L’article examine la notion d’autorité à partir de deux mouvements apparemment contradictoires : l’évolution du concept d’autorité parentale allant vers un apparent affaiblissement de cette notion et une certaine immanence de l’autorité dans le cadre judiciaire de l’assistance éducative. Les conditions de la manifestation de cette autorité sont explorées à travers les notions de cadre, de rituels et d’offre de pensée.

Davidson’s Surprise argument promises to resolve a dispute that has arisen in contemporary formal semantics over the proper semantic value for a semantic theory. At issue are doubts that Pietroski raises about the compositionality of truth-conditions, and thereby about truthconditional semantics, which treats a truth value as the semantic value for a sentence. The dispute is recalcitrant because, as I show, Pietroski’s evidence that truth-conditions are not compositional can be explained away with attention to Cappelen and Lepore’s distinction between (...) the truth of what is semantically expressed by an utterance and the truth of its speech act content. While the Surprise argument would, if it worked, support truth-conditional semantics, I demonstrate that it fails; in fact, it is peculiarly vulnerable to Pietroski’s concerns. (shrink)

On 24 July 2022, the landmark decision Roe v. Wade (1973), that secured a right to abortion for decades, was overruled by the US Supreme Court. The Court decision in Dobbs v. Jackson Women’s Health Organisation severely restricts access to legal abortion care in the USA, since it will give the states the power to ban abortion. It has been claimed that overruling Roe will have disproportionate impacts on women of color and that restricting access to abortion contributes to or (...) amounts to structural racism. In this paper, we consider whether restricting abortion access as a consequence of overruling Roe could be understood as discrimination against women of color (and women in general). We argue that banning abortion is indirectly discriminatory against women of color and directly (but neither indirectly, nor structurally) discriminatory against women in general. (shrink)

In french and english speaking countries, the articulation between epistemological beliefs, conceptions of teaching and learning and pedagogical practices of secondary school teachers in the natural sciences and humanities has been little studied (Araújo-Oliveira, 2012 ; Bartos et Lederman, 2014 ; Wanlin et al., 2019). Yet, while teachers display predominantly constructivist beliefs about teaching and learning, their teaching practices remain rather passive (OECD, 2019). Like in Therriault et al. (2018-2023), this article explores the characteristics of epistemological beliefs, conceptions of teaching (...) and learning, and teaching practices among a population of 112 secondary school teachers (beginners, intermediate and experienced) in the humanities and natural sciences in French-speaking Belgium. In a second step, we explore the articulations between these three theoretical constructs either from statistical analyses or from a more interpretative perspective. Quantitative analysis of the data (PCA, factorial ANOVA, correlations and Chi-square) show that teachers’ epistemological beliefs are rather refined, that there is an effect of professional seniority on these beliefs and that there is a link between refined epistemological beliefs and traditional conceptions of teaching and learning. Finally, teachers’ self-reported practices appear to be insensitive to the discipline being taught. (shrink)

Measuring responsiveness to gain accurate diagnosis in populations with disorders of consciousness (DOC) is of central concern because these patients have such complex clinical presentations. Due to the uncertainty of accuracy for both behavioral and neurophysiological measures in DOC, combined assessment approaches are recommended. A number of standardized behavioral measures can be used with adults with DOC with minor to moderate reservations relating to the measures’ psychometric properties and clinical applicability. However, no measures have been standardized for use with pediatric (...) DOC populations. When adapting adult measures for children, confounding factors include developmental considerations for language-based items included in all DOC measures. Given the lack of pediatric DOC measures, there is a pressing need for measures that are sensitive to the complex clinical presentations typical of DOC and that can accommodate the developmental levels of pediatric populations. The music therapy assessment tool for awareness in disorders of consciousness (MATADOC) is a music-based measure that has been standardized for adults with DOC. Given its emphasis on non-language based sensory stimuli, it is well-suited to pediatric populations spanning developmental stages. In a pre-pilot exploratory study, we examined the clinical utility of this measure and explored trends for test-retest and inter-rater agreement as well as its performance against external reference standards. In several cases, MATADOC items in the visual and auditory domains produced outcomes suggestive of higher level functioning when compared to outcomes provided by other DOC measures. Preliminary findings suggest that the MATADOC provides a useful protocol and measure for behavioral assessment and clinical treatment planning with pediatric DOC. Further research with a larger sample is warranted to test a version of the MATADOC that is refined to meet developmental needs of pediatric DOC populations. (shrink)

