En mettant en question l’utilisation par les colonisés de la langue des colonisateurs et en appelant au retour aux langues africaines, l’écrivain kényan Ngũgĩ wa Thiong’o a produit sans doute la critique la plus radicale et la plus audacieuse qui soit, de la colonisation de l’esprit. Cet article le met en conversation avec Karl Marx dans l'esprit de la pensée de Jane Anna Gordon sur la créolisation de la théorie politique.

Un texte n’existe que dans la mesure où il est lu et ses différentes lectures contribuent à en montrer la richesse et l’intérêt. En France on a longtemps lu et on continue encore à lire Fanon, en particulier Les damnés de la terre , à la lumière de la préface que Sartre avait rédigée, à la demande de Fanon lui-même, après une rencontre et d’intenses discussions entre les deux hommes au printemps 1961 à Rome. Le premier chapitre des Damnés de (...) la terre , intitulé “De la violence” avait été publié séparément dans les Temps Modernes , la revue dirigée par Jean-Paul Sartre, comme s’il s’agissait là de l’essentiel de ce livre. Il y a eu depuis beaucoup d’autres lectures de l’œuvre de Fanon, et en particulier de ce livre difficile et complexe. Je voudrais m’attacher, dans les pages qui vont suivre, à la lecture faite par Edward Said des textes de Fanon tout au long de sa carrière, à partir du moment, où, à la suite de la guerre de 1967 entre Israël et les pays arabes, et l’occupation de la Cisjordanie et de Gaza, ainsi que l’annexion de la partie Est de Jérusalem, Said va mêler intimement élaboration théorique et agir politique. Il est d’autant plus intéressant, d’un point de vue français, de porter attention à cette lecture, que Fanon aussi bien que Said, sont largement marginalisés dans le champ intellectuel et universitaire. Ils sont l’un et l’autre le symptôme d’une tache aveugle dans la pensée française dominante, peu encline à analyser le phénomène colonial. Il ne s’agit pas seulement des lacunes de l’histoire coloniale, qui commence tout juste à se développer. Le regard porté par Frantz Fanon sur la colonisation française en Algérie est difficilement supportable dans un pays qui se veut la “patrie des droits de l’Homme” et des valeurs universelles, tout comme la mise en évidence du racisme dans la France des années 1950. Ce qui semble encore davantage difficile à admettre, c’est que la domination coloniale puisse concerner aussi les catégories intellectuelles, les productions de l’imaginaire, et la construction des subjectivités. Lors de la parution, en 1980, de la traduction française d’ Orientalism , la levée de boucliers contre l’ouvrage fut telle qu’il fallut attendre vingt-cinq ans pour une nouvelle édition du livre qui était devenu introuvable. Entre temps Edward Said était mort, et sa notoriété internationale telle qu’il était impossible de continuer à faire comme si cet ouvrage avait cessé d’exister. On peut naïvement s’étonner d’une telle réaction, en face d’un livre dans lequel il est largement question d’écrivains et de savants français, et qui surtout a été écrit en partie dans le sillage intellectuel de Michel Foucault. Said avait cependant déjà pris, à cette époque, des distances avec la théorie foucaldienne, en s’appuyant sur d’autres théoriciens, au premier rang desquels Fanon. L’importance qu’il accordait à Fanon était antérieure. En effet, dans Beginnings , son premier ouvrage important de théorie littéraire, qui précédait Orientalism , Said avait déjà situé Fanon parmi ceux qui, avec Freud, Orwell, Lévi-Strauss et Foucault, avaient contribué à la production d’un “langage mental commun.&rdquo. The social sciences were founded at the height of the Euromodern era when the belief in infinite expansion coexisted with the willingness to enclose, categorize, and lock up a large part of humanity. The invention of the social sciences was closely linked to this enterprise of disciplinarization of spaces and of populations which accompanied the expansion of capitalism and colonial conquest. Stigmatized, dominated, and colonized groups were constituted as objects by social scientists who considered themselves as pure subjects, and concealed (...) the conditions under which they undertook their research and prohibited the colonized from expressing their own subjectivity. Colonization also imposed a binary cartography of the world and a geography of reason with obligatory references and strict disciplinary divisions. There are many ways to decolonize knowledge, but they remain marginal in a world where white male supremacy is also epistemological. The rejection of disciplinary decadence implies not only a critical but a metacritical gesture, and the refusal of the imperative of objectivation and non-engagement. (shrink)

