Judges in multiple US states, such as New York, Pennsylvania, Wisconsin, California, and Florida, receive a prediction of defendants’ recidivism risk, generated by the COMPAS algorithm. If judges act on these predictions, they implicitly delegate normative decisions to proprietary software, even beyond the previously documented race and age biases. Using the ProPublica dataset, we demonstrate that COMPAS predictions favor jailing over release. COMPAS is biased against defendants. We show that this bias can largely be removed. Our proposed correction increases overall (...) accuracy, and attenuates anti-black and anti-young bias. However, it also slightly increases the risk that defendants are released who commit a new crime before tried. We argue that this normative decision should not be buried in the code. The tradeoff between the interests of innocent defendants and of future victims should not only be made transparent. The algorithm should be changed such that the legislator and the courts do make this choice. (shrink)

Heuristics make decisions not only fast and frugally, but often nearly as well as “full” rationality or even better. Using such heuristics should therefore meet health care standards under liability law. But an independent court often has little chance to verify the necessary information. And judgments based on heuristics might appear to have little legitimacy, given the widespread belief in formal rationality.

Psychologists, economists, historians, computer scientists, sociologists, philosophers, and legal scholars discuss when is deliberate ignorance a virtue, and what type of environment does it require.

'Ethik ist auf deskriptives Wissen angewiesen. Das ist nichts Neues: Bereits Aristoteles betont, die Ethik müsse berücksichtigen, dass der Mensch von Natur aus ein soziales Wesen sei. Wie viel Gewicht aber kann und sollte man dem deskriptiven Wissen in normativen Fragen zugestehen? Max Stirner pioneered a radically existentialist thinking in which the ego or the Unique One is able to appropriate its “predicates” or determinations as objects of consumption. In this sense the singular event is privileged over the intellectual “spooks” that express the predicate’s independence from and mastery over its subject. Karl Marx’s thinking was decisively altered by his encounter with Stirner, to whom he replied at length in The German Ideology. I propose that Marx and Engels’s critique and appropriation of (...) Stirner provides the basis for what I call “communist existentialism,” and that this is the proper standpoint for radical philosophy today. After giving an account of this position, I briefly adopt it to critique two of the communist standpoints associated with “communization,” those of Tiqqun and Theorie Communiste. (shrink)

In contrast, I argue that in 1844 when Marx was developing his anthropology and social critique, he relied upon Fourier's thought to supply a key assumption. De 1815 - avec le Congrès de Vienne qui inaugure une ère de Restauration - à mars 1848, avec les répercussions de la révolution de février en Europe, la période du Vormârz ("avant mars") se caractérise, au sein du monde germanique, par une vie intellectuelle d'une particulière effervescence. Les grandes philosophies qui se sont construites pour dépasser Kant, avec Fichte, Schelling et Hegel, autorisent bon nombre de penseurs allemands à considérer l'Allemagne comme étant philosophiquement en avance sur son temps, ou (...) tout au moins à la pointe de la modernité. In an age where issues like climate change and the unintended consequences of technological innovation are high on the ethical and political agenda, questions about the nature and extent of our responsibilities to future generations have never been more important, yet simultaneously so difficult to answer. This book takes a unique approach to the problem by drawing on diverse traditions of thinking about care (including developmental psychology, phenomenology and feminist ethics) to explore the nature and meaning of our relationship with (...) the future. What is truth? What value should we see in or attribute to it? The war over the meaning and utility of truth is at the center of contemporary philosophical debate, and its arguments have rocked the foundations of philosophical practice. In this book, the American pragmatist Richard Rorty and the French analytic philosopher Pascal Engel present their radically different perspectives on truth and its correspondence to reality. Rorty doubts that the notion of truth can be of any practical use (...) and points to the preconceptions that lie behind truth in both the intellectual and social spheres. Engel prefers a realist conception, defending the relevance and value of truth as a norm of belief and inquiry in both science and the public domain. Rorty finds more danger in using the notion of truth than in getting rid of it. Engel thinks it is important to hold on to the idea that truth is an accurate representation of reality. In Rorty's view, epistemology is an artificial construct meant to restore a function to philosophy usurped by the success of empirical science. Epistemology and ontology are false problems, and with their demise goes the Cartesian dualism of subject and object and the ancient problematic of appearance and reality. Conventional "philosophical problems," Rorty asserts, are just symptoms of the professionalism that has disfigured the discipline since the time of Kant. Engel, however, is by no means as complacent as Rorty in heralding the "end of truth," and he wages a fierce campaign against the "veriphobes" who deny its value. _What's the Use of Truth?_ is a rare opportunity to experience each side of this impassioned debate clearly and concisely. It is a subject that has profound implications not only for philosophical inquiry but also for the future study of all aspects of our culture. (shrink)

