The U.S. doctrine of employment-at-will, modified legislatively for protected groups, is being less harshly applied to managerial personnel. Comparable compensation is not otherwise available in the U.S. to workers displaced by technology. Nine pairs of arguments are presented to show how fundamentally management and labor disagree about a company's responsibility for its former employees. These arguments, born of years of labor-management debate, are kaleidoscopic claims about which side has what power. Ultimately, however, not even both together can solve without creative (...) public intervention the emerging problem of massive technological unemployment — the other side of the corporate dream of profit without payrolls. In this article the outlines are sketched of an empirical science of literature as close as possible to the model of the natural sciences. This raises the question of what the standards of an empirical science in the strictest sense should generally be. Practical relevance of its results soon turns up as the fundamental condition for an explanatory empirical science, if the ideology of nearing an empirical truth is no longer accepted and a mere pragmatic justification rejected as its insufficient (...) substitute. As a consequence the logical priority of scientific explanation over scientific description is considered irrefutable. The so-called "sciences of understanding" - among them a "science of literature" - are confronted with a special difficulty, if they want to become explanatory empirical sciences. Their practical problems to be solved are related to linguistically or semiotically coded facts. To empirically describe these problematic facts causes this difficulty, which the author tries to overcome with recourse to ideas from Wittgenstein. And the practical relevance, which may be achieved with the help of nomological explanations, here doesn't consist in predictions for better practical production of means, direct or indirect, for survival, but in the provision of rational understanding for better practical teaching or criticism. This practical relevance is shown in the explanation of valuing acts of readers of The Golden Bowl by Henry James. The meaning of a literary text is no longer taken as a possible object of scientific empirical explanation, nor its rational justification as a scientific goal that might be practically relevant. This article argues in favor of modifying the medical model of severe psychiatric disturbances that underlies calling them "mental illness." The key reason for this proposal is that numerous specialists other than physicians as well as non-specialists contribute to the process of assisting a person recover from what the author suggests might better be called "extraordinary functional disability." There is little uniformity in existing definitions under state laws, but all involve three types of intervention: civil commitment; civil determination of legal (...) competency; and standing to be subject to criminal law. Physicians typically make relevant determinations in each of these areas; but non-physicians are the principal care-givers once a determination has been made. (shrink)

As a way of identifying factors that come into play in determining responsibility for displaced workers, author reviews a number of well known arguments for or against responsibility on the part of diverse actors in society. Key figures in this search for responsibility are corporations, unions, and government. No definitive responsibility is asserted.

Edmund Gettier is Professor Emeritus at the University of Massachusetts, Amherst. This short piece, published in 1963, seemed to many decisively to refute an otherwise attractive analysis of knowledge. It stimulated a renewed effort, still ongoing, to clarify exactly what knowledge comprises.

We consider two reasons why firms should be owned and run democratically by their workers. The first concerns accountability : Because the employment relationship involves the exercise of power, its governance should on democratic grounds be accountable to those most directly affected. The second concerns efficiency : The democratic firm uses a lower level of inputs per unit of output than the analogous capitalist firm.

Should the idea of economic man-the amoral and self-interested Homo economicus-determine how we expect people to respond to monetary rewards, punishments, and other incentives? Samuel Bowles answers with a resounding "no." Policies that follow from this paradigm, he shows, may "crowd out" ethical and generous motives and thus backfire. But incentives per se are not really the culprit. Bowles shows that crowding out occurs when the message conveyed by fines and rewards is that self-interest is expected, that the (...) employer thinks the workforce is lazy, or that the citizen cannot otherwise be trusted to contribute to the public good. Using historical and recent case studies as well as behavioral experiments, Bowles shows how well-designed incentives can crowd in the civic motives on which good governance depends. (shrink)

It is not only overtly probabilistic illatives like ‘makes it certain that’ but also apparently non-probabilistic ones like ‘therefore’ that have probabilistic import. Illatives like ‘therefore’ convey the meaning that the premise confers on the conclusion a probability not only greater than 0 but also greater than 1/2. But because they do not say whether that probability is equal to or less than 1, these illatives are appropriately called ‘neutral’.

Experiments are not models of cooperation; instead, they demonstrate the presence of the ethical and other-regarding predispositions that often motivate cooperation and the punishment of free-riders. Experimental behavior predicts subjects' cooperation in the field. Ethnographic studies in small-scale societies without formal coercive institutions demonstrate that disciplining defectors is both essential to cooperation and often costly to the punisher.

In this paper I examine five distinctions between deductive and inductive arguments, concluding that the best of the five defines a deductive argument as one in which conclusive favorable relevance to its conclusion is attributed to its premises, and an inductive argument as any argument that is not deductive. This distinction, unlike its rivals, is both exclusive and exhaustive; permits both good and bad arguments of each kind; and is both useful and needed in evaluating at least some arguments.

