The right to resist has been discussed ever since human collectivity has been regulated by law and political power. One crucial systematic problem is to legitimize a right above the law. After the right to resist became positive law in Germany, the discussion focussed on the question how a law like this is possible according to the logic of legislation. On the other hand the ethical theory of human rights claimed it to be an element of natural law. This paper (...) argues that both interpretations fall short of the eminent political dimension of political resistance. This is shown by a critique of the attempts to legitimize the right to resist in the history of political thought. The missing of a consistent legal or moral argumentation for it may open the perspective on the basic political problems. (shrink)

In diesem Beitrag wird die Bedeutung von Kants Begriff des ethischen Gemeinwesens für die Frage des Kosmopolitanismus herausgearbeitet. Kosmopolitanismus ist für Kant zunächst eine Konsequenz der Rechtslehre: Der Rechtszustand kann nur als globaler peremtorisch wirklich sein. Diese Einsicht kollidiert jedoch mit der Voraussetzung souveräner bürgerlicher Staaten, so dass der politische oder juridische globale Rechtszustand die moralische Forderung des Kosmopolitanismus nicht erfüllt. Es lässt sich zeigen, dass diese Kollision in der antagonistischen Form der modernen Gesellschaft gründet, deren politische Instrumente die Staaten (...) sind. Im Unterschied zu den rechtsphilosophischen Schriften konstruiert Kant in der Religionsschrift ein weltbürgerliches ethisches Gemeinwesen, das von der Idee einer moralisch organisierten Gesellschaft ausgeht. Dieses Modell wird im Rahmen der Religionsphilosophie entwickelt. This paper discusses Fichte’s doctrine of resistance as a phenomenon of transition from the early modern concept of sovereignty to the constitutional state of rule of law. Therefor in particular the doctrine of the Ephorat, in the version of Grundlage des Naturrechts, in its context of development, is interpreted as a constitutional self-limitation of political power, which is to preserve both the sovereign claim of identity and the constitutional claim of control. This thesis is developed in opposition to Kant and (...) Hegel and in dependence on Condorcet’s project of a constitution. Whereas Kant and Hegel discuss the right to resist on the basis of a traditional concept of sovereignty and – in spite of all oppositional interpretations – reject it, Fichte tries to develop in dependence on the French discussion on the constitution the theory of a juridical practice which allows to save the identity of law even in the case of conflict. The intention of the juridical structure of this practice can be found in the constitutional forms of self-limitation of modern states.Der Beitrag erörtert Fichtes Lehre vom Widerstandsrecht als Phänomen des Übergangs vom frühen neuzeitlichen Souveränitätsverständnis zum Rechts- und Verfassungsstaat. Dafür wird insbesondere die Lehre vom Ephorat in der Fassung der Grundlage des Naturrechts, im Kontext ihrer Entwicklung, als konstitutionelle Selbstbegrenzung der Staatsgewalt interpretiert, die sowohl den souveränen Einheitsanspruch als auch den konstitutionellen Kontrollanspruch wahren soll. Diese These wird in Abgrenzung zu Kant und Hegel und in Anlehnung an Condorcets Verfassungsentwurf entwickelt. Während Kant und Hegel das Widerstandsrecht aufgrund einer traditionellen Souveränitätsauffassung diskutieren und – allen entgegengesetzten Interpretationen zum Trotz – abweisen, will Fichte in Anknüpfung an die französische Verfassungsdiskussion die Theorie eines rechtlichen Verfahrens zur Wahrung der Identität des Rechts auch im Konfliktfall entwickeln, dessen rechtstheoretische Intention sich in den konstitutionellen Schranken moderner Staatsgewalt wiederfindet. The relation between human beings and nature is basically technical. Humans are compelled to transform the natural conditions of life through their labor, using technical equipment. Thus – and this is a specifically human characteristic – they set themselves apart from their natural surroundings. As a result of the same process, untouched nature exists no more. Therefore it is not a matter of how to absolutely preserve parts of nature from technical alteration, but rather a question of what the dominant (...) ends are in the technical development of modern society and whether these ends are reasonable or not. The ideas of Karl, Hegel and Marx concerning the connection between society and its ends will be discussed. The resulting combination of technical and moral moments, rather than an external ethical view, includes the proposal to revisit the concept of education and research. (shrink)

