Certified nursing assistants (CNAs) provide up to 80% of the direct care to older adults in long‐term care facilities.CNAs are perceived as being at the bottom of the hierarchy among healthcare professionals often negatively affecting their job satisfaction. However, manyCNAs persevere in providing quality care and even reporting high levels of job satisfaction. The aim of the present investigation was to identify primary themes that may helpCNAs make meaning of their chosen career; thus potentially partially explaining increases in job satisfaction (...) among this group. Focus groups were conducted withCNAs at three long‐term care facilities. Four themes emerged from the data:CNAwork is good or special;CNAas relationship builder;CNAas expert;CNAas team member. These themes reflect the perceptions that theseCNAs held in regard to themselves and their relationships to others in the work environment and, when present, can contribute to intrinsic job satisfaction. Our meaning‐making themes support the premise thatCNAs do not passively accept the evaluations of others but instead actively frame identities that validate their importance to residents and the institution. Northern researchers and service providers espousing modernist theories of development in order to understand and aid countries and peoples of the South ignore their own non-universal starting points of knowledge and their own vested interests. Universal ethics are rejected in favor of situated ethics, while a modified empowerment development model for aiding women in the South based on poststructuralism requires building a bridge identity politics to promote participatory democracy and challenge Northern power knowledges.

The aim of this essay is to rethink classic issues of freedom and moral responsibility in the context of feminist and antiracist theories of male and white domination. If personal identities are socially constructed by gender, race and ethnicity, class and sexual orientation, how are social change and moral responsibility possible? An aspects theory of selfhood and three reinterpretations of identity politics show how individuals are morally responsible and nonessentialist ways to resist social oppression.

