Utopia makes itself heard as Raphael voices a critique of who we are and configures that no-where which, paradoxically, we want to reach. We look to Deleuze and Guattari when we say that that critique can be envisioned as resistance to the present. AimThe aim of our study was to analyze physical activity levels, sitting time, physical fitness, and their relationship with depressive symptoms after home confinement in previously active older adults.MethodsThis cross-sectional study sample comprised 68 older adults from a community-based exercise program conducted in Porto, Portugal. After home confinement, participants were assessed in person for lower-body strength, cardiorespiratory fitness, agility/dynamic balance, handgrip strength, and anthropometry. Telephone interviews were performed to evaluate depressive symptoms with the Geriatric Depression Scale – 15 items and (...) physical activity levels through the International Physical Activity Questionnaire. Individuals were also asked to self-report changes in their physical activity levels and time spent sitting.ResultsNinety percent of older adults self-reported a decrease in overall physical activity levels, and nearly 65% increased daily sitting time during the home confinement. However, previously active older adults still presented high levels of physical fitness after 11 weeks of home confinement. Overall, 52.9% of participants scored 5 or more points on GDS-15, which is suggestive of depression. Higher levels of moderate-to-vigorous physical activity and cardiorespiratory fitness were found in the non-depressed group compared with the depressed group. Finally, results from multiple regression analysis revealed that MVPA was negatively associated with depression. This model explained 16.4% of the variability seen in depression score, controlled for age, gender, and education.ConclusionEven reporting a decline in physical activity, older adults who previously participated in a formal exercise program, still presented high levels of physical fitness after 11 weeks of home confinement. However, MVPA, but not physical fitness, seems to be an associated depression score in previously active older adults. These results reinforce the importance of older adults to remain physically active, since higher levels of MVPA may have a protective effect on depressive symptoms and, therefore, mitigate the negative impact of home confinement on mental health. Future longitudinal research studies are needed to ascertain these results. (shrink)

Organisations are increasingly transforming themselves to remain profitable and obtain sustainable competitive advantages. Business processes are as important as technology in promoting organisational transformation. Organisational transformation ultimately entails combining existing business components, whether or not with the same use and design, with new ones to generate novel products and services. For example, one particular type of organisation transformation is digital transformation. This notion, which covers even the subjective aspects of organisational transformation, is currently under intensive discussion and suffers from the (...) semantics terms fluctuation related to the notion of ‘organisational transformation’. We argue that this topic could strongly benefit from an ontological analysis and conceptual clarification of these notions. This paper contributes with an attempt in this direction by proposing a Core Ontology of Organisational Transformation (COOT). This ontology comprises concepts and relations central to creating a reference model representing the organisational transformation paradigm. The concept of Smart Healthy Age-Friendly Environments (SHAFE) emphasises the comprehensive person-centred experience as essential to promoting living environments. SHAFE takes an interdisciplinary approach, conceptualising complete and multidisciplinary solutions for an inclusive society. From this approach, we promote participation, health, and well-being experiences by finding the best possible combinations of social, physical, and digital solutions in the community. This initiative emerged bottom-up in Europe from the dream and conviction that innovation can improve health equity, foster caring communities, and sustainable development. (...) Smart, adaptable, and inclusive solutions can promote and support independence and autonomy throughout the lifespan, regardless of age, gender, disabilities, cultural differences, and personal choices, as well as promote happier and fairer living places. The New European Bauhaus initiative gathers “beautiful, sustainable, and inclusive projects and ideas” to inspire a positive transformation around us. The New European Bauhaus 2024 Festival took place between 9-13 April. “Designing the perfect New European Bauhaus neighbourhood: New European Bauhaus meets SHAFE” was a Satellite Event of the Festival, held as an online workshop, organised by the SHAFE Foundation on April 9th, 2024. At the event, a group of 50 participants with a multidisciplinary background discussed how to meet the challenges of the European Garcia family to enable them to live in a perfect neighbourhood. The White Paper presents the findings of the participants with the New European Bauhaus inspiring projects and ideas to house the European Garcia family in their neighbourhood. The White Paper recommends developers, designers, planners, and policymakers to include person-centred design of social and physical environments and technologies. Although awareness of person-centred design is growing, many initiatives still hamper the inclusion of citizens or end-users throughout the development of products and services. (shrink)

Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, surgió la oportunidad de volver (...) a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends like Flavia Carbonell, Fabio Pulido (...) and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. RESUMO Em nosso artigo, faremos uma breve exposição sobre o capítulo XXIV dos Mūlamadhyamakakārikā, de Nāgārjuna, e buscaremos oferecer uma defesa de nossa própria interpretação de sua filosofia, comparando-a com as interpretações semântica e pedagógica propostas, respectivamente, por Garfield e Siderits, por um lado, e Ferraro, por outro. Na nossa exposição, discutiremos a relação entre vazio, cooriginação dependente e verdade, apontando a íntima ligação entre esses termos no interior da filosofia de Nāgārjuna e buscando indicar em que sentido as quatro (...) nobres verdades do budismo, de acordo com o filósofo, só podem ser verdadeiras se elas forem vazias. A partir dessa análise, esperamos poder estabelecer uma relação entre verdade convencional e verdade suprema, tal como abordada nesse capítulo, segundo a qual tanto a verdade convencional quanto a suprema são vazias, sendo que a diferença entre ambas consistiria em que a primeira diz respeito à existência convencional das coisas, enquanto a segunda diz respeito à ausência de essência delas. Nesse sentido, tratar-se-á de analisar como seria possível, para Nāgārjuna, uma compreensão acerca da verdade que nos parece tão contraintuitiva, a saber, a de que a verdade só é possível se for relativa. Esperamos, assim, fazer uma pequena contribuição para a discussão de alguns dos conceitos mais relevantes do pensamento desse importante filósofo budista, sobretudo no que diz respeito à relação da verdade suprema com o vazio. ABSTRACT In our article, we shall make a brief exposition of the chapter XXIV of Nāgārjuna's Mūlamadhyamakakārikā, and we shall attempt to offer a defense of our own interpretation of his philosophy, comparing it to the semantic and pedagogic interpretations proposed, respectively, by Garfield and Siderits, on the one hand, and Ferraro, on the other. In our exposition, we shall discuss the relationship between emptiness, dependent co-origination and truth, pointing to the intimate connection between those terms within Nāgārjuna's philosophy and attempting to indicate in what sense the four noble truths of Buddhism, according to the philosopher, can only be true if they are empty. Through this analysis, we hope to be able to establish a relation between conventional truth and ultimate truth according to which both conventional and ultimate truth are empty, distinguishing themselves only insofar as the first one concerns the conventional existence of things, while the second one concerns the absence of essence of the very same things. With this in mind, we shall analyze how could it be possible, for Nāgārjuna, to have a comprehension on truth that seems to be so counter-intuitive, to wit, that truth is only possible if it's relative. We hope thus to make a small contribution to the discussion of some of the most important concepts of this important Buddhist philosopher, especially with regard to the relation between ultimate truth and emptiness. Although meritorious, Naïve Realism faces theoretical issues stemming from the lack of clarity in the concepts forming its propositions and the relevant (but not usually acknowledged) diversity of its theses. In this paper, my goal is to provide a groundwork that mitigates these theoretical complications. One such distinction concerns its subject matter, in particular, whether it deals with the nature of perceptual episodes or their phenomenology. My first goal is to acknowledge such distinctions by delimiting the former option, which I (...) refer to as “Ontological Naïve Realism”. To accomplish this, I proposed a distinctively minimal version of this position. However, a thorough characterization of the acquaintance relation was necessary for its postulation, which revealed a diversity of the corresponding relations/predicates. This informed the postulation of the minimal thesis and thus the definition of Ontological Naïve Realism. Based on this definition, I also proposed a novel classification and taxonomy of the relevant forms of Ontological Naïve Realism, based on the width of the attribution of naïve-realistic features and whether or not they identify perceptions/illusions to acquaintance instantiations. O objetivo deste trabalho é investigar a natureza ontológica e epistemológica do conceito de informação, focalizando inicialmente a Filosofia e Ética da Informação (EI), propostas por Floridi (1999; 2002; 2004; 2011; 2016), cujo fundamento teórico servirá de suporte para reflexões acerca da inteligência artificial generativa (IAGen), mais especificamente, o ChatGPT. O conceito de informação será abordado a partir de três vertentes na perspectiva filosófico-interdisciplinar: (1) realismo informacional, (2) ecologia informacional e (3) semântica informacional, segundo Gonzalez, Nascimento & Haselager (2004). A (...) partir dessa abordagem, direcionamos nosso estudo para propostas de Floridi (2004), indicando os seus possíveis problemas. Procuraremos entender a Filosofia da Informação, a partir da perspectiva da Ética da Informação (EI), analisando como a EI pode contribuir para reflexões acerca do uso de IA generativa. Problematizamos a EI a fim de construir uma ponte com a Ética Intercultural da Informação (EII) proposta por Capurro (2010). (shrink)

