At the same time, a prominent group of philosophical (...) bioethicists authored an article, possibly with a touch of defensiveness, to “make the case that philosophy and philosophers still have a very important and meaningful role to play in contemporary bioethics” (Blumenthal-Barby et al. 2021). Meanwhile, the annual meeting of the American Society for Bioethics and Humanities included several expressions of impatience with the historical privileging of philosophy over more empirical, situated, and community-oriented approaches to moral problems in health.DeGrazia and Millum’s work itself reflects the current state of bioethics and how it has changed since the heyday of grand bioethical theory construction in the late twentieth century. To apply Parfit’s philosophical taxonomy (1984), the general frameworks promulgated by theorists like Veatch, Engelhardt, and Gert, as well as Beauchamp and Childress, were by necessity revisionary. These bioethical theories were whole-cloth alternatives to a conventional and paternalistic medical ethos that was already widely acknowledged as unsatisfactory. Today, however, bioethics is a mature and institutionalized field, with well-established practices and a corpus of accepted tenets (alongside matters of ongoing but generally demarcated controversy). A plausible and fruitful contemporary theory of bioethics must be largely descriptive, in Parfit’s sense, providing an intellectual framework that gives coherence and sense to existing practice, while at the same time clarifying matters of confusion.In contemporary bioethics, a central component of this practice is the application of the four principles of biomedical ethics—non-maleficence, beneficence, justice and autonomy—not merely as originally proposed by Beauchamp and Childress (2019), but in their refined form, following decades of exchange, critique, and revision. DeGrazia and Millum’s theory begins with two core values: well-being and respect for rights holders. [End Page 321] The bulk of the book then applies the method of reflective equilibrium to specify these two values in terms of the canonical four principles, here treated as “mid-level” constructs with readier application to specific cases than the two core values. Experienced bioethicists may have an uncanny sense of setting off from a new trailhead, and yet, eventually finding themselves still walking a familiar path. However, this way of introducing and explicating the four principles will likely be more accessible to a wider audience, including high-level undergraduates and graduate students not already versed in the revisions, refinements, and compromises embedded in Beauchamp and Childress’s discussions.Two other features recommend this book as a resource for trainees and interested non-experts seeking to deepen their understanding of bioethics. First, the clarity of its style and organizational approach provides a welcome orientation for non-specialists. The chapters are structured so that major contending perspectives are outlined before the authors develop arguments for their own positions in that context. Each chapter proceeds by considering applications of the broader theory, showing how it can illuminate potential candidate approaches or policies, as well as demonstrating how to use the tools of ethical analysis to evaluate these proposals in both ideal and non-ideal cases. This didactic approach to the relationship between conceptual argument and practice will be accessible to many who are initially unfamiliar with or intimidated by theory. Second the commendable decision to make the book electronically available and accessible also has the potential to broaden the reach of the work, and in particular, to engage parties in under-resourced settings, which have so often been overlooked in bioethical discourse.As noted above, while the authors’ approach is descriptive in Parfit’s sense, it is not necessarily conservative. In many places, the authors highlight how their theory includes elements or renders conclusions that are not broadly accepted, and following the method of reflective equilibrium, they advocate for these positions both in terms of broad principles and particular judgments about cases. At present, the science of consciousness is structured around the search for the neural correlates of consciousness. One of the alleged advantages of the NCCs framework is its metaphysical neutrality—the fact that it begs no contested questions with respect to debates about the fundamental nature of consciousness. Here, we argue that even if the NCC framework is metaphysically neutral, it is structurally committed, for it presupposes a certain model—what we call the Lite-Brite model—of consciousness. This, we argue, represents a serious (...) liability for the NCC framework for the plausibility of the Lite-Brite model is very much an open question, and the science of consciousness would be better served by a framework that does not presuppose it. Drawing on interventionist ideas in the philosophy of science, we suggest that the Difference-Maker framework can provide just such an alternative. Instead of searching for the neural correlates of consciousness, we ought to be searching for the difference makers of consciousness. We detail how a shift to searching DMCs will change both the practice of consciousness science and the interpretation of existing results. (shrink)

While there is no principle of evil (archē kakou) for Plato, evil does exist in the Platonic framework in various ways, and these help to illuminate other important and overlooked features of Platonic thought: human freedom and the ability to choose and act. Using the Timaeus as the basis of investigation, this paper examines the world-soul and its relation to the human soul in order to understand Plato’s notion of congruency between parts and the whole. It specifically highlights the importance (...) of the three fundamental characteristics of the cosmos—singularity, proportionalism, and completeness—and their ability to explain the human being. The paper argues that Plato understands evil as basic incongruence on all levels, but specifically active incongruence on the human level. The incongruence between the human and the cosmic levels of evil reveals perhaps the most important aspect of the Platonic framework, the possibility for progress toward the good. (shrink)

