In this paper, I sketch a Kantian account of duties of rescue, which I take to be compatible with Kant’s theory. I argue that there is in fact no “trumping relation” between imperfect and perfect duties but merely that “latitude shrinks away” in certain circumstances. Against possible demandingness objections, I explain why Kant thought that imperfect duty must allow latitude for choice and argue that we must understand the necessary space for pursuing one’s own happiness as entailed by Kant’s justification (...) of one’s duty to promote other’s happiness. Nevertheless, becoming worthy of happiness has always priority over one’s own happiness, even when circumstances are such that we cannot secure our own happiness without seriously neglecting more pressing needs of other persons. I conclude that Kant’s moral theory calls for complementation by the political and juridical domain. Implementing just political institutions and creating satisfactorily well-ordered societies create an external world which is friendlier to our attempts to reconcile moral integrity and a happy human life. In this paper, I analyze the least discussed of Kant’s four examples of duty in the first section of his Groundwork to the Metaphysics of Morals: the gout sufferer who is no longer motivated by natural interest in his long-term wellbeing, and is thus in a unique position to secure his own happiness from duty. This example has long been wrongly interpreted as a failure of prudential rationality, as recently illustrated by Allen Wood’s reading of that example. -/- I argue (...) that the gout sufferer example is meant to illustrate a violation of a duty to the self and should not be confused with mere prudential failure. The example also helps us understand the line between prudential reason and duties to the self. I show that given Kant’s conception of happiness as an indeterminate concept and his hedonistic account of non-moral ends, it can sometimes be more rational from the perspective of empirical practical reason to choose short term over long-term wellbeing when long term wellbeing seems uncertain in regard to expected pleasure. In other words: Kant’s account of empirical practical reason does not rule out as irrational choosing short term pleasure at the expense of long-term wellbeing. However, this is precisely why the gout sufferer’s long-term happiness can be directly morally required and so becomes the content of a duty to the self. To explain how there can be a direct duty to promote our own happiness under certain circumstances I also elucidate Kant’s distinction between direct and indirect duties. (shrink)

En este artículo, sostendré que Kant no sólo propuso una versión secular de la posesión común de la tierra, sino que también se diferenció de forma radical de la concepción iusnaturalista de sus predecesores. Propongo que la revisión kantiana del derecho cosmopolita se dirige al mismo problema que el derecho de necesidad de Grocio, a saber, la implausibilidad de asumir derechos adquiridos absolutos cuando (...) esto contradice la razón por la que se introducen esos mismos derechos. Sin embargo, mientras que Grocio pretendió excusar violaciones de la propiedad privada en casos de necesidad, Kant limitó su discusión al derecho de rechazar la entrada de personas en un territorio. Muestro que para Kant, negar la ocupación del espacio que puede salvar la vida a otro ser humano que está, en principio, tan legitimado como cualquier otro a tener un derecho en la tierra está en contradicción con la justificación misma del derecho territorial de los Estados. Esto se debe a que el permiso para controlar el territorio y el derecho de los visitantes involuntarios a ser admitidos en una región están basados en el mismo fundamento legal o Rechtsgrund, a saber, la comunidad original de la tierra. This book analyses Kant’s assumptions about happiness and the implications they have for his moral, political, and legal thought. It provides a “map” of the different areas in which the concept of happiness appears in his practical philosophy and examines how it relates to the main themes of his practical philosophy.

ABSTRACTDid Kant believe we need a world government? It has been a matter of controversy in Kant scholarship whether Kant endorsed the creation of a world state or merely a voluntary federation of states with no coercive power. I argue that Kant's main concern was with a global juridical condition, which he regarded as a rational requirement given the equal freedom and equality of individuals. However, he recognized that implementing this rational ideal requires sensitivity to contingent aspects of world politics. (...) I will argue that Kant offers an ideal theory not disentangled from realist considerations and that he adopts what I will call methodological realism: the attempt to realize the requirements of Right in a world governed by its own laws and mechanisms. I will illustrate this interpretation with Kant's discussion of the right of nations. The confusion in regard to Kant's actual position on the matter, I will argue, is a direct consequence of Kant's methodological realism. The... (shrink)

This paper explores the alleged role of a conception of human nature for Kant’s justification of the duty to leave the state of nature and the related right to coerce others to enter the civil condition in the Doctrine of Right (1797). I criticise the interpretation put forward by Byrd and Hruschka, according to which Kant’s postulate of public right is a preventive measure based on a “presumption of badness” of human beings. Although this reading seems to be supported by (...) § 42 of the Doctrine of Right, I shall argue that the paragraph neither offers a justification of why we have a duty to leave the state of nature, nor explains why individuals are allowed to coerce others to do so. I offer an alternative interpretation of § 42 by focusing on the difference between formal and material violations of right and argue that the rationale behind the postulate of public right is the idea that remaining in the state of nature is a formal violation of the concept of right. It is therefore not prudential reason that authorizes us to coerce others to enter the lawful condition. (shrink)