In frameworks in which _topic-__theoretic_ considerations—_e.g._, tracking _subject-matter_ or _topic_—are given equal importance with _veridical_ considerations, assigning topics to formulae in a satisfactory way is of critical importance. While intuitions are more-or-less solid for _extensional_ formulae in a propositional language, arriving at a compelling account of the subject-matter of _intensional_ formulae, _i.e._, formulae including intensional operators, is more challenging. This paper continues previous work on modeling topics of intensional formulae in William Parry’s logic of analytic implication, adapting the general techniques (...) to the framework of _topic-sensitive intentional modals_ (TSIMs) championed by Francesco Berto and his collaborators. As illustrations, we introduce variations on Berto and Peter Hawke’s logic of knowability relative to information ( \(\pmb {\textsf{KRI}}\) ), including a refinement sensitive to topic-theoretic distinctions between knowledge and belief and a refinement capable of internalizing its own properties. Finally, subsystems of Aybüke Ozgun and Berto’s logic of plain hyperintensional belief ( \(\pmb {\textsf{PHB}}\) ) are introduced in which fine-grained distinctions in subject-matter are possible. David Hume has warned us not to endeavor to derive an “ought” from an “is” (1990, 469–70), reprimanding those who attempt to draw value judgments from empirical facts. But Judith Jarvis Thomson refuses to accept that values and facts are logically disjoint in this manner, primarily because of her worry that such a partition of our moral values from the “facts” will place a grave limitation on any ethical system, namely, that its claims apparently cannot be proven. Consequently, Thomson is (...) on the lookout for some provably true facts that can be used, contra Hume, to draw conclusions about moral values. Thomson begins by rejecting all generalist conceptions of the good (specifically, the utilitarian's identification of the good with pleasure) and proceeds to fracture the good into various kinds of “goodness in a way,” hoping to produce by this disintegration some moral facts that can be used to set ethics on an objective foundation. But I will argue that Thomson's so‐called objective facts are actually nothing but disguised moral claims, and that in attempting to sidestep the classic fallacy identified by Hume, she has blundered into another pitfall—the Smuggler's Fallacy, the offense of concealing her moral conclusions inside the premises of her argument. Much has been written about the ethics of eating meat. Far less has been said about the ethics of serving meat. In this paper I argue that we often shouldn’t serve meat, even if it is morally permissible for individuals to purchase and eat meat. Historically, the ethical conversation surrounding meat has been limited to individual diets, meat producers, and government actors. I argue that if we stop the conversation there, then the urgent moral problems associated with industrial animal agriculture (...) will go unsolved. Instead, we must also consider the important but overlooked role that midsized institutions play in addressing major collective problems. I focus mostly on the harms that industrial animal agriculture inflicts on humans, animals, and the environment, but the discussion bears on other global issues like climate change. Institutional choices are an underexplored avenue for driving social change—their power and influence outstrip individual actions, and they can shape behavior in modest ways that promote social goods. Here I highlight the paradigmatic case of catered events and suggest three ways that institutional actors can reduce meat consumption and shape cultural attitudes surrounding meat: large impact decisions, subtly shaping incentives, and consolidating burdens. Background: According to the Declaration of Helsinki, patients who take part in a clinical trial must be adequately informed about the trial's aims, methods, expected benefits, and potential risks. The declaration does not, however, elaborate on what “adequately informed” might amount to, in practice. Medical researchers and Local Research Ethics Committees attempt to ensure that the information which potential participants are given is pitched at an appropriate level, but few studies have considered whether the patients who take part in such (...) trials feel they have been given adequate information, or whether they feel able to understand that information.Objectives: To explore trial participants' views on the amount of information provided, and of their own understanding of that information.Design: Structured interviews of patients participating in clinical trials for the treatment of chronic medical condition.Findings: Patients generally felt they were given an appropriate amount of information, and that they were able to understand all or most of it. They felt they were given adequate time to ask questions before agreeing to take part. In comparison with treatment given outwith the research setting, patients generally felt they received more information when participating in a clinical trial.Conclusions: Researchers sometimes complain that patients are given too much information during clinical trials, and have limited understanding of that information. The present study shows that this perception is not necessarily shared by patients. More research is needed in this area, particularly to gauge whether patient understanding is indeed accurate. It is not easy to understand the history and origin of the different peoples of today's world inasmuch as scientific data are partial and seemingly contradictory. These roughly fall into three categories:-prehistoric data are remains of cultures and human skeletons. They allow us to affirm that such and such a region was inhabited in such and such an epoch. Their absence, however, means nothing, and they hardly permit the attribution of a biological origin to the peoples of the past because (...) of the rapid evolution of the forms and dimensions of the skeletons during the course of time;-present genetic data give an interesting picture of the biological relationship of peoples and of the way they diverged throughout history. Their interpretation is delicate, however, especially when it concerns small populations;-“biometric” data involve the measurement of pigmentation, dimensions and proportions of the body and organs. They are susceptible to very rapid variations during the course of history and mainly give an indication of the adaptation of the people to a certain kind of environment: tropical, temperate, cold or arctic, plain or altitude, forest, savannah, prairie, steppe or desert. This paper uses Paul Ricœur’s analyses of ideology to argue for the mitigation of the possibility of political evil within the political paradox. In explicating the paradox, Ricœur seeks to hold in tension two basic aspects of politics: its benefits and its propensity to evil. This tension, however, should not be viewed as representative of a dualism. The evil of politics notwithstanding, Ricœur encourages us to view the political order as a deeply important part of our shared existence. By thinking (...) past the distorting function of ideology to the legitimating and