This book examines how regulatory and liability mechanisms have impacted upon product safety decisions in the pharmaceutical and medical devices sectors in Europe, the USA and beyond since the 1950s. Thirty-five case studies illustrate the interplay between the regulatory regimes and litigation. Observations from medical practice have been the overwhelming means of identifying post-marketing safety issues. Drug and device safety decisions have increasingly been taken by public regulators and companies within the framework of the comprehensive regulatory structure that has developed (...) since the 1960s. In general product liability cases have not identified or defined safety issues, and function merely as compensation mechanisms. This is unsurprising as the thresholds for these two systems differ considerably; regulatory action can be triggered by the possibility a product is harmful, whereas establishing liability in litigation requires proving that the product was actually harmful.As litigation normally post-dates regulatory implementation, the 'private enforcement' of public law has generally not occurred in these sectors. This has profound implications for the design of sectoral regulatory and liability regimes, including associated features such as extended liability law, class actions and contingency fees. This book forms a major contribution to the academic debate on the comparative utility of regulatory and liability systems, on public versus private enforcement, and on mechanisms of behaviour control. Since the 1980s, there has been a steady growth of interest in the psychological mechanisms that regulate normal emotional experience. In this same period, cognitive-experimental researchers have sought to delineate the information processing biases that characterize emotional disorders. Exciting potential synergies exist between these two areas of investigation. In this article, we consider ways in which reciprocal benefits could be gained by the constructive transfer of theoretical ideas and methodological approaches between emotion regulation researchers and cognitive-experimental investigators. We also discuss (...) how recent innovations within each field can profitably impact upon progress within the other. It is concluded that the overlap in conceptual constructs, and the convergence of complementary investigative techniques, between these two research domains, provide opportunities for creative synthesis that could significantly enrich understanding of normal and abnormal emotion across future years. In this article we argue for the importance of studying interdisciplinary collaborations by focusing on the role that good choice and design of model-building frameworks and strategies can play overcoming the inherent difficulties of collaborative research. We provide an empirical study of particular collaborations between economists and ecologists in resource economics. We discuss various features of how models are put together for interdisciplinary collaboration in these cases and show how the use of a coupled-model framework in this case to coordinate (...) and combine background models from ecology and economics provided particular collaborative affordances and clear collaborative gain. This chapter begins with an overview of John Rawls's four‐stage sequence account of how to apply justice as fairness to institutions. It focuses on the facets of institutional design: (i) How should basic democratic institutions and processes be structured so as to realize the fair value of the basic political liberties? (ii) What kinds of educational and health institutions are needed to secure fair equality of opportunity? (iii) How do principles of justice apply to the family? (iv) What implications does (...) the difference principle have for the structure of a market economy? Rawls's extension of the original position via the four‐stage sequence proceeds against the background of three kinds of pluralism. The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. With a focus on Asian philosophical traditions, this book examines varieties of philosophical thought and self-transformative practice that do not fit neatly on one side or another of the standard Western division between philosophy and religion. It contains chapters by experts on Buddhist, Confucian, Taoist, Upaniṣadic and Jain philosophies, as well as ancient Greek philosophy and recent contemplative and spiritual movements. The authors problematize the notion of a European philosophical canon distinguished by "reason and rationality" in contrast to “religious Eastern (...) wisdom-traditions,” which are purportedly grounded in “faith.” These essays lay the groundwork needed to rethink dominant historical and conceptual categories from a wider global perspective to arrive at a deeper, more plural understanding of the diverse nature of both philosophy and religion. En novembre 1984, Christa Wolf ouvrait la première conférence de l'association des gynécologues psy-chosomaticiens de RDA réunis à Mag-Debourg. Dans son discours intitulé "Maladie et privation d'amour", elle s'interrogeait sur l'évolution de la médecine moderne dont les progrès en matière d'appareils médicaux éloignaient toujours davantage les praticiens de leurs patients. Par-delà son regard sur la relation entre l'âme et le corps, Christa Wolf informait aussi des attentes des femmes qui avaient pris au