Being whipped, getting a deep-tissue massage, eating hot chili peppers, running marathons, and getting tattooed are all painful. Sometimes they are also pleasant—or so many people claim. Masochistic pleasure consists in finding such experiences pleasant in addition to, and because of, the pain. Masochistic pleasure presents a philosophical puzzle. Pains hurt, they feel bad, and are aversive. Pleasures do the opposite. Thus many assume that the idea of a pleasant pain is downright unintelligible. I disagree. I claim that cases of (...) pleasant pains are more common than many philosophers suppose, and that they have no essential connection to either sex or psychopathology. I review several attempts to account for masochism that preserve the intuition that nothing can be both pleasant and painful at once. These account for some, but not all, cases of masochism. The stubborn remainder, I argue, are sensations that are genuinely pleasant and painful at once. I give an account of how that might be, focusing on boundary-pushing aspects of masochistic pleasure that have been largely overlooked in the literature. I show how, properly understood, pain and pleasure can coexist—and also why it is very rare for them to actually do so. (shrink)

This essay introduces, for theological consideration, some recent work in the field of cultural evolutionary theory, specifically the kin‐influence hypothesis. This theory holds that, following the beginnings of industrialization and economic growth, a nation's fertility rate commences a decline, which is further abetted by the consequent and increasing imbalance in the relative influence of kin versus nonkin influences on individuals in favor of the latter. It is further proposed that this process is itself a major independent factor in the emergence (...) of many of the features of what is called modernity, among which is that of secularization. Extending further this work, I argue that, given the historic alignment of family and religious values in Christian nations, a loss of religious belief and practice is, at least in part, the spill over effect of the opposing influence of values emerging from ever more dominant nonfamily social interaction. This essay provides an interpretation of Nathaniel Hawthorne's short story 'My Kinsman, Major Molineux.' It argues that in this story Hawthorne is presenting a tale of social transformation from the pre-modern to the modern society in the form of the protagonist Robin's experiences on coming from the backwoods to the city. Here Robin sees things he has never seen before and is transformed in terms of his religious attitudes as well as in terms of his simple individual,rural independence. Robin ends (...) up joining the urban mob in its humiliation of the gentleman figure of Major Molineux. The new urban world of the 19th Century is sympathetic neither to rural simplicty nor to gentlemanly dignity. (shrink)

In this paper I explore how intellectual humility manifests in mathematical practices. To do this I employ accounts of this virtue as developed by virtue epistemologists in three case studies of mathematical activity. As a contribution to a Topical Collection on virtue theory of mathematical practices this paper explores in how far existing virtue-theoretic frameworks can be applied to a philosophical analysis of mathematical practices. I argue that the individual accounts of intellectual humility are successful at tracking some manifestations of (...) this virtue in mathematical practices and fail to track others. There are two upshots to this. First, the accounts of the intellectual virtues provided by virtue epistemologists are insightful for the development of a virtue theory of mathematical practices but require adjustments in some cases. Second, the case studies reveal dimensions of intellectual humility virtue epistemologists have thus far overlooked in their theoretical reflections. (shrink)

In this paper we1 assess the potential for research on nonhuman animals to address questions about the phenomenology of painful experiences. Nociception, the basic capacity for sensing noxious stimuli, is widespread in the animal kingdom. Even rel- atively primitive animals such as leeches and sea slugs possess nociceptors, neurons that are functionally specialized for sensing noxious stimuli (Walters 1996). Vertebrate spinal cords play a sophisticated role in processing and modulating nociceptive signals, providing direct control of some motor responses to noxious (...) stimuli, and a basic capacity for Pavlovian and instrumental conditioning (Grau et al. 1990; Grau 2002). Higher brain systems provide additional layers of association, top-down control, and cognition. In humans, at least, these higher brain systems also give rise to the conscious experiences that are characteristic of pain. What can be said about the experiences of other animals who possess nervous systems that are similar but not identical to humans? (shrink)

