In recent years India has been moving further in the direction of adopting an Anglo-American model of corporate governance. This decision, the result more of international economic and political pressures than public debate, in effect represents a new development strategy for the world's most populous democracy. In light of this situation, it is important to ask two basic questions: 1) why has the Anglo-American model of corporate governance been adopted? and; 2) can it be justified? This paper addresses the first (...) of these questions by distinguish and examining three historical models of governance in India: 1) the managing agency model in the colonial period; 2) the business house model that emerged after independence, and; 3) the Anglo-American model which has recently been adopted (and is still emerging). The second question is approached through an examination of the "development impact" of the new model, as indicated by such measures as growth, employment and respect for shareholder rights. In this paper, we present a survey of the development of the technique of argument diagramming covering not only the fields in which it originated - informal logic, argumentation theory, evidence law and legal reasoning – but also more recent work in applying and developing it in computer science and artificial intelligence. Beginning with a simple example of an everyday argument, we present an analysis of it visualised as an argument diagram constructed using a software tool. In the context of (...) a brief history of the development of diagramming, it is then shown how argument diagrams have been used to analyze and work with argumentation in law, philosophy and artificial intelligence. This paper looks at a dispute decision theory about how best to characterize expected utility maximization and express the logic of rational choice. Where A1, … , An are actions open to some particular agent, and S1, … , Sn are mutually exclusive states of the world such that the agent knows at least one of which obtains, does the logic of rational choice require an agent to consider the conditional probability of choice Ai given that some state Si obtains, (...) Prob(Ai/Si). Or, is the logic of choice better represented by considering the probability of the counterfactual if Ai then Si, Prob(Ai ⟥-> Si). Causal decision theory, developed by Allan Gibbard, William Harper, and David Lewis defend the counterfactual analysis; whereas, Richard Jeffrey and others defend the conditional probability analysis, evidential decision theory. I argue that the problems posed by cases of decision instability favor evidential decision theory. (shrink)

People are unable to report how they decide whether to move backwards or forwards to catch a ball. When asked to imagine how their angle of elevation of gaze would change when they caught a ball, most people are unable to describe what happens although their interception strategy is based on controlling changes in this angle. Just after catching a ball, many people are unable to recognise a description of how their angle of gaze changed during the catch. Some people (...) confidently choose incorrect descriptions that would guarantee failure of interception demonstrating unconscious knowledge co-existing with systematically different conscious beliefs. Where simple solutions to important evolutionary problems exist, unconscious perception needs to be impervious to conscious beliefs. (shrink)

Martin Heidegger’s existential account of care in _Being and Time_ (2010) provides us with an opportunity to reimagine what the proper theoretical grounding of an ethic of care might be. Heidegger’s account of care serves to deconstruct the two primary foundations that an ethic of care is often based upon. Namely, that we are inevitably interdependent upon one another and/or possess an innate disposition to care for fellow humans in need. Heidegger’s account reveals that both positions are founded upon an (...) ontic (meaning factual existence), as opposed to an ontological (which refers to the nature of being), understanding of care. The distinctions between an ontic and ontological understanding of care are significant. Yet, I maintain that they are not completely incompatible. Both Heidegger and care ethicists contend that our existence with others is understood through a relational ontology. Furthermore, there are certain ontological structures from Heidegger which resonate with an ethic of care. Two key existential structures are leaping-ahead and being-guilty. These existential structures are latent in care ethics, and by explicitly revealing them I reinforce the connection between Heidegger’s account and care theory. Lastly, I develop the theoretical foundations of care ethics by proposing an existential ethic of care. (shrink)

A familiar post-Kantian criticism contends that Kant enslaves sensibility under the yoke of practical reason. Friedrich Schiller advanced a version of this criticism to which Kant publicly responded. Recent commentators have emphasized the role that Kant’s reply assigns to the pleasure that accompanies successful moral action. In contrast, I argue that Kant’s reply relies primarily on the sublime feeling that arises when we merely contemplate the moral law. In fact, the pleasures emphasized by other recent commentators depend on this sublime (...) feeling. These facts illuminate Kant’s views regarding the relationship between morality, freedom, and the development of moral feelings. (shrink)

It is known that the spaces of orders on orderable computable fields can represent all Π10 classes up to Turing degree. We show that the spaces of orders on orderable computable abelian and nilpotent groups cannot represent Π10 classes in even a weak manner. Next, we consider presentations of ordered abelian groups, and we show that there is a computable ordered abelian group for which no computable presentation admits a computable set of representatives for its Archimedean classes.