" Lui rétorquer, comme le faisaient G.E. Moore et la tradition de la philosophie du sens commun : " Mais je sais bien que j'ai deux mains! " semble à la fois une pétition de principe et une bien mauvaise réponse. Le mieux, depuis que nous avons perdu le (...) souci de fonder nos croyance sur des raisons ultimes, serait, tout simplement, de ne pas se soucier des questions du sceptique. Ce que l'on sait dépend, nous dit-on, des circonstances, et toutes nos connaissances sont faillibles. N'y a-t-il pas plutôt des savoirs, dont l'histoire nous montre combien leurs modes de validations sont variés? Ce livre entend refuser ce type de réponse contextualiste et relativiste. Il propose de revenir à la réponse de sens commun de Moore, à partir des reformulations contemporaines des raisonnements sceptiques issues de la philosophie analytique de la connaissance. Personne ne peut nous envoyer savoir quelque chose que nous ne pourrions pas savoir. De fait, nous savons, mais notre savoir n'est pas transparent : nous n'avons pas besoin de savoir que nous savons. Pour parvenir à cette réponse, il faut replacer la notion de connaissance, plutôt que celle de croyance justifiée ou rationnelle, au centre de l'épistémologie, et reformuler des questions traditionnelles comme celles de la nature de la perception, du témoignage, et de la connaissance a priori. Suppose we believe that God created the world. Then surely we want it to be the case that he intended, in some sense at least, to create THIS world. Moreover, most theists want to hold that God didn't just guess or hope that the world would take one course or another; rather, he KNEW precisely what was going to take place in the world he planned to create. In particular, of each person P, God knew that P was to exist. (...) Call this the "standard" conception. Most theists find the standard conception appealing. Unfortunately, the view seems to conflict with the equally appealing idea — call it "temporal actualism" — that there are no "future" individuals beyond those that already exist in the present moment. For, on this view, for any historical person P, prior to creation, there was no such person as P and hence nothing about P for God to know. Hence, in particular, God couldn't have known that P was to exist. This is of course not a new problem. But past solutions to it are highly problematic. In this paper, after canvassing previous approaches, I will propose a solution that seems to preserve both temporal actualism and a suitably robust form of the standard conception while avoiding the pitfalls of the past. First published in French, Marx's The Poverty of Philosophy (1847) was composed during his years in Brussels, when he was developing his economic views and, through confrontations with the chief leaders of the working-class movement, establishing his intellectual standing. In this classic work, which laid the foundation of ideas later developed in Capital, Marx polemicized against then premier French socialist, Pierre-Joseph Proudhon. Proudhon wanted to unite the best features of such contraries as competition and monopoly. He hoped to save the (...) good features of economic institutions while eliminating the bad. Marx, however, declared that no equilibrium was possible between the antagonisms in any given economic system. Social structures were transient historical forms determined by the productive forces: "The handmill gives you society with the feudal lord; the stream mill, society with the industrial capitalist.". Aristotle attaches particular significance to the homonymy of many central concepts in philosophy and science: that is, to the diversity of ways of being common to a single general concept. His preoccupation with homonymy influences his approach to almost every subject that he considers, and it clearly structures the philosophical methodology that he employs both when criticizing others and when advancing his own positive theories. Where there is homonymy there is multiplicity: Aristotle aims to find the order within this multiplicity, (...) and believes that doing so is crucial to scientific inquiry and philosophical progress.Christopher Shields investigates and evaluates Aristotle's approach to questions about homonymy, characterizing the metaphysical and semantic commitments necessary to establish the homonymy of a given concept. Then, in a series of case-studies, Shields examines in detail some of Aristotle's principal applications of homonymy--to the body, sameness and oneness, life, goodness, and being. Shields's aim is not only to give a fuller understanding of Aristotle's methodology and to illuminate his specific doctrines in a variety of areas, but to show that this methodology remains fruitful today. When it comes to second-order knowledge (i.e. knowing that one knows), internalists typically contend that when we know that p, we can, by reflecting, directly know that we are knowing it. Gettier considerations are employed to challenge this internalistic contention and to make out a prima facie case for internalistic metaepistemological skepticism, the thesis that no one ever intemalistically knows that one internalistically knows that p. In particular, I argue that at the metaepistemological second-order level, the Gettier problem generates three (...) distinct problems which, taken together, seriously undermine the possibility of anyone possessing second-order internalistic knowledge. Expressives like damn and bastard have, when uttered, an immediate and powerful impact on the context. They are performative, often destructively so. They are revealing of the perspective from which the utterance is made, and they can have a dramatic impact on how current and future utterances are perceived. This, despite the fact that speakers are invariably hard-pressed to articulate what they mean. I develop a general theory of these volatile, indispensable meanings. The theory is built around a class of (...) expressive indices. These determine the expressive setting of the context of interpretation. Expressives morphemes act on that context, actively changing its expressive setting. The theory is multidimensional in the sense that descriptives and expressives are fundamentally different but receive a unified logical treatment. (shrink)

