The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference to develop evaluation methods (...) for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery. Pornography is no longer an activity confined to a small group of individuals or the privacy of one’s home. Rather, it has permeated modern culture, including the work environment. Given the pervasive nature of pornography, we study how viewing pornography affects unethical behavior at work. Using survey data from a sample that approximates a nationally representative sample in terms of demographics, we find a positive correlation between viewing pornography and intended unethical behavior. We then conduct an experiment to provide causal (...) evidence. The experiment confirms the survey—consuming pornography causes individuals to be less ethical. We find that this relationship is mediated by increased moral disengagement from dehumanization of others due to viewing pornography. Combined, our results suggest that choosing to consume pornography causes individuals to behave less ethically. Because unethical employee behavior has been linked to numerous negative organization outcomes including fraud, collusion, and other self-serving behaviors, our results have implications for most societal organizations. The ‘friends of temporal parts’ and their opponents disagree about how things persist through time. The former, who hold what is sometimes called a ‘4D’ theory of persistence, typically claim that all objects that last for any period of time are spread out through time in the same way that spatially extended objects are spread out through space — a different part for each region that the object fills. David Lewis calls this manner of persisting ‘perdurance’. The opposing, (...) ‘3D’ theory has it that at least some objects do not persist in this manner; they ‘endure’ through time by ‘being wholly present at more than one time’.1 A related dispute pits ‘presentists’ against ‘non-presentists’. Presentists hold that the only things that really exist are those that exist now, at the present moment; and nonpresentists believe in something like a ‘block-universe’ in which non-simultaneous objects and events nevertheless co-exist (in a tenseless or non-temporal sense). Of late, the relations between these four positions have come under considerable scrutiny.2 As Ned Markosian has pointed out, it would be surprising if commitment to a perdurance or endurance theory of persistence automatically foreclosed one’s options in the presentism—non-presentism debate. But, says Markosian, that is just what the standard formulations of the perdurance and endurance theories imply.3 David Lewis has set the terms of the debate; in his usage, someone who thinks that all persisting objects endure would be said to hold the following. Henry Bugbee is a curious figure in the annals of American Philosophers. It seems that most philosophers either cherish his work dearly or have never heard of him. Albert Borgmann described his work as “both inconspicuous and consequential”. As of this writing, he has no entries on The Internet Encyclopedia of Philosophy, The Stanford Encyclopedia of Philosophy, or even Wikipedia. Among those who know his work, most only know his book, The Inward Morning. And few of those who know the (...) book have seen fit to write about it. It is not that Bugbee’s career was on the margins. To the contrary, with a Princeton BA, a Berkeley PhD, and a faculty position at Harvard, a colleague of both C.I. Lewis and W.V.O. Quine... This paper critically assesses the “procedural” accounts of political justice set forth by John Rawls in A Theory of Justice (1971) and Robert Nozick in Anarchy, State, and Utopia (1974). I argue that the areas of agreement between Rawls and Nozick are more significant than their disagreements. Even though Nozick offers trenchant criticisms of Rawls's argument for economic redistribution (the “difference principle”), Nozick's own economic libertarianism is undermined by his “principle of rectification,” which he offers as a possible ground in (...) practice for the application of something like the difference principle. Both Rawls's and Nozick's accounts of justice fail because of their abstraction from human nature as a ground of right. At the same time the libertarianism on which they agree in the non-economic sphere would deprive a free society of its necessary moral underpinning. Rawls and Nozick err, finally, by demanding that the policies pursued by a just society conform to theoretical formulas concocted by philosophy professors, rather than leaving room (as Lockean liberalism does) for the adjustment of policies to particular circumstances based on statesmen's prudential judgment and the consent of the governed. Particularly troubling from the perspective of a citizen seriously concerned with the advancement of justice and freedom is both thinkers' shrill denunciations of existing liberal societies for failing to conform to their particular strictures. In the Poroi, Xenophon’s radical solution to Athens’ financial problems includes several ideas vital to the field of political economy. His identification of justice with the pursuit of wealth provides an alternative to the power politics that for half a century had taken Athens into a series of self-destructive imperial wars. He supports his idea of economic growth with arithmetic calculations, and he connects the results to traditional Greek views of public rewards and benefits. From this he crafts a goal-directed (...) strategy for economic growth designed to foster good will through incentives rather than coercion. This brief commentary on the text shows how Xenophon’s positive claims are based not on a modern demand-side conception of economic stimulation, but rather on building productive capital. He is a proto-Saysian, not a Keynesian. Xenophon’s proposals range beyond the polis into a pan-Hellenic vision of increasing trade that is centred on Athens, monetized with Athenian coinage, and idealized into the common peace that the Greeks had so long desired but so little achieved. JOHN RAWLS IN A Theory of Justice attempts to deduce "the principles of justice" from the idea of a "contract" among free and equal persons. The factor which obviously distinguishes Rawls’ contract doctrine from the teachings of the great social contract philosophers who preceded him is that it does not rest on any examination of what the character of an actual nonpolitical condition or "state of nature" among men would be. Rawls’ procedure is in fact the opposite of that followed (...) by his predecessors: instead of inferring the principles of the contract from what men, given their nature, would be likely to agree upon in the absence of an already existing government and set of laws, he freely constructs the character and circumstances of the parties to his "purely hypothetical" "original position of equality" in order "to lead to a certain conception of justice". Michel de Montaigne (1533–1592), author of the Essays (published in successive, revised and expanded editions from 1580 until after his death), deserves to be recognized as the first) philosophic architect of modern liberalism, that is, a doctrine that advocates the advancement of individual liberty (under law), and consequently a reduction in the scope and purpose of government to securing what are represented by Montaigne’s successors (Hobbes, Locke, Montesquieu, and the American Founders) as people’s inherent rights to their life, liberty, property, (...) and the “pursuit of happiness” as they conceive it. His outward, periodic professions of extreme conservatism and of homage to the Catholic Church are merely a rhetorical cover designed to protect the author from being persecuted (and his book from being banned). As a practitioner of what he describes as esoteric rhetoric (attributing it to the ancient political philosophers), Montaigne invites careful readers to see through his rhetorical concealment by noting how his conservative professions are undermined by the overall train of his reasoning and argument. Although Montaigne’s argument for liberal individualism may have gone too far in its influence over the long run (that is, the 21st century), we citizens of modern liberal regimes owe him a debt of gratitude for helping to liberate us from the reign of arbitrary monarchs, oppressive aristocrats, and clerical oppressors. Recent developments in quantum physics postulate the existence of some form of multiverse, often considered inimical to theism. We argue that a cosmology of many worlds is not novel either to philosophy or to theism. The multiverse is not a monolithic concept and we refer to and use the four levels of categorization proposed by Max Tegmark. We trace the idea of a multiverse back to the Milesians and Epicureans in order to initially demonstrate its use of a plenitude argument. (...) We then examine the argument for possible compatibility based on a theistic principle of plenitude in three specifically Christian theists: Origen, Thomas Aquinas, and G. W. Leibniz. We conclude that this argument is sustainable so that if any level of the multiverse actually exists then it is harmonious with theism, and we argue that its fit is most successful if a multiverse is considered as a single possible world. We call this view Thomistic modal realism. (shrink)