The authors make a convincing case that behavioral scientists have mistakenly focused on improving individual decision making and in so doing have deflected attention from necessary changes in the rules of the game – societal institutions and policies – that shape individual decisions. To address this problem a behavioral science of public policy requires rethinking fundamental economic concepts including preferences and incentives.

What nonsense might be, and what Wittgenstein thought that nonsense might be, are two of the central questions in the current debate between those—such as Cora Diamond, James Conant and Michael Kremer—who favour a “resolute” approach to Wittgenstein’s work, and those—such as P. M. S. Hacker and Hans-Johann Glock—who instead favour a more “traditional” approach. What answer we give to these questions will determine the nature and force of his criticisms of traditional philosophy, and so the very shape Wittgenstein’s work (...) has for us, as well as, to some extent, what the lesson of the Tractatus might be. My aim in this paper is to provide a detailed defence of the austere view of nonsense, that lies at the heart of the resolute approach, against a range of influentialcriticisms developed by Hans-Johann Glock and which focus on Wittgenstein’s contextualism. In so doing, I hope also to shed some light on the kind of view the austere view is, as well as how it might relate to certain other crucial aspects of Wittgenstein’s thought. (shrink)

Dabei stehen die Fragen, welche die Anwendung des Schemas `Auffassung - Auffassungsinhalt' auf das Zeitbewusstein und die Gefahr des unendlichen Regresses betreffen, noch immer im Vordergrund. Es ergeben sich aber auch entscheidende neue Einsichten. Diese betreffen vor allem das auf die Zukunft gerichtete `protentionale' Zeitbewusstsein in seiner Verflechtung mit der `Retention' der Vergangenheit sowie eine spezifisch noematische Bestimmung der (...) Zeitmodalitäten, die zu einer neuen Phänomenologie der Individuation führt. Auch dem Zusammenhang zwischen zeitlichem Urstrom und ichlicher Zeitigung widmet Husserl erstmals eingehende Untersuchungen. Insgesamt handelt es sich bei den vorliegenden Nachlasstexten um eine Phänomenologie des Zeitbewusstseins in einer neuen, `genetischen' Perspektive, die sich nicht nur am Paradigma der Wahrnehmung orientiert, sondern auch den Akten der Erinnerung und der Phantasie Aufmerksamkeit schenkt. The thesis of this paper is that an argument's possessing the form of affirming the consequent does not suffice to make its premises at all favorably relevant to its conclusion. In support of this thesis I assume two premises and argue for a third. My two assumptions are these: (1) that an argument's possessing the form of affirming the consequent does not suffice to make its conclusion certain relative to its premises (this is widely, if not universally, acknowledged by writers (...) on logic), and (2) premises are favorably relevant to a conclusion only if it is certain or probable relative to them (I argued for this in an earlier paper). The premise I argue for in this paper is that an argument's possessing the form of affirming the consequent does not suffice to make its conclusion probable relative to its premises. To establish this third premise, I first refute a defense of the contrary position (namely, that an argument's possessing the form of affirming the consequent suffices to make its conclusion probable relative to its premises), then offer counterexamples to that position, and finally demonstrate the failure of several attempts to save it. I first support Alec Fisher's thesis that premises and conclusions in arguments can be unasserted first by arguing in its favor that only it preserves our intuition that it is at least possible that two arguments share the same premises and the same conclusion although not everything that is asserted in the one is also asserted in the other and second by answering two objections that might be raised against it. I then draw from Professor Fisher's thesis the consequence that (...) in suppositional arguments the falsity (or unacceptability) of a supposition does not tell unfavorably in the evaluation of the argument, because the falsity (or unacceptability) of a (nonredundant) premise counts against an argument if and only if that premise is asserted. Finally, I observe that, despite the fact that they are neither expressed nor even alluded to, implicit assumptions in arguments are always asserted, unless the conclusion, but none of the explicit premisses, is unasserted. Hence, apart from an exceptional case of the kind just mentioned, the falsity (or unacceptability) of implicit assumptions always counts against an argument. (shrink)

This paper is a study of the mental environment of the Newtonian conception of attraction in the case of George Cheyne, M.D. , physician of the early 18th century and author of a number of popular medical works. It traces the growth of his notions of a spiritual attraction between God and his creatures and between the creatures themselves, and the relation of these ideas both to his use of the Newtonian model of short-range attraction, and to his conception of (...) the creatures as reflections of the divine essence. The paper contends that the development of these aspects of Cheyne's thought harmonizes with the changing pattern of his life, and that this harmony is expressed by his general technique of reasoning by analogy between the various spheres of experience.