The concepts of autonomy and subjectivity are crucial not only for modern philosophy of law but also for its practice. Nevertheless, postmodern philosophy and postmodern theory of law claim to suspend these concepts, interpreting them as hypostatized narratives. The article argues that contrary to the postmodern reading, already the early modern concept of subjectivity is very fragile: It has no reality outside of a historical process in which the principle of subjectivity is connected to its external objective conditions of existence. (...) These conditions are both theoretical and practical; the former are acquired by science, the latter by social, political, and legal history. This history has not been the pure realization of rationality. The development of the state of law from the state of nature, including the original appropriation and legalization of private property, has been a history of violence. This violence has not simply been overcome but is preserved in modern legal systems, too. It takes a materialistic social theory to tell this story in opposition to the narrative of modern law as a pure triumph of human freedom. This also entails that the subjectivity that stands at the end of this story is not only fragile but also fragmented. (shrink)

Based on a comparative case study of six cross-sector partnerships (CSPs) in global health, we illustrate how a CSP’s aim to address a social issue on the basis of products influences the governance of collective action within the partnership and beyond, at the field level. We show how such product focus, through specialization, influences a CSP’s structures and interaction culture and, as a reflection of the partners’ underlying logics, generates different CSP-field effects. Specifically, if conceived as self-contained and without considering (...) the implications for other field players and programs, a product focus may expedite collective action within the CSP, but spur fragmentation and disruption at the field level. Conversely, if designed to strengthen field capacity and integration at the product-field interlinkages, a product focus may take longer to form but helps avoid the above field effects. On this basis, we advance theory on CSPs’ product focus as a multilevel coordination mechanism and elaborate on the implications for designing product-based CSPs. (shrink)

In this paper I outline the PAIR account of joint attention as a perceptual-practical, affectively charged intentional relation. I argue that to explain joint attention we need to leave the received understanding of propositions and propositional attitudes and the picture of content connected to it behind and embrace the notions of subject mode and position mode content. I also explore the relation between joint attention and communication.

Multi-stakeholder partnerships have become a major driver to attain the United Nations Sustainable Development Goals. However, managing MSPs is difficult because of the multiple complexities they involve. We seek to contribute to a better understanding of how MSPs cope with these complexities by exploring the MSP scope. In our study of four global health MSPs, we find that a function-oriented scope in terms of focusing on a single intervention helped filter the relevant external and internal complexities, whereas an issue-oriented scope (...) focused on addressing the health issue with multiple interventions magnified the complexities. As a result, the latter MSPs became overwhelmed and self-absorbed, while the former MSPs managed to remain outward-looking and sustain their collaborative energy and support. On this basis, we identify three mechanisms through which the MSP scope either helped or hampered the ability to cope with complexity, and we discuss the theoretical and practical implications for MSPs addressing the SDGs. Many challenges to economic and social well-being require close collaboration between business, government, and civil-society actors. In this context, the involvement of multiple companies rather than a single company may enhance such cross-sector social partnerships’ outcomes. However, extant literature cautions about the tensions arising from companies’ competitive interests and the detrimental effects on the CSSP’s social outcome. Similarly, studies analyzing simultaneous collaboration and competition suggest shielding off competitive elements from the collaboration. Based on insights into two multi-company CSSPs, we conversely (...) find that government and NGO partnership managers deliberately leveraged competition through the CSSP design. They used similar segmentation mechanisms to enhance CSSP contributions, but differed in the way they integrated collaborative and competitive elements, leading to sustained corporate commitment in one CSSP and unmet promises in the other. These insights expose the paradoxical nature of coopetition at the interface of social and economic goals, and advance current research by indicating competition’s positive effects and the respective partnership design implications. On this basis, our study helps reveal and better understand sustainability-related tensions and opportunities at the inter-organizational level. (shrink)

The proliferation of public–private partnerships for development as an answer to many public challenges calls for careful evaluation. To this end, tailored frameworks are fundamental for helping understand the PPPs’ impact and for guiding corrective adjustment. Scholars have developed frameworks focusing on the partners’ relationships, the order of effects, and the distinction between outputs and outcomes. To capture a PPP’s complexity and multiple linkages with its environment, we argue that a thorough evaluation should adopt a stakeholder-oriented approach and consider the (...) costs and benefits that a PPP implies for them—especially as taxpayers’ money is involved. For this purpose, we build on a stakeholder-oriented evaluation framework from the nonprofit business partnership literature. In line with our broad evaluation conception, we extend it with the manifold ripple effects that PPPs for development have and include the time dimension for the links between different PPP stages and related outcomes to become clearer. Applying this framework to an illustrative case, we highlight important direct and especially indirect stakeholder outcomes, which a narrow evaluation would omit, point to the challenges involved in the evaluation endeavor, and identify interesting future research areas. Morals from Motives develops a virtue ethics inspired more by Hume and Hutcheson's moral sentimentalism than by recently-influential Aristotelianism. It argues that a reconfigured and expanded "morality of caring" can offer a general account of right and wrong action as well as social justice. Expanding the frontiers of ethics, it goes on to show how a motive-based "pure" virtue theory can also help us to understand the nature of human well-being and practical reason.