These starkly beautiful photographs document the daily life and labor of blue-collar workers in modern America. From a foundry in which the very fires of hell seem to blast to an air-conditioned computer control room in which the workers appear casual and comfortable, David Parker's lens captures what Peter Rachleff calls "a performance, a ritual, an exercise centuries ol""-men and women at work on factory floors. These photographs, taken in twenty plants in all parts of Minnesota, explore the common (...) bonds of industrial labor. Whether it's the Ford plant in St. Paul, the Potlatch paper mill in Cloquet, or the Toro engine manufacturer in Windom, Parker seeks to honor "the collective genius of the American worker." Excerpts from interviews with the workers reveal their opinions on such diverse topics as health care and child care, union activity, immigrant labor, and the effects of globalization. Their words and these photographs document industrial laborers and the factories in which they work, revealing how workers interact with each other and their environment and how the culture of labor is reflected in the jobs women and men do. An appendix provides a history and description of each workplace, detailing the magnitude of production and the constant ingenuity required to manufacture even the most common products. This book is a tribute to the women and men who process the foods we eat, manufacture the cars we drive, and produce the goods that make our lives comfortable. (shrink)

It has been proposed by Dawkins, Dennett and others that memes are the units of cultural evolution. We here concentrate on Dennett's account because of the role it plays in his explanation of human consciousness - which is our principal target. Memes are claimed to be replicators that work on Darwinian principles. But in what sense are they replicators, and in what way are they responsible for their own propagation? We argue that their ability to replicate themselves is severely limited, (...) particularly in the case of language-borne memes. We contend, too, that the theory has unacceptable consequences for the role of design in accounting for cultural change, unless we seriously want to entertain the thought that design has as little relevance to cultural evolution as it does to the evolution of species. Finally, we argue that the account fails to do justice to the complexities of social practices. (shrink)