In recent years there has been a resurgence of interest in the work of Emmanuel Levinas, widely recognized as one of the most important yet difficult philosophers of the 20th century. In this much-needed introduction, Davis unpacks the concepts at the centre of Levinas's thought - alterity, the Other, the Face, infinity - concepts which have previously presented readers with major problems of interpretation. Davis traces the development of Levinas's thought over six decades, describing the context in which he worked, (...) and the impact of his writings. He argues that Levinas's work remains tied to the ontological tradition with which he wants to break, and demonstrates how his later writing tries to overcome this dependency by its increasingly disruptive, sometimes opaque, textual practice. He discusses Levinas's theological writings and his relationship to Judaism, as well as the reception of his work by contemporary thinkers, arguing that the influence of his work has led to a growing interest in ethical issues among poststructuralist and postmodernist thinkers in recent years. Here I interpret a central passage in Plato's Sophist by focusing on understudied elements that provide insight into the fit of the dialogue's parts and the Sophist-Statesman diptych as a whole. I argue that the Eleatic Stranger's account of what the dialectician "adequately views" at Sophist 253d1-e3 involves both division and the communion of ontological kinds, not just one or the other as has been typically argued. I also consider other key passages and the turn throughout the dialogue from imagistic (...) opining toward noetic understanding. (shrink)

Codes of ethics and conduct have become common in UK organisations. This paper explores how such codes are understood and responded to by those whom the codes seek to influence. The study is an interpretative one, based on interview material, in which a dialectical pattern is seen in employees’ reactions to codes. Initial contradictions are found in codes of ethics and in codes of conduct . These tensions create perceptions of a two‐tier system in organisations in which core employees are (...) subject to codes of ethics that are loosely applied, but non‐core staff are subject to codes of conduct that are strictly applied. However, even core staff are aware of a dialectical contradiction in their position. They believe that loyalty to the organisation is the price they pay for being allowed freedom of integrity by their organisations, but that the price they have to pay for showing integrity may be breaking faith with their organisations. This chiasmus of integrity and loyalty represents a difficulty for the project of improving standards of corporate citizenship. The use of this trope and other rhetorical figures to exemplify processes of understanding and interpretation in organisations is discussed. (shrink)

According to Stephen Law’s “X-claim argument,” the theist’s acquiring (what I call) an “x-claim defeater” automatically provides the theist with a reason to give up her x-claim belief. Contrary to Law, I argue that, even if the theist acquires such a defeater, it does not follow that the theist ought to give up her x-claim belief. This is because the degree of justification possessed by the theist’s belief may be sufficient to epistemically insulate itself against the x-claim defeater that was (...) initially brought against it. have recently provided a compelling demonstration of enhanced attentional control under post-hypnotic suggestion. Using the classic color-word interference paradigm, in which the task is to ignore a word and to name the color in which it is printed (e.g., RED in green, say ''green''), they gave a post-hypnotic instruction to participants that they would be unable to read. This eliminated Stroop interference in high suggestibility participants but did not alter interference in low suggestibility participants. replicated this pattern and further demonstrated (...) that it is not due to a visual strategy (such as blurring or looking at a different location). As a historical footnote, we describe a ''case study'' from 18 years ago in which we observed the same result using a hypnotic instruction to a single highly suggestible individual that he could not read. The elimination of Stroop interference has important implications for both the study of attention and the study of hypnosis. (shrink)

van der Velde's & de Kamps's model encodes complex word-to-word relations in sentences but does not encode the hierarchical constituent structure of sentences, a fundamental property of most accounts of sentence structure. We summarize what is at stake and suggest two ways of incorporating constituency into the model.

These educational inequalities include not only disparities in funding per pupil but also in class size, teacher qualification, and resources such as books, labs, libraries, computers, and curriculum, as well (...) as the physical condition of the school and the safety of students within it. While not all schools attended by poor children are bad schools, and not all schools attended by well-off children are good schools, there are clear patterns. Poor children are more likely to attend crowded and poorly equipped schools with less qualified teachers than the children of more affluent families. Climate change, rising energy costs, and other dilemmas raise the prospect for major change in energy-ecology-society relations. Two prominent proposals for change include: a nuclear power renaissance; and mega-scale renewable energy development. Both suggest that modern society will receive a rising stream of less CO2-rich kilowatt-hours, so that increased energy consumption and economic growth can continue. The article doubts these CO2 claims and finds both options lead to deepening unsustainability and environmental injustice. A third approach is proposed. A new institutional (...) and community strategy called a Sustainability Energy Utility. The SEU looks to reduce energy use and seeks to support remaining energy needs by community-scale renewables. To accomplish deep energy change, the authors show how an SEU can move society from an energy commodity to energy commons regime. Commonwealth economy and community trusts are key means to significant change: a future commons is offered as the more appropriate strategy. (shrink)