The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

The authors problematize the notion of a European philosophical canon distinguished by "reason and rationality" in contrast to “religious Eastern (...) wisdom-traditions,” which are purportedly grounded in “faith.” These essays lay the groundwork needed to rethink dominant historical and conceptual categories from a wider global perspective to arrive at a deeper, more plural understanding of the diverse nature of both philosophy and religion. We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. This paper examines the relationship between beauty and aesthetic properties to argue that aesthetic properties are connected to a work’s content, to what a work conveys or expresses. I turn to Kant’s Critique of Judgement to make the case. My argument highlights two parts of Kant’s approach. Kant argues that pure aesthetic judgements of beauty are grounded in a harmonious yet free play of the imagination and understanding. Such free play is pleasurable and intimates that the power or capacity of (...) imagination is suitable for and can be brought within the conditions of the capacity for conceptual understanding. Within this broader frame, Kant’s account of artistic beauty specifies the relationship of aesthetic properties to the beauty of a work: aesthetic attributes help convey the aesthetic ideas that beautiful works express. I examine how Kant’s view helps us appreciate that aesthetic properties of artworks are integral to conveying the content of a work, and that the pleasure we feel has the potential to make us aware of the experience, its nature and value. Il se nourrit et accompagne les transformations sociales et culturelles qui touchent non (...) seulement les sociétés nationales, mais également l'espace mondialisé. Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. The Introduction provides an overview of Kendall Walton’s make-believe framework for a variety of representations and his arguments that such representations are dependent on their social or historical context. Walton argues that diverse representations involve our capacities for imagination and make-believe with props; they overlap with the fictional. Focusing on make-believe with props explains paradigmatic representational arts such as paintings and novels, theater and film. But this perspective reaches beyond the arts: it explains pictures and photographs in general not only (...) artistic ones; stories in general as well as literary and performing arts; music; metaphors, and even the claims we make about fictional entities and existence. The first section explains the main points of the make-believe framework in Mimesis as Make-Believe, and it reconstructs Walton’s argument in “Categories of Art” that some aesthetic properties depend on the perceptible and historical categories of art to which a work belongs. The second section outlines Walton’s specific proposals about literary fiction, fictional characters, poetry, pictures, photographs, music and negative existential claims. These explanations are integrated with summaries of the papers. The third section examines Walton’s implicit view of two much-discussed issues: the ontology of art and definitions of art. This discussion clears away some misunderstandings of Walton’s contextualism or historicism and relates Walton’s work to Arthur Danto’s and Frank Sibley’s. (shrink)

The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions. If artworks and their aesthetic properties stand in constitutive relationships to historical context and circumstances, so that some understanding of relevant facts is involved in responding to a work, what becomes of the intuitive view that we see artworks and at least some of their aesthetic properties? This question is raised by arguments in both aesthetics and art history for the historical nature of works of art. The paper argues that the answer needs to take philosophy of perception into account. (...) The principal development that has shaped philosophy of perception in the last thirty years—explaining perceptual experience in terms of contents that represent that such-and-such is the case—is directly relevant to key arguments for the historical nature of art because contents can represent complex kinds and properties. Conceptual realism is especially well-suited for explaining perception of artworks and aesthetic properties because it emphasizes that forms of understanding—in the sense of capacities, abilities and techniques—are involved in perceptual engagement with individual objects and instances of properties. To make this case, the paper examines influential arguments for the historical nature of art and aesthetic properties by Arthur C. Danto and Kendall L. Walton; and examines art-historical discussions by Michael Baxandall, Linda Nochlin and T. J. Clark. The paper argues that the aesthetic properties of an artwork depend on human intentional uses of properties, colours and contours among them, and such uses may themselves be aesthetic. The Wittgensteinian notion of use is contextual and historical, and uses are perceptible. (shrink)