mot les promesses d'égalité des sexes en régime (...) "socialiste réel". Quelques années plus tôt Georges Canguilhem, résistant au scientisme triomphant, se proposait de continuer à penser la médecine comme un art qui devait s'adapter à chaque individu malade. Déplorant la disparition progressive de la clinique, il plaidait pour un dialogue continu entre le patient et le médecin Tandis que Sonia Combe s'appuie sur le discours de Christa Wolf pour appréhender l'expérience communiste à partir de l'étude de genre, revenant sur la double leçon de Christa Wolf et de Canguilhem, Antoine Spire se demande dans quelles conditions un retour de la médecine à la pratique clinique pourrait se faire et répondre à la demande des malades. The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions. Dans les sociétés démocratiques, le droit est le texte où s'écrivent nos croyances fondatrices : croyances en une signification de l'être humain, croyances dans la force des lois et l'empire de la justice, croyances dans les valeurs sociales de l'Interdit. Le droit impose donc un sens commun qui permet aux individus de se lier entre eux et de vivre ensemble, il fonctionne aussi comme une vérité du moment. Il se nourrit et accompagne les transformations sociales et culturelles qui touchent non (...) seulement les sociétés nationales, mais également l'espace mondialisé. Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. Ce mouvement de juridicisation du social et du politique se traduit non seulement par une prolifération et une diversification de la règle de droit, mais également par un processus parallèle de judiciarisation qui voit un certain nombre de problèmes être traités par l'institution judiciaire (politiques de santé, de sécurité, phénomènes de criminalité internationale, etc.). Entrons-nous dans un nouvel âge du droit? Ces nouvelles interactions entre la société et le droit inaugurent-elles l'ère d'une future démocratie juridique? We lay groundwork for applying ethnographic methods in philosophy of science. We frame our analysis in terms of two tasks: to identify the benefits of an ethnographic approach in philosophy of science and to structure an ethnographic approach for philosophical investigation best adapted to provide information relevant to philosophical interests and epistemic values. To this end, we advocate for a purpose-guided form of cognitive ethnography that mediates between the explanatory and normative interests of philosophy of science, while maintaining openness and (...) independence when framing such an investigation to achieve robust unbiased results. Some say that public policy can be made without the benefit of theory--that it emerges, instead, through trial-and-error. Others see genuine philosophical issues in public affairs but try to resolve them through fanciful examples. Both, argues Robert E. Goodin, are wrong. Goodin--a political scientist who is also an associate editor of Ethics--shows that empirical and ethical theory can and should guide policy. To be useful, however, these philosophical discussions of public affairs must draw upon actual policy experiences rather than contrived (...) cases. Further, they must reflect the broader social consequences of policies rather than just the dilemmas of personal conscience. Effectively integrating the literatures of social science, policy science, and philosophy, Goodin provides a theoretically sophisticated yet empirically well-grounded analysis of public policies, the principles underlying them, the institutions shaping them, and the excuses offered for their failures. This analysis is enhanced by the author's discussion of such specific cases as the disposal of nuclear wastes and the priority accorded national defense--cases that illustrate Goodin's theoretical and methodological framework for approaching policy issues. This article explores the themes of trust and ethical conduct in social research, with particular attention to the trust that can develop between the members of a research team as well as between researchers and the researched. The authors draw upon a three-year empirical study of destinations and outcomes for young people excluded from alternative educational provision. They also make reference to a contemporary exposition of Aristotle's writing on friendship in order to explore two sets of relevant distinctions that have (...) a bearing upon our understanding of relationships that emerge in the context of social research projects. These distinctions are between impartiality and selectivity on the one hand, and between universality and particularity on the other. The authors attempt to demonstrate that these distinctions influence the development of trust and the conduct of ethical research, arguing that the latter is not synonymous with compliance to ethical guidelines. This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)

It is perhaps unnecessary to defend the principle that mythical exempla in ancient poetry are not merely decorative, but serve in the expression of ‘significant emotion’ it would still be welcome to see it more frequently and more coherently applied. This paper tries to isolate one characteristic use of myth in four poems from Hellenistic and Roman authors; the last section summarizes its conclusions and briefly sets them in a context of literary history.

This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)