In June 2016, Texas A&M University hosted its inaugural philosophy camp for teens. In this article, we address how running a philosophy camp for pre-college students can have a positive impact on both the campers and the staff, which included philosophy faculty, graduate students (Philosophy and English), and undergraduates. We designed the week-long (Monday through Friday, 9 a.m.–4 p.m.) philosophy camp with three aims: to introduce pre-college students to philosophical thinking and dialogue; to develop an intellectual community among the campers; (...) and to provide a space in which young people could engage as equal partners in a series of spirited philosophical discussions. Drawing chiefly from our local community, we enrolled a diverse group of campers. We organized the week around themes that we thought would be of particular interest to pre-college students while also providing a broad view of the discipline. What we did not anticipate was the intense friendships that were formed, based on a shared love of philosophical ideas. (shrink)

Management theory is a diverse field where multiple theoretical perspectives coexist and coevolve, leading to conceptual pluralism. While conceptual pluralism is useful for grasping different aspects of the complex reality we live in, it may limit the further development of knowledge on elemental concepts. In this article, we focus on knowledge on the natural environment (NE) in management theory. We argue that management scholars and practitioners often rely on theoretical lenses that tend to reify the NE, thereby limiting the conceptualization (...) of some of the essential properties of the NE. Drawing on the example of the conceptual development of the ecosystem services (ES) at the intersection of economics and biology, we identify the advantages and the limits of interdisciplinary theory-building and testing. Finally, we discuss how tools from the philosophy of science can be useful for proposing a way forward for integrating reliable knowledge on the natural environment in management theory. (shrink)

Que peuvent nous apprendre des féministes matérialistes sur ces métamorphoses?

This thesis explores attempts to characterise the structure of reality. Three notions stand out: Lewisian naturalness, Sider’s ‘structure’, and grounding, where the latter has become the most popular way to characterise the structure of reality in the contemporary literature. I argue that none of these notions, as they are currently understood, are suited for limning the metaphysical structure of reality. In the first part of the thesis I argue that, by the lights of the relevant theories, both naturalness and structure (...) fall short of the theoretical role carved out for those posits. In the second part of the thesis I present two challenges to the ‘orthodox’ conception of grounding. The first contests the standard assumption that grounding is asymmetric, both by citing what I take to be best described as symmetric instances of grounding, and by developing and arguing for a new theory of metaphysical structure – ‘metaphysical interdependence’ – which takes grounding to be nonsymmetric. The second challenge concerns the relationship between grounding and explanation, and leads to a dilemma for the grounding theorist. My proposed resolution to the dilemma is to adopt an antirealist approach to grounding, which I further motivate and develop in the final chapter. (shrink)

It argues that while Butler remains trapped by the matter/representation binary, the Spinozist turn in Lloyd and Gatens, and Grosz's work on Bergson and Deleuze, are attempts to think corporeality.