This book examines how regulatory and liability mechanisms have impacted upon product safety decisions in the pharmaceutical and medical devices sectors in Europe, the USA and beyond since the 1950s. Thirty-five case studies illustrate the interplay between the regulatory regimes and litigation. Observations from medical practice have been the overwhelming means of identifying post-marketing safety issues. Drug and device safety decisions have increasingly been taken by public regulators and companies within the framework of the comprehensive regulatory structure that has developed (...) since the 1960s. In general product liability cases have not identified or defined safety issues, and function merely as compensation mechanisms. This is unsurprising as the thresholds for these two systems differ considerably; regulatory action can be triggered by the possibility a product is harmful, whereas establishing liability in litigation requires proving that the product was actually harmful.As litigation normally post-dates regulatory implementation, the 'private enforcement' of public law has generally not occurred in these sectors. This has profound implications for the design of sectoral regulatory and liability regimes, including associated features such as extended liability law, class actions and contingency fees. This book forms a major contribution to the academic debate on the comparative utility of regulatory and liability systems, on public versus private enforcement, and on mechanisms of behaviour control. Perceptual content involves determinate properties in a way that relies on our conceptual capacities no less than on the properties. The “richness” of perceptual experience is explained as a distinctive individual and property involving content. This position is developed in three steps: (i) novel phenomenological description of lived experience; (ii) detailed reconstruction of Gareth Evans’ proposal that we are capable of genuinely singular thought that (...) involves individuals under modes of presentation; (iii) re-consideration of the re-identification condition on conceptual contents. Beauty and the End of Art shows how a resurgence of interest in beauty and a sense of ending in Western art are challenging us to rethink art, beauty and their relationship. By arguing that Wittgenstein's later work and contemporary theory of perception offer just what we need for a unified approach to art and beauty, Sonia Sedivy provides new answers to these contemporary challenges. These new accounts also provide support for the Wittgensteinian realism and theory of perception that (...) make them possible. -/- Wittgenstein's subtle form of realism explains artworks in terms of norm governed practices that have their own varied constitutive norms and values. Wittgensteinian realism also suggests that diverse beauties become available and compelling in different cultural eras and bring a shared 'higher-order' value into view. With this framework in place, Sedivy argues that perception is a form of engagement with the world that draws on our conceptual capacities. This approach explains how perceptual experience and the perceptible presence of the world are of value, helping to account for the diversity of beauties that are available in different historical contexts and why the many faces of beauty allow us to experience the value of the world's perceptible presence. -/- Carefully examining contemporary debates about art, aesthetics and perception, Beauty and the End of Art presents an original approach. This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)

This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

This article argues that conceptual realism offers an important alternative to naïve realist, purely relational approaches with which ‘disjunctivism’ has come to be readily associated. I argue that John McDowell’s account of perception as both contentful and relational tends to go unnoted when the options for disjunctive theories are laid out. But McDowell’s approach is important because it comes up the middle between ‘intentional’ and ‘relational’ views of perception. In doing so, it offers theoretical resources for explaining perceptual experience and (...) its epistemic standing that purely relational views associated with naïve realism do not have. McDowell’s work opens a unified approach to perception and its epistemic potential that turns on the claim that it is contents and the broader context of capacities in which such contents figure that secure the perceiver’s relation to what she sees. I call views of this kind conceptual realism, though commonsense realism might be more apt. Following comparison of the explanations that conceptual and naïve realism can provide of various difficult scenarios, the paper concludes with an example of how conceptual realist theories might disagree or diverge from the detail of McDowell’s approach. My criticism draws on aesthetics to discuss experience of aesthetic properties. (shrink)