This doctoral thesis analyzes the systematic role of Kant’s conception of happiness in his moral, legal and political theory. Although many of his conclusions and arguments are directly or indirectly influenced by his conception of human happiness, Kant’s underlying assumptions are rarely overtly discussed or given much detail in his works. Kant also provides different and apparently incompatible definitions of happiness. This research explores the domains of Kant’s practical philosophy in which his conception of happiness plays a systematic role: the (...) relation between the natural need of human beings to pursue happiness and the ends-oriented structure of the human will; Kant’s anti-eudaimonism in ethical theory; Kant’s claim that we have an indirect duty to promote our own happiness and the problem that under certain circumstances, the indeterminacy of happiness makes it not irrational to choose short term satisfaction at the costs of one’s overall, long term happiness, given Kant’s conception of non-moral choice as expectation of pleasure; Kant’s justification of the duty to adopt the happiness of others as our ends and the latitude and eventual demandingness of this duty; finally, since Kant also subsumes subsistence needs and welfare under the concept of happiness of individuals, I also engage with the question of state provision for the poor in the Kantian Rechtsstaat and explore Kant’s conception of equity or fairness as an alternative to the traditional minimalist and the welfare interpretations of the Kantian state. In this paper, I provide an interpretation of the latitude of wide duties by analyzing Kant’s reinterpretation of Horace’s adage insani sapiens nomen habeat; aequus iniqui - ultra quam satis est virtutem si petat ipsam (the wise man has the name of being a fool, the just man of being iniquitous, if he seeks virtue beyond what is sufficient”, MS VI: 404n., 409 and 433n) and his criticism of Aristotle’s doctrine of the mean. In support of my interpretation I also (...) analyze Kant’s distinction between lying and reticence in his correspondence with Maria von Herbert and between openheartedness and reticence in the Religion. I argue that since there is no upper limit to the extent we may realize moral ends it may be morally permissible to take one’s prudential considerations into account when deciding how to comply with wide duties. In contrast, the deliberate disregard of one’s permissible prudential interests may reflect what Kant calls a fantastic conception of virtue, according to which agents vainly believe that they can completely achieve virtue in this life. I call attention to the fact that for Kant the wise (sapiens) is also a prudens, a person who does not think fantastically in matters of virtue and consequently does not attempt to “maximize virtue” at the expense of one’s permissible prudential interests as a finite being. Kant is probably one of the most misunderstood philosophers in the history of Western thought. Some of the most well-known and pervasive objections to Kant’s practical philosophy often rest on considerable misunderstandings of his central theses or a poor and superficial reading of his work. A common misconception is that in Kant’s practical philosophy there is no place or role for human happiness. In Happiness in Kant’s Practical Philosophy: Morality, Indirect Duties, and Welfare Rights, Alice Pinheiro Walla (...) dispels this misunderstanding by elucidating Kant’s conception of happiness (understood in broadly hedonist terms) and showing that, for Kant, the pursuit of happiness plays an important role in our personal and collective lives. This means that, far from endorsing an ascetic ideal of the moral agent, as it is commonly thought, Kant’s system embraces an ideal of the human life in which there is significant space, and even a duty, to pursue pleasurable endeavours. Somehow surprisingly, in Pinheiro Walla’s reading, Kant’s ethics is arguably less demanding than standard interpretations of Aristotelian and Utilitarian ethical theories. (shrink)

Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy. Le Moyen âge par ses images é um dos mais felizes exemplos de como investigação crítica, método e interpretação podem amalgamar-se para produzir uma obra referencial carregada de valor histórico. Talvez, se dispostos isoladamente, tais elementos não provocariam o impacto no leitor, altamente proveitoso quando se pensa o conjunto do livro. A História torna-se arte, em sua plenitude, pelo encantamento que se processa em escritas como essa. Isso ocorre porque a obra de Chiara Frugoni, respeitada medievalista italiana, inova ao confrontar (...) narrativas imagéticas relacionando-as com o simbólico, o metafórico e o místico. Essa escolha metodológica é facilmente explicável: para se compreender a imagem medieval, torna-se fundamental investigar suas dimensões ideológicas, seus significados culturais e suas funções estéticas. Apenas assim, defende Frugoni, poder-se-ia projetar uma análise histórica que, agregando saberes entrelaçados, se desdobra automaticamente em temas como imaginário coletivo, formas de devoção e práticas religiosas. Lawami' al-Nazar fi Tahqiq Ma'ani al-Mukhtasar is Aḥmad b. Ya'qub al-Wallali's (d. 1128/1716) commentary on al-Sanusi's (d. 895/1490) compendium of logic, al-Mukhtasar. Al-Wallali was the first commentator on al-Sanusi's compendium after the author's autocommentary. In this publication, Ibrahim Safri offers a critical edition of this work, together with a study of the author's life and oeuvre. Safri also tries to show the indirect influence of Avicennism on logic in the Maghribi tradition in the seventeenth and eighteenth centuries. On the basis (...) of his writings on logic and philosophical theology, al-Wallali was considered a master of rational sciences by his contemporaries. (shrink)

