Recientemente fue desechada una reforma en la Ley General de Salud cuyo fin era el de hacer obligatorio en todo el país el tamiz neonatal ampliado. Fue evidente el desconocimiento de la responsabilidad que tiene el Estado mexicano con la niñez, debido al interés superior de la misma y de conformidad con la Constitución y con los tratados internacionales en materia de derechos humanos, así como la responsabilidad internacional en este tema de salud y específicamente en este grupo poblacional sobre (...) la prevención y progresividad hacia el logro de un actuar ético indiscutible en donde la beneficencia y la equidad social son necesarias. Hay casos en los que se transforman y trastocan los objetivos de las instituciones por resoluciones y jurisprudencia de los tribunales, situación que se presentó en el análisis de una sentencia del 15 de mayo de 2019, por la 1ª Sala de la Suprema Corte de Justicia de la Nación (México), derivado del amparo en revisión 1388/ 2015, por la negativa del hospital de realizar la interrupción del embarazo, por motivos de salud, a pesar de que el niño tendría una (...) vida relativamente normal, perturbando el derecho a la salud, la conciencia social y el valor ético sobre la terapia y de la dignidad humana de todas las personas, discriminando al feto bajo un paradigma eugenésico. El ser humano se ha debatido entre lo que ha creído, cree y seguirá creyendo; pero, particularmente sobre la existencia de Dios, lo hace a su conveniencia. Cuando observan la naturaleza o el universo pueden preguntarse si surgió de una explosión hace millones de años o es creación de Dios. Filósofos, científicos y personas del común siguen buscando respuestas a sus preguntas. Es “el hombre en busca de sentido como lo propone Víctor Frank, y agrega, que, … hay en él (...) [en el hombre] una espiritualidad inconsciente: la presencia ignorada de Dios”. Es el ser humano que ha decidido ignorar, poner en duda, o negar radicalmente, la existencia de Dios, más aún cuando el mal prevalece en el mundo. No se podría negar la existencia de algo, o de alguien, que no existe. “Nadie niega a Dios, sino aquel a quien no le conviene que Dios exista” (Agustín de Hipona). “Es un nuevo ateísmo enfrentando la fe y la razón” (Antonio Cruz). “La existencia de Dios es evidente en sí misma” (Tomas de Aquino). “Tiene que haber una causa inexorable de lo creado… y ese ser sería Dios” (Aristóteles). “Mi conciencia está ligada a la palabra de Dios” (Martin Lutero). “… desde la creación del mundo conocieron a Dios, pero no quisieron adorarlo como Dios ni darle gracias. El artículo presenta el panorama entero de las ideas políticas del notorio conservador peruano Monseñor Bartolomé Herrera. Se trata por vez primera de un estudio exhaustivo de las redes conceptuales y filosóficas de su peculiar concepción del republicanismo, que se califica aquí de “reaccionario”. Luego de incluirlo en su contexto en la historia de las ideas en la polémica entre liberales y conservadores, el texto sostiene que, aparte de sus influencias neoconservadoras restauracionistas, Herrera, considerado hasta hoy un conservador liberal, habría (...) sido más bien un consumidor militante –pero encubierto- del pensamiento reaccionario del Conde De Maistre, el Vizconde de Bonald y, más particularmente, de Agustín Barruel, fuente reaccionaria descuidada por los especialistas en el pensamiento político peruano. Herrera habría sido un tipo peculiar de republicano: Un republicano reaccionario. Aunque de manera simulada y escondiendo sus fuentes, el Obispo de Arequipa, en tono análogo al Valdegamas de 1848, habría desarrollado una concepción anticontractualista y antiliberal de la república peruana desde una teología política contrarrevolucionaria. Nuestro frenesí de comunicación e información hace que las cosas des- aparezcan y devengan en no-cosas, también llamadas informaciones (Han, 2021: 10). El marco ontológico presente es resultado de un desplazamiento que va del ocaso de las cosas al consumo rápido y frenético de no-cosas. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. Lo único que le queda de las manos al (...) ser humano que habita este entorno son las yemas de los dedos con las que presiona las teclas para jugar con símbolos (Flusser, 2002: 107). ¿Qué efectos contrae este nuevo paradigma vital en el campo de la educación? ¿Qué significa educar en y trabajar con no-cosas? Impairments in pragmatic abilities, that is, difficulties with appropriate use and interpretation of language – in particular, non-literal uses of language – are considered a hallmark of Autism Spectrum Conditions (ASC). Despite considerable research attention, these pragmatic difficulties are poorly understood. In this paper, we discuss and evaluate existing hypotheses regarding the literalism of ASC individuals, that is, their tendency for literal interpretations of non-literal communicative intentions, and link them to accounts of pragmatic development in neurotypical children. We present evidence (...) that reveals a developmental stage at which neurotypical children also have a tendency for literal interpretations and provide a possible explanation for such behaviour, one that links it to other behavioural, rule-following, patterns typical of that age. We then discuss extant evidence that shows that strict adherence to rules is also a widespread feature in ASC, and suggest that literalism might be linked to such rule-following behaviour. (shrink)

