In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. Kalevi Kull’s target article importantly rejects the argument from biological aesthetics, that beauty is a product of natural selection. Instead, beauty is a reflection of the ongoing diversity of free semiotic choosing and fitting. From this view, biosemiotic aesthetics could become the semiotic branch par excellence, in its theorization of the origins of what has always been the central interest of general semiotics. The narrow argument about sexual selection is couched inside the broader ambition to establish a biological but nonreductive (...) definition and scope for aesthetics itself. One of the most important services biosemiotics can provide to the larger community is to bestow upon it some really unifying general principles applicable to all branches of semiotics, and the theory of biosemiotic aesthetics promises to do just this. General semiotics may later adopt some of Kull’s present theorization and apply it to the textual concerns which Kull prefers to consign to other specialists. (shrink)

Medical decision making on behalf of unrepresented patients is one of the most challenging ethical issues faced in clinical practice. The legal environment surrounding these patients is equally complex. This article describes the efforts of a small coalition of interested healthcare professionals to address the issue in Colorado. A brief history of the effort is presented, along with discussion of the legal, ethical, practical, and political dimensions that arose in Colorado’s effort to address decision making for unrepresented patients through an (...) extension of the existing Colorado Medical Treatment Decision Act (CRS 15-18). Foundations of Mind collects the essays which established Tyler Burge as a leading philosopher of mind.

In Burge [Disjunctivism and perceptual psychology. Philosophical Topics 33: 1–78, 2005], I criticized several versions of disjunctivism. McDowell defends his version against my criticisms in McDowell [Tyler Burge on disjunctivism. Philosophical Explorations 13: 243–55, 2010]. He claims that my general characterization fails to apply to his view. I show that this claim fails because it overlooks two elements in my characterization. I elaborate and extend my criticisms of his disjunctivism. I criticize his positions on infallibility and indefeasibility, and reinforce (...) my earlier charges that his views on perception and epistemology are hyper-intellectualized. The central point in my rejection of his disjunctivism concerns his claim that the science of perceptual psychology is irrelevant to his disjunctivist classification of perceptual states. I hold that this claim shows lack of familiarity with the science and serious misunderstanding of it. The basic deficiency in McDowell's disjunctivism is that it, like other versions, is incompatible with well-established scientific knowledge. (shrink)

Cognition Through Understanding presents a selection of Tyler Burge's essays that use epistemology to illumine powers of mind. The essays focus on epistemic warrants that differ from those warrants commonly discussed in epistemology--those for ordinary empirical beliefs and for logical and mathematical beliefs. The essays center on four types of cognition warranted through understanding--self-knowledge, interlocution, reasoning, and reflection. Burge argues that by reflecting on warrants for these types of cognition, one better understands cognitive powers that are distinctive of persons, (...) and of human beings. The collection presents three previously unpublished independent essays, in addition to substantial, retrospective commentary. Philosophers and psychologists have been attracted to two differing accounts of addictive motivation. In this paper, we investigate these two accounts and challenge their mutual claim that addictions compromise a person’s self-control. First, we identify some incompatibilities between this claim of reduced self-control and the available evidence from various disciplines. A critical assessment of the evidence weakens the empirical argument for reduced autonomy. Second, we identify sources of unwarranted normative bias in the popular theories of addiction that introduce systematic errors (...) in interpreting the evidence. By eliminating these errors, we are able to generate a minimal, but correct account, of addiction that presumes addicts to be autonomous in their addictive behavior, absent further evidence to the contrary. Recently there has been a resurgence of philosophical interest in love, resulting in a wide variety of accounts. Central to most accounts of love is the notion of caring about your beloved for his sake. Yet such a notion needs to be carefully articulated in the context of providing an account of love, for it is clear that the kind of caring involved in love must be carefully distinguished from impersonal modes of concern for particular others for their sakes, such (...) as moral concern or concern grounded in compassion. That is, we might say, the kind of caring that is central to love must be somehow distinctly intimate. The trouble is to cash out these firm intuitions in a satisfactory way. (shrink)