In this paper, we recover the idea cast by Graham Priest to our ears in 2000: That it was possible to experience Ontological Paraconsistency in life. He had, back then, as a translation of his thinking, a painting by Escher: The stairs could be going up or down, and one could not tell where they were going by simply examining the painting. The most obvious argument as to why that was not an instance of Ontological Paraconsistency found in reality was (...) that the perspective from which you would have to stare at the painting to see something different would be different too, so that it was impossible that we were getting up and down at the same time, that is, from the same perspective. That would happen with anything we picked in this world. We recently found something that does not entirely belong to this world, however, something that could finally satisfy the requirements of Priest, and therefore prove to us that there is a place for Ontological Paraconsistency. We observe that the paraconsistent robot, Emmy (Abe et al., 2006), is an application of the Non-ontological Paraconsistency, which we always believed to be passive of existence, but we here talk about another type of paraconsistency, which would be intrinsic to the being. The purpose of this paper is then providing a definite answer to the questions: Is there any real life instance of Ontological Paraconsistency? Is Ontological Paraconsistency a useful concept in terms of logical theories? (shrink)

Those who wish to defend the role of aesthetic values in science face a dilemma: Either aesthetic language is used metaphorically for what are ultimately epistemic features, or aesthetic language is used literally but it is difficult to see the importance of such values in science. I introduce a new account that gets around this problem by looking to an overlooked source of aesthetic value in science: the relation between form and content. I argue that a fit between the content (...) of a thought experiment, and the way in which that content is formulated, can have important epistemic pay offs through contributing to scientific understanding. Is there a role for aesthetic judgements in science? One aspect of scientific practice, the use of thought experiments, has a clear aesthetic dimension. Thought experiments are creatively produced artefacts that are designed to engage the imagination. Comparisons have been made between scientific (and philosophical) thought experiments and other aesthetically appreciated objects. In particular, thought experiments are said to share qualities with literary fiction as they invite us to imagine a fictional scenario and often have a narrative form (Elgin 2014). (...) But philosophical discussions of aesthetics in science have focused mainly on the epistemic role of beauty and elegance when it comes to theories and mathematical proofs, and thought experiments have been widely overlooked. My aim in this chapter is to address how the aesthetic choices scientists make in the design of a thought experiment contribute to its function: to communicate, convince, or explain a theory or phenomenon. A key issue is whether any aesthetic features in science provide anything beyond catching our attention, or are at best, a mere heuristic aid. I respond to accounts that argue this way and show how formulation is important in scientific thought experiments and, similarly to literary fictions, there is more than one way of interpreting a thought experiment scenario. I end by considering which literary examples are most appropriate when making comparisons with thought experiments. As a result, the difference between representations in art and science raised in current discussions is not as stark as it has been made out to be, and science is a more heterogeneous practice than has been allowed. Historically left to the margins, the topics of imagination and creativity have gained prominence in philosophy of science, challenging the once dominant distinction between ‘context of discovery’ and ‘context of justification’. The aim of this chapter is to explore imagination and creativity starting from issues within contemporary philosophy of science, making connections to these topics in other domains along the way. It discusses the recent literature on the role of imagination in models and thought experiments, and their comparison with fictions. (...) It then turns to the importance of constraints on imaginings in the scientific domain, as well as whether constraints can hinder creativity. The second part of the paper focuses on the social dimensions of science. It considers imagination and creativity of scientific communities, asks whether the institution of science promotes creativity (and whether we want it to) or if it encourages conservativeness, and ends with a reflection on the politics of imagination and creativity in science. While the influence of emotion on individuals'' ethical decisions has been identified by numerous researchers, little is known about how emotions influence individuals'' ethical decision process. Thus, it is not clear whether different emotions promote and/or discourage ethical decision-making in the workplace. To address this gap, this paper develops a model that illustrates how emotion affects the components of individuals'' ethical decision-making process. The model is developed by integrating research findings that consider the two dimensions of emotion, arousal and feeling (...) state, into an applied cognitive-developmental perspective on the process of ethical decision-making. The model demonstrates that certain emotional states influence the individual''s propensity to identify ethical dilemmas, facilitate the formation of the individual''s prescriptive judgments at sophisticated levels of moral development, lead to ethical decision choices that are consistent with the individual''s prescriptive judgements, and promote the individual''s compliance with his or her ethical decision choices. In particular, the model suggests that individuals experiencing arousal and positive affect resolve ethical dilemmas in a manner consistent with more sophisticated cognitive moral structures. This paper surveys the current field, including the changing attitudes towards the scientific imagination, the fiction view of models, how the imagination can lead to knowledge and understanding, and the value of different types of imagination. Graham Wallas (31 May 1858 - 9 August 1932) was an English socialist, social psychologist, educationalist, a leader of the Fabian Society and a co-founder of the London School of EconomicsWallas joined the Fabian Society in April 1886, following his acquaintances Sidney Webb and George Bernard Shaw. He was to resign in 1904 in protest at Fabian support for Joseph Chamberlain's tariff policy.Wallas argued in Great Society (1914) that a social-psychological analysis could explain the problems created by the impact of (...) the industrial revolution on modern society. Bien común y ciudadanía en una era emotivista: la política identitaria como vector de crisis y renovación del debate público Este artículo analiza los conceptos de ciudadanía y bien común, considerando la crisis del debate público provocada, entre otras causas, por una distorsión de las políticas identitarias, en el contexto del emotivismo moral moderno. Para ello, este trabajo adopta la metodología de la revisión bibliográfica para desarrollar un análisis teórico de conceptos centrales de la filosofía práctica contemporánea, abarcando diversas referencias, (...) como MacIntyre, Lilla, Taylor, Finnis, Sandel y Kymlicka. Tras presentar el diagnóstico de MacIntyre sobre el ethos emotivista moderno como factor de insolubilidad de las controversias morales y la crítica de Lilla a la despolitización causada por el atomismo de las políticas identitarias, se estudian las condiciones para la rehabilitación teórica de los conceptos de ciudadanía y bien común, a partir de una ética aristotélica y comunitaria relativa a la razón práctica, en virtud de la cual la amistad cívica es relevante para equilibrar las diferencias dentro de una unidad política mayor. La conclusión es que las políticas de identidad pueden salvaguardarse si se ponderan con el concepto de bien común, para así superar las contradicciones emotivistas del debate público. (shrink)