integrating functions that Ricœur calls more basic than distortion, a mode of thought that is often at the heart of political evil, ideology can be used to mitigate that very evil. Ever since the Proslogion was first circulated , critics have been bemused by St Anselm's brazen attempt to establish a matter of fact, namely, God's existence, from the simple analysis of a term or concept. Yet every critic who has proposed to ‘write the obituary’ of the Ontological Argument has found it to be remarkably resilient . At the risk of adding to a record of failures, I want to venture a new method for attacking this durable argument. Neither the (...) common version of Anselm's argument from Chapter II of the Proslogion nor the previously unrecognized modal version uncovered by Norman Malcolm from Pros , III can possibly get under way without Anselm's celebrated assertion that God is that than which no greater can be conceived. There is a tendency today to substitute the affirmation of the absolute value of peace for an earlier, fully-formulated ideal of universal peace. This formula, if I am not mistaken, bears the mark of a new exigency: how to maintain the philosophical task, that is, give a basis to the idea of peace that does not arise solely from circumstantial considerations—however imperious they may be, since they come from the knowledge of the danger that a new world war would bring (...) to entire populations—without again falling under Utopian illusions that have fed the projects of perpetual peace. However, some of the difficulties with which the present consideration will deal give a glimpse of the definition of peace as an absolute value. Today there is a great deal of discussion about human rights. We speak of them in reference to totalitarian regimes but also in reference to Western democracies, which is a sign, it seems, of a reconsideration of the legitimacy of the power of the State and the conception of law on which this legitimacy rests. However, we had thought this question had been settled for a long time, at least in democratic countries: a legitimate government is one elected by the (...) people, whose sovereign will it expresses through elected representatives, retained or replaced periodically, who make the laws. In other words, the people are sovereign, and the exercise of this sovereignty is governed by a constitution, according to laws that permit the legitimacy of the State (Rechtsstaat) to be expressed concretely. The doubts that arise concerning human rights in many areas of the world would thus be signs of either a rupture between the sovereign people and the executive or legislative power, to which the people delegate the care of their interests and will, or of a resignation of the popular will, reduced to the condition of a sort of do-nothing king, doubting his own legitimacy and handing his power over to his clerks. In both cases, there is a crisis of confidence and perhaps more: a fundamental skepticism toward the very notion of legitimacy as it is usually presented, that is, as the expression of the will of the people: a capricious will, sometimes docile and sometimes rebellious, of an amorphous sovereign (rex otiosus) that it is difficult to identify in the features of its representatives, (congress, parliament or national assembly) or in the form of a ballot. In any case, the citizen, holder of a small particle of popular sovereignty, feels alienated from the State and its institutions, contrary to what we find in texts before the 18th century, when institutions were surrounded by an apparent, if not always sincere, respect and when the social hierarchy was accepted as a matter of fact. One of the most intriguing and painful anomalies of the modern world—so diffused that it has almost become a universal culture— is the incredible number of individuals and groups who kill, torture, burn, kidnap, imprison or merely outrage other people with a clear conscience when a political motive may be alleged. Added to them is the much larger number of people and institutions that tolerate, approve, encourage, praise and even bless that type of behavior when it occurs within a political (...) context. Included in this generic political violence is „the kind of behavior that is much more serious and that we may call terrorist, the behavior of those who seek to impose their will through the commission of atrocities that sow a generalized terror or a panic fear, and then to manipulate the reactions these atrocities provoke. Here “private” terrorists, as well as “semi-state” and “state” terrorists commit acts that would not be tolerated in normal, non-political life, and the public that approves this conduct would never accept it if it occurred in everyday life. Since the end of the 19th century, Brazilian researchers have speculated about the phenomenon of ethnic coexistence they have witnessed in their country. How may the mixed culture that is its obvious result be explained? Should it be attributed to some sociocultural syncretism, to an interpenetration of civilizations or, quite simply, to a synthesis? Whatever the case, it is certain that cultural elements of very different origins became united in Brazil and that they have remained closely associated there in spite (...) of their disparity. The best example of this “cultural conglomerate,” if we may call it that, is without a doubt that of the Afro-Brazilian religious cults and, although numerous studies have already been devoted to them, they have a richness of content and meaning, plus a capacity for renewal, that is far from being exhaustively investigated. Virtually all political theory and ethical systems presuppose the primacy of human beings.human beings have rights, privileges, legal standing, and—it is said—claims to our sympathy. Many political debates, therefore, center on questions of where these lines are to be drawn. But many humans do not behave this way. People, for example, may expend far more love, time, money, and energy on their pets’ well-being than on abstract humans. If the choice is between an operation to save their dog’s life, or (...) saving a human life through the United Nations, for example, most will choose the former, even if put in such stark terms. This essay argues that people’s love for their dogs transcends the human/animal barrier, that this love overturns assumptions about the role of abstraction in our lives, and that such attunement can be understood only via new formulations of the roles of ethics and philosophy. In this article we revisit a number of disputes regarding significance logics---i.e., inferential frameworks capable of handling meaningless, although grammatical, sentences---that took place in a series of articles most of which appeared in the Australasian Journal of Philosophy between 1966 and 1978. These debates concern (i) the way in which logical consequence ought to be approached in the context of a significance logic, and (ii) the way in which the logical vocabulary has to be modified (either by restricting some notions, (...) or by adding some vocabulary) to keep as much of Classical Logic as possible. Our aim is to show that the divisions arising from these disputes can be dissolved in the context of a novel and intuitive proposal that we put forward. (shrink)

