One worry about metaethical expressivism is that it reduces to some form of subjectivism. This worry is enforced by subjectivists who argue that subjectivism can explain certain phenomena thought to support expressivism equally well. Recently, authors have started to suggest that subjectivism can take away what has often been seen as expressivism's biggest explanatory advantage, namely expressivism's ability to explain the possibility of moral disagreement. In this paper, I will give a response to an argument recently given by Frank (...) Jackson to this conclusion that will show that it is false that subjectivism could explain disagreement as well as expressivism. (shrink)

Constructibility and complexity play central roles in recent research in computer science, mathematics and physics. For example, scientists are investigating the complexity of computer programs, constructive proofs in mathematics and the randomness of physical processes. But there are different approaches to the explication of these concepts. This volume presents important research on the state of this discussion, especially as it refers to quantum mechanics. This `foundational debate' in computer science, mathematics and physics was already fully developed in 1930 in the (...) Vienna Circle. An introduction to informal logic, critical thinking and rhetoric utilizing actual public discourse .

In the context of discovery-oriented hypothesis testing research, behavioral scientists widely accept a convention for false positive (α) and false negative error rates (β) proposed by Jacob Cohen, who deemed the general relative seriousness of the antecedently accepted α = 0.05 to be matched by β = 0.20. Cohen’s convention not only ignores contexts of hypothesis testing where the more serious error is the β-error. Cohen’s convention also implies for discovery-oriented hypothesis testing research that a statistically significant observed effect is (...) four times more probable to be a mistaken discovery than for a statistically significant true observed effect to be independently replicable. In the long run, Cohen’s convention thus is epistemically harmful to the development of a progressive science of human behavior, making its acceptance crucial in explaining the replication crisis in behavioral science. The balance between α- and β-errors generally ought to be struck using both epistemic and practical considerations. Yet epistemic considerations alone imply that making a genuine contribution to the body of knowledge in behavioral science requires error rates that are not only small but also symmetrical. (shrink)

Like many governments in this COVID-19 pandemic, the Nigerian government imposed a lockdown on the country. As a consequence of the lockdown, many businesses shutdown and effectively had no source of revenue. Yet, without receiving any bailout or palliatives from the government, these businesses are required to meet their tax obligations to the government. Bearing in mind that this time (COVID-19 era) is different, one wonders what is required of businesses in view of the taxation problem and the social contract (...) between the businesspersons and the government. In view of social contract obligations, in this COVID-19 pandemic should businesses pay tax to a government that seems to have delegitimised itself by its exploitative actions in terms of taxation and delinquent omission in terms of the provision of public goods and social services? The Nigerian government at all tiers (federal, state and local) seldom respect the essence of taxation. Therefore, businesses often pay tax for nothing. For many businesses, as far as taxation is concerned, to pay or not to pay? that is the question. This article is aimed at teasing out this taxation problem that may or may not be a moral dilemma. In view of certain ethical considerations, this article shows why in spite of social contract obligations, there is no consensus or canonical agreement on whether, as law-abiding citizens and juridical persons (legal entities), businesspersons and businesses ought to or ought not to pay tax to the Nigerian government in this COVID-19 pandemic. How does tacit knowledge inscribe itself into cultural and social practices? As the established distinction between tacit and explicit or discursive forms of knowledge does not explain this question, the contributions in this volume reconstruct, describe, and analyze the manifold processes by which the tacit reveals itself: They focus, for example, on metaphors, myths, and visualizations as explications of the tacit as well as on processes of embodiment. This is a comprehensive study of the far-reaching changes that led to a re-shaping of the philosophical discourse in Islam during the sixth/twelfth century. Whereas earlier Western scholars thought that Islam's engagement with the tradition of Greek philosophy ended during that century, more recent analyses suggest its integration into the genre of rationalist Muslim theology (kalam). This book proposes a third view about the fate of philosophy in Islam. It argues that in addition to this integration, Muslim theologians picked up (...) the discourse of philosophy in Islam (falsafa) and began to produce books on philosophy. Written by the same authors, books in these two genres, kalām and philosophy, argue for opposing teachings on the nature of God, the world's creation, and on the afterlife. This study explains the emergence of a new genre of philosophical books called "hikma" that stand opposed to Islamic theology and at the same wishes to complement it. Offering a detailed history of philosophy in Iraq, Iran, and Central Asia during the sixth/twelfth century together with an analysis of the circumstances of practicing philosophy during this time, this study can show how reports of falsafa, written by major Muslim theologians such as al-Ghazali (d. 505/1111), developed step-by-step into critical assessments of philosophy that try to improve philosophical teachings, and eventually become fully fledged philosophical summas in the work of Fakhr al-Din al-Razi (d. 606/1210). The book ends in a discussion of the different methods of kalam and hikma and the coherence and ambiguity of a Muslim post-classical philosopher's œuvre. (shrink)