Landauer's principle, often regarded as the basic principle of the thermodynamics of information processing, holds that any logically irreversible manipulation of information, such as the erasure of a bit or the merging of two computation paths, must be accompanied by a corresponding entropy increase in non-information-bearing degrees of freedom of the information-processing apparatus or its environment. Conversely, it is generally accepted that any logically reversible transformation of information can in principle be accomplished by an appropriate physical mechanism operating in a (...) thermodynamically reversible fashion. These notions have sometimes been criticized either as being false, or as being trivial and obvious, and therefore unhelpful for purposes such as explaining why Maxwell's Demon cannot violate the second law of thermodynamics. Here I attempt to refute some of the arguments against Landauer's principle, while arguing that although in a sense it is indeed a straightforward consequence or restatement of the Second Law, it still has considerable pedagogic and explanatory power, especially in the context of other influential ideas in nineteenth and twentieth century physics. In this paper I aim to show why pediatric suffering must be understood as a judgment or evaluation, rather than a mental state. To accomplish this task, first I analyze the various ways that the label of suffering is used in pediatric practice. Out of this analysis emerge what I call the twin poles of pediatric suffering. At one pole sits the belief that infants and children with severe cognitive impairment cannot suffer because they are nonverbal or lack subjective life (...) experience. At the other pole exists the idea that once child suffering reaches some threshold it is ethical to eliminate the sufferer. Concerningly, at both poles, any particular child vanishes from view. Second, in an attempt to identify a theory of suffering inclusive of children, I examine two prominent so-called experiential accounts of suffering. I find them both wanting on account of their absurd entailments and their flawed assumptions regarding the subjective experiences of people who cannot communicate expressively. Finally, I extend arguments found in Alastair MacIntyre’s Dependent Rational Animals to argue that child suffering can be understood only as a set of absences—absences of conditions such as love, warmth, and freedom from pain. An evaluation of these absences reveals the exquisite dependency of children. It also discloses why pediatric suffering is necessarily a social and political event. Unlike adults, children will never be either the authors or the mitigators of their own suffering. Rather, children must rely wholly on others in order to resist suffering, grow, and flourish. This book analyzes contemporary visual art produced in the context of conflict and trauma from a range of countries, including Colombia, Northern Ireland, South Africa, and Australia. It focuses on what makes visual language unique, arguing that the "affective" quality of art contributes to a new understanding of the experience of trauma and loss. By extending the concept of empathy, it also demonstrates how we might, through art, make connections with people in different parts of the world whose experiences differ (...) from our own. This article is about the theoretical life of `the abject'. It focuses on the ways in which Anglo-American and Australian feminist theoretical accounts of maternal bodies and identities have utilized Julia Kristeva's theory of abjection. Whilst the abject has proved a compelling and productive concept for feminist theory, this article cautions against the repetition of the maternal (as) abject within theoretical writing. It argues that employing a Kristevan abject paradigm risks reproducing, rather than challenging, histories of violent disgust towards maternal (...) bodies. In place of the Kristevan model of the abject, it argues for a more thoroughly social and political account of abjection. This entails a critical shift from the current feminist theoretical preoccupation with the `transgressive potentiality' of `encounters with the abject' to a consideration of consequences of being abject within specific social and political locations. One central argument in favor of perceptual accounts of emotions concerns recalcitrant emotions: emotions that persist in the face of repudiating judgments. For, it is argued, to understand how the conflict between recalcitrant emotions and judgment falls short of incoherence in judgment, we need to understand recalcitrant emotions to be something like perceptual illusions of value, so that in normal, non-recalcitrant cases emotions are non-illusory perceptions of value. I argue that these arguments fail and that a closer examination of recalcitrant (...) emotions reveals important disanalogies with perception that undermine the perceptual model of emotions. This article presents a radical claim: American medical ethics is broken, and it needs love to be healed. Due to a unique set of cultural and economic pressures, American medical ethics has adopted a mechanistic mode of ethical reasoning epitomized by the doctrine of principlism. This mode of reasoning divorces clinicians from both their patients and themselves. This results in clinicians who can ace ethics questions on multiple‐choice tests but who fail either to recognize a patient's humanity or to navigate (...) the ethical quandaries into which they are frequently thrown. Drawing on personal experience as well as the philosophical work of Augustine of Hippo, Simone Weil, and Iris Murdoch, we propose a novel ethical approach grounded in a conception of neighbor love, specifically, the virtue of love understood as attention to a sufferer's humanity. We conclude with five practical recommendations for reimagining medical ethics education oriented around the virtue of love. (shrink)