Whole-genome analysis and whole-exome analysis generate many more clinically actionable findings than traditional targeted genetic analysis. These findings may be relevant to research participants themselves as well as for members of their families. Though researchers performing genomic analyses are likely to find medically significant genetic variations for nearly every research participant, what they will find for any given participant is unpredictable. The ubiquity and diversity of these findings complicate questions about disclosing individual genetic test results. We outline an approach for (...) disclosing a select range of genetic results to the relatives of research participants who have died, developed in response to relatives? requests during a pilot study of large-scale medical genetic sequencing. We also argue that studies that disclose individual research results to participants should, at a minimum, passively disclose individual results to deceased participants? relatives. (shrink)

Caster Semenya is done with track and field. At 29, her hopes for a continued career as a professional middle-distance runner are dashed. After her case against International Association for Athletics Federation 1 was dismissed by the Court for Arbitration of Sport on 1 May 2019, she has switched to football later in the year.1 Semenya’s case may have come to its legal conclusion, however it has generated an aporia regarding the binary classification in athletics, which has yet to be (...) solved.2 It is time the implications of the fair equality of opportunity principle as a normative basis for the construction of categories in sport are taken seriously to move forward the debate on unfair advantages in sport. Loland conditionally justifies restricting the women’s category to athletes with testosterone levels below a certain threshold, on the basis of the FEO principle, and of a distinction between stable and dynamic inequalities between athletes. …. Las afirmaciones verdaderas reciben su justificación de creencias que tienen al conocimiento como base, por lo que para su formulación y comprensión se necesita asumir una posición fundacionalista. En este artículo se propone un fundacionalismo confiabilista, inspirado en Goldman, aunque con cambios importantes respecto a su teoría. A diferencia de Goldman, considero que no todas las creencias tienen que ser verdaderas, ni toda justificación de las creencias requiere de la verdad. Adicionalmente, las creencias verdaderas, expresadas mediante oraciones asertóricas, estarían fundadas (...) en creencias aún más básicas, cuya justificación proviene del uso del lenguaje. (shrink)

In this article, we present ideas related to three key aspects of mindfulness training: the regulation of attention via noradrenaline, the importance of working memory and its various components (particularly the central executive and episodic buffer), and the relationship of both of these to mind-wandering. These same aspects of mindfulness training are also involved in the preparation and execution of movement and implicated in the pathophysiology of psychosis. We argue that by moving in a mindful way, there may be an (...) additive effect of training as the two elements of the practice (mindfulness and movement) independently, and perhaps synergistically, engage common underlying systems (the default mode network). We discuss how working with mindful movement may be one route to mindfulness training for individuals who would struggle to sit still to complete the more commonly taught mindfulness practices. Drawing on our clinical experience working with individuals with severe and enduring mental health conditions, we show the real world application of these ideas and how they can be used to help those who are suffering and for whom current treatments are still far from adequate. Social distance often motivates consumers to increase their interactions through social networking sites. This study identifies antecedents of consumer brand usage and brand connection of SNSs, under the influence of consumer perceived ethics (CPE), during the COVID pandemic and afterward (N = 308). The proposed model was tested using partial least squares-structural equation modeling with AMOS 23. In both periods, this study shows CPE consistently affects consumer engagement and involvement. The results demonstrate that in social isolation, affective engagement has higher (...) relevance to driving Self-Brand Connection (SBC) among consumers and SNSs. On the other hand, CPE was demonstrated to provide consistent and significant effects in both periods, showing its stable capacity to impact brand involvement, engagement, use, and self-connection. In the context of the pandemic, this study demonstrates the consistent effects of CPE and other impacts of Consumer Brand Engagement (CBE) on brand usage and self-connection of SNSs. (shrink)