Although logical settings are typically concerned with tracking alethic considerations, frameworks exist in which topic-theoretic considerations—e.g., tracking subject-matter or topic—are given equal importance. Intuitions about extending topic through a propositional language are generally straightforward for extensional cases. For a number of reasons, arriving at a compelling account of the subject-matter of intensional operators—such as intensional conditionals—is a more difficult task. In particular, the framework of topic-sensitive intentional modals (TSIMs) championed by Francesco Berto and his collaborators leave the topics of intensional (...) formulae undefined, which artificially constricts the expressivity of the theory. This paper proposes an approach to fill in this lacuna, emphasizing an analogous problem in Parry-style containment logics. In this setting, the approach receives a proof-of-concept through the introduction of a natural and general family of subsystems of Parry’s $${\textsf{PAI}}$$ PAI —with sound and complete axiomatizations—that allow a fine degree of control over the topics of intensional conditionals. Among all the possible choices of “objects” for collection, that of works of art is the richest in meaning. In this paper we propose to discover if this ages-old activity may be understood as a historical phenomenon or only interpreted as one of the expressions man may give of his relationship with the universe of artistic works.

Political theory has long depended upon a clear boundary between life and non-life. Even work which emphasizes non-human beings (e.g., in animal rights, posthumanism or “new materialism”) continues to reinforce the divide between the organic and the inorganic. This article undermines that division, highlighting marginal cases of life. The organicity of certain rocks and biochar, the growth of crystals, the machinic qualities of viruses: all point to an instability in the excluded middle between life and non-life. The article suggests alternative (...) philosophical traditions to which political theory could turn—namely, panpsychism, hylozoism, and traditional animism—as conceptual and theoretical resources to examine these interstices. The subject to consider briefly here is certainly complex and difficult but especially abundant in epistemological misunderstanding and hermeneutic complications. To try to avoid all those pitfalls it is necessary to set up some rudimentary limits and recall some truisms of sociological analysis.

Like many intensional logics, William Parry’s logic of analytic implication PAI admits extensions determined by imposing semantic conditions on its account of modality. PAI is unique, however, in its allowing a second dimension—a topic-theoretic dimension—along which extensions can be defined. The recent introduction by Francesco Berto of topic-sensitive intentional modals (TSIMs)—which disagree with PAI on this type of condition—provide further motivations to examine such topic-theoretic extensions. In this paper, we introduce, motivate, and characterize a number of such extensions of PAI, (...) paying special attention to applications to Berto’s framework and to ways in which the modal and topic-theoretic dimensions influence one another. The theory of beauty has always rested on the representation of the infinite, understood in its finite expression and perceptible through the senses. The relationship of beauty to truth, of art to science, is inevitably modified with the new way of treating the infinite in the modern conception of the world. Non-classical science works with the notions of “infinitely large” and “infinitely small,” modifying their meanings in terms of experimental observations. We put these words in quotation marks because the Whole (...) may be considered as finite or infinite according to the angle from which it is viewed: the “infinitely small” only becomes so in determined circumstances, for example, when we consider the extended and discrete elements of space and time in a macroscopic approximation, as infinitely small elements of perpetual motion. Modern science studies these two poles of being—the Whole and its parts—in their interaction, admitting the dependence of macroscopic and even cosmic processes with regard to the processes being created in infinitely small spheres (or, according to another interpretation, finite but extremely small). However, as characteristic of our time as these concepts are—most often hypothetical—they nonetheless express a very old historical tradition that contemporary retrospection, turned toward classical science and the past of science in general, allows us to discern very clearly. All the culture of the past was dominated by the principle of the authority of the Whole over its parts. In peripatetic cosmology and physics, individual processes depended on the cosmic harmony of the center and frontiers of the universe, on the spheres and places toward which bodies tend. This authority of the general law, of universal harmony, of the system hinging on individual processes, is confirmed in Aristotle's Physics, but not only there: we find it in almost all the thinkers of antiquity. On the plane of general logic, it received expression in the Hegelian concept of the true infinite, a concept constituting to a high degree the philosophical equivalent of classical science. In Hegel's time, this last was already drawing away somewhat from the idea of an absolute and strict subordination of elementary processes to integrating systems and general laws, laws being realized through the probability of microprocesses, thus statistical laws, and whose exact application ignored individual acts, for example, the mechanism of molecules in thermodynamics. The statistical theory of heat has rendered continual a discrete microcosm—for the movement of individual molecules it substituted the average speed of the molecules—and continual laws became supreme points determining macroscopic processes. These laws had a differential nature. In other words, they prescribed the defined relationships between the infinitely small increases in size. Also, the schema of the classic law consisted in defining infinitely small processes by an infinitely large integral legality because of the number of processes. The infinitely true of Hegel is the actual infinite being realized in each of its finite elements; it is the subjection of the finite element to the infinite. (shrink)

