive. In another key, Kaplan shows how mimetic theory, when placed in dialogue with particular theologians, can advance theological discussion in areas where mimetic theory has seldom been invoked. On this level the book performs a dialogue with theology that both revisits earlier theological efforts and also demonstrates how mimetic theory brings valuable dimensions to questions of fundamental theology. Religionists and leftists have aligned themselves with several green causes, but have yet to engage each other in a real discussion of environmental issues. In this paper, I try to establish the basis for a dialogue between those segments of the religionist and leftist traditions that appear to have the most promise for forging a united green front. I label these two subgroups constructive postmodern religionistsand constructive postmodern leftists. I summarize the key ideas shared by each group, discuss how each (...) can rectify some of the weaknesses of the other, and consider some potential philosophical barriers to their union. Human behavior depends on the ability to effectively introspect about our performance. For simple perceptual decisions, this introspective or metacognitive ability varies substantially across individuals and is correlated with the structure of focal areas in prefrontal cortex. This raises the possibility that the ability to introspect about different perceptual decisions might be mediated by a common cognitive process. To test this hypothesis, we examined whether inter-individual differences in metacognitive ability were correlated across two different perceptual tasks where individuals made judgments (...) about different and unrelated visual stimulus properties. We found that inter-individual differences were strongly correlated between the two tasks for metacognitive ability but not objective performance. Such stability of an individual’s metacognitive ability across different perceptual tasks indicates a general mechanism supporting metacognition independent of the specific task. (shrink)

Most current dental ethics curricula use a deontological approach to biomedical and dental ethics that emphasizes adherence to duties and principles as properties that determine whether an act is ethical. But the actual ethical orientation of students is typically unknown. The purpose of the current study was to determine the ethical orientation of dental students in resolving clinical ethical dilemmas. First-year students from one school were invited to participate in an electronic survey that included eight vignettes featuring ethical conflicts common (...) to the health care setting. The Multidimensional Ethics Scale was used to evaluate the students’ ethical judgments of these conflicts. Students rated each vignette along 13 ethically relevant items using a 7-point scale. Nine of the thirteen items were analyzed because they represent the dominant ethical theories, including deontology. One hundred sixteen dental students successfully completed the survey. Of the analyzed items, those associated with deontology had comparatively weak associations with whether students judged the action to be ethical and whether students judged themselves likely to perform the action. Whether an action was judged to be caring had the strongest association with whether the action was judged to be ethical and whether students judged themselves likely to perform the action. These results suggest that adherence to duties or principles has weaker association with students’ ethical judgments and behavior compared to caring, which was found to be more influential in their ethical judgments and behavior. Introspection, or metacognition, is the capacity to reflect on our own thoughts and behaviours. Here, we investigated how one specific metacognitive ability develops in adolescence, a period of life associated with the emergence of self-concept and enhanced self-awareness. We employed a task that dissociates objective performance on a visual task from metacognitive ability in a group of 56 participants aged between 11 and 41 years. Metacognitive ability improved significantly with age during adolescence, was highest in late adolescence and plateaued going (...) into adulthood. Our results suggest that awareness of one’s own perceptual decisions shows a prolonged developmental trajectory during adolescence. (shrink)

Clatterbuck et al. (Biol Philos 28: 577–592, 2013) argue that there is no fact of the matter whether selection dominates drift or vice versa in any particular case of evolution. Their reasons are not empirically based; rather, they are purely conceptual. We show that their conceptual presuppositions are unmotivated, unnecessary and overly complex. We also show that their conclusion runs contrary to current biological practice. The solution is to recognize that evolution involves a probabilistic sampling process, and that drift is (...) a deviation from probabilistic expectation. We conclude that conceptually, there are no problems with distinguishing drift from selection, and empirically—as modern science illustrates—when drift does occur, there is a quantifiable fact of the matter to be discovered. The Italian Republic was created at the close of World War II by the political forces that had taken part in the Resistance, with an explicitly anti-fascist ideological foundation. However, the official commitment to anti-fascism and democracy was belied by the continuing role of neo-fascist parties and organizations in the political system. This role was firstly as a potential alternative source of support for the ruling Christian Democrats, and secondly as the key element of a hidden network ready to use (...) violent and undemocratic means to condition the normal political process. This network moved into action at the height of the “strategy of tension” (1969–80). Analysis of this period leads us to reassess the nature of postwar Italian democracy. In the “Second Republic” (post-1994) Silvio Berlusconi has promoted a revisionist approach to Fascism and the Resistance as part of his own strategy to maintain himself in power, while also espousing a plebiscitarian conception of democracy that presents certain analogies with the methods and style of the Fascist regime.