The central theme of the volume is cultural diversity, a vast subject that is highly relevant today. The particular focus here is on the many ways in which this diversity is managed within the framework of State law. The twelve contributors to this book have a special interest in how cultural traditions and their various forms of expression are handled by the law. They were all participants in the 2009 Research Programme of the Centre for Studies and Research of the (...) Hague Academy of International Law. The breadth of the subject is reflected in the wide spectrum of perspectives from which the topic has been explored. Starting in each case from the existing State and international legal frameworks, the contributors explore how the interactions between positive law and other normative orders can be placed at the service of a legal system that is as fair as possible within a plural context. This book provides an up-to-date introduction to the study of generics and pursues the enterprise of the influential Generic Book edited by Gregory Carlson and Jeffry Pelletier, which was published in 1995. Genericity is a key notion in the study of human cognition as it reveals our capacity to organize our perceived reality into classes and to describe regularities. The generic can be expressed at the level of a word or phrase (ie the potato in The Irish economy became dependent (...) upon the potato) or an entire sentence (eg in John smokes a cigar after dinner, the generic aspect is a property of the expression, rather than any single word or phrase within it). This book gathers new work from senior and young researchers to reconsider the notion of genericity, examining the distinct contributions made by the determiner phrase (eg the notions of kind/individual) and the verbal predicate (eg the notions of permanency, disposition, ability, habituality, and plurality). Finally, in connection with the whole sentence, the analytic/synthetic distinction is discussed as well as the notion of normality. A filosofia com crianças, em todas as suas guisas, visa engendrar o pensamento filosófico e o raciocínio nas crianças. Muito é escrito sobre o que a participação na filosofia poderia fazer para a criança academicamente e emocionalmente. O que propomos aqui é que permitindo às crianças participar de diálogos filosóficos elas aprenderão uma abordagem que poderia dar suporte a sua participação na sociedade e que poderia envolvê-las na consideração e no arejamento de suas vistas, tomando decisões em suas interações e (...) relacionamentos com os outros. É inevitável que, vivendo com os outros, se encontrem os valores dos outros. É essencial, portanto, que as crianças aprendam como lidar com os valores dos outros mas também que elas aprendam como desenvolver os seus próprios pelo questionamento e a reflexão. Melhor que ensinar às crianças sobre os valores ou ensinar-lhes os valores que elas deveriam ter, este artigo sugere que às crianças deveriam ser proporcionadas oportunidades de explorar uma variedade de perspectivas e que elas precisam aprender a fazer isto. Além disso, no entanto, a fim de viver harmoniosamente com os outros, existem considerações sobre ética a serem encontradas. As crianças precisam aprender como lidar com política, arte, ciência, literatura e a maior variedade de problemas que a vida em sociedade inclui. De fato, as crianças precisam aprender o que é requerido para ser um cidadão. Aqui o aprendizado da criança é contextualizado no Currículo de Excelência da Escócia, no qual se espera das crianças que elas sejam capazes de “fazer escolhas e tomar decisões informadas” e de “desenvolver pontos de vista informados e éticos de problemas complexos” (Scottish Executive, 2004, p.12) como parte de sua educação para a cidadania. Se ser um cidadão envolve esses elementos, então existe um desafio para os professores no que concerne a como as crianças vão alcançar os resultados desejados. O objetivo de tal currículo é que a criança ‘aprenda para a vida’ adquirindo as competências para a vida de forma que a sociedade se beneficie. É colocado, neste artigo, que participando dos diálogos filosóficos uma pessoa é suscetível de favorecer uma apreciação dos outros e de suas perspectivas, de compreender que os valores e opiniões de alguém evoluem, que essa visão filosófica pode, de fato, funcionar para a melhora da sociedade. The term 'therapeutic misconception' (TM) was introduced in 1982 to conceptualize how some psychiatry trial participants perceived and interpreted their involvement in research. TM has since been identified in many settings and is a major component in research ethics discussions. A qualitative study included a subgroup of interviews with five parents (two couples, one mother) who declined to enrol their baby in a neonatal trial. Analysis suggested the possibility of a counterpart to TM which, given the original terminology, we term (...) the 'injurious misconception' (IM). While TM is closely linked to the elision of care and research, and involves an over-stated sense of benefit and protection, IM may be a product of a particularly keen and discomforting sense of distinctions between care and research and a correspondingly over-stated sense of risk and threat. Two years ago, a nest box outside my window held a pair of Violet-Green Swallow. I counted six swallows fledge from the box and take their first flights in the July rain. Leaving the roof of the nest box, they flew in little loops out over the water, trying out their wings. I watched them from the dock, their bodies suspended in the air between the raindrops. This experience was the inspiration for what I call ‘nest-works’ – for poetic wilding (...) of all-too-human spaces. Nest-works began with an experimental panel for the 2021 College Art Association Conference, called ‘Co-Making this World’. The experimental session was modelled after the nest of a bird, a Black-Capped Chickadee. As this cavity-nester builds a home of disparate materials, the panel of artist-researchers built a session of disparate theories and practices, as we considered relationships with world-systems that are in the process of making (such as the nest of the chickadee). For Technoetic Arts, we weave a new nest-work of research material, as we consider new models for knowledge and creative production. This nest-work is an entanglement of short essays made by artists working with a common pattern, framing eco-poetics on collaborative and participatory processes with the non-human/more-than-human. Utilizing the methodology of theological ethnography, this essay centers the (...) personal experiences of Palestinian Christians and considers the implication their understanding of Mary has for Fratelli Tutti and Christian ethics. Tous les textes rassemblés ici, comme autant de variations, sans jamais le dire, souhaitent contribuer à la reconnaissance de l'oeuvre. Irigaray demonstrates that metaphysics depends upon the specific negation and exclusion of the female body. Readings of Irigaray's Speculum of the Other Woman tend to highlight the status of this excluded materiality: is there an essential female body which precedes negation or is the feminine only an effect of exclusion? I approach Irigaray's work by way of another question: is it possible to move beyond a feminist critique of metaphysics and towards a feminist philosophy?