Social movements are using education to generate critical consciousness regarding the social and environmental unsustainability of the current food system, and advocate for agroecological production. In this article, we explore results from a cross-case analysis of six social movements that are using education as a strategy to advance food sovereignty. We conducted participatory research with diverse rural and urban social movements in the United States, Brazil, Cuba, Bolivia, and Mexico, which are each educating for food sovereignty. We synthesize insights from (...) critical food systems education and the political ecology of education in analyzing these cases. We compare the thematic similarities and difference between these movements’ education initiatives in terms of their emergence, initial goals, expansion and institutionalization, relationship to the state, theoretical inspirations, pedagogical approach, educational topics, approach to student research, and outcomes. Among these thematic areas, we find that student-centered research on competing forms of production is an integral way to advance critical consciousness about the food system and the political potential of agroecological alternatives. However, what counts, as success in these programs, is highly case-dependent. For engaged scholars committed to advancing education for food sovereignty, it is essential to reflect upon the lessons learned and challenges faced by these movements. (shrink)

The word “legitimacy” and its derivations (legitimate, legitimation, etc.) are widely employed in scientific language as they also are in current usage. In fact, we find them in several areas, from that of reasoning (“this conclusion is legitimate”) to that of law (“judgment of legitimacy”, “legitimate family”) and politics (“legitimate sovereign”). It is particularly in this latter domain, however, that they have their normal use as qualifications for power, and it is this particular aspect that I shall consider in this (...) paper. In accredited political language “legitimacy” designates a principle, or criterion, of justification for power (acting and commanding) and, correlatively, of the obedience that is its due. (shrink)

Anarchism is a fertile site for nurturing the sorts of encounters that feminists have called intersectionality. Anarchism and intersectionality share the goal of critically examining familiar as well as emergent flows of power and meaning, and understanding their relations to one another. This paper focuses on three compelling directions for anarchist studies: Indigenous anarchism, anarchism developing with new materialism, and anarchism emergent in radical book arts. Each thread has established roots while also moving in new directions. Anarchist encounters with Indigeneity, (...) new materialism, and book arts resonate with each other: they can foster “a commitment to the particular” through which we can immerse ourselves in rich and dense worlds where specific Indigenous theories and practices, detailed encounters with non-human things, and particular artistic + intellectual productions of materials can emerge. Since 1973 the experts of O.C.D.E. have been presenting the development of systems born of computer science and telecommunication as a “ second industrial revolution.” A year earlier the Japan Computer Usage Development Institute announced for the year 2000 the advent of a “society of information.”.