In recent years, the changing landscape for the conduct and assessment of research and of researchers has increased scrutiny of the reward systems of science. In this context, correcting the research record, including retractions, has gained attention and space in the publication system. One question is the possible influence of retractions on the careers of scientists. It might be assessed, for example, through citation patterns or productivity rates for authors who have had one or more retractions. This is an emerging (...) issue today, with growing discussions in the research community about impact. We have explored the influence of retractions on grant review criteria. Here, we present results of a qualitative study exploring the views of a group of six representatives of funding agencies from different countries and of a follow-up survey of 224 reviewers in the US. These reviewers have served on panels for the National Science Foundation, the National Institutes of Health, and/or a few other agencies. We collected their perceptions about the influence of self-correction of the literature and of retractions on grant decisions. Our results suggest that correcting the research record, for honest error or misconduct, is perceived as an important mechanism to strengthen the reliability of science, among most respondents. However, retractions and self-correcting the literature at large are not factors influencing grant review, and dealing with retractions in reviewing grants is an open question for funders. (shrink)

The context-based use of terminology and phraseology is one of the essential building blocks of legal translation. The contextual nature of both components has implications when it comes to designing resources that are adapted to the needs of translators. For Arabic legal translation, there are a multitude of different print and online resources available, however, they do not integrate the context-related parameter for term choice acceptability. In this article, we will describe the main features of certain bilingual legal dictionaries with (...) the English-Arabic and French-Arabic language pairs. We will then make a descriptive assessment of the tools available online, highlighting their limitations. Taking into consideration all the contextual parameters involved in making a translation choice, we will put forward the value of developing bilingual ontologies with Arabic. With the rapid expansion of information technologies, a move towards formalizing legal knowledge will help fill existing gaps in the representation of Arabic legal content and the retrieval of information, providing legal translators with a tool that provides specific details that will enable translators to make informed and relevant decisions, in addition to opening new research perspectives for Arabic legal translation. This article offers a detailed textual reexamination of the ‘family resemblance’ passages to reconsider their implications for understanding art. The reassessment takes into account their broader context in the Philosophical Investigations, including the rule following considerations, and draws on a realist interpretive framework associated principally with the work of Cavell, Diamond, McDowell, and Putnam. Wittgensteinian “realism with a human face” helps us discern that the primary issue is not whether certain concepts are definable, posing a stark opposition between essentialism and (...) its denial about kinds such as language or games. What is at issue is keeping uses of language in view in their variety and their broader life contexts. Focus on rules suggests more broadly that norms and values inhere in practices and play a constitutive role in determining the entities integral to those practices. From this perspective, a Wittgensteinian framework explains art as locally overlapping practices, each with their own constitutive norms and values for the works integral to them. What makes something art has normative force specific to a practice. This recognizes the historically contingent nature of art practices in a way that relational definitions or disjunctive ‘cluster’ explanations do not. (shrink)

The idea of nonconceptual contents proposes that there are mental contents at the level of the experiencing person that are individuated independently of ‘anything to do with the mind.’ Such contents are posited to meet a variety of theoretical and explanatory needs concerning concepts and conceptual mental contents which are individuated in terms having to do with the mind. So to examine the idea of nonconceptual content we need to examine whether we really need to posit such content and whether (...) there is a coherent, viable way of doing so. I will examine the idea of nonconceptual contents by considering Christopher Peacocke's attempt, in his Study of Concepts, to posit such contents.Three principal kinds of considerations motivate positing non-conceptual content: epistemological, phenomenological, and explanatory-psychological. A theory of knowledge might posit nonconceptual content in order to show that our experience contains the justificatory base for empirical thought as its own proper part. Non-conceptual content might also be posited in order to account for the finely detailed or determinate phenomenological character of perceptual experience. (shrink)