This book fills a gap in studies of meaning by providing detailed case studies of attested corpus data on the meanings of words and phrases.

Partnerships can play an important role in addressing environmental concerns and fostering environmental improvement. In this context, we argue that a more elaborate understanding is needed of how partners intend to reach beyond the partnership boundaries and target stakeholders at the firm, industry, supply-chain, or societal levels. As environmental improvement is intertwined with the process of change, we build on the theory of planned change to explain how the focus on selected partnership mechanisms may help partners anticipate and overcome barriers (...) when targeting environmental improvement at these different levels. We test our framework, using a sample of 566 environmental partnerships formed in the USA, and provide rich insights into how partners intend to reach beyond the partnership boundaries. From a practical perspective, these insights may inform corporate managers’ decision to configure environmental partnerships in terms of the target group and suitable partnership mechanism. From a theory perspective, the study helps develop a more systematic understanding of what partners intend to do and when partnerships may provide benefits in addressing level-specific change barriers. These insights provide a first step in positioning partnerships in the broader context of environmental change and encourage future research to move from the intentions to the actual outcomes. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

Michael Otsuka sets out to vindicate left-libertarianism, a political philosophy which combines stringent rights of control over one's own mind, body, and life with egalitarian rights of ownership of the world. Otsuka reclaims the ideas of John Locke from the libertarian Right, and shows how his Second Treatise of Government provides the theoretical foundations for a left-libertarianism which is both more libertarian and more egalitarian than the Kantian liberal theories of John Rawls and Thomas Nagel. Otsuka's libertarianism is founded (...) on a right of self-ownership. Here he is at one with 'right-wing' libertarians, such as Robert Nozick, in endorsing the highly anti-paternalistic and anti-moralistic implications of this right. But he parts company with these libertarians in so far as he argues that such a right is compatible with a fully egalitarian principle of equal opportunity for welfare. In embracing this principle, his own version of left-libertarianism is more strongly egalitarian than others which are currently well known. Otsuka argues that an account of legitimate political authority based upon the free consent of each is strengthened by the adoption of such an egalitarian principle. He defends a pluralistic, decentralized ideal of political society as a confederation of voluntary associations. Part I of Libertarianism without Inequality concerns the natural rights of property in oneself and the world. Part II considers the natural rights of punishment and self-defence that form the basis for the government's authority to legislate and punish. Part III explores the nature and limits of the powers of governments which are created by the consensual transfer of the natural rights of the governed. The guiding inspiration of this book is the attraction and distance that mark the relation between anthropology and philosophy. This dissertation abstract and the reflection commentary present the work done by Dr. Lea Stadtler. Comprising four articles, the dissertation explores the challenge of designing successful public–private partnerships for development and contributes to the discourse on partnerships and business engagement in society. Article I adopts the company perspective and develops a conceptual framework for interest alignment in PPPs for development. Based on a theoretical analysis, Article II examines the role that different structures play in handling common design challenges. Articles III (...) and IV are empirical: The former analyzes how partners cope with tensions occurring on the PPP’s boundaries, while Article IV explores the roles of broker organizations, which increasingly facilitate the partnering process of PPPs for development. We ordinarily suppose that there is a difference between having and failing to exercise a rational capacity on the one hand, and lacking a rational capacity altogether on the other. This is crucial for our allocations of responsibility. Someone who has but fails to exercise a capacity is responsible for their failure to exercise their capacity, whereas someone who lacks a capacity altogether is not. However, as Gary Watson pointed out in his seminal essay ’Skepticism about Weakness of Will’, the (...) idea of an unexercised capacity is much more difficult to make sense of than it initially appears. Eldred offers a remedy to the consequences of ancient Greek misconceptions of time that are also entrenched in today’s mathematized physics. Here time is spatialized as the one-dimensionally linear ‘arrow of time’ for the sake of predicting and controlling movement. But such spatialized time distorts the phenomenon of time itself. An alternative, hermeneutic-phenomenological path begins with a pre-spatial concept of time that is genuinely three-dimensional. This paves the way for recasting who we are as humans in belonging, first of all, (...) to the free openness of 3D-temporality. This belonging enables temporally 3D-vision of the psyche that empowers us to see movement at all and reconcile its inherent contradictoriness. We are then also able to conceive ourselves no longer merely as internally cogitating, self-conscious subjects, but as engaged existentially in temporally 3D-interplay, mutually estimating and esteeming who we are. This unpredictable interplay is constrained, however, by being played out in the sociating medium of thingified value, the accumulative movement of thingified value having gained the upper hand in dictating our life-movements as well as our interplay with the earth.