This book aids in the rehabilitation of the wrongfully deprecated work of William Parry, and is the only full-length investigation into Parry-type propositional logics. A central tenet of the monograph is that the sheer diversity of the contexts in which the mereological analogy emerges – its effervescence with respect to fields ranging from metaphysics to computer programming – provides compelling evidence that the study of logics of analytic implication can be instrumental in identifying connections between topics that would otherwise remain (...) hidden. More concretely, the book identifies and discusses a host of cases in which analytic implication can play an important role in revealing distinct problems to be facets of a larger, cross-disciplinary problem. It introduces an element of constancy and cohesion that has previously been absent in a regrettably fractured field, shoring up those who are sympathetic to the worth of mereological analogy. Moreover, it generates new interest in the field by illustrating a wide range of interesting features present in such logics – and highlighting these features to appeal to researchers in many fields. This paper critically investigates the implementation of the UN guiding principles on business and human rights (UNGPs) into the corporate setting through the concept of ‘translation’. In the decade since the creation of the UNGPs, little academic research has focussed specifically on the corporate implementation of human rights. Drawing on qualitative case studies of two multinational corporations—an oil and gas company and a bank—this paper unpacks how human rights are translated into the corporate context. In doing so, the paper focuses (...) on the “resonance dilemma” translators encounter, the strategies used to make human rights understandable and palatable, and the difficulties that emerge from this process. We contend that the process of making human rights understandable and manageable can change their form and content, which may act as an obstacle to human rights realisation and corporate accountability for human rights. A wide family of many-valued logics—for instance, those based on the weak Kleene algebra—includes a non-classical truth-value that is ‘contaminating’ in the sense that whenever the value is assigned to a formula φ⁠, any complex formula in which φ appears is assigned that value as well. In such systems, the contaminating value enjoys a wide range of interpretations, suggesting scenarios in which more than one of these interpretations are called for. This calls for an evaluation of systems with multiple contaminating (...) values. In this paper, we consider the countably infinite family of multiple-conclusion consequence relations in which classical logic is enriched with one or more contaminating values whose behavior is determined by a linear ordering between them. We consider some motivations and applications for such systems and provide general characterizations for all consequence relations in this family. Finally, we provide sequent calculi for a pair of four-valued logics including two linearly ordered contaminating values before defining two-sided sequent calculi corresponding to each of the infinite family of many-valued logics studied in this paper. The break necessary to establish a rigorous science of cultural works is something more and something else than a simple methodological reversal.1 It implies a true conversion of the ordinary way of thinking and living the intellectual enterprise. It is a matter of breaking the narcissistic relationship inscribed in the representation of intellectual work as a “creation” and which excludes as the expression par excellence of “reductionist sociology” the effort to subject the artist and the work of art to a (...) way of thinking that is doubly objectionable since it is both genetic and generic.It would be easy to show what the most different kinds of analysis of the work of art owe to the norms that require treating works in and for themselves, with no reference to the social conditions of their production. Thus in the now-classic Theory of Literature, René Wellek and Austin Warren seem to advocate “an explanation in terms of the personality and the life of the writer.” In fact, because they accept the ideology of the “man of genius” they are committed, in their own terms, to “one of the oldest and best-established methods of literary study”—which seeks the explanatory principle of a work in the author taken in isolation .2 In fact, this explanatory principle resides in the relationship between the “space” of works in which each particular work is taken and the “space” of authors in which each cultural enterprise is constituted. Similarly, when Sartre takes on the project of specifying the meditations through which society determined Flaubert, the individual, he attributes to those factors that can be perceived from that point of view—that is, to social class as refracted through a family structure—what are instead the effects of generic factors influencing every writer in an artistic field that is itself in a subordinate position in the field of power and also the effects specific to all writers who occupy the same position as Flaubert within the artistic field. 1. This paper discusses three relevant logics that obey Component Homogeneity - a principle that Goddard and Routley introduce in their project of a logic of significance. The paper establishes two main results. First, it establishes a general characterization result for two families of logic that obey Component Homogeneity - that is, we provide a set of necessary and sufficient conditions for their consequence relations. From this, we derive characterization results for S*fde, dS*fde, crossS*fde. Second, the paper establishes complete sequent calculi (...) for S*fde, dS*fde, crossS*fde. Among the other accomplishments of the paper, we generalize the semantics from Bochvar, Hallden, Deutsch and Daniels, we provide a general recipe to define containment logics, we explore the single-premise/single-conclusion fragment of S*fde, dS*fde, crossS*fdeand the connections between crossS*fde and the logic Eq of equality by Epstein. Also, we present S*fde as a relevant logic of meaninglessness that follows the main philosophical tenets of Goddard and Routley, and we briefly examine three further systems that are closely related to our main logics. Finally, we discuss Routley's criticism to containment logic in light of our results, and overview some open issues. (shrink)