Moral error theories are often rejected by appeal to ‘companions in guilt’ arguments. The most popular form of companions in guilt argument takes epistemic reasons for belief as a ‘companion’ and proceeds by analogy. I show that this strategy fails. I claim that the companions in guilt theorist must understand epistemic reasons as evidential support relations if her argument is to be dialectically effective. I then present a dilemma. Either epistemic reasons are evidential support relations or they are not. If (...) they are not, then the companions in guilt argument fails. If they are, then a reduction of epistemic reasons to evidential support relations becomes available and, consequently, epistemic reasons cease to be a viable ‘companion’ for moral reasons. I recommend this structure of argument over existing strategies within the literature and defend my claims against recent objections from companions in guilt theorists. (shrink)

The norms surrounding pejorative language, such as racial slurs and swear words, are deeply prohibitive. Pejoratives are typically a means for speakers to express their derogatory attitudes. As these attitudes vary along many dimensions and magnitudes, they initially appear to be resistant to a truth-conditional, semantic analysis. The goal of the paper is to clarify the essential linguistic phenomena surrounding pejoratives, survey the logical space of explanatory theories, evaluate each with respect to the phenomena and provide a preliminary assessment of (...) the initial resistance to a truth-conditional analysis. The Unfinished Revolution compares the post-Second World War histories of the American and British gay and lesbian movements with an eye toward understanding how distinct political institutional environments affect the development, strategies, goals, and outcomes of a social movement. Stephen M. Engel utilizes an electic mix of source materials ranging from the theories of Mancur Olson and Michel Foucault to Supreme Court rulings and film and television dialogue. The two case study chapters function as brief historical sketches to elucidate (...) further the conclusions on theory and whilst being politically-oriented, they also examine gay influence and expansion into mainstream popular culture. The book also includes an appendix that surveys and assesses the analytical potential of five critical understandings of social movements: the classical approach, rational choice, resource mobilization, new social movement theories, and political opportunity structures.