It is common in the history of science to try to extend an idea first demonstrated in one domain into others. Sometimes the extension is literal, and sometimes it is frankly metaphorical. Sometimes, however, when an extension is claimed to be literal, it is far from easy to see that it is. If an extension does not make use of entities and mechanisms involved in the original domain, and introduces novel entities and mechanisms, then it is not unreasonable to doubt (...) the claim of its authors that it is a literal extension of a well-established theory. IT is, therefore, not surprising that many who accept that the cultural transmission of information is unique to out species nevertheless balk at Dawkins's and Dennett's contention that there are units of cultural evolution, called 'memes', which can be used to explain the development and diversity of human culture, and whose survival is explicable in terms of Darwin's theory of evolution by natural selection. Our aim in this paper is to argue that scepticism about Dawkins's and Dennett's proposal is indeed justified; though it of course does not follow that there is not another way of explaining human culture in evolutionary terms. Several alleged counterexamples to the definition of ‘intrinsic’ proposed in Rae Langton and David Lewis, ‘Defining “Intrinsic”’, are unconvincing. Yet there are reasons for dissatisfaction, and room for improvement. One desirable change is to raise the standard of non-disjunctiveness, thereby putting less burden on contentious judgements of comparative naturalness. A second is to deal with spurious independence by throwing out just the disjunctive troublemakers, instead of throwing out disjunctive properties wholesale, and afterward reinstating those impeccably intrinsic disjunctive properties (...) that are not troublemakers. (The second of these changes makes the first more affordable.) A third, suggested by Brian Weatherson, would be to invoke the general principle that the intrinsic and the extrinsic characters of things are independent, rather than relying just on one special case of this principle; but it is none too obvious how to do this. Skinner has assigned the persistence of cognitive explanations to the literature of freedom and dignity. This view is challenged especially as it applies to behavioral scientists. It is argued that cognitive explanations persist because current behaviorism does not challenge cognitive epistomology; because behavior analysts have failed to provide research evidence at the level of human behavior, and finally because a science of behavior based solely on operant principles is necessarily incomplete. The implications of these problems for behavior analysis are addressed.

Is there a justified presumption that a speaker is testifying sincerely? Anti-reductionism about testimony claims that there is, absent reasons to the contrary. Yet why believe this, given the actuality and prevalence of lies and deception? I examine one argument that may be appropriated to meet this challenge, David Lewis's claim that truthfulness is a convention. I argue that it fails, and that the supposition that there is a presumption of sincerity remains unsupported. The failure of Lewis's (...) argument is instructive, however, for it shows us a better way of approaching language use than the standard anti-reductionist treatment. As speech is an intentional action, so a presumption of the sincerity or otherwise of others' testimony must be explicable in the terms we normally use to explain action. (shrink)

We extend in a natural way the operation of Turing machines to infinite ordinal time, and investigate the resulting supertask theory of computability and decidability on the reals. Everyset. for example, is decidable by such machines, and the semi-decidable sets form a portion of thesets. Our oracle concept leads to a notion of relative computability for sets of reals and a rich degree structure, stratified by two natural jump operators.

In the context of a discussion of time symmetry in the quantum mechanical measurement process, Aharonov et al. (1964) derived an expression concerning probabilities for the outcomes of measurements conducted on systems which have been pre- and postselected on the basis of both preceding and succeeding measurements. Recent literature has claimed that a resulting "time-symmetrized" interpretation of quantum mechanics has significant implications for some basic issues, such as contextuality and determinateness, in elementary, nonrelativistic quantum mechanics. Bub and Brown (1986) have (...) shown that under the standard interpretation of the aforementioned expression, these claims employ ensembles which are not well defined. It is argued here that under a counterfactual interpretation of the expression, these claims may be understood as employing well-defined ensembles; it is shown, however, that such an interpretation cannot be reconciled with the standard interpretation of quantum mechanics. Many philosophers who support a four-dimensionalist metaphysics of things also conceive of experience as a state of a mind having temporal extension or existing as a momentary feature of the dimension of time. This essay shows that such a strict four-dimensionalism — suggested in works by D. M. Armstrong, Mark Heller, and David Lewis — cannot be correct, since it cannot allow for the passing of time that is essential to awareness. The argument demonstrates that the positing of (...) any temporal process at all must compromise the strict four-dimensionalist view of the temporality of experience. This is not to say that the traditional endurantist view is left wholeheartedly endorsed. As I point out, this traditional view makes several questionable claims of its own that must be carefully scrutinized. Still, the criticism of the strict four-dimensionalist ontology indicates a direction to be followed in developing a successful metaphysics of experience. (shrink)

Structural properties are properties something has in virtue of its mereological structure in that they are properties whose instantiation by a particular involves the parts of the particular being propertied and related in the appropriate way. Most of the literature on structural properties has focused on problems that arise from the pairing of two assumptions: (1) structural properties are universals and (2) structural properties are, in some sense, composed of the properties they involve. Chief among these difficulties is David (...) Lewis’ claim that the conjunction of (1) and (2) require non-unique composition and hence entail the denial of the extensionality of parthood: butane, as well as methane, is composed of the universals carbon, hydrogen and bonded, yet they are distinct properties. This is the extensionality problem. In this paper I discuss a different problem for the conjunction of (1) and (2) and propose a single solution to both problems. First, in section two, I introduce the idea of multiple decomposition and suggest that at least some structural properties are multiply decomposable. In section three, I introduce the “problem of multiple decompositions.” This problem arises when it seems possible for a structural property to be composed of some xs and some ys even when the xs ≠ ys. Finally, in section four I show how both problems admit of a single solution by focusing on the parthood relation that holds between structural properties and their constituents. While the solution I propose is theoretically costly, I argue that this cost should be paid to retain both (1) and (2). (shrink)