“Frontier” is included in the general category of “limit” (limes: a road bordering a field). But what is at the origin of limit, frontier? An authority, a power that can exercise “the social function of ritual and social significance of the line, the limit whose ritual legitimizes passage, transgression” (Bourdieu, 1982, p. 121). The limit, a traced line, sets up an order that is not only spatial but temporal, since it not only separates a “this side” from a “that side” (...) but also a “before” and an “after”. This dual nature of the limit is at work in the myth of the founding of Rome. Any limit, any frontier, is intentional: it proceeds from a will; it is never arbitrary. Its legitimacy was originally established by a religious ritual and later, by a political procedure. (shrink)

For several decades, molecular genetics have given rise to a new order of phenomena, profoundly disturbing the classic ideas that men have of their identity and their place in the universe. What becomes of the classic figure of man when hybridizations permit the systematic crossing of the frontiers between species? What do the possibilities opened by cloning and especially the grafting of foreign genes in mammals mean to us? What happens to the classic structures of relationship when the introduction of (...) foreign genes into the cells of embryos allows us to obtain individuals that are heirs of the genetic patrimony of eight or twelve different parents? The list of all these strange phenomena would be long, and the disquieting nature of the results thus obtained gives spectacular effects that, for the scientific mind, are not satisfactory. It is thus in a different perspective that we must reflect on the rapid irruption of this new order of phenomenality brought about through the genetic approach. (shrink)

The social sciences are again talking about time. They venture to do so, because the crisis of meaning in which modem society is involved shows the narrow limits of the solutions to this problem of being that phenomenology has reinvented. Since meaning only exists in duration of time, the crisis becomes a crisis of time and a crisis of the representation of man in time.

This paper argues that two single-factor accounts of exploitation are inadequate and instead defends a two-factor account. Purely distributive accounts of exploitation, which equate exploitation with unfair transaction, make exploitation pervasive and cannot deliver the intuition that exploiters are blameworthy. Recent, non-distributive alternatives, which make unfairness unnecessary for exploitation, largely avoid these problems, but their arguments for the non-necessity of unfairness are unconvincing. This paper defends a two factor account according to which A exploits B iff A gains unfairly from (...) B and either A believes that the gains he receives in the transaction wrong B, or A is culpably unaware that the gains he receives in the transaction wrong B. This account avoids the problems of non-distributive approaches and also delivers the intuition that exploiters are blameworthy. (shrink)

National Action Plans on business and human rights are a growing phenomenon. Since 2011, 42 such plans have been adopted or are in-development worldwide. By comparison, only 39 general human rights action plans were published between 1993 and 2021. In parallel, NAPs have attracted growing scholarly interest. While some studies highlight their potential to advance national compliance with international norms, others criticise NAPs as cosmetic devices that states use to deflect attention from persisting abuses and needed regulation. In response to (...) wider critiques of international human rights norms, and their failure to exact universal state compliance, experimentalist governance theory highlights the dynamic, dialogic and iterative character of human rights implementation as well as the role of stakeholders. In this article, we apply experimentalist governance theory to evaluate the role and character of business and human rights NAPs. Rather than attempting to evaluate NAPs’ ultimate consequences for rights-holders, which appears premature, we focus on NAPs processes. Specifically, we analyse NAPs processes in twenty-five states against five experimentalist governance criteria relating to stakeholder participation; agreement on a broad problem definition; local contextualisation; monitoring and peer review and periodic revision and learning. According to our findings, NAPs on business and human rights in most states demonstrate resemblance to the traits of experimentalist governance. In particular, our analysis points to the emergence of relatively sophisticated and demanding institutional governance mechanisms within NAPs — including the institutionalisation of complex deliberative processes. Nevertheless, our paper also identifies some significant shortcomings in NAPs, related to the lack of inclusion of vulnerable groups and the lack of explicit indicators and targets. (shrink)