Inhabitants of low-lying islands flooded due to anthropogenic climate change will lose their territory and thereby their ability to exercise their right to political self-determination. This paper addresses the normative questions which arise when climate change threatens territorial rights. It explores whether the loss of statehood supports a claim to territorial compensation, and if so, how it can be satisfied. The paper concludes that such claims are well founded and that they should be met by providing compensatory territories. After introducing (...) a differentiation between land rights and territorial rights, previous theoretical responses to the problem of sinking islands are criticized. It is argued that states may be required to give up parts of their territory as compensation. The paper develops criteria of sufficiency for compensatory territories and proposes to base their selection process on a negative auction. Since it is unlikely that unsettled compensatory territories that meet the specified requirements are available, the rights of their original inhabitants are discussed. (shrink)

Ever since Kant, moral philosophers have been more or less animated by the mission of discovering inescapable law-like rules that would provide a binding justification for morality. Recently, however, many have started to question whether this is possible and what, after all, this project could achieve. An alternative vision of the task of moral philosophy starts from the pragmatist idea that philosophizing begins and ends in human experiencing. It leads to a view where morality is seen as a “social technology” (...) that aims to make living together possible, and strengthens people's capability to live a good life within a society. The role of moral philosophy is, accordingly, to develop our moral tools further. Moral philosophers become ethical engineers who use their expertise in ethical topics to criticize existing “moral technology” and construct new concepts, tools, and theories that better answer the current challenges for living a good life. Closer examination, however, throws doubt upon this transparency claim and it is argued that filmic realism is not the proper lens through which to understand stand-up specials, that they represent a more artistic medium in which the director of the special needs to (...) be seen as an artist along with the comedian. John Rawls proposed, as what he called “the liberal principle of legitimacy,” that coercive exercises of political power can be justified to free and equal dissenters when “in accordance with a constitution (written or unwritten) the essentials of which all citizens, as reasonable and rational, can endorse.” Does “unwritten constitution” there refer to norms of constitutional import, but that subsist only as custom, not as law? Twice in the 2020 term, in Bostock and Comcast, the Supreme Court doubled down on the reasoning of “but-for causation” to interpret antidiscrimination statutes. According to this reasoning, an outcome is discriminatory because of some status—say, sex or race—just in case the outcome would not have occurred “but-for” the plaintiff’s status. We think this reasoning embeds profound conceptual errors that render the decisions deeply confused. Furthermore, those conceptual errors tend to limit the reach of antidiscrimination law. In this essay, we (...) first unpack the ambiguity of this but-for causal reasoning. We then show that this reasoning arises from a misapplication of tort law principles within antidiscrimination law, and that, as a result, it is both conceptually and normatively indeterminate. Life goals or aspirations can be distinguished as intrinsic or extrinsic, with different implications for well-being. In this study we used network analysis to reexamine this intrinsic-extrinsic distinction, illustrating how novel candidate aspirations can be mapped along this dimension using innovative methods. We identify four previously unexamined life aspirations, predicting that aspiring for power and social adherence would group with extrinsic goals, whereas aspiring for self-expression and mastery would group with intrinsic goals. In two samples (n = 196; n = (...) 346) we analyze both the original life-goal variables and these novel aspirations using factor analysis, multidimensional scaling, circumplex modeling, and a network analysis using a graphical least absolute shrinkage and selection operator (glasso) to estimate the network structure of aspirations using EBIC. Replicating past intrinsic-extrinsic distinctions, all four methods further classified power and social adherence as extrinsic goals, and self-expression and mastery as intrinsic goals. The intrinsic-extrinsic distinction was also clearly visible in the network analysis. Finally, consistent with hypotheses, power and social adherence were unrelated to wellness indicators, whereas self-expression and mastery correlated positively with well-being indicators and negatively with ill-being indicators, supporting their hypothesized nature as extrinsic and intrinsic, respectively. The paper considers the set $\mathscr{M}\mathscr{L}_1$ of first-order polymodal formulas the modal operators in which can be applied to subformulas of at most one free variable. Using a mosaic technique, we prove a general satisfiability criterion for formulas in $\mathscr{M}\mathscr{L}_1$, which reduces the modal satisfiability to the classical one. The criterion is then used to single out a number of new, in a sense optimal, decidable fragments of various modal predicate logics.

