The Search for the Legacy of the USPHS Syphilis Study at Tuskegee is a collection of essays from experts in a variety of fields seeking to redefine the legacy of the infamous Tuskegee Syphilis Study. The essayists place the legacy of the study within the evolution of racial and ethnic relations in the United States. Contributors include two leading historians on the study, two former United States Surgeons General, and other prominent scholars from a wide range of fields.

In 2000, US Secretary of Health and Human Services Secretary Tommy Thompson mobilized the US public health infrastructure to deal with escalating trends of excess body weight. A cornerstone of this effort was a report entitled The Surgeon General's Call to Action to Prevent and Decrease Overweight and Obesity. The report stimulated a great deal of public discussion by utilizing the distinctive public health terminology of an epidemic to describe the growing prevalence of obesity in the US population. We suggest (...) that the ensuing controversy was fueled in part by the report's ambiguous usage of the evocative term “epidemic.” In some passages, the report seems to use “epidemic” in a literal sense, suggesting that rising prevalence of excess body weight should be defined technically as a disease outbreak. Other passages of the report present the same key term metaphorically, leaving readers with the impression that the epidemic language is invoked primarily for rhetorical effect. Here, we explore dynamics and implications of both interpretations. This analysis sheds light on the ongoing public argument about the appropriate societal response to steadily increasing body sizes in the US population; likewise, it capitalizes on the accumulated knowledge that the field of public health has garnered from combating diverse historic epidemics. Our interdisciplinary approach deploys critical tools from the fields of rhetoric, sociology and epidemiology. In particular, we draw from metaphor theory and public address scholarship to elucidate how the Call to Action frames public deliberation on obesity. We turn to the applied public health literature to develop a reading of the report that suggests a novel approach to the problem—application of the Epidemic Investigation protocol to streamline the public health response and reframe the public argument about obesity. Reasoned disagreement is a pervasive feature of public life, and the persistence of disagreement is sometimes troublesome, reflecting the need to make difficult decisions. Fogelin suggests that parties to a deep disagreement should abandon reason and switch to non-rational persuasion. But how are the parties to know when to make such a switch? I argue that Fogelin's analysis doesn't clearly address this question, and that disputes arising in areas like medical decision making are such that the parties to them have (...) reasons to act as if they can be rationally resolved even if they are deep. Fogelin's analysis is thus of limited value as regards the practical moral demand of addressing concrete moral dilemmas. (shrink)

The model of clinical ethics consultation (CEC) defended in the ASBH Core Competencies report has gained significant traction among scholars and healthcare providers. On this model, the aim of CEC is to facilitate deliberative reflection and thereby resolve conflicts and clarify value uncertainty by invoking and pursuing a process of consensus building. It is central to the model that the facilitated consensus falls within a range of allowable options, defined by societal values: prevailing legal requirements, widely endorsed organizational policies, and (...) professional standards of practice and codes of conduct. Moreover, the model stipulates that ethics consultants must refrain from giving substantive recommendations regarding how parties to a moral disagreement in the clinic should evaluate their options. We argue that this model of CEC is incomplete, because it wrongly assumes that what counts as the proper set of allowable options among which the parties are to deliberate will itself always be clearly discernible. We illustrate this problem with a recent case on which one of us consulted—a neonate born with trisomy 18 (T18). We try to show that law, policy, and standards of practice reveal no clear answer to the question posed by the case: namely, whether forgoing gastrostomy tube feedings for a baby with T18 is allowable. We suggest there may be other kinds of cases in which it may simply be unsettled whether a given choice falls within the set of allowable options within which consensus is to be facilitated. What should an ethicist do when confronting such unsettled cases? We agree with the facilitation model that an ethicist should remain neutral among the allowable options, when it is clear what the allowable options are. But, in unsettled cases, the role of a consultant should be expanded to include a process of moral inquiry into what the allowable options should be. We end by raising the issue of whether this means an ethicist should share his or her own conclusions or views about the allowability of a given clinical option. (shrink)