This article asks how military ethics should respond to adversaries deliberately conducting hostilities below the threshold of war. Three options are considered: a novel, limited force paradigm; an expanded hostilities paradigm, i.e., within the law of armed conflict; and an international law enforcement paradigm derived primarily from human rights law. None is problem-free. Mindful of under-deployed classic just war reasoning arguments for discrimination between vices opposed to peace, this article argues against an expanded hostilities paradigm and shows that the retributive, (...) ‘equilibrium of justice’ test used sometimes to support such an expansion is necessary but not sufficient. It explains the need for further examination of whether/how Aquinas and his interpreters can/should conceive of actions under the paradigm of war occurring against non-state actors. (shrink)

This paper proposes a view uniformly extending expected utility calculations to both individual and group choice contexts. Three related cases illustrate the problems inherent in applying expected utility to group choices. However, these problems do not essentially depend upon the tact that more than one agent is involved. I devise a modified strategy allowing the application of expected utility calculations to these otherwise problematic cases. One case, however, apparently leads to contradiction. But recognizing the falsity of proposition (1) below allows (...) the resolution of the contradiction, and also allows my modified strategy to resolve otherwise paradoxical cases of group choice such as the Prisoners' Dilemma: -/- (1) lf an agent x knows options A and B are both available, and x knows that were he to do A he would be better off (in every respect) than were he to do B, then doing A is more rational for x than doing B. The fundamental question in reverse mathematics is to determine which set existence axioms are required to prove particular theorems of mathematics. In addition to being interesting in their own right, answers to this question have consequences in both effective mathematics and the foundations of mathematics. Before discussing these consequences, we need to be more specific about the motivating question.Reverse mathematics is useful for studying theorems of either countable or essentially countable mathematics. Essentially countable mathematics is a vague term that is (...) best explained by an example. Complete separable metric spaces are essentially countable because, although the spaces may be uncountable, they can be understood in terms of a countable basis. Simpson gives the following list of areas which can be analyzed by reverse mathematics: number theory, geometry, calculus, differential equations, real and complex analysis, combinatorics, countable algebra, separable Banach spaces, computability theory, and the topology of complete separable metric spaces. Reverse mathematics is less suited to theorems of abstract functional analysis, abstract set theory, universal algebra, or general topology.Section 2 introduces the major subsystems of second order arithmetic used in reverse mathematics: RCA0, WKL0, ACA0, ATR0 and – CA0. Sections 3 through 7 consider various theorems of ordered group theory from the perspective of reverse mathematics. Among the results considered are theorems on ordered quotient groups, groups and semigroup conditions which imply orderability, the orderability of free groups, Hölder's Theorem, Mal'tsev's classification of the order types of countable ordered groups. In §76 of the 3rd Critique, Kant claims that an intuitive understanding would represent no distinction between possible and actual things. Prior interpretations of §76 take Kant to claim that an intuitive understanding would produce things merely in virtue of thinking about them and, thus, could not think of merely possible things. In contrast, I argue that §76’s modal claims hinge on Kant’s suggestion that God represents things in their thoroughgoing determination, including in their connection to God’s actual will. Hegel famously criticizes Kant’s resolution of the antinomies. According to Sedgwick, Hegel primarily chastises Kant’s resolution for presupposing that concepts are ‘one-sided’, rather than identical to their opposites. If Kant had accepted the dialectical nature of concepts, then (according to Sedgwick) Kant would not have needed to resolve the antinomies. However, as Ameriks has noted, any such interpretation faces a serious challenge. Namely, Kant’s first antinomy concerns the universe’s physical dimensions. Even if we grant that the concept of the finite (...) is necessarily related to that of the infinite, the physical universe cannot both have and lack a temporal beginning. I argue that Hegel neither adopts Sedgwick’s view that Kant’s antinomies require no resolution nor absurdly accepts that the physical universe both has and lacks a temporal beginning. Instead, Hegel proposes a sophisticated resolution of Kant’s first antinomy (including its physical aspect) that depends on Hegel’s theory of the Absolute. (shrink)