We present empirical evidence from social psychological research which suggests that standard methods employed when teaching the heuristics and biases program in the context of critical thinking instruction are likelier to facilitate the discernment and correction of biases in others’ reasoning than to have a similar effect in the self-monitoring case. Exemplified by the social phenomenon of false polarization, we suggest that CT instruction may be improved by fostering student’s abilities at counterfactual meta-cognition, and present a corresponding teaching and learning (...) activity. In the consolidated cases Altitude Express v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC, the Supreme Court will decide whether or not Title VII prohibits discrimination on the basis of sexual orientation or gender identity. Although the parties disagree as to the appropriate formulation of a but-for test to determine whether or not there was a discriminatory outcome, all parties do agree to the use of such a test, which asks “whether the evidence (...) shows ‘treatment of a person in a manner which but for that person’s sex would be different.’” City of Los Angeles, Dep’t. of Water and Power v. Manhart, 435 U.S. 702, 711 (1978). However, but-for tests confuse more than they clarify the inquiry; a discriminatory outcome cannot be explained by appeal to just a discrete characteristic of a particular person. Individuals are not discriminated against because of these characteristics per se. Rather, they are discriminated against because of the social meanings and expectations that attach to these characteristics. Beyoncé and Taylor Swift illustrate the difference between individual-level causation and social explanation in two separate songs, “If I Were a Boy” and “The Man.” The explanation for why the counterfactual ‘male’ Beyoncé and Swift are evaluated differently than their current ‘female’ versions does not lie in individual-level features considered apart from the social world, but in social-level roles and expectations associated with those features. For this reason, a social explanation test—one that asks whether the social meanings of sex characteristics, rather than the characteristics per se, explain the outcome in question—is more suitable for determining whether or not Title VII has been violated. The topic of homonymy, especially the variety of homonymy that has gone under the title, “focal meaning,” is of fundamental importance to large portions of Aristotle’s work—not to mention its central place in the ongoing controversies between Aristotle and Plato. It is quite astonishing, therefore, that the topic should have gone so long without a book-length treatment. And it is all the more gratifying that the new book on homonymy by Christopher Shields should be so comprehensive, and of such uniformly (...) high quality. A concise and readable account of Burke's political philosophy.