Building on prior research in Confucianism and business, the current study examines the effects of Confucianism on consumer trust of government involvement with products and company brands. Based on three major ideas of Confucianism – meritocracy, loyalty to superior, and separation of responsibilities – it is expected that consumers under the influence of Confucianism would perceive products from government-involved enterprises to have more desirable attributes and show preference for their company brands. Findings from an empirical study in the Chinese automobile (...) market support the hypotheses. The results suggest that small firms doing business in China would especially benefit from some association with the government. These results also provide managerial implications for enterprises in other countries with a Confucian cultural background. (shrink)

Exactly how do the sign/symbol/token systems of endo- and exo-biosemiosis differ from those of cognitive semiosis? Do the biological messages that integrate metabolism have conceptual meaning? Semantic information has two subsets: Descriptive and Prescriptive. Prescriptive information instructs or directly produces nontrivial function. In cognitive semiosis, prescriptive information requires anticipation and “choice with intent” at bona fide decision nodes. Prescriptive information either tells us what choices to make, or it is a recordation of wise choices already made. Symbol systems allow recordation (...) of deliberate choices and the transmission of linear digital prescriptive information. Formal symbol selection can be instantiated into physicality using physical symbol vehicles (tokens). Material symbol systems (MSS) formally assign representational meaning to physical objects. Even verbal semiosis instantiates meaning into physical sound waves using an MSS. Formal function can also be incorporated into physicality through the use of dynamically-inert (dynamically-incoherent or -decoupled) configurable switch-settings in conceptual circuits. This paper examines the degree to which biosemiosis conforms to the essential formal criteria of prescriptive semiosis and cybernetic management. (shrink)

A curious and comparatively neglected element of death penalty jurisprudence in America is my target in this paper. That element concerns the circumstances under which severely mentally disabled persons, incarcerated on death row, may have their sentences carried out. Those circumstances are expressed in a part of the law which turns out to be indefensible. This legal doctrine—competence-for-execution —holds that a condemned, death-row inmate may not be killed if, at the time of his scheduled execution, he lacks an awareness of (...) his impending death or the reasons for it. I argue that the law of CFE should be abandoned, along with the notion that it is permissible to kill the deeply disturbed just so long as they meet some narrow test of readiness to die. By adopting CFE, the courts have been forced to give independent conceptual and moral significance to a standard for competence that simply cannot bear the weight placed upon it. To be executable, CFE requires that a condemned prisoner meet a standard demonstrating an awareness of certain facts about his death. Yet this standard both leads to confusing and counter-intuitive results and is unsupported either by the reasons advanced by the courts on its behalf or by any of the standard theoretical justifications of criminal punishment. If executing the profoundly psychotic or delusional is wrong the law needs a better account of the wrong done when prisoners like Ford are killed. I suggest wherein that wrong might be located. _The Code of Ethics and Professional Responsibilities for Healthcare Ethics Consultants_ instructs clinical ethics consultants to preserve their professional integrity by “not engaging in activities that involve giving an ethical justification or stamp of approval to practices they believe are inconsistent with agreed-upon standards” (ASBH, 2014, p. 2). This instruction reflects a larger model of how to address value uncertainty and moral conflict in healthcare, and it brings up some intriguing and as yet unanswered questions—ones that the drafters of the (...) _Code_, and the profession more broadly, should seek to address in upcoming revisions. The objective of this article is to raise these questions as a way of urging greater clarification of the _Code’s_ overall approach to professional integrity, its meaning, and implications. (shrink)