This paper considers the ethics of routine antenatal HIV testing and the role of informed consent within such a policy in order to decide how we should proceed in this area—a decision that ultimately rests on the relative importance we give to public health goals on the one hand and respect for individual autonomy on the other.A recent illuminating qualitative study by Zulueta and Boulton1 explores the practicalities of informed consent in routine antenatal HIV testing. Its results support what I (...) have argued1 is inevitable with routine testing policies of this kind: that routine antenatal testing regimes are incompatible with requirements for informed consent. It has become clear that intervention could reduce the risk of transmitting HIV from mother to child from 15–20%2 to around 8%,3 or possibly as low as 2%.4,5 The evidence of this possibility produced a general trend towards introducing routine antenatal HIV screening in developed countries worldwide.6,7,8,9,10 The aim was to dramatically reduce the rate of HIV transmission from mother to child by encouraging universal antenatal HIV testing. The UK has been no exception, and in 1999 the government instructed health authorities to implement a policy of offering and recommending an HIV test to all pregnant women.11This UK antenatal screening policy and others like it, although well-meaning, are problematic in their formulation. In order to reflect contemporary ethical and legal practice, such policies attempt to marry the public health aims of maximising uptake of testing with a commitment to respect the choices of patients by requiring informed consent before they participate in screening. In the Spring of 1944, an informal discussion took place in Cambridge between Mr. R. S. Whipple, Professor Allan Ferguson and Mr. F. H. C. Butler, concerning the formation of a national Society for the History of Science. This is the opening sentence of the inaugural issue of the Bulletin of the British Society for the History of Science, the Society's first official publication. Butler himself was the author of this outline account of the subsequent approach to the Royal Society, (...) the parallel moves to establish a National Committee of the International Academy of the History of Science, the formation of a provisional committee to prepare a draft constitution for a national society, and the proceedings of the first Annual General Meeting in May 1947. Whipple had been in Cambridge to discuss his offer to present his collection of old scientific instruments to the University and the possible foundation of a new museum, and Butler, as Secretary of the History of Science Committee in Cambridge, was the chief mover in both this development and an initiative coupled with it to establish a department of the history of science. Kant seems to have been the first to notice that there is something peculiar about the difference between right and left, but he failed to say exactly what the peculiarity is. Philosophical accounts of freedom typically fail to capture an important kind of freedom—freedom to change what one cares about—that is central to our understanding of what it is to be a person. This paper articulates this kind of freedom more clearly, distinguishing it from freedom of action and freedom of the will, and gives an account of how it is possible. In 1997, a court in Cyprus jailed Pavlos Georgiou for fifteen months for knowingly infecting a British woman, Janet Pink, with HIV-1 through unprotected sexual intercourse. Pink met Georgiou in January 1994 whilst on holiday. She discovered that she had contracted the virus from him in October 1994 but continued the relationship until July 1996 when she developed AIDS. She returned to the UK for treatment and reported Georgiou to the Cypriot authorities.1There have been a number of legal cases involving (...) deliberate transmission of HIV, but most have involved forced exposure to infected bodily fluids for example, rape or biting, and have been dealt with using the existing legislation for rape or assault. While it is often difficult to prove responsibility for transmission in cases of forced exposure to HIV, it is even more contentious in cases like those of Janet Pink where an individual has consented to sex but claims that he/she was not forewarned of his/herpartner's HIV-positive status. At present there is no specific criminal offence of having unprotected sexual intercourse without disclosing one's HIV-positive status but a prosecution could possibly be brought under any one of a number of existing offences.2 Perhaps a change of policy needs to be considered. The Home Office has issued a consultation document which outlines a proposal that will allow the criminalisation of intentional transmission of diseases, like HIV, that are likely to cause serious harm. This revised legislation would cover all other potentially fatal diseases but seems primarily to be targeted at HIV transmission. Should transmission of HIV through consensual sex, without the HIV-positive status of the individual being disclosed, be an offence? This question, and that of whether there is a moral obligation to disclose a positive HIV status prior to having a sexual relationship is the subject of this paper. (shrink)