The “boomerang thesis” enjoys widespread currency in contemporary scholarship: that the means and ends of colonial domination would “spin back” to the metropole is an idea with intuitive grip. This article extrapolates the depth of meaning this metaphor contains, as well as what it conceals. It first considers the “boomerang” as it appears in Aimé Césaire’s Discourse on Colonialism, a poetic work that captures the moral and experiential return-effects of imperial violence. Turning to Hannah Arendt’s The Origins of Totalitarianism—the only (...) articulation of the thesis that uses the word “boomerang”—the article disaggregates the teleological, ideological, and institutional elements that spun back from European colonies in the imperial era. Finally, it traces the development of the thesis in Michel Foucault’s “Society Must Be Defended,” where it is transformed into a more general explanatory mechanism. Each theorist indicates how distance operates to transform dubious, even hateful ideas into acceptable practices. (shrink)

Manuel Herrera Gómez es Profesor Titular de Sociología de la Universidad de Granada (1998). En las últimas décadas se ha desarrollado un intenso (...) debate que contrapone a los defensores de un modelo liberal de sociedad y a los que apuestan por un modelo comunitario. Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. The topic of the relationship between the organism and its environment runs through the theories of Uexküll, Goldstein and Canguilhem with equal importance. In this work a counterpoint will be established between their theories, in the attempt to assess at which points the melodies are concordant and at which points they are discordant. As fundamental basis to his theory, Uexküll relies on the concept of conformity to a plan, which allows him to account for the congruity and perfect adjustment between (...) organisms and their Umwelten. For Goldstein and Canguilhem, the relationship between an organism and its environment resembles instead a debate or coming to terms, in which the organism, as to ensure the continuity of the state of health, must constantly create norms to maintain a productive relationship with its environment. The pinpointing of these conceptual frameworks allows to lay emphasis on that each theory relies on specific assumptions regarding teleology and sense in organisms, as well as on specific definitions of the concept of life in general. Ultimately, the view that organisms and their environments have an original and common source, a principle, or plan, which must possess all the creative characteristics of life, will be seen as prevailing. Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. This paper presents the complete development of the scale, as well as the implications and limitations of the main findings and the managerial implications. (shrink)

Une théorie qui veut établir les principes d'une science du droit, mais dont les fondements épistémologiques remontent aux premières années du XXe siècle, peut-elle garder sa validité de nos jours ?

Has science already answered the fundamental questions about the concepts of Life, Cosmos and Evolution? Has science not relegated these fundamental questions by following up on more immediate, “useful” and practical endeavors that ultimately ensure that the wheel of capitalism keeps spinning in its frantic search for material and economic progress? There is something terribly wrong with the current theory of evolution, understood as the Darwinian theory with its successive versions and extensions. The concept of natural selection, the cornerstone of (...) Darwinism, is logically inconsistent. This has been demonstrated in some of my latest academic publications. The entire conceptual framework of Darwinism is inadequate. Organisms do not compete with each other for the survival of the fittest. The fundamental relationship in Nature is not competition or confrontation, but interconnectivity, complementarity, and relational meaningfulness. A new theory of evolution is necessary to explain how it is possible that organisms as simple as bacteria, protozoa and diatoms could have generated organisms as complex as primates, and among them, the human being, a being capable of feeling and thinking, of suffering and enjoying, a being capable of having ideals and purposes. A theory that explains how it is possible that this being so complex, rich, and to some extent still unknown, has emerged from a single cell, an egg-cell, lacking all the capacities, riches and depths of human existence. There is an ongoing debate about the meaning of lexical words, i.e., words that contribute with content to the meaning of sentences. This debate has coincided with a renewal in the study of polysemy, which has taken place in the psycholinguistics camp mainly. There is already a fruitful interbreeding between two lines of research: the theoretical study of lexical word meaning, on the one hand, and the models of polysemy psycholinguists present, on the other. In this paper I aim at (...) deepening on this ongoing interbreeding, examine what is said about polysemy, particularly in the psycholinguistics literature, and then show how what we seem to know about the representation and storage of polysemous senses affects the models that we have about lexical word meaning. Esto conlleva la necesidad de de crear lo que se conoce como el lenguaje de «los datos sensoriales», que debería ser previo al lenguaje ordinario y al que podría traducirse el primero mediante la provisión de una serie de reglas con este objeto. In this work the doctrine of organicism will be addressed, as explained and seen mainly by Bertalanffy. We will study how this doctrine represents and embodies the ambiguity of Kantian teleology as a regulative principle, and how this same problem leads to consider a real problem as a knowledge problem. It will be concluded that organicism, conceived in this way, does not represent a true holism, but what we will call a syn-holism, a synthesis or assembly, and that to obtain (...) a true holism we must resort to the concept of true form. Finally, it will be established that since the fundamental characteristic of an organism is its development, a historical theory of the organism is required for which the concept of field can be useful and necessary. The influence of Kurt Goldstein on the thinking of Georges Canguilhem extended throughout his entire work. This paper seeks to examine this relationship in order to conduct a study of the norm as a nexus or connection between the concept and life. Consequently, this work will be a reflection on the approach to life as a normative activity and self-realization. For this, it will be necessary to redefine the concepts of health and disease, and make a crossover between the two. (...) At the end of this trajectory, it will be found that these concepts can explain the identity between the concept and life, which leads to the unexpected conclusion that the cure is ultimately self-healing. What is the relation between science and ideology? Are they incompatible, complementary or the same thing? Should science avoid “contamination” from ideology? Is there an only way to do science? Does anyone of them lead to the same results and give us the same worldview? We will focus on the figure of Alexander Bogdanov, Russian physician and philosopher, in order to discuss these and other relevant topics. His theories gave birth to what may be called later “the theory of two (...) sciences”, which entitles this work. (shrink)