In this paper I attempt to address what appears to be a novel theoretical and practical problem concerning physician-assisted suicide (PAS). This problem arises out of a newly created set of circumstances in which persons are hospitalized in jurisdictions where PAS, though now legally available to patients, remains morally contentious. When moral disagreements over PAS come to divide physicians, patients, and family members, it is quite likely they will today find their way to the hospital’s consulting ethicist, a member of (...) an emerging group of professionals charged with the responsibility (so we are told) of resolving moral conflict in the clinic. What can or should an ethics consultant do to fulfill this mandate in such circumstances? I argue that the now predominant conception of clinical ethics consultation is importantly deficient in that it provides no final guidance to ethicists on how they should respond in such cases. The ethicist may only recommend—or assist others to reach—solutions to moral disagreements falling within the limits of established norms. Since the normative landscape of PAS appears to be changing, whether it falls within these limits is unsettled. I conclude that the accepted goals of ethics consultation require a revised and expanded conception of the ethicist's role in cases involving PAS. I close by outlining what that revised understanding would look like and the further questions it raises. (shrink)

In his private notes written in 1936 (now published as GA82), Heidegger enumerates three “fundamental deceptions” at play in Being and Time (1927). The thrust of these deceptions is twofold: that Dasein is something given and that the task of phenomenology is to describe Dasein in its givenness. These are deceptions, Heidegger claims in 1936, because Dasein is not something given, but can only be reached in a leap, and because the task of phenomenology is not to describe Dasein in (...) its givenness, but to bring about Dasein and the “there,” the site of Being’s happening, through a creative leap-in. Scholars might be inclined to read these deceptions as further evidence for the view that Heidegger in the 1930s abandons phenomenology understood as a descriptive enterprise oriented toward givenness. This paper argues, to the contrary, that phenomenology for the young Heidegger was never a descriptive enterprise oriented toward givenness, but always, however obliquely presented throughout the 1920s, a way of participating in the creative unfolding of the site of Being’s happening. Previous research has found that populist attitudes and conspiracy mentality – here summarised as anti-establishment attitudes – increase when people feel threatened. Two types of intergroup threat have been distinguished, namely realistic threats (pertaining to socio-economic resources, climate, or health), and symbolic threats (pertaining to cultural values). However, there is no agreement on which types of threat and corresponding appraisals would be most important in predicting anti-establishment attitudes. We hypothesise that it is the threat itself, irrespective of its cause, that (...) predicts anti-establishment attitudes. In the current paper, we conducted new (multilevel) regression analyses on previously collected data from four high-powered studies with multiple time points (Study 1) or collected in multiple nations (Studies 2–4). All studies included a populist attitudes scale, a conspiracy mentality scale, and different types of threat and emotion measures, reflecting both realistic and symbolic threats. Across studies, both realistic and symbolic threats positively predicted anti-establishment attitudes. The results support an emotional appraisal approach to anti-establishment attitudes, which highlights the importance of anxiety and feeling threatened regardless of what type of event elicits the threat. Several philosophers, including most prominently Theodore Benditt, have recently urged that the discourse of rights, widely thought to be a central, if not foundational feature of moral and political thought, is in reality a mere “redundant” appendage---a discourse that holds no distinctive place in moral or legal reasoning owing to the fact that it is thoroughly derivative because collapsible into other forms of moral or legal language. In this paper I attempt to (1) flesh out this “Redundancy” Thesis (RT) and (...) (2) identify and criticize at least two general arguments that might be thought to give rise to it: the claims that rights reduce (respectively) to duties (the Correlativity Thesis) or to permissions (the Permissibility Thesis). I try to show how and why these arguments fail and why they do not therefore support RT. (shrink)