Starting with a brief overview of current usages, this paper offers some constituents of a use-based analysis of ‘fallacy’, listing 16 conditions that have, for the most part implicitly, been discussed in the literature. Our thesis is that at least three related conceptions of ‘fallacy’ can be identified. The 16 conditions thus serve to “carve out” a semantic core and to distinguish three core-specifications. As our discussion suggests, these specifications can be related to three normative positions in the philosophy of (...) human reasoning: the meliorist, the apologist, and the panglossian. Seeking to make these conditions available for scholarly discussion, this analysis-sketch should not be viewed as final or exhaustive. (shrink)

I address the ethical treatment of animals from a Heideggerian perspective. My argument proceeds in two stages. First, it is necessary to develop a nonanthropocentric concept of freedom which extends beyond the sphere of human interests. Second, it is essential to show that our capacity to speak must serve the diverse ends of “dwelling,” and hence can be properly exercised only by balancing the interests of animals with those of our own. Rather than point to naturalistic similarities between humans and (...) animals (e.g., the capacity to feel pain), or even ontological ones (e.g., the shared dimension of “care” [Sorge]), the better strategy lies in expanding the scope of moral agency in a way which allows the differences between humans and animals to suggest guidelines as to why the former should exhibit benevolence toward the latter. In this way, I show that the basic percepts of Heidegger’s philosophy support an ethic which can attend to, and speak in behalf of, the welfare of animals. (shrink)

Deep ecology is examined from the perspective of scientific ecology. Two norms, self-realization and biocentric equality, are considered central to deep ecology, and are explored in brief. Concepts of scientific ecology that seem to form a bridge to these norms are ecological hierarchical organization, the exchange of energy, material and information, and the development of species within ecosystems and the biosphere. While semantic problems exist, conceptually it appears that deep ecology norms can be interpreted through scientific ecology.

The history of western philosophy provides many occasions for verifying a general experience: theoretical innovations gain immediate appreciation only if they do not demand too much of the ability of contemporaries to integrate them into their worldview. If they emerge hastily and lack clear connection to their epoch’s expectations about meaning, they will be dismissed as an “untimely growth.” This is, of course, easy enough to understand. What is remarkable, though, is that even subsequent generations that have come to accept (...) the innovation will often continue to regard its originator as taboo. (shrink)

Zusammenfassung Die im Dezember 2022 in Kraft getretene Erweiterung des Infektionsschutzgesetzes sieht vor, im Fall einer Pandemie knappe intensivmedizinische Ressourcen nach dem Kriterium der Überlebenswahrscheinlichkeit zu priorisieren. Der Aufsatz geht der Frage nach, ob der Vorwurf, diese Regelung setze Menschen mit Behinderung einer erheblichen Diskriminierungsgefahr aus, berechtigt ist. Nach einer kurzen Darstellung des im Infektionsschutzgesetz festgelegten Zuteilungsverfahrens wird zunächst das vielschichtige Konzept der Diskriminierung erörtert. Im Kontext der Allokation knapper intensivmedizinischer Ressourcen besteht vornehmlich das Risiko einer nichtintendierten Diskriminierung, die in (...) direkter wie auch indirekter Form erfolgen kann. Die Regelungen, die das Infektionsschutzgesetz trifft, bieten Menschen mit Behinderung einen vergleichsweise hohen Schutz vor direkter Diskriminierung. Dennoch müssen Menschen mit bestimmten Behinderungen gravierende Nachteile hinnehmen, weil sie im Fall einer COVID-19-Infektion absehbar eine geringere Überlebenswahrscheinlichkeit als gesunde Menschen haben. Eine indirekte Diskriminierung liegt aber nur dann vor, wenn für die Auferlegung disproportionaler Nachteile keine hinreichende Rechtfertigung angeführt werden kann. In modernen pluralistischen Gesellschaften, die durch tiefgreifende Wertkonflikte gekennzeichnet sind, sollten unterschiedliche ethische Theorien – darunter auch konsequentialistische Positionen – als mögliche Grundlage einer Rechtfertigung anerkannt werden. Im Ergebnis erweist sich der Vorwurf, eine am Kriterium der Überlebenswahrscheinlichkeit orientierte Zuteilung knapper intensivmedizinischer Ressourcen bewirke eine Diskriminierung von Menschen mit Behinderung, als nicht stichhaltig.