Despite the fact that time, evolution, becoming and genealogy are central concepts in Deleuze's work, there has been no sustained study of his philosophy in relation to the question of history. We argue that dominant white cultural views and public health co-produce race as a technology that charts the path of viral transmission away from the white bodies to form a trajectory for an otherwise aimless disease. This epistemological project is one enmeshed in popular culture, medical practice, and biopolitics. COVID-19 and the related Black Lives Matter (BLM) movement work together to make visible the narrative technologies. This project contributes to understanding race and public health as co-constituted in ways that shape (...) imaginative possibilities, material and agential realties, and health outcomes in light of COVID-19. Our argument is novel in naming race a technology of American public health and taking up Coeckelbergh and Reijers’ call for a normative theory of narrative technology. We extend Coeckelbergh and Reijers’ narrative technologies to include race, a narrative artifact, co-produced by biology, public health, and individual actors. (shrink)

Materialism is at once the most general of concepts, capable of gesturing to anything that seems either foundational or physicalist, and yet is also one of the most rhetorical of gestures: operating as a way of reducing, criticising or ‘‘exorcising’’ forms of idealism and ideology. Derrida's early, supposedly ‘‘textualist’’ works appear to endorse a materiality of the letter (including syntax, grammar, trace and writing) while the later works focus on matter as split between that which is posited and that which (...) will always appear as a receding ground. It is more important than ever that materialism not be accepted too readily as a way of overcoming a supposedly linguistic or textualist Derrida in order that Derrida might be smuggled into the contemporary heaven of naturalism and physicalism. On the contrary, it is the dispersed, inhuman and inorganic materiality beyond bodies, physis and substance that offers itself for genuinely deconstructive thinking. (shrink)

For the past two decades, the issue of the body and essentialism has dominated feminist theory. In general, it is assumed that the body has been devalued and repressed by the Western metaphysical tradition. In this article, I make two claims to the contrary. First, as poststructuralist theory has tirelessly demonstrated, Western thought has continually tried to ground thought in some foundational substance, such as the body. Second, the most provocative, fruitful and radical aspects of recent feminism and poststructuralism concern (...) the event of incorporeality. What makes incorporeality such an urgent issue is its tie with anti-foundationalism. If there is not a direct or proper passage between what is and what is thought, then thinking can be considered as a force or event in its own right. By disrupting the traditional philosophical series that ties thought to some grounding body, thinkers as diverse as Deleuze, Derrida, Irigaray and Foucault have opened the possibility of a theory of the incorporeal. RÉSUMÉ: Prenant comme point de départ un article récent de Neil Campbell, j'examine la question de savoir si la survenance psychophysique peut assurer la dépendance psychophysique. Mes thèses principales sont que contrairement à ce que croit Campbell, il n'est pas clair que Kim ait montré de manière convaincante que les formulations de la survenance psychophysique en termes de propriétés soient inadéquates pour expliquer la dépendance psychophysique; la pertinence des difficultés soulevées par Kim tient surtout à la conception que l'on se (...) fait, d'abord de la notion de dépendance qui est en jeu, puis d'autres notions également, comme celle d'explication; pour quelqu'un qui est convaincu par les problèmes de Kim, il n'est pas clair—contrairement à ce que suggère Campbell—que le passage d'une survenance au niveau des propriétés à une survenance au niveau des prédicats, comme celle de Davidson, puisse être d'une quelconque utilité; donc ce qui importe à notre problème n'est pas de savoir si nous avons affaire à une survenance au niveau des propriétés ou à une survenance au niveau des prédicats, mais c'est plutôt la façon dont on conçoit la notion de dépendance dans ce contexte, et d'autres notions telles que celle d'explication. The implicit activities of the living body in sports (such as heart rate, involuntary gestures, stress, reflex, emotional regulation and interaction expressions) emerge in the consciousness of the lived body without our voluntary control. We demonstrate physiological emersion, and how, including in dramaturgical perception, physiological flows and processes collide with the image of a whole body. In this paper, we introduce corporeal non-property as the missing (?) link between phenomenology and neuroscience, renewed by research on the cerebral unconscious and the (...) perception of their lived body. Rather than mindfulness, physical activity obliges the subject to learn the unconscious and his motor skills from his living body: a new psychoanalysis of sport is thus established by studying what emerges from the activity of the living body up to the level of the conscious description of motor action. In this paper, we explain why that awareness occurs, and why it matters for the understanding of unconscious activity of the athlete’s living body. This is potentially interesting, although it needs, as a theory, to overcome the obvious reliance of the body on unconscious or habitual/automated physiological processes. But the incorporation of body techniques forms a habitus. (shrink)

Abstract There is general agreement that the targeting of civilians in war is morally wrong. But sometimes starvation tactics are accepted as being a better option than direct military attacks. This article questions this view by arguing that starvation tactics affect civilians first and inflict long-term suffering. It argues that they are not just unless they can be limited to a small area where only military personnel will be affected. It looks at the provision for starvation tactics in the Geneva (...) Conventions, and at the argument of double effect. It then illustrates the argument with three case studies: the siege of Leningrad; the application of sanctions prior to and during the Gulf War in 1990?1991; and restrictions of food during the war in Bosnia.