Within the rich literary tradition of the West Syrian (i.e., Syriac Orthodox) Church, two ninth-century authors stand out thanks to a curious problem. The authors are the bishops John of Dara, who lived in the first half of the century, and Moses bar Kepha, who died in northern Iraq in 903. The problem is the literary relationship between several of the texts transmitted in their names. Applying a three-pronged approach to this synoptic problem, this article offers a path toward a (...) solution. On the basis of biographical, stylistic, and philological arguments, it is argued that at least one text that goes under John’s name, On Heretics, was not in fact written by him. The author of that text, likely operating in the tenth century, drew heavily from Moses bar Kepha’s treatise On Paradise, while reshaping the material from Moses, and also incorporating additional material from other sources. Dieses Buch befasst sich mit der rechtlichen Bewertung von modernen Verfahren der Intervention in die menschliche Keimbahn, d.h. von gentechnischen Veränderungen am Menschen, die an die nachfolgenden Generationen weitergegeben werden. Neuartige Methoden wie die CRISPR/Cas9-Technik, der Mitochondrientransfer und die Möglichkeit der Herstellung artifizieller Gameten aus hiPS-Zellen stellen das Recht vor neue Herausforderungen. Insbesondere ist fraglich, ob die aktuell bestehenden Gesetze diese neuen Verfahren noch erfassen oder ob gesetzliche Lücken entstanden sind. Dieses Buch analysiert in diesem Zusammenhang die Rechtslage in Deutschland (...) und Frankreich. Es behandelt dabei sowohl genetische Veränderungen an menschlichen Keimbahnzellen zur Forschung in vitro als auch solche, die in der Geburt von Menschen münden. Zudem wird der Frage nachgegangen, ob das deutsche Verfassungsrecht einer Anwendung dieser Verfahren grundsätzlich entgegensteht oder ob eine gesetzliche Zulassung in der Zukunft unter bestimmten Voraussetzungen möglich wäre. Auf der Grundlage des Rechtsvergleichs sowie der verfassungsrechtlichen Untersuchung formuliert das Buch einen Regelungsvorschlag, sowohl zur Beseitigung aktuell bestehender rechtlicher Lücken und Unklarheiten als auch im Hinblick auf eine mögliche Anwendung der Verfahren. En “Sur un autoportrait de Rembrandt”, Paul Ricoeur trabaja la identidad del pintor holandés analizando un autorretrato de 1660. En vista de que Ricoeur aborda “la escritura como un capítulo en una teoría general de la iconicidad”, da lugar a entenderlo de modo semejante a como W. J. T. Mitchell propone leer a Jaques Derrida: como “un filósofo de la versión gráfica del giro pictorial”. De sostenerse esta lectura, por una parte, la iconicidad devendría una dimensión irreductible de la comprensión (...) de sí. Por la otra, en el autorretrato de Rembrandt de 1660, el autor “real”, tras disolverse en el personaje “irreal” que retrató, creó la distancia para que en carácter de espectador pueda examinarse autobiográficamente merced a objetivarse en su imagen especular. Y en ese análisis de sí por sí devendría un sí mismo capaz de vivir una vida digna de ser vivida. De ser consiste la argumentación, nuestra hipótesis es que la “identidad narrativa”, largamente trabajada por Ricoeur, quedaría subordinada a, al tiempo que complementaría, lo que damos en llamar aquí la “identidad icónica”. The political and financial investments in the implementation of forensic DNA databases and the ethical issues related to their use and expansion justify inquiries into their performance and general utility. The main function of a forensic DNA database is to produce matches between individuals and crime scene stains, which requires a constant input of individual profiles and crime scene stains. This is conditioned, among other factors, by the legislation, namely the criteria for inclusion of profiles and the periods of time (...) and conditions for their retention and/or deletion. This article aims to provide an overview of the different legislative models for DNA databasing in Europe and ponder if wider inclusion criteria – and, consequently, database size – translates into more matches between profiles of crime scene stains and included individuals. The legislation governing forensic DNA databases in 22 countries in the European Union was analysed in order to propose a typology of two major groups of legislative criteria for inclusion/retention of profiles that can be classified as having either expansive effects or restrictive effects. We argue that expansive criteria for inclusion and retention of profiles do not necessarily translate into significant gains in output performance. (shrink)

In June 2023, a group of ‘Aristotelians without Borders’ met in the splendid Villa San Remigio in Verbania, one of the beautiful premises of the University of Eastern Piedmont. Following in the footsteps of Aristotelians over the centuries, the participants were committed to the belief that engaging in dialogue has a value in itself. Our Aristotelian predecessors have collectively bequeathed to us a common language, a shared form of rationality and a grammar of thought which allow us to engage in (...) dialogue despite our differences. One of the main philosophical works by Alexander of Aphrodisias, De principiis, is lost in its original Greek text, but it is preserved in three extant Medieval Semitic versions, one in Syriac and two in Arabic, which were written in the Near East between 500 and 950 AD. These versions are not totally identical and, as we have shown in 2012, they are in a rather complex textual relationship. As we will show in this article, a tentative reconstruction of the (...) lost text should be based upon an attentive and point‑to‑point comparative analysis of some aspect of all three versions.