Kant claims that an intuitive understanding—such as God would possess—could cognize things in themselves. This claim has prompted many interpreters of Kant's theoretical philosophy to propose that things in themselves correspond to how an intuitive understanding would cognize things. In contrast, I argue that Kant's theoretical philosophy does not endorse the common proposal that all things in themselves correspond to how an intuitive understanding would cognize things. Instead, Kant's theoretical philosophy maintains that things in themselves might or might not correspond (...) to how an intuitive understanding would cognize things. I then consider whether Kant's moral philosophy and theory of reflecting judgment might provide alternative grounds for claiming that we should regard things in themselves as corresponding to how an intuitive understanding would cognize things. I argue that Kant's moral philosophy does not provide such grounds, but his theory of reflecting judgment does. Thus, interpretations of Kant's transcendental idealism should attend to the differences between Kant's theoretical philosophy, moral philosophy, and theory of reflecting judgment in assessing the relationship between intuitive understanding and things in themselves. Most prions (infectious proteins) are self‐propagating amyloids (filamentous protein multimers), and have been found in both mammals and fungal species. The prions [URE3] and [PSI+] of yeast are disease agents of Saccharomyces cerevisiae while [Het‐s] of Podospora anserina may serve a normal cellular function. The parallel in‐register beta‐sheet structure shown by prion amyloids makes possible a templating action at the end of filaments which explains the faithful transmission of variant differences in these molecules. Writers, philosophers, and theologians have oft made the comparison between being a mature human being and a masterpiece work of art or design. Employing the analogy between the creation of artistic value and the creation of full-fledged human value, this paper stakes out a middle ground between pro-choice and pro-life by considering a more general account of value and the relationship between being a potential X and a mature implementation of X's potential. I argue that the value of a potential (...) X is a function of a number of factors, most importantly, what I call the "accessibility relation" between a potential X and a full-fledged instantiation of this potential. The value is as much intrinsic to the “seed” as to some future implementation of the seed’s potential. This approach inclines even a secular humanist to reasonably confer a significant degree of moral value to a human conceptus, and even more to an early term fetus. (shrink)

Einstein insisted that the only acceptable interpretation of the quantum theory was an ensemble interpretation, that this way of understanding the quantum formalism eliminated all the problems associated with interpreting the theory as a complete description of individual systems. But he never developed his ensemble interpretation in any detail or explained how it was supposed to resolve the difficulties with the individual interpretation. We offer a reconstruction of Einstein's position that is consonant with his other beliefs and examine the “prism” (...) reconstruction recently proposed by Arthur Fine. We show the plausibility of our reading, as an interpretation of Einstein, and criticize Fine's proposal, as an alternative interpretation and as an attempt to understand quantum theory. As we reconstruct it, Einstein's position is, nevertheless, problematic. We therefore conclude with a plausible, if unoriginal, suggestion as to the reason he failed to develop his remarks on ensembles more fully. (shrink)

This is an unpublished talk written for a meeting of French philosophers. The paper describes the evolution versus creationism/intelligent design controversy in the U.S. A number of philosophers and scientists try to resolve this issue by sharply distinguishing the realm of science versus any talk of the supernatural. These pro-evolutionists often appeal to science's essential commitment to "methodological naturalism," the view that scientific methodology is essentially committed to naturalism and cannot meaningfully entertain hypotheses concerning the supernatural. I criticize methodological naturalism, (...) suggesting that such an appeal is misguided and counterproductive. I suggest an alternative view of the supernatural consistent with scientific knowledge. How should we conceptualize direct action against climate change? Although direct action is an increasingly significant tactic by the global climate movement, we lack understanding how direct action contributes to the systemic change necessary for addressing the crisis. Drawing upon critical theories of climate change as a crisis in the social reproduction of the metabolic relations between humans and nature in capitalism, I conceptualize direct action as attempts to intervene directly in the organization of the social metabolism, towards reorganizing these (...) relations in a more socially just and ecologically sustainable manner. My framework thus expands and clarifies the scope and potential of direct action as a means of confronting the capitalist climate crisis, as evidenced by Greta Thunberg’s school strike for climate.