L’enfant placé a souvent vécu des traumatismes qui ont impacté sa capacité à réguler ses émotions dans les relations interpersonnelles. Afin d’aider les assistants familiaux et les parents à mieux s’ajuster à l’enfant ont été instaurés des temps d’observation dans les conditions naturelles des interactions adulte-enfant qui ont été enregistrés en vidéo. Le vidéo-feedback a ensuite été utilisé avec chacun des adultes. L’exemple de Matthias montre comment ce dispositif a permis aux parents d’identifier les conséquences de leur comportement sur leur (...) enfant. L’exercice a été plus difficile pour l’assistante familiale davantage centrée sur ses besoins. (shrink)

Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as “law” (...) in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. Bréhier, J. Moreau, G. Reale, J. Igal, A. H. Armstrong... agree to it. The present study tries to make explicit and interpret it, examining some basic features, or general traits, wich reveal the Plotinian doctrine from this same point of view. Therefore, the systematic side of Plotinus’ thought (...) is here viewed as the really suitable mode, way or “mothodology” to think the Totality as a supreme unity, and to express the One’s ontology as a perfect whole. According to this interpretation, the system reflects the “synoptical” view of its same content, and shows it as the One’s “presence” in the whole reality and in the Plotinus’ intuitive mind, developed through an ordered series of concepts, in view of the mystical experience, to the union with the One, as the final goal. Social representations can be conveyed through language, which expresses a construction of the reality. Assuming the complex task of analyzing the results of a qualitative study, this article exposes from a structuralist approach, a proposal to analyze and construct social representations from the central core theory. Thus validate in methodological terms, a way to graphically express results for a holistic analysis and interpretation of these central and peripheral notions. In the fiftieth disputation of his Disputationes metaphysicae (1597), Francisco Suárez distinguishes three notions of time. Suárez offers an account of the ways in which the predicate ‘when’ can be taken and presents a more general perspective based on the principle of duration, rather than the Aristotelian definition of time. His view differs from Aristotle’s and Aquinas’ account because Suárez emphasizes that time cannot be reduced to the number of the movement of the last sphere in the Aristotelian model of (...) the cosmos. The intrinsic duration of a thing is its true time; this duration can be taken in an absolute or a relative sense. In an absolute sense, intrinsic time is an internal property of a thing that cannot be really distinguished from existence itself and cannot be compared with other durations. In a relative sense, we can imagine this intrinsic duration as filling up a certain interval within an infinitely extended imaginary succession. This imaginary succession is an ens rationis. The third concept of time is the Aristotelian notion: this is just an extrinsic time, a measurement of one movement by means of a comparison with another movement, especially the motion of the last sphere. Finally, in order to show the value of Suárez’s insights, I compare them with some contemporary issues in the analytic philosophy of time. (shrink)

Los estudios de géneros discursivos han prestado poca atención a las tesis o seminarios producidos para la obtención del grado de licenciatura. En este artículo se describe, desde el enfoque del genre analysis (Swales, 1990), la organización retórica del marco referencial de un conjunto de 30 tesis de pregrado elaboradas por estudiantes de la carrera de Trabajo Social de la UCSC. Se identifican cuatro movidas retóricas: teórico, conceptual, empírico y normativo. Se observa que cada una tiene propósitos diferentes sobre cuestiones (...) teóricas, prácticas y legales relacionadas con el problema social que aborda cada tesis. Se advierte la presencia de algunos pasos retóricos recursivo y, al mismo tiempo, un fuerte compromiso de la investigación con la resolución de un problema social real. Studies of discourse genre have paid little attention to graduation theses produced by undergraduate students. This article describes, from a genre analysis approach (Swales, 1990), the rhetorical organization of the reference framework of a set of 30 undergraduate theses prepared by social work students at the UCSC. The study identifies four rhetorical moves: theoretical, conceptual, empirical, and normative. It is observed that each move has different purposes on theoretical, practical, and legal issues related to the social problem addressed by each thesis. The presence of recursive rhetorical steps is apparent, along with a strong commitment to solving real social problems through research. (shrink)