As knowledge increases about the human genome,prenatal genetic testing will become cheaper,safer and more comprehensive. It is likelythat there will be a great deal of support formaking prenatal testing for a wide range ofgenetic disorders a routine part of antenatalcare. Such routine testing is necessarilycoercive in nature and does not involve thesame standard of consent as is required inother health care settings. This paper askswhether this level of coercion is ethicallyjustifiable in this case, or whether pregnantwomen have a right to (...) remain in ignorance ofthe genetic make-up of the fetus they arecarrying. While information gained by genetictesting may be useful for pregnant women whenmaking decisions about their pregnancy, it doesnot prevent harm to future children. It isargued that as this kind of testing providesinformation in the interests of the pregnantwomen and not in the interests of any futurechild, the same standards of consent that arenormally required for genetic testing should berequired in this instance. The Covid‐19 pandemic has created a clinical environment in which health care practitioners are experiencing moral distress in numerous and novel ways. In this narrative reflection, a pediatric palliative care physician explores how his hospital's strict visitation policy set the stage for moral distress when, in the early months of the pandemic, it prevented two parents from being together at the bedside of their dying child.

Concepts We thank all three commentators for extremely constructive, insightful, and gracious commentaries. We cannot address all their valuable points. In this response, we elucidate and relate the concepts of addiction, disease, disability, autonomy, and well-being. We examine some of the implications of these relationships in the context of the helpful responses made by our commentators. This article explores how abortion bans in states with large Black populations will exacerbate existing racial inequities in those states’ child welfare systems.

While I am inclined to agree that in most cases a choice to become pregnant and bring to birth a child is an irrational choice, unlike Professor Häyry,1 I believe that choosing to do so is far from being necessarily immoral. In fact I will argue that it is often these irrational choices which make human life the valuable commodity many of us believe it is.Häyry argues that not only is the choice to have children always an irrational choice, but (...) also it is necessarily an immoral choice. Thus, for Häyry “human reproduction is fundamentally immoral”.1 He claims it is important to point out to prospective parents that their urge to have children is irrational. From this, he argues, it follows that once this is accepted the use of advance technologies to assist conception should be reassessed, and furthermore, the irrationality and immorality of having children should become a legitimate part of guidance given to those expressing a wish to have children.According to Häyry the reason it is irrational and immoral to choose to bring to birth a child is that “having a child can always realistically lead to the worse possible outcome, when the alternative is not having a child”.1 He argues that when people consider having children they are faced with the choice between deciding not to have children and thus harming or benefiting no-one , or having children where this life may be good or bad, and thus the value of this choice can be …. What are we to make of works of art whose apparent point is to convince us of the meaninglessness and absurdity of human existence? I examine, in this paper, the attempt of Albert Camus to provide philosophical justification of art in the face of the supposed fact of absurdity and note its failure as such with specific reference to Sartre’s criticism. Despite other superficial similarities, I contrast Camus’s concept of the absurd with that of his ‘existentialist’ colleagues, including Sartre, and (...) suggest that the latter concept is more philosophically viable. I conclude that existential phenomenology consequently provides a more promising philosophical justification for artistic creation in the light of the more viable conception of absurdity. (shrink)

This paper attempts to explain why Heidegger's thought has evoked both positive and negative reactions of such an extreme nature by focussing on his answer to the central methodological question “What is Philosophy?” After briefly setting forth Heidegger‟s answer in terms of attunement to Being, the centrality to it of his view of language and by focussing on his relationship with the word "philosophy‟ and with the history of philosophy, the author shows how it has led Heidegger to construct his (...) own work, itself linguistic, as a self-referential union of form and meaning. It is suggested that, from a Heideggerian perspective, this gives his work added argumentative force but, conversely, allows the critic no point of entry into his hermeneutical circle – hence the extreme reactions. This observation is then applied to address a related critical question; it is used to make sense of the apparent distinction, in Heidegger's work, between talking about attunement to Being and actually effecting such an attunement. The author argues that, for Heidegger, there is actually no distinction and that his apparent descriptions of attunement to Being at once describe and effect such an attunement. This union can therefore be conceived as one dimension of the intimacy, previously observed, between form and content and which is recognised to be a feature of Heidegger‟s work by both the acolyte and the critic.