We are at the crux of a return of animals to the battlefield. Framed as an improvement over current limitations of biomimetic devices, couplings of microelectrical mechanical systems with insect bodies are currently being designed and created in laboratories, with funding from military agencies. Moving beyond the external attachment of computerized ‘backpacks’, MEMS are being implanted into larval stages to allow for living tissue to envelop otherwise fragile circuitry and electronics: the creation of bioelectronic interfaces. The weaponization of animals, with (...) insect cyborgs as a first step—a foundation for the remaking of more complex species—is an anthropocentric solution to an anthropocentric problem. Speciesism is the normative context in which technoscientific discourse and such approaches to nanoscience and nanotechnology are situated. This is a network of actors and relationships within and across science and society. Animals are framed as mechanical devices that can be dis/enhanced for human ends. This paper engages with the remaking of species, the blurring of boundaries between mechanism and organism, and the implications of the effective disappearance of the animal as key sociotechnological challenges. Consciousness lacks extension and other spatial properties. But how can this be, if it arises from matter in space? The paper argues that this conundrum can only be solved by recognizing that our current conception of space is fundamentally inadequate. However, no other conception is available to us.

Pains are subject to obvious, well-documented, and striking top-down influences. This is in stark contrast to visual perception, where the debate over cognitive penetrability tends to revolve around fairly subtle experimental effects. Several authors have recently taken up the question of whether top-down effects on pain count as cognitive penetrability, and what that might show us about traditional debates. I review some of the known mechanisms for top-down modulation of pain, and suggest that it reveals an issue with a relatively (...) neglected part of the cognitive penetrability literature. Much of the debate inherits Pylyshyn’s stark contrast between transducers and cognition proper. His distinction grew out of his running fight with Gibson, and is far too strong to be defensible. I suggest that we might therefore view top-down influences on pain as a species of transducer calibration. This provides a novel but principled way to distinguish between several varieties of top-down effect according to their architectural features. (shrink)

This book shows the surprising dynamism of the field of civil procedure through its examination of a cross section of recent developments within civil procedure from around the world. It explores the field through specific approaches to its study, within specific legal systems, and within discrete sub-fields of civil procedure. The book reflects the latest research and conveys the dynamism and innovations of modern civil procedure - by field, method and system. The book's introductory chapters lay the groundwork for researchers (...) to appreciate the flux and change within the field. The concluding chapters bring the many different identified innovations and developments together to show the field's ability to adapt to modern circumstances, while retaining its coherence even across different legal systems, traditions, fields and analytic approaches. Specifically, in this book the presence of dynamism is explored in the legal systems of the EU, France, the US, Brazil, Australia, the UK and China. So too that dynamism is explored in the contributions' analyses and discussions of the changes or need for change of specific aspects of civil procedure including litigation costs, class actions, derivative actions, pleadings, and res judicata. Furthermore, most of the individual contributions may be considered to be comparative analyses of their respective subjects and, when considered as a whole, the book presents the dynamism of civil procedure in comparative perspective. Those discrete and aggregated comparative analyses permit us to better understand the dynamism in civil procedure - for change in the abstract can be less visible and its significance and impact less evident. While similar conclusions may have been drawn through examinations in isolation, employing comparative analytic methods provided a richer analysis and any identified need for change is correspondingly advanced through comparative analysis. Furthermore, if that analysis leads to a conclusion that change is necessary then comparative law may provide pertinent examples for such change - as well as methodologies for successfully transplanting any such changes. In other words, as this book so well reflects, comparative law may itself usefully contribute to dynamism in civil procedure. This has long been a raison d'être of comparative law and, as clear from this book's contributions, in this particular time and field of study we find that it is very likely to achieve its lofty promise. According to Wittgenstein's mature philosophy, no 'language game' or 'form of life' is inherently philosophically problematic. However real, practical moral problems undermine the objectivity of morality, which as moral beings we cannot abandon. This problem is both philosophical and 'real'. Morality therefore undermines the later Wittgenstein's whole account of philosophy, i.e. its nature, how such problems are resolved, and its relation with the rest of our lives. Perhaps that is why he virtually never mentions Ethics in his writings after 1932-3.

In the period since 1944 English primary education has been subject to recurring criticism. Official enquiries, surveys of attainment, individual causes-célèbres and the pronouncements of pundits have drawn attention to purported 'crises'.