Although machine intelligence is increasingly employed in healthcare, the realm of decision-making in medical ethics remains largely unexplored from a technical perspective. We propose an approach based on fuzzy cognitive maps (FCMs), which builds on Beauchamp and Childress’ prima-facie principles. The FCM’s weights are optimized using a genetic algorithm to provide recommendations regarding the initiation, continuation, or withdrawal of medical treatment. The resulting model approximates the answers provided by our team of medical ethicists fairly well and offers a high degree (...) of interpretability. The Triple Helix is a global model originating in developed economies but less developed countries have also made attempts to implement it into their national contexts. Meanwhile, the national context can be characterised by means-ends decoupling at the state level which implies that policies and practices of the state are disconnected from its core goal of creating public welfare. It refers to the oligarchic economies in which the state is captured by exploitative, rent-seeking oligarchies in business and politics. Ukraine is (...) an example of such a country. Thus, the research question is: how did means-ends decoupling at the state level affect the implementation of the Triple Helix model in Ukraine? To answer this question, we employed both rational choice institutionalism and sociological institutionalism. The data emanate from interviews with the senior managers of four universities and science parks established within them. The findings reveal that means-ends decoupling at the state level, caused by the rent-seeking behaviour of business and political oligarchies, led to the implementation of the Triple Helix model in Ukraine also reflecting a case of means-ends decoupling. The greater the institutional complexity experienced by the science park and the more the senior managers of the university and the science park maintain a logic of confidence in practices that deviate from the Triple Helix model, the greater rent-seeking and means-ends decoupling at the organisational level. Both rent-seeking and means-ends decoupling were found to not only hinder economic growth but also result in a diversion of human intellectual capital. (shrink)

The progression of research and scholarly inquiry does not occur in isolation and is wholly dependent on accurate reporting of methods and results, and successful replication of prior work. Without mechanisms to correct the literature, much time and money is wasted on research based on a crumbling foundation. These guidelines serve to outline the respective responsibilities of researchers, institutions, agencies, and publishers or editors in maintaining the integrity of the research record.