We argued in our joint article that the facilitated consensus model of clinical ethics consultation is incomplete because it does not address the problem of what we have called “unsettled cases.” Sabrina Derrington and April Dworetz, Mark Aulisio, and Al Jonsen have each usefully challenged our claims and conclusions. How do ordinary Muslims deal with and influence the increasingly pervasive Islamic norms set by institutions of the state and religion? Becoming Better Muslims offers an innovative account of the dynamic interactions between individual Muslims, religious authorities, and the state in Aceh, Indonesia. Relying on extensive historical and ethnographic research, David Kloos offers a detailed analysis of religious life in Aceh and an investigation into today's personal processes of ethical formation. Aceh is known for its history of rebellion and (...) its recent implementation of Islamic law. Debunking the stereotypical image of the Acehnese as inherently pious or fanatical, Kloos shows how Acehnese Muslims reflect consciously on their faith and often frame their religious lives in terms of gradual ethical improvement. Revealing that most Muslims view their lives through the prism of uncertainty, doubt, and imperfection, he argues that these senses of failure contribute strongly to how individuals try to become better Muslims. He also demonstrates that while religious authorities have encroached on believers and local communities, constraining them in their beliefs and practices, the same process has enabled ordinary Muslims to reflect on moral choices and dilemmas, and to shape the ways religious norms are enforced. Arguing that Islamic norms are carried out through daily negotiations and contestations rather than blind conformity, Becoming Better Muslims examines how ordinary people develop and exercise their religious agency. In Leviathan Thomas Hobbes defines moral philosophy as 'the science of Virtue and Vice', yet few modern readers take this description seriously. Moreover, it is typically assumed that Hobbes' ethical views are unrelated to his views of science. Influential modern interpreters have portrayed Hobbes as either an amoralist, or a moral contractarian, or a rule egoist, or a divine command theorist. David Boonin-Vail challenges all these assumptions and presents a new, and very unorthodox, interpretation of Hobbes's ethics. He shows (...) that Hobbes is best understood as embracing a theory of virtue concerned with the development of good character traits rather than with rules of behaviour. In focusing in a quite new way on Hobbes's moral theory this book is likely to attract considerable attention amongst both philosophers and intellectual historians. (shrink)

Abstract An anonymous manuscript from the fourteenth or early fifteenth century, recently discovered, apparently transmitted Thierry of Chartres's philosophical theology to Nicholas of Cusa around 1440. Yet the author of the treatise is not endorsing Thierry's views, as both Cusanus and modern readers have assumed, but in fact is writing in order to refute them. Curiously the author never mentions Thierry's best known triad of unitas, aequalitas and conexio . But a careful comparison of the structure of the author's argument (...) to Thierry's extant works shows that the author was nevertheless quite familiar with the Breton master's writings. The reatise's author offers an incisive critique of Thierry's theory of “four modes of being“ and rejects two of the modes in particular. From this new perspective, the manuscript can be valued as the first known evidence of Thierry of Chartres's late medieval reception. (shrink)

Does "nature" still exist? Common wisdom now acknowledges the malleability of nature, the complex reality that circumscribes and constitutes the human. Weather patterns, topographical contours, animal populations, and even our own genetic composition--all of which previously marked the boundary of human agency--now appear subject to our intervention. Some thinkers have suggested that nature has disappeared entirely and that we have entered a postnatural era; others note that nature is an ineradicable context for life. Christian theology, in particular, finds itself in (...) an awkward position. Its Western traditions have long relied upon a static "nature" to express the dynamism of "grace," making nature a foundational category within theology itself. This means that any theological inquiry into the changing face of nature must be reflexive and radically interdisciplinary. This book brings leading natural and social scientists into conversation with prominent Christian theologians and ethicists to wrestle collectively with difficult questions. Is nature undergoing fundamental change? What role does nature play in theological ethics? How might ethical deliberation proceed "without nature" in the future? What does the religious drive to transform human nature have to do with the technological quest to transcend human limits? Would the end of nature make grace less comprehensible? (shrink)

In this paper, I put forward a theory about the modes and dimensions of being. In the first section, I define existence through coexistence, understood as the codetermination of certain things and processes via other things and processes. In the second section, I differentiate between modes and dimensions of being. In the third section, I argue that the modes of existing are the different ways in which coexistence and codetermination take place and discuss two types of modes ("fundamental" and "categorial"), (...) to subsequently present a classification thereof.
